Introduction of Distinguished Visitors and Guests Mayor Hill recognized State Representative Roy Hudson AWARDS, PRESENTATIONS, AND COMMUNICATIONS None. CITY MANAGER'S REPORT City Manager Michael J McNulty reported that the consultants have been in contact on the signalization of the intersection at Broadway and Ironwood, which should be ready for bid procedures very soon, and that the State Health Department has begun procedures to upgrade the city's position on the priority planning grant list for sewage treatment facilities, and have advanced the city to make application for such a grant for the next fiscal year CALL TO THE PUBLIC None. i'►. PUBLIC HEARINGS PROPOSED ORDINANCE NO 516, EXECUTIVE SESSIONS (With the Emergency Clause) City Attorney David Alexander explained that there is no state law prohibiting the taping of executive sessions by the city council and this ordinance would adopt a procedure as *n how and when recordings would be made of an executive session Mayor Hill asked if there was anyone who wished to speak in favor of or in opposition to the item. Mr. Gil Verley addressed the council in favor of allowing the recordation of executive sessions on personal recorders by councilmembers. Mayor Hill asked if there was anyone else wishing to speak. There being no one else wishing to address the council Mayor Hill closed the hearing to the public. VOTE: Unanimous Ao', The motion carried. follows Deputy City Clerk Lori Clark read as ORDINANCE NO. 516, AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION CITY CODE, CHAPTER 2 MAYOR AND COUNCIL, ARTICLE 2-4 COUNCIL PROCEDURE, BY ADDING SECTION 2-4-10 RECORDING OF EXECUTIVE SESSIONS; REPEALING ANY CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. Councilwoman Gardner MOVED THAT ORDINANCE NO. 516, AS READ BY THE CITY CLERK, BE APPROVED AND ADOPTED WITH THE FOLLOWING AMENDMENT: THAT SECTION 2-4-10 READ AS FOLLOWS: "NO RECORDING OF ANY EXECUTIVE SESSION BY ANY MEMBER OF THE CITY COUNCIL OR BY ANY PARTICIPANT THEREOF SHALL BE PERMITTED." Councilman Jimenez seconded the motion. Councilwoman Taylor made the following amendment to the motion THAT ALL EXECUTIVE SESSIONS SHALL BE TAPED. Councilman Baljo seconded the motion. City Attorney Alexander informed the council that the amendment to the motion is inappropriate, due to the fact that the motion and amendment to the motion contradict each other. Councilwoman Taylor and Councilman Bajo withdrew the amendment and second to the motion. Councilwoman Taylor stated that items placed on the agenda should be introduced by the party requesting the agenda item. Mayor Hill stated that executive sessions could be taped and minutes made as in regular meetings, but it should not be necessary for councilmembers to make personal recordings of such sessions. Mr. Alexander suggested that an amendment could be made by Councilwoman Taylor, deleting everything in Section 2-4-10, and adding the intended wording Councilwoman Taylor amended the motion as follows. THAT EVERYTHING IN SECTION 2-4-10 BE DELETED AND INSERTING "RECORDINGS OF ALL EXECUTIVE SESSIONS BY THE CITY COUNCIL BE PERMITTED, TO BE RECORDED BY THE CITY CLERK AND TO BE KEPT IN A SECURE CITY VAULT." REGULAR MEETING OF THE CITY COUNCIL JULY 15, 1986 PAGE 3 ..� w Councilman Baljo seconded the amendment to the motion Councilwoman Gardner expressed objection to the recording of executive session at all, but would agree if Section 2-4-10 read "no recording of any executive session by any member of the city council or by any participant thereof shall be permitted except in those instances where it is deemed to be in the best interest of the city by all of the council." Councilman Baljo agreed that there should not be "secret" recordings, but possibly an official recording. Councilwoman Taylor stated that this would make the council more aware of what they do and say in an executive session, and also could be reviewed by councilmembers unable to attend those meetings. Councilman Jimenez stated that his only objection to these recordings was that the tapes may fall into the wrong hands, and that a responsible staff member be present when someone is reviewing the tapes or possibly conduct all discussions in open public meetings. Councilman Baljo reiterated that he has no objection the recording of executive sessions by a staff member, such as the City Clerk. City Attorney Alexander informed the council that if the person listening to the tape had not been present at the meeting, to comply with Open Meeting Law a person that was in attendance would have to be present. Councilwoman Taylor Councilman Baljo withdrew the amendment and second to the motion. Councilwoman Taylor amended the motion THAT EVERYTHING IN SECTION 2-4-10 BE DELETED AND THAT "RECORDINGS OF ALL EXECUTIVE SESSIONS BY THE CITY COUNCIL