AUGUST 20, 1985
The regular meeting of the City Council of the City of Apache Junction,
Arizona, was held on August 20, 1985, at the Apache Junction City Council
Chambers pursuant to the notice required by law.

Vice Mayor Bakkedahl called the meeting to order at 7:00 p.m.

AWARDS, PRESENTATIONS AND COMMUNICATIONS
Vice Mayor Bakkedahl presented a Certificate of Appreciation to Leo S.
Frazier, Jr., for service as Building Official/Zoning Administrator.
CITY MANAGER'S REPORT
City Manager Michael J. McNulty reported that the Legislature has
provided for counties outside of Pima and Maricopa to try to increase
revenue for purposes of highway improvements by having a County-wide
election to add 1/2 cent to the sales tax, and in Pinal County the election
cannot be held prior to December 10, 1985, and is delayed until resolution
of some technical questions have been accomplished, but all entities in the
County will benefit by the revenues.
Councilman Baljo endorsed the election for increased revenues.

PUBLIC HEARINGS
PROPOSED RESOLUTION NO. 85-36,
IDA REVENUE BONDS
Mr. McNulty explained that there has
been a proposed project with funding through tax-exempt bonds, that would
build a medical office building on Idaho Road and 2nd Avenue. Mr. McNulty
Aim*, stated that the Industrial Development Authority does recommend approval of
this project.
Mr. Mike Terry, 15280 Knox, Tempe,
Snell and Wilmer, bond counsel for the issue which is a medical/dental
complex, explained that this would include primary care, specialists, and
an outpatient ambulatory surgery unit, and would be owned by a partnership
by the name of "Eye-Tooth Enterprises" consisting of two doctors and one
dentist, and introduced Dr. LeThar Bleuth, Dr. Paul Snow, and Dr. Elwynn
Kaffal. Mr. Terry stated that the proceeds of the bonds would be used to
acquire the building and equipment, and requested that the proposed
resolution be approved, and further informed the Council and public that a
public hearing would be held on August 30, 1985.
Ms Mandy Weaver, 1118 W. Walada St.,
Phoenix, Arizona, a consultant to the partnership, presented a rendering of
the proposed building, and expressed the necessity of these types of
specialists in Apache Junction, and stated that a private bank has expressed
interest in purchasing the bonds.
Dr. Alwin Cathal, 17135 E. Tremaine,
Gilbert, requested approval of the bond issue, and described the benefits of
the facility.
Ms Karen Buck, 1816 Neil Drive,
Tempe, Administrator for Southwestern Eye Center, addressed the Council in
regards to the Opthamology/Medical practice and Ambulatory Surgery practice
in the proposed facility.
Councilman Eidson asked if these
services would be available 24 hours per day.
Mr. Terry stated that this would not
be emergency care, however, all doctors are on 24 hour call.
Amok Councilman Eidson wished to know
when the facility would be in operation.
Mr. Terry replied that the new
facility would be in operation in six to eight months.
Councilwoman Gardner expressed her
approval of this project.
Councilman Baljo MOVED THAT
RESOLUTION NO. 85-36, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, APPROVING THE ISSUANCE OF $2,500,000 IN
INDUSTRIAL DEVELOPMENT REVENUE BONDS (IDAHO ROAD MEDICAL/DENTAL CENTER),
SERIES 1985, OF THE INDUSTRIAL DEVELOPMENT AUTHORITY OF THE CITY OF APACHE
JUNCTION, ARIZONA, BE APPROVED AND ADOPTED.
Councilwoman Gardner seconded the
motion.
VOTE: Unanimous

Vice Mayor Bakkedahl stated that on
behalf of the City, this project would be very welcome and appreciated.

MEETING OF SEPTEMBER 3, 1985.

COMMUNITY DEVELOPMENT AND HOUSING
NEEDS, 1985 GRANT
Director of Planning Chuck Newcomer
stated that this is a public hearing to obtain citizen views on community
development housing needs, and this is a requirement of the CDBG application
process. Mr. Newcomer further stated that these funds must benefit low to
moderate income persons, and must serve an area where 60% of the residents
are in this income bracket, also may fund drainage needs.
Vice Mayor Bakkedahl opened the
hearing to the public.
Vice Mayor Bakkedahl asked if there
was anyone who wished speak on this item. There being no one wishing to
address the Council, Vice Mayor Bakkedahl closed the hearing to the public.
Vice Mayor Bakkedahl asked how many
applications are we competing with
Mr. McNulty stated that there is
$1.1 million available to the region, and possibly all 12 cities and towns
in the region will apply, with eight being awarded funding.
Councilwoman Gardner, 1244 S. Pinto,
Apache Junction, asked when we would know if we would receive funds.
Mr. McNulty stated that the City
would know if we qualify by the end of September.
PROPOSED ORDINANCE NO. 369,
PZ-17-85, RIDDLE
Vice Mayor Bakkedahl opened the
hearing to the public.
Mr. Newcomer briefed the Council on
the application for rezoning from GR General Rural to C-3 General Commercial
District of a 1.1 acre parcel, located on the northeast side of Highway 60
at the intersection of Wickiup Road and 16th Avenue in Section 27.
Mr. Newcomer stated that the original request was for C-4 Heavy Commercial
District, and at Council request the applicant had amended the application
to C-3 General Commercial District.
Ms Patricia Meyer, 1981 S. Cactus,
Apache Junction, requested approval of the application, and stated that
there are no plans at present for a proposed use
Vice Mayor Bakkedahl asked if there
was anyone who wished to speak in favor of or in opposition to the rezoning.
There being no one wishing to address the Council, Vice Mayor Bakkedahl
called upon the Director of Planning for recommendations.

