McNulty City Clerk Kathleen Connelly ng Official Charles Coleman DISCUSSION ON CITY BUILDING REQUIREMENTS AND BUILDING PERMIT PROCESSES ) Mayor Hill asked if anyone wished to address the Council in regards to Building requirements and permit processes Mr Andrew Grenya, 1929 S. Vaquero Rd., Apache Junction, addressed the Council with complaints on the permit processes and requirements. Mr. Mel Mulholland, 7570 E. U.S. Highway 60, Apache Junction, read objectives of the Apache Junction Contractor's Association, which included encouraging a better working relationship with the City staff. Several other contractor addressed the Council with complaints and suggestions. Mayor Hill thanked all those present for attending the meeting and expressing their views, and stated that there is a problem which will be looked into and straightened out. Councilman Baljo stated that staff should be allowed some time to look into these matters, and possibly have another meeting in the near future Councilman Jimenez MOVED THAT A SPECIAL MEETING BE HELD ON JUNE 18, 1986, AT 4:00 P.M., IN THE CITY COUNCIL CHAMBERS. McNulty briefed the Council on the proposed 1986-87 budget, and explained that should the Council wish to add to the budget, a subtraction must be made in another area and that there is more than necessary in the Contingency Fund for that purpose, and than the Council may adopt a tentative budget for publication and final adoption at a later date. Mr. McNulty further stated that the City has received a request from the Gerontology Research Foundation for a grant of S25,000, which is actually for the next fiscal year. Mr. Jon Allison explained that the Community Foundation has received three requests for funding, and recommended the Gerontology Research Foundation grant request Mr. John Granillo, 930 E. Desert Avenue, Apache Junction, addressed the Council outlining the purpose of the Gerontology Research Foundation. Ms Virginia Seeman also addressed the Council in regards to the Gerontology Research Foundation. Councilmembers discussed changes in the proposed budget Councilwoman Taylor MOVED THAT THE TENTATIVE BUDGET ADOPTION FOR THE FISCAL YEAR 1986-87, BE POSTPONED UNTIL JUNE 25, 1986, AT 7 00 P.M Councilman Eidson seconded the motion. Several contractors in the community addressed the Council with complaints. Mr Arlie Meyers addressed the Council with questions on building requirements City Manager Michael McNulty replied that any of these questions are answered in the City Development Guide. Vice Mayor Bakkedahl explained the processes a permit goes through including the Public Works Department, Engineering Division, and Building Division, and stated that the misconception that the Building Division is the only department in the process, may be part of the problem. VOTE' In Favor Councilman Baijo, Councilwoman Gardner, Councilman Eidson, Councilwoman Taylor, Vice Mayor Bakkedahl, Mayor Hill Abstained Mayor Hill (on Items No 2, as was not present at meeting) Introduction of Distinguished Visitors and Guests Mayor Hill thanked all those present for attending the meeting. 1 AWARDS, PRESENTATIONS AND COMMUNICATIONS Mr. Phil Goldsberry, Central Arizona Association of Governments, outlined the purpose of CAAG. Ms Trish Georgeoff explained the various programs available through CAAG, including Block Grants. CALL TO THE PUBLIC /11.14, Mr Anthony Zeiber, 1417 E. 17th Avenue, Apache Junction, addressed the Council with a complaint pertaining to the Apache Junction Fire Department, and requested a letter to waive a fire plug required by the Fire Department Councilman Eidson stated that it has been concluded by the Council that an improvement district should be formed in this area, to eventually provide fire hydrants which would eliminate the requirement for a fire plug. City Attorney David Alexander advised Mr. Zeiber that the City has no control over the Fire Department, as they are governed by the Fire Board and the Fire District. t_ CITY MANAGER'S REPORT Acting City Manager/City Clerk Kathleen Connelly read into the record the consensus report from the Apache Junction Growth Conference, held in Wickenburg the previous weekend. PUBLIC HEARINGS REGULAR MEETING OF THE CITY COUNCIL OCTOBER 21, 1986 PAGE 2 PROPOSED ORDINANCE NO 530, AMENDMENT TO CHAPTER 3 ADMINISTRATION OF THE CITY CODE, PERTAINING TO REVISIONS AND ADDITIONS TO THE POLICE POLICIES AND PROCEDURES (With Emergency Clause) Director of Public Safety Bill McDaniel explained that proposed Ordinance No 530 brings the Police Policies in line with the Fair Labor Standards, and defines duties of some of the newer positions and responsibilities, but that no new positions are being created Mayor Hill asked if there was anyone /"ok, who wished to speak in favor of or in opposition to the item. There being no one wishing to