Presentation and discussion on the purchase of a PM-10 certified street sweeper to be reimbursed by a Congestion Mitigation and Air Quality grant awarded to the city on June 30,2010 The grant award is$173,000.00 with the remaining total to be paid by the city not to exceed $20,336.32. Total cost of the Tymco Model 600 sweeper would be$193,336 32 The sweeper would be purchased through the HGAC cooperative contract#SW04-10 8. HONORABLE MAYOR AND CITY COUNCIL THROUGH GEORGE HOFFMAN, CITY MANAGER FROM EARL SIMMERS, IT DIRECTOR SUBJECT COST BENEFIT ANALYSIS—AVAYA PHONE SYSTEM This past spring the city fulfilled its five year lease term with Avaya City Manager,George Hoffman, asked me to do a cost benefit analysis on renewing the lease versus a lease to purchase option Under the current lease with Avaya,the monthly lease payment is approximately$11,000 00.With a lease renewal the new monthly payment would be$10,000 00,or$120,000 00 per annum. The option of a lease to purchase agreement(2-year cost)would total $262,050 38. Further,with the lease to purchase option the city will begin actual savings upon the second year and second month of the terms (August 2012) An initial payment of$131,025 19 including taxes is due upon execution of the lease to purchase agreement. Development Fee Ordinance Appeal On July 26, 2010,the City received a request from John and Joanne Fairman to appeal and waive the required$9,508 development fee for placement of a mobile home on their property located at 2143 Apache Drive (see attached letter) The Fairmans were notified of the fee by the city on July 25,2010, so their appeal was submitted within the required 30 day timeline The Fairmans are hoping that the Council will waive the fee due to their financial condition and the fact that a home previously existed on the property [Note. If a building permit was issued within one year of the previous residence being removed, no development fee would be required according to our code As it turns out,the previous residence was removed two years ago] Article 7-1-1-M (Relief Procedures and Hearings) of the Land Development Code provides, among other things, that the City Council must hold a public hearing on the appeal within 45 days after received by the Development Fee Administrator (see attached code section regarding development fee appeals). The ordinance does not, however, apply standards or criteria to the Council's review and determination of these types of appeals Staff Recommendation: Development Services staff recommends that the City Council review and discuss the appellant's request at the August 17th meeting Staff will then schedule a September 7th public hearing for council action on the requested appeal (Note: If the Council does not make a decision by September 10`h,the matter is deemed approved) [Historical Note. Such appeal must be filed with the Development Fee Administrator in writing. 1) within (30) calendar days after the date the City notified the developer of an assessment or offset determination, or 2) within thirty (30) calendar days after the developer paid the development fee In either case, any building permit issued before the appeal is filed shall be considered stayed until after the appeal process has concluded Any work in progress completed during the appeal process shall be performed at the developer's own risk. Conditional Use Permit Appeal Scheduling Inserted requirement that a Conditional Use Permit appeal from the Planning&Zoning Commission's decision shall be scheduled for the next regularly scheduled meeting of the Council in accordance with state law (Chapter 1, Section 1-6-1-D;p. 35) 1 3 Board of Adjustment ("BOA") Annual Report. Changed the requirement that BOA must issue an annual, not monthly report to the City Council (Chapter 1, Section 1-11-2, p. 67) 4 Board of Adjustment Action Deleted requirement that the BOA must report its finding to the Planning&Zoning Commission and City Council (Chapter, Section 1-12-3, p 72).