BE PERMITTED AND IN SUCH INSTANCES THE RECORDING SHALL BE KEPT BY THE CITY CLERK IN A SECURE CITY VAULT, AND THAT ALL REVIEWINGS OF THE EXECUTIVE SESSIONS SHALL BE DONE BY HEADPHONES WITH CITY CLERK OR CITY OFFICIAL IN ATTENDANCE. Councilman Baljo seconded the motion. VOTE: Unanimous The amendment to the motion carried. VOTE (on the motion as amended) Unanimous The motion as amended carried. PROPOSED ORDINANCE NO. 518, CONTINGENCY ACCOUNT Councilwoman Taylor explained that this ordinance was proposed to save funds for water and sewer, but that this area should have further study prior to any action. Councilwoman Taylor MOVED THAT PROPOSED ORDINANCE NO. 518 BE POSTPONED UNTIL THE REGULAR CITY COUNCIL MEETING OF NOVEMBER 4, 1986. Councilman Baljo seconded the motion. Councilman Jimenez stated that the City is not short of funds, and the contingency account has a present balance of approximately $105,000, which is a healthy amount REGULAR MEETING OF THE CITY COUNCIL JULY 15, 1986 PAGE 4 Amok Elk Councilman Eidson commented that funds were expended at the previous meeting in the amount of $16,000 which will be taken from contingency, and also liability insurance will be due soon, but at this time the city is solvent. City Manager McNulty further explained that the purpose of the contingency fund is to provide for unforeseen things, and that any particular projects should have an account set up and monies budgeted into that account. Amlik VOTE Unanimous The motion carried NEW BUSINESS ACCEPTANCE OF TECHNICAL REPORTS NO 1 AND 2 OF THE PROPOSED GENERAL PLAN Associate Planner Jim Nakagawa introduced the representatives from BRW to present the completed reports regarding "Data Collection and Analysis" and "Goals and Objectives", for the proposed General Plan, and they are seeking an indication from the council whether or not the reports are acceptable. Mr. Rick Tomalchek, representative of BRW, 2700 N Central Avenue, Phoenix, reviewed Report No. 1 "Data Collection and Analysis" with the council. Councilwoman Taylor suggested that a study session be held on the differences of opinion with these reports. Mr. Rich Unger, representative of BRW, reviewed Report No 2, "Goals and Objectives" with the council Councilman Baljo stated that the vast majority of the reports are acceptable, with the exception of the density suggested in the "zone of influence" to the north. Councilman Jimenez MOVED THAT TECHNICAL REPORT NO 1 DATA COLLECTION AND ANALYSIS AND TECHNICAL REPORT NO. 2. �..� GOALS AND OBJECTIVES BE ACCEPTED FROM BRW, INC., AS A PART OF THEIR WORK IN PREPARING A NEW GENERAL PLAN FOR THE CITY, AND DELETE IN THE ITEM OF QUESTION FIVE ACRES TO INDICATE LOW DENSITY. Councilman Baljo seconded the motion. VOTE Unanimous The motion carried. Mayor Hill recessed the meeting Mayor Hill reconvened the meeting. Mayor Hill announced that there were two members of the public wishing to speak on the previous item. Mr Joe Morvak, 5090 E. Roosevelt, Apache Junction, addressed the council in objection to the reports that have been submitted by BRW. Mr. Keith Stachar, 6301 E Roundup, Apache Junction, spoke in objection to the many of the recommendations made by BRW for the proposed General Plan. REGULAR MEETING OF THE CITY COUNCIL JULY 15, 1986 PAGE 5 Az Mayor Hill called for a motion to move Item No 7 to be considered prior to Item No 5 Councilman Jimenez MOVED THAT ITEM NO 7 BE HEARD AND CONSIDERED BEFORE ITEM NO. 5. Councilwoman Gardner seconded the motion VOTE: Unanimous ,..� The motion carried. PROJECT SELECTION FOR 1986 CDBG APPLICATION Director of Planning Chuck Newcomer explained that there are three projects which to be considered for funding by the 1986 Community Development Block Grant Program housing rehabilitation, construction of center for handicapped and other social services, and construction of water line extensions Mr Newcomer further stated that only one project can be selected for submission to CAAG. Ms Jean Perkins, 616 N Cactus, Apache Junction, addressed the council supporting housing rehabilitation and a transportation system for those in need. Councilwoman Taylor suggested that the Transportation Board address the subject of a transportation system Ms Yvonne Swift, 2654 E. Foothill, Apache Junction, requested the selection of the project extending water lines in the areas that require water hauling. Ms Blanche Hardisty, 2130 N. Starr, Apache Junction, also supported extending water lines. Mr Kenneth Rheim, 2181 N Starr, Apache Junction, representing several other members of the public that had to leave the meeting, requested that the CDBG application be submitted for extending water lines, as the water company wants $47,000 to do this, which the residents in this area do not have Councilwoman Gardner asked if the residents of that area needing