The agreement is for a period of one (1) year with an option to renew automatically and continuously for a total length of the contract not to exceed ten (10) years from the original signing of the agreement. Staff respectfully requests entering into the first amendment between the city and JB Superior Maintenance Services, LLC beginning October 6, 2020 until April 27, 2028. The amendment will cover adding janitorial services to the following Parks and Recreation facilities: 1) Superstition Shadows Park, 1091 W Southern Avenue; 2) Little League Complex, 440 S Ironwood Drive; 3) Flatiron Park, 100 N Apache Trail; 4) Prospector Park, 3015 N Idaho Road; and 5) City Complex West, 1001 N Idaho Road for$65,340 a year. 575 E. Baseline Avenue, Apache Junction, AZ 85219 • Voice (480) 982-1055 • FAX (480) 983-5752 or (480) 982-8005 FIRST AMENDMENT TO JANITORIAL SERVICES AGREEMENT BETWEEN CITY OF APACHE JUNCTION AND JB SUPERIOR MAINTENANCE SERVICES, LLC THIS FIRST AMENDMENT to the above-referenced agreement is made and entered into this day of , 2020, ("the Execution Date") by and between the CITY OF APACHE JUNCTION, ARIZONA, an Arizona municipal corporation ("City") and JB SUPERIOR MAINTENANCE SERVICES, LLC., an Arizona corporation, ("Contractor"), sometimes both collectively referred to as the "Parties", or individually as "Party". RECITALS A. On April 19, 2017, the Parties entered into an agreement for janitorial services as an emergency measure due to the previous vendor's irregular business qualifications and on or around November 1, 2017 the contract term expired. B. In response to Request for Proposals No. PW 2017-35, Contractor was the successful bidder and on April 17, 2018, the Parties entered into a comprehensive janitorial services agreement(the "Agreement"). C. Since that time, there has been an increased need for general cleaning services in Parks and Recreation Department facilities to include restrooms and trash dumpsters, which was not within the initial project description of the Agreement. D. Mutual interest exists to amend the Agreement by adding the Parks and Recreation facilities to the project description. AGREEMENT NOW, THEREFORE, in consideration of mutual promises contained herein and other good and valuable consideration, the receipt and adequacy of which is hereby acknowledged, the Parties agree to amend the Agreement as follows: A. Section 1 of the Agreement, Project Description, shall be amended to add janitorial services at the following Parks and Recreation facilities: 1) Superstition Shadows Park, 1091 W. Southern Avenue; 2) Little League Complex, 440 S. Ironwood Drive; 3) Flatiron Park, 100 N. Apache Trail; 4) Prospector Park, 3015 N. Idaho Road; and 5) City Complex West, 1001 N. Idaho Road, and as more fully detailed in Exhibit A. B. Section 2, Price, shall be modified to include the janitorial services cost for the additional Parks and Recreation facilities as more fully set forth in Exhibit A. C. Section 3, Contract Term, The Term of this Contract shall be a total of ten (10) years from April 17, 2018, unless either Party serves upon the other Party a Notice of Termination no later than sixty (60) calendar days prior to the next succeeding April 17' anniversary date each year this contract is in effect. However, even in such case, the Early Termination provisions and consequences set forth in Sections 15 and 16 still apply. D. Except as expressly amended herein, all other terms and conditions of the Agreement executed by the Parties, shall remain in full force and effect until expiration or termination. I have been a Foreman for a majority of my career. I have a tremendous amount of experience and knowledge of many construction trades and have overseen projects from start to finish. Additionally, being the Chairman of the Superstition Horsemen's Association has allowed me to gain board member skills in directing others and a firm grasp on "Rogers Rules of Order" I am a regular at council meetings and I am "engaged" in the community of Apache Junction. A) Depending on the board they are going to have different roles in which they serve, Both The Library Board and The Parks and Recreation Commission will make recommendations to the city council to include regulations, policies, staff members, and improvements. B) I personally feel that it is important to represent the needs of the people when you are serving in an appointed or elected office, The people are who voted for the council who then appoints the board members. One important thing is that you cant please everyone and at certain times sometimes you might need to make an unpopular decision when you feel it is the right thing to do. I do encourage government officials to listen to the concerns of the people. C) I would say keep it civil and respect their opinions and at the same time you should be able voice your own views and concerns, especially when one board is going to want their project funded over the other boards project. As far as if there was an opportunity to collaborate with another board on something, then I would say that it is best to try to work with them and try to reach an agreement with the members of the other board and with your own board.
