3 Presentation and discussion of case SD-2-15, a proposed
.••. preliminary plat for Old West Marketplace by Barclay Group and
Sustainability Engineering Group (SEG), representing WGG
Partners LLC (owners) The applicants propose to re-plat the old
Apache Junction Plaza subdivision and absorb it into a new
larger commercial subdivision to be called Old West Marketplace,
to include about 151,000 square feet of retail and commercial
space on six new lots at the northeast corner of Old West
Highway and Idaho Road

NUMBERS AND HER NUMBERS WERE INVALID AT THE TIME WE ATTEMPTED TO CONTACT HER SHE
ALSO DOES NOT HAVE COMPUTER ACCESS AT THIS TIME AND COULD NOT RESPOND TO EMAILS SENT
TO HER. SHE THEREFORE WAS UNAWARE OF HER TERM EXPIRATION OR THE NEED TO FILE ANEW

(BOARD/COMMISSION INTERVIEWS)
Interviews for the October 19 work session are for all valid applicants and reappointees for
the Construction Code Board of Appeals, Health and Human Services Commission,
Industrial Development Authority and Municipal Property Corporation. The Construction
Code Board of Appeals has two year terms of office The Health and Human Services
Commission and the Municipal Property Corporation have three year terms of office The
Industrial Development Authority has six year terms of office. There are vacant positions
on the Construction Code Board of Appeals and Industrial Development Authority.
The Health and Human Services Commission allows limited membership for non-city
residents according to Apache Junction City Code 2-11-2(C), attached for your reference
Only two of the five positions maybe filled by non-residents There are two positions to be
filled this year Dana Osborne, a non-resident, is requesting to be reappointed. There is
one non-resident currently on the commission.
Most individuals whose terms are expiring have indicated a desire to be reappointed
The following list includes (a) current board/commission members who have expressed
interest in being reappointed, (b) new applicants who have expressed interest in being
appointed to a city board or commission and (c) applicants previously interviewed but not
appointed and the applications are less than two years old. Letters were sent to all
applicants and those requesting reappointment for the boards/commissions
Copies of the talent bank applications have been given to council in an accompanying
notebook. If an applicant for reappointment/appointment is currently on another
board/commission, it is so noted under "Additional Comments" in each section of the
notebook

serve in a manner related to the knowledge I have gained over the last 20+years working in Arizona in the
construction Industry. I have extensive knowledge in the Park Model/Arizona Room area of construction.

I have always wanted to serve my community in someway. I have recently accomplished the Citizen
Leadership Institute classes offered byApache Junction and would like to pay my community back for the

Regarding: Updates to the City's Auc ' Pawnshop and Second
Hand Dealers Ordinance
The Police Department and City Attorney's Office have been working together to revise the
current outdated City Ordinance relating to Auctions, Pawnshops and Second Hand Dealers.
This is being proposed due to current best practices and emerging new technology now
available to both law enforcement and the business community
Staff has recognized the need to modify and update the ordinance as it has become
cumbersome and inefficient due, in part, to inaccurate submissions, illegible forms, poor quality
photographs and rising costs to the City By updating the ordinance and partnering with
LeadsOnline, a nationally recognized online investigation system, City businesses will be
equipped with the means to easily comply with mandatory reporting requirements.
Additionally, a representative from LeadsOnline will be present at the City Council Work Session
scheduled for October 19, 2015, to present the proposed program and the many benefits it can
provide to the affected businesses, the Police Department and community at large ,�

WHY CHANGE?
New ordinance will allow all participants to use one unified records
management system for all transactions.
lig law enforcement agencies in Arizona use Leads Online.
45 agencies in Pinal County and Maricopa County use Leads Online.
Will eliminate the tons of paper being delivered and used by PD and Shop
owners and let us not forget the money saved in stamps & printing.
For the period of September 2014 to present:
Police department volunteers have spent over x10 hours manually entering and
tracking pawn tickets.
Over 3,000 pawn tickets were handled.
Over 4,800 items were pawned.
Some police departments have Detectives solely assigned to the Pawn
Division.
Other departments have an edge in the fight to recover and prosecute their cases
faster.

