receive documentation on these items from the City Manager for their review prior to the meeting Any member of the Council may remove any

2. Approval of Minutes of Regular Meeting of February 16,2010
3 Consideration of Resolution No. 10-05,authorizing the City of Apache Junction to enter into a Mutual Aid Compact
with the Arizona Department of Emergency and Military Affairs.
The City desires,pursuant to A R S §26-308,to participate in the Arizona Mutual Aid Compact(AZMAC)for emergency management,
which covers emergencies and provides the procedures for notifying participating agencies of the need for emergency
assistance, identifies available resources, and provides for compensation of resources
The City of Apache Junction typically employs all of its own resources but sometimes requires the additional assistance of other
agencies to cope with law enforcement emergencies By participating in the AZMAC each of the participating agencies can assist one
another when an emergency occurs by providing resources as are available and needed including, but not limited to,fire, police,
medical and health, environmental,communication,and transportation services to cope with the problems of response
Resolution No 10-05 authorizes the Mayor to sign the AZMAC agreement on behalf of the City
E AWARDS, PRESENTATIONS AND PROCLAMATIONS.
Awards,presentations from other organizations,proclamations issued by the mayor, and acknowledgement of distinguished guests and
visitors, and staff presentation of receipt of grant or donated funds are permitted at this time
4 PRESENTATION OF A LEADERSHIP IN ENERGY AND ENVIRONMENTAL DESIGN CERTIFICATE TO THE
MAYOR AND CITY COUNCIL.
Roger G Schweirjohn, President of Habitat for Humanity Central Arizona,will present to the Mayor and Council a Leadership in
Energy and Environmental Design(LEED)certificate recognizing the fact that all of the homes in the Ironwood Trails Subdivision have
received their LEED designation To receive LEED designation,each home must have met extensive criteria established by the U S
Green Building Council
Each of the homes in the Ironwood Trails Subdivision was provided a solar energy package by Salt River Project

Ordinance No 1359 allows for the continuation of the 2%sales tax as originally adopted by Ordinance No 1129 in May 2000

The regular meeting of the City Council of the City of
Apache Junction, Arizona, was held on February 16, 2010, at the
Apache Junction City Council Chambers pursuant to the notice

Pinal County Supervisor Bryan Martyn complimented city staff on
their assistance with the Lost Dutchman Marathon. He then
presented a check in the amount of $1, 000 as a donation towards
the purchase of fireworks for the Fourth of July Celebration.
ANNOUNCEMENT OF CURRENT EVENTS
Mayor Insalaco commented the Lost Dutchman Marathon was great
for the city and the whole area He talked to people from all
over the world who came to the race He thanked the parks and

recreation staff and all the volunteers who assisted and thanked
the community for all its support .
CITY MANAGER' S REPORT
City Manager George Hoffman commented on economic development in
the traditional sense and tourism. He read some comments from
the Lost Dutchman Marathon website He thanked the mayor,
Councilmember Barker, city staff members, Lost Dutchman Marathon
committee members, and everyone else who assisted at the event
They have been communicating with State Parks management to keep
Lost Dutchman State Park open, there is a meeting on it tomorrow
morning.

addressed the council They have been open already, but they
want to let everyone know that they are open. They will have
fencing around and security so that no one can leave with

Director Brad Steinke briefed the council on the item
Councilmember Dietz commented
it states in their packet that this is a public hearing only and
no action was to be taken on this tonight

Brad Steinke stated they do not have to take action tonight, but

because the time clock is ticking, there is a time period within
which they must take action
Councilmember Dietz commented
it states they must take action by March 21 .

Mayor Insalaco opened the
public hearing on the item
Ms . Debbie Johnson, the
applicant, stated she has bought the property on Acacia. It is
a developed piece of land with water, sewer and electricity
She was fortunate enough that they removed the debris before she
purchased it, but the debris was removed two years ago. She
asked if they would waive the fee so that she can move her home
on the property without any more financial troubles

Councilmember Coleman asked
if they could comment
City Attorney Joel Stern
stated since this is the applicant it is not really part of the
public hearing They can ask her questions and she can ask
questions in return They can then reopen the public hearing.
Councilmember Coleman
commented he does not have any questions for her He wanted to
say the intent of the development fees is for an increase in the
usage This one is not an increase in the usage or intensity
like others are. In his opinion, it should not be applied in
this case

Ms . Debbie Johnson thanked
him and commented she likes the way that the monies are divided
and where it is supposed to go They are good places for the
money to go.

