The number in parentheses below the name of the city indicates the present population. Each city or town was asked if their city code listed their individual departments, named the department head by title, listed the divisions and division head by title, any other subordinate positions, and if the functions of each were included. At appears that the majority of those contacted included the departments, department heads and their functions. The listing of the divisions varied, and very few included other subordinate positions. A few of the charter cities indicated that department positions were included in their charter in addition to the city code. Also attached for your review is a copy of my memorandum to the council dated November 18, 1985, as well as a copy of Chapter 3 of the City Code. This information is as follows: COTTONWOOD: Chapter 3 ADMINISTRATION of their code lists the officers of the town (manager, clerk, marshal , engineer, attorney and magistrate) including brief descriptions of their duties. Additional chapters deal with creation and duties of the police department and court proceedings and organization. ( PAYSON: Chapter 3 ADMINISTRATION lists officers of town (marshal , clerk, _ magistrate, attorney, engineer) including lengthy and detailed descriptions of clerk 's duties and brief descriptions of duties of other officers. Additional chapters deal with creation, duties and composition of police department, and powers and duties of town magistrate. PRESCOTT: Charter lists city manager, city clerk, attorney and magistrate; City Code sets departments, department heads, divisions and outlines duties of each. CHANDLER: Charter lists manager, clerk, attorney and magistrate. City Code lists department heads and outlines divisions and duties. City Manager is responsible for setting duties of divisions. FLORENCE: Code only lists manager. No other departments or duties are listed in code. GILBERT: Code lists all departments, department heads and duties. Code also lists division heads and what department they fall under. No reference in code to divisions or duties. This is done by each department. GLENDALE: Charter and city code list manager, clerk, attorney and judge. Department heads are listed in charter. There is no outline of duties or divisions. MESA: Separate chapters in city code devoted to each department. Some (manager, clerk, attorney, acting city manager) are also listed in charter. There are separate chapters in their code for city manager, magistrate, clerk, treasurer, attorney, acting city manager, police department, fire, public works, general services, community services, management services, airport, utility, and community development. Each of these individual chapters outlines the organization of the department, appointment of the department head, and duties. PHOENIX. Charter outlines some officers of the city (manager, clerk, treasurer, attorney, engineer, police chief) . City code outlines entire administrative branch of the city which includes offices of administrative services, community services, community development, street transportation and general services; and departments of parks, recreation and library, human resources, building safety, aviation, planning, traffic engineering, police, water and waste water management, engineering, public works, fire, management and budget, man- agement information systems, finance, city auditor, law, personnel , city clerk and urban development. Sections of the code outline duties and responsibilities of the city manager and department heads, both in general and on an individual basis. Separate sections outline the organization of each department and lists their respective divisions. There is no listing of division responsibilities. Councilman Jimenez briefed the Council and public on the amendment to the City Code, explaining that this requires that all department head positions and some division heads be appointed by the City Manager subject to ratification by Council. Mr. Gil Verley, 620 S. Palo Verde, Apache Junction, addressed the Council in opposition to the amendment. Mr. McNulty further explained that this amendment only adds department and division heads to the ratification requirement that is in the City Code at present, and does not interfere with the City Manager form of government Councilman Eidson MOVED THAT -7 ORDINANCE NO. 428, BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE � ORDINANCE BE WAIVED. Manager. Whenever the word "manager" is used, it shall be construed to mean the city manager of the City of Apache Junction, Arizona. B. Ratification. Whenever "ratification" by the council is required under this chapter, it shall be effected only by a majority vote of the seven member city council , as then constituted, convened in a regular or special council meeting. Sec. 3-1-2 Office of City Manager Created The office of the city manager of the City of Apache Junction is hereby created and established. The manager shall be appointed by the council wholly on the basis of his administrative and executive ability and qualifications and shall hold office for and at the pleasure of the council . Sec. 3-1-3 Residence Residence in the city at the time of appointment of a manager shall not be required as a condition of the appointment, but within 120 days after reporting for :cork the manager must oecome a resident of the city unless the council approves his residence outside the city. L -Zq.2- Rev. 6/80 3-1-4 ADMINISTRATION 3-1-8 Sec. 3-1-4 Eligibility No member of the council shall be eligible for appointment as manager until one year has elapsed after such council member shall have ceased to be a member of the council . Sec. 3-1-5 Bond The manager shall furnish a corporate surety bond to be approved by the —7) council in such sum as may be determined by the said council , and shall be conditioned upon the faithful performance of the duties imposed upon the manager as herein described. Any premium for such bond shall be a proper charge against the city. Sec. 3-1-6 Acting City Manager In the event of the absence or disability of the manager, his powers and duties shall devolve upon the following officers of the city and they are so appointed in the following order as each succeeding officer may be absent or disabled: 1. Director of Public Safety 2. Director of Public Works 3. Director of Administrative Services. Sec. 3-1-7 Compensation A. The manager shall receive such compensation as the council shall from time to time determine. In addition, the manager shall be reimbursed for all actual and necessary expenses incurred by him in the performance of his official duties. 2) B. Upon termination of the manager by reason of involuntary removal from service for other than willful misconduct in office, the manager shall receive payment for all accrued regular working hours, all accrued vacation hours and the equivalent of thirty days severance pay at the regular pay rate. Sec. 3-1-8 Powers and Duties The manager shall be the administrative head of the government of the city under the direction and control of the council . He shall be responsible for the administration of all affairs of the city which are under his control . In addition to his general powers as administrative head, it shall be his duty and he shall have the powers set forth in the following subsections: -24.3- Rev. 6/84 3-1-8 ADMINISTRATION 3-1-8 A. Law Enforcement. It shall be the duty of the manager to see that all laws and ordinances of the city, and that all franchises, con- tracts, permits and privileges granted by the council are faithfully observed and to report any failure in that regard to the council , which shall give such instruction and direction as it may desire for remedial , corrective or terminating action by the manager. B. Authority Over Employees. It shall be the duty of the manager, and he shall have the sole authority to control , order and give directions to all heads of departments and to subordinate officers and employees of the city under his jurisdiction through their department heads. C. Power of Appointment and Removal . Subject to the exceptions expressly provided by this cnapter, it shall be the duty of the manager to, and he shall appoint, remove, promote and demote any and all officers and employees of the city, except magistrate, city attorney and members of the boards and commissions and committees, all of whom shall be appointed by the council . As to these officials he shall recommend appointment and removal . All this shall be subject to all applicable personnel ordinances, rules and regulations and statutes of the State of Arizona. D. Ordinances. It shall be the duty of the manager to recommend to the council for adoption, such measures and ordinances as he deems necessary. E. Attendance at Council Meetings. It shall be the duty of the manager to attend all meetings of the council unless he is excused therefrom by the mayor individually or by the council , except when his removal is under consideration. He shall present definite recommendations relative to each item on the agenda for approval , rejection or modification by the council . F. Financial Reports. It shall be the duty of the manager to keep2) the council fully advised as to the needs of the city in such form and at such times as requested by the council . G. Budget. It shall be the duty of the manager to prepare and submit the proposed annual budget and the proposed annual salary plan to the council for its approval . H. Expenditure Control and Purchasinc. It shall be the duty of the manager to see that no indebtedness is incurred or expenditure made in violation, of the Arizona Constitution, the State budget law and Arizona Revised Statutes Section 42-303(d) in particular. -24 4- Rev. 6/30 3-1-9 ADMINISTRATION 3-1-10 ) I. Investigations and Complaints. It shall be the duty of the manager to make invest -- - of the city and department or division th- of any obligati . _ _. _ _ . w _ . , council . Further, it shall be the duty of the manager to investigate all complaints in relation to matters concerning the administration of the city government and in regard to the service maintained by public utilities in said city and report all findings to the council. Sec. 3-1-9 Internal Relations A. Council-Manager Relations. The council and its members shall deal with the administrative services of the city only through the manager, except for the purpose of inquiry, and neither the council nor any member thereof, shall give orders or instructions to any employee or officer other than the manager. The manager shall take his orders and instructions from the council only when promulgated at a duly convened meeting of the council , and no individual councilman shall give any orders or instructions to the manager except for purpose of inquiry. B. Attendance at Commission Meetings. The manager may attend any and all meetings of all commissions, boards or committees created by the council , upon his own volition or upon direction of the council . At such meetings which the manager attends, he shall be heard by such commissions, boards or committees as to all matters upon which he wishes to address the members thereof, and he shall inform said members as to the status of any matter being considered by the council , and he shall cooperate to the fullest extent with the members of