water lines would qualify for the grant. Mr. Newcomer replied that according to census track numbers, they would not qualify. Mr John Allanson, Executive Director, Community Foundation, outlined a proposal for a center for the handicapped and other social services, for MARC, to be built on the land subleased to the Foundation, dnd requested that this grant application be submitted with this project. Mr. McNulty explained that the project may not be viable, should they not be granted the amount requested Mr. Allanson stated that the cost of construction would be approximately $100,000. Councilwoman Taylor stated that the housing rehabilitation would be a better use of the grant. Councilman Jimenez explained the favorable points of the Foundation project be selected for the CDBG grant. Mr. McNulty stated that there is aproximately $800,000.00 available for grants for 15 entities, and on the basis of the projects, the funding will be granted REGULAR MEETING OF THE CITY COUNCIL JULY 15, 1986 PAGE 6 Councilman Jimenez MOVED THAT THE FOLLOWING PROJECT BE PREPARED FOR THE 1986 APPLICATION CONSTRUCTION OF CENTER FOR HANDICAPPED AND OTHER SOCIAL SERVICES Vice Mayor Bakkedahl seconded the motion. VOTE In Favor: Councilwoman Gardner, Councilman Jimenez, Councilman Baljo, Vice Mayor Bakkedahl, Mayor Hill Opposed. Councilman Eidson, Councilwoman Taylor The motion carried Councilman Eidson suggested that councilmembers meet with Arizona Water Company to check into having water lines entended for the residents of the area in question PROPOSED RESOLUTION NOS 86-26 AND 86-27, LAND AND WATER CONSERVATION FUND GRANT-IN-AID PROGRAM Mr. McNulty explained that in order to complete the Land and Water Conservation Fund Grant applications for the further development of Prospector Park and City Hall Complex Park, these resolutions are necessary. Councilwoman Gardner MOVED THAT RESOLUTION NOS. 86-26, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, APPROVING THE APPLICATION FOR LAND AND WATER CONSERVATION FUNDS FOR CITY HALL COMPLEX PARK IMPROVEMENTS; AND THAT RESOLUTION NO. 86-27, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, APPPROVING THE APPLICATION FOR LAND AND WATER CONSERVATION FUNDS FOR PROSPECTOR PARK DEVELOPMENT, PHASE II, BE APPROVED AND ADOPTED. Councilman Baljo seconded the motion. Councilwoman Taylor stated that the city has budgeted $60,000 as matching funds. VOTE Unanimous The motion carried. PROPOSED RESOLUTION NO. 86-25, AB-86-04, MT. As was discussed previously at the April 2, 1986, Council Study Session, the City is not being reimbursed for performing plan reviews of inspections, in comparison to the Building Division charging a plan review fee for review of plans and inspec- tion of buildings in order to offset costs incurred by the city. Essentially, the same process should be applied to the Engineering Division for similar work. In preparing this ordinance, we have made inspection fee studies comparing other cities fee schedules. These comparisons were provided for your review at the April 2nd study session. We also, at that time, performed fee studies for plan reviews and made comparison checks against recent projects designed and constructed in Apache Junction to our current standards and requirements. Inspections requested from the city for work on weekends and after normal working hours may be performed upon advance payment to the city by the applicant or contrac- tor Fees for overtime inspections are as follows: Weekdays (before/after normal working hours) $15 00 plus 1 1/2 times inspectors hourly wage. Saturdays 25.00 plus 1 1/2 times inspectors hourly wage Sundays 35 00 plus 2 times inspectors hourly wage D. Requests for inspections or plan reviews beyond normal working hours may be performed at the pleasure of the city as a courtesy to the applicant and is not intended to be a mandated service This extra work may be performed by the city predicated on the availability of manpower and the employee's agreement to work accordingly providing their normal job requirements and health are not negatively impacted E. Should the applicant desire the expediting of work beyond the limits and/or capability of the city at the time, arrangements may be made by the city for work to be performed by a consulting firm providing the applicant pays the consultant's fee plus ten (10%) percent to offset city expenses. SECTION V UNAUTHORIZED WORK Any work undertaken prior to securing a permit may be required to be restored to it's original condition prior to granting a permit, or the city may charge a fee not to exceed $500 00 in addition to the normal fee for inspection and examination of the work done, prior to issuance of a permit. All stop work orders shall require that work cease until the Engineering Division determines whether the construction