AWARDS, PRESENTATIONS AND COMMUNICATIONS PUBLIC PETITION - FOUR-WAY STOP SIGN ) ) Mayor Seeman called upon Planning Director Gero to brief the Council on this matter. Planning Director Gero reported that his office had received a petition signed by numberous persons located in the vicinity of South Idaho and Broadway, requesting the Council to consider a four-way stop sign at that intersection. This is currently being investigated by City officials and there will be a report submitted to the Council at a future meeting. Councilman Damiano reported that he had traveled the area being petitioned and that it is his feeling that there does exist a safety hazard at that particular intersection. ORDINANCE NO. 20, PERTAINING TO PROSTITUTION, HOUSES OF PROSTITUTION AND RELATED OFFENSES (FIRST READING) ) f ) Mayor Seeman explained that a letter from Mr. Robert M. Dugger, Chairman of the Pinal County Libertarian Committee, was delivered that afternoon, addressed to the City Council. One of the items discussed in the letter is Ordinance No. 20, regarding prostitution. Mayor Seeman asked if anyone from his affiliated party was present and wished to read the letter. There was no response from the audience. Councilman Damiano read the portion of Mr. Dugger's letter referring to Ordinance No. 20. PTayor Seeman called upon the City Clerk to read the title of Ordinance Number 20 for the first reading. City Clerk Ballard read as follows. Ordinance Number 20, an Ordinance of the Common Council of the City of Apache Junction, Arizona Amending Chapter 10, Apache Junction City Code, by Amending Section 10-1-17, Pertaining to Prostitution, Houses of Prostitution, and Related Offenses /"- and Providing for Penalties and Providin? for Severability. ORDINANCE NO. 18, BUSINESS LICENSE (SECOND READING) ) ) Mayor Seeman reported that this is the second reading of Ordinance No. 13. k The Council discussed the reasons for the Business Licensing and the revenues that would be forthcoming and the protection afforded the businesses within the City. Regular Meeting-Jan. 2, 1980 Page 4 Persons expressing their views and asking questions regarding Ordinance No. 18 are as follows: Dan Andrews, 1975 N- LaBarge, not a City resident Bill Ellis, 1670 S. Saguaro, Mesa, Business Manager of the local Greyhound Track C.T. Parks, 1283 S. Cedar, Apache Junction Arthur Strange, 1173 Escondido, Apache Junction The general consensus of their comments were that if they would be charged a business license fee, how much would they be charged and would the Mayor and Council consider charging a lesser quarterly fee. Mayor Seeman reported that the City Council, in their Work Session, reviewed and made comparisons of fee schedules from other cities of comparable size. The general feeling at the Work Session was that the Council should look at this license for six months and see if there has been too much charged, or not enough: we should not make money on it, as it is only a method of control. Councilman Eidson • �. reported that he had talked to some of the local small businessmen and every one of them had felt that the fees were reasonable and would prefer an annual charge, which might help to eliminate some of the vendors who come in to sell on a very short term basis and move on. Councilman Shanks reported that she feels a token $5.00 fee would be adequate for the local businesses and that exceptional fees be imposed upon outside peddlers or undesirable business applications. Councilman Hill pointed out that a business license fee is tax deductable. Vice-Mayor Granillo reported that these fees may be reviewed on a yearly basis and any necessary adjustments can be made. Assistant City Attorney Goodwin reported that, in regard to a General Law City, by Statute the license cannot be for a period of more than one year and it cannot be for less than $10.00 per year nor more than $5,000.00 per year: and these are the only provisions that State Statutes have for General Law Cities on business licenses 1 Vice-Mayor Granillo MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT THE READING OF ORDINANCE NUMBER 18 BE READ BY TITLE ONLY AND THAT THE READING OF THE ENTIRE ORDINANCE BE WAIVED. This completes the review of this proposed annexation to the point that it is now ready for the City Council's consideration of the second reading of the Proposed Ordinance #17. With regard to the question of fire services, it has been determined that the area proposed for the annexation is part of an area covered by contract with Rural Metro for fire services. It was further determined that Rural Metro has a mutual aid agreement with the Apache Junction Township Fire Department, whereby, if requested by Rural Metro for fire fighting assistance, that the Township Fire Department would respond. At a Planning and Zoning Commission meeting held on 1-3-80, the Commission met with Mr. Halbert and discussed the proposed annexation. The Commission voted to recommend to the City Council the proposed annexation. Several other letters submitted by Mr. Halbert are also attached. Should the Mayor and City Council decide to consider this matter tonight, the request for annexation would have to first be removed from the table and, secondly, the Council may take whatever action it deems appropriate. This project may have future implications for possible city growth. Mr. Siegel informed me that two (2) bridges are currently planned being on Meridian and on Ironwood. These are north-south roads. Where the aquaduct will cross Baseline (east-west traffic) no bridges are planned. The location would be