WHY CHANGE?
New ordinance will assist to quickly identify and recover any property
from active cases.
Quicker access to property pawned/sold from within our city and
nationwide means faster recovery of property/evidence and facilitate
more timely prosecution.
Implementing this ordinance will ensure that all businesses and the
Police Department will work together collaboratively.
Implementing this new ordinance with the new technology will
safeguard citizen property and businesses involved.

Secondhand dealer means a person conducting the business of buying, selling,
trading, exchanging, accepting for sale on consignment, or otherwise dealing in
secondhand items or precious items, or both secondhand items and precious items,
whether such business is the principal or sole business conducted or is merely
incidental to, in connection with or a branch or department of some other business.
This definition includes antique dealers, auctioneers and auction houses
receiving actual possession of secondhand items by purchase or consignment for
sale at auction or otherwise and dealers of precious items, as that term is used in
A.R.S. § 44-16o1 et seq. This definition shall not exempt any person who buys
secondhand items for cash.
In addition to obtaining and maintaining a business license pursuant to section
of this Code, each pawnbroker, junk dealer and secondhand dealer shall pay the
required reporting fees, as set from time to time by resolution of the town council,
except that a secondhand dealer who is a non-profit charitable organization,
qualified and registeredpursuant to Section 501(c)(3) of the United States Internal
Revenue Code shall not be required to pay the required reporting fees.

§ 17-1-2 LICENSE REQUIRED
All Pawnbrokers, Secondhand Dealers and Auctioneers must be licensed to do business in the
city limits under A.J.C.C. Chapter 8 and must obtain a regulatory license ("RL") under tlus
chapter
^ § 17-1-3 LICENSING REQUIREMENTS AND FEES
A person shall not act as a Pawnbroker, Secondhand Dealer or Auctioneer until licensed with an
RL issued by the city
(A) An RL may not be sold or transferred without the approval of the police department
(B) A person applying for a new Pawnbroker RL is required to pay a non-refundable application
fee of one thousand dollars ($1,000.00)to the city as mandated under A J C C , Vol I, Chapter 4,
due at the time the application is filed
(C) Each licensed Pawnbroker is required to pay a non-refundable renewal fee of five hundred
dollars($500 00) annually to the city. The annual renewal fee is due no later than January 3 1"of
each year as mandated under A.J C.C., Vol. I, Chapter 4
(D)A licensee who fails to renew an RL within thirty (30) calendar days after the payment of the
RL fee is due is subject to a penalty of one hundred dollars ($100 00) payable with the RL
renewal fee
(E)A Pawnbroker, Secondhand Dealer or Auctioneer shall not conduct business at a location
other than where it is licensed as initially established in its RL on file with the police department

(F) The police department shall require any person, other than a bank or licensed lending
institution, having any interest, directly or indirectly, in a Pawnshop, to submit a full set of
fingerprints, together with the applicable fingerprint and background check processing fees for
each person, to the police department within 30 days from the date of application The police
department shall process the fingerprints for the purpose of obtaining a state and federal criminal
records check pursuant to A R S § 41-1750 and Public Law 92-544 The police department may
exchange tlus fingerprint data with the Federal Bureau of Investigation
(G)A corporation shall own the entire equitable interest in its RL through an agent if the agent is
otherwise qualified to hold a Pawnbroker RL The agent is subject to the penalties prescribed for
any violation of law relating to Pawnbrokers On the death, resignation or discharge of an agent

