REGULAR MEETING OF THE CITY COUNCIL DECEMBER 17, 1985 PAGE 2 OF 16 PUBLIC HEARINGS PROPOSED ORDINANCE NO. 450, LOT SPLIT (With the Emergency Clause) Director of Planning Chuck Newcomer briefed the Council on the proposed amendments to the original draft of Ordinance No. 450. Mayor Hill opened the hearing to the public. Mr. Ray Hooker, 565 W. 16th Avenue, Apache Junction, real estate broker, addressed the Council in opposition to the ramifications of the proposed ordinance should it be adopted. Mr Keith Stachar, 6301 E. Roundup, Apache Junction, real estate broker, spoke in opposition to the proposed lot split ordinance. Mr. John Granillo, Jr., 400 W. 23rd Avenue, Apache Junction, expressed opposition to the proposed ordinance. Mr. Wendell J. Clarke, 2385 S. Cactus, Apache Junction, requested that this proposed ordinance be denied. Mayor Hill asked if there was anyone else who wished to speak on this issue. There being on one else wishing to address the Council, Mayor Hill closed the hearing to the public. Councilman Jimenez MOVED THAT ORDINANCE NO. 450, BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. 11 Councilwoman Gardner seconded the motion. City Clerk Kathleen Connelly read as follows. /► ORDINANCE NO. 450, AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING ARTICLE III OF THE APACHE JUNCTION SUBDIVISION REGULATIONS BY SETTING FORTH STANDARDS, PROCEDURES, AND REQUIREMENTS FOR LAND SPLITS; REPEALING ANY CONFLICTING PROVISIONS; AND PROVIDING FOR SEVERABILITY. Councilman Baljo MOVED THAT ORDINANCE NO. 450, AS READ BY THE CITY CLERK, BE POSTPONED FOR REVISION AND FURTHER CONSIDERATION UNTIL THE FIRST REGULAR CITY COUNCIL MEETING OF JUNE, 1986. Councilman Eidson seconded the motion. Councilman Baljo stated that this action would give pro and con parties a chance to further consider any proposed ordinance on this issue, as well as preventing the ordinance from being submitted with further revisions at the next meeting. Councilman Eidson explained that the Planning and Zoning Commission denied this ordinance, feeling that this would only cause problems for the seller or buyer, with very little benefit to the community. REGULAR MEETING OF THE CITY COUNCIL DECEMBER 17, 1985 PAGE 3 OF 16 emPrnor Councilwoman Taylor stated that a survey was done in surrounding communities on lot split ordinances, revealing that cities that are entirely developed found it necessary to have lot split regulations, but that cities that are not completely developed have discovered that this type of regulating would stop growth, and further stated that it is the duty of the Council to protect the community, but that "protectionism" is worse than a disease. Councilman Jimenez expressed strong i^ support for the study and work accomplished by the staff in attempting to organize the community neighborhoods, and further stated that this ordinance would benefit our city. Vice Mayor Bakkedahl stated that this ordinance, in it's revised form, is basically requiring a survey of the property, and expressed approval of these proposed regulations. VOTE. In Favor: Councilman Eidson, Councilwoman Taylor, Councilman Baljo, Mayor Hill Opposed: Councilwoman Gardner, Councilman Jimenez, Vice Mayor Bakkedahl The motion carried. PROPOSED ORDINANCE NO. 407, PZ-41-85, WIRTH ) Mr. Newcomer stated that Mr. Richard Wirth, applicant for the rezoning, has submitted a letter requesting that this application be postponed. VOTE: Unanimous The motion carried. ^k PROPOSED ORDINANCE NO. 453, AMENDMENT TO SUBDIVISION REGULATIONS) Mr. Newcomer explained that this amendment changes the composition of the Subdivision Committee to include: the Planning Director, Director of Public Works, Director of Public Safety, Chief of the Fire Department, Building/Zoning Official, and the City Engineer. Mayor Hill asked if there was anyone who wished to speak in favor of or in opposition to the proposed ordinance. Mr. Keith Stachar, 6301 E. Roundup, Apache Junction, addressed the Council as a member of the Subdivision Committee, opposing the changes which exclude public members from the Committee. Mr. John Granillo, Jr., also addressed the Council, objecting to the amendments to the Subdivision Regulations which would result in the exclusion of public representation on the Committee. Mayor Hill asked if there was anyone else who wished to address the Council on this amendment. There being no one else wishing to speak, Mayor Hill closed the hearing to the public. ORDINANCE NO. 453, AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE CITY CODE OF APACHE JUNCTION, ARIZONA, VOLUME II, LAND DEVELOPMENT CODE, CHAPTER 2 SUBDIVISION REGULATIONS BY AMENDING SECTION 6.02 (1); REPEALING ANY CONFLICTING PROVISIONS; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT. SECTION