as a public record that certain document filed with the city clerk
entitled "2015 Amendments to the Apache Junction City Code,
Volume I, Chapter 8 Business" and declaring an emergency
8. Presentation and discussion on Ordinance No 1421, amending
the Apache Junction City Code, Volume I, Chapter 8- Business,
by repealing Article 8-5. Massage Establishments, Section 8-5-5,
Permitted Locations, Article 8-8 Licensing Requirements for
Special Community and Private Events, Article 8-9. Sales Within
Mobile Home Parks, RV Parks and Mobile Home Subdivisions,
and Article 8-10 Temporary Food and Beverage Vendors, all in
their entirety, except Article 8-8 which shall be amended, and
adopting by reference that certain document entitled "2015
Amendments to the Apache Junction City Code, Volume I,
Chapter 8 Business" The standard sections relating to
conflicting provisions, severability, penalties, and declaring an
emergency are also up for consideration in the ordinance
9. Presentation and discussion on proposed Resolution No. 15-35
and memorandum of shared intent between the City of Apache
Junction and the Town of Queen Creek
10. Discussion on possible boards and commissions recognition
program
11. Review and discussion on potential updates to the city council

It is with deep regret that I announce my resignation from the Board of Directors of the
Superstition Mountains Community Facilities District No 1 effective immediately Due to
personal health reasons, I am no longer able to devote the necessary time to serving the
District.
I have thoroughly enjoyed the opportunity to serve the District as a member of its Board for the

It is with regret that I inform you of Ms. Patricia Richmond's resignation from the Board of
Directors of the Superstition Mountains Community Facilities District No 1 (the "District"). Due
to personal health reasons, Ms Richmond is no longer able to attend meetings and commit the
necessary time and energy to serving the District She has served the District for over
seventeen years and will be greatly missed
I would like to request that the City Council consider filling the vacant position on our Board of
Directors as soon as possible, for the remainder of Ms. Richmond's term which expires on

PUBLIC HEARING STAFF REPORT
DATE: September 15, 2015
REQUEST: City-staff proposed amendments to Planning and
Zoning Administrative Fees.
BACKGROUND
Each year, the City Council adopts a Legislative Work Plan. In
the future, the plan will be known as the "City Operations Work
Plan. " The 2014/2015 Legislative Work Plan, item #25, called
for an update to the City' s current Planning and Zoning fee
schedule. Based on staff recollection, the Planning and Zoning
Fees have not been updated since 1996 (nearly 20 years) . City
staff conducted research on fees elsewhere in the region and
made three presentations to the Planning and Zoning Commission,
(April 28, June 23, and August 25, 2015) .
At the June 23rd P&Z Commission meeting, the Commission directed
staff to refine the proposal to have the fee more directly tied
to city-costs rather than a comparison of what other communities
are charging for fees. The fees are based on estimated staff
time for each application type as well as the number of city-
staff involved in a particular application type along with an
hourly rate for various staff. This information was presented
on August 25, 2015 .
PLANNING STAFF ANALYSIS AND FINDINGS
The Planning and Zoning fees now reflect what the City-staff
believes to be realistic costs based on the actual time involved
in each type of case and also include the staff hours from
various departments that are involved in various application
types. In general, the proposal does not raise fees dramatically.
Fees have either stayed the same, gone up or gone down. In some
cases fees have been eliminated and some new fees are being
proposed.

Notable Changes:
• Landscape plan appeals will now go just to P&Z rather than
an option to go to the Board of Adjustment.
• All continuances are set at $250 for all categories.
• The CUP fee is the same but is $100 more for non-
residential CUPs.
• Variance Fee is now double and an increase by $150 for a
non-residential variance.
• A new fee of $1, 300 is proposed for a General Plan Text
Amendment A new fee of $1, 300 is also being proposed for a
Zoning Text Amendment
• A General Plan Major Map amendment is reduced from $2, 165
to $1, 550 (per acre fee is not changed) .
• There is a new fee for "Administrative Relief" which is a
staff approved minor variance (within specific parameters) .
• Appeals (same fee as a Variance) .
• Fees for Development Agreements were clarified and
increased by $1, 075 but an amendment is reduced by $825.
• Preliminary and Final Plat fees were increased slightly for
a Preliminary Plat but a little more than doubled for a
Final Plat.
•�. • The fee for the Team Pre-application meeting (Preliminary
Development Review - as part of a rezoning) was eliminated
and replaced with a new fee for Commercial / Industrial /
Multi-Family Design Review and will be applied when final
plans are submitted for review.
• A new fee of $25 is being proposed for Administrative Use
Permits (AUPs) for Home Occupations, Temporary Uses, etc.
• A new fee is being proposed for administrative costs
related to Annexations. A two-tier fee structure is being
proposed based on the number of property owners. $875 if
less than 20 owners and $1, 075 if more than 20 property
owners.