of a corporation holding a Pawnbroker RL, the corporation shall promptly assign the RL to
another qualified agent selected by the corporation and shall notify the police department as well
as meet all requirements of A.J C C Chapter 8.
(H)The City shall not issue or renew a Pawnbroker RL-
(1) to a person who,within one year before the filing date of the Pawnbroker application, has
violated any provision of a previously issued Pawnbroker RL or has had a Pawnbroker
RL revoked,
(2) to a person who, within five years before filing the Pawnbroker application, has been
convicted of a felony involving trafficking in stolen property, fraudulent schemes,
forgery, theft, extortion or conspiracy to defraud or any other crime involving moral
turpitude,
(3) to a corporation unless it has on file with the city a list of its officers and directors and
any stockholders who own ten percent or more of the corporation within 30 days from the
date of RL application;
(4) to a corporation if any of its officers or directors or any stockholder who owns ten percent
or more of the corporation has within five years been convicted of a felony involving
trafficking in stolen property, fraudulent schemes, forgery, theft, extortion or conspiracy
to defraud or any other crime involving moral turpitude.
(5) to a person or corporation that has knowingly made any false statements or material
misrepresentations in the RL application
(6) to a person or entity that is in arrears in any transaction privilege or use tax amount
(I) A person shall not use the word "pawn", "pawnshop", "pawnbroker", "secondhand dealer",
"auctioneer" or"auction house" in its business name, on any sign or in any advertisement unless
the person is licensed as a Pawnbroker pursuant to this article.
§ 17-1-4 REVOCATION AND SUSPENSION OF RL AND ADMINISTRATIVE
APPEAL
(A) To suspend or revoke any license issued under this chapter, the chief of police shall deliver
or mail by certified mail to the business address as shown on a licensee's application, a written
notice that such license is suspended or revoked The reason for such suspension or revocation
shall be set forth in the notice The notice shall also contain the licensee's rights and procedures

to appeal such suspension or revocation. A suspended or revoked license shall be surrendered to
the chief of police on demand. If an appeal is requested, the licensee has a right to an appellate
hearing with the city manager. If an appellate hearing to the chief s decision is desired, the
licensee shall file for an appellate hearing with the city clerk's office within 10 working days of
receipt of the chief of police's notice of suspension or revocation Failure to demand a hearing
within that time will constitute a full waiver. After considering evidence presented at the hearing,
the city manager shall make a decision to uphold or repeal the license suspension or revocation
and shall deliver or mail by certified mail the results of the decision to the business address as
shown on the license application. The city manager's decision shall be considered the final and
binding administrative action of the city.
(B) Any person aggrieved by the city manager's decision pursuant to subsection (A) above shall
have the right of appeal to the Pmal County Superior Court Any action to review a final
administrative decision shall be commenced by filing a notice of appeal within thirty-five (35)
days from the date when a copy of the decision sought to be reviewed is served upon the
licensee The appeal shall contain a written statement setting forth fully the grounds for the
appeal pursuant to A R S § 12-901, et seq.
(C)Notwithstanding any other provisions of this chapter, any RL shall be revoked by the chief of
police for one (1) year upon a showing that the applicant or an employee thereof has been
convicted of violating 1) any of the provisions of A R S Title 44, Chapter 11, Article 3 in the
conduct of business of the establishment, 2) any violation of this chapter; 3) sufficient evidence
exists showing RL licensee or his or her employees used or is using the premises for an illegal
purpose
(D) No person may reapply for any license after denial, revocation or non-renewal of such
license unless the cause for such denial, revocation or non-renewal has been removed or
corrected and unless all past due fees have been paid.
§ 17-1-5 PAWN TRANSACTIONS
(A)The length of all Pawn Transactions is a nummum of ninety(90) calendar days, except that a
longer term may be contracted between the Pawnbroker and the Pledgor.
(B)A Pawnbroker shall not enter into a Pawn Transaction or good faith outright purchase of
tangible personal property with a person who is less than eighteen years of age
(C)A Pawnbroker shall not enter into a Pawn Transaction or good faith outright purchase of
tangible personal property that has a manufacturer's serial number that has been removed, altered
or obliterated

(D) Before entering into a Pawn Transaction or good faith outright purchase of tangible personal
property, a Pawnbroker shall require the Pledgor or seller to identify himself with an
identification document sufficient to verify the information required pursuant to A.R.S § 44-
1625
(E)A Pawnbroker shall retain any pledged goods at the Pawnbroker's place of business or any
other storage location approved by the police department ^
(F) The Pawnbroker and Secondhand Dealers shall retain any property obtained by good faith
outright purchase in its original form for twenty(20) calendar days after the original Transaction
Date at the Pawnbroker's place of business or other storage location approved by the police
department
(G) A Pawnbroker shall maintain at the Pawnbroker's place of business records of each
Reportable Transaction and all Pawn Tickets and shall retain the records for at least two years
after the date when the transaction occurred or as long as the police department communicates to
the Pawnbroker what is the required record retention period according to departmental policy.
The Pawnbroker shall ensure that the records include accurate copies of all transaction receipts
or Pawn Tickets. On request by the police department, the Pawnbroker shall allow the agent to
inspect the Pawnbroker's receipts, Pawn Tickets or any federally or state mandated alcohol,
tobacco and firearms logs or to review any article received by the Pawnbroker by pledge,
purchase or trade.