between Meridian and Ironwood. This is of concern to me. The Superstition Freeway plans indicate an interchange at Iron- wood. The next westerly interchange will be at Signal Butte. This may mean that traffic which would normally travel Baseline will have to be bypassed on local arterials for miles, including by two Apache Junction schools. In a subsequent conversation with Bernie Minter, Pinal County Highway Engineer, I have learned Pinal County has taken an official position to gain a third bridge on the project within the county. I am suggesting the City of Apache Junction support the County by the attached resolution. Attached is a copy of Mr. Minter's letter on subject and a proposed resolution in support. It is unlawful to offer, agree, attempt to commit, or commit an act of prostitution; C. It is unlawful to solicit or hire another person to commit an act of prostitution; D. It is unlawful to manifest an intent by word, sign or action to commit an act of prostitution; E. It is unlawful for the owner or person having charge or control of any house, building, apartment, room or premises to rent or lease any such house, building, apartment, room or premises to any person to be used as a place of prostitution or to knowlingly permit any such house, building, paartment, room or premises to be used for prostitution or for immoral purposes or practices. The owner or person having charge or control of any house, building, apartment, room or premises shall be and is hereby authorized to summarily remove and eject from such house, building, apartment, room or premises any tenant, subtenant, lessee, or sub- lessee or any person who shall commit any act of prostitution or immoral act or practice or who shall knowingly suffer or permit to be committed any act of prostitution or any immoral act or practice in or about such house, building, apartment, room or premises. F. It is unlawful for any person to use any house, building, apartment, room or premises for prostitution or for any immoral purposes or practices. G. It is unlawful for any person to frequent, loiter in or continue in any house, building, apartment, room or premises used for purposes of prostitution or for any immoral purposes or practices. H. It is unlawful to aid or abet the commission of any of the acts prohibited by this section. I. Penalties Any person found guilty of violating any provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not to exceed $300.00 or imprisonment for a period of not to exceed three (3) months, or by both such fine and imprisonment. Should a lot split be created that had no frontage on a street the person should be able to get a building permit. It is not good planning to have lots without street frontage. With regard to the language on subdivisions the City will hereafter approve all subdivisions and the Board of Adjustment can grant variances to any previous subdivision problems. The definition as written must be corrected to allow the City to be able to have good land controls. In that this definition is confusing and is a daily problem, I recommend passage by the emergency clause. The Planning and Zoning Commission recommended the change. The amendment was to rewrite the fencing requirement for mobile home parks and add a fencing requirement for travel trailer parks. The proposal reads: Section 2001, Subsection (e) (11) : "The mobile home or travel trailer park shall be screened around its periphery except for gates or access ways by a solid wall or fence of not less than five (5') feet, nor more than six (6') feet of height, measured on the fence from outside of the park." Current language provides that only when a mobile home park abuts "adjoining lots" that "a solid fence or wall, or suitable plantings" must be provided. There is not requirements for travel trailer parks. Therefore, any mobile home park on a street is not required to provide such fencing. The Planning and Zoning Commission voted to recommend approval of the amendment and I recommend its approval. My reasoning is the:solid fence would create a separation from outside and inside the park for r lights, air pollution, and sound. He already has fifteen (15) acres adjacent to the subject site which is currently being deveooped and known as Weaver's Needle RV Park. On January 3, 1980, the Planning and Zoning Commission held an advertised public hearing on this request. By a vote of 3- yes, 1 no, 2 abstain, the Couuiiission voted to recommend approval of the requested zone change. A portion of the subject site lies within "Weeks Wash", a desig- nated flood prone area by the Federal Emergency Preparedness Agency. (See attached map.) The subject site is proposed to be added to Weaver's Needle RV Park (having 279 spaces) and would add about 70 spaces. During the Planning and Zoning hearing the staff had not made a survey of the acres vacant by zone for trailer homesite. We have determined there are approximately 117.5 acres within the City limits and over 200 acres outside the City limits but within three miles. Incidently, there is an 80 acre proposed zone change to TH in the County at this time at the proposed Superstition freeway and Ironwood Road. In that the surrounding lots are TH the rezoning would be compatible. Tomahawk road is currently dirt surfaced as is 4th Avenue. The right- of-way on Tomhawk will be adequate when developed for the traffic. City officials will be able to require detailed flood water data of the developer and compliance with such requirements. The current project is proposed to have a 2" water meter off of a 6" water main which would be insufficient for fire protection. Planning Director Recommendation I recommend the denial of this rezoning at this time. There is an over- abundance of TH zoning in the City. In addition, I do not believe areas which are flood prone are suited for TH uses. Through my over- sight the requirement for quorum was not included. Therefore, I am requesting the City Council approve the enclosed change. Two changes are proposed. They are: 1. Changing from four to five voting members the minimum required to constitute a quorum. 