all commissions, boards or committees appointed by the council . Sec. 3-1-10 Removal Procedure A. Removal of City Manager. The removal of the manager shall oe effected only by a majority vote of the seven member council , convened in a regular council meeting or special council meeting called for that purpose, subject, however, to the provisions of the next succeeding subsections. In case of his intended removal by the council , the manager shall be furnished with a written notice stating the council ' s intention to remove him at least thirty days before the effective date of his removal . If the manager so requests, the council shall provide in writing detailed reasons for the intended removal , which shall be provided the manager within seven days after the receipt of such reouest from the manager, and at least fifteen days prior to the effective date of such removal . -24 S- D. 7/Rn 3-1-11 ADMINISTRATION 3-1-11 ( 1 B. Hearing. Within seven days after the delivery to the manager of such notice of intention to remove, he may, by written notification to the city clerk, request a hearing before the council. Thereafter, the council shall fix a time for the hearing which shall be held at its usual place, but before the expiration of the thirty day period, at which the manager shall appear and be heard, with or without counsel. C. Suspension Pending Hearing. After furnishing the manager with written notice of intended removal , the council may suspend him from duty, but his compensation shall continue until his removal by action of the council passed subsequent to the aforesaid hearing. D. Discretion of Council. In removing the manager, the council shall act as its discretion and its action shall be final and shall not depend upon any particular showing or degree of proof at the hearing. E. Limitation on Removal . Notwithstanding the provisions of Section 3- 1-10 hereinabove set forth, the manager shall not be removed from office, other than for misconduct in office, during or within a period of ninety (90) days next succeeding any general municipal election held in the city at which election a member of the council is elected or when a new councilman is appointed; the purpose of this provision is to require any newly elected or appointed member of the council or a reorganized council to observe the actions and ability of the manager in the actual performance of the powers and duties of his office. F. Resignation of Manager. The manager shall provide the council with thirty (30) days written notice of intention to resign his position. The manager shall assist the council in the recruitment and selection of a replacement if requested by the council . In the event of resignation due to health reasons, the period of written notice shall be determined in conference between the manager and the council. Sec. 3-1-11 Agreements on Employment Nothing in this article shall be construed as a limitation on the power or authority of the council to enter into any supplemental agreement with the manager delineating additional terms and conditions of employment not inconsistent with any provisions of this article or of State Statutes. -24.6- Rev. 6/84 3-2 ADMINISTRATION 3-2-3 r1f'V�ti.l c' J—L Jl 4L J .. i :.j Lit' \ 3-2-1 Office Establisned 3-2-2 Bond 3-2-3 Duties 3-2-4 Vacancies 3-2-5 Subordinate Positions Within Office of City Clerk Section 3-2-1 Office Established The office of tne city clerk of the City of Apache Junction is hereby created and established. the city clerk shall be appointed and removed by the city manager subject to ratification of the council . It shall be the duty of the city clerk to attend all meetings of the council unless at his request he is excused therefrom by the mayor individually or by the council , and shall be responsible for recording the minutes and presenting tnem to the council for approval . Ratification of the appointment or removal of the city clerk by tne council shall be construed as compliance with the provisions of A.R.S. Section 9-271. Sec. 3-2-2 Bond Before entering upon his duties of office, the city clerk shall execute a bond in such amount as is provided by statute, conditioned upon the faithful performance of his duties. Sec. 3-2-3 Duties A. Signatures. The city clerk shall seal and attest all contracts of the city and all licenses , permits and such other documents as shall require the formality. B. Money Collected. The clerk shall turn over all money received by him on benalf of the city to the city finance officer promptly upon receipt of the same; and with such money he shall give a statement as to the source thereof. C. Accounts. The clergy shall keep accounts showing all money received by him and the source and disposition thereof; and such other accounts as may be required by statute or ordinance. -2 .7- Rev. 7/80 � I 3-2-4 ADMINISTRATION 3-2-5 It shall be the duty of the clerk to keep the city council fully advised as to the financial condition of the city in such form and such things as requested by the city council . D. Records. In addition to the record of ordinances and other records which the clerk is required by statute to keep, he shall keep a register of all licenses and permits issued and the payments thereon; a record showing all of the officers and regular employees of the city; a record of all physical properties of the city and the department or office to which the respective properties are assigned; and such other records as may be required by the council . E. Seal . The clerk shall be the custodian of the city seal and shall affix its impression on documents whenever this is required. F. Documents. The clerk shall be the custodian of all documents