(H)A Pawnbroker shall produce the Pawnbroker's register, shall exhibit all articles received by
the Pawnbroker in pledge or purchase or shall produce the Pawnbroker's account of sales to a
local law enforcement agency on the agency's request to inspect the register, articles or accounts
of sales of the Pawnbroker or on service of a search warrant or order issued by a judge or
magistrate
§ 17-1-6 PAWN TICKETS REQUIRED
(A)All Pawn Transactions must be evidenced by a Pawn Ticket that is issued at the time of the
Pawn Transaction
(B)A Pawn Ticket shall include,at a minimum,all of the following-
(1) The name, address and telephone number of the Pawnshop and Pledgor per ticket
(2) The birth date and physical description of the Pledgor, including gender, height, weight,
hair and eye color and race

(3) The number and type of the identification document presented by the Pledgor
(4) A listing of the individual articles left in the possession of the Pawnbroker, unless legally
exempt.
(5) The date of the Pawn Transaction
(6) The maturity date of the Pawn Transaction which shall be set forth in at least twelve-
point type.
(7) The principal amount of the Pawn Transaction
(8) The following statement in at least ten-point type "You are not obligated to redeem the
Pledged Goods. The Pledged Goods will be forfeited to the pawnbroker after the maturity
date unless the Pledged Goods are redeemed or you enter into a new pawn transaction for
the Pledged Goods."
(9) A digital photograph of the item
§ 17-1-7 DISPOSITION OF PROPERTY SEIZED BY POLICE DEPARTMENT FROM
PAWNSHOP
(A) Scope
(1) Property that is in the possession of the police department and that has all of the
characteristics set forth in subsection B of this section shall be disposed of pursuant to
this article
(2) Property that is in the possession of a business regulated by A J C C , Vol I, Chapter 8
and that has characteristics 2 through 5 of subsection B of this section may be disposed of
pursuant to this article.
(B)Property included-
(1) Property that has come into the possession of the police department by means of seizure
by the department or some other law enforcement agency
(2) The city has reason to believe that the property was stolen or otherwise taken from a
lawful possessor through criminal conduct

(3) No Arizona court has before it a petition against a suspect alleged to have stolen the
property.
(4) Two or more persons are known or believed to have made or can reasonably be
anticipated to make a claim for possession of the property.
(5) The city makes no claim to possession of the property Asdh
(6) The property will not be required to be retained for use as evidence in any legal
proceeding other than the hearing under this article.
(C) Initiation of Petition The police department shall file a petition with the hearing officer
setting forth the following
(1) The facts establishing compliance with the basis for the action under subsection B
(2) The name and address of each person described in subsection B(4).
(3) An accurate description of the property, any identifying marks or senal numbers, the
police identification number(s), the location where seized and the person from whom
seized
(D) Service of the Petition,Notice of Hearing
(1) The petition shall be served either personally, by first class mail, postage prepaid, return
receipt requested or through any other reasonable means that affects actual service, upon
all persons known to have an interest in the property, each person described and named in
subsection B(4)and, in all cases,upon the person from whom the property was seized ,^
(2) A copy of this article shall be served with each petition
(3) There shall also be served at the same time of the petition and a copy of this article, a
Notice of Hearing establishing the hearing date, time and place The hearing date shall
be set not less than twenty-five (25) nor more than sixty(60) calendar days after the date
of service of the petition and notice, subject to subsection G below or agreement of
respondents.
(4) Service by mail shall be made to the last known address of all persons included in
Subsection 1 of this section

