The Council may,at this time,take single action on any or all items listed as consent agenda items.These items may include, but are not limited to,acceptance of agenda, acceptance of minutes, appointments, acceptance of resignations and adoption of certain resolutions and other items which do not require a public hearing The Consent Agenda is a timesaving device of which the Mayor and City Council is to receive documentation on these items from the City Manager for their review prior to the meeting Any member of the Council may remove any item from the Consent Agenda for discussion and cause a separate vote on the matter later in the agenda 1 Acceptance of Agenda. 2. Approval of Minutes of Regular Meeting of November 16,2010. 3. Consideration of Appointment of Deputy City Magistrates Consideration of the appointment of Dale E. Collier and Rebecca Standage as deputy city magistrates for a two year term ending January 15,2013 4. Consideration of appointment of Pro-Tern Magistrates. Consideration of reappointment of Lisa Peters and Michelle O'Hair-Schattenberg as magistrate pro-tems for a two year term 5. Consideration of proposed Resolution No. 10-41,authorizing the City to enter into an intergovernmental agreement with Arizona Department of Transportation for Safe Routes to School grant funds. In July 2010,the City of Apache Junction was notified of a grant awarded under the Safe Routes to School Program Cycle 4 The program would provide enforcement and education services regarding walking and biking to school safety for Superstition Mountain Elementary School and Cactus Canyon Junior High The Agreement and Resolution are needed to receive grant funds 6. Consideration of Resolution No. 10-42 authorizing the submission of a grant application to the Arizona Department of Transportation for Local Transportation Assistance Fund II funding for Fiscal Year 2010-2011. The City is eligible to receive$30,401 67 in Local Transportation Assistance Fund II funds City staff and the Leadership Team have recommended that the funds be used to support the transportation program at the Apache Junction Active Adult Center Resolution Number 10-42 would authorize the submission of a grant application to support the transportation program at the Center Further,the resolution would satisfy grant application requirements 7. Consideration of a "Main Street" Cross-Section Design. Staff created a"Main Street" Cross-Section to be adopted per the Downtown Redevelopment and Implementation Strategy. Staff respectfully requests Council approval of the"Main Street" Cross-Section which would be added as a standard detail in the current Engineering Design Guidelines 8. Consideration of proposed professional services agreement with OSAM Document Solutions,Inc not to exceed $67,565.00. The City's magistrate court has need of an electronic document management system, including software and hardware that will help staff manage the import, archival,and retention of court documents OSAM Document Solutions, Inc.is the vendor from which the Arizona Supreme Court has procured software/hardware and document management services. The City and OSAM have negotiated a professional services agreement, and staff respectfully requests Council approve the agreement E AWARDS, PRESENTATIONS AND PROCLAMATIONS. Awards,presentations from other organizations,proclamations issued by the mayor,and acknowledgement of distinguished guests and visitors, and staff presentation of receipt of grant or donated funds are permitted at this time 9 INTRODUCTION AND DISCUSSION WITH SENATE DISTRICT 23 ELECTS JOHN FILMORE AND STEVE SMITH. 10. PRESENTATION OF THE VOLUNTEERS IN SERVICE TO AMERICA(VISTA)PROGRAM. In November 2009,the City was fortunate to receive a Volunteer in Service to America(VISTA) participant. Under the VISTA program, a volunteer serves for one year With the departure of the City's first VISTA volunteer,staff wishes to. 1)reflect on the accomplishments of the first VISTA,Sarah Knaack,and 2) introduce the Council to the new VISTA,Amanda Ripstra. F. ANNOUNCEMENT OF CURRENT EVENTS. The Mayor or any member of Council may at this time present a brief summary of current events However,no discussion shall take place on such items except for clarifying comments related to substance,time and location G. CITY MANAGER'S REPORT. The City Manager,members of City staff or those individuals designated by the Manager may present information pertinent to items under consideration or information related to the operation of the City There shall however be no discussion at this time except for clarification inquiries. 11. MANAGER'S REPORT H. PUBLIC HEARINGS. Public hearings required by applicable law shall be conducted by the Council and any person shall be given the opportunity to speak.All remarks shall be addressed to the Council as a whole and not to any member thereof Such remarks shall be limited to five(5) minutes unless additional time is granted by the Mayor This time limitation shall not apply to applicants and their agents appearing before the Council 12. APPLICATION FOR A SPECIAL EVENT LIQUOR LICENSE FOR SUPERSTITION MOUNTAIN ROTARY CLUB #1246. This is for Lost Dutchman Days February 25-27,2011 This public hearing is the next step in the approval process. Council shall make a recommendation for approval or denial to be forwarded to the Arizona Department of Liquor Licenses and Control 13. APPLICATION FOR A NEW LICENSE,INTERIM PERMIT,LIMITED LIABILITY CO.,SERIES 10 LIQUOR LICENSE FOR MAIN MARKET. This is the next step in the approval process for a liquor license Council shall make a recommendation for approval or denial to be forwarded on to the Arizona Department of Liquor Licenses and Control. 