public hearing on the item There being no one wishing to
speak, he closed the public hearing and reopened the item to
council discussion.
Councilmember Wilson
commented he talked to two other people this week that are
basically doing the same thing They purchased land that
formerly had mobile homes on them. They were kind of
blindsided One of them wants to put a manufactured home on it,
the other wants to build a stick built home on it . In talking
to one owner that has removed an old mobile home, he removed it
because vagrants were coming in and taking it over He did not
want the liability costs on it . He did not know when he removed
it that he would be faced with development fees It is not just
her, it is also affecting others
City Clerk Kathleen Connelly
asked if the council is prohibited from voting on this tonight
City Attorney Joel Stern
stated he did not believe so. They have the window. They could
also continue it to a date certain such as the next meeting or
the one after that . It must be done before March 21
Mayor Insalaco commented the
sooner they solve this, the better.
Councilmember Serdy commented
365 days is okay, but if they go to 366 days it is a problem
He has a problem with that time limit .
Mayor Insalaco commented they
all do.
Councilmember Dietz commented
he would like to see that changed in the ordinance. He does not
know if it needs to come back as a direction to staff or what

the process would be to get that taken care of It needs to be
looked at and squared away
City Attorney Joel Stern
stated it would have to be a separate ordinance to change it in
the future
Councilmember Dietz commented
he understands that . This is one that they need to look at and
Om% take care of so that they do not inconvenience people in the
future. He believes everyone on the council is in agreement
that this is not something they would want to do.

observe the second part as it is not on the agenda.

this is great He is glad they are bringing it up because this
will actually pay for this person' s salary and benefits .
Mayor Insalaco opened the
public hearing on the item
Mr Mike Weller, 471 W 21st
Avenue, Apache Junction, addressed the council . He commented he eS
is with a group called the White Hats and they have a gentleman
that is working a probation period. In these economic times, he
does not have $65 a month He asked if they could do work or
something It seems like a hardship being put on top of a
hardship.
Mayor Insalaco closed the
public hearing with no one else wishing to speak. He reopened
the item to council discussion.
Councilmember Wilson asked
what would happen with a situation like that just mentioned.
Judge James Hazel stated it
would be up to the city attorney. He would have to say if he
could pass on the fee.
City Attorney Joel Stern
stated he would not overrule a judge.
Judge James Hazel commented
it is a great question. In these economic times, there are many
people that have difficult circumstances The purpose of this
ordinance is to fund the services that the city needs to
provide At the same time, if a person has a hardship, he will
waive the fees That is one of the reasons they came up with
the city work crew that they are using, including the hard work
of Mr. Bell, as well . On Tuesday and Thursday mornings they
have up to 15 people who owe fines to the city who are doing
community service work for the city cleaning the streets around
the right-of-ways Our new probation officer has met with the
senior center about having some of these people serve the meals
and clean up after the meals They are doing the same thing
with the food bank He has always been willing to have a

person, if they cannot afford it, work off their fine . The
focus they will have in the future is if they are going to do
that, it will be of direct benefit to the city The new
probation officer has already met with the parks superintendent
and they will do some work on the trail system. They always
give the person the opportunity to work it off if they cannot
afford to pay. In the future, they will require they do it as a
direct benefit to the city
Councilmember Dietz asked if
that takes care of Mr. Weller' s concern.
Mr Mike Weller stated it
does .
Councilmember Serdy asked how
they determine the rate that they would be paying it off
Judge James Hazel stated
Judge Alexander established a rate at $7 50 an hour. That is
the rate he uses as he thinks it is fair If a person comes
within a hundred dollars and has been doing a good job, then
they will give them additional benefit, especially if they have
been showing up every week We had one gentleman who showed up
every work crew day in January on time and did his work. He
owed about $100 or $120 yet . He told him he has done everything
he has been asked to do and he had followed his orders, so he
waived the remainder of his fine and excused him. They also
have parks workers write notes to him and let him know if they
are good workers and compliant If the person is successful, he
will talk to him and tell him he did a good job and they
^ appreciated him showing up each time

Councilmember Coleman asked
what is on the Maricopa County side of the piece of property
involved
Economic Development Director
Steve Filipowicz stated there is a residential subdivision. Our

vision, based on a preliminary analysis, is the site is not
suitable to residential development due to fissures . They might
be able to use if for a business park such as an employment
center. It has been in the works for several months as staff
has interacted with several state agencies.
Councilmember Dietz asked if
this had been discussed with anyone from the City of Mesa .