(5) Service shall be complete upon receipt of notice of hearing
(6) Proof of service upon each potential claimant shall be delivered to the hearing officer.
(E) Claimant's Rights.
loaft (1) Any person claiming an interest in the property shall be known as a "respondent" The
person from whom the property was seized shall be considered a "respondent" unless that
person signs a waiver relinquishing all interest in the property
(2) A respondent or any other person claiming any ownership interest of any kind or
possessory right to the property, shall have the right to appear at the hearing and to
present any and all evidence in support of such person's claim to the property
(3) Except as provided in subsection F(2) of this Article, the failure of any person to appear
at such hearing shall constitute a waiver of any claim to the property by such person as
against the City and shall authorize the hearing officer to enter a ruling consistent
therewith
(F) Conduct of Hearing.
(1) The hearing shall be conducted informally and the technical rules of evidence shall not
apply provided that the decision of the hearing officer shall, in all cases, be based upon
substantial and reliable evidence. All parties shall have the right to be represented by
counsel, to present evidence and testimony in support of their position and to cross
examine adverse witnesses. All witnesses shall be placed under oath before testifying
The hearing officer may permit a respondent to appear at the hearing telephonically upon
good cause shown
(2) The burden of proof shall be at all times upon the person or person challenging the
possession of the regulated business or the party from whom the property was taken by
the police department, even if the regulated business or the party from whom the property
was taken does not appear at the hearing.
(3) The hearing shall be recorded electronically or by other means
(4) The decision of the hearing officer shall be issued within ten (10) calendar days after the
hearing is concluded The decision shall be in writing and shall be hand-delivered or
mailed by first class postage prepaid United States mail to each respondent or claimant
who attended the hearing

(5) The decision of the hearing officer shall be final upon issuance
(G) Hearing Continuance. The hearing officer may grant a request to continue the hearing on
good cause shown.
(H) Judicial Review Any respondent or other party participating in the hearing who feels
aggrieved by the decision of the hearing officer may seek Judicial review by way of special
action or other available remedy in superior court
(I)Hearing Officer All petitions filed pursuant to this article shall be assigned to and considered
by a hearing officer designated by the city manager. Such hearing officer or designee shall in no
event be an employee of the police department
(J)Release of Seized Property-
(1) Any person prevailing in a hearing or uncontested proceeding convened pursuant to
subsection C of this article shall be entitled to receive the property described in the
petition after producing a copy of the decision in their favor and appropriate
identification to the property's custodian.
(2) No property may be released pursuant to this subsection until the expiration of forty
five(45)calendar days from the date of the hearing officer's decision
(K) Release of Unseized Adjudicated Property.
(1) Any peace officer of the police department may seize the property from the regulated
business or other person in possession of the property upon the hearing officer's order
that a respondent or claimant other than the regulated business or other person has the
greater claim to possession of the property
(2) A receipt identifying the property, the peace officer involved in the seizure and the
date of the seizure shall be given to any regulated business or other person from
whom property is seized pursuant to this section
(3) The property, upon its seizure by the police department pursuant to this section, will
be given to the respondent or claimant prevailing at the hearing unless the property is
required to be retained by the police department for use in any legal proceeding. At
the expiration of any such legal proceeding and related appellate periods the property
shall then be given to the prevailing respondent or claimant

(4) No property seized by the police department pursuant to this section may be given to
the prevailing respondent or claimant until the expiration of twenty(20)calendar days
after the issuance of the hearing officer's decision.
(5) The respondent or claimant prevailing at the hearing shall sign a receipt for any
property returned to that person pursuant to this section.
(6) Notwithstanding any other provision of this chapter, a regulated business may not
dispose of any property that has been made the subject of a decision by the hearing
officer pursuant to this Article, except as ordered by a court, the hearing officer or
any peace officer
(L) Limited Effect of Hearing Officer Decision- Nothing in this article shall prevent any person
from filing an action in a court of appropriate jurisdiction to establish ownership of or right to
possession to the property
§ 17-1-8 REPORTS REQUIRED
(A) Every person engaged in the business of Pawnbroker, Auctioneer or Secondhand Dealer
shall make out and deliver to the chief of police a true, complete and accurate report each day
any article is received through a reportable transaction Reports shall be submitted electronically
by Pawnbrokers, Auctioneers or Second Hand Dealers via LeadsOnline or other comparable
software provider selected by the city within 24 hours after the receipt of the property concerned
is written.
(B) Each Pawnbroker, Secondhand Dealer and Auctioneer shall pay to the city a fee in the
amount of three dollars ($3 00) pursuant to A J C C , Vol I, Chapter 4, for each report required
to be prepared pursuant to A R S § 44-1625(A) and A J C C § 17-1-8 Each transaction report
shall include no more than three (3) items For the purposes of this subsection, multiple non-
serialized items of the same type that are delivered in a single transaction and that have no
owner-assigned numbers, engravings, inscriptions, monograms or other unique identifying
characteristics,may be considered one (1) item on the report Every transaction report entry over
three (3) will require a $1.00 surcharge per item listed The $3 00 report fee and the $1 00 per
item surcharge shall be due and payable to the city on the 30th day of April, July, October and
January and shall be based on the number of reports submitted to the city during each quarter
(C)Each report shall include at least all of the following.
(1) The last, first and noddle name of the Pledgor or Seller

