Cam, y ii V Z ft.: / • � • 1Z��� o C . ity A pache &unction June 5, 1985 MEMORANDUM TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL THROUGH: CITY MANAGER 7q FROM: APACHE JUNCTION PUBLIC LIBRARY BOARD SUBJECT: REQUEST FOR AGENDA ITEM FOR JUNE 18,1985, CITY COUNCIL MEETING The Apache Junction Public Library Board members would like the opportunity to approach the City Council on the subject of the disposition of the current library building. Mr. Charles Russell will act as the spokesperson for the Board in presenting the Board's wishes as to the method of disposition of the current library building and their desire to be fully involved in the disposition process. Other members of the Library Board may also desire to express their opinions following Mr. Russell's remarks. Board members feel it is their duty to protect the interests of the individuals who first established the library in Apache Junction, and desire to see that the wishes of the organization who donated the library to the City are carried out in the spirit with which the original agreement giving the library to the City was made. 1 C01 NORTH IDAHO • APACHE JUNCTION,ARIZONA 85220-0190 • TELEPHONE(602)982 8002 AGREEMENT FOR DONATION OF LIBRARY TO THE CITY OF APACHE JUNCTION , ARIZONA This Agreement made and entered into by and between THE CITY OF APACHE JUNCTION , a municipal corporation , hereinafter referred to as "CITY" , and the APACHE JUNCTION LIBRARY ASSOCIATION , .�. a/k/a APACHE JUNCTION PUBLIC LIBRARY ASSOCIATION , INC. , herein- after referred to as "ASSOCIATION" . RECITALS : 1 . Association is the owner in fee simple of certain real property , a library building and certain fixtures and personal property located at 122 East Second Avenue, Apache Junction , Arizona, whose legal description is : Lots 50 and 51 , APACHE JUNCTION PLAZA, according to Book 10 of Maps , Page 41 , of Pinal County , Arizona. 2. City was incorporated on November 24 , 1978 , and currently has no public library. 3 . Association wishes to donate its real property , library building, fixtures and personal property , located at 122 East Second Avenue, Apache Junction, Arizona , to the City, and the City wishes to accept such donation. TERMS : 1. Association hereby donates to the City the Public Library located at 122 East Second Avenue, Apache Junction , Arizona, whose legal description is as follows • Lots 50 and 51 , APACHE JUNCTION PLAZA, according to Book 10 of Maps , Page 41 , of Pinal County , Arizona, said donation to include all the real property owned by the Association at the above described property , all buildings , all cash except the sum of $1 , 500 , fixtures , and personal property located on said property. An inventory of the items included in this transaction is attached hereto and made a part hereof as though set forth in full , as Exhibit "A". 2 The City hereby accepts said donation and agrees to maintain said property in reasonable repair and to use said property for library purposes , however, if the City builds a new City complex which includes library facilities , then the City may sell the donated property or any part thereof , so long as the proceeds of the sale benefit the new library facility. elk The Association donates said property and the City accepts said property with the understanding that the library will continue to operate on said property or a suitable alterna- tive location within the community. 3. The City agrees that all services offered by the library shall be made available to City and County residents alike, except non-residents may be charged a nominal service fee. Said service fee shall not exceed the sum of five dollars ($5. 00) per year for a period of two (2) years from the date of this Agreement. 4. Disincorporation: If the City should be dis- incorporated within two (2) years from the date of this Agreement, the City agrees that upon said disincorpoation the above described library, real property, buildings , fixtures and appurtenances shall revert to the Association. 5. By accepting said property, the City agrees to assume all responsibility, legal or otherwise, in connection with said property and library operation unless or until the above described library, real property, buildings , fixtures and appurtenances shall revert to the Association.