belonging to the city which are not assigned to the custody of some other officer. G. Indices. The clerk shall keep and maintain a proper index to all documents and records kept by him, so that ready access thereto and use thereof may be had. H. Ex Officio Collector. The clerk shall act as and perform all the duties of collector unless and until a separate collector is appointed. I. Additional Duties. In addition to the duties herein provided the clerk shall perform such other duties and functions as may be required by statute or ordinance. Sec. 3-2-4 Vacancies In case the office of city clerk shall become vacant for any �^ reason, the city manager shall appoint a successor subject to ratification of the council . Sec. 3-2-5 Subordinate Positions Within Office of City Clerk A. There are hereby created within the office of the city clerk the positions of finance officer, bookkeeper and deputy tax collector, and the employees holding said positions shall be subject to the supervision and control of the city clerk. B. The finance officer and the deputy tax collector shall be appointed and romoved by the city clerk subject to the provisions of Article 3-10 of this code. The finance officer, bookkeeper and deputy tax collector shall have such duties and responsibilitios as are set forth in the job description approved by the city council in accordance with Article 3-10 of -90 P- On., 7 mr, 3-3 ADMINISTRATIOt 3-4 this code. The bookkeeper shall be appointed and removed upon the recommendation of the finance officer subject to the ratification of the city clerk and the provisions of Article 3-10 of this code. C. In addition, it snall be the duty of the deputy tax collector to collect and receive all money due on special assessments and special taxes that are not paid directly to the treasurer, and to keep such records pertaining to such collections as may be required by statute or ordinance. D. The deputy tax collector shall make such reports reaardina delinquent special assessments as are required by statute, and shall make a monthly report to the council , showing what money has been received ana the source thereof. E. The deputy tax collectors shall also make an annual report, during the last month of the fiscal year, showing all the activities of his office. Article 3-3 OFFICE OF DEPUTY CITY CLERK A. The city manager shall appoint a deputy city clerk who shall have the power and duty to execute all documents required by any law or ordinance to be executed by the clerk, and affix the seal of the city thereto whenever required. B. When signing any documents the deputy city clerk shall sign the name of the city clerk followed by the word "By" and the deouty clerk's own name and the words "deputy clerk". C. The powers and duties herein described shall be exercised by such deputy clerk only in the absence of the city clerk from his office in the city hall , and only when either written direction has been given by the city clerk to exercise such power, or the manager has determined by resolution that the city clerk is temporarily or permanently incapacitated to perform such function. D. Such deputy clerk shall have the authority and power herein described, and such further power and authority as may be provided by statute. The director of administrative services shall supervise his department in accordance with the applicable personnel ordinance and Article 3-10 of this code and shall exercise such Dowers and perform such duties as are customarily conferred and required by applicable ordinances, resolutions or lawful directive. The position of the director of admin- istrative services is hereby declared as classified service and he/she shall be appointed and removed by the manager; and shall serve and receive such compensation as shall be determined in accordance with the applicable personnel ordinances. Sec. 3-4-2 Division Within the Department There are hereby created within the department of administrative services, the divisions of general administration, personnel management, budget and planning and records management; division superintendents and section heads shall be appointed and removed by the director of administrative services subject to the ratification of the manager and provisions of Article 3-10 of this code as it now exists or may be hereafter amended. The director of public works shall be superintendent of streets as required by A.R.S. Sections 9-601 through 9-714 inclusive and as authorized by A.R.S. 9-271B (3) (f) , as amended. Ratification of the appointment or removal of the director of public works by the council shall be construed as compliance with the provisions of A.R.S. Section 9-271B (3) , as amended. Sec. 3-5-2 Divisions Within the Department There are hereby created within the department of public works , divisions of engineering, public works operations, (having subordinate thereto an airport section) , building inspection and community services. Division superintendents and section heads shall be appointed and rer'oved by the director of public works subject to the ratification of the manager and provisions of Article 3-10 of this code as it now exists or may be hereafter amended. Sec. 3-5-3 Powers and Duties In addition to those duties set forth in Section 3-5-4 and 3-5-5, the department of public works shall have charge of and supervision over the care, maintenance and construction of all streets, sidewalks, alleys and Public ways; the construction, operation and maintenance of all storm water and sanitary sewers and all street gutters, drains , drainageweys , wastewater treatment, airports , improvemen., districts, easements and the appurtenances tnereto; the care, maintenance and construction of all public buildings , lands and parkways; the operation, maintenance and construction or all other public works projects and improvements withinl the jurisdiction of the city. Sec. 3-5-4 Divir.'on of Bu:ldino Inspection There is hereby created the division of building inspection. It shall consist of the superintendent of building inspection woo shall be head of the division and all officers and erwlo)'ees assigned thereto. -24. 