(2) The permanent address and telephone number, if applicable,of the Pledgor or Seller.
(3) The birth date and physical description of the Pledgor or Seller including gender, height,
weight,hair and eye color and race
(4) The number and type of the identification document presented by the Pledgor or Seller
(5) An accurate, legible description of each item pledged or sold, including the
manufacturer's name, model number, serial number, caliber, size, type of item and any
owner-applied number,inscription or monogram.
(6) The Pawnbroker's name and address and the clerk's initials and identifying number
(7) The date and time of the initial Pawn Transaction
(8) The type of Pawn Transaction and initial pawn ticket number
(9) A fingerprint of the Pledgor or Seller.
(D) The Pledgor or Seller shall sign the report and attest to the following statement that shall
appear on the report in at least ten-point bold type
"All information in this report is complete and accurate. I am the owner of the goods
described in this report or I am authorized to enter into this Pawn or sale transaction on
behalf of the owner of the goods described in this report I understand that I will be
guilty of a class 1 misdemeanor if the information in this report is not complete and
accurate, if I am not the owner of the goods pledged or sold or if I am not authorized to
enter into the Pawn or sale transaction on behalf of the owner of the goods
(E) No item shall be sold or exchanged by any Pawnbroker and Secondhand Dealer or
Auctioneer until it shall have been in the custody thereof for twenty (20) calendar days after
completing and delivering to the chief of police the report required under subsection(A)above.
(F) Every person engaged in the business of Secondhand Dealer shall record the description of
every article sold and shall comply with all LeadsOnline or other comparable software provider
reporting requirements listed in (B) Such person shall also record the name and address of the
purchaser of such articles This record shall be held by the dealer or Secondhand Dealer for at
least one hundred eighty(180)calendar days after the sale

(G) Upon notification by representatives of the police department that goods and articles
received on deposit or consignment, in Pawn, pledge, trade, exchange or purchase, are the fruits
of a crime, no Pawnbroker, Secondhand Dealer or Auctioneer shall dispose of the property
Interest upon the goods and articles pawned or pledged shall cease to accrue on the date of the
notification
(H) Every person engaged in the business of Pawnbroker, Secondhand Dealer or Auctioneer
shall prominently display a copy of these provisions in a conspicuous place on the premises of
the business
(I) Every person engaged in the business of Pawnbroker, Secondhand Dealer or Auctioneer who,
in the conduct of the business, comes into possession of abandoned property, shall turn over the
property to the police department for which a receipt shall be issued If ownership of the
property is not established within ninety (90) calendar days after delivery to the police
department, the property shall be returned to the person from whom the police department
obtained possession This subsection shall not apply to unredeemed pawned or pledged articles
(J) The business premises of any Pawnbroker, Secondhand Dealer, or Auctioneer along with
their Pawn Transaction records, and stock of goods and articles, shall be open at reasonable
hours to reasonable inspection by representatives of the police department or the city clerk's
office
(K) No person engaged in Pawnbroker, Secondhand Dealer, or Auctioneer business shall
knowingly permit a person whose RL is under revocation or suspension to be employed in any
capacity of such establishment
§ 17-1-9 VIOLATIONS
Any person convicted of a violation of any provision of this chapter shall be guilty of a class one
misdemeanor and shall be punished as authorized under Article 1-1-I I(A)of this Code.