Steve Filipowicz stated it has not.
Mayor Insalaco closed the

ENVIRONMENTAL ASSESSMENT THROUGH THE ARIZONA DEPARTMENT OF

AND CERTIFYING THAT THE APPLICATION• (1) MEETS THE COMMUNITY' S

PRESENTATION AND DISCUSSION ON THE
EXPANSION OF THE CENTRAL ARIZONA
COLLEGE CAMPUS
Mr Dennis Jenkins,
president of Central Arizona College, briefed the council on the
item. Mr John Irwin gave a presentation on their plans for the
campus for the future and the partnership between the city and
the college

Councilmember Dietz asked if
the entrance off of Old West Highway would still be used.
Mr John Irwin stated they
will be eliminating those entrances as there will be a
significant drop off of almost 15' to the parking lot . They
will be closing them in the end They will only have the 3
entrances listed in the powerpoint presentation
Councilmember Serdy commented
he did not recognize the old campus in the master plan. He
asked if it would be torn down
Mr. John Irwin stated in the
master plan the old buildings will be eliminated, but that is
long term The first phase calls for them constructing a 40, 000
to 50, 000 sq ft building. It has not been planned yet It
will be incorporated into the existing site Once they get out
to 500, 000 or 600, 000 sq ft . , the location of the existing
buildings will be a parking lot . They do not have a timeline on

been mentioned that the master plan looks like a football or an

put lights in, but the retention area could be a park in the

got on their radar and they realized what this park means to us .
If we had gone quietly into the night, they would have closed
it . Everybody that stood up, called and wrote letters, it all
pays off and helps . That is why they are having this meeting
tomorrow.
Economic Development Director
Steve Filipowicz stated he would like to acknowledge a packet
they will be presenting tomorrow that, assuming council adopts
this resolution, will be the lead piece . We have another
resolution and letter of support from the Friends of Apache
Junction. Moments ago, Supervisor Martyn handed him a letter of
support He also has letters of support from the Superstition
Mountain Historic Society, the Apache Junction Police Officer
Association Fraternal Order of Police; East Valley Partnership;
Liberty Water, which is a private industry that was at the Pinal
Partnership breakfast this community help host last Friday
morning; Friends of Apache Junction Library; Pinal County
Economic Development Department, and two private citizen emails
There is also a letter from the Arizona State Horsemen' s
Association on the way.

The City of Apache Junction typically employs all of its own resources but sometimes requires the additional assistance
of other agencies to cope with law enforcement emergencies By participating in the AZMAC each of the participating
agencies can assist one another when an emergency occurs by providing resources as are available and needed including,
but not limited to,fire, police, medical and health, environmental, communication, and transportation services to cope with the

A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, AUTHORIZING THE CITY OF
APACHE JUNCTION TO ENTER INTO A MUTUAL AID COMPACT WITH
THE ARIZONA DEPARTMENT OF EMERGENCY AND MILITARY
AFFAIRS.
WHEREAS, on August 16, 2007, the City entered into a mutual
aid agreement with various state, county, and municipal law
enforcement agencies to provide for mutual emergency aid, and
WHEREAS, this agreement did not cover non-law enforcement
emergencies; and
WHEREAS, pursuant to A R S § 26-308, the Arizona Mutual Aid
Compact ("AZMAC") exists for the purposes of• (1) providing the
procedures to notify participating agencies of the need for
emergency assistance, (2) identifying available resources; and
(3) providing a mechanism for compensation for resources, and
WHEREAS, it is desirable to enter into the AZMAC in order to
expand the type of emergencies for which the City can obtain
assistance, to include fire, police, medical and health,
environmental, communication, and transportation services to cope
with the problems of response, and
WHEREAS, it is also desirable that the manner of financing
of such cooperative undertakings be resolved in advance of such
emergency; and
WHEREAS, the parties have crafted a written agreement which
defines the emergency management terms and procedures which will
be used among participating agencies for dispatching mutual aid
assistance to any affected area in accordance with local
ordinances, resolutions, emergency plans or agreements and sets
forth the conditions for such arrangement, and OIS
WHEREAS, in addition to the authority identified above,
pursuant to A R S § 11-952 (A) , public entities may enter into
agreements with other municipalities and governmental entities
for Joint or cooperative activities