address the Council, Mayor Hill closed the hearing to the public Councilman Baljo MOVED THAT ORDINANCE NO. 530, BE READ BY TITLE ONLY WITH THE EMERGENCY CLAUSE, AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED Councilwoman Taylor seconded the motion. PROPOSED ORDINANCE NO. 533, PZ-32-86, CRISTALL AND ROLLINGHER (Postponed Item) Associate Planner/Deputy Director Jim Nakagawa briefed the Council on the request for rezoning of a five acre parcel, located on the north side of Smoketree Street between Cedar and Warner Drive, from GR General Rural to CR-3 (MH) Single Family Residence, and stated that the Planning and Zoning Commission recommends approval of the application Ms Judith Van Houten, 5110 N. 40th Street, Phoenix, addressed the Council requesting approval of the application, and stated that there is not a proposal for development at this time. Mayor Hill asked if there was anyone who wished to speak in favor of or in opposition to the item There being no one wishing to address the Council, Mayor Hill closed the hearing to the public. Vice Mayor Bakkedahl MOVED THAT ORDINANCE NO. 533, AS READ BY THE CITY CLERK, BE APPROVED AND ADOPTED. Councilwoman Gardner seconded the motion. Councilman Baljo amended the motion THAT A SUBDIVISION PLAT NOT BE FILED WITH THE CITY WITHIN TWO YEARS (INSTEAD OF ONE YEAR), OR THE ZONING REVERTS TO GENERAL RURAL Councilman Eidson seconded the amendment to the motion Councilman Baljo explained the reason for the amendment being that as the applicant does not have a present proposal, one year may not be sufficient. Councilwoman Gardner asked if the Council can legally make this type of amendment. City Attorney David Alexander replied that the upon enacting a conditional zoning amendment provisions in the City's amendment procedures, with the general statement that if the zoning classification request is not utilized within a two year period, that the Planning and Zoning Commission may request that it revert back to the original classification, and also that the Council may also stipulate a conditional zoning amendment based upon form of development, which applies in this case. .010\ VOTE (on the amendment to the motion) Unanimous The amendment to the motion carried. VOTE (on the original motion with the amendment): Unanimous The motion carried PROPOSED ORDINANCE NO 539 AND RESOLUTION NO. 86-37, ADOPTION OF AND DECLARING A PUBLIC RECORD, THE POLICIES FOR THE USE OF THE LIBRARY'S PROGRAM ROOM (With the Emergency Clause) Director of Library Pam Loui stated that this the Library Board of Trustees has made recommendations for the Policies for the use of Library's Program Room, and members of the Board are present should the Council wish to ask questions Vice Mayor Bakkedahl clarified that there are two rooms available, the Program Room, and the Community Center meeting room. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 21, 1986 PAGE 4 oink ismk Councilwoman Gardner suggested that the smoking policy be changed to having a designated area, the patio Councilman Eidson asked if this room is available to "private" organizations Ms Loui explained that private organizations have the use of the room in the Community Center Councilwoman Taylor asked if the fee schedule is included in the ordinance. City Attorney David Alexander recommended that a minimal charge be established for every organization, except City departments, and not exempt any group from the fee Acting City Manager/City Clerk Kathleen Connelly suggested a fee of $5 00 per hour for the use of the facility, so that it is uniform Mayor Hill asked if there was anyone who wished to speak in favor of or in opposition to the item There being no one wishing to address the Council, Mayor Hill closed the hearing to the public. Councilwoman Gardner explained that the Council cannot amend this rezoning to a higher use, but can for a lower use, so unless the applicant reapplies for a higher use the request must remain as is. SECTION I IN GENERAL It is necessary in the public interest that all uses of the dedicated right of way, Federally Patented Eaements and other easements for public roads, streets and alleys, by individuals, corporations and political subdivisions be regulated, managed and controlled so that said public areas may be effectively utilitized and maintained for their primary purpose as public ways Persons, corporations, associations, or other political subdivisions shall not, without obtaining a permit, enter upon any public road, Federally Patented Easement or other easement, street, alley or right of way of any public road, street, alley or way not a State highway and within the corporate limits of the City of Apache Junction, for the purpose of performing any construction, reconstruction, removal, repair, maintenance, or any other work, including but not