SUBJECT: PROPOSED CHANGES IN COUNCIL MEETING PROCEDURES
As you are well aware , Council agendas have become increasingly
longer during the past few months . Due to the overall growth of
the city, the increasing number of rezoning and abandonment
applications , items of general procedure and statutory requirements ,
the trend toward longer and longer agendas will continue .
In an effort to streamline Council meetings and yet conduct them
professionally and within the requirements of the City Code and
State law, several changes in procedures may be considered by
the Council as follows:
A. Eliminate the requirement to have two separate readings ,
at least 24 hours apart , of any ordinance that is
written without the emergency clause . This is a
requirement imposed by the City Code . There is no
basis for it in State law. By making the second
separate reading optional , instead of mandatory,
the Council would be able to hold a public hearing
on an ordinance , discuss it and hold the vote on the
same night . The procedure would be similar to that
used in the adoption of an ordinance with the
emergency clause with the exception that the ordinance
would not become effective for 30 days .
An optional second reading would enable the Council
to vote on routine and non-controversial ordinances
immediately after the public hearing . There would be
no need to carry over the ordinance to the second
meeting , which would considerably shorten the motion
used to adopt the consent agenda and would save
time and money in preparation of the packet .

Meeting Procedures
The City Council would , of course , still have the
option of postponing action on the ordinance until
a later date if more discussion or research was needed .
Making the second reading optional would considerably
shorten both the consent and regular agendas , stream-
line administrative procedures , especially in the
area of zoning . Adoption of this optional procedure
would have to be in the form of an ordinance
amending the City Code .
B . Modify the method by which the Council makes a motion.
Presently, every motion is preceded by the phrase "Be
it resolved by the Mayor and City Council of the City
of Apache Junction, Arizona , that" . This phrase serves
no particular purpose and , in many cases , is redundant
since similar wording is contained in the document
being adopted . Robert ' s Rules of Order recommends
using the phrase "I move that" or "I move to" . The
suggested motion would still be printed in the packet
in the shorter version .
C . Increased use of the consent agenda to adopt minutes
and routine items . Abandonments , resolutions , and
applications for liquor licenses are examples of
items that could be placed on the consent agenda .
Any member of the Council would be able to remove
any item from the consent agenda if so desired .
All items on the consent agenda would be specifically
..�. outlined so that the motion to adopt would be "I
move that Items Numbered through as listed
on the consent agenda be adopted . " This would
eliminate the need to spell out each item individually
in the motion.
These proposed changes will be discussed at the November 5th work
session. If the Council wishes to adopt any of these procedures ,
they will not appear until the November 2oth regular meeting .

Sec. 2-4-9 Suspension of Rules
• Any of the provisions of this chapter may be temporarily suspended in
connection with any matter under consideration by a recorded vote of
three-fourths of the members present, except that this section shall
not be construed to permit any action that is contrary to state statutes.

Section 2-5-1 Prior Approval
All ordinances, resolutions and contract documents shall, before formal
presentation to the council, have been reviewed as to form by the attorney.
4111 When there are substantive matters of administration involved, all ordinances,
resolutions and contract documents shall be referred to the person who
will be charged with the administration of such ordinance, resolution
or contract. Such person shall have an opportunity to present comments,
suggestions and objections, if any, prior to the passage of the ordinance,
resolution or acceptance of the contract.
�. Sec. 2-5-2 Introduction
Ordinances, resolutions and other matters or subjects requiring action
by the council shall be introduced and sponsored by a member of the
council, except that the attorney may present ordinances, resolutions
and other matters or subjects to the council, and any councilman may
assume sponsorship thereof by moving that such ordinance, resolution,
matter or subject be adopted; otherwise they shall not be considered.
Sec. 2-5-3 Same Day Passage Prohibited
No ordinance, except an emergency ordinance, shall be put on its final
passage on the same day on which it was introduced.

Sec. 2-5-4 Two Separate Readings
®' All ordinances, except emergency ordinances, shall have two separate
readings, but the first and the second reading shall never be made on
the same day. The first reading may be by title only, but the second
reading shall be in full unless the council, in possession of printed
copies of said ordinance, shall unanimously allow reading by title only.
Sec. 2-5-5 Requirements for an Ordinance
Each ordinance may have only one subject, the nature of which is clearly
expressed in the title. Whenever possible, each ordinance shall be
introduced as an amendment to this code or to an existing ordinance and,
in such case, the title of the sections to be amended shall be included
in the ordinance. --
Sec. 2-5-6 Effective Date of Ordinances
No ordinance, resolution or franchise shall become operative until
thirty days after its passage by the council and signature by the mayor,
except measures necessary for the immediate preservation of the peace,
health or safety of the city. Such an emergency measure shall not
become immediately operative unless it states in a separate section
the reason why it is necessary that it should become immediately
operative, and unless it is approved by the affirmative vote of three-
fourths of all the members elected to the council taken by ayes and
nays.
Sec. 2-5-7 Signatures Required
Every ordinance passed by the council shall, before it becomes effective,
be signed by the mayor and attested by the clerk.
Sec. 2-5-8 Publishing Required
Only such orders, resolutions, motions, regulations or proceedings of the
council shall be published as may be required by state statutes or
expressly ordered by the council.
Sec. 2-5-9 Posting Required
• Every ordinance imposing any penalty, fine, forfeiture or other punish-
ment shall, after passage, be posted by the clerk in three or more public
places within the city and an affidavit of the person who posted the
ordinance shall be filed in the office of the clerk as proof of posting.