should be restored to it's original condition or grants a permit in accordance with this ordinance SECTION VI EMERGENCY REPAIR This ordinance shall not prevent any person, corporation or political subdivision from maintaining any pipe or utility lawfully on or under any public street, or from making excavation or performing any work as may be necessary for the preserva- tion of life or property when an urgen necessity arises during the hours that the city offices are closed, except that those making emergency use shall apply for a permit within one (1) calendar day after the city offices are again open SECTION VII CONSTRUCTION STANDARDS All work performed in said public roads, streets, alleys or ways shall be done j in accordance with the approved permit, plan, specifications and special provi- sions of the city for such installation The city may require additional work, materials, equipment and devices to properly control traffic, provide access to adjoining property, and maintain other facilities in the area during the time work is being performed ORDINANCE NO 503 PAGE THREE OF FIVE SECTION VIII ASSURANCE OF CONSTRUCTION Prior to issuing a permit, each applicant shall submit to the city an assurance of construction as outlined in the current edition of the city's Development Guide In instances where an applicant is issued numerous small permits through- out the year, he may post a continuing use bond to cover work under more than one permit, however, this continuing bond provision is not intended for use to construct residential and commercial projects The continuing bond shall be of,^ value sufficient to cover all work under construction by the permittee at any time and shall be satisfactory to the city. SECTION IX LIABILITY AND PROPERTY DAMAGE INSURANCE No applicant shall be entitled to a permit under this ordinance unless and until he shall have filed and maintained on file with the city a certificate certifying that he and/or his company or business firm carries public liability and property damage insurance issued by an insurance carrier authorized to do business in the State of Arizona insuring the applicant and the city and it's agents, against loss by reason of injuries to or death of persons, or damages to property arising out of or related to work performed by the applicant, it's agents or employees while performing any work under such permit. Such insurance shall be primary and provide coverage for all liability assumed by the applicant under this section, and shall be provided by any permittee in the following minimum amounts $500,000 00 for death of or injury to any one person in any one accident $1,000,000.00 for death of or injury to more than one person in any one accident $500,000 00 for property damage. Failure by the applicant to provide the city with such a certificate and failure by the city to demand the filing by permittee of such a certificate before such a permit is issued, shall not be deemed to waive permittee's obligation to provide tl the insurance specified herein Such insurance certificate shall remain in effect, and be kept on file with the city, until all work to be performed by the permittee under the permit has been completed. Where an encroachment involves a permanent obstruction, such insurance certificate requirements and other stipulations shall remain in effect until such construction is removed. The insurance certificate shall provide that coverage cannot be cancelled or expire without providing fifteen (15) days written notice to the city of such action and noting the permit number on such written notice No evidence of liability insurance or surety bond shall be required as a condition precedent to the issuance of a permit to a res.es dent owner of a residential property where he proposes to perform construction in front of his own property, or a federal, state, county or municipal agency or political subdivision, or any public service corporation with a net worth of more than one million ($1,000,000) dollars as reflected by it's most current balance sheet The permittee shall be responsible for all liability imposed by law for personal injury or property damage arising out of or related to work performed by the permittee under permit, or arising out of the failure on the permittee's part to perform it's work unde.