11- Rev. 7/80 3-5-4 ADMINISTRATION 3-5-4 A. Duties. It shall be duty of the superintendent of building inspection to see the enforcement of all ordinance and code provisions relating to buildings or zoning and to inspect all uuiidifgs or street:. being erected or altered, as frequently as may be necessary to insure compliance. B. Ex Officio inspector. The superintendent of building inspection shall act as ex otficio building inspector and shall have all the powers and perform all the duties connected twith that office and he shall enforce all provisions of the uniform code, now existing or hereafter amended. C. Stop Order. The superintendent of building inspection shall have the poorer to order all work stopped on construction or alteration or repair of buildings in the city when such work is being done in -violation of any provision of any code provision or ordinance relating thereto, or in violation of the zoning ordinance. Work shall not be resumed after the issuance of such an order except on the written permission of the inspector, provided, that if the stop order is an oral one, it shall be followed by a written stop order within an hour. Such written stop order may be served by any inspector. D. Entry Powers . The superintendent of building inspection shall have the power to make or cause to be made an entry into any building or premises where the work of altering, repairing or constructing any building or structure is going on, for the purpose of making inspec- tions, at any reasonable hour. E. Subordinate Positions Within the Division of Building Inspection 1. Office of Inspection. There is hereby created within the division of building inspection an inspection office having subordinate thereto a plans check section. Office heads and section heads shall be aeDointed and removed by the superin- tendent of building inspection subject to the ratification of the director of public works and the provisions of Article 3-10 of this code as it now exists or may be hereafter amended. 2. Zoning Administrator. There is hereby created within the division of building inspection the office of the zoning administrator under the provisions of Arizona Revised Statutes 9-271B (3) (f) and C. The zoning administrator shall be the superintendent of building inspection and the superintendent of building inspection shall exercise ell rignts , Dowers , authority, duties and orivile,:cs conTerre'd on the zoning administrator by statutes, this code or by ordinance. a. Upon completion of the necessary processing, the zoning administrator shall submit the site plan to the executive secretary of the planning and zoning commission for placement on the commission agenda. 2) Receive, review and process amendments to the Apache Junction zoning ordinance. Upon completion of the necessary review and processing, the zoning admin- istrator shall submit the amendment and the city recommendation to the executive secretary of the planning and zoning commission for placement on the commission agenda. 3) Receive, review and process petitions for a variance, special exception, appeal or interpretation to be considered by the board of adjustment. Upon comple- tion of the necessary processing, the zonino adminstrator shall submit the petition for a variance, special exception, appeal or interpretation with the city's recommendation to the executive secretary of the board of adjustment for placement on the board agenda. Sec. 3-5-5 Division of Community Services There is hereby created the division of community services. It shall consist of the superintendent of community services who shall be the head of the division and all officers and employees assigned thereto. All such officers and employees shall perform their duties subject to the supervision of the superintendent who shall operate solely under the guidance and direction of and report directly to the director of public works. The superintendent of community services shall supervise his department in accordance witn the applicable personnel ordinances and shall exercise such powers and perform such duties as are required by this code, applicable ordinances, resolutions or lawful directives. A. Subordinate Positions Within the Division. There are hereby created within the division of community services the offices of recreation, community center. uno van.s and recreation development, and other such nffic-s as the superintendent deems appropriate for the efficient and expeuicious operation of the division. Appointment and Compensation. The position of the superintendent of community services is hereby declared as classified service and he shall be appointed and removed by the director of public works subject to ratificat'on of the manager; and shall serve and receive such compensation as shall be determined in accordance with the applicable personnel ordinance. C. Powers and Duties. The superintendent of community services shall : 1 . Administer and operate existing recreation and park areas , facilities and programs and plan for the acquisition, development and operation of proposed facilities and programs in accordance with policies set by himself, by lawful directives, by the council , and when possible, with the recommendations formulated by the parks and recreation commission. 