Summary
P-21-98-SD is a proposed preliminary plat of parcels 102-03-3030
and 102-02-0050, approximately 7 . 7 acres currently zoned RM-1/PD
"High Density Multiple-Family Residential by Planned
Development" that has been requested by Galileo Capital
Partners, represented by Greg Loper.
The original rezoning by planned development was approved by the
council on February 2, 2021, through Ordinance No. 1501 . This
preliminary plat is specifically the preliminary consideration
of the proposed subdivision. The properties will actually be
subdivided and finalized through a future, final plat submittal .
P&Z Commission Hearing and Recommendation
The Planning and Zoning Commission held a public hearing for
P-21-98-SD on September 27, 2022, at which time they voted 6-0
to recommend approval of P-21-98-SD. Please see the attached
staff report and exhibits presented to the Planning and Zoning
Commission.
During the meeting the Planning and Zoning Commission discussed
the maintenance responsibilities, homeowners associations,
parking provisions, the location of amenities, affordability,
water drainage, and the development' s impact on the local
neighborhood.

net acres (102-03-3030 and 102-02-0050)
into a 106-unit townhome subdivision
BACKGROUND
Conceptual plans for the townhome community known as "Old West
Highway Village" were initially presented and proposed for
development in 2020 as Case PZ-1-20 . These plans were approved
and adopted February 2, 2021, through Ordinance No. 1501, which
authorized the planned development rezoning of Parcels 102-03-
3030 and 102-02-0050 from B-4 "Business Park & Light Industrial"
to RM-1/PD "High Density Multiple-Family Residential by Planned
Development" to allow the development of approximately one
hundred seven (107) townhome units, which has most recently been
reduced to one hundred six (106) units to accommodate additional
amenity, parking, and retention spaces .
Per condition of approval thirteen (13) in Ordinance No. 1501,
all of the units on the west and south edges of the property
have been noted on the plat to be limited to (2) two-stories in
order to accommodate neighborhood privacy concerns expressed at
the public hearings for case PZ-1-20 .

PROPOSALS
P-21-98-SD is a proposed preliminary plat to subdivide 7 . 7 net
acres (Parcels 102-03-3030, and 102-02-0050) into a 106-unit
townhome subdivision, with typical lot sizes of approximately
1, 130 square feet (20' x 56 . 5' lots) , and with the homes sizes
consisting of two-story and three-story homes .
STAFF ANALYSIS
Staff has found that the preliminary plat reflects substantial
compliance and consistency with the Planned Development and the
conditions of approval presented with case PZ-1-20 and
incorporated by Ordinance No. 1501, including general layout,
lot sizes, setbacks, public and private rights-of-ways,
easements and tracts, amenities, perimeter lot separation walls,
architecture, landscaping and other improvements as were
required.
The applicant has worked with Staff in order to meet the
requirements regarding the provision of amenities and pedestrian
connectivity to Old West Highway' s upcoming sidewalks .
Other conditions of approval consist of architectural
requirements that the applicant will be required to show
conformance to when they submit the final plat and improvement
plans, per condition eleven (11) of Ordinance 1501 .
PLANNING DIVISION RECOMMENDATION
Staff is supportive of the proposed preliminary plat and
respectfully recommends to the Commission that they include the
following conditions of approval as part of a favorable
recommendation to the City Council . As always, Commissioners
may recommend changes or additional conditions which they feel
will improve the development plan.
RECOMMENDED MOTION FOR PRELIMINARY PLAT
I move that the Planning and Zoning Commission recommend to the
Apache Junction City Council the approval of Preliminary Plat,
case P-21-98-SD requested by Galileo Capital Partners,
represented by Greg Loper (applicant) , for a one hundred six
(106) lot residential subdivision tentatively to be named Old
West Highway Village, located south of Old West Highway, between
South Royal Palm Road and South Tomahawk Road, subject to the
following conditions of approval :