• the permit If any claim of such liability is made against the city, it's officers, agents, boards or employees, the permittee shall defend, indemnify and hold each of them harmless from such claims including claims alleging the joint negligence of the city, it's officers and employees, and the permittee SECTION X EXEMPTIONS A no-cost permit may be issued to federal, state or county agencies for work in which a contractor is engaged in a city sponsored project. The Clerk-receptionist positions were discussed during the budget process and the departments involved will be able to absorb the increased cost within their budgets. The requested change in the custodial area is to provide supervision. At this time supervision comes from the Director of the Operations Division or his lead man. Because of the other needs of the Division, these individuals are most often away from the complex. This requested change will be a promotion for one of the custodial employees who has proven his ability to perform in the position. It will be a working supervisor position and will not require the hiring of any new people. This is an upgrade. The cost can be absorbed by the division. The design of the private streets serve a twofold purpose of 1 ) discouraging use of the streets by non-residents, and 2) counteracting the effects of urban congestion and monotony while providing the environmental amenities. The private streets will be maintained through a homeowner' s association. �. Perimeter streets will be improved prior to occupancy along with street lights and fire hydrants. Location of the main entrance on a major arterial should serve the needs of the development. Additional entrances have been provided on Warner and Windsong. Sewage will be provided through an agreement with the Pinal County development, Mesa Grande, to the north. Pinal County previously requested that Mesa Grande install a treatment facility of oversize capacity to allow adjoining developments to use it. The use of satellite treatment plants will aid the community in the future as sewer lines to these shared facilities could be converted for a conveyance system for a main treatment plant in the future. As developments occur they will be designed to carry sewage offsite. Mesa Grande will benefit in three ways: 1 . developers connecting into the system will pay for a portion of the facility; 2. developers connecting to the system will provide additional reuse (gray) irrigation water for Mesa Grande recreational uses, and 3. it will reduce the drain of the water table by using "gray" water for irrigation in lieu of purchasing ground water for this purpose which will also be less expensive. Ample open space has been provided around the housing units as well as around the perimeter of the project. Additional recreation facilities have been .�. provided for residents of the development. The guideline provided for a density of 5-10 units per acre would be 15% open space. Parking has been provided in close proximity to the units served with additional landscape areas provided. PLANNING DEPARTMENT COMMENTS AND RECOMMENDATIONS The conceptual plan submitted for this development shows a genuine effort to comply with the intent and purpose of the Planned Development Ordinance. The design of the project is creative and shows attention to the needs of the future residents. One of the items on the agenda tonight is the award of bid for public works equipment based upon a bid previously awarded by Maricopa County. As noted in the memo from the Operations Supervisor, the city can save a considerable amount of money by going with the Maricopa County bid. The city attorney has raised the question as to whether or not the city can legally accept such a bid without a provision to do so in the city code. The code, in its present form, prohibits such a procedure even "'` though a considerable savings could be realized. The city attorney recommends that the council consider an amendment to the code that would permit the acceptance of any bid awarded by the state purchasing office or any other political subdivision of the state. The inspection of their property showed the major problem to be old lumber and wood which has either been stored on or dumped on the property. Mrs. Iverson indicates in her letter that she will have someone remove the lumber from the property, but will need additional time to remove any other violations of Article 9-2 such as weeds or litter. PLANNING DEPARTMENT RECOMMENDATION Set up and sales of model home and establishment of a temporary real estate office to service sales in a subdivision is a typical and appropriate use within a residential subdivison for initial lot and dwelling unit sales. And, this is already being done at the Sunrise RV Resort. The request to sell RV's from this location to the general public for installations outside the park, I feel would be inappropriate, since this is the type of use which would be typically done in our CB-2 or C-4 zoning districts, and there is no location along Broadway Avenue that I would advocate as an appropriate location for an RV sales lot. Granted, their model home display and office is very tasteful , the appearance from Broadway Avenue is attractive and the model units are screened from Broadway Avenue. In reality, if