I IN GENERAL The Apache Junction, Arizona, City Code is hereby amended by amending Section 6.02 (1); to read as follows- SECTION 6.02 (1) 1. The Subdivision Committee is hereby established and shall consist of the following members or their duly authorized representatives: A. The Planning Director, who shall be Chairman B. The Director of Public Works, who shall be Vice Chairman C. The Director of Public Safety Amt. D. The Chief of the Fire Department E. The Building/Zoning Official F. The City Engineer SECTION II REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this Ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section, sub-section, sentence, phrase, clause or portion of this Ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. PROPOSED ORDINANCE NO. 456, PZ-70-85, NRB PARTNERSHIP Mr. Newcomer briefed the Council on the request for rezoning from Trailer Homesite by Planned Development to Multiple Family Residence by Planned Development of eight combined parcels of 33.51 acres, which has a general plan designation of medium/high residential opportunity, located on the west side of Idaho Road, just north 'Irk of the Lost Dutchman Travel Trailer Park Annex. Mr. Newcomer further stated that the Planning and Zoning Commission recommends approval of the application with stipulations. Mr. Gene Larson, representing NRB Parnership, 4250 E. Camelback, Phoenix, explained that the proposed use is a multi-family housing complex, with a mixture of one and two-story buildings. Mayor Hill asked if there was anyone who wished to speak in favor of or in opposition to the rezoning. There being no one wishing to address the Council, Mayor Hill closed the hearing to the public. PROPOSED ORDINANCE NO. 459, OBSCENITY AS A PUBLIC NUISANCE AND AMENDMENT TO THE ZONING ORDINANCE, BY PROVIDING ZONING CLASSIFICATION IN WHICH ADULT ACTIVITIES MAY BE CONDUCTED (With the Emergency Clause) Mayor Hill opened the hearing to the public. Councilman Eidson explained that the proposed motion was drafted by City Attorney Alexander at the request of the Council. City Attorney Alexander stated that proposed Ordinance No. 459, declares those items of obscene materials a public nuisance, which are contained in the State of Arizona Criminal Law, and explained the proposed amendment to the Zoning Ordinance. Mayor Hill asked if there was anyone who wished to speak on this item. There being no one wishing to address the Council, Mayor Hill closed the hearing to the public. Councilman Eidson MOVED THAT SECTION 13.010 OF THE CITY OF APACHE JUNCTION ZONING ORDINANCE BE AMENDED TO PROVIDE FOR THE LOCATION OF BUSINESSES INVOLVING ADULT ACTIVITIES. SAID AMENDMENT SHALL ADDRESS THE ZONING CLASSIFICATIONS IN WHICH SUCH ADULT ACTIVITIES MAY BE CONDUCTED; SHALL DEFINE A MINIMUM DISTANCE FROM SCHOOLS, CHURCHES, AND RESIDENTIAL AREAS WHICH MUST BE MAINTAINED BY ADULT ACTIVITIES; AND SHALL PROVIDE FOR SPECIAL USE PERMITS OR OTHER REGULATIONS REQUIRED TO REGULATE ADULT ACTIVITIES. Councilman Baljo seconded the motion. VOTE: Unanimous The motion carried. PROPOSED ORDINANCE NO 460, COUNCIL SALARIES City Clerk Kathleen Connelly explained that at the request of the Council, two options are provided of the proposed ordinance, the first option would increase the salaries of the staggered terms of the Council to $200 at the time the terms expired, and the Mayor's salary would increase to $400 with the commencement of the new budget year, with the remaining members of the Council receiving the increase when the terms expire in 1989. Ms Connelly further explained that the second option would increase the salaries the same as the first option beginning with the budget year in 1989. Mr. Broman stated that the Development Coordinating Committee recommends approval of the abandonment with conditions. Vice Mayor Bakkedahl felt that this abandonment was not necessary. The engineer for the project addressed the Council with the problems caused by the incorrect legal description, explaining why the abandonment is necessary. The West Smoketree Street alignment was abandoned (AB 81-7, Resolution 81-21 ) January 5, 1982, along with the N.Gold alignment. PROJECT DESCRIPTION The proposed project is a 66 unit family mobile home park by planned development. 15% open space has been provided in the form of retention and recreational areas. The density for the development would be 6.6 spaces per gross acre. Lot sizes would range from 3510 square feet to 5040 square feet, the required area being 3000 square feet. There have been protests filed on this case. The protests constitute over 20% of the property directly adjacent to the subject site along one side and will have the effect of requiring a favorable vote of three-fourths of the City Council for approval . PLANNING DEPARTMENT COMMENTS AND RECOMMENDATIONS The proposed development conforms to the General Plan designation for this location. A planned development may be granted only if it is found that the development conforms to all six criteria set forth in Section 19.0109 of the Zoning Ordinance. If approved staff would recommend the following stipulations: 1 . No travel trailers be allowed in this development. 