REGULAR MEETING OF THE CITY COUNCIL SEPTEMBER 16, 1986 PAGE 1 Ink Vice Mayor Bakkedahl seconded the motion. VOTE Unanimous (Councilwoman Taylor abstained on Item No. 3, as was not present at the September 2, 1986 meeting.) The motion carried. CALL TO THE PUBLIC None. CITY MANAGER'S REPORT Acting City Manager Kathleen Connelly announced that Thursday at 7.00 p.m. there will be a Special Work Session pertaining to sewer and water issues, next Tuesday at 7.00 p.m., the Planning and Zoning Commission will hold a public hearing to include the General Plan, Wednesday, September 24th, the Arizona Department of Transportation will hold a public hearing on proposed designs for the intersection of Route 60 and 360(Superstition Freeway), Friday, September 26th, the Grand Opening of the Prospector Park. Director of Public Safety Bill McDaniel introduced Public Information Officer Steve Greb, to give a report on the Community Relations programs. Officer Greb, outlined the various programs sponsored by the Police Department, to include "Students against Drunk Drivers", and block watches. Councilman Jimenez asked about the progress on cleaning up junk cars. Officer Greb explained a "grid" system for officers responsible for junk cars in specific areas PUBLIC HEARINGS APPLICATION FOR PERSON TRANSFER OF SERIES 6 LIQUOR LICENSE, CACTUS CLUB Mr Mackay Ashley, applicant for the Person Transfer, requested approval of the application. Mayor Hill asked if there was anyone /'\ who wished to speak in favor of or in opposition to the application. There being no one wishing to address the Council, Mayor Hill closed the hearing to the public Vice Mayor Bakkedahl MOVED THAT THE APPLICATION FOR A PERSON TRANSFER OF A SERIES 6 LIQUOR LICENSE, SUBMITTED BY MR MACKAY ASHLEY, AGENT FOR CACTUS CLUB LOUNGE, BE RECOMMENDED FOR APPROVAL TO THE STATE DEPARTMENT OF LIQUOR LICENSES AND CONTROL Councilman Baljo seconded the motion. VOTE Unanimous The motion carried. PROPOSED ORDINANCE NO 527, PZ-28-86, ARNOLD Director of Planning Chuck Newcomer explained that this item is scheduled for the October 7, 1986, City Council meeting and will be discussed at that meeting REGULAR MEETING OF THE CITY COUNCIL SEPTEMBER 16, 1986 PAGE 2 �� PROPOSED ORDINANCE NO. 534, PZ-34-86, STACHAR AND CHRISTENSEN ) Mr. Newcomer briefed the Council on the application for rezoning of a .73 acre parcel, located on the northwest corner of the intersection of West Superstition Boulevard and North Ironwood Drive, from CB-1 Local Business Zone to C-2 Local Commercial District, and stated that the Planning and Zoning Commission recommends approval of the request. ,ram Mr. Keith Stachar, 6301 E. Roundup, Apache Junction, explained that this property is under construction as a multi- tenant building, and requested approval. Mayor Hill asked if there was anyone who wished to speak in favor of or in opposition to the application. There being no one wishing to address the Council, Mayor Hill closed the hearing to the public. Councilman Baljo MOVED THAT ORDINANCE NO. 534, BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Councilwoman Gardner seconded the motion. VOTE Unanimous The motion carried. City Clerk Kathleen Connelly read as follows: ORDINANCE NO 534, AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION, ARIZONA, ZONING ORDINANCE BY AMENDING THE ZONING DISTRICT I CLASSIFICATION IN REZONING CASE PZ-34-86 FROM LOCAL BUSINESS ZONE CB-1 TO LOCAL COMMERCIAL DISTRICT C-2, REPEALING ANY CONFLICTING PROVISIONS, AND PROVIDING FOR SEVERABILITY. Councilman Baljo MOVED THAT ORDINANCE NO. 534, AS READ BY THE CITY CLERK, BE APPROVED AND ADOPTED. Vice Mayor Bakkedahl seconded the motion Ark VOTE- Unanimous The motion carried. PROPOSED ORDINANCE NO 539 AND RESOLUTION NO. 86-37, POLICIES, LIBRARY PROGRAM ROOM) Councilwoman Taylor stated that the Library Director requests that this item be postponed until October 21st Councilwoman Gardner MOVED THAT ORDINANCE NO. 539 AND RESOLUTION NO. 86-37, BE POSTPONED UNTIL THE REGULAR CITY COUNCIL MEETING OF OCTOBER 21, 1986. Councilman Baljo seconded the motion. Councilman Jimenez wished to know why this is requested for postponement. PROPOSED ORDINANCE NO. 540, YARD SALES (With the Emergency Clause) ) Councilman Eidson explained that this ordinance amends Chapter 8, Business, of the Apache Junction City Code, pertaining to requirements for a "full-time" yard sale. ,^ 1 Mayor Hill asked if there was anyone who wished to speak in favor of or in opposition to the ordinance There being no one wishing to address the Council, Mayor Hill closed the hearing to the public. Councilwoman Taylor MOVED THAT ORDINANCE NO. 540, BE READ BY TITLE ONLY WITH THE EMERGENCY CLAUSE, AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED Councilman Ba1Jo seconded the motion. VOTE Unanimous The motion carried. Councilwoman Taylor explained that a permanent yard sale is required to obtain a Business License. City Clerk Kathleen Connelly read as follows: ORDINANCE NO. 540, AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE 1 APACHE JUNCTION CITY CODE, CHAPTER 8 BUSINESS, ARTICLE 8-7 YARD SALES, REPEALING ANY CONFLICTING PROVISIONS, PROVIDING FOR SEVERABILITY, AND DECLARING AN EMERGENCY. Councilman Eidson MOVED THAT ORDINANCE NO 540, AS READ BY THE CITY CLERK, BE APPROVED AND ADOPTED. Councilwoman Taylor seconded the motion VOTE: Unanimous The motion carried OLD BUSINESS RECONSIDERATION OF ORDINANCE NO. 329, PZ-31-86, WILSON ) Councilwoman Gardner, having placed this item on the agenda, requested that it be removed from the agenda. REQUEST FOR MAJOR AMENDMENT TO PLANNED DEVELOPMENT, PZ-17-83, SUNRISE R.V. RESORT (Postponed Item) ) Mr. Newcomer stated that this was postponed from August 5th Council meeting, and outlined additional information including that it is possible for ADOT to license an R V dealer with the restriction that the units could be sold for initial installation in the development only REGULAR MEETING OF THE CITY COUNCIL SEPTEMBER 16, 1986 PAGE 4 Mr Randall Deming, 1403 W. Broadway, Apache Junction, submitted a petition signed by residents of Sunrise R V Resort, supporting the sale of units in the development, and addressed the concerns regarding this proposal. Councilman Eidson pointed out that Apache Junction would benefit from the additional sales tax. Mr. Newcomer recommended limiting sales to units for installation within the development only. Councilwoman Taylor asked if an additional business license would be necessary for sales of units as well as lots. Ms Connelly replied that Sunrise currently has a business license for sale and rental of spaces, and a license for the rental and sale of the units to be used within the park itself. City Attorney Alexander explained that once