SYNOPSIS:
Agenda for May 9, 1988 approved as submitted.
Minutes for April 11, 1988 approved as submitted.
BA-5-88 approved.
1. Roll Call six members present with one absent. (Mrs. Lynch
arrived after the agenda and minutes were approved. )
2. Chairman asked for a motion to accept the May 9, 1988 agenda.

May 9, 1988."
Motion passed 5-0-0.
4. Chairman asked for a motion to accept the April 11, 1988
minutes.
5. Blatterspiel/Pfeifer M/S "I make a motion we accept the minutes dated
April 11, 1988, as presented to us. "
Motion passed 5-0-0.
6. Chairman opened BA-5-88 to the public and asked for staff
briefing.

7. Mr. Dunn briefed the Board on BA-5-88, a request by Leroy C.
and Nancy Lyon for a Temporary Use Permit to allow
the use of a travel trailer as a dwelling unit on
their property located at 361 South Royal Palm Road.
8. Chairman asked Board if they had any questions of staff.
There were none.
He asked if the applicant were present and cared to
address the Board.
9. Nancy Lyon added there was one correction to the chronology
shown. She stated the unit was not installed until
January 4, 1986. They purchased the land on
September 7, 1985, and the ordinance was passed
September 17, 1985. They did not check with the
city regarding any changes and how these might
affect their situation.
10. Board asked Mrs. Lyon if she understood information
received from the Building Department regarding the
mobile home being in noncompliance and if she had
contacted them regarding this.
11. Nancy Lyon replied she did not. She had become upset when the
Building Department called the unit a "travel
trailer" because it had been sold to them as a "park
model mobile home. "
12. Board asked applicants if they anticipated being finan-
cially able to put a mobile home on the lot within
the next nine months.
13. Nancy Lyon answered she thought they would.
14. Board asked what the term "park model " meant to her.
15. Nancy Lyon interpreted a travel trailer as being a self-
contained unit, which this one is not. It has to be
hooked up to utilities.
16. Board asked staff what was the minimum size for a mobile
home.
17. Mr. Newcomer explained the definition of a mobile or manufactured
home comes from the Department of Housing and Urban
Development. He further explained why the appli-
cants ' unit is classified as a travel trailer.

18. Board asked the applicants if they had a title to the unit
and how this read.
19. Nancy Lyon answered their title said "travel trailer. "
20. Chairman asked the applicants if they were aware they would
have to get a mobile home to place on the property
even if they received the Temporary Use Permit.
They assured him they were.
He asked if anyone else wished to speak in favor of
the applicants.
21. Fred Cicco is a property owner near the Lyon 's and stated he is
in favor of the permit being granted.
22. Chairman asked if there were any others who wished to favor
the application. There were none.
He asked if there were any who wished to oppose the
application. There were none.
He asked for staff recommendation.
23. Mr. Dunn gave staff recommendation and conditions for
approval .
24. Chairman asked for any rebuttal from the applicant.
25. Nancy Lyon said the travel trailer being stored on the adjacent
lot has been removed.
26. Chairman closed the hearing to the public and asked Board for
—• deliberation and motion.
27. Pfeifer/Blatterspiel M/S "I move that BA-5-88, an application for a
Temporary Use Permit to allow the use of a travel
trailer as a dwelling unit for a period of 9 months
maximum, from this date to February 9, 1989, be
approved subject to the following conditions•
1. This permit shall be nonrenewable.
2. The property owners shall bring their property
into conformance with Section 20.0106(2) of
the Apache Junction Zoning Ordinance within
sixty (60) days of this action (and that,
according to prior information, is in regards
to the other travel trailer that was on the
property) .

3. This permit shall be revoked if any of these
conditions are not adhered to.
In granting this Temporary Use Permit, the Board
bases its decision on the following findings of
fact•
1. The request meets the criteria of a true
temporary nature in that the owners will
remove the travel trailer prior to, or just at
the end of, the 9-month period.
2. The situation does not involve the erection of
substantial buildings, thus again meeting a
second criteria for a Temporary Use permit. "
Motion passed 6-0-0.
28. Chairman told the applicants their request had been approved
and they could seek any further instructions from
the Building Department to comply within the 9-month
period.
29. Pfeifer/Castro M/S "I move we adjourn. " Meeting adjourned at
7:25 p.m.