14. CONSIDERATION OF RESOLUTION NUMBERS 10-44 AND 10-45,SUPPORTING THE APPLICATION TO THE GREATER ARIZONA DEVELOPMENT AUTHORITY (GADA)AND REIMBURSEMENT OF FUNDS RECEIVED FOR STREET BONDS. Staff presented a summary of Resolution No 10-44 and 10-45,supporting an application to the Greater Arizona Development Authority(GADA)and providing for reimbursement of funds received for street bonds Staff seeks approval of said resolutions on December 7,2010 I OLD BUSINESS. The Council shall consider any business that has been previously considered and which is still unfinished to include those items previously postponed or tabled No member of the public shall be permitted to speak on these items unless invited to do so by the Mayor after first submitting a written request-to-speak form with the City Clerk. COUNCIL DIRECTION TO STAFF TO PROCEED WITH DRAFTING REGULATIONS FOR MEDICAL MARIJUANA USES,INCLUDING DISPENSARIES,OFF-SITE CULTIVATION LOCATIONS AND OTHER RELATED USES. This Direction to Staff item follows up on the presentation and discussion with the City Council on December 6, 2010,regarding the voters'approval of Proposition 203,the medical marijuana intiative Staff seeks direction to proceed with drafting regulations for medical marijuana dispensaries, off-site cultivation locations and other related issues. L. SELECTION OF MEETING DATES, TIMES, LOCATIONS, AND PURPOSES: 16. ANNOUNCEMENT OF CURRENT EVENTS Councilmember Serdy commented he had the first meeting with the Tourism Advisory Committee in Phoenix and it was very enlightening. The East Valley/Pinal County has not been featured or highlighted and he learned a lot about what they can be doing and what can be budgeted. They talked about the upcoming centennial which has been taken on the by the focal point and tourism committee locally. Apache Junction will be having two centennials as 2011 is also the 100th anniversary of the completion of Roosevelt Dam and when Teddy Roosevelt took the Model T up there. They will be capitalizing on that aspect and, starting at the focal point, they will get a Teddy Roosevelt impersonator. Rather than have a separate event, they will already be assembling for Lost Dutchman Days 2012, and they will try to get him to be the Grand Marshal for the parade and have speaking events throughout the day. The museum and ook historical society will have some of the blocks from the original dam. There will be a permanent monument there. They will be working with them on their centennial. There is no budget for this, so they will be asking for corporate donors . Councilmember Barker is also on this committee and has instrumental . Wayne Standage has been a tireless researcher and has been instrumental on the Teddy Roosevelt part of this . If anyone wants to help or donate, contact one of them after the meeting. He believes this will be exciting for the community as the dam is more ours than any other community in the valley. REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 16, 2010 PAGE 3 OF 7 A. Councilmember Barker commented they do have a budget; they just do not have any money for it. Councilmember Wilson commented this weekend at Prospector Park the parks and recreation department had their Little Buckaroos rodeo. They had 56 children attend and it was very well run. He brought along a pony to assist for the activities . They had a petting zoo with a turkey, rabbits, goats and chickens. He enjoyed leading the kids around, especially for those riding a 'oak. horse for the first time. Councilmember Barker commented the weekend before Animal Control held an adoption day out at Kaufman Homes . Fourteen out of 19 dogs were adopted. There were a lot of people out there. Unfortunately not a lot of cats went as well . Animal Control did a good job out there. Councilmember Barker commented the Community Alliance Against Family Abuse event was held Saturday night. It closed down the events for domestic violence month. They have held events all month long. The final event was at Starbuck' s . The community and city staff are getting involved in this area. Councilmember Barker commented the Veterans' Day Parade was an amazing parade . They have had a very exciting week. Mayor Insalaco commented Vice Mayor Dietz, Councilmember Barker and he attended the groundbreaking this morning for the expansion of Central Arizona College at Winchester and Old West Highway. It is nice to go to a groundbreaking and know that they are going to start right away. A lot of times you can go to one of these things and 6 or 8 months later they might start and they might not. This is the second groundbreaking they have had in a short time, the first being Superstition Mountain Mental Health and the next day they were there with the bulldozers. Tomorrow they are mapping out the roads there. CITY MANAGER' S REPORT City Manager George Hoffman thanked city staff that worked on the Wellness Event, and commented on comments from Central Arizona College President Dennis Jenkins at the groundbreaking, two multi-million dollar projects bookending the downtown, an REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 16, 2010 PAGE 4 OF 7 Arizona State Parks Board meeting tomorrow in this council chambers, Chief Monahan being invited to speak at a 2-day summit in Houston on domestic violence, and the clearing of vegetation on State Route 88 by Arizona Department of Transportation. Recreation Superintendent Liz Langenbach gave a presentation on the merger of the Holiday Event and Light Parade. Quail, Apache Junction, addressed the council regarding charging stations for electric vehicles and his term limit initiative. Councilmember Coleman asked if Mr. Fisher had ever considered limiting how many times you can unsuccessfully run for a public office. They are