Mr. Newcomer stated that this is a
request for rezoning from GR General Rural to C-3 General Commercial
District of a 1.43 acre parcel, located on the northeast side of Highway 60
at the intersection of Bowman Road and 16th Avenue in Section 27, and was
originally requested for rezoning to C-5 Heavy Commercial District, but in
compliance with Council request has been amended.
Vice Mayor Bakkedahl asked if there
was anyone who wished to speak in favor of or in opposition to the
application. There being no one wishing to address the Council, Vice Mayor
Bakkedahl called upon the Director of Planning for recommendations.
Mr. Newcomer stated that staff has
no objections and the Planning and Zoning Commission recommends approval
with the stipulation that the 40' right-of-way and 20' by 20' cutoffs at
intersections be dedicated.

South Cactus Road and East 4th Avenue in Section 21 with General Plan
designation of Medium to High Density Residential Opportunity.
Mr. A.E. Sullivan, representing the
applicants, 438 N. Saguaro, Apache Junction, made himself available to
answer questions.
Councilman Jimenez asked how many
times the property would be split.
Mr. Sullivan replied that it can be
split three times, but at the present there are no apparent plans.

presented developed with a mobile home with a designation of medium to high
density residential opportunity, with surrounding uses including mobile
homes, a church, and vacant land.

Mr. Newcomer stated that this is an

of three 1 1/4 acre parcels, located between North Stagecoach and North
Acacia Roads in Section 22, with designations of Low Density Residential on
the General Plan, which is defined as 0-7 persons per acre. Mr. Newcomer
further stated that surrounding land uses include mobile homes and vacant
land.
Ms Anna Koeper, 472 N. Acacia,
Apache Junction, requested approval of the rezoning for the purpose of
placing a second mobile home on one of the 1 1/4 acre parcels.
Councilman Eidson asked if this case
could be presented to the Board of Adjustment.
Mr. McNulty explained that the Board
of Adjustment handles only peculiar problems, but cannot create a special
situation for a property owner.

recommend denial of the application based on noncompliance with City General
Plan as the neighborhood is zoned Low Density Residential, and that the
Planning and Zoning Commission recommends 6-1 denial of the rezoning for the
oak, above reason and that although there are some areas grandfathered before the
General Plan came into effect, it is felt that this would be spot zoning not
in the best interest of the General Plan of the City of Apache Junction.

Agreement with Pinal County Health Department adopted by the Council, and at
the request of the Health Department, requirements for Certificates of
Health and sanitary inspections for thos businesses which are involved with
the sale or distribution of food and drink, are put into ordinance form.
City Manager McNulty requested that
this ordinance be postponed due to the emergency clause and lack of a
three-quarter vote at this time.

TERMS OF EXPIRATION
Vice Mayor Bakkedahl opened the

Ms Connelly addressed the Council on
the proposed ordinance which would attempt to create a uniform system for
the expiration of terms on City Boards and Commissions. Ms Connelly stated
that this would also prevent record keeping problems that have existed in
the past.
Councilman Baljo expressed his
feeling that if all positions are vacant at the same time, there may be a
problem with filling them, but that as it pertains to administration it
would be appropriate.
Councilman Eidson voiced the same
concern.
Ms Connelly further explained that
terms now expiring in April, would be extended until June, and terms
expiring in November would be cut short in June, but this would only occur
one time after which all terms would be uniform.
Councilwoman Garder asked if an
applicant could apply for more than one Board or Commission at the same
time.

Broman, briefed the Council on the request for abandonment of a portion of
San Marcos Drive and Virginia Street, which has been previously unimproved,
and it appears that San Marcos will never be continued through, and that the
Development Coordinating Committee recommended approval of the abandonment.
Mr. Craw Schaub, 352E E. Carole,
Mesa, representing Summerset Development, stated that the Development has
five lots on the corner of San Marcos Drive, and requested approval of the
abandonment.
Vice Mayor Bakkedahl stated that
Arizona Statutes requires that the Developer pay for the cost of plat
changes should they be amended.
Mr. Broman replied that for this
amendment a letter would be sufficient, without changing the entire plat.
Mr. McNulty reiterated that if it is
necessary for the plat to be amended, it would be at the cost of the
devleoper.

of this is for construction of a culvert on Ironwood Drive, and this is an
intergovernmental agreement between the State of Arizona and the City for
that project.
Councilwoman Gardner confirmed that
this is a drainage problem on Ironwood Drive, and pointed out another street
problem in that area.
Mr. McNulty replied that the City
would attempt to additionally improve the street.

Project Description
Rezoning case PZ-31-85, Proposed Ordinance No. 393, is a request by the
applicants Dawn Nehls and Sylvia Stevens to rezone their property from GR
General Rural to TH Trailer Homesite Zone. The site is 5 acres gross
(four 14 acre parcels) and each parcel is developed with a mobile home.
The site is located at the southeast corner of the intersection of East
Broadway Avenue and South Tomahawk Road in Section 27. It is designated
Local Commercial Opportunity with a surrounding designation of Medium/High
Density Residential Opportunity on the General Plan (denotes possible
suitability for either residential or commercial uses) . Surrounding land
uses include apartments and vacant land.
Planning Department Comments and Recommendations
Based on its conformity with the General Plan, staff is not opposed to the
rezoning. However, since this property has been parcelled in a manner
which, in the City Attorney's opinion, may constitute a subdivision, I would
recommend that the case be postponed by the City Council until the applicant
has completed the necessary steps to comply with the Planning and Zoning
Commission's stipulation to either comply with the City's Subdivision Regulations
or to re-split the property in a manner which does not constitute a subdivision.
The applicant was agreeable to re-split the property and has submitted a sketch
(attached) which indicates how the four parcels would be converted to three
and one of the mobile homes would be removed. As of this date, this re-splitting
of the property has not been accomplished, but I will inform the Council prior
to the public hearing as to any documentation submitted by the applicant. Once
this is accomplished, and should the rezoning be approved, staff would

