Ms Janet Hartley, President of AARC, and presented a plaque to the City Council for the support in having DES reconsider the contract for Southwest ,060,.. Human Development. CITY MANAGER'S REPORT City Manager Michael J. McNulty reported that there has been communication with a firm that provides waste water treatment in other cities, and that the Board of Supervisors is moving forward on the 1/2 cent gas tax Mr. McNulty stated that there will be a meeting on October 7th, held by the Chamber of Commerce to support this tax, and that there will be cable TV broadcast on the Superstitions on one of the cable networks. PUBLIC HEARINGS PROPOSED ORDINANCE NO 406, PZ-40-85, HOHN ) Mayor Hill opened the hearing to the public. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 1, 1985 PAGE 2 OF 14 Deputy Director/Associate Planner Jim Nakagawa briefed the Council on the application for rezoning from General Rural to Trailer Homesite of 3 parcels, totaling 2 1/2 acres, located on the northeast corner of Main Drive and West Roundup Street in Section 18. Mr. Wilmer Hohn, applicant for the rezoning, requested approval. Mayor Hill asked if there was anyone /114,„ who wished to speak in favor of or in opposition to the rezoning. There being no one wishing to address the Council, Mayor Hill called upon the Planning Department for recommendations. Mr. Nakagawa stated that staff has no objections to the rezoning with stipulations of rights-of-way dedication and that the parcel not be developed into a mobile home or RV park unless permitted by the City, and that the Planning and Zoning Commission recommends approval with the stipulations mentioned by staff. PROPOSED ORDINANCE NO. 413, PZ-47-85, UPTON Mayor Hill opened the hearing to the public REGULAR MEETING OF THE CITY COUNCIL OCTOBER 1, 1985 PAGE 3 OF 14 Mr. Nakagawa explained that this is a application for rezoning from Gr General Rural to Trailer Homesite of a 1 1/4 acre parcel, located just south of the southwest corner at the intersection of West Tepee Street and North Valley Drive. Mr. Bryan Scott Upton, 1540 N Valley Drive, Apache Junction, requested approval of the application. Mayor Hill asked if there was anyone who wished to speak in favor of or in opposition to the rezoning There being no one wishing to address the Council, Mayor Hill called upon the Department of Planning for recommendations. Mr. Nakagawa stated that staff has no objections and that the Planning and Zoning Commission recommends approval with the stipulations that east 33' of the property be dedicated for roadway purposes and that the parcel not be developed into a mobile home or RV park unless permitted by the City. Mr. Nakagawa briefed the Council on the application for rezoning from GR General Rural to C-4 Heavy Commercial District of a 5 acre parcel, located at the southwest corner of the intersection of U.S. Highway 60 and South Bowman Road in Section 27 REGULAR MEETING OF THE CITY COUNCIL OCTOBER 1, 1985 PAGE 4 OF 14 Planning Intern/Assistant Rodney Class-Erickson showed a video tape of the subject site. Mr. Bob Jones, representing the applicant, outlined the proposed development which would be a contractor sales and service. Mr. Hank Steelsmith, Architect for the project, P.O. Box 151, Show Low, Arizona, explained the various aspects of the site plan. Councilwoman Gardner inquired about access to the property. Mr Steelsmith stated that Bowman would be widened to accomodate traffic and there would also be an access from Highway 60. Councilman Jimenez asked if there would considerable noise, as there is mobile home park located to the west of the subject site. Mr. Steelsmith replied that there would not be excessive noise, and certainly not after business hours, and that this area is designated commercial on the General Plan. Vice Mayor Bakkedahl wished to know what type of business was proposed. Mr. Steelsmith stated that it would be some type of building materials sales. Mayor Hill asked if there was anyone who wished to speak in favor of or in opposition to the rezoning. Mr. Nakagawa stated that staff suggested alternatives and the Planning and Zoning Commission recommends approval with the stipulation that the applicant submit a site plan prior to Council approval. Mr. Nakagawa briefed the Council on the request for rezoning from General Rural to C-3/PD General Commercial by Planned Development of a 2 1/2 acre parcel located 400' south of Apache Trail approximately 280' east of Thunderbird Drive, proposing a mini-storage complex with a m ail center, retail space, and a caretaker's dwelling, and further explained that the northern portion of the entire project is already zoned CB-2, which allows the mini-storage. Mr Randall D. Skidmore, one of the applicants, outlined the project and requested approval. Mayor Hill asked if there was anyone who wished to speak in favor of or in opposition to the rezoning. There being no one wishing to address the Council, Mayor Hill called upon the Associate Planner from recommendations Agmmilk Mr. Nakagawa stated that the site is designated for General Commercial use on the General Plan and staff stipulates that the development be controlled by the Planned Development plan and that the Planning and Zoning Commission recommends approval with stipulation that conceptual plans be forwarded to Council. Mr. Broman further stated that the Development Coordinating Committee expressed no objection to the abandonment. Mr. Larry Richardson, Scottsdale, representing Lewis Brewer Development Company, explained the reasons for abandoning the roads, and outlined the possible street development. PROPOSED RESOLUTION NO. 85-44, AB-85-10, PLAZA DRIVE Mr. Broman reminded the Council that on May 21, 1985, the Design Concept Report for the reconstruction of U.S. 60/SR 88 was approved, and as indicated on the plan the access to the Bayless Plaza is to be moved north approximately 200', which would make it necessary to abandon the prior alignment of a portion of Plaza Drive, and stated that the Development Coordinating Committee recommends this abandonment, which would be contingent upon reconstruction of the intersection of U.S. Highway 