limited to, pavement, curb, driveway, sidewalk, drainage or flood control facilities, grading, oiling, gravelling, or any surfacing of any road, street, alley or way, water, gas, sewer, or other types of pipelines; irrigation and wastewater facilities; utility lines including electric, television, telephone or other power service and communication facilities, structures and signs, whether temporary or permanent, plantings, landscaping, water and or drainage systems and decorative placements; or any of the aforesaid which may overhang the public road, street, alley or way The Engineering Division of the Department of Public Works is hereby authorized to issue such permits in accordance with conditions outlined in the current edition of the City of Apache Junction Development Guide and the schedule of fees indicated herein SECTION II PERMITS All applications for permits shall be in writing on such form as required by the city Applications shall be submitted at least three (3) working days prior to start of construction and shall be accompanied by three (3) approved copies of a drawing, map, diagram, or similar exhibit of a size and sufficient to clearly illustrate the location, dimension, motive, method and purpose of the proposed work. Applicants for such permits may be either an owner or a contractor, however, the work may be performed only by (1) a contractor (2) utility company (3) governmental agency or (4) resident owner of residential property where the property owner proposes to do the work If the improvement to be constructed under the permit is not to become the property of the city and if the applicant is someone other than the owner, the owner shall also sign the permit form indicating that he agrees to the conditions of the permit. Permits shall be issued only to the person, corporation, or political subdivision making application, and therefore may not be assigned to another person, corporation or political subdivision by the permittee. If the permittee assigns his permit to another, the permit shall become void. A permit shall be valid for the time indicated on the permit which shall not exceed twelve (12) months If work is not completed within the allotted time, a new permit must be obtained for such remaining work. If the work, or a portion of the work is not performed after a permit is obtained, the permit shall be cancelled and the unused portion, minus ten (10%) percent for processing of the fee related to inspection costs, may be refunded at the request of the applicant ORDINANCE NO 503 PAGE ONE OF FIVE s L SECTION III INSPECTIONS The city may provide the applicants with inspection services to determine if the improvements constructed are substantially in accordance with the approved plan, special condition, and permit granted. Should the applicant desire the expediting of work beyond the limits and/or capability of the city at the time, arrangements may be made by the city for work to be performed by a consulting firm providing the applicant pays the consultant's fee plus ten (10%) percent to offset city expenses SECTION V UNAUTHORIZED WORK Any work undertaken prior to securing a permit may be required to be restored to it's original condition prior to granting a permit, or the city may charge a fee not to exceed $500 00 in addition to the normal fee for inspection and examination of the work done, prior to issuance of a permit All stop work orders shall require that work cease until the Engineering Division determines whether the construction should be restored to it's original condition or grants a permit in accordance with this ordinance SECTION VI EMERGENCY REPAIR This ordinance shall not prevent any person, corporation or political subdivision from maintaining any pipe or utility lawfully on or under any public street, or from making excavation or performing any work as may be necessary for the preservation of life or property when an urgent necessity arises during the hours that the city offices are closed, except that those making emergency use shall apply for a permit within one (1) calendar day after the city offices are again open SECTION VII CONSTRUCTION STANDARDS All work performed in said public roads, streets, alleys or ways shall be done in accordance with the approved permit, plan, specifications and special provi- sions of the city for such installation The city may require additional work, materials, equipment and devices to properly control traffic, provide access to adjoining property, and maintain other facilities in the area during the time work is being performed ORDINANCE NO 503 PAGE THREE OF FIVE SECTION VIII ASSURANCE OF CONSTRUCTION Prior to issuing a permit, each applicant shall submit to the city an assurance of construction as outlined in the current edition of the city's Development Guide In instances where