recommend stipulating the dedication of the east and south thirty-three
feet (33' ) of the subject property for public roadway and associated purposes
along with twenty foot (20' ) by twenty foot (20' ) cut-offs at intersections.
Staff also recommends stipulating that these parcels not be developed into
a mobile home or recreational vehicle park unless otherwise permitted by the
City.
Two (2) protest petitions have been filed (see attached map for locations) .
These protests constitute approximately 50% on the east side of the property
and therefore, passage by the City Council will require a 3/4's vote.
Stipulations in Ordinance
Staff and the Planning and Zoning Commission recommend stipulating roadway
dedications for public rights-of-way and that these parcels not be developed
into a mobile home or recreational vehicle park unless otherwise permitted
by the City. A third stipulation imposed by the Commission and recommended
by staff was that the City Council not approve this rezoning until the applicant
has performed the necessary actions to comply with the City's Subdivision
Regulations, or to re-split the property in a manner which does not constitute
a subdivision. This third stipulation is not in the Ordinance, but can be
added if the Council so chooses.
Planning and Zoning Commission Recommendation
The Planning and Zoning Commission at their regular meeting of July 23, 1985,
after public hearing, voted to approve the following motion: (M/S Hoaglin/
Conway 3-2-0)
"BE IT RESOLVED by the Planning and Zoning Commission of the City of
Apache Junction, Arizona, that rezoning case PZ-31-85, also known as
Proposed Ordinance No. 393, application of Dawn Nehls and Sylvia
Stevens for their property described as, a matter of public record,
requesting rezoning from GR General Rural to TH Trailer Homesite Zone,
that the Commission recommends to the Apache Junction City Council the
approval of said application with the stipulations as recommended by
the staff.
The reasons for this recommendation are:
1. The request complies with the General Plan.
2. It seems as if it is the best use of the property at this time. "

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA, THAT.

SECTION I IN GENERAL
The zoning district classification on the Zoning District Map, City of Apache
Junction, Arizona, for the parcels of land described as:
The West 1 of the Northwest 1 of the Northwest 1 of the
Northwest 1 of Section 27, Township 1 North, Range 8 East,
Gila and Salt River Base and Meridian, Apache Junction, Pinal
County, Arizona,
be and hereby is amended from GR General Rural to TH Trailer Homesite Zone,
subject to the following stipulations 1) the applicants dedicate the east
and south thirty-three feet (33') of the subject property for public roadway
and associated purposes along with twenty foot (20') by twenty foot (20')
cut-offs at intersections, and 2) these parcels not be developed into a mobile
home or recreational vehicle park unless otherwise permitted by the City.
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of
this Ordinance or any part of the code adopted herein by reference are hereby
repealed
SECTION III PROVIDING FOR SEVERABILITY
If any section, sub-section, sentence, phrase, clause, or portion of this
Ordinance or any part of the code adopted herein by reference is for any
reason held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction, such decision shall not affect the validity of
the remaining portions thereof.

Planning Department Comments and Recommendations
There are pros and cons to granting the requested rezoning.
On the positive side• The property is located on an arterial roadway approximately
600 feet off of Highway 60. The property to the west has been zoned CB-1 and
present land uses to the south (but not necessarily the CB-2 zoning) renders
the property undesirable for residential uses. The General Plan indicates the
area to the north (at the intersection of Broadway and Tomahawk) and to the
south would be suitable for commercial uses.
On the negative side: The General Plan designation is for Low Density Residential .
The adjacent properties to the north and east are zoned for Low Density Residential
use. The property to the west is zoned CB-1, a classification less intensive
than C-3. If commercial uses are deemed suitable for the site, is Local
Commercial (C-1 or C-2) best or is the C-3 General Commercial appropriate and

The reasons for this recommendation are:
Even though this area is a low density area abutting Highway 60, it is
zoned commercial 600 or 700 feet beyond the applicant's footage from
the Commercial Opportunity zone. This area should be considered for a
change in the General Plan on the next consideration. C-3 is more
compatible for this particular area and is the best use of the property
at the present time. "

SUBJECT: PROPOSED ORDINANCE NO. 418 -- HEALTH PERMITS
In conjunction with the Intergovernmental Agreement with the Pinal County
Health Department as adopted by the Council at the July 16th regular
meeting, the City has agreed to certain stipulations involving Certificates
of Health and sanitary inspections for those businesses which are
involved in the sale or distribution of food and drink.
Specifically, these stipulations are that the City will not issue a
business license for these business until such time that a written
approval to operate is received from the County Health Department.
Proposed Ordinance No. 418 places such a requirement in the business license
section of the City Code. While there presently is such a stipulation
in Section 8-5-14 pertaining to permanent business, there is no such ,.�
requirement clearly spelled out for temporary or peddler type businesses.
It has, however, been the policy of the city to require health permits for
all food-related businesses.
Proposed Ordinance No. 418 makes two changes in the City Code:
A. It adds Section 8-1-10 and makes it mandatory for all temporary
and peddler-type businesses involved in the sale of food and/or
beverages to obtain a health certification prior to issuance
of a business license.
B. It amends Section 8-5-14 by making the language uniform with the
similar requirement in Section 8-1-10 and adds the stipulation
that all new or remodeled bars and restaurants provide a health
certificate prior to issuance of a license.
This ordinance has been prepared with the Emergency Clause because of the
need to have it immediately operative.

AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA, ESTABLISHING THE SPEED LIMIT ON LOST DUTCHMAN
BOULEVARD BETWEEN GOLDFIELD ROAD AND IDAHO ROAD REPEALING ANY
CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY, PROVIDING FOR
PENALTIES; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA THAT.
SECTION I IN GENERAL
It is in the public interest to insure safe, effective and efficient traffic
flow along public rights—of—way within the City of Apache Junction,
Arizona and it has been determined that speed limits are necessary for the
public safety, therefore, the speed limit be established at 35 M.P H on
Lost Dutchman Boulevard between Goldfield Road and Idaho Road.
Furthermore, the Director of Public Works and the Director of Public Safety
are hereby empowered and directed to initiate appropriate action to install
the speed limit signs and enforce the speed limits on the referenced streets.
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions
of this ordinance, or any part of the code adopted herein by
reference, are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion
of this ordinance, or any part of the code adopted herein by
reference, is for any reason held to be invalid or unconstitutional by
1[ the decision of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions thereof.
SECTION IV PENALTY CLAUSE
Any person found guilty of any violation of or failure or refusal to
do or perform any act required by Chapter 12 of this code constitutes
a civil traffic violation Civil traffic violations are subject to
the provisions of Title 28, Chapter 6, Article 20 and 21, Arizona
Revised Statute, and amendments thereof.
SECTION V EMERGENCY CLAUSE
It is necessary for the preservation of the peace, health and safety
of the City of Apache Junction, Arizona, that this ordinance become
effective immediately, an emergency is hereby declared to exist and
this ordinance shall be effective immediately upon passage and adoption.

SUBJECT: PROPOSED ORDINANCE NO. 422 (ANIMAL REGULATIONS)
This ordinance has been prompted by and been prepared in conjunction with
the proposed equine zoning district regulations which will be brought
before the Council in the near future.
Proposed Ordinance No. 422 addresses particular problems which arise in
the keeping of animals, not only horses, such as manure removal and
storage, quality of care, safe and secure containment, protection of
groundwater, and prevention of fly and rodent breeding. It also estab-
lishes enforcement procedures.
I have prepared this ordinance so that it encompasses the keeping of all
animals and does not address only a particular segment. In doing so, I
feel it will save the City future costs by having to compile and adver-
tise ordinances for different kinds of animals.
This ordinance has been written with the emergency clause so that it
may be effective prior to Council consideration of the equine zoning
districts.

CHAPTER IV
ANIMALS, BIRDS, FOWLS, RODENTS
AND FLY BREEDING CONTROL
REGULATION 1 . Definitions
1 . The term "animal " shall include all mammals (excepting
man) , birds, fowls and rodents .
"oft. 2. For the purpose of this Regulation, a populous district
shall be a neighborhood with an average density of two
(2) or more families per acre.
REGULATION 2. Keeping of Animals
a. All animals shall be kept and maintained in such a manner
as to not disturb the peace, comfort or health of any
person residing within the county.
b. Whenever animals are kept within the county without food,
water and proper care, it shall be the duty of the humane
officer to take into custody such animals which are so keot.
c. No person shall keep or maintain any poisonous reptiles or
dangerous, carnivorous, wild animals without first having
registered such animals or reptiles with the humane
officer. The humane officer may prescribe regulations to
insure the safe penning or, caging of such animals or
reptiles.
d. Piggeries -- (1 ) No pigsty or piggery shall be built or
maintained on marshy ground or land subject to overflow,
nor within 200 feet of any stream, canal or other source
of water supply, nor within 300 feet of an inhabited
house or public meeting house on an adjoining property;
,.. (2) when garbage is fed to pigs, all unconsumed garbage
shall be removed daily and disposed of by burial or
incineration; (3) no organic material furnishing food for
flies shall be allowed to accumulate on the premises;
(4) all garbage shall be handled and fed upon platforms of
concrete or other impervious material ; (5) unslaked lime,
hypochiorite of lime, borax or mineral oil shall be used
daily in sufficient quantities to prevent offensive odors
and the breeding of flies.
REGULATION 3. Sanitary Regulations
a. Any person, firm or corporation is prohibited from keeping
any mammal , bird, fowl or rodent in such manner that the
condition of the same shall cause fly breeding or constitute
a nuisance, or which shall or does cause noxious or
offensive odors.

b. In populous districts , any corral , barn, enclosure or
other structure for the purpose of housing, keeping or
caring for any aninal or animals shall be 50 feet away
from all property lines unless it is a fly-tight
enclosure approved by the Department, and any animal
weighing in excess of 100 pounds shall be restricted
from coming with 100 feet of any dwelling or any person
or persons on adjacent properties.
REGULATION 4. Manure Disposal
a. Manure must be completely removed from stables, yards, or
other animal enclosures once weekly, or as often as
necessary to maintain a sanitary premises.
b. Adequate fly-tight containers approved by the local Health
Department must be provided for the storage of manure
unless it is completely removed from premises once weekly.
Exception: In commercial animal feeding operations and
chicken ranches , isolated farms and premises, the manure
must be disposed of in the manner approved by the Health
Department.
c. Manure shall not be accumulated in any place where it can
affect a source of drinking water.
REGULATION 5. Water and Feed
a. Drinking troughs must be provided with overflow drainage
and the overflow drainage must not constitute a nuisance.
b. Spillage and leftovers from animal feedings must be
disposed of in a manner that precludes fly breeding and/or
obnoxious odors.