60 and S R 88 Vice Mayor Bakkedahl asked if a barrier would be placed in the abandoned area. Mr. Broman explained that there would not be a physical barrier, that the owner would possibly restripe the parking area of Bayless Plaza to integrate with the reconstruction. Mr. McNulty stated that it would not be in the property owners best interest to barricade that access, and the abandonment essentially relieves the City of liability for that portion of the street which is basically in the middle of the parking lot. These regulations were developed as a result of numerous discussions with the Zoning Ordinance Rewrite Committee and representatives of the local Horsemen 's Association. Many of the items dealing with the health, sanitation and safety that we had originally anticipated being done through these regulations , have instead been addressed through a revision in the City Code section dealing with the keeping of animals. Planning Department Comments Regardless of the regulations implemented, there will always be a problem of conflicts between horse owners and non-horse owners. Between the recent amendments to Chapter 6 of the City Code and the proposed revisions to the Zoning Ordinance, hopefully the property rights of everyone will be maintained. The keeping of horses, unless otherwise specifically permitted or prohibited in a zoning district's regulations, shall be permitted only in residential zones and all lots for the keep- ing of horses shall have a minimum size of either 1} acre gross or 1 acre net. 2 The number of horses permitted on a lot is not limited. However, the owner shall comply with the other regulations contained herein as well as any other applicable regulations of the City and any other agency having jurisdiction I 3. The commercial boarding of horses shall be permitted on lots consisting of a minimum of 21 gross acres and shall be located in an area designated for low density residential uses in the Apache Junction, Arizona, General Plan. 4 Rental trail riding stables, which include any enterprise providing horses and equipment rented on a time basis, may be permitted in any district, subject to a Conditional Use Permit and subject to a minimum lot size requirement of ten (10) acres. 5. Accessory buildings and structures for the keeping of horses /'m., shall comply with the applicable regulations in Section 6.0116, except that for "shade structures" (a structure consisting of a roof supported by columns and used exclusively for the shading of livestock) shall not be considered a structure used for the keeping of animals or livestock, but shall comply with other applicable requirements of Section 6.0116. SECTION II REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this Ordinance or any part of the code adopted herein by reference are hereby repealed. September 17, 1972, is significant because on this date an Arizona State Law went into effect which set forth the standards for mobile homes constructed in Arizona and for those mobile homes proposed for sale in Arizona. Mobile homes constructed in, or proposed for sale in Arizona, as of September 17, 1972, were required to meet American National Standard Institute (ANSI) 119. 1, the nationally recognized standard at the time. According to Jim Bond, Deputy Director of the Office of Manufactured Housing, ANSI 119. 1 is the basis upon which the National Manufactured Home Construction and Safety Standards Act of 1974 and Title VI of the Housing and Community Development Act of 1974 were founded. These "Acts" provided the basis for federal standards as promulgated by the U.S. Department of Housing and Urban Development (HUD) , which, in turn, resulted in the Federal Mobile Home Con- struction and Safety Standard which became effective on June 15, 1976. Further, the Deputy Director stated that there was no significant difference between ANSI 119. 1 and the HUD standards which became effective on June 15, 1976. Mobile Home/Manufactured Housing units proposed for installation or relocation in the City of Apache Junction can be identified as meeting specific construc- tion standards by locating on the dwelling unit the State of Arizona Insignia of Approval (manufactured after September 17, 1972) or a decal certifying the dwelling unit has been manufactured in accordance with HUD standards (manu- factured after June 15, 1976) . 1001 NORTH IDAHO ROAD APACHE JUNCTION, ARIZONA 85220 TELEPHONE(602) 982 8002 Honorable Mayor and City Council Request Agenda Item - October 15, 1985 Proposed Amendment to the City Code Addressing HUD Standard Mobile Homes It appears the major difference between September 17, 1972, and June 15, 1976, as "manufacturing cut-off dates" is the age of the mobile home/manu- factured housing unit allowed to be installed or relocated in the City. Both the City Attorney and the Zoning Administrator have indicated that September 17, 1972, appears to be an appropriate "manufacturing cut-off date", in conjunction with the "Insignia of Approval ". Alternative wording of the ordinance reads as follows: 1. Mobile Home/Manufactured Housing units proposed for installation or relocation in the City of Apache Junction, Arizona, shall be affixed with a decal certifying that the dwelling unit has been inspected and constructed in accordance with the requirement of the U.S. Department of Housing and Urban Development (HUD) in effect at the date of manu- facture wherein such date shall not have been prior to June 15, 1976. This amendment shall not prohibit the continued occupancy of non- certified mobile home/manufactured housing units currently located in the City of Apache Junction, or 2. Mobile Home/Manufactured Housing units proposed for installation or relocation in the City of Apache Junction, Arizona, shall be affixed with either of the following: a. Provide technical assistance and program development assistance , as requested, to new and existing local human service agencies (e.g. development of a Board of Directors, establishing a constitution and by-laws, filing for incorpora- tion, setting up operating policies and procedures, grantsmanship, funding sources, methods of gaining and maintaining public support) . 