2. Prepare an annual budget for presentation to the city council . 3. Inform the general public of the services and facilities being provided by the division of community services; address pro- fessional civic and lay groups on recreational subjects , solicit suggestions from the general public on increasing the effective- ness of the recreation programs; cooperate with governmental and voluntary organizations and agencies in the solving of recreation problems; provide, upon request, assistance of a technical nature to community agencies and organizations on problems related to recreation and park facilities and programs. 4. Assist community organizations in the promotion of recreation services; conduct studies of local conditions and needs for recreation services; assist with the recruitment and training of professional recreation personnel and volunteer leaders. 5. Upon request, advise the council , the Darks and recreation commission and community organizations concerning the expenditure of public funds for recreation and parks; acquisitions , design and development of recreation facilities and areas; and shall maintain effective and cooperative relations with all city officials, state and federal agencies and with local , state and national voluntary recreation organizations. 6. He shall , .:ith the approval of the mayor and council , post such rules and regulations as he deems necessary for the conduct of persons in the parks and other recreational facilities under his jurisdiction. -24. 14- Rev. 7/80 • 3-5-6 ADMINISTRATION 3-6-1 L Sec. 3-5-6 Assignment and Custody of Physical Properties All physical properties of the city, including the wastewater treatment system, parks , playgrounds and all municipal utilities not assigned to some other department or officer, shall be and are her._by assigned to the department of public works The director of public works shall he the custodian of all tools , equipment and other personal property assigned to the department of public works. The city clerk shall furnish the director of public works with a list of physical properties specifically assigned to other departments or officers. Sec. 3-5-7 Advice and Assistance The director of public works shall provide technical and operational advice and assistance to, and cooperate with, all other departments, boards, commissions, offices or other official entities of the city. The director of public safety shall supervise his department in accordance with the applicable personnel ordinances and Article 3-10 of this code and shall exercise such powers and perform such duties as are customarily conferred and renuired by applicable ordinance, resolution or lawful directive. The position of the director of public safety is hereby declared as classified service and said director shall be appointed and removed by the manager subject to ratification of the council and shall serve and receive such compensation as shall he determined in accordance with the applicable personnel ordinance. -24. 15- Rev. 7/80 3-6-2 ADMINISTRATION 3-6-6 Sec. 3-6-2 Function It shall be the function of the department of public safety to preserve order, enforce this code, ordinances and laws in the city, preserve the peace, mitigate the results and render aid in the case of disaster or accident, and to prevent and extinguish accidental or destructive fires. Sec. 3-6-3 Duties of Director of Public Safety The director of public safety shall have all the duties and powers assigned by this code, law or ordinance to the chief of the fire department and to the chief of the police department and ratification of the appointment or removal by the council shall be construed as compliance with the provisions of A.R.S. Section 9-2710(3) , as amended. Sec. 3-6-4 Divisions of Department of Public Safety There are hereby created within the department of public safety divisions of police, fire and animal control . Division superintendents thereof shall be appointed and removed by the director of public safety subject to the ratification of the city manager and the provisions of Article 3-10 as it now exists or may be hereafter amended. Sec. 3-6-5 Rules and Regulations The director of public safety may make or prescribe such rules and regulations for the conduct of his department as he shall deem advisable; such rules, when approved by the council , shall be binding on such members. The rules may cover the conduct of the members, uniforms and equipment to be worn or carried, hours of service, vacations and other matters necessary or desirable for the better efficiency of the department. Sec. 3-6-6 Status of Members Members of the department of public safety shall be appointed and promotions within the department shall be made, in the manner provided by law. Each member of the department shall have all the responsibility, authority end liability prescribed by statute or ordinance for policemen and firemen. -24. 16- Rev. 7/DO 3-7 ADMINISTRATION 3-7-1 Article 3-7 CONTRACT PROCEDURE 3-7-1 Formal Contract Procedure 3-7-2 Open Market Procedure 3-7-3 Inspection and Testing 3-7-4 Surplus Supplies and Equipment 3-7-5 Professional Services Section 3-7-1 Formal Contract Procedure Except as otherwise provided herein, purchases, leases, rentals and contracts for supplies, services, equipment and the sale of personal property of estimated value greater than five thousand dollars, shall be by written contract with the lowest or highest responsible bidder, as the case may be, pursuant to procedure prescribed herein. A. Notice Inviting Bids. A notice inviting bids shall include a description of the articles to be purchased or sold, shall state where bid blanks and specifications may be secured and the time and place for opening bids. 1. Published Notice. A notice inviting bids shall be published at least ten days before the date of opening the bids. Notice shall be published at least once in a newspaper of general circulation, printed and published in the city. 2. Bidder's List. The purchasing officer shall also solicit sealed bids from all prospective suppliers whose names are on the bidder's list, or who have requested their names to be added thereto. 