SECTION I IN GENERAL
That the Apache Junction City Code, Chapter 6 ANIMALS, be amended by
adding Article 6-6 KEEPING OF ANIMALS, to read as follows.

Section 6-6-1 Definitions
A. "Animal" shall mean all mammals (excluding man), birds, fowl and rodents,
and shall include all equine such as horses, mules and donkeys
B "Manure" shall mean refuse of stables, yards, corrals or barn yards
consisting of mammal or fowl excreta with or without litter
IL C "Sanitary Premises" shall mean those premises on which problems arising
from odors, insect and rodent breeding, or any other condition which
constitutes a nuisance are prohibited or non-existent
Section 6-6-2 Maintenance of Property
A No person, firm or corporation shall be permitted to keep or harbor any
animal in such a manner that the condition of such animal shall cause
fly breeding, rodent breeding, cause noxious or offensive odors or
^ constitute a nuisance.
B. All corrals, barns, enclosures or other structure used for the purpose
of housing, keeping or caring for any animal or animals shall be
structurally sound so as to contain such animals safely and securely

(B. Manure shall be completely removed from premises one time per week

accordance with the provisions as contained in Article 6-2 of this
chapter

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA THAT
SECTION I IN GENERAL
It is in the public interest to insure safe, effective and efficient
traffic flow along public rights—of—way within the City of Apache
Junction, Arizona and it has been determined that traffic control devices
are necessary for the public safety. Now, therefore, be it ordained
that stop signs be designated at the following locations.
Lost Dutchman Boulevard at State Route 88 Eastbound (Existing),
Lost Dutchman Boulevard at Bull Dog Mine Road Eastbound (Proposed),
Lost Dutchman Boulevard at Bull Dog Mine Road Westbound (Proposed),
Lost Dutchman Boulevard at Idaho Road Westbound (Existing),
Saguaro Drive at 16th Avenue Southbound (Proposed),
Concho Street at Meridian Drive Westbound (Proposed),
Greasewood Street at Meridian Drive Westbound (Proposed),
Virginia Street at Rennick Drive Westbound (Proposed),
Furthermore, the Director of Public Works and the Director of Public
Safety are hereby empowered and directed to initiate appropriate
action to install and enforce said traffic control devices
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions
of this ordinance, or any part of the code adopted herein by
reference, are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion
of this ordinance, or any part of the code adopted herein by
reference, is for any reason held to be invalid or unconstitutional by
the decision of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions thereof.
SECTION IV PENALTY CLAUSE
Any person found guilty of any violation of or failure or refusal to
do or perform any act required by Chapter 12 of this code constitutes
a civil traffic violation Civil traffic violations are subject to
the provisions of Title 28, Chapter 6, Article 20 and 21, Arizona
Revised Statute, and amendments thereof.
SECTION V EMERGENCY CLAUSE
It is necessary for the preservation of the peace, health and safety
of the City of Apache Junction, Arizona, that this ordinance become
effective immediately, an emergency is hereby declared to exist and
this ordinance shall be effective immediately upon passage and adoption.

SUBJECT: PROPOSED ORDINANCE NO. 424 -- YOUTH ADVISORY BOARD
As discussed at the August 19th work session, the attached ordinance has
been prepared pertaining to the creation of a Youth Advisory Board.
In conjunction with Council direction, Proposed Ordinance No. 424 will
have the effect of establishing a nine member Youth Advisory Board con-
sisting of five youth members and four adult members. The ordinance also
sets forth the Board's officers, quorum, terms of office, meetings,
vacancies and removal of members, and a brief description of duties.
This ordinance will appear on the September 3rd agenda for Council
consideration. It has been written with the emergency clause so that
recruitment for members can begin immediately.

SECTION I IN GENERAL
That the Apache Junction City Code, Chapter 2 MAYOR AND COUNCIL,
be amended by adding Article 2-14 YOUTH ADVISORY BOARD, to read as follows

Section 2-14-1 Creation
There is hereby established a Youth Advisory Board which shall act solely as
an advisory body to the City Council to promote and develop youth-oriented
programs and services within the City of Apache Junction.
IL Section 2-14-2 Membership and Terms of Office
A The Youth Advisory Board shall consist of nine (9) members who shall be
appointed by the Mayor and approved by the City Council The nine
members shall consist of five (5) juveniles and four (4) adults. Ex
officio members, without voting privileges, may be designated by the Mayor
with the approval of the City Council
B The initial appointments of members shall be as follows Three members
with terms beginning upon their appointment and expiring June 30, 1986,
/III\ three members with terms beginning upon their appointment and expiring
June 30, 1987, and three members with terms beginning upon their
appointment and expiring June 30, 1988. Thereafter, Board members
shall serve for a term of three years or until their successors are
duly appointed and qualified, and terms of members shall be so stag-
gered that the terms of no more than three members shall expire in any
one year Ex officio members shall serve for a term not to exceed one
year.
C All members shall be residents of the City of Apache Junction
Section 2-14-3 Salaries and Personal Expenses
Members of the Youth Advisory Board shall receive no salary or other remun-
eration for their services in such capacity and shall not be entitled to
personal expenses incurred by them in the discharge of their official duties
except to the extent, purposes and amount such expense is first authorized
and approved in advance by the City Council
Section 2-14-4 Officers
The Board shall elect a chairman, vice chairman and secretary from among its
members to serve for a period of one year The vice chairman shall preside
at meetings in the absence of the chairman.