the development is selling units for outside use, it must be zoned Commercial. Ms Connelly explained that the present request would not be appropriate, but there are two options. Mayor Hill MOVED THAT THE MAJOR AMENDMENT TO A PLANNED DEVELOPMENT FOR SUNRISE R.V RESORT, BE POSTPONED FOR A WORK SESSION ON OCTOBER 6, 1986. Councilman Baljo seconded the motion. Councilman Baljo expressed his feeling that it should be postponed as every effort should be made to resolve this problem and assist the applicant. VOTE: In Favor: Councilman Eidson, Councilman Baljo, Mayor Hill Opposed Councilman Jimenez, Councilwoman Taylor, Councilwoman Gardner, Vice Mayor Bakkedahl The motion failed. Councilman Jimenez MOVED THAT THE REQUEST FOR MAJOR AMENDMENT TO PLANNED DEVELOPMENT FOR SUNRISE R.V. RESORT, PZ-17-83, BE DENIED. Councilwoman Gardner seconded the motion. VOTE In Favor Councilwoman Taylor, Councilwoman Gardner, Councilman Jimenez, Vice Mayor Bakkedahl Opposed: Councilman Baljo, Councilman Eidson, Mayor Hill The motion carried APPOINTMENTS TO PERSONNEL REVIEW BOARD ) Ms Connelly explained that at the Special Meeting of August 11, 1986, two appointments were made to the Personnel Review Board, and additional appointments were postponed to allow time to contact the members whose terms had expired in case they wished to be reappointed Ms Connelly further explained that Virginia Seeman wishes to be reappointed, but Lowell Arnold has not responded to messages Councilwoman Taylor MOVED THAT VIRGINIA SEEMAN AND RICHARD OLTMAN BE APPOINTED TO THE PERSONNEL REVIEW BOARD. Mayor Hill reconvened the meeting at 8 40 p m NEW BUSINESS PROPOSED RESOLUTION NO. 86-36,70 CONSIDER AND IF DEEMED APPROPRIATE, TO AUTHORIZE PARTICIPATION IN THE ARIZONA FINANCING PROGRAM Finance Controller Keith Lewis explained that this is a cost-efficient alternative for financing bond issues and/or lease-purchase programs Councilwoman Gardner MOVED THAT RESOLUTION NO. 86-36, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, RELATING TO FINANCE; AUTHORIZING PARTICIPATION IN ARIZONA MUNICIPAL FINANCING PROGRAM AND EXECUTION OF AGREEMENTS AND INSTRUMENTS IN CONNECTION THEREWITH; AND DECLARING AN EMERGENCY, BE APPROVED AND ADOPTED. Councilwoman Taylor seconded the motion. VOTE• Unanimous The motion carried. AWARD OF BIDS FOR STREET STRIPING, FUEL, CRACK SEALANT, PAVING MATERIALS, SAND AND AGGREGATES, BRUSH CHIPPER, POWER SWEEPER AND CHIP SEAL Operations Supervisor Doug Dobson explained that notices were published for bids on the eight items, and a total of 21 bids were received, and made recommendations Councilwoman Gardner MOVED THAT THE BIDS BE AWARDED AS FOLLOWS PW-86-6 STREET STRIPING TO PRECISION STRIPING, PW-86-5, FUEL TO MESA FUEL COMPANY, PW-86-9, CRACK SEALANT TO ROAD MAINTENANCE SUPPLY, PW-86-7, BRUSH CHIPPER TO VERMEER, PW-86-11, SAND AND AGGREGATES TO CASHWAY CONCRETE AND MATERIALS, PW-86-12, PAVING MATERIALS TO UNION ROCK, PW-86-13, STREET SWEEPER TO COPPER STATE, PW-86-14, CHIP SEALING TO NESBITT CONTRACTING Councilman Baljo seconded the motion VOTE: Unanimous The motion carried REGULAR MEETING OF THE CITY COUNCIL SEPTEMBER 16, 1986 PAGE 6 40114 REQUEST TO SOLICIT BIDS FOR APACHE JUNCTION EQUESTRIAN PARK ARCHAELOGICAL INVESTIGATIONS Director of Community Services Jeff Bell requested authorization to solicit for bids for the Apache Junction Equestrian Park Archaelogical Investigations, as staff has been working with Bureau of Land Management preparing detailed specifications for the investigations imak Councilwoman Taylor MOVED THAT AUTHORIZATION BE GIVEN TO THE DIRECTOR OF COMMUNITY SERVICES THROUGH THE ACTING CITY MANAGER TO SOLICIT BIDS FOR THE APACHE JUNCTION EQUESTRIAN PARK ARCHAEOLOGICAL INVESTIGATIONS. Vice Mayor Bakkedahl seconded the motion VOTE. Unanimous The motion carried APPOINTMENTS TO YOUTH ADVISORY BOARD Mr. Bell explained that names were provided to the Council as recommended by the School District, to be appointed to the Youth Advisory Board. Councilwoman Gardner MOVED THAT ILENE LABASH, SOREN SAGGIO, SUSAN DOBSON, ROSS GREVES, MAX RAGSDALE, WENDI MELCHER, STEPHANIE CARTER, MARIE PUCSH, BECKY WINKLE, JASON HUTCHENS, JOY SMITH, AND DON WORKMAN, BE APPOINTED TO THE YOUTH ADVISORY BOARD. Councilman Jimenez seconded the motion. VOTE Unanimous The motion carried. ACCEPTANCE OF RESIGNATION FROM AND APPOINTMENTS TO BOARD OF ADJUSTMENT Councilwoman Gardner MOVED THAT THE RESIGNATION OF MR. SAM GARDOM FROM THE BOARD OF ADJUSTMENT BE ACCEPTED WITH „o., REGRET. FLOOD CONTROL PROJECTS ) Director of Public Works Rich Broman stated that the Flood Control District of Maricopa County is finalizing plans to construct the Apache Junction Flood Retarding Structure and Floodway at the northerly limits of the City, and have made recommendations and requests which require Council approval Mr. Dick MacNamara, Project Manager for the Acquisition Department of the Flood Control District, addressed the Council regarding the proposals REGULAR MEETING OF THE CITY COUNCIL SEPTEMBER 16, 1986 PAGE 7 Councilman Baljo MOVED THAT A PORTION OF THE FEDERALLY PATENTED EASEMENT ON APACHE DRIVE, SOUTH OF LOST DUTCHMAN BOULEVARD, AND A PORTION OF THE FEDERALLY PATENTED EASEMENT ON WINDSONG STREET, WEST OF IDAHO ROAD, BE EXTINGUISHED, PROVIDING THAT THE FLOOD CONTROL DISTRICT OF MARICOPA COUNTY PROVIDES LEGAL DESCRIPTIONS AND PLOT PLANS OF THOSE AREAS OF FEDERALLY PATENTED EASEMENT ABANEDONMENT AND DEDICATIONS OF RIGHTS-OF-WAY FOR CUL-DE-SAC IMPROVEMENTS, TO BE REVIEWED AND APPROVED BY THE CITY'S DEPARTMENT OF PUBLIC WORKS; AND THAT AS THE CITY DOES NOT RETAIN RIGHTS-OF-WAY OR DEDICATED EASEMENTS FROM „oft., THE STATE LAND DEPARTMENT, NO OBJECTION IS EXPRESSED TO THE ABANDONMENT OF BULLDOG MINE ROAD AND THAT IN COOPERATION WITH THE PROPOSED FLOODWAY CONSTRUCTION, THE DEPARTMENT OF PUBLIC WORKS IS DIRECTED TO IMPROVE TOMAHAWK ROAD INITIALLY AS A DIRT ROADWAY IN ORDER TO PROVIDE ACCESS TO STATE ROUTE 88. Councilwoman Gardner seconded the motion VOTE: Unanimous The motion carried. PROPOSED PALM SPRINGS UNIT 6 IMPROVEMENT DISTRICT Mr. Broman outlined the proposal for an improvement district in Unit 6 of Palm Springs, and explained that there are two alternative plans for the Council to choose from Councilman Baljo MOVED THAT AUTHORIZATION BE GIVEN THE DIRECTOR OF PUBLIC WORK THROUGH THE ACTING CITY MANAGER TO CONTACT PROPERTY OWNERS IN THE VICINITY OF PALM SPRINGS UNIT 6 AND AFFECTED AREAS TO DETERMINE INTEREST IN CRATION OF AN IMPROVEMENT DISTRICT Councilwoman Taylor seconded the motion. Councilman Baljo stated that this is the only feasible way to improve the industrial area, which will give incentive for industrial businesses to locate in this area. Mayor Hill announced the Councilman Jimenez became