2. Five to six foot block wall be required around the perimeter of the project. 3. All setbacks required by Section 15.0800 of the Zoning Ordinance be met and adhered to. 4. The dedication of the east thirty-three feet (33' ) of the subject property for public roadway and associated purposes. PLANNING AND ZONING COMMISSION RECOMMENDATIONS: At the regular Planning and Zoning Commission meeting of November 12, 1985, the proposed rezoning was returned to the applicant for revisions and the hearing was postponed until December 10, 1985. The General Plan has designated the commercial areas at the intersection of Broadway and Ironwood into General Commercial north of Broadway and Ironwood and Local Commercial south of Broadway. 2. The northwest corner of this intersection was zoned CB-2 General Commercial prior to the time the city was incorporated. The northeast corner of this ,.� intersection was rezoned to CB-2 General Commercial in May, 1984. Both of these corners comply with their General Plan designation. 3. The Southwest corner of this intersection has a Local Commercial General Plan designation, however, in September, 1984, this site was rezoned from CR-3 Single Family Residential Zone to CB-2 General Commercial . The rezoning request was passed without restrictions even though it did not comply with the General Plan. 4. Currently, there are no commercial businesses open at this intersection. There is, however, a commercial plaza under construction at the southwest corner of the intersection. As construction of commercial uses is completed at this intersection there will be an increase in traffic congestion in this area. The CB-2 General Commercial zoning classifications could generate unde- sirable types of traffic such as the larger and heavier semi-trucks, as could certain uses within the C-3 classification. 5. Consideration will have to be given to the type of traffic control devices required by the increase in traffic caused by these developments. 6. An additional factor, in relationship to traffic and uses, is the close proximity of the Superstition Elementary School . 7. On the application for rezoning the applicant stated that the intended use for the site is a shopping center. The C-2 district will accomodate most typical shopping center uses, except for alcoholic beverage sales which would �► require a conditional use permit. Another restriction in C-2, not in C-3 is the maximum floor area limitation of 4,000 square feet for an individual business. 8. A final consideration would be the impact of commercial development to the existing single family residences across the street to the west. Special care will need, to be taken in placement of the southernmost entrance as head- lights from exiting evening traffic could illuminate the front rooms of these residences and become a real nuisance. Roadway dedications have been made previously. This committee was to consist of two park owners/managers who have parks with pre-1976 mobile homes, two residents of pre-1976 mobile homes, two mobile home dealers, one Council representative, a representative from the State Office of Manufactured Housing, and a representative from the Mobile Home Association. This committee was to submit a report within 120 days. Mayor Hill as the Council representative, and one mobile home resident have already been appointed. AGE SPECIFIC ZONING -PZ-83-85 APACHE VILLA SUBDIVISION AGENDA ITEM REQUEST - JANUARY 7, 1986 Residents of the Apache Villa subdivision have met numerous times with city staff to discuss age specific zoning for the subdivision. Units 2, 3, 4, and 5 contain age specific restrictions in their deed restrictions. For Unit 1 , to doc- ument that it has been sold, rented, and developed as a retirement community, the following has been submitted: deed restrictions applicable to 25 lots in Unit 1 , deed restriction amendments signed by a majority of property owners in Unit 1 , statements from the developer, purchasers, salespersons and newspaper advertisements. If the Council desires this to be handled by initiative (versus an application to be signed by 75% of the property owners) the following motion is recommended: "I move that the City Council initiate an amendment to the Apache Junction, Arizona, Zoning Ordinance by amending the Zoning Map to establish the Age Specific (AS) Overlay Zoning District