ARIZONA MUTUAL AID COMPACT
This Compact is made and entered into by and among the signatory political
jurisdictions within the State of Arizona and the Arizona Department of Emergency and
Military Affairs.
Recitals
WHEREAS, one or more parties to this Compact may find it necessary to utilize all of
their own resources to cope with emergencies and may require the assistance of
another party or other parties, and
WHEREAS, it is desirable that all resources of political subdivisions, municipal
corporations, tribes and other public agencies be made available to respond to such
emergencies, and
WHEREAS, it is desirable that each of the parties hereto should assist one another
when such emergency occurs by providing such resources as are available and needed
including, but not limited to, fire, police, medical and health, environmental,
communication, and transportation services to cope with the problems of response and
WHEREAS, it is desirable that a compact be executed for the interchange of such
mutual aid, and
WHEREAS, it is desirable that the manner of financing of such cooperative
undertakings be resolved in advance of such emergency.
NOW, THEREFORE, IT IS HEREBY AGREED by and between each and all of the
signatories hereto as follows

COMPACT
1. Purpose.
The purpose of this Compact is to define for the participating parties the
emergency management terms and procedures which will be used among participating
,.. parties for dispatching mutual aid assistance to any affected area in accordance with
local ordinances, resolutions, emergency plans or agreements Contracting authority for
political subdivisions of Arizona for this Compact is based upon A R S § 26-308 which
provides that each county and incorporated city and town of the state may appropriate
and expend funds, make contracts and obtain and distribute equipment, materials and
supplies for emergency management purposes Tribal contracting authority will be in
accordance with each Tribe's laws
2. Scope.
The Scope of this Compact is to (1) provide the procedures to notify the
Providing Parties of the need for emergency assistance, (2) to identify available
resources, and, (3) to provide a mechanism for compensation for resources
3. Definitions
Automatic Mutual Aid means the automatic dispatch and response of
requested resources without incident specific approvals These agreements are
usually basic contracts, some may be informal accords
Backfill means replacement of the Requesting Party's personnel who
perform the regular duties of other personnel while they are performing
eligible emergency work
Compact means this document, the Arizona Mutual Aid Compact
("AZMAC")
Director is the Director of the Department of Emergency and Military
Affairs ("DEMA")
Emergency or Emergencies means any disaster, emergency, or contingency
situation which requires a collaborative effort among multiple Jurisdictions
Jurisdiction means an entity, including Political Subdivisions and tribal
governments, which (1) has the authority to act, within a defined geographical
area especially in times of emergency and (2) is a party to this Compact
Local Mutual Aid are agreements between neighboring jurisdictions or
organizations that involve a formal request for assistance and generally cover a
larger geographic area than automatic mutual aid.
Political Subdivision means any county, incorporated city or town, or public
education district, irrigation, power, electrical, agricultural improvement, drainage,
and flood control districts, and other tax levying public improvement districts.
Providing Party means the Jurisdiction providing aid in the event of an
it
emergency
Requesting Party means the Jurisdiction requesting aid in the event of an
Emergency
Self-deployed means to respond to an emergency without being requested by
the Requesting Party
4. Guiding Policy.
Arizona Revised Statute ("A R S."), Title 26, Military Affairs and Emergency
Management
Arizona Administrative Code ("A A C."), Title 8, Emergency and Military
Affairs.
National Incident Management System ("NIMS"), 2008
5. Procedures for Requesting Assistance.
A Requesting Party, which needs assistance in excess of its own resources and
existing automatic mutual aid or local mutual aid due to an emergency is authorized to
request assistance from any party to this Compact However, when making such
requests, consideration shall be given to, and requests made, based on, but not limited
to, the geographical proximity of other jurisdictions with that of the jurisdiction requesting /Mk
assistance All requests for assistance from the State must come from the Requesting
Party's county
Requests should specify what the emergency is, what resources are needed and the
estimated period of time during which such mutual aid shall be required, if known An
example is provided in Appendix A
6. Providing Party's Assessment of Availability of Resources and Ability to
Render Assistance.
Subject to the terms of this Compact, the Providing Party shall make reasonable
efforts to assist the Requesting Party In all instances, the Providing_Party shall render
such mutual aid as it is able to provide consistent with its own service needs at the time,
taking into consideration the Providing Party's existing commitments within its own
jurisdiction The Providing Party shall be the sole judge of what mutual aid it has
available to furnish to the Requesting Party pursuant to this Compact
7. Implementation Plan.
Each party should develop an emergency operations plan that includes a
process to provide for the effective mobilization of its resources, both public and private,
including acceptance of mutual aid to provide or receive assistance under this Compact.
8. Contact List.
Each Party shall develop a contact list as outlined in Appendix B, which shall be
provided to the Director for distribution to all other parties to this Compact
9. Reimbursement Procedures
If the Providing Party desires reimbursement, the Requesting Party shall
reimburse the Providing Party for all costs when any mutual assistance is requested,
whether an incident has been declared an emergency or not The Providing Party must
declare to the Requesting Party its intent to seek reimbursement before responding to
the Requesting Party's request for assistance The Requesting Party, which is informed
in advance of the Providing Party's intent to request reimbursement and which
subsequently authorizes the Providing Party to respond, shall reimburse the providing
party after receipt of an itemized voucher and documentation of all allowable costs of
labor, equipment, and materials that have actually been expended in providing
assistance
The Providing Party and the Requesting party shall agree upon allowable costs
for mutual assistance prior to the dispatch of any mutual assistance resources Unless
otherwise negotiated by the parties involved, the parties may reference the state
allowable costs as defined in A A C Title 8 (as may be amended from time to time)
10. Reimbursement Procedures from the State.
The state is not liable for any claim arising from an emergency for which the
applicant receives funds from another source (A A C Title 8, R8-2-312)
Self-deployed resources will not be reimbursed
When mutual aid is extended under this Compact to the State, if the Providing
Party desires reimbursement from the State, reimbursement, if any, to the Providing
Parties by the State for costs will be provided to the Requesting Party pursuant to
A R S § 35-192, and A.A.0 Title 8 as applicable (as may be amended from time to
time). A requesting jurisdiction other than a county may submit a request to the county
for reimbursement The county will then request reimbursement from the Director for
reimbursement of the Requesting Party
After the State and/or President has declared an emergency, the Requesting
Party shall prepare an itemized voucher and documentation of all paid allowable costs
including all the cost of the Providing parties for submittal to the State for consideration
for reimbursement in accordance with A A C Title 8 (as may be amended from time to
time)
11 Personnel Compensation and Insurance.
The Requesting Party and the Providing Party shall be responsible for all
compensation and insurance coverage of their respective employees and equipment
12. Immunity.
The parties shall have such immunity as provided by applicable state, federal or
tribal law
13. Indemnification.
To the fullest extent permitted by law, each party agrees to defend, indemnify,
and hold harmless the other party and the other party's officers, agents, and employees
from all claims, losses, and causes of actions arising out of, resulting from, or in any
manner connected with this Compact, but only to the extent such claim, loss, cause of
action, damage or injury is caused or contributed to by the negligent acts or omissions
of the indemnifying party
14. Term.
This Compact shall be effective on the date it is recorded with the Secretary of
State Except as otherwise provided in this Compact, this Compact shall terminate ten
years after the effective date This Compact, upon mutual consent of the parties may
be extended for a period of time not to exceed 10 years Any modification or time
extension of this Compact shall be by formal written amendment and executed by the
parties hereto.