Background
Barclay Group and SEG, represented by Colby Fincham, have
applied for preliminary plat approval for a proposed 6-lot
commercial subdivision to be called "Old West Marketplace" The
B-3 (City Center) -zoned, 18 59-acre development site, previously
included the never-built-out, obsolete, Apache Junction Plaza
Subdivision (northeast corner of 2nd Avenue and Idaho) , where the
City recently completed a land swap for the proposed downtown
park property.
The developers propose a +/-151, 000 square-foot shopping center
which includes a 123, 000 square-foot grocery store anchor and
ancillary retail and business pads and lots, such as for a bank
and fast food restaurants They propose to develop the site in
compliance with all of the city' s development standards, thus no
rezoning or planned development approval process is necessary.
The property is located at the northeast corner of Old West
Highway and Idaho Road, and is also bounded on the north by
Junction Street and Outpost Road on the east
Planning and Zoning Commission Recommendation
The Planning and Zoning Commission public hearing on the pre-
plat is scheduled for October 13, 2015 Their recommendation on
the proposed subdivision will be presented to the Council
verbally at their work session on October 19.

LOCATION: The property is located at the northeast
corner of Old West Highway and N. Idaho
Road and includes the old gas station, the
2nd Avenue alignment, Apache Junction Plaza
and a couple of other undeveloped parcels

BACKGROUND .w.
The Apache Junction Plaza subdivision was a commercial subdiv-
ision platted in 1962 prior to City incorporation. As a sub-
division, it was never developed the way it was intended, with
around 50 small shops around a central parking area. There was
a fence company that developed one of the small parcels and the
City also had the library there, which later became the Apache
Junction Water Company building. None of the other parcels were
ever developed to the best of our knowledge and for all intent
and purposes it was an obsolete subdivision, with fragmented
ownership interests for decades.
In more recent years, the parcel ownership was consolidated by a
downtown LLC group who had hoped to absorb the property into a
larger downtown redevelopment plan. Finally, the old subdiv-
ision and a few other parcels around it are an the process of
being acquired by the Barclay Group, who is working with a
developer to reconfigure the properties into a commercial
shopping center.
CURRENT PROPOSAL
The Barclay Group and SEG are proposing a preliminary plat for a
commercial subdivision—a shopping center--bordered by Idaho Road .nk
on the west, Old West Highway on the south, Junction Street on
the north and Outpost road on the east. Old West Marketplace
will include a ma3or anchor tenant grocery store and fueling
station, and 5 other commercial parcels which are proposed to be
developed with a bank, a couple of fast food pads and some
ancillary retail and shops . The anchor tenant alone is proposed
to be developed with 123, 000 square feet of retail space, and
the additional shops will add about another 28, 000+ square feet
of retail and commercial space (see proposed preliminary plat
attached) .
Because the properties are properly zoned and the applicants are
not proposing any deviations from standard zoning, landscape or
parking requirements, there is no rezoning needed in this case,
just presentation and approval of the preliminary and final
plats, which we hope to finalize no later than December.

Concurrent with the proposed plats, the applicants are also
working with the Public Works Department and the utility
companies to abandon and/or relinquish old rights-of-way and
utility easements which currently affect the properties.
PLANNING STAFF ANALYSIS AND FINDINGS
Relationship to General Plan:
The subject site and properties to the north, south and west are
designated "Downtown Mixed Use". Properties immediately east of
the site are designated "Community Commercial". The proposed
use is in compliance with the General Plan designated land uses
for the area.
Zoning/Site Context:
The 18 . 59 acres property is currently zoned B-3 (City Center) ,
under the city' s newly adopted zoning ordinance, as mentioned in
the background information. The site is bordered by vacant
properties on the north, various retail and office uses to the
west and south, and by residential uses and other commercial
uses to the east. The northeast corner of the site is adjacent
to an old abandoned residence which is not a part of the
proposed subdivision. The proposed commercial subdivision is an
allowed use in the B-3 zone, and the applicants are proposing to
develop the property in compliance with all city codes and
standards (zoning, landscaping, parking, engineering, design
guidelines, etc. ) ; thus no rezoning or planned development
�.. approval process is needed.
Street Improvements:
The property' s main entrance point will be from Old West Highway
("OWH") . Secondary access points are proposed on Idaho and
Junction. The SEG engineers and the city' s engineers are
working together to create an east-bound and west-bound main
entry way at OWH, which will involve at least one new median
break. The access point at Idaho will also be a full access
entry point. The access points on Junction will allow for both
right and left turns. Most traffic is expected to use the OWH
access point . Other streets and utility easements not needed
for the development, such as 2"d Avenue and Explorer Road, are in
the process of being abandoned and/or relinquished through the
Public Works Department and the utility companies to make way
for the shopping center. The developers will construct the