also contacted for warrants or emergency police matters if I am not available Judge Dale Collier and Rebecca Standage are recommended for the position. On October 29, 2010 the City received the agreement. Given the delayed response from ADOT,the Safe Walk to School program was unable to begin in September as planned. ADOT requested that the City return the signed agreement and a resolution immediately, so the program could begin Due to the agenda calendar, the City was able to place the resolution on the agenda in December ADOT authorized the City to return the signed agreement prior to having the resolution signed in order to expedite the process After review from the City Attorney, staff provided the agreement for the Mayor's signature. In Fiscal Year 2011,the City will receive $30,401 67 See Attachment 1. The funds would be directed to the Apache Junction Active Adult Center(D.B.A. East Valley Adult Resources) for support of its transportation program. The LTAF II funds, and required match, would enable the Center to provide approximately 4,621 one way trips to medical appointments, shopping trips, and Center activities. See Attachment 2. BACKGROUND Funded by the Arizona State Vehicle License Tax and the Arizona State Lottery Powerball,the LTAF II Program makes grants to cities for transit services/vehicles/support facilities that. • Convey multiple passengers(usually 5 or more), and • Serve the general public, elderly persons, persons with disabilities, and/or low-income persons engaged in employment activities Funds can be used for planning, capital, operation, or staff expenses The City must provide a 25%cash match for the amount received. Municipalities can use the funds themselves, direct funds to another governmental entity, or give the funds to a sub-recipient non profit organization When funds are directed to another entity, the recipient of the LTAF II funds becomes responsible for providing the 25%cash match DISCUSSION The recommendation to fund the transportation program at the Center is supported by the Leadership Team and is based on the following rationale. I The recommendation is consistent with previous City Council decisions 2 Over the years, funding this transportation program has proven to be an efficient investment of the LTAF II funds In FY 2009-2010, LTAF II funds enabled the Center to provide transportation services at the cost of$9.72/one way trip In comparison, East Valley Dial-A-Ride was charging$34/one way trip 3. The City of Apache Junction ; r s• N through the LTAF II allocations has made it possible for hundreds of older adults remain independent through vans traversing the City The transportation system has five vehicles on the road daily to provide transportation and home delivered meals. The development and implementation of this system shows what can happen when a nonprofit and a City truly care about its residents especially those in their later years who can no longer operate a vehicle. The support by the City of Apache Junction (LTAF II) over the last nine years has been invaluable It has provided operational support, purchase of vehicles and even a 25% match for a 5310 (State of Arizona subsidy program) vehicle The organization is very grateful to be considered for this final LTAF II allocation. Over the last 14 years,the Active Adult Center in Apache Junction has grown to become a focal point for aging services East Valley Adult Resources values the generations by providing opportunities to connect, contributed and care for each other A continuum of services is provided from those who are very active to those who need support to .•. remain independent Transportation is a key component in allowing people to continue to have control over their lives. Transportation provides older and disabled adults independence to attend the active adult center for lunch, health education, exercise, etc , assistance to doctor appointments, and to purchase nutritional and other needed products from local retailers. As this program has grown there has been need to seek other resources to meet the increasing demand Recently a new state grant(5317)was received to enhance transportation to veterans especially in the area of medical transportation. With additional vehicles being utilized on a daily basis, our operational costs (insurance premiums, fuel costs and repair work)grew by over$5,000 last year. The elimination of 1 Am. Auk the LTAF II funding in February 2010 put our service in jeopardy of continuing This final LTAF II funding along with the new state grant will allow us to continue this service until June 2012 The focus of the new state grant is to increase our ability to serve veterans with transportation for medical appointments especially to the Southeast Veterans Clinic who can then get a ride to the Phoenix Veterans Hospital. We have scheduled monthly trips, but would like to expand this service if funding permits This service provided 166 trips in the last three months for medical visits. FY 2009-2010 Transportation Program and Impact of FY 2009-2010 LTAF II Funding During FY 2009-10, the overall transportation program expenditure for the Center was $121,737 31 Individual direct assistance=$91,774 81 and Ride Choice=$28,962 50 Of the total cost for individual direct assistance, the Center received $52,619 18 in LTAF II funding for operational expenses and spent$55,576 06 There was a small amount of carryover from the previous year which was utilized to balance the budget These LTAF II funds made it possible to provide 9,439 units (one way trip) at a unit cost of$9 72 Ride Choice provided 5,602 units for a unit cost of$5.16 As a comparison, currently an East Valley Dial-A-Ride one way trip costs $34 Apache Junction Active Adult