Each party shall comply with applicable provisions of the Americans with
Disabilities Act (Public Law 101-336, 42 United States Code 12101-12213) and all
applicable federal regulations under the Act, including 28 Code of Federal Regulation
Parts 35 and 36
16. Non-Discrimination.
All parties to this agreement shall not discriminate against any employee, client
or any other individual in any way because of that person's age, race, creed, color,
religion, sex, disability or national origin in the course of carrying out Party duties
pursuant to this Compact
17. Compliance with Laws
Each party shall comply with all federal, tribal, state and local laws, rules,
regulations, standards and Executive Orders, as applicable, without limitation to those
designated within this Compact. Any changes in the governing laws, rules and
regulations during the terms of this Compact shall apply but do not require an
amendment.
18 Worker's Compensation.
Each party shall be responsible for any injuries which may occur to its
own personnel during the course of rendering mutual aid pursuant to this Compact In
accordance with A R S § 23-1022, each party of a political jurisdiction of Arizona shall
be deemed the primary employer and shall have sole responsibility for the payment of
worker's compensation benefits to their respective employees Each party shall comply
with the notice provisions of A R S § 23-1022 (E)
19. Insurance.
Each Requesting and Providing Party shall bear the risk of its own actions, as it
does with its day-to-day operations, and determine for itself what kinds of insurance,
and in what amounts, it should carry
20. Non-appropriation.
Notwithstanding any other provision in this Compact, a party may terminate its
participation in this Compact if for any reason the party does not appropriate sufficient
monies for the purpose of maintaining this Compact In the event of such cancellation,
the terminating party shall have no further obligation to the other parties other than for
payment for services rendered prior to cancellation
21. No Third Party Beneficiaries.
Nothing in the provisions of this Compact is intended to create duties or
obligations to or rights in third parties not parties to this Compact or affect the legal
liability of either party to the Compact by imposing any standard of care different from
the standard of care imposed by law
22. Entire Agreement.
This document constitutes the entire Compact between the parties pertaining to
the subject matter hereof. This Compact shall not be modified, amended, altered or
extended except through a written amendment signed by the parties and recorded with
the Arizona Secretary of State or Tribal government as appropriate
23. Jurisdiction.
Nothing in this Compact shall be construed as otherwise limiting or extending the
legal jurisdiction of any party Nothing in this Compact is intended to confer any rights
or remedies to any person or entity that is not a party.
24. Conflict of Interest.
This contract is subject to cancellation for conflict of interest pursuant to A R S §
38-511, the pertinent provisions of which are incorporated herein by reference.
25. Supervision and Control.
Management of an emergency shall remain with the jurisdiction in which the
emergency occurred Supervision and control of Providing Parties personnel and
equipment shall be in accordance with National Incident Management System The
Requesting Party will be responsible for providing supplies and services, such as food,
shelter, gasoline and oil, for on-site use of equipment and for the personnel providing
assistance All equipment and personnel used pursuant to this Compact shall be
returned to the Providing Party upon being released by the Requesting Party or on
demand of the Providing Party for such return
26. Severability: Effect on Other Agreements.
It is expressly understood that this Compact shall not supplant existing
agreements between some of the parties, which do provide for the exchange or
furnishing of certain types of services on a compensated basis.
27. Severability.
If any provision of this Compact is held to be invalid or unenforceable, the
remaining provisions shall continue to be valid and enforceable to the full extent
permitted by law
28. Responsibility of the Department of Emergency and Military Affairs.
Nothing within this Compact limits or restricts the duties and obligations the State
of Arizona may have to respond to the emergency of any party
29. Effective Date
This Compact shall become effective as to each party when adopted by
resolution and executed by the governing body of the jurisdiction, and shall remain
operative and effective as between each and every party that has heretofore or
hereafter executed this Compact, until participation in this Compact is terminated by the
party The termination by one or more of the parties of its participation in this Compact
shall not affect the operation of this Compact as between the other parties thereto. The
Director shall issue an annual report, with updates as needed, to all parties identifying
the parties to this Compact
30. Execution Procedure.
Execution of this Compact shall be as follows
This Compact, which will be designated as "Arizona Mutual Aid Compact," shall be
executed in counterparts by the governing body of each party Upon execution, the
counterpart will be filed with the Secretary of State and the Tribal government as
applicable and be provided to the Director. This Compact will be effective between all
parties who execute this Compact even if it is not executed by all eligible jurisdictions
31. Termination
Termination of participation in this Compact may be effected by any party as
follows
Notice of termination will be given to the Director 20 calendar days prior to
termination
A party shall by resolution of its governing body terminate its participation in this
Compact and file a certified copy of such resolution with the Secretary of State or the
Tribal government, and a copy will be provided to the Director
The parties to this Compact understand and acknowledge that this Compact is
subject to cancellation by any party pursuant to A R S § 38-511 or applicable Tribal
law
32. Dispute Resolution.
In the event of any controversy, which may arise out of this Compact, the parties
agree that the matter shall be arbitrated as provided in A R S § 12-1518(A) or
applicable Tribal law The method of arbitration and the selection of arbitrators shall be
decided by the mutual agreement of the parties at such time as arbitration services are
needs.

AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
i JUNCTION, ARIZONA, RELATING TO THE TRANSACTION PRIVILEGE LICENSE TAX
(SALES TAX) ; AMENDING THE TAX CODE OF THE CITY OF APACHE JUNCTION BY
CONTINUING THE RATE OF TAXATION BY TWO-TENTHS OF ONE PERCENT (.2%) AS
ORIGINALLY ADOPTED BY ORDINANCE NO. 1129, DESIGNATING THE PURPOSE;
DESIGNATING AN EFFECTIVE DATE, PROVIDING FOR EXISTING CONTRACTS,
PROVIDING FOR PENALTIES, REPEALING ANY CONFLICTING PROVISIONS;
PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
WHEREAS, Arizona Revised Statutes § 9-240(B( (26) conveys upon the
Mayor and City Council the power to levy taxes including a transaction
privilege license tax (sales tax) ; and
WHEREAS, the City of Apache Junction has sustained diminished
revenues due to the current nationwide economic downturn; and
WHEREAS, the City of Apache Junction has already received notice that
its proportionate share of state shared revenues for Fiscal Year 2010-2011
will be decreased by approximately $1 1 million; and
WHEREAS, since Fiscal Year 2007-2008, the City of Apache Junction
already reduced its personnel and operating costs by $5 6 million; and
WHEREAS, having no city property tax, the City of Apache Junction
relies heavily upon sales tax revenues to provide city services; and
WHEREAS, the Mayor and City Council have determined that the
continuation of the two-tenths of one percent (.2%) transaction privilege
license tax (sales tax) as set forth in this ordinance is necessary to
sustain the quality for community residents and enhance the public health,
safety and welfare; and
WHEREAS, at their regular meeting of February 16, 2010, a majority of
the Mayor and City Council directed staff to prepare an ordinance for an
extension of the .2% sales tax in compliance with State law and the Model
City Tax Code; and
WHEREAS, changes to the transaction privilege tax rate are affected
by amending the Tax Code of the City of Apache Junction, and by appropriate
notification to city taxpayers and to the Arizona Department of Revenue.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS

SECTION I IN GENERAL
A. The tax rate in each of the following sections of the city tax code
is continued at the rate of two and two-tenths percent (2.2%) .
Section 8A-405 Advertising
Section 8A-410 Amusements, exhibitions, and similar activities
^ Section 8A-420 Feed at wholesale
Section 8A-425 Job printing
Section 8A-427 Manufactured buildings
Section 8A-430 Timbering and other extraction
Section 8A-435 Publishing and periodicals distribution
Section 8A-440 Rental occupancy
Section 8A-444 Hotels
Section 8A-445 Rental, leasing, and licensing for use of real
property
Section 8A-447 Additional tax upon transient lodging
Section 8A-450 Rental, leasing, and licensing for use of tangible
personal property
Section 8A-455 Restaurants and bars
Section 8A-475 Transporting for hire
B The tax rate in the following sections of the city tax code
is continued at the rate of three and two-tenths percent
(3 2%) .
Section 8A-470 Telecommunications services
Section 8A-480 Utility services
C. Section 8A-460 of the city tax code shall continue to read.
Section 8A-460 . Retail sales • measure of tax; burden of proof;
exclusions
(a) The tax rate shall be at the amount equal to two and two-
tenths percent (2 . 2%) of the gross income from the business
activity upon every person engaging or continuing in the
business of selling personal property at retail
(b) The burden of proving that a sale of tangible personal
property is not a taxable retail sale shall be upon the
person who made the sale
(c) Exclusions For the purpose of this Chapter, sales of
tangible personal property shall not include:

(1) sales of stocks, bonds, options, or other similar
materials .
(2) sales of lottery tickets or shares pursuant to Article
1, Chapter 5, Title 5, Arizona Revised Statutes .
(3) sales of platinum, bullion, or monetized bullion,
except minted or manufactured coins transferred or
acquired primarily for their numismatic value as
prescribed by Regulation
(4) gross income derived from the transfer of tangible
personal property which is specifically included as
the gross income of a business activity upon which
another Section of this Article imposes a tax, shall
be considered gross income of that business activity,
and are not includable as gross income subject to the
tax imposed by this Section.
(5) sales by professional or personal service occupations
where such sales are inconsequential elements of the
service provided
(d) Notwithstanding the provisions of subsection (a) above, when the
gross income from the sale of a single item of tangible personal
property exceeds two thousand dollars ($2,000) , the two and two-
tenths (2.2%) tax rate shall apply to the first $2,000. Above
$2,000, the measure of tax shall be at a rate of one and two-tenths
percent (1.2%) .
(e) When this City and another Arizona city or town with an equivalent
excise tax could claim nexus for taxing a retail sale, the city or
town where the permanent business location of the seller at which the
order was received shall be deemed to have precedence, and for the
purposes of this Chapter such city or town has sole and exclusive
rights to such tax.
(f) The appropriate tax liability for any retail sale where the order is
received at a permanent business location of the seller located in
this City or in an Arizona city or town that levies an equivalent
excise tax shall be at the tax rate of the city or town of such
seller's location.
(g) Retail sales of prepaid calling cards or prepaid authorization
numbers for telecommunications services, including sales of
reauthorization of a prepaid card or authorization number, are
subject to tax under this Section.
SECTION II CONSTRUCTION CONTRACTING EXCEPTION