• Fees for special sign permits and weekend directional signs
are being eliminated.
• Fees for certain copies are proposed to increase. Fees
were established in 1990 The major change is for large
format copies 24" X 36" at . 19 a linear foot. 11" X 17" inch
copies are also proposed for an increase.
Planning Division Recommendation
The staff is proposing to amend the fees in accordance with the
attached spreadsheet in Exhibit 1. Planning Staff offers the
following Recommended Motion, should the Commission wish to
forward a recommendation of approval to the City Council.
RECOMMENDED MOTION
I move that the Planning and Zoning Commission, having
evaluated Planning & Zoning Fees as requested by the City
Council, recommend the attached fees in Exhibit #1 be forwarded
to the City Council for further consideration as amendments to
Volume 1, Chapter 4 of the City of Apache Junction Code of
Ordinances, Article 4-4 Planning, Zoning Review and Subdivision
Fees, Section 4-4-10.

A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF APACHE
JUNCTION, ESTABLISHING A "MEMORANDUM OF SHARED INTENT
BETWEEN THE TOWN OF QUEEN CREEK AND THE CITY OF APACHE
JUNCTION DATED NOVEMBER 18, 2015"
WHEREAS, on August 25, 2015 the mayors and councils of rak
both the communities of Queen Creek and Apache Junction held
a joint special meeting to discuss issues of concern for both
communities in a public forum; and
WHEREAS, at that forum, a topic of mutual concern was
discussed on how both entities could effectively and
responsibly plan for the future growth and development of
their respective communities, while carrying out the
established general plans of their communities; and
WHEREAS, based upon that discussion both communities
desire to collaborate with one another and to continue to
discuss plans for an eventual shared boundary
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City
Council of the City of Apache Junction, Arizona:
Section 1 : That the document attached hereto as "Exhibit
A" and entitled "Memorandum of Shared Intent between the Town
of Queen Creek and the City of Apache Junction, November 18,
2015" is hereby established.
Section 2 : That three (3) copies of this resolution and
attachment shall remain on file in the city clerk' s office as
prescribed by law.

MEMORANDUM OF SHARED INTENT BETWEEN THE TOWN OF QUEEN CREEK
AND THE CITY OF APACHE JUNCTION, NOVEMBER 18, 2015
On August 25, 2015, the Town Council of Queen Creek and City
Council of Apache Junction held a joint public meeting to
review and discuss issues of mutual concern.
One of the issues discussed was municipal planning and future
growth. For the benefit of current and future residents, it
was agreed that both communities should continue to discuss
and plan towards an eventual shared city and town boundary.
A shared municipal boundary is currently depicted in both
general plans of the Town of Queen Creek and the City of
Apache Junction. Both plans depict this boundary on what are
currently State of Arizona trust lands, known informally as
the "Superstition Vistas" tract.
The State' s approximate location for future extension of the
State Route 24 highway is in the proximity of both
communities' depicted future boundaries . As a result, it is
generally agreed that the final positioning of the State Route
24 could serve as a practical, physical and geographic
boundary for the common municipal boundaries
It is also generally understood that the efforts towards the
long-term development and annexation of Superstition Vistas
can be more effective working collaboratively rather than
working separately. These collaborative efforts may include:
land use and infrastructure planning, economic development,
revenue sharing along future freeway corridors, strategic and ^
intergovernmental communication, and other mutually
beneficial efforts between the two communities and with
external partners . These external partners may include: the
Arizona State Land Department; potential land bidders and
developers; Pinal County; Maricopa County; the State
Legislature; and, other stakeholders .
As staff communicate with each other, it is understood that
there is a common respect for shared goals of planning for
appropriate growth while sustaining communities financially,
culturally, and environmentally for an improved quality of
life for current and future residents .