2. In the second sentence clarifying the intent by inserting the words "of the quorum voting" after the word "majority." In that the Planning and Zoning Commission must continue it's work I am asking the City Council to pass the amendments with the emergency clause. Mr. Baljo called the meeting to order at 7:05 p.m. and Chairman requested the Executive Secretary call the roll of members. 2. Mr. Gero called the roll and determined that four of the five Exec. Sec. members appointed to the Planning and Zoning Commission were present as indicated above. �� 3. Chairman declared a quorum present. He then turned the meeting over to the Executive Secretary for special business regarding the resignation of the Chairman. tyi 4. Adams/Strickler M/S to accept the resignation of C.T. Parks. The motion passed unanimously by roll-call vote. 5. Exec. Sec. announced that the vote provided for a vacancy as Chairman of the Planning and Zoning Commission. He therefore called for nominations for Chairman of the Planning and Zoning Commission. 6. Hudson/Strickler M/S to nominate George Baljo as Chairman of the Panning and Zoning Commission. to that there was no other nominations , the nominations were closed. The motion passed unanimously by roll-call vote. Mr. Baljo was declared Chairman of the Planning and Zoning monkCommission to finish the current term. 7. Chairman declared by his election as Chairman of Planning and Zoning Commission that a vacancy exists in the office of Vice-Chairman. I 8. Strickler nominated Mr. Strange for Vice-Chairman. There being no other nominations for Vice-Chairman all the nominations were closed for the office. By unanimous vote of those present Mr. Strange was elected Vice-Chairman of the Planning and Zoning Commission. 10. Chairman announced that this was the time and place for the Public Hearing on Planning and Zoning Commission Case PZ-7-79 and asked the Executive Secretary to brief those present as to this particular case. 11. Exec. Sec. indicated that this was Case PZ-7-79, the request of Mr. Schuster to change a parcel of land of approximately 5 acres from General Rural (GR) to Multiple Family Zoning of (CR-5) . The property is located at Scenic and Royal Palm Road. He indicated on a sketch map the location of the subject property. This case was properly advertised on November 14, 1979. 12. Bob Lake represented the applicant, Mr. Schuster, on this particular case. He noted that along Scenic Street that the right-of-way in question has been recorded and oso'mk, on file for the subject property. He indicated that Mr. Schuster is desirous of building Multiple Family Dwelling units on the particular property. He indicated that Mr. Schuster is anxious to begin with this project as soon as possible. He did not have available particulars as to the intentions of Mr. Schuster. 13. Exec. Sec. commented that with regard to this particular case there are a number of concerns: a. Approval of a CR-5 for the particular property would allow up to 109 dwelling units. There is no mention by the applicant nor would there be a requirement should the applicant make mention, as to the number of bedrooms that could be built on the said property. b. The Director of Planning is not sure as to whether or not the future interests of the City could be accomodated by such a high density with such a large number of bedrooms ,ga1 both in terms of carrying_capacity_for the property and in terms of being able to provide for a sewage system in the area. r-- c. Although Scenic Drive can handle the transpor- tation which might be generated by such a ° development the requirements of the Zoning Ordinance at this time, do not provide for regulatory mechanism to insure a quality development in the area. Dec. 11, 1979 Page 3 d. The Director of Planning would like to request the Planning and Zoning Commission to table the section until the Director would have a chance to talk to Mr. Schuster with regard to a possible several month delay to work with Mr. Schuster in developing a planned area development for the 5 acre parcel. The requirements for frontage and the provisions for utility services and fire and police services require the utilization as a practical matter of only those front portion of the parcel. This would not allow the developer the flexibility to develop the entire area. 14. Chairman noting no other comments from the public announced the public hearing was closed. 15. Baljo/Adams M/S to table action on PZ-7-79, the request of Mr. Schuster to the first regular meeting of the Planning and Zoning Commission in January to give Mr. Schuster a full opportunity to present his case under the new guidelines of the City of Apache Junction we will be developing. The motion failed by 2-2 vote. 16. Baljo/Strickler M/S to reopen the public hearing and continue consider- s ion of PZ-7-79 on January 14, 1980. The motion passed unanimously by roll-call vote. 17. Exec. Sec. requested that the Planning Commission initiate a Commission initiative on Section 439 and Section 2001 (e) (11) of the Zoning Ordinance. 18.