In accordance with Session Laws (House Bill 2008) , Forty-Ninth Arizona
State Legislature, 2009 Third Special Session, Chapter 7, § 42, the tax
rate in each of the following sections of the city tax code is reduced to
two percent (2%) on September 2, 2010 and shall automatically change to two
and two-tenths percent (2.2%) on July 1, 2011
Section 8A-415 Construction contracting: construction contractors
Section 8A-416 Construction contracting: speculative builders
ems Section 8A-417 Construction contracting. owner-builders who are
not speculative builders
SECTION III DESIGNATING THE PURPOSE
For such period of time that the City of Apache Junction, Arizona, levies
the tax as described in Section I above, the revenues collected from the
two-tenths of one percent ( .2%) continuation shall be used for expenses
related to general government
SECTION IV DESIGNATING AN EFFECTIVE DATE
The provisions of this ordinance shall become effective on September 2,
2010.
SECTION V PROVIDING FOR EXISTING ONCTRACTS
The tax dosed pursuant to Section I(D) of this ordinance shall not apply
to contracts entered into prior to September 1, 2010.
SECTION VI PROVIDING FOR PENALTIES
Any person found guilty of violating any provision of these amendments to
OmS the tax code shall be guilty of a class one misdemeanor and shall be
prosecuted pursuant to Article 1-8 of the Apache Junction City Code and
Section 8A-580 of the Tax Code of the City of Apache Junction.
SECTION VII REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of
this ordinance or any part of the code adopted herein by reference are
hereby repealed
SECTION VIII PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, clause, phrase or portion of this
ordinance is for any reason held to be invalid or unconstitutional by the
ORDINANCE NO. 1359

decision of any court of competent jurisdiction, such decision shall not
affect the validity of the remaining portions thereof.
SECTION IX DECLARING AN EMERGENCY
Whereas it is necessary for the preservation of the peace, health, and
safety of the City of Apache Junction, Arizona, an emergency is declared to
exist, and this ordinance shall become immediately operative and in force
from and after the date of posting

years experience in various government entities and would like to use that education and experience to
give back to the city I am also a pro tem Justice of the Peace in Pinal County and believe my experience
in deciding cases would be an asset on the Board of Adjustment

(a) Follow the laws,policies and guidelines set by the City Council when making decisions and,when

1992 to Present: Administrator I - Office of the Pinal County Attorney. Child Support Div., Florence, AZ
In 1992 the County Attorney promoted me to Administrator I. I have supervised a staff of up to 15 non-attorney
personnel (Intake Specialists and Legal Case Managers) For two years (2003 to 2005) I did Community Outreach
with the scope of work being to educate the community about the law and how we operate and how the public
could benefit from the services of the Title IV-D program.
1986 to 1992: Sr. Case Manager- Office of the Pinal County Attorney. Child Support Div., Florence. AZ
Originally hired as an Intake Specialist, I was soon promoted to Paralegal then to Sr Paralegal (Case Manager) I
was responsible for a caseload, accomplishing all tasks associated with paternity, establishment and enforcement
cases I interviewed applicants, accomplished skip-tracing, prepared cases for court and assisted the attorney at
hearings each week. I was the sole case worker for all Interstate cases I conducted workshops, then initiated
cases to other jurisdictions and processed reciprocal cases from foreign jurisdictions I also trained all new
employees in the IV-D concepts, policies and the laws governing child support enforcement I wrote the office
training manual.
1966 to 1986: Previous Employment & Educational Information

PRACTICAL WORK EXPERIENCE FROM VOLUNTEER ACTIVITIES
Club Organizer. My first endeavor, while in high school, was the founding of a neighborhood teen club

Historic Preservation Advisory Committee• Appointment by the Arizona State Parks Board
As a member of this committee, I was involved with rewriting the grant application and the process for applying for
Heritage Fund monies (AZ State lottery) for the preservation of historic sites/structures. Twice yearly we review
all applications and make recommendations to the State Parks Board as to the awarding of grant monies.
Crisis Responder. Volunteer with the Apache Junction Police Department's Victim Services office
On-call one weekend each month and other times during the month I respond to calls to assist the police with
victims at death and fire scenes, DV situations, homeless, etc. I provide information to the victim and assist them
as necessary
AZ Family Support Council: As the President for five consecutive years, I organized seminars and conferences for
this statewide organization; arranged the training tracts, speakers, entertainment, etc. Experience working with
hotels, restaurants and food caterers, making arrangements for locations and meals, for groups up to 500