1) The project shall be developed in accordance with and in
compliance to the plans attached and associated to this
case and the planned development rezoning case PZ-1-20 and
all the provisions of the Zoning Ordinance applicable to
this case .
2) All conditions of approval of Ordinance No. 1501 as
approved pursuant to the planned development major rezoning
case PZ-1-20 and the zoning standards of this RM-1/PD-zoned
property shall govern the design and subsequent
improvements of the Final Subdivision Plat.
3) Within one year of Preliminary Subdivision Plat approval,
the developer shall submit for formal review, the Final
Subdivision Plat and improvement plans for the proposed
subdivision. Said final plat and improvement plans shall
reflect substantial compliance with the preliminary plat
insofar as general layout, number of lots, location of
natural and man-made amenity features and areas, and
internal and external streets and connectivity.
4) The homeowners association through the Conditions,
Covenants and Restrictions (CC&Rs) for Old West Highway
Village shall also include provisions to address and
specify that the homeowners association is perpetually
responsible for the maintenance and upkeep of all common
areas and facilities, drainage and retention areas, fencing
and landscape improvements both internal and along the
outside perimeter of the subdivision. Should the homeowners
association ever dissolve or become defunct, the
maintenance of such areas shall be the responsibility of
the abutting lot, tract, or parcel owner.
5) The developer shall work with and coordinate separately
with all known utility companies which serve Apache
Junction, to provide necessary services to the site and to
relinquish and/or relocate any utility easements as needed,
prior to or upon final plat approval .
6) The developer' s engineer shall meet the civil engineering
improvement plans and document requirements in accordance
of the city' s approved engineering standards that are in
effect at the time of plan submittal .

Introduction:
This application is being submitted for the approval of a Preliminary Plat for "Old West
Highway Village," a 106-lot single-family attached residential development on
approximately 11.816 gross acres / 7.708 net acres located on the south-side of Old West
Highway, east of Royal Palm Road and west of Tomahawk Road.
Project Description:
Old West Highway Village is proposed to be developed on two (2) parcels totaling
approximately 11.816 gross acres / 7.708 net acres located along the south-side of Old
West Highway (formerly known as US 60), east of Royal Palm Road and west of
Tomahawk Road.
The associated Pinal County Assessor Parcel Numbers ("APN's") are 102-02-0050 and
102-03-3030.
The proposed development is a 106-lot, single-family attached (zero-lot line) residential
townhome-type development, along with associated open space and amenities. The
proposed density is approximately 9.0 dwelling units per net acre (13.88 d.u./gross acre).
The proposed Preliminary Plat reflects the RM-1/PD (High Density Multiple-Family
Detached Residential by Planned Development) zoning, and the Minor General Plan
Amendment designation of High Density Residential, as approved for the Property by the
Apache Junction City Council on February 2, 2021 , under application case #PZ-1-20 and
Ordinance #1501 .

AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, AMENDING THE APACHE
JUNCTION, ARIZONA, ZONING ORDINANCE, BY AMENDING THE
ZONING DISTRICT MAP, CITY OF APACHE JUNCTION, ARIZONA,
CHANGING THE ZONING DISTRICT CLASSIFICATION FOR THE
PROPERTY DESCRIBED IN THE PLANNED DEVELOPMENT REZONING
CASE PZ-1-20, A REQUEST BY APACHE JUNCTION 772, LLC,
REPRESENTED BY GREG LOPER, FROM BUSINESS PARK ("B-1")
TO HIGH DENSITY MULTIPLE-FAMILY RESIDENTIAL BY PLANNED
DEVELOPMENT ("RM-1/PD") AND APPROVING A MINOR GENERAL
PLAN AMENDMENT CHANGING THE LAND USE DESIGNATION FROM
LIGHT INDUSTRIAL/BUSINESS PARK AND INDUSTRIAL TO HIGH
DENSITY RESIDENTIAL; REPEALING ANY CONFLICTING
PROVISIONS; AND PROVIDING FOR SEVERABILITY.
WHEREAS, the submitted planned development ("PD") plan
proposes a future 107-lot residential subdivision, located on
the south-side of Old West Highway, east of Royal Palm Road and
west of Tomahawk Road, tentatively called "Old West Highway
Village, " on an approximately 7 . 93-acre subject property ("the
Property") ; and
WHEREAS, the Property is designated "Light
Industrial/Business Park and Industrial" by the city' s general
plan and the requested rezoning and planned development do not
comply with the Light Industrial or Business Park designation
and require a minor general plan amendment; and
WHEREAS, on January 12, 2021, the Apache Junction planning
and zoning commission voted 4-3 to recommend denial of rezoning
case PZ-1-20; and
WHEREAS, the city council hereby determines that the
proposed PD rezoning request conforms to all of the general
criteria as specified in Apache Junction City Code, Volume II,
Land Development Code, Chapter 1 : Zoning Ordinance,_Article 1-5 :
Zoning Bulk and Use Regulations, Section 1-5-1, Residential Use
Regulations and Article 1-4 : Zoning Districts, Section 1-4-3,
Planned Development ("PD") Overlay District (except as otherwise
conditioned herein) , including integration with the surrounding
neighborhood, adequate traffic accommodation, adequate public
facilities, extension of infrastructure, and that the design and
uses should result in enhancements to the social, built and
natural environments in the city.

NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF APACHE JUNCTION, ARIZONA, AS FOLLOWS :
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map,
City of Apache Junction, Arizona, for the property legally
described as :
All that part of the East half of the Northwest quarter of
the Northeast quarter AND all that part of the Northeast
quarter of the Northeast quarter of Section 28, Township 1
North, Range 8 East of the Gila River Base and Meridian,
Pinal County Arizona, lying South of the U. S . Highway 60,
70, 80 and 89;
Also known as parcels 102-03-3030, and 102-02-0050, located
in the Northeast quarter Section 28, Township 1 North,
Range 8 East, of the Gila and Salt River Base and Meridian,
Apache Junction, Pinal County, Arizona;
be and hereby is amended from Business Park ("B-4") to High
Density Multiple-Family Residential by Planned Development ("RM-
1/PD") ; and the general plan land use designation of the same
properties be and hereby is amended from Light
Industrial/Business Park and Industrial to High Density
Residential subject to the following conditions of approval :
1) The property shall be developed in accordance with the
plans and elevations attached and associated to this case
and all the provisions of the zoning ordinance applicable
to this case .
2) The preliminary and final plats shall reflect substantial
compliance and consistency with the PD concepts presented
with case PZ-1-20, incorporated by reference herein, and as
otherwise specified through these conditions of approval,
to include general layout, lot sizes, setbacks, public and
private rights-of-ways, easements and tracts, amenities,
perimeter lot separation walls, model types, landscaping
and other improvements .
3) The proposed development shall not be age restricted.

4) Parcels 102-03-3030 and 102-02-0050 shall be combined into
one parcel, either through the platting process or a lot
combination, prior to final plat.
5) Street improvements include but are not necessarily limited
to, extension of pavement and the provision of sidewalk,
curb, gutter, streetlights, underground utilities, fire
hydrants, and landscaping shall be required as part of this
PD project, and are subject to review and approval by the
city engineer or his designee . Pedestrian connections to
Old West Highway must be included as conceptually designed
in the application documents .
6) Landscaping, screening and irrigation improvements shall be
planted within a minimum 10-feet deep strip inside the net
property line along the Old West Highway side of the
property, and shall be provided in compliance with the
city' s landscape and screening requirements contained in
Apache Junction City Code, Volume II, Land Development
Code, Chapter 1, Zoning Ordinance, Article 1-8, Landscape
Regulations . All required trees shall be 24" box, and all
required shrubs shall be 5-gallon in size. A 6-foot-tall
fence shall be constructed on the west and south boundaries
of the property, with landscaping.
7) Mailboxes must be architecturally integrated within the
site and compliment the building elevations .
8) Light poles shall not exceed 15-feet in height and all
applicable city lighting ordinance standards shall be
maintained.
9) Twenty-five percent (250) of the internal open space shall
be usable open space and recreational amenities shall be
provided in compliance with the city' s parks and recreation
standards for homeowners' association maintained areas .
10) Substantial amenities such as a community pool, tot lots,
trails, ramadas, and like features must be included in the
development and will be reviewed during the platting
process .

11) As the time of final plat and improvement plans submittal,
the developer shall also present colored elevations for the
proposed development. Elevations shall incorporate at
least three (3) material types and four-sided architecture.
12) Architecturally distinct doors and recessed windows will be
required to provide high quality elevations .
13) All of the units on the west and south edges of the
property (shown on the site plan as units 1-4, 35-38, 55-
58, 74-77, and 85-107) shall be limited to the two-story
version of the proposed building elevations .
14) All applicable permits shall be applied for and plans shall
be designed to current city codes prior to any lot grading
or construction on the lots . Inclusively, all applicable
development fees shall be paid at the time of permits
issuance .
15) All common areas, amenity areas and tracts within and
immediately adjacent to the proposed development, including
perimeter walls and fences, and interior and exterior
common area landscaping, shall be owned and maintained in
good condition at all times by the owners or homeowners
association of the proposed subdivision.
16) The developer' s engineer shall meet the civil engineering
improvement plans and document requirements, as outlined in
the previously provided pre-application and review comments
and in accordance with the city' s approved engineering
standards that are in effect at the time of plan submittal .
17) Signing/striping plans for Old West Highway will be
required at the time of final plat submittal and should
show existing signs, new locations of relocated existing
signs or new signs, existing striping or modifications to
the same, and new striping.
18) Fire safety measures are required for all townhomes and
sprinkler systems or fire walls must be implemented to meet
fire code standards set forth in adopted city codes . Dead-
end streets may require additional fire hydrants .

