FEBRUARY 20, 1980
A Regular Meeting of the City Council of Apache Junction was held on
February 20, 1980, at the Apache Junction City Hall, pursuant to the notice
as required by law.
CALL TO ORDER
Mayor Virginia Seeman called the meeting to order at 7: 10 P.M. at the
Apache Junction City Hall.

#17, Apache Junction, speaking as a private citizen and chairman of the Pinal
County Libertarian Committee, read a Resolution passed by that Committee as
follows:
.ft. Madame Mayor and Councilmembers:
As chairman of the Pinal County Libertarian Committee I hereby condemn the
actions of the City Council and announce our support for recall movement for
which petitions are now being circulated. The particular reasons for this
declaration are as follows:
1. The continued practice of misleading the public, especially
in the case of denying any knowledge of public opposition to
Ordinance No. 18.

2. The denial of public access to proposed ordinances thereby
making public opposition extremely difficult.
3. The grossly arrogant attitude maintained toward the public
by Councilman Eidson and Councilman Damiano.
4. The practice of publishing ordinances in out of town newspapers,
making it difficult for the public to find out what ordinances
exist and what their contents are.
S. The passage of Ordinance No. 18 in the face of known public
opposition. Councilwoman Shanks cast the only dissenting
vote on this ordinance and for that action she deserves and
receives our commendation.
This declaration is by and for the Pinal County Libertarian Committee and does
not necessarily represent the view of each individual member.

Councilman Eidson responded to the
presentation by saying that he was glad that Mr. Dugger came out with this speech,
because if Mr. Dugger did support him he would ask Mr. Dugger not to.
Councilman Damiano responded that
he also has the same sentiments.
CITY MANAGER'S REPORT )
) City Manager Lee called on the
Director of Public Works, Mr. Broman to give a report on the streets within the
corporate limits, and any other related problems.
Director of Public Works Broman
reported that no highway bridges were closed, no deaths due to flooding, there
were two relocations by the Police Department of people that the flood waters
did approach and actually got into their finished floors.
Mr. Broman further reported on
the condition of the streets explaining the reason for have a lot of pot holes
due to the chip seal treatment of the roads and the roads are not prime condition
roads. Also the raveling of pavement due to the flood waters crossing the streets
and the edge of of the pavement being torn up due to no curbing.
Mr. Broman explained that there
has been a lot of development that is blocking and diverting drainage and this
is going to be a problem in the future. Unsure on how the City will resolve this
problem, he felt that it will take a lot of study just to find out some of the
historicial data on how they were allowed to become as they are and then deter-
mine what measures have to be taken to correct thAm. In the future the City will
have to approach a storm drainage system throughout the City. Structures are
needed in the Weaks Wash area, being it was absolutely impassable, although it
may be a minor inconvience, at this time, the City needs access at all times in
case of emergencies.

Mr. Broman reported that there
are some flood control projects that are in design now and are scheduled for
construction, two to three years away, but once these structures are in place,
they should reduce flooding to the effect that the City would have here. Also
.'► other Cities and Towns are using on-lot-retention, allowing the water to per-
culate. That may be something the City would want to address.
Mr. Broman further reported that
there are two main areas now that are of concern is the Bulldog Wash and the
Weaks Wash,they're being studied by the consultants and are part of this flood
insurance of Apache Junction. Right now that proposal is being held up in the
contract department of the Federal Agency. He recommended to the City Council
and citizens that a letter be written to the Federal Agency stating that Apache
Junction does in fact have a flood problem and a drainage problem and would like
those proposals expedited, so the the City knows how to plan for the future.
Vice-Mayor John Granillo asked if
there is any possibility, in view of the circumstances, that monies would be
available at either the State level or the Federal level for assisting the City
in repairing the streets.
City Manager Lee explained that
the City is pursuing related funding sources for signage, that would help divert
some of the funds to the streets. The City was not declared as part of the
emergency group by the Governor.
City Manager Lee called upon the
Director of Public Safety for his report.
Director of Public Safety McDaniel
reported the only problems the City had were addressed by the Director of Public
Works, and was pleased to report that since Sunday there were only three minor
traffic accidents, and complimented the citizens on their good driving habits.
City Manager Lee added that a
three man Public Works Department had vehicles on stand by and equipment ready
to handle that emergency. Also the Public Works Department saved nine hundred
dollars by constructing barricades in house.
Mayor Seeman complimented the
staff for the ability to respond and being available for twenty-four hours a
day.

Mayor Seeman called upon the the
applicant Ervin E. Wohl, to speak on the behalf of Skagg's Company, Inc.

representing the applicant said he was available to answer questions the City
Council may have.
Councilman Shanks asked why the
applicant has reapplied, as the City Council had acted upon a Skagg's application
several months ago.
City Clerk Ballard brought to the
attention of the City Council on the agent's name Ervin E. Wohl, corporate name
Skagg's Companies, Inc. and the name of the present licensee(s) E. E. Wohl, Agent,
American Stores Company and explained that it is a corporate name change.