on the area known as Apache Villa sub- division, Apache Villa Unit 2 subdivision, Apache Villa Unit 3 subdivision, Apache Villa Unit 4 subdivision, and Apache Villa Unit 5 subdivision. And further, that the Planning and Zoning Commission shall hold a public hearing on this proposed amendment and that mailed notices to property owners within the area of the proposed change or within 300 feet shall not be required." In letter from Mr. Oaklie Ray (developer of Apache Villa) on December 4, 1985, he stated that their sales persons, at time of sale of lots in Unit 1 told all purchasers that they would not sell to anyone under 45 or that had children under 18. Newspaper ad dated March 5, 1972, in Arizona Republic for Apache Villa with words, "Retirement at its best". Letter from Lynnwood J. Miles Realty stating that they sold 10 homes in Apache Villa in 1972 and 1973. Sales literature contains words, "retirement area", which was given to all prospects. Letters from 4 homeowners in Unit 1 stating that the subdivision was represented to them as a retirement community and that no one under 45 was able to purchase a home. The latest information received indicates that the structure will be constructed to accommodate a 28' paved roadway with 10' shoulders and an embarkment slope of 12' : 1 ' . This section should be adequate to meet existing and short term transportation needs; but may fall substantially short in meeting the increased traffic development demands considering rapid development as projected for the future, coupled with the extension of freeways and the planned Red Mountain Freeway. Therefore, it is recommended that consideration be given to a resolution which would provide for an expanded section to accommodate the ultimate street section that could be developed (74' back of sidewalk to back of sidewalk plus a 5' shoulder to the top of the embankment slope). Additional consideration should be given to the fact that if the future road base is not constructed with the initial project that expansion in the future will be extremely expensive and complicated as it will impact the stormwater storage volume, require environmental impact studies, require addition relocation due to new development, require additional right—of—way and be delayed as due to the Federal Government involvement, all at future inflated costs. At this time, the Chief Engineer and General Manager has indicated that expansion as suggested is not normal policy; however, this matter will be placed on the Flood Control District's Advisory Boards agenda for January 22, 1986 for discussion and comments from Apache Junction. A very large percentage of permit requests are from individuals who want to do their own work. Because we have a building code everyone is required to meet the requirements that apply to their project. The new position will enable us to have an inspector on hand to answer questions, review plans, and explain what is necessary to obtain a permit with as little trouble as possible. We also feel that with this new position we ,` would be able to offer classes in code compliance to the community. This position will be able to be funded through the division's budget because of the change in the Chief Inspector's position, now paid less than old, and the replacement of the Plans Examiner. This position would be a second Plans Examiner. The requested position for the Public Safety Department is in the records section. The need is based on the amount of records being handled. In 1980 there were 2,000 records handled, in 1985 there were 9,022. This is a 350 percent increase in workload. Up to now the computer and the new filing system have enabled the existing clerk to keep up with the load. However, the increase is getting beyond our person's capacity. A complete list of the duties and responsibilities of the position are attached. The cost of the position will be borne by the Department's budget through salary savings and will not require supplementing from the contingency fund. Does related work as required. �. Responsible for taking calls from the public and processing them for appropriate police action. Work involves the maintenance of computerized and manual files of varied complexity. The employee ensures correctness of input and retrieval of file information. Considerable judgement and care are used in supplying department information to requestors. Duties are performed within the confines of established division procedures and policies. The employees is expected to exercise judgement in accordance with policies. Supervision is received from the Administrative Lieutenant who is available to provide technical assis- tance. EXAMPLES OF WORK Miscellaneous Offense Reports and Field Interview Cards -Prepare miscellaneous