MEMORANDUM TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL -_-, l 1 i '' THROUGH: CITY MANAGER 'GVR IN\ R � FROM: DIRECTOR OF PUBLIC WORKS 116�� REGARDING: INSPECTION AND PLAN REVIEW FEE SCHEDULE Study Session Agenda Item Attached is a draft of a Resolution establishing engineering inspection and plan review fees including provisions for liability insurances and construction assurances. At this time, the City is not being reimbursed for performing plan reviews or inspections in comparison to the Building Division charging a plan review fee for review of plans and inspection of buildings in order to offset costs incurred by the City. Essentially, the same process should be applied to the Engineering Division for similar work. In preparing this resolution, we have made inspection fee studies comparing �.,. other city' s fee schedules. These comparisons are attached for your review. We have also performed fee studies for plan reviews and have made comparison checks against recent projects designed and constructed in Apache Junction to our current standards and requirements. As this resolution involves myriad complicated procedures, we would be happy to discuss any questions you may have prior to the study session in order to expedite the review. RWB: sh Attachments. Draft Resolution Inspection Fee Comparison exhibits Plan Review Fee Comparison exhibits File 100.051 1001 NORTH IDAHO • APACHE JUNCTION ARIZONA 85220-0190 • TELEPHONE(602)982 8002 rommor RESOLUTION NO A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, DECLARING THE ESTABLISHMENT OF AN ENGINEERING INSPECTION AND PLAN REVIEW FEE SCHEDULE, LIABILITY INSURANCE AND CONSTRUCTION ASSURANCES FOR PERMITS TO WORK IN DEDICATED CITY OF APACHE JUNCTION RIGHTS-OF-WAY. WHEREAS, it is necessary in the public interest that all uses for the right-of-way for public roads, streets, and alleys by individuals, /mak corporations and political subdivisions be regulated and controlled so that said public roads, streets, alleys may be effectively utilized and maintained for their primary purposes as public ways, and WHEREAS, the laws of the State of Arizona authorize the Apache Junction City Council to control and manage said public roads, streets and alleys within the City of Apache Junction. NOW, THEREFORE, BE IT RESOLVED that no person, corporation, association or other political subdivision shall without obtaining a permit therefore, enter upon any public road, street, alley or way or upon the right-of-way of any public road, street, alley or way, not a State Highway, inside the corporate limits of The City of Apache Junction for the purpose of performing any construction, reconstruction, removal, repair, maintenance or any other work, including, but not limited to the following: 1. Pavement, curb, gutter, driveways, sidewalks; 2. Drainage or flood control facilities, 3. Grading, oiling, graveling or any surfacing of any road, street, alley or way; 4. Water, gas, sewer or other types of pipelines, 5 Irrigation and waste water facilities, 6 Utility lines such as electric, television, telephones, other power service and communication facilities, 7. Structures, signs (whether temporary or permanent), 8. Plantings, landscaping, watering and/or drainage systems, and decorative placements; 9. Any of the above which may overhang the public road, street, alley or way BE IT FURTHER RESOLVED that the Apache Junction City Council hereby authorize the City of Apache Junction Department of Public Works, Engineering Division to issue such permits /Mk BE IT FURTHER RESOLVED that all applications for such permits shall be in writing on such form as required by the Engineering Division, Department of Public Works, unless waived in writing by the Director of Public Works. The application shall be submitted at least three working days prior to start of construction and shall be accompanied by three (3) copies of a drawing, map, blueprint, diagram, or similar exhibit of a size and in the quantity prescribed by the Director of Public Works, sufficient to clearly illustrate the location, dimension, motive, method and purpose of the proposed work. Applicants for such permits may be either an owner or a contractor; however, the work may be performed only by (1) a contractor, (2) utility company, (3) governmental agency, or (4) resident owner of residential property, where the property owner proposes to do the work. If the improvement to be constructed under the permit is not to become the property of the City of Apache Junction, and if the applicant is someone other than the owner, the owner shall also sign the permit form indicating that he agrees to the conditions of the permit. Permits shall be issued only to the person, corporation or political subdivision making application and therefore may not be assigned to another person, corporation or political subdivision by the permittee If the permittee assigns his permit to another, the permit shall become void. A permit shall be valid for one year or as indicated on the permit from date of issue, unless sooner cancelled. If work is not completed within one year, or the alloted time period, a new permit must be obtained for such uncompleted work If no work is performed after a permit is obtained, the permittee may apply for the cancellation of the permit. If approved, the fee, less processing charge, shall be refunded to the permittee RESOLUTION NO PAGE ONE OF FOUR ww=ir Am. odoik. BE IT FURTHER RESOLVED that if any work is undertaken prior to securing a permit therefor, the Director of Public Works may require the City road to be restored to its original condition prior to granting a permit, or may charge a reasonable fee not to exceed $500 in addition to the normal fee schedule for inspection and examination of the work done prior to issuance of a permit All work shall cease until the Director of Public Works determines whether the public road should be restored to its original condition or grant a permit in accordance with this resolution. �^ BE IT FURTHER RESOLVED that this resolution shall not prevent any person, corporation or political subdivision from maintaining any pipe or conduit lawfully on or under any public street, or from making excavation as may be necessary for the preservation of life or property when