ill and had to leave the meeting. VOTE Unanimous ,oft The motion carried RELOCATION OF PUBLIC WORK FACILITY Mr. Broman explained that the Council had expressed the desire to relocate the Public Works Department, and a parcel of land located south of Baseline Road and west of Royal Palm may be looked upon favorably with application to the State, and requested authorization from the Council to submit an application for a commercial lease to the State. Director of Public Safety Bill McDaniel stated that such buildings will be proposed that will prevent undue noise from Animal Control Councilman Baljo MOVED THAT AUTHORIZATION BE GIVEN THE DIRECTOR OF PUBLIC WORKS, THROUGH THE ACTING CITY MANAGER, TO PERFORM NECESSARY WORK IN ORDER TO FILE A COMMERCIAL LEASE APPLICATION WITH THE STATE LAND DEPARTMENT FOR THE RELOCATION OF THE PUBLIC WORKS MAINTENANCE AND ANIMAL CONTROL FACILITIES. Councilwoman Gardner seconded the motion REGULAR MEETING OF THE CITY COUNCIL SEPTEMBER 16, 1986 PAGE 8 VOTE: Unanimous The motion carried ACCEPTANCE OF RESIGNATION FROM AND APPOINTMENTS TO ECONOMIC OPPORTUNITIES ACTION TEAM Economic Development Specialist John ____ Schoeph explained that there are three vacancies on the Economic Opportunities Action Team, due to resignations, and further stated that there are three Talent Bank applications. Mrs. Davies desires the Council to know that the Commission had incomplete infor- mation so this had to be their choice. Mr. Taylor stated this was one reason this motion was made for C-1 because the representative is not at liberty to say what will be going in there, but she did say they would have to obtain a Special Use Permit. This motion passed 5-2-0 with Mrs. Conway and Mr. Vehon dissenting. The Personnel Office shall be responsible for formally notifying all employees, division heads, and department heads of the existence of this policy The City Manager and the Department Heads are responsible for creating an atmosphere in which sexual harassment is completely out of place, taking immediate and appropriate corrective action in response to any confirmed violation of this policy, and assuring that no reprisals are taken against either those who complain or corroborating witnesses. The Personnel Officer is responsible for auditing the operation of this policy, providing counsel, and resolving any unsettled questions which may arise from this policy. The City Manager/Personnel Officer, or 2. The Department Head When a Department Head receives a complaint of sexual harassment from an employee, the Department Head shall immediately notify the City Manager/Personnel Officer. In the event the accusation of sexual harassment is made against the City Manager by an employee directly supervised by the City Manager the complaint shall be made directly to the City Council who shall be committed to investigating the complaint and taking immediate appropriate corrective action of any confirmed viola- tion. SECTION 4. Reprisal Prohibited: The City of Apache Junction is committed to thoroughly investi- gating each complaint and to taking immediate appropriate corrective action on all confirmed violations of this policy The City Manager/Personnel Officer and the appropriate Department Head are responsible for thoroughly investigating and resolving any complaints. The Community Relations Officer shall prepare programs in crime prevention and community crime trends General programs shall include but not be limited to 1. Stranger Danger The Community Relations Officer will prepare weekly and monthly reports that shall present the efforts, surveys and accomplishments of the unit. Reports will be forwarded to the Chief of Police and the Administrative Services Commander. Any survey conducted by the Community Relations Officer of any home or business location will be classified confidential and will be prepared in one original and one copy with the following distribution: 1. The Training Officer shall make available to all department employees all training set by legal mandate or required by appropriate levels of management to assure effective and efficient performance of present or proposed assignments The responsibility for coordinating all training activity related to all Police Department personnel shall be assigned to the Training Officer. B. The Training Officer's duties shall include, but is not limited to the following 1. Developing and maintaining a master training plan to insure accomplishment of training and objectives 2. Developing a liaison with A.L.E.O.A.0 , area colleges and universities, government agencies, businesses, police departments, and other outside trainers to acquire training materials and information on courses available for external training. Examples of work performed are Amok - Handling of initial arraignments, filing complaints, serving court papers, conducting follow-up for the City Prosecutor and handling pre-trial hearings. - Checking reports written by the Patrol Division on a daily basis. - Being responsible for the Police Department fleet maintenance program and monthly report. - Preparing the monthly patrol activity report. - Acting on reported City Code violations and serving city ordinance documents. - Supervising a squad of officers on a particular shift on an "as needed" basis. - Overseeing the Police Department community service program for adults and juveniles. - Performing other related duties and/or special projects as directed by the Chief of Police 2.12 Cadet Trainee The Cadet Trainee is an individual who is in training at the Police Academy. Because of trainee status a cadet at the Academy is not entitled to overtime compensation under the Fair Labor Standards Act during Police Academy enrollment. 2.13 Identification Technician I The Identification Technician I is directly responsible to the Detective Division Lieutenant for: - Assisting at crime scene investigations for the detection of latent impressions and other evidence. - Taking photographs at crime scenes, photographs of suspects and/or evidence using black and white or color photography. - Examining evidence submitted to the laboratory for latent impressions, striation marks and other evidence to attempt to connect evidence with suspects. - Collecting, classifying, and identifying fingerprints, and conducting fingerprint searches. - Solving problems encountered in the classification, com- parison, search, and filing of fingerprints. 