Center Scope of Service Apache Junction Active Adult Center's budget for FY 2010-11 is $487,536 40%from federal/state sources, 24%from the City of Apache Junction and 36%from project revenue, private grants and fundraising. The FY 2010 transportation budget (which includes direct assistance and Ride Choice) is$124,450 Over the last year 43,252 meals were prepared for Apache Junction residents Half of the meals were enjoyed at the Active Adult Center and the other half were delivered to homebound older adults There were over 2,200 people who received assistance and/or participated in the comprehensive array of programs offered at the Center. Request for FY 2010-11 LTAF II Funding The Apache Junction Active Adult Center is requesting$30,401 67 for support of its individual direct assistance transportation program This amount combined with $22,500 (pending) from a State of Arizona source will provide us with the ability to maintain the service through June 2012 The total cost for this program in FY 2010-11 is projected to be $86,345. Additional funds for this program come from individual donations, suggested donations from the recipients and the Area Agency on Aging. The requested LTAF funding of$30,401 67 will go exclusively into the direct assistance transportation system for labor, insurance, maintenance and gasoline (vehicles get about 5-6 miles per gallon) East Valley Adult Resources will provide the required 25% cash match It is projected that there will be a total of 10,500 units (i e one way trips) 2 lk provided in FY 2010/11 by this program The LTAF II funds and match will cover 4,621 trips. Currently, the vans are driven approximately 100 miles per day, making between 50-75 stops per day. ATTACHMENTS: Click to download ❑ OSAM Agreement Aiwa, .0114, ELECTRONIC DOCUMENT MANAGEMENT SYSTEM PROFESSIONAL SERVICES/SOFTWARE/HARDWARE AGREEMENT WITH OSAM DOCUMENT SOLUTIONS, INC This Agreement is made as of the day of 2010 (the "Effective Date") by and between THE CITY OF APACHE JUNCTION, an Arizona municipal corporation by and through its Municipal Court Department ("Customer"), and OSAM DOCUMENT SOLUTIONS, INC., an Arizona corporation, ("Contractor"), both of which may be hereinafter referred to collectively as the "Parties" RECITALS A On or about August 3, 2010, Contractor and the Arizona Supreme Court Administrative Office of the Courts ("AOC") entered into an agreement for electronic document management systems and related services (the "AOC Agreement"). B Pursuant to the AOC Agreement, any Arizona court or political subdivision on behalf of a court may procure materials or services described in the AOC Agreement for use by Arizona courts or judicial branch units without having to separately procure such services and products through a local bidding process For purposes of the professional services agreement between the Parties, the AOC Agreement has been incorporated into this Agreement as Exhibit A, but with exceptions noted in Section 7 below C As in the case of the AOC Agreement, Customer has similar electronic document management system needs and Contractor has a desire to provide such services and products to Customer as set forth in the Scope of Work (the "SOW") For purposes of the professional services agreement between the Parties, the SOW has been incorporated into this Agreement as Exhibit B, but with exceptions noted in Section 8 below D. The Parties have set forth below software/hardware and contemplated services Contractor will provide Customer, which includes managing the import, archival, and retention of court documents, and the payment terms for such services and products AGREEMENT NOW, THEREFORE, in consideration of the Recitals noted above, the mutual covenants and conditions below, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows: 1 CONTRACTOR'S DUTIES. Contractor agrees to perform the professional services and provide the products detailed in Exhibits A and B, subject to the modifications set forth in Sections 7 and 8 below Should any of the AOC Agreement terms conflict with any terms under this Agreement or the SOW, the terms of this Agreement and the SOW shall govern 1 AlIlk p 2 COMPENSATION: Customer shall compensate Contractor for its professional services and products as set forth in Exhibit B. 3. The go-live date for the proposed system shall be May 1, 2011, with final acceptance and satisfaction of all outstanding change orders serving as a pre-requisite Implementation by this date is a material term of this contract and failure to meet such deadline due to Contractor or supplier error shall render the Agreement terminated, with 100% refund of all amounts paid by City due and payable from Contractor for un-installed and/or unaccepted deliverables (b) A SOW and a Functional Specifications document detail Contractor's services and implementation and are attached hereto as Exhibit B and Exhibit C, respectively, and subject to the modifications set forth in Section 8 below. 