Section 2-14-5 Meetings
The Board shall establish a regular meeting day and time and shall meet
at least once each month. Special meetings may be called as required
All meetings shall be held in compliance with the Open Meeting Act as
provided for in A.R.S. §38-431 as amended A quorum shall consist of
five (5) voting members for the transaction of all business
Section 2-14-6 Vacancies
Vacancies shall be filled by the City Council in accordance with Section ^\
2-14-2 for the unexpired term of the affected member.
Section 2-14-7 Removal of Members
Members of the Youth Advisory Board shall serve at the pleasure of the Council
and may be removed by the Mayor with the concurrence of the Council A member
shall not be absent from any Youth Advisory Board regular meetings for more
than three (3) consecutive times without a reasonable excuse After the
absence of three consecutive regular meetings, the remaining members of the
Youth Advisory Board shall vote to retain or recommend to the City Council
that the absentee member be relieved of his duties on the Board.
Section 2-14-8 Duties
The Board, through the Superintendent of Community Services, shall make
recommendations to the City Council regarding general policy relating to
youth-oriented services and programs as provided by the City.

this ordinance or any part of the code adopted herein by reference are hereby

SUBJECT: PROPOSED ORDINANCE NO. 425 (TRASH PICK-UP)
The attached ordinance has been prepared in response to a Council request
at the August 19th work session.
Proposed Ordinance No. 425 accomplishes two purposes: (a) it establishes
specific hours of operation for companies to pick up trash throughout
the city; and (b) it prohibits the mechanical compaction of trash in
any residential area of the city prior to 8:00 a.m. .
This ordinance will appear on the September 3rd agenda for Council
consideration. It has been written without the emergency clause so
that there may be sufficient time to notify the trash companies of any
new city regulations so that they can effectively implement them. ^.

SUBJECT: PROPOSED ORDINANCE NO. 426 (IDA)
As discussed at the August 19th work session, there does not currently exist
any ordinance establishing the Industrial Development Authority.
Proposed Ordinance No. 426 has been prepared in response to requests from
the IDA and their attorney. It not only establishes the IDA, but also
sets the number of members, its officers, and the number of members
required to constitute a quorum. Hopefully, this will eliminate some
of the difficulties the IDA and the city have had in the past with regard
to terms of office, membership and meeting procedures.
This item will be placed on the September 3rd agenda for Council consideration.
It has been written with the emergency clause because of the potential need Amu.
for the IDA to have a definite number of members and a quorum.

AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION
CITY CODE, CHAPTER 2 MAYOR AND COUNCIL, BY ADDING ARTICLE
2-15 INDUSTRIAL DEVELOPMENT AUTHORITY, REPEALING ANY CON-
FLICTING PROVISIONS, PROVIDING FOR SEVERABILITY, AND
DECLARING AN EMERGENCY.

APACHE JUNCTION, ARIZONA, AS FOLLOWS:
SECTION I IN GENERAL
That the Apache Junction City Code, Chapter 2 MAYOR AND COUNCIL,
be amended by adding Article 2-15 INDUSTRIAL DEVELOPMENT AUTHORITY, to
read as follows.
Article 2-15 INDUSTRIAL DEVELOPMENT AUTHORITY
Section 2-15-1 Creation
Section 2-15-2 Membership and Terms of Office
Section 2-15-3 Officers
Section 2-15-4 Vacancies
Section 2-15-5 Quorum
Section 2-15-1 Creation
There is hereby established an Industrial Development Authority, hereinafter
referred to as "Authority", which shall perform all duties reserved to
Industrial Development Authorities as contained in state and federal
regulations
Section 2-15-2 Membership and Terms of Office
A The Industrial Development Authority shall consist of seven (7) members
who shall be appointed by the Mayor and approved by the City Council.
B After the expiration of initial appointments, the terms of members
shall be as follows: two members with terms beginning from their
appointment and expiring six years from the date of appointment,
three members with terms beginning from their date of appointment
and expiring six years from the date of appointment; and tWo
�� members with terms beginning from their date of appointment and
expiring six years from the date of appointment. All Authority
member terms shall be for a period of six years, and terms of
members shall be so staggered that the term of no more than three
members shall expire in any one year
Section 2-15-3 Officers
The Authority shall elect a chairman and vice chairman from among its
members. The vice chairman shall preside at meetings in the absence of
the chairman. All officers shall serve until their successors are
elected.
Section 2-15-4 Vacancies
Vacancies shall be filled in accordance with Section 2-15-2 by the Council
for the unexpired term of the member affected
Section 2-15-5 Quorum
A quorum shall consist of four (4) voting members for the transaction of
all business

SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions
of this ordinance or any part of the code adopted herein by reference are
hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion of this
ordinance or any part of the code adopted herein by reference is, for any ,61
reason, held tote invalid or unconstitutional by the decision of any court
of competent jurisdiction, such decision shall not affect the validity of
the remaining portions thereof
SECTION IV EMERGENCY CLAUSE
It being necessary for the preservation of the peace, health and safety
of the City of Apache Junction, Arizona, an emergency is declared to exist
and this ordinance shall become immediately operative and in effect from
the date of adoption hereof.

Planning Department Comments and Recommendations
Intent/Purpose of Planned Development
Project does not comply with the intent or purpose of the Planned Development
in terms of creative design, preservation of natural green spaces , counter-
acting the effects of urban congestion and momotony by providing environmental
amenities. Nor does it meet the further intent of insuring compliance
with the General Plan.
Development Standards
Project does not conform on two major points.
1. Buildings , etc. , shall be located in such a manner so
as to avoid a corridor, tunnel , linear or barracks-
like
effect.
2. There shall be a minimum of 20% of the total area
dedicated or reserved as common usable open area.
General Criteria
A planned development may be granted only if it is found that the development
conforms to all six criteria set forth in Section 19.0109 of the Zoning
Ordinance. This project does not meet all six criteria.
Recommendations
Staff recommends the request for preliminary planned development approval be
returned for revision and referred back to the Development Coordinating
Committee for the addition of the 20% open space.