2.16 Communications Supervisor The Communications Supervisor is directly responsible to the Administrative Services Commander for ORDINANCE NO. 541 PAGE 5 of 11 3 - Directing and reviewing the work of Communications Personnel. - Receiving and transmitting communications, instructions, and policy to operations as directed. - Assisting in training of dispatchers, reviewing the work of dispatchers during progress and upon completion, and making written performance evaluations of employees. - Giving instructions on special duties. - Assigning specific work areas within the division. - Assisting in the operation of the communications operation as needed - Making records and maintaining files as required. - Preparing daily work schedules for the communication section to insure the full operation of all communication dispatch equipment CHAPTER 3. PERSONNEL 3.01 Work Hours A. Non-sworn Personnel Non-sworn personnel work an eight (8) hour day exclusive of the lunch time. Emergencies may arise when an employee is not relieved from their responsibilities for a lunch break. All non-sworn personnel, except those classified as exempt, shall have a regularly recurring work period of seven con- secutive days. Any hours worked in excess of forty during the work period shall be compensated at time and one-half the employee's regular hourly rate of pay. Starting and ending hours shall be specified by the Division Bureau or Section Commanders. B. Sworn Personnel: Sworn Personnel, with the exception of detectives, shall have a regularly recurring work period of 28 consecutive days Any hours worked in excess of 171 hours during the 28 day work period shall be compensated at time and one-half the employees regular hourly rate of pay. �► Detectives, except those classified as exempt, shall have a regularly recurring work period of seven consecutive days. Any hours worked in excess of forty during the work period shall be compensated at time and one-half the employee's regular hourly rate of pay. The basic eight hour work day shall be inclusive of the one- half hour lunch period. The Commanders shall make every reasonable effort to insure the lunch period is uninterrupted by recall to work. 3.08 Vacation Leave A. Eligiblity Eligibility to use vacation credits shall begin after completion of one year of employment. However, in special circumstances employees may be granted special authoriza- tion to utilize vacation leave with pay once the employee has been employed by the department for six months. No member shall be permitted to take vacation leave with pay unless he has earned vacation time equal to the amount of leave requested. ORDINANCE NO. 541 PAGE 6 of 11 Aft. Ask 3 C. Accumulation - Maximum: Members may not accumulate vacation in excess of that established by the rules and regulations of the Personnel Policies of the City of Apache Junction. To prevent the loss of accumulated vacation leave, department members are encouraged to review "Personnel Sick-Vacation Report," which reflects an accumulation of leave earned and taken from each individual member. Amok If the requirements of the service are such that employees cannot take part or all of their annual vacation in a par- ticular year, such vacation may be taken during the following calendar year. In cases where employees are unable to use accrued vacation due to departmental workload, an exception may be made with department head and city manager approval. In the event one or more municipal holiday falls within an annual vacation leave, such holidays shall not be charged as vacation leave Employees who have satisfactorily completed twelve (12) months employment and who terminate employment shall be paid in a lump sum for all accrued vacation leave earned prior to the effective date of termination. Employees who terminate prior to twelve (12) months of service shall forfeit paid vacation leave The annual vacation leave policy is as follows: 1 year - 4 years 12 working days 5 years - 9 years 15 working days 10 years - 14 years 18 working days 15 years or more 24 working days 3.20 Classification A. Probationary Period Civilian employees receiving their probationary appointment or status shall serve a six month probation period, sworn officers receiving their probationary appointment or status shall serve a twelve month probationary period This period may be extended, on an individual basis, as the need arises, to insure the employees meet the required standards of per- formance. 3.21 Overtime A. Patrolman Non-exempt patrolmen who work in excess of 171 hours in an established 28 day work period shall be compen- sated with time and one-half the regular hourly rate of pay for all hours in excess of 171. (See City Personnel Policies) Detectives• Non-exempt detectives who work in excess of 40 hours in the established 7 day work period shall be compen- sated with time and one-half the regular hourly rate of pay for all hours worked in excess of forty during the work period. B Civilian Personnel Non-exempt civilian personnel who work in excess of forty (40) hours per seven day work period shall be compensated at time and one-half the regular hourly rate of pay for all hours in excess of 40. (See City Personnel Policies ) C. Justification: Justification for overtime may include, but is not necessarily limited to, any of the following: ORDINANCE NO 541 PAGE 7 of 11 114, - holdover for completion of an assignment which includes the associated paperwork, - mandatory shoot at the range, - court time, - any in-service training, - instruction. The reason for the overtime shall be explained on the request form which shall be submitted within seventy-two (72) hours from when the overtime hours were worked. Failure to comply 01.11., may result in denial of request. The employee's supervisor shall be responsible for the completeness and accuracy of the request. Normally, compensatory time shall be granted within the work period in which it was accrued unless the time given to the employee would hinder the operation of his assignment. In all those cases where compensatory time cannot be given during the work period in which it was accrued (28 day work period for sworn officers [excluding detectives] and the seven day work period for civilian employees and detectives, overtime compensation shall be paid. In all cases, the needs of the department shall be the prime concern. 3.22 Retirement - Arizona State System B. Contributions Both the employer and the employee contribute equal percentage amounts toward employee retirement. The percentage contributed is revised periodically by the retire- ment system. The employee's normal contributions are credited to the indi- vidual account and cumulative interest is credited at the end of each fiscal year. CHAPTER 4. Uniform and Equipment Possession and Wearing of Uniforms 4.11 Jewelry No visible necklaces, ornamental bracelets or anklets shall be worn with the official uniform. Female employees with pierced ears are permitted to wear one small set of stud earrings. All other visible jewelry shall be limited to watches and no more than two rings on each hand. Uniform Regulations 4.15 Authorized Wearing of Uniform E. Face and eye makeup for female employees shall be applied neatly and thinly and will harmonize with hair color and the color of the uniform or plain clothes. Employees engaged in off duty employment shall provide a memorandum through the Chain of Command to the Chief of Police advising of the location of outside employment and a general description of the duties involved. 