5. Any action at law or in equity brought by either party for the purpose of enforcing a right or rights provided for in this Agreement, shall be tried in a court of competent jurisdiction in Pinal County, State of Arizona The parties hereby waive all provisions of law providing for a change of venue in such proceeding to any other county In the event either party shall bring suit to enforce any term of this Agreement or to recover any damages for and on account of the breach of any term or condition in this Agreement, it is mutually agreed that the prevailing party in such action shall recover all costs including• all litigation and appeal expenses, collection expenses, reasonable attorneys' fees, necessary witness fees and court costs to be determined by the court in such action. Amok 11 FORCE MAJEURE Neither Customer nor Contractor, as the case may be, shall be considered not to have performed its obligations under this Agreement in the event of enforced delay (an "Enforced Delay") due to causes beyond its control and without its fault or negligence or failure to comply with applicable laws, including, but not restricted to, acts of God, fires, floods, epidemics, pandemics, quarantine, restrictions, embargoes, labor disputes, and unusually severe weather or the delays of subcontractors or materialmen due to such causes, acts of a public enemy, war, terrorism or act of terror (including but not limited to bio- terrorism or eco-terrorism), nuclear radiation, blockade, insurrection, riot, labor strike or interruption, extortion, sabotage, or similar occurrence or any exercise of the power of eminent domain of any governmental body on behalf of any public entity, or a declaration of moratorium or similar hiatus (whether permanent or temporary) by any public entity directly affecting the obligations under this Agreement In no event will Enforced Delay include any delay resulting from unavailability for any reason of labor shortages, or the unavailability for any reason of particular contractors, subcontractors, vendors or investors desired by 4 Contractor in connection with the obligations under this Agreement Contractor agrees that Contractor alone will bear all risks of delay which are not Enforced Delay. In the event of the occurrence of any such Enforced Delay, the time or times for performance of the obligations of the Party claiming delay shall be extended for a period of the Enforced Delay; provided, however, that the Party seeking the benefit of the provisions of this Section shall, within thirty (30) calendar days after such Party knows or should know of any such Enforced Delay, first notify the other Party of the specific delay in writing and claim the right to an extension for the .-. period of the Enforced Delay; and provided further that in no event shall a period of Enforced Delay exceed ninety (90) calendar days 12 TERMINATION This Agreement may be terminated by either party upon six (6) months' written notice. If this Agreement is terminated, Customer shall be reimbursed from Contractor the amount paid for any undelivered and/or unaccepted products or services. Upon termination, Customer agrees to pay for all deliuvered, accepted, and properly invoiced services that were provided up to the announced Termination Date 13 INDEMNIFICATION. To the fullest extent permitted by law, Contractor shall defend, indemnify and hold harmless Customer, its agents, officers, officials and employees from and against all tortious claims, damages, losses and expenses (including but not limited to attorney fees, court costs, and the cost of appellate proceedings), relating to, arising out of, or alleged to have resulted from the acts, errors, mistakes, omissions, work or services of Contractor, its agents, employees, or any tier of Contractor's subcontractors in the performance of this Agreement Contractor's duty to defend, hold harmless and indemnify Customer, its agents, officers, officials and employees shall arise in connection with any tortious claim, damage, loss or expense that is attributable to bodily injury, sickness, disease, death, or injury to, impairment, or destruction of property including loss of use resulting therefrom, caused by an Contractor's acts, errors, mistakes, omissions, work or services in the performance of this Agreement including any employee of Contractor, any tier of Contractor's subcontractor or any other person for whose acts, errors, mistakes, omissions, work or services Contractor may be legally liable 14 LICENSE• Contractor represents and warrants that any license necessary to perform the work under this Agreement is current and valid. Contractor understands that the activity described herein constitutes "doing business in the City of Apache Junction" and Contractor agrees to obtain a business tax license pursuant to Article 8-5 of the Apache Junction City Code and keep such license current during the term of this Agreement Any activity by subContractors within the corporate city limits, will invoke the same business tax regulations on any subContractors, and Contractor ensures its subContractors will obtain any required business tax license 15. RECORDS• Records of Contractor's labor, payroll, and other costs pertaining to this Agreement shall be kept on a generally recognized accounting basis and made available to Customer for inspection on request. RIGHT OF CUSTOMER TO CONTRACT WITH OTHERS: Nothing in this Agreement shall imply Customer is obligated to obtain the services described herein with only this particular contractor. 17. WAIVER OF TERMS AND CONDITIONS: The failure of Customer or Contractor to insist in any one or more instances on performance of any of the terms or conditions of this Agreement or to exercise any right or privilege contained herein shall not be considered as thereafter waiving such terms, conditions, rights or privileges, and they shall remain in full force and effect. 18 COMPLIANCE WITH FEDERAL AND STATE LAWS Contractor understands and acknowledges the applicability to it of the American with Disabilities Act, the Immigration Reform and Control Act of 1986 and the Drug Free Workplace Act of 1989. 19 ENTIRE AGREEMENT. This Agreement and any attachments represent the entire agreement between Customer and Contractor and supersede all prior negotiations, representations or agreements, either express or implied, written or oral It is mutually understood and agreed that no alteration or variation of the terms and conditions of this Agreement shall be valid unless made in writing and signed by the parties hereto. Written and signed amendments shall automatically become part of the Supporting Documents, and shall supersede any inconsistent provision therein; provided, however, that any apparent inconsistency shall be resolved, if possible, by construing the provisions as mutually complementary and supplementary. 