NEWCOMER, DIRECTOR OF PLANNING PREPARED BY: RODNEY CLASS-ERICKSON, PLANNING ASSISTANT SUBJECT: REQUEST FOR AGENDA ITEM - WORKSESSION - SEPTEMBER 16 , 1985 PROPOSED AMENDMENT TO THE CITY CODE ADDRESSING HUD STANDARD MOBILE HOMES Since mobile home or manufactured housing units are a major element of Apache Junctions residential development, it is in the best interest of Apache Junction's residents and the City's development to ensure the quality of mobile homes proposed for installation or relocation in Apache Junction meet adequate environmental standards , as well as , fire and life safety standards . As of June 1 , 1985, the Arizona Division of Motor Vehicles will refuse to accept application for title or application for Affidavit of Affixture unless the home has been inspected and received a certificate of compliance from the State Office of Manufactured Housing. (Reference Senate Bill 1269) . The purpose of this inspection is to ensure that mobile homes coming into the state of Arizona meet fire and life safety standards. It should be noted that environmental standards are not addressed by this inspection requirement. In addition, mobile homes currently titled in Arizona , regardless of age or use , are exempt from the requirements of Sentate Bill 1269. It would be ineffectual to incorporate this inspection requirement as a part of an amendment to the city code because of the following: 1. It does not address environmental standards. 2. It excludes mobile homes currently titled in Arizona. 3. And, the Office of Manufactured Housing does not have the jurisdiction to conduct inspections upon request of another jurisdiction. 1001 NORTH IDAHO ROAD APACHE JUNCTION, ARIZONA 85220 TELEPHONE(602) 982-8002 Honorable Mayor and City Council Proposed Amendment te^`ie City Code Addressing HUD Standard Mobile Humes September 11, 1985 Page Two At present, the only alternative available which will address environmental standards and fire and life safety standards is to restrict mobile homes proposed for installation or relocation to those manufactured after June 15 , 1976 and affixed with a decal certifying the mobile home was manufactured in accordance with the Department of Housing and Urban Development standards. Several communities in Arizona have restricted residential development with respect to mobile home and manufactured housing units. Lake Havasau City .-. and Bullhead City only allow mobile home units manufactured after June 15, 1976 and in compliance with HUD standards. Mesa and Yuma will allow non-HUD standard mobile home units in parks. However, they restrict mobile homes from development on individual lots unless they were manufactured after June 15, 1976 and manufactured in compliance with HUD standards. The possible wording of an ordinance could read as follows: "Mobile homes or manufactured housing units proposed for installation or relocation in Apache Junction , Arizona, shall be restricted to those manufactured after June 15, 1976 and affixed with a decal certifying that said unit was manufactured in accordance with the Department of Housing and Urban Development standards. This amendment shall not prohibit the continued occupancy of a mobile home or manufactured housing unit not meeting said standards currently located in the City, nor does it prohibit the relocation to another space within an individual mobile home park of non-certified units ." If the City Council decides to pursue HUD standard mobile homes , staff will put the amendment in ordinance form. CRN:RC-E:j1