an applicant is issued numerous small permits through- out the year, he may post a continuing use bond to cover work under more than one permit, however, this continuing bond provision is not intended for use to construct residential and commercial projects The continuing bond shall be of value sufficient to cover all work under construction by the permittee at any time and shall be satisfactory to the city. Ir- SECTION IX LIABILITY AND PROPERTY DAMAGE INSURANCE No applicant shall be entitled to a permit under this ordinance unless and until he shall have filed and maintained on file with the city a certificate certifying that he and/or his company or business firm carries public liability and property damage insurance issued by an insurance carrier authorized to do business in the State of Arizona insuring the applicant and the city and it's agents against loss by reason of injuries to or death of persons, or damages to property arising out of or related to work performed by the applicant, it's agents or employees while performing any work under such permit. Such insurance shall be primary and provide coverage for all liability assumed by the applicant under this section and shall be provided by an permittee in the following minimum amounts• General Liability Bodily Injury and Property Damage: $300,000 each occurrence. $300,000 aggregate Automobile Liability Bodily Injury and Property Damage $300,000 combined Workers Compensation and Employers Liability. $100,000 each accident. $300,000 Disease - Policy limit $100,000 Disease - Each employee The City of Apache Junction may require higher insurance amounts for areas of high risk. Failure by the applicant to provide the city with such a certificate and failure by the city to demand the filing by permittee of such a certificate before such a permit is issued, shall not be deemed to waive permittee's obligation to provide the insurance specified herein. Such insurance certificate shall remain in effect and be kept on file with the city until all work to be performed by the permittee under the permit has been completed. Where an encroachment involves a permanent obstruction, such insurance certificate requirements and othe stipulations shall remain in effect until such construction is removed. The insurance certificate shall provide that coverage cannot be cancelled or expire without providing fifteen (15) days written notice to the city of such action and noting the permit number on such written notice No evidence of liability insurance or surety bond shall be required as a condition precedent to the issuance of a permit to a resident on residential property where he proposes to perform construction in front of his own property, or a federal, state, county or municipal agency or political subdivision, or any public service corporation with a net worth of more than one million ($1,000,000) dollars as reflected by it's most current balance sheet. The permittee shall be responsible for all liability imposed by law for personal injury or property damage arising out of or related to work performed by the permittee under permit, or arising out of the failure on the permittee's part to perform it's work under the permit If any claim of such liability is made against the city, it's officers, agents, boards, or employees, the permittee shall defend, indemnify and hold each of them harmless from such claims including claims alleging the joint negligence of the city, it's officers and employees, and the permittee ORDINANCE NO 503 PAGE FOUR OF FIVE v Arok oink SECTION X EXEMPTIONS A no—cost permit may be issued to federal, state or county agencies for work in which a contractor is engaged in a city sponsored project. NO. 5.,u PAGE TWO PROJECT DESCRIPTION The General Plan designation for this area calls for a local commercial node at the intersection of S. Tomahawk Road and E. Broadway Avenue. Usually this commercial designation extends only to the limits of the property which actually abut the intersection. When the Local Business (CB-1 ) zoning for this site was approved, it was part of a five acre parcel which did abut the intersection. There is an existing DAV Clubhouse on the subject property. The DAV proposes to move its thrift shop from its current location on Apache Trail to this loca- tion. They propose to construct a 50 foot by 80 foot addition to their existing structure to accomodate this thrift shop. At the Planning and Zoning Commission Public Hearing, the applicant indicated his intent to rent a temporary building to place on the subject site until such time as permanent construction is completed. Since that time staff has had further discussion with the applicant to determine the size and nature of this temporary structure. Applicant indicated they intend to use three eight foot by eight foot by forty foot "sea cargo boxes" for the temporary structure. Staff also asked about the status of the building plans and planned construction date. Building plans have not been started nor submitted for approval . Applicant was rather vague about start-up date for construction. They have indicated they have set money aside for the construction of the permanent structure. No retention or offsite improvements have been provided to date. Onsite improve- ments have been limited to a small section of paved parking. Pieces of broken concrete have been used for erosion control in Weekes Wash. The DAV was asked to remove this debris approximately one year ago by the Public Works Department, but this has not been accomplished to date. The following questions regarding development of the subject site were addressed to the Public Works Department. Their response to each question follows the question. Q. Will offsite improvements (curb, gutter, etc. ) be required at the time of the building permit or would they be deferred? A. Off site improvements generally would be required. However, Weekes Wash will in the future require a box culvert for flood control . There- fore, if a written request is received for postponement it will be allowed until such time as other improvements occur. Q. Will onsite retention be required? A. On site retention will be required along with compliance to the Flood Plane Ordinance. Retention capacities should be based on a fully paved lot. These are fairly unsightly and as we discussed, may be altering the flow. Should this material be removed and would the applicant be required to provide a more effective method of control') A. Broken concrete and debris must be removed to insure proper flow. The subject site is located on E. Broadway Avenue, an arterial , which will provide sufficient transportation to and from this commercial site. The reason the applicant has applied for C-2 Local Commercial District is that second-hand sales are not allowed in CB-1 Local Business Zone. The old Commercial classifications were progressive, that is the "lighter" classification allowed a list of uses, then the "heavier" classification would allow all the uses of the "lighter" classification and allowed additional uses. Second-hand sales was listed in CB-2 General Business Zone, but not in CB-1 Local Business Zone, so it was not allowed. Under the proposed zoning classification, C-2, lodge, fraternal and civic assembly is allowed under permitted uses. Alcoholic beverage sales are allowed by Condi- tional Use Permit only in the C-2 district. The Planning Director has no problem with liquor sales continuing as a non-conforming use on this property. The applicant has been asked to address a letter to the City requesting permission to place temporary structures for storage purposes on the subject site. Temporary arrangements such as this should define time limits for the uses and under what circumstances a temporary use can occur. Because temporary uses generally benefit only the applicant/owner it is necessary to impose strict limitations from the onset to avoid involved and costly legal disputes later when the City must have this use discontinued or terminated. PLANNING DEPARTMENT COMMENTS AND RECOMMENDATIONS The staff would recommend approval of the rezoning request stipulating. 1 . Site plan approval prior to commencement of construction. 2. This ordinance proposes a change to the Apache Junction City Code re- garding the manner in which vacancies on the city council are filled. The code currently requires that council vacancies occurring for what- ever reason are filled by appointment of the city council . This proposed change would require that an election be held to fill the vacant seat when more than two years remain in the term of office. Because of possible questions raised by placing such a vacancy on the same ballot as candidates for full terms such as would occur at a regular primary election, a stipulation has been added that any can- didate for the vacant seat would not be eligible to run for one of ,..•. the full terms. This would eliminate the confusion caused by having a person's name appear on the ballot more than once and also elim- inate the possibility of having the same person elected to two seats. Six applications for building permits were recently processed in the area of Desert View Drive between Foothill and Smoketree streets. Lots were deeded as follows: Lot #1: A.E. Sullivan to L. Simmons These locations have been plotted on a portion of the County Assessor's map and highlited for your information. Technically, a subdivision has not been created because the splits were made by three different individuals; however, in reality, the subdivision of land into six 8,140 square foot lots has resulted. Continued lot splitting and development in this manner