If approved, staff does recommend the following stipulations:
1. The use of the east portion of the site for R.V.
storage to be terminated within 24 months of start
of Phase II , whichever occurs first.
2. The use of a mobile home as a caretaker's residence
be terminated within 24 months or start of Phase II ,
whichever occurs first.
3. The second phase of the project commence within 24
months.
4. If a deferment of offsite improvements is allowed,
that this deferment be for a maximum of 24 months .
5. Signage must comply with the City of Apache Junction
Sign Code.
Development Coordinating Committee Recommendation
The DCC recommends the preliminary planned development for denial based on
the lack of required open space.
If approved, DCC did recommend the following stipulations:
1. Maximum 24 month duration for R.V. storage.
2. Maximum 24 month duration for mobile home as caretaker's
residence.
3. Second phase to commence within 24 months.
4. Maximum 24 month deferment of those offsites specified.

Recommended Motion
I move that the preliminary planned development (PZ-67-84) be returned for
revision and hereby return to the Development Coordinating Committee until

SUBJECT: ECONOMIC DEVELOPMENT DISTRICT
Several months ago an Economic Development District was proposed to the
Central Arizona Council of Governments Region.
This type of district is a creature of the Federal government, and they, if funds
are available, contribute "seed money" toward planning for economic development.
This "seed money" amounts to $50,000, which must be matched by local funds.
Currently there are literally hundreds of these districts which are not funded
by the Feds.
I do not believe that this type of District will be of material benefit to the
City of Apache Junction. The development effort will concentrate on the most
depressed areas of the district. In our case the copper communities. We could
be put in the position of having to contribute to the local match, without
�-. receiving any direct benefit.
I also believe that the State Department of Commerce is capable of doing the
same thing that the District would do. They are currently conducting a study of
several of these depressed communities. This study, when complete, will form
a blueprint for economic development.
Because the Department of Commerce is charged by the Governor with making
a recommendation on the formation of this type of district, they are asking that
the members of C.A.C.G. respond.
I wish to recommend to you that the Mayor be authorized to reply to the
Department of Commerce that the City of Apache Junction is opposed to the
formation of this District at this time.

A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION, ARIZONA, RELATING TO INDUSTRIAL DEVELOP-
MENT, APPROVING AND AUTHORIZING THE ISSUANCE BY THE INDUS-
TRIAL DEVELOPMENT AUTHORITY OF THE CITY OF APACHE JUNCTION,
ARIZONA, OF ITS MEDICAL FACILITIES REVENUE BONDS (EYE TOOTH
ENTERPRISES PROJECT) SERIES 1985.
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF 0001,
APACHE JUNCTION, ARIZONA, AS FOLLOWS:
WHEREAS, the Mayor and City Council of the City of Apache Junction,
Arizona, (the "City") have heretofore approved the incorporation of the
Industrial Development Authority of the City of Apache Junction, Arizona,
(the "Issuer"), and
WHEREAS, the Issuer has granted preliminary approval of the
issuance and sale of its Medical Facilities Revenue Bonds (Eye Tooth Enter-
prises Project), Series 1985 (the "Bonds") in an aggregate principal amount
not to exceed $2,500,000, the proceeds of which will be used to assist Eye
Tooth Enterprises, an Arizona general partnership, in financing the
acquisition, construction and equipping of a medical and dental center of
approximately 14,200 square feet to be situated on approximately 0.9 acres
of land at 110 South Idaho Road, Apache Junction, Arizona, (the "Project"),
Eye Tooth Enterprises being the initial owner and developer of the Project;
and
WHEREAS, the Mayor and City Council of the City of Apache Junction,
at its meeting on August 20, 1985, granted preliminary approval to the issuance
of the Bonds by the Issuer to assist in the financing of the Project, and
WHEREAS, Section 103(k) of the Internal Revenue Code of 1954, as
amended (the "Code"), requires that the "applicable elected representative"
of the City approve the issuance of the Bonds after a public hearing fol-
lowing reasonable public notice, and
WHEREAS, a public hearing with respect to the proposed issuance of
the Bonds to assist in financing the Project was held by the Issuer in
accordance with the requirements of the Code on August 30, 1985, and the
results thereof have been reported to the Mayor and City Council; and
WHEREAS, the Industrial Development Plans for Municipalities and
Counties Act, being Title 9, Chapter 11, Arizona Revised Statutes, as amended ,Imikk,
(the "Act"), requires that the proceedings of the Issuer pursuant to which
the Issuer proposes to issue bonds include a requirement for the approval
by the governing body of the City of the issuance of bonds, and
WHEREAS, the Mayor and Council of the City have duly considered
the proposed issuance and sale of the Bonds by the Issuer and the loan of
the proceeds thereof to Eye Tooth Enterprises to assist in financing the
Project, and the Mayor and Council of the City deem it appropriate to
approve the issuance of the Bonds by the Issuer, and
WHEREAS, it is necessary for the immediate preservation of the
peace, health and safety of the City that this resolution become immediately
effective.
L NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS

SECTION 3 The various CIty officers and employees are authorized

SECTION 4 All resolutions or ordinances,or parts thereof, in
conflict with the provisions of this resolution are, to the extent of such
conflict, hereby repealed.
SECTION 5. It is necessary for the preservation of the peace, health
and safety of the City of Apache Junction, Arizona, that this resolution
become immediately effective, an emergency is hereby declared to exist, and
this resolution shall be effective immeidately upon its passage and adoption.