5.58-2 Prohibition of Off Duty Employment G. An employee engaged in off-duty employment may be required to terminate said employment if the position is found to be in conflict with the best interest of the Apache Junction Police Department. 5.80-1 Portable Roadblock System "Road Fangs" Whenever a police pursuit is taking place within or about to come into the City, the "Road Fangs" may be put into use under the following guidelines: A. B The system will be set up at a place that is least likely to cause injury to officers, bystanders and the fleeing suspect. C. The system will be placed across both lanes of traffic with patrol vehicles parked off the roadway, but at each end of the system. Emergency lights on the patrol vehicles will be activated. D. The supervisor will insure that all normal traffic in the Alift, area is detoured and all onlookers and pedestrians are kept at a safe distance. E. Once the system is set up, the supervisor will see to it that the dispatcher and pursuing and assisting units are aware of the location of the roadblock. The system will not be utilized unless there is adequate time to notify pursuing agencies/units. F. Under no circumstances will the pursuing units allow their vehicles to drive over the roadblock system. G. The supervisor or officer in charge on shift will carry the roadblock system in his vehicles at all times. SECTION II. REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III. During the past several months, it has become obvious that the majority of the communication with the board and other agencies res- ponsible for transportation-related issues comes from the Department of Public Works. The original ordinance establishing the transpor- tation board, however, places much of that responsibility with the City Clerk as recording secretary. At their meeting held on September 16th, members of the transportation board unanimously recommended that the present ordinance be amended to reflect this issue and officially delegate the responsibility to the Department of Public Works. In an additional amendment, they have requested that their meetings be held on an "as necessary" basis rather than mandatory at once per month. I concur with both of these recommendations. During the past several months both the City Clerk 's office and the Department of Public Works have been assisting the board. There has been much duplication of work and yet there is the chance that something might be overlooked when the responsibility is divided in two very different areas. This ordinance has been written with the emergency clause with the intention that an immediate change will not delay any of the activities of the transportation board currently underway. Among the suggested amendments were a change in the maximum height requirement, the consideration of parcels adjacent to Highways 60 and 88 as "commercial " with regard to the sign regulations, and an appeal process involving the city council for special use permits if requested by the applicant. In order for any amendments to take place, the ordinance must first be reviewed by the Planning and Zoning Commission and public hearings held on the proposed changes. If the council still wishes to have A.., the sign code reviewed and possibly amended, a motion requesting the Planning and Zoning Commission to take such action is in order. Upon examination of the qualified bids it is recommended that Arnold's Auto Center be awarded the vehicle bids. Arnold's vehicle price is $12,740.70 minus the 5% bid preferance allowed by Apache Junction City Code, Section 3-7-1 .G for a total of $12,103.66 per vehicle. This cost is $37.33 less than the next closest bidder, Chapman Chevrolet of Tempe. Arnolds also adhered exactly to the bid specification while Chapman Chevrolet listed a number of exceptions, with the most notable being no oil pressure guage, smaller rims and an additional charge to allow for the independent operation and dash mounting of the trunk release. The proposal is entitled "Protecting the Patron's Right to Access Library Materials." The heart of the project is a radio frequency system which operates much like the ones currently installed at the two Mesa Public Libraries and at the Gilbert Public Library. It is safe for use on audio and video cassettes as well as books. Its purpose is to deter unwarranted removal of materials from the library. The results to the patron would include greater accessibility to the library's collections and unhindered access to the audio cassettes. With the system in operation we could unlock the cassette case which now must remain protected. We can apply for the grant without any outlay of local funds for the equipment and supplies we are requesting; however, we have been Am*, informed by the state library's LSCA Coordinator that our request has a better chance of funding if local commitment to the project is demonstrated through the Council's willingness to provide some local funding. Through a readjustment of our budget categories we believe we can commit $1,000.00 to the project without having the Council approve spending of funds not already allocated to the library for fiscal year 1986/87. Of course, as with all LSCA funds, we absorb all costs for staff involved in the project. We believe that the benefits this system will provide in encouraging patrons to follow proper procedures for checking out materials will soon have the system paying for itself through the reduction in book and audio visual loss. A number of libraries have done studies both before and after installation and have proved their effectiveness in reducing the number of missing books. Future costs past the grant period would be maintenance on the system as needed and the purchase of the stickers which activate the unit. The State Advisory Council on Libraries, who make recommendations to the State Librarian as to which grants should be funded, need assurance from the City Council that the program funded will be continued past the grant period. This section also provides any additional information .