20 SEVERABILITY• If any part, term or provision of this Agreement shall be held illegal, unenforceable or in conflict with any law, the validity of the remaining portions and provisions hereof shall not be affected 21 CONFLICTS OF INTEREST This Agreement is subject to, and may be terminated by Customer in accordance with, the provisions of A.R.S. § 38-511 22 ACCURACY OF WORK• Acceptance of services or work by Customer shall not relieve Contractor of the responsibility for subsequent correction of any such errors and the clarification of any ambiguities. Consultant shall make all necessary revisions or corrections resulting from errors and omissions on the part of Contractor without additional compensation. Upon final completion and delivery of the proposed solution (the "Solution") to Customer, Vendor shall provide written notice to Customer that the Solution is delivered and that the 30-day Acceptance Testing Period, as defined and described below, shall commence Immediately upon Customers receipt of the notice described above, Customer may conduct testing procedures on the Solution to determine whether the Solution substantially conforms to the applicable functional specifications contained in the Detailed Design Document (the "Software Requirements Specification"). Such testing procedures shall be as mutually agreed upon by Vendor and Customer and shall be implemented and performed as follows For a period of thirty (30) calendar days after Customers receipt of the notice described above from Vendor(the "Acceptance Testing Period") Customer may conduct testing of the Solution to confirm that the Solution substantially conforms to the applicable functional specifications and to Customers good faith and reasonable satisfaction If, during the Acceptance Testing Period, Customer reasonably determines that a non-conformity of the Solution to the applicable functional specifications exists and Customer notifies Vendor in writing of such non-conformity, Vendor shall use commercially reasonable efforts to correct such non-conformity within ten (10) calendar days of receipt of such notice (during which time the running of the Acceptance Testing Period will be suspended) and cause the Solution to successfully pass acceptance testing to Customers good faith and reasonable satisfaction as set forth above Acceptance: If, at any time during the Acceptance Testing Period, Customer gives written notice to Vendor that the Solution has successfully passed acceptance testing to Customers good faith and reasonable satisfaction, then Customer shall be deemed to have accepted the Solution as of the date of such notice If Customer fails to give Vendor a notice of non-conformity(ies) during the Acceptance Testing Period, then Customer shall be deemed to have accepted the Solution as of the end of the Acceptance Testing Period If Customer has given such a notice of non-conformity(ies), and Vendor has corrected such non-conformity(ies) and delivered the corrected Solution to Customer,the Solution shall be deemed for all purposes to have been accepted by Customer as of the end of the Acceptance Testing Period Non-Acceptance: If Vendor has attempted to correct any non-conformities in the Solution after Customer has given notice of non-conformity(ies) during the Acceptance Testing Period on at least three (3) occasions with respect to a single identified non-conformity, and the corrected Solution still is not accepted as provided above, Customer may, in its sole discretion, and as Customers sole and exclusive remedy against Vendor arising out of any non-acceptance of the Solution. Customer agrees to take all reasonable steps to protect all Work Products and Innovations delivered by Vendor to Customer under this SOW, and any related documentation, from unauthorized copying or use If a Work Product consists of software, the source code of such Work Product shall be deemed to include trade secrets of Vendor or its suppliers The source code and embodied trade secrets are not licensed to Customer Customer agrees not to modify, disassemble, decompile, reverse engineer or otherwise attempt to derive source code from any such Work Product for any reason 3. Copies and Adaptations. Customer may not make or authorize the making of copies or adaptations of any Work Products Customer agrees. The Order to Show Cause or OSC form is created by a clerk in Microsoft Word ® through the case management system called AZTEC This non-compliance document is issued when a defendant has failed to comply and a court date must be scheduled for the defendant to meet with the Judge Once the clerk creates this OSC she will virtually print it into OnBase and index the document with the case number (and any additional keywords that are wanted). The OSC will automatically route to the Entry Queue that will transition it to the "OSC Awaiting Signature Queue" and wait for the judge's signature Document Types • CA-OSC • CA-Minute Entry NCL - Entry Queue Queue Description The Entry Queue is used to route the OSC document to the OSC Awaiting Signature Queue If it is a Minute Entry Document it will route it to the Minute Entry Awaiting Signature Queue. BACKGROUND "AmeriCorps VISTA is the national service program designed specifically to fight poverty. Founded as Volunteers in Service to America in 1965 and incorporated into the AmeriCorps network of programs in 1993, VISTA has been on