offense reports, arrests and accidents for data entry. -Enter all date into computer. -Prepare supplemental reports for entry into computer, updating reports, clearing reports, deletion, filing and dissemination. -Enter appropriate data and maintain Uniform Crime Report. Enter -number and kind of criminal acts that occur -personal characteristics concerning persons arrested -law enforcement dispositions of juveniles -law enforcement employee information -continuously update Uniform Crime Report on a daily basis. -Update dispositions both adult and juvenile. -Dissemination -Process and disseminate requests from the daily Miscellaneous Offense Reports to: Juvenile Probation, City Attorney, County Attorney, Liquor Board, Medical Examiner. -Process and disseminate Accident Reports to: Arizona Department of Transpor- tation, Public Works and the Administrative Lieutenant. -Process mail requests for: insurance agencies, attorneys,and victims. -Process phone requests for: insurance agencies, criminal justice agencies and the public. -Process In-House requests for: Detectives (make copies of reports and mail to specified agencies) , Officers ( retrieve information from computer and files) , Military, Public and Criminal Justice Agencies. -Establish and maintain police records filing system. -File daily miscellaneous offense reports, property sheets, fingerprints, photo- graphs, rap sheets, insurance finals, etc. -Maintain stolen property file. Type and file card and clear when property is recovered. -Responsible for intra and inter-office training. -Responsible for these duties weekly: processing fingerprints cards from arrest sheets and mail, process accident reports and disseminate to appropriate depart- ment and agencies and disseminate pawn shop slips to specified agencies. -Responsible for these duties monthly: Uniform Crime Report, each officers . 1 activity log on a monthly basis, maintenance information kept on each police vehicle during the month. Detectives activity logs on a monthly basis. -Entry of back reports -Maintenance of Detectives Files -Computer maintenance, addition and deletion of codes, constant adaption of computer programs. -Computer programing training. -Updating changes in local,state and national laws and policies governing dissemination, Uniform Crime Report, etc. -Working with the main frame programer to develop new programs and revise old ones for more efficient operation. -Accept checks from public for accident and other reports making receipts when required. REQUIRED KNOWLEDGE, SKILLS AND ABILITIES Considerable knowledge of divisional policies, operating procedures and methods. Knowledge of departmental organization and some knowledge of the city streets and areas. Knowledge of office methods and equipment. Skill demonstrated in typing at a rate of 40 words per minute. Ability to process a high volume of important documents and to use complex office equipment. Ability to maintain complex alpha and numeric filing systems. Ability to courteously and effec- tively dealwith the public by phone and in person and the ability to remain calm and think clearly and quickly in emotional and emergency situations. The ability to perform effectively on a consistent basis although interrupted. Mr Newcomer said that it was not a common procedure but a procedure that could be instituted when the applicant is going for a rezoning and a project scheme at the same time.'' 10. Mr. Berry asked why the Board of Adjustment was being asked for this request before a request for a rezoning was heard by the Planning and Zoning Commission. 11. Mr Newcomer explained that it was just a matter of scheduling 12. Chairman asked if the applicant wished to speak. 13 Mr. Skidmore said that he was one of the developers for the project. He said the reason that a request for a zero lot line is being made is that the exterior of the building is almost always, the next person's fence He said there is no way to put a landscape buffer in there, maintain it and still provide access He said they felt it was the best use of the property. He explained the reason that the wall changes heights at different places is so that they can retain their own water 14. Mr. Warin said he is one of the partners of ICAM Properties and they are in the process of selling the property to Skidmore/ Rottweiler Partnership. He said they still own property to the west of the subject property He felt the highest and best use of theme' land would be for Commercial use He was in favor of the requested variance 15. Mrs Bennett spoke of her concern as to why a twelve foot wall is needed. 16. Mr. Kane asked if it were a wall or a building that was going to be built. His concern was that the water did not overflow into the church parking area. 17.