19) Any major deviation or proposed changes from the original
plans associated with this project will require a major PD
amendment.
SECTION II REPEALING ANY CONFLICTING PROVISIONS :
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY:
If any section, subsection, sentence, phrase, clause or portion
of this ordinance, or any part of the code adopted herein by
reference, is for any reason held to be invalid or
unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions thereof.

I think the main duties of the board is to hear the citizen/companies requests and/or problem and help
them resolve their problems in the best way for both the city and the safety of the citizen or citizens. Make
sure the city is following fair and proper guidelines an the citizen is also no making false claims. I think
Honesty and integrity is the utmost importance to serve on this as well as any board. Any self interest
must be left at the door, and I can promise I will and can do this. I completed the Citizens Leadership
course a little over a year ago and have been excited to serve My City, I did get appointed to the
Construction Code of Appeals Board but we all know how active that has been, I see this as a real chance
to serve my City.

I have a true passion to serve my city and I believe with my construction back ground I would make a
good fit on this board. I was a Residential Superintendent for 5 years and know allot of the building codes.
I have overseen the construction of over a 100 homes from tract homes to customs. I know Electrical,
plumbing, basic carpentry, grading and drainage, was certified by Maricopa County for Dust
control(expired now). I understand and know how to read blue prints, plots and plats.

I want to help serve my city and I think with my back ground and understand of construction this would be
a good fit and I am genuinely interested in helping the city move forward in its development.

The key responsibilities of the commission to the city council is to make planned out and educated
recommendations to inform the council on zoning issues and changes. The responsibilities of the
commission to the residents of AJ is to make sure that all decisions on zoning and planning best reflect
the wishes and interests of the residents. The responsibilities of the commission members to the other
commission members is to work together and communicate with one another in making sure that the best
decisions and recommendation are being made.

As a construction business owner, zoning laws are something that I deal with quite often. Having grown
up here in town, I am 100%committed to making decisions that are in the best interest for the residents of
AJ and of preserving our rich history. Having recently ran for city council and received over 2,700 votes, I
have the backing and confidence of many of my fellow AJ residents.

I believe the board and commission members vote on recommendations sent to the City Council in
regards to what gets the go ahead and what takes a back seat for the community (due to budget,
popularity, resources, and locations). Perhaps some volunteering plus an awareness and a sense of
pride. As members I believe the goal is to make a better and brighter tomorrow for everyone here and
passing through, as well as future residents.

I enjoyed my 10 years working for the City of Apache Junction's Parks and Recreation Department
(AJPR) very much and would love to be a part of growing, helping, and bettering the community in any
way possible.
Please state why you would like to be appointed to this board/commission:
I feel that I have a vested interest in Apache Junction because although I wasn't born in Arizona, I have
been in this city since kindergarten. I worked at Kmart, Dolly Steamboat, Blockbuster, Central Arizona
College, and for the City of Apache Junction for Parks and Recreation Department. I love being a part of
something bigger than myself, but knowing I had a hand in it. Health and family leisure activities are
important for people physically, mentally, spiritually, as well as emotionally. Whether it's playing, creating,
learning, socializing or just getting the body moving AJPR is the best place to do it (Prospector Park,
Multi-Generational Center, Flatiron Park, Superstition Shadows Aquatic Center, Rodeo Grounds-We've
got you covered!).

I have a wealth of responsible public service experience. I have a long history of working cooperatively
with people from diverse socio-economic and educational backgrounds. The department I managed was
among the elite in Illinois. I was named as one of the top 10 public works directors in North America by the
27,000 member American Public Works Association. My department and I were recognized by APWA,
AWWA and other agencies with various local, regional and national awards.

I saw an article in the local AJ newspaper today (5/31/16) advising readers of the need for three board
members for this particular commission. I would imagine it's not a"gig"that elicits much interest by most,
regardless of its importance. If the Board believes I possess the basic credentials and can bring some