someone were currently to come into their sales office and order a park model to be installed elsewhere in the City, it would be difficult for us to enforce this as a zoning violation. Similarly, it would be difficult for us to prohibit salespersons in a typical subdivision model home display from suggesting that the prospective customer consider another subdivision that the developer has if that particularly subdivision or homes do not meet the customer's preferences. What we can reasonably prohibit, however, is an overt commercial operation which includes signs or other ad- vertising announcing that sales for locations outside a particular development are possible from the location or that the location serves as a general purpose real estate office. In summary, it is my recommendation that the establishment of an RV sales operation within the Sunrise RV Resort would be inappropriate commercial use of the site. The TH base zoning district is a residential district, and the residents within the resort deserve the same level of protection from incompatible commercial uses as do residents of any subdivision. An alter- native available to the applicant would be to establish a sales office in a commercial district. CRN.U1 July 12, 1986 Members of the City Council Apache Junction, AZ Dear Council Members. It has come to our attention that we need to address the council regarding the sale of Park Models from our resort to the general public. We are the owners of Sun- rise RV Resort, 1403 West Broadway, Apache Junction, and manufacturer of National Prebuilt Manufactured Homes. We would like to ask for special permission from the City Council to sell our Park Models to the general Park Model buying public outside of our park Please under- stand we are speaking of new units only. It is not our intention or desire to handle used units such as trade-ins. If we were asked to accept a trade-in, we would simply call a dealer for what is known in the industry as a buy bid and let the dealer have the used unit. Within our park we have installed twenty new Park Models mounted very uniquely at ground level. Of these twenty units we have three set aside as display units and one as a display and sales office as shown in the drawing. If you will check the drawing or come to the park for a visual appraisal you will discover that we do not have ample room for a regular sales lot or space to set used unit. We have invested a tremendous amount of money in the units installed in our park and feel this is very much an asset to the community If you will check our re- sort, you will find one of the cleanest, best cared for resorts in the area. In surveying the area, we find dealers have set display units in most of the RV resorts and are selling units from that location Because of the investment we have in our display models in our resort, we see no need to have a seperate sales lot out of the resort as most of the dealers do. Again, we are only asking for permission or revision of our planned development to llow us to sell our product to our own resort customers and to the general buying public. We would like to have a sign only as large as DOT requires and be able to put some advertising in the newspapaer to attract buyers. In consideration of the mutual covenants contained A herein the parties agree as follows. / 1 SECTION ONE Premises Licensor hereby grants to Licensee the right to use a portion of certain premises located at 1177 N. Idaho Road, Apache Junction, Arizona, for Licensee's exclusive use between the hours of 8-00 o'clock a.m. and 4 00 o'clock p.m., Monday through Friday of each week. Said premises being more specifically described in the diagram attached hereto as Exhibit A, the subject area being outlined by a yellow line. SECTION TWO Term The term of this License Agreement is for three (3) years, beginning , 1986, and terminating on , 1989. SECTION TFREE License Fee Licensee shall pay Licensor the sum of ONE DOLLAR ($1 00) and by other good and valuable consideration as provided for in Section Five herein SECTION FOUR Utilities, Maintenance snd Supplies Licensor shall be responsible for the furnishing of all utilities except for long distance telephone service utilized by the Licensee for which Licensee shall be solely responsible. On a weekly basis, Licensee shall provide general premises janitorial service. Licensee shall provide daily cleaning of the premises Licensor shall maintain and keep the premises in good repair except for damage caused by activities under the direction and control of Licensee for which Licensee shall have repaired at its expense Licensor shall clean after allowing groups to use the facile-y outside normal license hours. Licensor shall spray for insects at least quarterly. SECTION FIVE Use of the Premises The premises are to