SUBJECT• City of Apache Junction Board and Commission Member Recognition
At the November 2, 2015 Work Session, city council will have the opportunity to discuss the
development of a recognition program for the volunteer appointees who serve on one or more
of the city's nine board or commissions
One key element in successful recruiting for boards and commissions is finding those with a
desire to serve their community, and who have the desired skillset or a willingness to learn
Showing appreciation, even in the simplest ways, is critical to retaining engaged volunteers
Background:
The City of Apache Junction currently does not have a prescribed or consistent recognition
program for appointees that serve on the various city's boards and commissions Ten plus
years ago, board and commission members were recognized at an annual city picnic In the
years since, recognition has transitioned to certificates of appreciation or to nothing at all The
reason for this has varied and often was dependent on the participation of the board and
commission members in any recognition efforts tried in the past
Staff queried those departments that serve as the board/commission liaison of the more active
boards and commission,those that meet regularly, to inquire if they currently do any type of
recognition for their members, and if so the type and at what point(s) in service

Current practices.
Library Board
The Library Board holds an annual volunteer appreciation event at which they recognize each
board member. Specifically, they announce their name, title and ask them to stand to be
recognized
Planning and Zoning Commission
In recent years, the Planning and Zoning Commission began preparing certificates of
appreciation for each term a commissioner completed More recently, they provided for
plaques to two outgoing commissioners One plaque was simple in nature to recognize a
commissioner who had served six years The second plaque was more ornate and was provided
to a commissioner who had served more than twenty years
Parks & Recreation Commission
In the past the Parks & Recreation Commission recognized those commissioners who served
several terms with a plaque and formal presentation at a council meeting This type of
recognition fell to the wayside after a couple of incidents when commissioners failed to show at
the council meeting for participation in the formal recognition
Recognition options moving forward:
The following are options the mayor and council may wish to consider in the development of a
recognition program, if desired. Council may wish to consider one or a combination of the
options listed below
1) A certificate of appreciation signed by the mayor for each term served
2) A certificate of appreciation or plaque signed by the mayor when a board member or
commissioner vacates their seat.
3) An annual event to recognize the board and commission members This concept could
range from a standalone continental breakfast hosted by city council or could be rolled
up into one of the city's annual employee events such as the employee breakfast or
scrub n' grub luncheon
4) Leave the type of recognition up to the individual boards and commissions

The Policy Team expects the Staff Team to:
• Return telephone calls and contacts from council members(or the Council staff)as soon as
possible that day, but under any circumstances within 24 hours. Final solutions and follow-up
will depend upon the situation—and agreed upon delivery times
• Give emergencies noted by the Council immediate attention.Show the same priority and
responsiveness to the Council staff as they would the council members themselves
• Meet agreed deadlines for deliverables
Section Eight-Staff Team Expectations of Policy Team
The Staff Team expects the Policy Team to:
• Deal with management-level staff on constituent services
• Be clear on their expectations for delivery time and the deliverable
• Work with staff to reach an agreement on what gets done(and when).

RULE 2
CONDUCT OF COUNCILORS AND ENFORCEMENT
A. CITY COUNCILOR ATTENDANCE AT SCHEDULED CITY MEETINGS
1. Councilors will notify both the Mayor and City Manager's Office in writing (email
is appropriate) of their inability to attend any scheduled City Council meeting.
2 Should a Councilor be unable to attend any scheduled City Council meeting by
unforeseen circumstances, that Councilor will notify the Mayor and the City
Manager's Office as soon as possible after the meeting
3 The second failure by a Councilor to notify the Mayor and City Manager's Office
of anticipated or unforeseen absences may result in actions as outlined in
Section K below
B. EQUAL VOICE AND VOTE
All members of the City Council, including those serving as Mayor and Vice Mayor,
have equal votes. All Councilors should be treated with equal respect.
C. GENERAL RULES OF DECORUM
1. Councilors shall fully participate in City Council meetings and other public forums
while demonstrating respect, kindness, consideration, and courtesy to others.
2. At all times, Councilors shall be respectful of other people's time, and shall
attempt to stay focused and act efficiently during public meetings

Councilors that go beyond appropriate criticism of another Councilor's opinion or
position on a matter.
F. PUBLIC COMMUNICATIONS
1. When speaking publically regarding City issues, Councilors will inform their
listeners that"any expressions of opinion can only be attributed to me and
do not necessarily represent the position or opinion of the City Council or
City staff," or words to that effect.
2. When writing an item for publication, such as a fetter to the editor, Councilors will
conclude their written statement with the disclaimer"Any expression of opinion
that may be read into this article can only be attributed to me as the author
and does not necessarily represent the position or opinion of the City
Council or City staff," or words to that effect.
3. Articles assigned to be written by Councilors, such as City Talk, will include the
disclaimer as outlined in Section F, Paragraph 2 above, and will be distributed to
all local media through the City Manager's Office.