3. Bulletin Board. The purchasing officer shall also advertise pending leases, rentals, purchases or sales by a notice posted on a public bulletin board in the city hall . B. Bidder's Security. When deemed necessary by the purchasing officer, bidder's security may be prescribed in the public notices inviting bids. Bidders shall be entitled to returned bid security, provided that a successful bidder shall forfeit his bid security upon refusal or failure to execute the contract within the time specified, dating from award of contract, unless the city is responsible for the delay. The council may, on refusal or failure of the successful bidder to execute the contract, award it to the next lowest responsible bidder. If the council awards the contract to the next lowest bidder, the amount of the lowest bidder's security shall be applied by the city to the difference between the low bid and the second lowest bid and the surplus, if any, shall be returned to the bidder in default. -24.17- Rev. 10/84 3-7-2 ADMINISTRATION 3-7-2 C. Bid Opening Procedure. Sealed bids shall be submitted to the purchasing officer and shall be identified as bids on the envelope. Bids shall be opened in public at the time and place stated in the public notice. A tabulation of all bids received shall be available to the public for inspection during regular business hours for a period of not less than thirty (30) days following the bid opening. D. Bid Rejection. At its discretion, the city council may reject any and all bids. E. Award of Contracts. Contracts shall be awarded by the city council to r the lowest responsible bidder except as otherwise provided herein. F. Tie Bids. If two or more bids received are for the same total amount or unit price, quality and service being equal and if the public interest will not permit the delay of re-advertising for bids, the city council shall determine the successful bidder by lot. G. Local Preference. The city will grant a five percent (5`S) advantaae to a bidder whose business is located within the corporate limits of the City of Apache Junction if quality and service are equal . H. Performance Bonds. The city council shall have the authority to require a performance bond before entering a contract in such amount as ;t shall find reasonably necessary to protect the best interests of the city and if the city council requires a performance bond, the form and amount of the bond shall be described in the notice inviting bids. I. Lease or contract purchase agreements shall have their value estimated as the cumulative total value of the contract expense to the city. Rentals shall be valued at the cumulative total of rental payments for the anticipated rental period or for one (1) calendar year from the start of the rental for long-term items , whichever is less. Sec. 3-7-2 Open Market Procedure A. Purchases of supplies, equipment, contractual services and sales of personal property of an estimated value in the amount of over five hundred dollars (S500.00) , but rot exceedirg five thousand dollars (S5,000.00) , may be made by the purchasing officer in the open market by observing the procedure prescribed in section 3-7-1, with the folio ina exceptions. 1. Minimum Number of Bids Open market purchases shah , wherever possible, be based on at least tnr,ee bids, and shall be awarded to the lowest responsible bidder. 2. Notice Invitinc. Bids. The purchasing officer shall solicit not less thin three (3) written bids from prospective vendors. Notices will be posted on a public bulletin board in the city hall not less than forty-eight (48) hours before opening bids. -2E . 13- Rev. 7/80 3-7-3 ADMINISTRATION 3-7-5 B. The purchasing officer shall have authority to require chemical and physical tests of samples submitted with bids and samples of deliveries which are necessary to determine their quality and conformance with specifications. Sec. 3-7-4 Surplus Supplies and Equipment All departments and offices shall submit to the purchasing officer, at such time, and in such form as he shall prescribe, reports showing all supplies and equipment which are no longer used or which have become obsolete or worn out. The purchasing officer shall have the authority to sell all supplies and equipment which cannot be used or which have become unsuitable for city use, or to exchange the same for, or trade in the same for new supplies and equipment. Such sales shall be made pursuant to Section 3-7-1 or 3-7-2, whichever is applicable. Sec. 3-7-5 Professional Services A. Professional services may be contracted through a council-approved consultant selection process. These services may include, but are not limited to, engineering, architectural, financial and general management services. B. Requests for contracts for professional services shall be posted on a public bulletin board at the official posting locations adopted by the council not less than forty-eight hours before the time established for submitting bids. The director shall be appointed and removed by the manager subject to ratification of the council and shall serve and receive such compensation as shall be determined in accordance with the applicable personnel ordinance. The