the front lines in the fight against poverty in America for more than 40 years. VISTA members commit to serve full-time for a year at a nonprofit organization or local government agency,working to fight illiteracy, improve health services, create businesses, strengthen community groups, and much more. With passion, commitment, and hard work, VISTA workers create or expand programs designed to bring individuals and communities out of poverty. Each VISTA member makes a year-long, full-time commitment to serve on a specific project at a nonprofit organization or public agency In return for their service, AmeriCorps VISTA members receive a modest living allowance and health benefits during their service, and have the option of receiving a Segal AmeriCorps Education Award or post-service stipend after completing their service About 6,500 VISTAs are placed each year in more than 1,200 projects in low-income communities around the country VISTA members generally do not provide direct services, such as tutoring children or building homes. If successful, this program will be duplicated throughout the United States. Sarah Knaack's service has proven to be invaluable, the City wishes to share her accomplishments. DEC. 7, 2010, DIRECTION TO STAFF DIRECT STAFF TO INITIATE ORDINANCE AMENDMENT(S) CONCERNING PROPOSITION 203, NON-PROFIT MEDICAL MARIJUANA DISPENSARIES BACKGROUND: Proposition 203 is a ballot initiative approved during the general election on November 2, 2010. The initiative enacts a group of statutes titled the "Arizona Medical Marijuana Act," to include a new Chapter 28.1 in Title 36 and amendment of Arizona Revised Statute (ARS) 543-1201. The new law decriminalizes possession, sale and cultivation of marijuana for certain purposes under state law and provides for the establishment of non-profit medical marijuana dispensaries and off-site cultivation locations The law allows, on a statewide basis, one dispensary and off-site cultivation location for every 10 pharmacies, thus approximately 120 dispensaries could be established in Arizona. The law requires dispensaries to be at least 500 feet from a public or private school, but has no other requirements Local communities can establish zoning requirements for the location of dispensaries and off-site cultivation locations. Several local communities are in the process of adopting ordinance changes including Mesa, Gilbert, Queen Creek, Marana, Tucson, and Pima and Mancopa counties. The law specifically permits cities, towns and counties to enact zoning regulations for such medical marijuana dispensaries, and the City has the authority to enact such zoning regulations pursuant to ARS Title 9, Article 6 1 Page 1 of 5 Proposition 203, also known as the Arizona Medical Marijuana Act, allows a "qualifying patient" who has a "debilitating medical condition" to obtain an "allowable amount of marijuana" from a "non-profit medical marijuana dispensary" and to possess and use the marijuana to treat or alleviate the debilitating medical condition or symptoms associated with the condition. The Arizona Department of Health Services (DHS) would be required to adopt and enforce a regulatory system for the distribution of marijuana for medical use, including a system for approving, renewing and revoking the registration of qualifying patients, designated caregivers, non-profit dispensaries and dispensary agents. The costs of the regulatory system would be paid from application and renewal fees collected, civil penalties imposed and private donations received pursuant to the proposition A "qualifying patient" is defined as a person who has been diagnosed by a physician (a doctor of medicine, osteopathy, naturopathic medicine or homeopathy) as having one of the following debilitating medical conditions. 1. Severe and chronic pain. c Severe nausea d Seizures (including those characteristic of epilepsy) e. Severe and persistent muscle spasms (including those characteristic of multiple sclerosis) 10 Any other medical condition added by DHS through a public petition process. In .. order to register with DHS, a qualifying patient must submit a signed written certification issued by the physician that states the physician's professional opinion that the patient is likely to receive therapeutic or symptom-relieving benefits from the medical use of marijuana to treat or alleviate a debilitating medical condition The certification must specify the debilitating medical condition and must be made in the course of a physician-patient relationship after the physician has completed a full assessment of the patient's medical history. If the qualifying patient is under 18 years of age, the patient's custodial parent or legal guardian must submit written certifications from two physicians and the custodial parent or legal guardian must consent in writing to control the patient's medical use of the marijuana A qualifying patient who is registered with DHS (or a registered designated caregiver on behalf of the qualifying patient) may obtain up to 2 5 ounces of marijuana in a 14-day period from a registered non-profit Page 2 of 5 medical marijuana dispensary. If the qualifying patient's home is located more than 25 miles from the nearest non-profit medical marijuana dispensary, the patient or designated caregiver may cultivate up to 12 marijuana plants in an enclosed, locked facility. (CAN the City require a CUP for this, a single entity/residential location or are we covered by limiting dispensaries in commercial areas and cultivation in industrial areas?) A registered non-profit medical marijuana dispensary must be operated on a not-for- profit basis, but may receive payment for all expenses incurred in its operation. DHS may not issue more than one non-profit medical marijuana dispensary registration certificate for every ten pharmacy permits issued by the Arizona State Board of Pharmacy under current law The dispensary may cultivate marijuana only in an enclosed, locked facility and may acquire marijuana from a registered qualifying patient or designated caregiver if the patient or caregiver is not compensated for the marijuana. The proposition specifies various security, record-keeping and verification requirements relating to the operation of dispensaries. Proposition 203 generally provides that any person who acts in conformity with the requirements of the proposition is not subject to any governmentally imposed sanction relating to the medical use of marijuana. This proposition would prohibit certain discriminatory practices, including the following. 