SYNOPSIS BA -4-05 -Modify TH Zoning requirements with intent of constructing single-family residence on a ±8,000 square foot parcel CALL TO ORDER Chairwoman Gardner called the meeting to order at 7:00 p.m. ROLL CALL Board Members Present:Chairwoman Mari Gardner Board Member Carol Urich Board Member Sandra Spelman Board Member Lori D'Amico Board Member Daniel Austin Vacancy Board Members Absent:'Board Member Jane Jones Staff Present:,City Attorney Joel Stern Senior Planner/Zoning Administrator Rudy Esquivias ACCEPTANCE OF AGENDA BOARD MEMBERS SPELMAN/URICH M/S "I MOVE FOR THE APPROVAL OF THE AGENDA." BOARD OF ADJUSTMENT AND APPEALS JANUARY 9,2006 PAGE 1 OF 4 MOTION CARRIED VOTE 5-0 PUBLIC HEARINGS BA -4-05 .Modify TH Zoning requirements Chairwoman Gardner announced that this is a request by Robert Schaefer and Ann Arseneault to modify the TH (Trailer Homesite)Zoning District requirements. We have a request by staff to continue this case until February 13,2006. Senior Planner/Zoning Administrator Rudy Esquivias reported that staff is asking for a continuance of the case.The case was advertised and by law we are supposed to notify all property owners within 300 feet of the property and the applicant by mail.The letters did not get sent out.The case was previously being handled by our former planner who has left the City and there was a miscommunication.I spoke with the applicant and advised that we had to continue the case until the 13th.The applicant was very understanding.We request that you continue this case. Chairwoman Gardner called for a motion to continue Case BA -4-05. BOARD MEMBER AUSTIN/SPELMAN M/S "I MOVE THAT WE POSTPONE CASE BA -4-05 AND CONTINUE IT AT OUR NEXT BOARD MEETING ON FEBRUARY 13,2006." MOTION CARRIED VOTE 5-0 OLD BUSINESS None NEW BUSINESS None REQUEST OF STAFF None EXECUTIVE SECRETARY INFORMATION AND REPORTS BOARD OF ADJUSTMENT AND APPEALS JANUARY 9,2006 PAGE 2 OF 4 Senior Planner/Zoning Administrator Rudy Esquivias reported on the Shell sign. Both the business proprietor and the property owner/Shell Oil Company is ignoring us.A letter was sent out advising the business owners of the issue with the sign giving them a certain amount of time to remove the sign or come into compliance.Originally they were talking with us and coming in and finding out what the issues were.They finally stopped communicating.I talked with the City Attorney and spoke with the Code officers.The next step would be to fill out a complaint and site them and hand i t over to the City Prosecutor's office.We have talked about using a process server on the applicant and the property owner to see if we can get any results that way. They are being non -responsive.They don't want to move their sign.We have talked to them about alternative places to'Out the sign and also putting signs up on the canopy.They are not responding to anything.We had spoken to Mr. Musser when they were asking for a variance and they told us they were looking into the possibility of doing that.I t looks like we are going to have to take this one to court. Mr.Esquivias reported on the resignation of Steve Abraham.Associate Planner. He has moved on to Pinal County Planning Department as a Senior Planner.We have had interviews and offered a position to one individual.We also have two Planning Interns on board assisting us. Mr.Esquivias wanted to thank the individuals that were able to attend the Boards and Commissions Workshop.Information received was very informative and will be incorporated into new member packets.