) Mayor Seeman opened the Public
Hearing on Ordinance No. 30, Rezoning PZ 10-79, applicant Frank Deane.
Mayor Seeman called on the Plann-
ing Director to brief the City Council and public on this petition.
Planning Director Gero pointed out
on the City map the location of the rezoning request and further explain the zon-
ing of the surrounding area, and the development in that area is already indust-
rial in character for lots that are developed. Also that Tomahawk has access to
Highway 60 and when the freeway is extended to Apache Junction, you would be able
to get onto the freeway from this area and Tomahawk is a section road, and further
commented that the Planning Commission did recommend unanimously for this part-
icular application.
Mr. Frank Deane, 1310 E. 17th Ave-
nue, explained he has been working on this since the first of July, and would
answer questions.
Councilmembers asked Mr. Deane
several questions on the type of business he is anticipating to construct and
how many people he planned on employing.
Mr. Deane answered that he is
planning to have a travel trailer repair shop and he would be working by himself,
but that would depend on the demand of the business.
Mayor Seeman asked if there is any-
one in the audience that wants to speak in favor of the said petition.

ing Director for his recommendation.

Planning Director Gero reported
he concurred with the recommendation of the Planning Commission and would re-
Aol commend to the City Council the passage of the requested rezoning and explained
that in their agenda packet he has given four reasons behind his recommendation.
Mayor Seeman question the continu-
ation of spot zoning. Would the City ever need a Master Plan, and what is the
advantage of having a Master Plan if the City continues to spot rezone?
Planning Director Gero explained
that zoning must be an on-going action of the community, the City can not holdup
zoning, between the time the City took over the zoning powers and the that the
City develops a Master Plan. Second, it will take from the time the City begins
to the time the City completes the Master Plan, approximately two years to com-
plete. The City would not want to hold up people unnecessarily for two years and
futher explained the purpose of the Master Plan.

of Public Works to report on this item.
Director of Public Works Broman
reported that the past history of the electrical bill on the traffic lights and
the fact that the City did not have an agreement with the Arizona Department
of Transportation. He explained the contents of the agreement and informed the
Council what other Cities normally are expected to do on their maintenance agree-
...., ment with the Arizona Department of Transportation.

Planning Director Gero explained
one minor change that was indicated in his memorandum to the City Council that
he had intended to file the A-95 Review by March 1st, and the City is going to
be annroximatelv a month and a half slower, depending upon the ability of State

and Federal agencies to come to some preliminary agreements. He further explain-
ed the reasons for the coordination of the other agencies.

) Councilman Eidson stated that he
would like to make his feelings toward the Libertarian Party clear and would like
to respond to Mr. Dugger's statement earlier in the meeting and would like to say
that any political party that advocates the uncontrolled use of drugs, uncontroll-
ed adult book stores, movie houses, literature, uncontrolled prostition, stating
"It is a part I want to stay away from as much as I possibly can and I hope that
this message is also conveyed to Mr. Saggio." He said he felt that he represented
on these issues about 99% of the people in Apache Junction.
Councilman Damiano stated that he
would like to deny any allegations, made by Robert M. Dugger, Chairman of the
Libertarian Party. Let the people of this City be informed that these false all-
egations and accusations, these statements made by him are nothing but a way in
which expreses his revenge, and all decisions, and ordinances made by the City
Council which do not suit him or his party.

Mayor Seeman read a letter
from the Chamber of Commerce of February 14, 1980, with a Resolution which
reads as follows:
p HONORABLE MAYOR SEEMAN: At a
Regular meeting of the Board of Directors of the Apache Junction Chamber of
Commerce on February 14, 1980, the following resolution was passed:
WHEREAS, the availability of
transportation contributes reatly to the meaningful and orderly growth of a
community, and
WHEREAS, air travel is clearly
of increasing importance in the transportation system of the United States, and
WHEREAS, the Chamber of Commerce
Airport Advisory Committee has pursued a study of aiport feasibility, and
WHEREAS, the development of an
Airport in Apache Junction appears to have considerable merit, and
NOW THEREFORE, BE IT RESOLVED
that the Apache Junction Chamber of Commerce recommends to the City Council the
appointment of a Board of Airport Commissioners to further pursue the develop-
ment of an airport for Apache Junction.