be used by Licensee for purposes of operating a senior citizens' center to deliver services to the citizens of Apache Junction, Arizona, sixty years of age ®11" or older, and Licensee shall not refuse the use of the premises to said citizens unless such use would conflict with a special program being conducted by Licensee. Licensee shall be permitted, during its use of the premises to allow other groups to use the facility provided such use is not contrary to Licensor's policies and it is not for a money-making purpose. Licensee may also use the premises to provide congregate egiS meal and home delivered meal programs Licensee shall not permit the premises to be used for religious purposes or allow alcoholic beverages to be brought onto the premises. Licensee shall have a responsible person available on the premises at all times during the hours it has exclusive use thereof Licensor shall have the right to use the premises from time to time providing such use is outside the normal licensed hours or if during such licensed hours with the permission of the Licensee. Licensee may ut_lize the premises during times other than specific licensed hours providing Licensee secures Licensor's permission. SECTION SIX Liability Insurance Licensee shall procure and maintain in force at its expense during the term of this license and any extension thereof, public liability insurance for damages to persons or property arising out of accidents occurring on the premises while Licensee has use thereof The minimum amount of coverage for any person injured or for any one accident shall be ONE MILLION DOLLARS ($1,000,000 00) , and there shall not be less than TWENTY-FIVE THOUSAND DOLLARS ($25,000 00) coverage for property damage. SECTION SEVEN Alteration of Premises No changes, modifications or alterations of the premises shall be made by Licensee without the express written consent of Licensor. SECTION EIGHT Furniture and Equipment Both Licensor and Licensee will provide furniture and equipment to be used on the premises and both shall have the right to use the other's furniture and equipment, provided, however, should the same be damaged by either, other than normal wear and tear, the party responsible shall repair the damage Licensor and Licensee shall append to this Lease within thirty (30) days of the execution thereof an inventory detailing the respective property of each. SECTION NINE Termination While termination of this License is not contemplated by the parties, either party shall have t,le right to give notice to the other on or before May 1st of each calendar year of its intent to terminate this Lease on July 1st, which is the beginning of the fiscal year for each of the parties. mf SECTION TEN Notices Notices to the Licensor shall be given to the City Manager at the Apache Junction, Arizona, City Hall, 1001 N. Idaho Road, Apache Junction, Arizona 85220. Notice to the Licensee shall be given to the Director, Pinal-Gila Council for Senior Citizens, Inc., P. O. Box 1129, Florence, Arizona 85232. SECTION ELEVEN Conflict with Federal Regulations Should any provision of this Lease conflict with any Federal Law or regulation governing the use of the premises by Licensor or Licensee, then said provision shall be considered void and an appropriate provision, if necessary, substituted thereof. Other cities in the valley such as Scottsdale, Tempe, Mesa, Chandler, and Gilbert, already have some sort of site plan/design review process in operation. Citizens in Apache Junction have commented previously on the need to protect mountain views, preserve native vegetation, determine the appropriate location for buildings on a site, and to review drawings that will indicate what proposed buildings would look like. Recognizing this, staff had included a requirement in last year's Request for Proposals that a Community Design Element be prepared as a part of the new General Plan. This is the policy development aspect of a community design program. This work by the consultants will cover such areas as: 1. The identification of design problems in the City. 2. The development of design goals and objectives. 3. The development and testing of alternative design solutions and policies. 4. The selectio„ of an effective design policy. 5. The implementation of the design policy by the adoption of a site plan/design review ordinance and other regulations. 6. The role that the community design element will handaApproved by in guiding land development decisions. Any Design Review Board will need to know what design objectives it is seeking to accomplish, which is the work that the consultants, BRW, was hired to do. BRW was also hired to draft. 1. A Site Plan/Design Review Ordinance. 