6 . Help to keep city officials and human service agencies informed about significant changes in human service needs and resources . 7 . In cooperation with the Apache Junction area' s human service agencies and organizations, periodically assess the effectiveness, overlapping, gaps, efficiency and deficiencies among such programs and recommend, as needed, new or better ways for them to meet needs. 8 . Help to coordinate, when appropriate, the efforts and resources of local human service agencies (e .g . Epicenter, Reach Out Food Bank, Salvation Army, Catholic Social Services, etc . ) . C. PROGRAM DEVELOPMENT ACTIVITIES The Foundation will assess and prioritize local human service needs and will serve as a catalyst in develop- ment of appropriate community programs/services accordingly. For example, 1984 surveys by the Foundation of a variety of key local human service providers* identified the following priority community needs : (a) more assistance to senior citizens, especially in the areas of health screening and health care, employment services, legal aid, block watch and telephone reassurance programs, housing, adult day care, consumer protection, housekeeping services and transportation; (b) more services for children, especially emergency dental care, child abuse (physical and sexual) , teenage pregnancies, affordable day care centers, parenting classes and affordable medical care; and (c) expansion of the Food Bank' s services, along with counseling/ training programs to help the unemployed find -lobs. Resolution of some human service-related problems is neither within the capabilities nor the feasible responsibilities of the Foundation (e.g. versus the City, State or other) . However, the Foundation is in a position of being able to make recommendations *Human service agency directors, social workers, public health workers, educators and school nurses . concerning priorities of needs and appropriate other resources. A major goal, in this respect, is to help prevent human service needs of Apache Junction residents from outracing community and other resources for resolving them. The Foundation and its resources will assist the City in both short and long range efforts to help meet the area' s rapidly growing human service needs and do so in an orderly and coordinated fashion. D. OTHER ACTIVITIES 1 . Conduct special studies/evaluations for the City and for the Pinal County United Way' s efforts in Apache Junction. 2. Assist the City with its Community Development Block Grant and other planning efforts if requested. III . Quantitative and qualitative measures to be used to evaluate the services. Progress reports concerning services being provided to the City of Apache Junction will be given to the City Manager on a quarterly basis (or more often if a need is indicated) . Program evaluation can, thereby, be conducted by the City Manager and City Council in terms of how well the services described herein are being implemented. The project consists of four major areas that will help us satisfy the information and recreational needs of the senior residents and winter visitors. First we are requesting funding for additional large print materials. Second, we are requesting funding for audio cassettes. Third, we are requesting a projection television system for providing video programs in a large format. Finally, we are requesting travel money to reimburse volunteers for mileage in participating in a homebound delivery service. These four areas should cover library service to nearly all of the older residents of Apache Junction - to the mobile and healthy, to the mobile with limited visibility, to the citizen with limited mobility, and to the homebound or institutionalized elderly. The committee which screens requests of libraries for grant funds is constantly looking for assurance from the governing agency of the library making the request that the project will not end with the end of the grant period. The commitment required in this case would be that the collections begun with grant monies would be maintained by the city and that travel funds for the volunteer-run homebound service would be available in subsequent years. We would be purchasing base collections with grant funds with an expectation of maintaining the collections through increased book and cassette budgets in the future. A resolution to support this grant may result in a substantial improve- ment to the library's services to the elderly. These will be available to the public 53 Mr Newcomer Spoke about the Land Split Ordinance. Lot sizes were upped so they are back to the drawing board Hope to be finished in a month. Also answered questions regarding the fee schedule for this matter. 54 Mr Taylor Asked if this would come back to them 55. Mr Newcomer Stated that this was his recommendation that it go to the Commission first even though it is in the Subdivision Ordinance and isn't required by the City Code, it's still a major impact on future planning and development of the City 56 Mr Taylor Asked if they would have a work session on Lot Split - Land Split Ordinance? 57. Mr. Newcomer Stated that would be possible 58. Mrs. Conway Concerned that there should be a work session especially for real estate people 59 Chairman Asked Mr. Jorgensen if he still cared to have an initiative added to the future agenda. 60 Mr Jorgensen State he would concerning building height and how it's determined He recommended that as a Commission we make an initiative that building height be determined by actual measurement from the highest point to grade or from grade to highest point on the structure and that be considered the building height. Stated that at present the formula that's used allows a couple of feet higher than what the ordinance states Most people are quite vehement about their views not being obstructed. 61 Chairman Appropriate to direct staff to investigate the best way to handle this. 62 Mr Newcomer Will put it on the next agenda and will get diagrams that show how the building height is determined. 63. Mrs Conway Asked questions about the APA meeting in Mesa, regarding when and how to meet 64.