1. A school or landlord may not refuse to enroll or lease to a person registered pursuant to this proposition unless failing to do so would cause the school or landlord to lose a monetary or licensing benefit under federal law. 2 An employer may not discriminate against a person registered pursuant to this proposition in hiring, terminating or imposing employment conditions unless failing to do so would cause the employer to lose a monetary or licensing benefit under federal law Further, an employer may not penalize a qualifying patient registered pursuant to this proposition for a positive drug test for marijuana, unless the patient used, possessed or was impaired by marijuana on the employment premises or during hours of employment Proposition 203 would not 1. Authorize a person to undertake any task under the influence of marijuana that constitutes negligence or professional malpractice. 2. Authorize possessing or using medical marijuana on a school bus, on the grounds of a preschool, primary school or high school or in a correctional facility 3. Authorize smoking marijuana on public transportation or in a public place 4. Authorize operating, navigating or being in actual physical control of a motor vehicle, aircraft or motorboat while under the influence of marijuana A registered Page 3 of 5 qualifying patient would not be considered to be under the influence of marijuana solely because of the presence of marijuana in the person's system that appears in a concentration insufficient to cause impairment. 5. Require a government medical assistance program or private health insurer to reimburse a person for costs associated with the medical use of marijuana 6 Require an owner of private property to allow the use of marijuana on that property. -b, 7 Require an employer to allow the ingestion of marijuana in the workplace. 8 Prevent a nursing care or other residential or inpatient healthcare facility from adopting reasonable restrictions on the provision, storage and use of marijuana by residents or patients. CITY COUNCIL DISCUSSION AND DIRECTION: This item is scheduled for discussion only at the City Council's Work Session on December 6. However, at their regular meeting on December 7, it is recommended that the Apache Junction City Council direct staff to initiate a Zoning Code Text Amendment that 1. Limits the location of medical marijuana dispensaries and off-site cultivation locations to commercial and industrial zones; creates definitions for dispensaries and off-site cultivation locations, allows dispensaries with on-site cultivation to be located in commercial or industrial zones, allows off-site cultivation facilities (not co-located with a dispensary) to be only in industrial zones, prohibits medical marijuana dispensaries and/or off-site cultivation locations in any Planned Community District 2. Requires a dispensary or off-site cultivation facility to be located in a permanent building, not in a cargo container, manufactured building of any kind, RV, trailer, or motor vehicle. 3 Requires a Conditional Use Permit approved by the Planning and Zoning Commission for a medical marijuana dispensary or medical marijuana off-site cultivation location 4 Requires a Conditional Use Permit application for a dispensary or medical marijuana cultivation to include, at a minimum, the following supplemental information • Certification that the property owner is aware the property will be used for marijuana dispensing or cultivating and providing documentation that the applicant can meet DHS standards for approval, Page 4 of 5 • Requires a list of the operating organization's officers and board of directors and a certification that the operators comply with requirements in the law prohibiting criminal history, • Application or acknowledgement to obtain a City Business or Operating License, • Limit on floor area and hours of operation, • Prohibition on drive-through pickup windows and delivery service, and • Prohibition on outdoor seating areas at dispensaries and cultivation locations. Required spacing requirements' • At least 2,000 feet from other dispensaries and off-site cultivation locations, • At least 1,000 feet from schools, day care centers and churches, • At least 1,000 feet from drug and alcohol rehabilitation facilities, • A least 1,000 feet from other sensitive land uses as determined by the Zoning Administrator on a case by case basis, and • Allows the Planning and Zoning Commission to add permit conditions necessary to conserve and promote the public health, safety, convenience and general welfare 5. Additional Requirements to consider • Security Plan including lighting, alarms, secure storage, and other necessary building safety measures, • Prohibit on-site consumption, • Limit to one dispensary per ten pharmacies in the City, • No off-site cultivation without associated dispensary; and • No more than one off-site cultivation location per dispensary 6.