2. A Landscaping Ordinance. ,n\ 3. Manufactured Housing guidelines. These three studies will be used to implement the Community Design Element. The ordinances will set forth standards, procedures, and requirements for development that will be subjected to review. It will also identify the persons or groups such as a Design Review Board that will be making decisions with respect to design. We recommend, therefore, that your Council defer making any decisions with respect to a Design Review Ordinance, a Design Review Board, or a Citizen 's Advisory Committee on Design until the consultants have completed their work. Attached is a preliminary estimate amounting to $71 ,580 from the Pinal County Highway Department outlining costs to be incurred for engineering, materials, labor and equipment. These costs are to be shared equally between the City and the County. Chairman asked the applicant to speak 6 Alan Parry responded, stating he was the representative for thi_ case. He stated their request and answered questions. 7. Chairman there being no one to speak in favor or opposition, he asked for staff's comments and recommendations 8. Mr. Newcomer stated that a DCC meeting had been held and they recom- mended approval with certain stipulations He also added two stipulations given by the Planning Department 9. Conformance to the site plan submitted. 2 Conformance to the rules and regulations of all departments and agencies having jurisdiction 3. Frank Fruhauff stated he is the representative for the case. He stated his request and answered questions 15 Chairman there being no one wishing to speak in favor or opposition he asked for staff's comments and recommendations. 16. Mrs. Reid stated that staff feels that this application meets the criteria discussed such as building height. Staff recommends approval for this request with certain condi- tions to be met 17 Chairman closed this hearing to the public. 18. Davies/Taylor M/S "I move that Conditional Use Permit application SUP-3-86 be approved subject to the following stipulations 1 That approval of this Conditional Use Permit be subject to the approval of the rezoning application. 2. That the use of the existing building be specified for educational purposes and church related activities only 3 That construction occur in conformance with the site plan and elevations as submitted with exception of the relocation of the driveway entrances as required by Section 20.0103 of the Zoning Ordinance. ..o- 4. Chairman asked the applicant if he had any comments specific to the rezoning case that he hadn't expressed for the previous case. 22. Mr. Fruhauff stated there was nothing more he needed to add. 23 Chairman there being no one to speak in favor or opposition, he asked for staff's comments and recommendations. 24. Chairman Made the Call to the Public 4 Keith Stachar addressed the Commission regarding the Lot Split Ordinance He feels that this should be brought back to the P & Z Commission for their input since it has been passed with an amendment that has created a problem with the enactment of that Ordinance. Since it is coming up for reconsideration, he would like to see the P & Z give their input The current Ordinance is quite difi it than when P & Z saw it last. He feels that it should be reconsidered by the Commission, staff, and the public, to come up with a workable solution before it gets to the City Council 5. Chairman asked for Staff to bring up the topics under Information and Reports 6. Mr. Newcomer Brought up the subject of the HUD Mob'', Home issue. 7 Commission discussed what they should do and directed staff to advertise this for a public hearing, in which staff would give their recommendations on how to proceed with the issue. 8 Mr. Newcomer introduced the Section 15 Rezone issue 9. Commission discussed this issue and directed staff to do more invest- tigating before any recommendations can be made and any action taken 10. Mr. Newcomer introduced the Parking Ordinance issue Ikk Ad Ilk 11. Commission discussed this issue and directed staff to come up with recommendations on amendments to the Zoning Ordinance 12. Mrs Reid introduced the R1-16 Zone issue. 13. Commission discussed this issue and directed staff to �\ 1 address the R1-16 Zoning 2 to address the problem of illegal subdivisions and to solve this problem. 14. Mr. Newcomer introduced the Ex-Officio Commission members issue 15 Commission discussed this and directed staff to find out more specifics regarding how many members; how long would they be appointed for, would they be at every meeting or just the meetings that concern their area, etc 16 Mr Newcomer Stated there is a new General Plan newsletter, and there will be a meeting June 27th with staff and BRW to tell which direction they are headed 17 Mrs Davies asked Mr Coleman (Zoning Administrator) regarding how the Commissioners could be of help in noticing zoning violations. 18.
