MEMORANDUM TO: HONORABLE MAYOR AND MEMBERS OF THE
CITY COUNCIL
FROM: LCITY MANAGER
SUBJECT: DESERT VIEW
Shortly after the Council meeting at which this subject was discussed, I and
the City Attorney met with the attorney representing several of the area
residents and the developer. At this meeting certain goals were discussed
and we parted with the understanding that the attorney representing the
residents would get back to us. Before anything could happen he was terminated.
This brings us back to square one.
If the people are to acquire the right to continue to have right-of-way over
the land they must do so in court. The City can not. If the City is to acquire
the property it can be done by dedication or purchase.
In the past the City only required the dedication of one-half of the streets on
the edges of a development. In this particular case it would require more
than half of the street to be dedicated by the developer. If we were to buy
the property I feel we open the City up to purchasing streets from now on.
The developer has the option of starting legal action to secure his right of
ownership. Unless he does so, this situation could continue since the people
would have a right at any time to assert their right-of-way across the property.
It is my recommendation that the City advise the developer that until this
problem is solved his development, as planned, cannot be approved.