1 Councilors shall treat all City staff as professionals
2 Councilors shall refrain from personal public criticism of an individual employee
that goes beyond appropriate criticism or questioning of his/her position on a City
matter Concerns about an employee's performance should be discussed in
private and should be brought to the attention of the City Manager.
3. Councilors should attempt to avoid unnecessary or prolonged disruption of City
staff from their jobs Councilors should not disrupt City staff while they are in
meetings, on the phone, or engrossed in performing their duties, unless there is a
compelling time-sensitive concern that must be addressed immediately.
4. Councilors should refrain from involvement in administrative functions.
Councilors must not attempt to unduly influence City staff on the making of
appointments, awarding of contracts, selecting consultants, processing of
development applications, or granting City licenses and permits However, this
does not preclude City Council members from being involved in such decisions

when they are part of a committee that has been formed for the purpose of
recommending the selection of a professional firm or recommending the hiring of
a key staff member In being part of that committee it is understood that they will
be impartial and make their recommendation based on the merits of the
applicants and will recuse themselves from the process if there is a conflict of

5. Upon receipt of a citizen's complaint, a Councilor may refer the complaint to the
City Manager for review and response Before responding to a citizen complaint,
Councilors should check with the Mayor or City Manager to see if any action has
already been taken on the issue. Copies of any response may be provided to
other Councilors and the City Manager.
H. RESPONSE TO COMMUNICATIONS FROM THE PUBLIC
1. Councilors are strongly encouraged to acknowledge telephone, letter and
electronic communications from the public
2 When responding to such inquiries regarding City issues, Councilors should
indicate a disclaimer such as. "Any expression of opinion that may be read
into this response can only be attributed to me as the author and does not
necessarily represent the position or opinion of the City Council or City
staff," or words to that effect
3 Individual Councilors may respond to correspondence that has been directed to
the entire City Council Councilors should qualify any response they make which
contains their personal opinions as opposed to any official position of the City.
4 Councilors shall always be courteous and professional in any correspondence or
interaction with members of the public
I.REFERRAL OF CITIZEN COMPLAINTS CONCERNING CITY SERVICES
When contacted by a citizen concerning a complaint regarding a City service,
Councilors will notify the City Manager of the complaint and inform the citizen that
his/her concern has been forwarded to the City Manager's Office The City Manager
should inform the referring Councilor of what action may have been taken.
J. IMPROPER INFLUENCE
1 A Councilor may not use City staff or letterhead to support personal or non-City
functions or fundraisers
2 Councilors shall not use their official office as a means of advancing personal
opinions through public statements whereby an inference can be drawn that they
are speaking on behalf of the City Any such public statements shall contain clear
language indicating that such statements are the opinions and comments of the

1 Councilors shall not, except pursuant to such reasonable exceptions as are
provided by regulation, solicit or accept any gift or other item of monetary value

conducting activities regulated by the City of Sedona, and whose interests may
be substantially affected by the performance or nonperformance of the

L. ENFORCEMENT OF THE RULES OF PROCEDURE
1 City Councilors who fail to follow these Rules of Procedure are subject to both
private reprimand and formal censure. It is at the discretion of the Mayor to
initiate action if a Councilor's behavior is called into question by another
Councilor When this occurs, the Mayor will discuss the behavior with the
concerned Councilor whose actions are being questioned and may issue a
private reprimand. If the Mayor is the individual whose actions are being
questioned, the same procedure will be followed after a Councilor expresses a
concern to the Vice Mayor
2 If, after a second private reprimand concerning the same behavior, the conduct
continues, the matter shall be referred to the City Council to consider whether a
public censure is appropriate Any public censure for violation of these Rules of
Procedure can only take place upon a (two-thirds) vote of the entire City Council
