CITY MANAGER'S REPORT City Manager Michael J McNulty reported the results of the "Public Works Clean-up" week, and stated that the overall cost was $5,261.00, compared with a cost of $3,233.00 in 1983. Mr. McNulty also reported that the ribbon cutting for the new library should be within the first two weeks in July. Mayor Hill asked if there was anyone who wished to speak in favor of or in opposition to the application. There being no one wishing to address the Council, Mayor Hill closed the hearing to the public. Councilman Baljo MOVED THAT THE APPLICATION FOR A PERSON TRANSFER OF A SERIES 6 LIQUOR LICENSE, SUBMITTED BY JERRY DON AND ELAINE YVONNE JAMES AGENTS FOR JAKE'S-O-MINE, BE RECOMMENDED FOR APPROVAL TO THE STATE DEPARTMENT OF LIQUOR LICENSES AND CONTROL. Councilwoman Taylor seconded the motion. VOTE. Unanimous The motion carried. PROPOSED ORDINANCE NO. 450, LOT SPLITS (Postponed Item) ) Director of Planning Chuck Newcomer explained that previously the Council had postponed this ordinance regarding lot splits, and recommended that this be further postponed to allow staff to proceed with the General Plan revisions, of which lot split regulations would be included. Vice Mayor Bakkedahl MOVED THAT PROPOSED ORDINANCE NO. 450, BE FURTHER POSTPONED UNTIL THE NEXT REGULAR CITY COUNCIL MEETING OF JUNE 17, 1986. „Am\ Councilman Baljo seconded the motion. Several councilmembers addressed the lot split issue. VOTE. Unanimous The motion carried PROPOSED ORDINANCE NO. 501, PZ-11-86, SAVAGE, HARE AND WOODFORD Mr. Newcomer briefed the Council on the request for rezoning of three combined parcels of 3.44 acres, located on the south side of West Shiprock Street between North Desert View Drive and North Delaware, from GR General Rural to CR-2 (MH), and stated that the Planning and Zoning Commission recommend denial, feeling that there are too many easements in the city, and that there is no access to these properties. Mr Larry Savage, 2497 W. Shiprock, Apache Junction, requested approval of the rezoning application. Mayor Hill asked if there was anyone who wished to speak in favor of or in opposition to the rezoning. REGULAR MEETING OF THE CITY COUNCIL JUNE 3, 1986 PAGE 3 OF 14 Mr. Jerry Burgess, 349 S. Saguaro, Apache Junction, addressed the Council in favor of the application Mr. Gil Verley, 620 S. Palo Verde, Apache Junction, spoke in favor of the rezoning, stating that with the current zoning ordinance, there should be no reason for denial. ,filimb. Mr. Earl Laabs, 1322 N Goldfield, Apache Junction, stated that even though having no connection with this property, this is the only recourse of the property owner to make use of the land Mayor Hill pointed out that the applicant has offered to black-top the easement to provide an additional access Mr. Keith Stachar, 6301 E. Roundup, Apache Junction, stated that this request is appropriate and conforms with the General Plan. There being no one else wishing to address the Council, Mayor Hill closed the hearing to the public. Councilwoman Taylor MOVED THAT ORDINANCE NO. 501, AS READ BY THE CITY CLERK, BE APPROVED AND ADOPTED WITH THE FOLLOWING STIPULATION• THAT THE DEDICATION TO THE CITY OF THE NORTH 33 FEET OF THE SUBJECT SITE AND A 20 FOOT BY 20 FOOT CUTOFF AT THE INTERSECTION OF SHIPROCK AND DELAWARE DRIVE FOR A PUBLIC ROADWAY AND ASSOCIATED PURPOSES Councilman Baljo seconded the motion. VOTE. Unanimous The motion carried. PROPOSED ORDINANCE NO. 505, PZ-14-86, JOHNSON AND FORD ) Mr. Newcomer stated that this is a postponed rezoning request from the May 20, 1986, regular city council meeting, and is an application for the rezoning of two combined parcel of REGULAR MEETING OF THE CITY COUNCIL JUNE 3, 1986 ,. _. PAGE 4 OF 14 111••=11r 3 3/4 acres, located on the west side of North Tomahawk Road between East Scenic Street and East Superstition, from GR General Rural to CR-1 (MH), and further stated that the Planning and Zoning Commission recommended approval with stipulations, and that due to protests this ordinance does require a three-quarter vote of the City Council Mr. Bob Perrault, 2237 W. Foothill, Apache Junction, representing the applicants, outlined the proposal and to requested approval of the application. Councilwoman Taylor asked if Mr. Perrault is aware that this property may be split in only three parcels, according to real estate regulations. Mr. Perrault replied that of the two owners, one would get two lots and the other would only make three sales, but there was a possibility of five lots. Mayor Hill asked if there was anyone who wished to speak in favor of or in opposition to this application. Ms Glenna Traylor, 482 N. Tomahawk, Apache Junction, adjacent property owner, addressed the Council in opposi- tion to the rezoning, due to the washes, which will cause problems with access to these lots. Ms Traylor further commented that 90% of the adjacent property owners have protested this rezoning, and the remaining 10% could not be reached. Ms Lynette Mewhorter, 1378 E. Scenic, Apache Junction, spoke in opposition to the request for rezoning, and stated that putting concrete in the washes would increase the problems. Mr. Perrault gave a rebuttal of the I opposition. Mr. Perry Traylor, 484 N. Tomahawk, Apache Junction, spoke in opposition to the application. There being no one else -wishing to speak, Mayor Hill closed the hearing to the public. Councilman Baljo MOVED THAT ORDINANCE NO. 505, AS READ BY THE CITY CLERK, BE APPROVED AND ADOPTED. Councilwoman Taylor seconded the motion. REGULAR MEETING OF THE CITY COUNCIL JUNE 3, 1986 PAGE 5 OF 14 Councilman Eidson asked if there could be a compromise. Councilman Baljo and Councilwoman Taylor withdrew the motion and second. Mr. Perrault stated that a compro- /\ mise could be made by making the 1 1/4 in front would be two lots, and the 2 11— 1/2 acres in the rear would be a maximum of three sales with no further splits. Councilman Eidson asked if the protesters would consider withdrawing their petitions with this compromise Mayor