Mayor Seeman explained that there
is an airport committee, but inorder to create a commission we must first pass an
Ordinance. She further explained that an Ordinance to create an Aiport Commission
and an Ordinance to create a Library Board will appear on the agenda at the
next regular meeting. When the Ordinance is in effect, the Council can then
appoint commission members.
Mayor Seeman read a letter from
Ad Hoc Committee member Tom Lester on the Business License committee, requesting a
30 day extension of time, so that the committee could more justly fulfill the
obligation for which it was formed.
Councilman Shanks MOVED THAT THE
AD HOC COMMITTEE ON THE BUSINESS LICENSE STUDY SUBMIT A WRITTEN REPORT OF THE
FIRST 30 DAYS OF ACTIVITIES, AND ON THE COMMITTEE'S SECOND 30 DAY ACTIVITIES,
AND EXTEND THE COMMITTEE AN EXTENSION TIME OF 30 DAYS.
Councilman Hill seconded the
motion.

Mayor Seeman reported on the State
Land and that the City is moving onto 20 acres on the corner of Idaho and Super-
stition Blvd. The address is 1001 North Idaho. The State Land Department
has agreed to a special use permit at a fee of $700 a month, payable in advance
semi-annually.

SUBJECT: Request to withdraw rezoning application
PZ-10-79 and proposed Ordinance ##29.
Attached you will find a memorandum dated February 19, 1980 from
Bob Cosby with regard to proposed Ordinance #29, also known as
rezoning case PZ-10-79, seeking to rezone the NW corner of Toma-
,^ hawk and 4th Avenue. The memorandum states the applicant requests
the withdrawal of consideration of Ordinance #29 and the rezoning.
This office has received a written power-of-attorney for Mr. Bob
Cosby to act in behalf of Mr. Troy Church with regard to this re-
zoning application and such is on file in the Planning Office.
I concur with the request and a motion to permit the withdrawal
would be sufficient to accomplish the request. The staff apprec-
iates the applicant's consideration in working with the City and
would be open to working with them to review suggestions for
alternative uses for the property.

Dear Mayor and City Council:
With regards to my request for rezoning the corner of Tomahawk
and 4th Avenue, also as proposed Ordinance 29, I am respect-
fully requesting this be withdrawn.
We understand the position that the City is in with regards to
Trailer Home Site rezoning and although, we disagree with the
position in principle, we never the less will respect the import-
ance of the issue at this time. We believe that that portion of
the site in the flood prone area most properly should be zoned
to Trailer Home Sites. Upon the approval of the City Council of
the proposed Plan Development Ordinance, we will be submitting an
application for rezoning for a plan compatable with the City's
wishes but which allows us to develop our property to its fullest
extent.

SUBJECT: Library Board
This Department has been directed by the Mayor and Manager to establish
a library board.
Attached is a copy of ARS Section 9-411 to 9-419 for further explanation
of the Public Library.
Public libraries provide a source of reference and information for
students and residents. Also, they serve to enhance the arts and
provide a clean leisure activity for the total community for our
senior citizens.
This Department recommends that a library board be created to
coordinate all aspects necessary to establish and operate a library.

AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA,
AMENDING CHAPTER 2 BY ADDING ARTICLE 2-7 ESTABLISHING A
LIBRARY BOARD PURSUANT TO ARIZONA REVISED STATUTES,
TITLE 9, CHAPTER 4, ARTICLE 2; PROVIDING THE REPEAL OF
CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY.
SECTION 1
ARTICLE 2-7 LIBRARY BOARD
There is hereby established the Apache Junction
Public Library, to be governed by six ( 6) trustees, in
compliance with Section 9-411 to 9-419, Arizona Revised
Statues (1956) , said sections of statutes being adopted by
reference just as if copied fully herein, said City
revserving the right to levy taxes for the support of said
library as provided by law.
SECTION 2 REPEAL OF CONFLICTING ORDINANCES
All ordinances and parts of ordinances in conflict
with the provision of this ordinance or any part of the Code
adopted herein by reference are hereby repealed.
SECTION 3 SEVERABILITY
If any section, subsection, sentence, clause,
phrase or portion of this ordinance or any part of the code
adopted herein by reference, is for any reason held to be
invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions thereof.

§ 9-411. Tax levy for library purposes
A city or town may levy annually, in addition to all other taxes, a
tax not to exceed one and one-half mills on the assessed value of all
property in the city or town, exclusive of the valuation of property
exempt from taxation, for the purpose of establishing and maintain-
ing therein free public libraries and reading looms, for purchasing
books, journals and other publications, and erecting and maintaining
such buildings as may be necessary therefor

I concur with the attached comments by the Department of Public Works
in regard to creating an airport commission. It is not uncommon for
municipalities our size to have a commission of interested local
citizens capable of researching the advantages and disadvantages of
establishing an airport within or without the corporate limits.
Establishing the commission is not a City Council commitment to
construct an airport, only to act as a recommending body to the
City Council on all airport related matters.