an urgent necessity therefor arises during the hours the offices of the City of Apache Junction are closed, except that those making emergency use shall apply for a permit within one (1) calendar day after the offices are again opened. BE IT FURTHER RESOLVED that all work done in said public roads, streets, alleys or ways shall be done in accordance with the permit and specifications of the City of Apache Junction for such installation. The Director of Public Works may require, in the public interest, such structures as designated by him to properly control traffic, provide access to adjoining property and maintain other facilities in the area. BE IT FURTHER RESOLVED that the Director of Public Works shall furnish to the applicants such inspection services as will determine if the improvements constructed are in accordance with permits granted and the specifications and details mentioned in this resolution Any persons or corporation, association, or political subdivision, doing work under any permit as set forth in this resolution shall notify the Engineering Division, Department of Public Works, at least one (1) full working day in advance of the time and place the work will begin BE IT FURTHER RESOLVED that the applicant shall, before any permit shall be issued, deposit with the City of Apache Junction a permit fee to cover the City's cost of inspection and clerical services. The schedule of fees set forth herein is established to offset the City's expenses incurred in connection with processing permit applications and inspecting work performed under the permits and the fee shall be computed on the basis of such fee schedules If the work is not performed after a permit is obtained, the permit shall be cancelled and the portion of the fee relating to inspection costs refunded at the request of the applicant. In instances where an applicant is issued numerous small permits throughout the year, he may post a continuing use bond to cover work under Amok more than one permit; however, this continuing bond provision is not intended for use on new subdivision work The continuing Bond shall be of value sufficient to cover all work under construction by the permittee at any time and shall be satisfactory to the City of Apache Junction. BE IT FURTHER RESOLVED that the permittee shall be responsible for all liability imposed by law for personal injury or property damage arising out of or related to work performed by the permittee under permit, or arising out of the failure on the permittee's part to perform its work under the permit If any claim of such liability is made against the City, its officers, agents, boards or employees, permittee shall defend, indemnify and hold them, and each of them harmless from such claims, including claims alleging the joint negligence of the City, its officers and employees and the permittee No applicant shall be entitled to a permit under this resolution unless and until he shall have filed and maintained on file with the City of Apache Junction a certificate certifying that he and/or his company or business firm carries public liability and property damage insurance issued by an insurance carrier authorized to do business in the State of Arizona, insuring the applicant and the City and its agents, against loss by reason of injuries to, or death of persons, or damages to property arising out of or related to work performed by the applicant, its agents or employees while performing any work under such permit. Such insurance shall be primary and provide coverage for all liability assumed by the applicant under this section, and shall be provided by any permittee in the following minimum amounts $500,000 for death of, or injury to, any one person in any one accident, $1,000,000 for death of, or injuries to, more than one person in any one accident, $500,000 for damages to property. Failure by the applicant to provide the City with such a certificate, and failure by the City to demand the filing by permittee of such a certificate before such a permit is issued, shall not be deemed to waive permittee's obligation to provide the insurance specified herein. Such insurance certificate shall remain in effect and be kept on file with the City until all work to be performed by the permittee under the permit has been completed. Where an encroachment involves a permanent obstruction such insurance certificate requirements and other resolution stipulations shall remain in effect until such construction is removed. The insurance certificate shall provide that coverage cannot be cancelled or expire without providing fifteen days written notice of such action to the City, also noting the permit number No evidence of liability insurance or surety bond shall be required as a condition precedent to the issuance of a permit to. (1) a resident owner of a residentia property where he proposes to perform construction in front of his own property; (2) a federal, state, county or municipal agency or political subdivision, or (3) any public service corporation with a net worth of more than $1,000,000 as reflected by its most current balance sheet No permit shall be issued for work within the right—of—way, in which a contractor is engaged in a City road project, without written permission from the contractor accompanying the application for permit BE IT FURTHER RESOLVED that this Resolution is an amendment to Item 5, page 42 of the Apache Junction Development Guide. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS SECTION I IN GENERAL That the Apache Junction City Code, Chapter 12 TRAFFIC be amended by adding Article 12-4 VEHICLE WEIGHT RESTRICTIONS ON PUBLIC STREETS to read as follows ARTICLE 12-4 VEHICLE WEIGHT RESTRICTIONS ON PUBLIC STREETS Section 12-4-1 Weight Restrictions Within Residential Areas and Other Roads Section 12-4-2 Weight Restrictions On Mile Grid Roadways, US Highways and State Routes Section 12-4-3 Exemptions Section 12-4-4 Weighing of Vehicles Section 12-4-5 Unlawful Weight Section 12-4-6 Damages to the Street Section 12-4-7 Overweight Permits Section 12-4-8 Penalties Section 12-4-1 Weight Restrictions Within Residential Areas and Other Roads It shall be unlawful for any person, partnership, association, company or corporation to operate a vehicle having a gross weight, including load, in excess of eight thousand (8,000) pounds on the public street in any residential area and other roads within the corporate limits of the City, except roads as indicated in Section 12-4-2. Section 12-4-2 Weight Restrictions on Mile Grid Roadways, US Highways and i.. State Routes The total gross vehicle weight and total gross axle weight of any motor vehicle, truck or trailer, including the load thereon, driven only on mile grid roadways (section-line roads), US Highways and State Routes, shall not exceed the gross weight given for the respective distance between the first and last axles of the group of axles measured longitudinally to the nearest foot as set forth in the appropriate table of weights applicable to highways under the jurisdiction of the State by Section 28-1008, 28-1009 and 28-1009 01 of the Arizona Revised Statutes in effect on the date that this ordinance becomes effective or as from time to time subsequently amended Said State Statutory tables and provisions are hereby made a part of this section in their entirety as though fully set forth herein This section shall not apply to fire apparatus, urban mass transit transportation vehicles, implements of husbandry, including farm tractors temporarily moved upon a highway, or to vehicles operated under the terms of a special permit as provided herein Section 12-4-3 Exemptions Vehicles involved in the pickup or delivery of goods or services, vehicles owned by a public or private utility while necessarily in use in the construction, installation or repair of any public utility or cable television, so long as they use the most direct route to accomplish the purpose, emergency vehicles and school buses, shall be exempt from the provision of Section 12-4-1 of this article unless otherwise specified ORDINANCE NO 485 PAGE ONE OF THREE r--� Section 12-4-4 Weighing of Vehicles Any peace officer employed by the State of Arizona, County of Maricopa, County of Pinal, or the City of Apache Junction having reason to believe that the gross weight, including load, of a vehicle is unlawful, is authorized to require the driver to stop and submit of a weighing of the vehicle and load by means of either portable or stationary scales and may require that the vehicle be driven to the nearest public scales in the event such scales are within two miles, in the same manner as is provided in State statutes. Section 12-4-5 Unlawful Weight When a peace officer, upon weighing a vehicle and load as provided in Section 12-4-4, determines that the weight is unlawful, the officer may require the driver to stop the vehicle in a suitable place and remain standing until such portion of the load is removed as may be necessary tc reduce the gross weight of the vehicle to the limit as permitted in Sections 12-4-1 or 12-4-2 respectively All material so unloaded shall be cared for by the owner or operator of the vehicle at the risk of the owner or operator Section 12-4-6 Damages to Street Any person driving, operating or parking any vehicle, object or contrivance upon any street in the City shall he liable for all damage which the street may sustain as a result of any illegal operation, driving or moving of the vehicle, object, or contrivance, or as a result of operating, driving, or moving any vehicle, object, or contrivance weighing in excess of the maximum weight established by Section 12-4-1 or 12-4-2 Section 12-4-7 Overweight Permits The City Manager, or his designee, upon application in writing and good cause shown, may issue a special permit in writing authorizing the applicant to operate a vehicle or load exceeding the maximum specified in this article on any street under the jurisdiction of the city Section 12-4-9 Penalties A In addition to any other penalties provided herein, any person convicted of violating the provisions of this article shall be punished by a fine as set forth in the following table 1,001 to 1 ,250 pounds in excess $ 100.00 1,251 to 1,500 pounds in excess 200 00 1,501 to 2,000 pounds in excess 300 00 2,001 to 2,500 pounds in excess 400.00 2,501 to 3,000 pounds in excess 500 00 3,001 to 3,500 pounds in excess 600 00 3,501 to 4,000 pounds in excess 660.00 4,001 to 4,500 pounds in excess 720.00 4,501 to 4,750 pounds in excess 760 00 4,751 to 5,000 pounds in excess 800 00 5,001 to 5,250 pounds in excess 840 00 5,251 to 5,500 pounds in excess 880 00 5,501 to 5,750 pounds in excess 920 00 5,751 to 6,000 pounds in excess 960 00 6,001 pounds and over in excess 1,000 00 B. If any arresting officer finds that the person has violated only the axle weight limitation and not the total weight limitation, the officer shall request the driver to reload the vehicle to comply with the axle weight limitations, and if the driver so complies, he shall not be subject to arrest or fine. If the driver does not comply with the request of the officer to reload, the driver shall be subject to arrest and fine as provided by this section C?DINANCE NO 485 PAGE TWO OF THREE A► .. SECTION II REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section, subsection, sentence, phrase, clause or portion of this ordinances or any part of the code adopted herein by reference is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent juris- diction, such decision shall not affect the validity of the remaining portions thereof. The gross weight imposed on the highway by the wheels of any one axle of a vehicle shall not exceed twenty thousand pounds, provided that the director may in accordance with the provisions of 5 28-1011 issue a special permit for the purpose of moving from job to job within this state and from lob to place of servicing and return within the state, road machinery which exceeds the maximum weight specified in this section B For the purposes of this article an axle load means the total load transmitted to the road by all wheels whose centers arc included between two parallel transverse vertical planes forty inches apart, extending across the full width of the vehicle C. The City has been making reference to barricading manuals of other jurisdic- tions. The attached draft copy of a barricading manual is especially designed for use in Apache Junction. Essentially, the City of Mesa barricade manual has been used as a reference and modified.