Hill explained that protest petitions cannot be withdrawn at this point. Mr Newcomer stated that the compromise could be put into the ordinance, but this has not been done in the past. City Attorney Alexander recommended against doing this, as it would be creating a special zoning district. Councilman Baljo suggested a "gentlemen's" agreement. City Manager McNulty explained that this type of agreement would not be binding on subsequent buyers of the lots. Councilman Eidson clarified the recommendations as approving or denying as is. ) 1 Councilman reinstated the original motion with the stipulation that the lots be a minimum of 20,000 square feet. Councilwoman Taylor reinstated the second to the motion. Vice Mayor Bakkedahl commented that rook this area is designated as medium to high density in the General Plan. VOTE. In Favor: Councilman Eidson, Councilman Baljo, Councilwoman Taylor, Vice Mayor Bakkedahl, Mayor Hill Opposed. Councilman Jimenez, Councilwoman Gardner The motion failed due to the three-quarter vote required for approval. PROPOSED ORDINANCE NO. 504, PZ-13-86, BRENNAN AND GILLETT ) Mr. Newcomer stated that the applicant has requested a 30 day postponement of this rezoning request. PROPOSED ORDINANCE NO. 506, PZ-15-86, MILAM ) Assistant Planner Julie Reid briefed the Council on the request for rezoning of a 1 1/4 acre parcel, located on the southeast corner of North Grand Drive and West Foothill Street, from GR General Rural to CR-2 (MH) Single Family Residence Zone, and stated that the Planning and Zoning Commission recommends approval of the rezoning, and stated that protests have been submitted, requiring three-quarter vote of 'oft, the City Council for passage Ms Ione Chovanec, 1980 W. Canyon, Apache Junction, representing the applicant, requested approval of the rezoning. Mayor Hill asked if there was anyone who wished to speak in favor of or in opposition to the request for re- zoning. Mr. Bob Anderson, 1870 N. Grand, Apache Junction, addressed the council in opposition to the application, expressing concern over keeping livestock. Councilwoman Taylor explained that his right to keep livestock would grandfathered. Ms Chovanec stated that two of the lots would be 11,000 square feet, with the third being 17,000 square feet. There being no one else wishing to speak, Mayor Hill closed the hearing to the public. PROPOSED ORDINANCE NO. 507, PZ-16-86, FOWLER ) Ms Reid briefed the Council on the request for rezoning of a 1 1/4 acre parcel, located on the northwest corner of North Valley Drive and West Shiprock Street, from GR General Rural to REGULAR MEETING OF THE CITY COUNCIL JUNE 3, 1986 PAGE 7 OF 14 CR-2 (MH) Single Family Residence Zone, and since after roadway dedications there would only be 39,204 square feet left, the applicant will only split the property into two lots; and stated that the Planning and Zoning Commission recommends approval with stipulations Mr. Chester R. Fowler, Lost Dutchman Travel Trailer Park, requested approval stating that they wished to place another mobile home on the property to reside in. /00k Mayor Hill asked if there was anyone who wished to speak in favor of or in opposition to the application. Mr. Keith Stachar, 6301 E. Roundup, Apache Junction, pointed out that this case would fit the new classification previously discussed at the work session. PROPOSED ORDINANCE NO. 508, PZ-17-86, SIERRA ENTERPRISES, JONES AND JOHNSON) Mr. Newcomer briefed the Council on the request for rezoning of a 3.721 acre parcel, located between South Bowman Road and South Cortez Road and between East 17th Avenue and East 18th Avenue, from GR General Rural to C-3 General Commercial District with the original application being for C-4 Heavy Commercial District which was amended, and stated that the Planning and Zoning Commission recommends approval of the application. Mr. Dick Johnson, 1731 E. Grove, Mesa, one of the property owners, stated that this zoning request is compatible with the General Plan and requested approval of the application. Councilwoman Gardner expressed the opinion that a planned development would be more appropriate for this property. In addition to hearing the consultant's request, the City polled other cities to determine their requirements in regard to retention basin depth and the results are as follows. 1 . A portion of the flows can be retained in the area North of the drainage channel and additional retention/detention areas can be designed within the pavement areas. In fact, the consultant has included retention on parking lot paving on another local project. D.C.C. concerns were also expressed that deviation from the requirements would be an invitation for all subsequent developers to request exceptions or modification of requirements. This in itself could lead to confusion and inequities. In addition, to date all other developers have met the current requirement. In essence, the Development Coordinating Committee strongly recommends that the appeal to the City Council to increase the retention basin depth and side slopes be denied and that the current require- ments as stated in the Development Guide be followed. Our proposal was entitled: "Senior Citizens ' Services Project" and our request was for $21,000. We are delighted that we received full funding for this grant. What remains to be done is the completion of the Intergovernmental Agreements (Contracts) which require a Resolution from the City Council to the effect that the Council approves the agreement to accept the funds, and to authorize an executor of the agreement. Among other items requested in the grant was the acquisition of a projection television system which will be installed in the new library's program room. While purchased with the needs of the Senior Citizen in mind, the system will also be used by library staff to present programs to all age groups. We are very excited about the possibilities for service to the senior adult that are opened to the library staff through the receipt of this grant.