The key responsibility of members is to represent the interests of all citizens of Apache Junction. The
2020-2050 Master Plan, developed after our citizens' input, provides a guidebook. Commission/Board
members deserve someone who attends all meetings, does their homework, reaches reasonable
conclusions, communicates effectively (speaking and listening), and understands the need to reach and
support a consensus even though they may not get all they wanted.
Please state the reason(s)why you feel you are qualified to serve on this board/commission:
My years of volunteer experience and employment in our community gives me an idea of what Apache
Junction is all about-and its complicated. There is a broad variety of interests. My education taught me
how to do research and draw logical conclusions. As a craftsman I learned attention to detail. As a
manager I learned leadership and communication skills. As a sailor I learned teamwork. Those are skills
necessary for service on Boards and Commissions. My communication with city staff has been amiable
and my presence on boards and commissions has been valued.
Please state why you would like to be appointed to this board/commission:
There is some history of community service in my family, which is why I first applied for any open position
7 years ago. A great uncle was Mayor of West Bend, Wis., 1920-1926. Another uncle served on the Town
Board of Wayne, Wis., all his adult life. As our community moves forward, I believe I have what it takes to
contribute to good decisions as Apache Junction undergoes significant changes.

I have limited knowledge of the District. I have been on committees involved with economic development
in AJ. I am a retired CPA and partner of PricewaterhouseCoopers. My skill base is finance, turning around
troubled companies, strategic planning and economic development. Also, I am currently the Secretary of
this Board and I would like to continue working with this organization.

I believe that the growth of AJ will need to come from alliances and partnerships with the surrounding
unincorporated areas as well as the eventual development of land from the AZ State Land Trust and BLM
land. As a Gold Canyon resident I cannot get elected to the City Council. Therefore I want to work with the
ancillary services that will help to achieve that growth.

The primary duty of the Board is to hear and decide appeals made by individuals regarding construction
codes and decisions made by the Building and Safety Manager. To provide for reasonable interpretations
of the provisions of the Technical Codes to determine the suitability of alternate materials and methods of
construction, and to recommend changes of the various building and fire codes to the Building and Safety
Manager.

This Commission conducts public hearings to determine the needs of City residents with regard to public
health, provision of human services and care of the elderly, handicapped and developmentally disabled.
They enhance the development of public health through public forums, seminars and work with other
agencies.The Commission reviews requests submitted by health and human services providers for the
City funding and makes recommendations to the Council regarding such funding. The group assists in the

This commission promotes and encourages diverse citizen participation in public art. They assist corporations,
commercial developments, and other private and governmental entities to incorporate public art and recommend the
operating and capital improvement program budgets for the public art program. They make recommendations
regarding the operating and capital improvement program budgets for the public art program. The commission also
conducts the request for qualifications process for all public art installations and reviews gifts of art offered to the city
for artistic and cultural purposes. They provide information, recommendations and advise city council and staff on

recommending body on public art projects relating to art in public places and as the recommending body on public art
projects relating to art in private development.
The Public Arts Commission shall consist of seven (7) members, at a minimum,the commission shall have four

Membership shall be comprised as follows:
• 2 members: practicing artists (either resident or not)from the visual, public, and performing arts discipline);
• 2 members: a person (either resident or not) with an interest in visual, performing arts, architecture or urban
design;
• 1 member: practicing professional (either resident or not) from the field of design, or architecture, (should
an eligible applicant not apply, an additional practicing artist shall fill this seat);

I believe the key responsibility of a board &commission member to the city council and/or district are to
advise and make recommendations accordingly. The key responsibility of a board &commission member
to the citizens of Apache Junction is to gain public trust in acting fairly and honestly in making decision's
effecting the community and being available to the community. The key responsibility of a board &
commission member to other board commission or committee members are being an objective listener to
new and ongoing program initiatives as well serving as a liason between other boards.
Please state the reason(s) why you feel you are qualified to serve on this board/commission:
I feel I am qualified to serve on city council because of my relationships with the community, local
businesses and local nonprofit organizations. I am honest, transparent, have an open mind, and respect
others opinions.
Please state why you would like to be appointed to this board/commission:
I would like to be appointed to one of the above three boards in order to further serve my community, to
be involved in influencing policy changes, having a voice in decision making and broaden my horizons of
resources and services. As an appointed board member I will be able to assist in advocating solutions for
local problems and protect the interest of local citizens.

Public Arts Commission -To help the city select public arts projects which emphasize some aspect of
Apache Junction history while maintaining a pleasing aesthetic look.

Public Arts Commission - I believe a strong public arts program can reflect a community's history, culture,
and values, and should be managed to balance the needs of the community as well as meeting the
values of the citizens. I have been on the Commission for almost 2 years.
Please state why you would like to be appointed to this board/commission:
Public Arts Commission -As one who is interested in the history of Apache Junction and the Superstitions
Area and an artist, I am interested in building and maintaining a strong public arts program. I feel public
art should represent the soul of the community. I have been on the Commission for almost 2 years, and
would like to continue helping to develop a strong public arts program in AJ.