•4 considered pertinent to the project. Patrons of the Apache Junction Public Library have a right to adequate collections and reasonable ease of accessing the collections. Meeting "two books per capita," the current Minimum Arizona Public Library Standards guideline, can begin to be met through two avenues: increasing book collec- tions and decreasing losses. The City of Apache Junction is working toward increasing the collection by continuing to increase the book budget (from $6,000 in 1983/84 to $30,000 in 1986/87) The problem of decreasing losses can be tackled in two ways. First, circulation can be more accurately controlled through an automated system which systematically produces overdue notices and bills and which tags delinquent patrons so that they are reminded of overdue items they have not returned. The City of Apache Junction has purchased all of the necessary hardware, software, and supplies to implement and maintain Circulation Plus, an automated circulation system. The other method for reducing loss is to deter the unwarranted removal of books and cassette tapes through the use of a security or theft detection system. The library now needs to implement such a system to help ensure our patrons access to the materials they need in a timely manner. As in the phrase "Shoplifters Take Everybody's Money" it is true that "Library Materials Thieves Take Everybody's Books." Our patrons who carefully treat library materials, always check out the books and tapes they take, and return them on time deserve to have everyone else follow these same rules. We know that a theft detection system will not completely eliminate book theft any more than publicity campaigns eliminate shoplifting, but studies done where security systems have been installed show substantial reductions in book loss. (A drop of 7% to 11% in some instances--see appendix A for reports on security systems) We discovered how great a problem book loss was for the Apache Junction Public Library when in September 1985 an inventory was conducted, the first since the library was acquired by the City in February 1982. It showed an unaccounted loss of 2,880 volumes out of a collection of 13,803. These were not books which had been lost in circulation, but were simply "missing." At a dollar value of only $10 per volume, the loss represented is $28,800, nearly our entire book budget for the current year. Needless to say this is an intolerable situation for the public who demand increasing collections but are sustaining an average loss of 823 books per year. When it is observed that only 3,087 books were added to our collection in 1985/86, the magnitude of the problem is even more apparent. If we could stem the tide of losses our efforts toward meeting standards of two books per capita would be enhanced. Of course, book loss is a problci for all public libraries, but our rate ADPTM343 6/20/86 could be higher than most because we have a highly mobile population. Based upon figures prepared by the Economic Development Department of the City of Apache Junction the City population figures rise from 15,699 in summer to 38,880 in winter. When the surrounding area is included those figures are 27,271 in summer and 52,445 in winter. With the seasonal transients come greater exposure of unprotected materials to theft by a mobile usership. When stolen items are re-ordered they are likely to receive more stringent restrictions, further handicapping our innocent patrons. Some materials cannot be replaced. This is especially true of some Arizona materials. This too costs our public who appreciated being able to find local history materials here. Dollars spent on replacements are not then available for new acquisitions for which our users are clamouring. FY 1987 LSCA PROJECT APPLICATION II. Statement of the Problem Describe the situation, environment and other essential factors that require change. It is a statement of the current state of affairs. Patrons are being denied their right to access library material through the unwarranted removal of material by individuals who do not observe the appropriate circulation procedures. After a move into a facility 4 times the size of the previous library, staff are finding it difficult to police the actions of the few who cause in- convenience for the many; therefore, some collections, such as audio cassette tapes, must be locked. Staff must be more cautious about patrons carrying large bags or backpacks, even penalizing innocent patrons by subjecting them to a search of their personal belongings. All ,f this is necessary to curb unaccounted losses in book materials, and yet, we are quite aware that these measures will neither consistently be applied, nor will be as effective as we need them to be. III. Description of Needs This section provides description of the necessary materials/services in order to resolve the problem as stated in Section I. With a radio frequency theft detection system, books and materials would be as protected as possible from unlawful removal by individuals who currently circumvent the appropriate procedures for checking out r► materials. Because both audio and video cassette tapes would need protection, as well as books, a magnetic system would be inappropriate for complete protection of the collection. The result of our study shows that the radio frequency system would be cheaper to install and maintain than the magnetic versions. We would also acquire the appropriate supplies to activate the system. These would then be installed by staff or volunteer assistance where possible. Of course the system would need to be bid and installed. The costs involved with this would be absorbed locally. An impersonal theft detection system causes the burden to fall on the would-be thief, and off the loyal patron. The library user must indeed admit to himself that he is a thief in order to remove a tagged book from the library. He must deface the book by removing the tag, or come into the library prepared to take the necessary measures to interrupt the system. Since most people believe themselves to be honest, it is this psychological factor upon which we are counting to reduce our loss. When it is evident that this measure is being taken to guard everyone's rights, we believe most people will respect the system and abide by the rules. 