necessary street improvements on OWH, Idaho and Junction. Since
no access point is proposed on Outpost Road, no additional
improvements are proposed on that road.
Public Input: •-.
Since the property is already properly entitled and there is no
rezoning involved, public outreach is not required to plat the
subdivision. Public outreach related to the road abandonment/
relinquishment issue is being handled by Public Works as part of
their process.
P&Z COMMISSION WORK SESSION
At their work session on September 22, the Commissioners seemed
amenable to the proposed development, welcoming new retail and
shopping opportunities to Apache Junction. The dissolving of
the old obsolete plat of Apache Junction Plaza will finally make
way for new Dob generating and sales tax generating development .
PLANNING DIVISION RECOMMENDATION
Staff comments and comments from other reviewing agencies have
been addressed in the new pre-plat exhibit dated September 30,
2015. Planning Staff believes that the new proposed preliminary
plat for Old West Marketplace represents an improvement to the
previous plat proposed for the property, and presents said
development for the Commission' s consideration. If the
Commission is desirous of forwarding a favorable recommendation �.
on the pre--plat to the City Council, then Staff recommends the
following motion and conditions of approval:
RECOMMENDED MOTION FOR PRELIMINARY PLAT
I move that the Planning and Zoning Commission recommend to the
Apache Junction City Council the (APPROVAL/DENIAL) of a prelim-
inary plat, case SD-2-15, a request by Barclay Group and SEG,
represented by Colby Fincham, for a proposed commercial subdiv-
ision to be named Old West Marketplace, located at the northeast
corner of Old west Highway and S. Idaho Road, subject to the
following conditions of approval:
1) The subdivision shall be designed in compliance with all
standard City development requirements, including but not
limited to zoning, landscaping, parking, on-site and off-

site engineering requirements, design guidelines, overlay
district guidelines, etc.
2) The final subdivision plat shall be designed in substantial
.•. compliance with the approved preliminary plat, including
the overall concept plan, on-site and off-site development
plans, lot layouts, and concept elevations ultimately
accepted by the city Council.
3) Within one year of preliminary subdivision plat approval,
the developers shall submit for formal review, the final
subdivision plat and improvement plans for the proposed
subdivision.
4) Street improvements along Old West Highway, Idaho Road and
Junction Street, including but not limited to, the
extension of pavement and the provision of sidewalks,
curbs, gutters, streetlights, fire hydrants, landscaping,
undergrounding of utilities, etc. , shall be designed and
constructed according to the City of Apache Junction
Engineering Guidelines and/or as otherwise determined by
the City Engineer.
5) The Conditions, Covenants and Restrictions for Old West
Marketplace, to be enforced by an owners association, shall
also include provisions (at a minimum) to address the
following: shared access and driveways, shared parking,
shared drainage and retention areas, master sign concept,
establishing a uniform system for garbage pick-up and mail-
delivery, specifying that the owners association is
responsible for the maintenance and upkeep of the drive and
parking areas, the common areas and the perimeter walls and
landscape improvements both internal and along the outside
perimeter of the subdivision.
6) The developers shall continue to coordinate and work with
the Public Works Department and the utility companies which
serve Apache Junction, to establish and/or relocate proper
utility easements throughout the subdivision, including
underground power lines and adequate easements for dry and
wet utilities, as well as the abandonment and/or relin-
quishment of any unnecessary road, federally patented
easements or other easements .
