SYNOPSIS:
Agenda for June 13, 1988 approved as submitted.
Minutes for May 9, 1988 approved as submitted.
BA-4-88 approved.
1. Roll Call five members present with two members absent.
2. Chairman asked for motion to approve the agenda dated
June 13, 1988.
3. Blatterspiel/Castro M/S "I make the motion we approve the agenda dated
June 13, 1988 as presented. "
Motion passed 5-0-0.
4. Chairman asked for motion to approve the minutes dated May 9,
1988.
5. Castro/Blatterspiel M/S "I make a motion that we approve the minutes
dated May 9, 1988. "
Motion passed 5-0-0.
6. Chairman opened BA-4-88 to the public and asked for staff
briefing. He asked staff that recommendations be
held until the end of the public hearing.

7. Mr. Dunn briefed Board on BA-4-88, a request by Ernest and
Norma Casserly Perkins for a determination of
requirements for employee housing as they specifi-
cally apply to their property and use located at the
Circle C Ranch, approximately 400 feet south of
Superstition Boulevard on the east side of North
Royal Palm.
. 8. Chairman asked Board if they had any questions of staff.
9. Board asked if staff had heard from adjacent owners.
10. Mr. Dunn answered staff had received nothing in writing but
had received a couple of phone calls.
11. Chairman asked if applicant cared to address the Board.
12. Norma Perkins clarified they were asking for four trailers, not
five. She explained they need more help in winter
than in the summer. They were told by the County
that they have a right to have seasonal farm help.
Their employees are not rowdy and usually stay with
them for one or two years. They have lost grand-
father rights in their effort to improve the
appearance of the property. They have kept the
place clean and will continue to do so.
13. Chairman asked Board if they had any questions of
Mrs. Perkins.
14. Board asked how long the applicants had been at this place
and how long they had had the lots.
�-- 15. Norma Perkins answered they had been in Apache Junction since
1959, and the place was paid for in 1972. They had
bought additional land 8 or 9 years ago and some
more last summer.
16. Chairman asked if anyone wished to speak in favor of the
applicant. (At this time, he asked that a letter
staff had received be read aloud. )
17. Mr. Dunn read a letter dated April 25, 1988, from Barron W.
Jones, owner of the home at 907 East Ranch Road,
Apache Junction, Arizona, stating he had no
objections to the applicant's request and commending
them as good neighbors. (Staff then pointed on the
map where Mr. Jones ' property is located relative to
the Perkins ' property. )
18. Chairman asked Mrs. Perkins to return to the speaker's stand.

19. Board questioned if the septic system installation would
be a problem for the applicants and if they were
willing to adhere to County policies.
20. Norma Perkins indicated they thought they had a site selected that
would be appropriate, and they have been in touch
with the County regarding this.
21. Chairman asked if anyone present wished to speak in
opposition to the request.
22. Louise Hughes identified herself as the person Mrs. Perkins had
referred to as having had problems with. She said
she is not opposed to the applicants ' request as
long as things are kept up to standard and drainage
is proper. She had photographs of drainage coming
from one of the trailers.
23. Chairman asked if this drainage was on Mrs. Hughes ' property
or on the applicants ' property. He asked her to
point this out on the map.
24. Louise Hughes showed where the drainage problem was. (It actually
was not on her property. )
25. Board asked Mrs. Hughes if she had approached the
applicants regarding this problem or if she had
called the County Health Department.
26. Louise Hughes replied she had not talked with the applicants. She
had talked with Vice-Mayor Bluntschly and he sup-
posedly had contacted the County Health Department.
She asked what are the requirements when a trailer
is placed on the property and how is a determination
made as to whether a trailer is a travel trailer or
a mobile home.
27. Mr. Coleman said the State of Arizona makes that determination,
and the City abides by Arizona State Statutes.
28. Chairman asked if there were any other questions of
Mrs. Hughes. There were none.
He asked if others wished to speak in opposition to
the request. There were none.
He then asked Mrs. Perkins if she had any rebuttal .

29. Norma Perkins said there had never been any of their sewage on the
property in question and denied other comments
Mrs. Hughes had made. She explained she had
previously filed harassment charges against
Mrs. Hughes and had won, but she had dropped the
charges. Mrs. Perkins invited anyone who wished, to
come out and see the site in question.
.•� 30. Chairman commended Mrs. Perkins for dropping the harassment
charges and confirmed that she was going to put in a
septic system where the portable toilet now sits.
31. Norma Perkins said where the portable toilet sits is not the
property in question. She said Mrs. Hughes ' problem
stems from her having built her house in a wash.
The applicants had offered to install a culvert for
Mrs. Hughes, but Mrs Hughes would not sign a paper
alleviating them from any responsibility, thus they
did not proceed.
32. Chairman asked if the opposition cared to make a rebuttal
statement.
33. Louise Hughes said she had called the City regarding the problem,
and Mr. Bluntschley could be asked what had
happened.
34. Chairman asked staff for recommendation.
35. Mr. Dunn gave staff recommendation.
36. Chairman asked Board if they had any questions regarding the
staff recommendation. They had none, so he closed
the hearing to the public and asked the Board to
consider the application.
37. Pfeifer/Blatterspiel M/S "I would move that the following conditions be
approved and adopted, as they specifically apply to
the housing of employees on the property described
in application BA-4-88•
1. The applicants meet all County health
regulations, including the installation of
additional septic systems if necessary.
2. The applicants be limited to 5 total units for
the 5.03 acres described in their application
(BA-4-88) .

3. Setbacks for structures be established for the
site as a whole in the following manner:
A. Front yards are to be measured from
North perimeter property lines.
B. Rear yards are to be measured from South
perimeter property lines.
C. Side yards are to be measured from East
and West perimeter property lines.
4. A minimum separation of twenty feet (20' ) be
maintained between all dwelling units.
5. Any change in the use, size, shape or
character of the property may render this
Order null and void.
In adopting this Order, I would ask the Board to
cite the following findings
1. The type of labor described in this request is
analogous to "farm labor" permitted in a
General Rural (GR) zone.
2. The four (4) separate parcels described in
this request are being used as a single,
integrated site.
3. Accessory structures (barns, tack sheds,
corrals , etc. ) and mobile homes for employee
housing are necessary, incidental uses to the
main use of horse boarding and training.
4. Overall density on the site is consistent with
existing neighborhood densities.
5. The conditions set forth in this order apply
only to the specific circumstances of this
request, that being BA-4-88, and may not be
applicable to similar or dissimilar uses in
this or any other zone.
6. The Board has received one letter from an
adjacent neighbor who is not opposed to the
situation. The Board has also heard from
Louise Hughes, the only adjacent neighbor
present, and she has stated that she does not

oppose the motion as long as all necessary
safety and health steps are taken. The owners
have stated and agreed to install all required
septic systems. "
Motion passed 5-0-0.
38. Chairman told the applicants the Board had approved their
AMES request.
39. Castro/Kelley M/S Motion to adjourn at 7:55 p.m. Vote was
unanimous.