3 ADPTM343 6/20/86 FY 1987 ^` LSCA PROJECT APPLICATION W. Goals and Objectives As a result of meeting the needs (as stated in III) describe the new or resulting outcome (Goal). Also describe the steps in reaching that goal as objectives. Objectives are usually measurable. GOAL: Eliminate unwarranted removal of library materials from the Apache Junction Public Library. OBJECTIVE: Install a materials theft detection system and have all materials tagged with detection devices by the end of the fourth month of the funding of the grant. OBJECTIVE: Target a 10% reduction in unaccountable lost materials based upon a comparison of the January 1987 inventory with the January 1988 inventory. • OBJECTIVE: Promote the security system to the public as a device which will protect their rights to access materials. This will be conducted through a news release and an informative poster the week the system goes into effect. V. Target Audience Provide specific information about who the project is directed to benefit and/or interest. This information should clearly relate to the problem and the needs as stated in II do III above. The plan to acquire a library security system bene- fits all of the patrons, young and old, of the Apache Junction Public Library. Card holders now number 7,043. Any patron who needs a specific library materials and now finds it "missing" from the shelves would be positively affected by a reduction in materials loss. Any patron who can now be spared a search of personal belongings will be benefitted by this system. Any patron who wishes to use audio cassettes in the library will be spared finding a staff person to unlock the case and be spared having to check out an item for in-library use. The number of people who hold library cards does not entirely reflect the individuals who would be aided by this system. Population of the area we serve is estimated (by the Economic Development Dept. of the City of Apache Junction) to be as high as 52,445 in winter and 38,880 in summer. Others affected by the grant would be persons attempting to interlibrary loan materials from the Apache Junction Public Library. 4 ADPTM343 6/20/86 FY 1987 LSCA PROJECT APPLICATION VI. I thought I would write now before-I get letter number 3. First of all , Checkpoint is COMPLETELY reliable - no false alarms and no "skips or misses. " Now that I will have a computer in the library in addition to video tapes and audio cassettes, I 'm even more pleased I do not have a system using magnetic devices. As you might remember, I was experiencing between an 8 to 10% loss before Checkpoint was installed. In the last three years, the book loss has decreased dramatically - less than 1%. The first year 55 books were stolen, last 36, and this year only 26 books from a collection that has grown from 9,500 to approximately 14,500. This collection has grown, first of all , because very few titles are missing from the shelves, and secondly, because book money buys new titles, not replacements. An interesting phenomena is happening. The books that are "lost and paid" (that is; checked out but not returned by a student and paid for) are decreasing in proportion to the "stolen" books. There were 41 such books last year; this year, 17 books. I don't know whether or not Checkpoint is the reason this is happening, but I 'm delighted with the statistics. Taylor/Vanhoy M/S "I recommend that the Agenda dated September 9, 1986 and the Minutes dated August 26, 1986 be approved as submitted " Motion passed 6-0-0. 3 Chairman asked the Commission, and specifically a member of the IF prevailing side that made the motion to deny SUP-4-86 at the last meeting, to make a motion to rehear this case. 4. Vanhoy/Taylor M/S "I make a motion that we rehear SUP-4-86 " Motion passed 4-2-0 with Mrs. Davies and Mr Jorgensen dissenting. 5. Chairman opened SUP-4-86, and staff having no further briefing he asked the applicant to speak 6. Jeff Keehne stated he is the representative. Stated they are asking for relief from the Sign Code to allow them to get their franchise with Travelodge He believes that this will increase their business and that it will have an impact on other businesses in the community as well. They are willing to clean up all the little, unsightly signs and replace them with the new signs that are required by Travelodge. Stated they are not going to do anything with the highest sign. They are waiting until ADOT finishes realigning that intersection, at which time they will re-do that sign, bringing it down to a lower height They are hoping to acquire rights to the state property to use for another sign Therefore, they are removing the { large sign from this SUP application. They are only concerned at this time with the two entrance signs. 7. Mr Taylor In order for the Commission to consider going against the Ordinance, we must get something on the non-conforming end. The little signs you want to get rid of are mostly conforming anyway We need a substantial give and take on the non-conforming signs. Otherwise if anybody else comes in, the Ordinance might as well be thrown out. We must show a good reason to do it Planning and Zoning Commission Minutes - September 9, 1986 - Page Two The sign that Mr Keehne is talking about not doing anything with now, and later reducing it substantially, could be possibly considered a give on their part on the nonconforming sign if they would agree to stipulate what they'll be doing with it, how low they'll take it, or how much they're going to take away from it Stated he'd be happier to see a much lower sign than the 40 feet 8 Mrs Callahan asked staff that if the P & Z allowed him to have a new 25 foot sign, and now since he's saying they're not going to make a decision about the 40 foot sign until later, is there any way we can hold them to any decision? If they decide not to do anything with it, then are we stuck with the 40 foot sign 9 Mr Newcomer stated that unless they substantially change the sign, then the sign would remain. If they do decide to change it, then they would have to come back to the Commission. 10 Mr Keehne stated that the sign will have to say Travelodge in order to become affiliated with them Therefore, the sign cannotbe left asit is Travelodge g has granted li them a waiver until the intersection is finished, but after that it will have to be changed. 11 Mr Taylor asked staff if the Commission could put a stipulation in this Special Use Permit as to what the height of the 40 foot sign could be whenever they would rebuild it 12 Mr Newcomer stated this was possible, as well as regarding the removal of the other small signs 13. Chairman asked if Travelodge has any alternative signs that would be a little lower? 14 Mr. Keehne the handouts show what Travelodge sent them for this area, and also judging from what others have up in this area, this is the exposure they would like to have for the franchise. 15. Mr. Jorgensen stated it sounds like Travelodge might be flexible with what they are recommending. 16. Mr. Keehne stated that it has not been brought to their attention. 