Changes in the scheduling for the CDBG application process necessitate a
special City Council meeting on September 9, 1985. September 9, 1985 is
the earliest possible date for the resolutions to be adopted as the public
review period ends September 8, 1985. September 9, 1985 also is the
latest date for the resolutions to be adopted as they must be delivered
to CAAG Regional Office on September 10 , 1985.
At this public hearing, four resolutions will need to be discussed and
adopted for the process to continue. An application has been submitted
lacking these resolutions.
The initial required public hearing was held August 20, 1985 with very
little public input. We anticipate this hearing to last a very short time.

Savings, 3160 W. Apache Trail , Apache Junction; First Interstate, P.O. Drawer F,
Apache Junction; Arizona Bank, 6861 E. Apache Trail , Mesa; United Bank, P.O. Box J,
Apache Junction; Valley National Bank, P.O. Box 29505, Phoenix, and Western Savings
& Loan, 242 N. Central Avenue, Phoenix, informing them of the City's desire to
invest the sum of $1 ,155,000.00 for a series of thirty-two (32) days. Each bank
was asked to submit a written bid by 9:30 a.m. , on August 15, 1985, indicating
the rate of interest offered on the dollar amount for the period of thirty-two
(32) days.
The bids, opened and read by the City Clerk, Kathleen Connelly, were as follows:

NARRATIVE REPORT
APACHE JUNCTION SELF STORAGE
Owner/Developers DENCO Development

The Apache Junction Self Storage consists of 42,000 sq. ft. of
rentable area of which 41,600 sq.ft. is storage rental and 400 sq.ft.
is rental office space. This project is situated on a 2.04 acre site
near the intersection of Delaware and Greasewood Roads in the City of
Apache Junction, Arizona.
The Developer has designed the project to be aesthetically pleasing
from the street view as well as structually sound in the masterful
blending of steel and masonry construction.
The project is designed with all exterior solid masonry walls on
the North, West, and South side- with a pleasing blend of granite ground
cover with native species of desert trees and shrubs tastefully land-
scaping the Greasewood side of the project.'
It is the Developer's-proposal to widen Greasewood and to add curb
and gutter tothe `extent of the_ :development of Phase I which has approx
imately 300 ft. of frontage on Greasewood. These street improvements
will be to City of Apache Junction specifications and of the best
quality of materials and standards of workmanship.
To be economically viable, the Developer proposes to continue the
improvement of Greasewood (approximately an additional 154.32') as
well as 172' frontage on Delaware Drive, when the Developer is ready
' to move to Phase II of this project. The Developer would not be in a

position to make these improvements at this time, but would commit to
these improvements at a later date when he develops the Phase II portion
of this project. The exisiting Laundromat at the corner of Delaware
and Greasewood covering approximately .36 acres is under separate owner-
ship and the Developer has no plans for improving this owner's street
frontage. The Developer proposes the abandonment of Desert View Drive
due to no current use nor apparent need for this street.
. The project site itself has an asphalt paved entrance from Delaware
of 30' in width extending back into the security area of the Self Storage.
The Project consists of seven buildings totaling 42,000 sq.ft. ' The
interior buildings are all of steel construction painted white with.:
roll up doors on each individual storage unit, with steel beamed roof
construction peaked in the center and sheeted with rustproof Zincalume
Leak Proof Panels. Asphalt paving -is throughout •the compound and in-,
between storage buildings with exits and emergency access paved out to
Greasewood. All on site water will be retained on property with the
use of drywells to conform to design requirements as established by the
project engineers and the city staff. There is 24 hour security lighting,
security fencing and a 24 hour on site caretaker planned with this project.
The exterior masonry walls will be painted an aesthetically pleasing
earth tone color to match the granite landscape and native shrubbery
•
that the Developer is installing as part of this project (on theGreasewood
• frontage on Phase I). •
Overall, the development will be a very well built, well designed,
aesthetically pleasing project. With the landscaped street frontage,
all asphalt paving, and exterior masonry construction, this will be the
most appealing self storage project in the City of Apache Junction.
Also, this project will set a tone and an example of high quality for
any future project of this'.concept and will enhance the development
• and character of the neighborhood and prove to be an asset to the
community.

Additional Information

Self Storage
We will require all loading of individual storage units with
parallel parking only. We will instruct all renters of this
requirement at the time the lease the unit. We will inform
them that this is for fire safety purposes. We will police
individual renters for compliance and make this job a part
of the work requirement for our 24 hour on site caretaker/
manager.
The storage units will not be sprinklered, but we are proposing
an additional fire hydrant of the NorthWest Corner of the
Development on the Greasewood frontage .

Addendum to Narrative Report
Apache Junction Self-Storage
Internal project lighting will be accomplished by flood
lights strategically located through out the project. These
lights will be mounted at the ends of each building to shine
down into the complex and to not interfere with any neighbors
to our project.
The Zero setback on the South property line is the most
practical method for a project of this type . This setback
actually provides a block wall free of charge for the ad-
joining property owner to the south. A block wall that will
most likely be utilized to the benefit of the adjacent property
owner when he becomes ready to develop his property.
The Developer agrees to a maximum 24 month placement and
use of the mobil home . The Developer also agrees to a maximum
two year deferral of full improvement of Delaware Drive .
We respectfully request an exception to the 20% open space
rule due to the type and use of the project.
The project is entirely self-contained with the interior
portion of the project screened from the public view with
the use of decorative block walls and landscaping on all street
view sides of the property and will prove to be aesthetically
pleasing to the neighborhood.