director shall appoint a deputy director and other assistants as necessary to accomplish his mission. - Rev. 10/34 3-8-2 ADMINISTRATION 3-9-1 Sec. 3-8-2 Duties of the Director Toe duties of the director shall be as follows: A. The preparation and periodic revision of an emergency operations plan for adoption by the mayor and city council . B. The necessary liaison between the city council and other emergency service organizations within the State of Arizona. C. The control and direction of the training of the emergency services organization. D. Such other duties as prescribed by law or by regulations adopted • by the mayor and city council . Sec. 3-8-3 Membership The emergency services organization of the City of Apache Junction shall consist of the officers and employees of the City of Apache Junction designated in the emergency operations plan as well as all volunteers. The functions and duties of the organization shall be distributed between such departments and services of the City of Apache Junction as Prescribed in the emergency operations plan. Sec. 3-8-4 Violations It shall be unlawful for any person to willfully obstruct, hinder or delay any member of the emergency services organization in carrying out his duties under this article. It shall also be unlawful for any person to wear, carry or display any emblem, insignia or other means of identification as a member of the emergency services organization of the City of Apache Junction unless so authorized by the proper officials. The director of planning shall supervise his departments in accordance with the applicable personnel ordinances and article 3-10 of this code and shall exercise such powers and perform such duties as are customarily conferred and required by this code, applicable ordinance, resolution, or lawful directive. The position of the director of planning is hereby declared as classified service, and he shall be appointed and removed by the manager. Sec. 3-9-2 Powers and Duties The director of planning shall : A. Supervise the preparation and/or the updating of the Apache Junction general plan, specific plans and such other plans and studies as are necessary and appropriate. Title 9, Chapter 4, Article 6 and Chapter 11 of this code. B. Accept for placement on the commission agenda, development site plans prepared in accordance with the provisions of the city zoning ordinance and the city subdivision regulations , which have been received and reviewed by the zoning administrator. 2. Accept for placement on the commission agenda, zoning amendnents prepared in accordance with the provisions of the city zoning ordinance and the city subdivision regulations , which have been received and reviewed by the zoning administrator. 3. Accept for placement on the commission agenda, such other items as are appropriate for consideration by the commission. 4. The office of the Library of the City of Apache Junction is hereby created and esta:, lhsited. The position of the library director is hereby ceciareo as classified service, and he shall be appointed and removed by the city council subject to reco,nmendation of the city manager and the library board and shall serve and receive such compensation as shall be determined in accordance with the (r applicable personnel ordinance. Sec. 3-11-2 Duties of Library Director A. The library director shall: retain all duties and responsibilities assigned by this code, law or ordinance and shall abide by those set forth in Arizona Revised Statutes Sections 9-411 through 9-420. B. Consult v:ith the president of the library board as to the items to be included on the agenda of meetings for said board prior to the preparation and distribution of the agenda by the library director. The library director, if requested by any board members, shall include on the agenda any item requested by said board member. C. Prepare and distribute the official minutes of all library board meetings. D. Consult with the library board and city manager on the establishment of all policies and procedures including, but rot limited to library hours, general standards of service, book selection, policy and fees. E. Administer a4id operate existing library facilities and programs and plan for the development and operation of proposed facilities and programs in accordance with policies set by lawful directives of the library board and the city council. (a. F. Make recommendations to the city manager, with the assistance of the library board, for the annual budget for submittal to the city council. G. Inform the general public of the services and facilities being provided by the office of the library; address professional civic and lay groups on related subjects, solicit suggestions from the general public on increasing the effectiveness of programs; cooperate with governmental and voluntary organizations and agencies in the solving of related problems; provide, upon request, assistance of a technical nature to community agencies and organizations on problems related to library facilities and programs. -24.24- Rev. 5/83 3-11-3 ADMINISTRATION 3-1 1-3 H. Assist community organizations in the promotion of library services; conduct studies of local conditions and needs for such services ; assist with the recruitment and training of professional library personnel and volunteer leaders. Upon request, advise the council, the library board and coni'unity organizations concerning the expenditure of public finds for the library; acquisitions, design and development of facilities; and shall maintain effective and coonerativa relations with all city officals, state an:: feoera1 agencies and with local , state and national voluntary organizations.