17 Mrs Davies feels that after driving past this property many times, and noting that the tall sign is virtually obscured, she feels that an eight foot sign would work better along with billboards at each end of town. 18 Chairman asked if anyone wished to speak in favor of this applica- tion 19 John Schoeph feels that the City has an opportunity to get a national franchise which represents the potential for increased occupancy which translates into more retail sales activity and broader exposure of the City to the national market. Stated special circumstances regarding this case that should be considered 1 That this property is at a strategic location at the intersection of two major highways, which is near the geographical center of the City, and repre- sents historical significance. 2 The configuration of the property is unusual, distinc- tive, and is a community landmark !1_�! Planning and Zoning Commission Minutes - September 9, 1986 - Page three 3. The property represents an attractive community image at a prominent location which is of general community concern 4. The mix of services provided here is unique as a community center which is an asset. 5. With a national franchise, the property can generate increased sales and sales tax revenue and employmn and promoting the community image. Stated he spoke by phone with a Mr Dan Ponder who is the director of Franchises and Franchise Services for Travelodge He asked Mr. Ponder how they approach working with cities and sign ordinances. They stated that they do desire to work within ordinances, but on the other hand they fully back their local franchisee because of the importance of proper signing This is especially important in going through the transition from a local or independent business to a national chain name During that process, identification is critical It is their policy to seek the best visibility 20. Chairman there being no one to speak in opposition, and staff having no further comments, he asked Mr Keehne if he had anything further to add 21. Mr. Keehne he thinks it's a great asset to the community that we would have the franchise in town 22. Chairman closed this hearing to the public. 23 Mr Taylor feels that the applicant is willing to make a reduction in some of their non-conforming signs. Feels that the past vote should be reconsidered and work with these f people If they're willing to give up something, the City will benefit by getting new signs. 24 Ms. Callahan feels the national franchise knows little about Apache Junction, has not been alerted to the Sign Ordinance, and has not had an opportunity to submit any other type of signs except the 25 foot signs. She would like to see a continuance so they can bring other options that would better fit into the City's Ordinance. 25. Mrs. Davies stated her agreement with above statement 26 Taylor/Callahan M/S "I make a motion to continue this to September 23, 1986 so that they can come up with a definite size design, or the one that's different from the one that they are proposing, because I don't feel the votes are here to get it through the way it is tonight I think a contin- uance would be in the best benefit of the applicant and the Commission Also, that Travelodge submit any alternative signing before the next meeting. Chairman asked the applicant to speak 32 Judith Van Houten responded and noted she was the representative Stated the applicants are not sure of their intent on this property They're deciding whether to hold the property for the future, whether to develop it in the near future, or to sell it. 33. Chairman there being no one wishing to speak in favor or opposition, he asked for staff's recommendations. 34. Mr. Nakagawa Noted that this request does comply with the General Plan designation for the site. However, they would recommend stipulating the dedication of rights-of-way as well as the submittal to the City of a subdivision • plat within one year 35. Chairman closed this hearing to the public. 36 Davies/Taylor M/S "I move that the Commission recommend to the Apache Junction City Council the approval of rezoning case PZ-32-86, an application of Ernest and Bunny Cristall and Larry and Tulane Rollingher for their property described as a matter of public record, requesting rezoning from GR General Rural to CR-3 (MH) Single Family Residence Zone developed under subdivision regulations Any stipulations or recommendations are that- 1. A subdivision plat must be filed with the City within one year or the zoning reverts to General Rural 2. The applicants dedicate the West, South, and East thirty-three feet (33') of the subject property for public roadway and associated purposes along with a twenty foot (20') by twenty foot (20') cutoff at intersections The reasons for this recommendation are 1 That a subdivision plat would set a precedent for upgrading an area that is sure to develop, and this area should develop in an orderly way where the General Plan designates Medium to High Residential Density 2 That the City would be protected should the applicants sell the property for others to develop ! 3 That street improvements and design review are L the main benefits to the City from the subdivision process." Motion passed 5-0-1 with Mr Vehon abstaining. 46 Mr. Newcomer under Information and Reports, he stated there would be a City Council Work Session on the Sign Code, Sep- tember 11, 1986 at 7 p.m. On September 24, 1986 at 7 p m in the City Council Chambers, Tudor Engineering will be holding a public meeting regarding the design of the 6360 intersection on the new Superstition Freeway Also, at the next P & Z meeting, he will have some informa- tion and alternatives on private drives 47 Mr Nakagawa stated that the first public hearing for the General ' L Plan will be held at the September 23, 1986 P & Z Commis- sion meeting There will be another Work Session on the General Plan on October 8, 1986 There will also be a City Council Work Session on water and sewage on September 18 at 7 p.m. Amok Adaft. Planning and Zoning Commission Minutes - September 9, 1986 - Page six 48 Mrs. Davies Under Commission Requests to Staff, she asked if the excerpt from Section 13.0108 of the Zoning Ordinance that is on the back of protest petitions could be copied on the back of the letter to the 300 foot property owners Stated that there are Commissioners who need a copy of the Boards & Commissions Handbook. Requested they get copies regularly of the City Council Aimak Minutes that refer specifically to the P & Z's decisions 49. Mr. Jorgensen asked that Mr. Newcomer see a copy of the contract that requires the signs for SUP-4-86, in order to verify that this is a contractual requirement of this franchise. 50. Mr Taylor noted that he had received a phone call regarding a lot that someone had brought in a 14 foot mobile right behind the house This mobile is hooked up to lights, etc and he knows that this lot was not split. He wanted to bring this to the attention of the proper staff. 51.