may result in negative impacts to the city in respect to image, utilities and street eifiN development. You may wish to refer this matter to the City Attorney's office to determine if circumvention of the subdivision regulations has resulted and if appropriate legal action should be considered. You may additionally notice that other splits have occurred and are indicated on a portion of this plan which is typical of information processed through our offices. SUBJECT: RESOLUTION NO. 86-41 -- PURCHASING FROM MEMBERS OF THE CITY COUNCIL The State Legislature, during its last session, amended Arizona Revised Statutes i38-503 pertaining to purchases made by a municipal government from a member of its city council. The law allows a city to purchase supplies, materials or equip- ment from a member of the council without going through the competitive bid process if the amount of a single transaction is less that $300 and the annual total does not exceed $1000. In addition to these dollar limitations , a council which wishes to allow purchases of this kind must annually adopt a policy governing these purchases. Resolution No. 86-41 provides the City Council with such a '� policy. RESOLUTION NO. 86-41 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, PINAL AND MARICOPA COUNTIES, ARIZONA, ADOPTING A POLICY AND PRESCRIBING PROCEDURES FOR PURCHASING FROM THE MAYOR AND ANY MEMBER OF THE CITY COUNCIL. WHEREAS, pursuant to the provisions of Section 38-503, egNArizona Revised Statutes, as +a ended, the City of Apache Junction may authorize, without using competitive public bidding procedures, the purchase of supplies, materials and equipment from the mayor and any member of the council, and WHEREAS, the City of Apache Junction City Council must adopt, on an annual basis, a policy that governs such purchases, NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL of the City of Apache Junction, Pinal and Maricopa Counties, Arizona, that the following policy is adopted and the procedures are prescribed for purchasing supplies, materials and equipment from the mayor and any member of the Apache Junction City Council Section 1 During the fiscal year ending June 30, 1987, the City of Apache Junction may purchase supplies, materials and equipment from the mayor or any member of the city council without using the com- petitive public bidding procedures if the amount of a single transaction does not exceed three hundred dolalrs. The separate, individual total of any transactions in the fiscal year for each member of the council or for the mayor shall not exceed one thousand dollars Section 2. In this resolution, "purchasing agent" means the person authorized by the city council or city manager to act on behalf of the City of Apache Junction when procuring supplies, materials and equip- ment for public use The purchasing agent shall keep separate, up-to-date records of all purchasing transactions with the mayor and each member of the council These records shall be public and shall include the date, amount and nature of each transaction The purchasing agent shall be responsible for ensur- ing that the cost of a single transaction made pursuant to this resolution does not exceed three hundred dollars and that the total of such trans- actions in the fiscal year ending June 30, 1987, with the mayor and each councilmember does not exceed one thousand dollars Any purchasing trans- action with the mayor or member of the city council that exceeds these limits shall only be made by public competitive bidding procedures Section 3 The provisions of this resolution shall be cumu- lative and supplemental to the provisions of the City Code or city ordi- nances governing purchases. The law included a compliance date of July 1 , 1986 , but provisions were also made to allow exemptions on an in- dividual basis as approved by the director of the Department of Library, Archives and Public Records. Earlier this year, an exemption was granted to the city through January 1 , 1987 . It still is not cost effective, however, for the city to begin using letter size paper for all forms and permanent records by January 1st . Many departments still have supplies of legal size forms and the legal size paper used for all original minutes, ordinances, resolutions, etc. This paper in particular is very costly. Based upon the potential cost to the city to make the change to letter size paper for forms and permanent records , I am requesting the council ' s support in my request to the director of the Department of Library, Archives and Public Records for an additional exemption to June 30 , 1987 , to allow all departments to budget appropriately and to use up existing supplies . The attached resolution addressed to the Department of Library, Archives and Public Records makes such a request for an J extension.