SUBJECT: Establishing an Airport Commission
Residents of Apache Junction have initiated actions to investigate
the feasibility of establishing an airport that would serve the local
areas. These actions have been:
1. Coordination with the local Chamber of Commerce,
es 2. Coordination with airport managers and developers,
3. Coordination with State and Federal Aviation agencies, which
includes air space approval for a site located in Section

4. Coordination with airport consultants,
5. Attendance at an Aviation Forecast Seminar,
6. Preparation of a preliminary airport report,
7. Request for city involvement to include:
a. assistance in preparing a preliminary report,
b. approving consultants for obtaining grants and pre-
paring master plan analysis and environmental impact
report,
c. managing, operating and maintaining the facility if and
when it would be approved by the City Council,
d. establishing an airport commission.
This department has reviewed reports, attended an aviation forecast
seminar, met with airport consultants, toured valley airports and dis-
cussed airport feasibility in general.
It is my understanding that a city airport study could be expedited
with grants to include 90% Federal participation and 5% State part-
" icipation. The City would contribute the remaining 5% which would
match the State contribution.

After the study and master plan, if it is determined that the project
enN and site is feasible, further construction engineering plans can be
initiated and funds applied for, with Council approval.
An airport in this community could provide substantial incentive to
industry to locate to this area, which would increase the City's
tax base. It could also provide more convenient transportation to
winter visitors that are becoming more concerned with automobile trans-
portation, s well as satisfythe need of the local pilots.
The establishment of an airport commission can investigate, coordinate
and recommend action for all areas of interest and concern.
I recommend the establishment of an airport commission.

The Chamber of Commerce Airport Advisory Committee respectfully requests
the Mayor and City Council to appoint an Airport Board or Commission to
assist in the development of a municipal airport for the City of Apache
Junction.
The proposed Board or Commission could handle these responsibilities.
1. Develop and recommend to the Mayor and City Council a
Master Plan for a municipal airport.
2. Recommend to the Mayor and Ctty Council additions, deletions
or modifications to a master security plan airport operations
manual and airport ordiances.
3. Review airport contracts, leases, and recommend changes there zo
as directed by the Mayor and City Council.
4. Review rates for tie downs, hangers, fuel etc., as well as
recommend changes there to.
5. Assist the city management staff and other planning agencies
in preparing for a comprehensive airport improvement plan.
6. Establish and review aircraft noise and clear zone standards.
7. Advise the Mayor and City Council on plans of airport concern
involving other city plans and functions which may encroach
upon or limit the full utilization of the airport.
8. Hear complaints of pilots or other citizens using airport
facilities and recommend any adjustment to the Mayor and City
Council.
9. Recommend to the Mayor and City Council any safety precautions

Section 2-9-1 Creation
An Airport Commission of the City of Apache
Junction, Arizona is hereby created.
Section 2-9-2 Membership and Terms of Office
A. The Airport Commission shall consist of five
(5) members who shall be appointed by the Mayor and approved
by the City Council . Ex officio members, without voting
privileges , may be designated by the Mayor with approval of
the City Council . At least one ex officio member may be
designated from outside the City limits of the municipality.
B. The appointments shall be for three (3) years
each with the terms of members so staggered that the terms
of no more than two (2) members shall expire in any one
year. The initial appointments of members shall be for two
(2 ) members with terms beginning upon their appointment and
expiring March 1, 1981, two (2) members with terms beginning
upon their appointment and expiring March 1 , 1982 ; one (1 )
member with a one year term beginning upon his appointment
and expiring March 1 , 1983. Thereafter, they shall all
serve for a term of three (3 ) years or until their
successors are duly appointed and qualified . Honorary
members shall serve for a term not to exceed one (1 ) year.
C. All members shall be residents of the City of
Apache Junction except as otherwise provided for ex officio
members.
Section 2-9-3 Salaries and Personal Expenses
The members of the City of Apache Junction Airport
Commission shall receive no salaries or other remuneration
for their services in such capacity, and shall not be
entitled to personal expenses incurred by them in the
discharge of their official duties, except to the extent and
purposes and amount such expense is first authorized and
approved in advance by Common Council .
Section 2-9-4 Officers
The Commission shall elect a Chairman,
Vice-Chairman, and Secretary from its members to serve for a
period of one ( 1 ) year. The Vice-Chairman shall preside at
meetings in the absence of the Chairman.
Section 2-9-5 Rules of Procedure; Power and Duties
There is hereby vested in the City of Apache
Junction Airport Commission full power and authority for,
and on behalf of the City of Apache Junction, Arizona, to
represent said City in any and all negotiations with
individuals, corporations, associations, Governmental
agencies, etc. , for the development and promotion of
commerce by air in the Counties of Pinal and Maricopa and
especially the City of Apache Junction, Arizona. The
Director of Public Works shall review all the Commission 's
recommendations and shall submit his recommendations to the

Council . No contracts or other commitments shall be deemed
to have been entered into or made, except in compliance with
the provisions of Article 3-7 of this Code.
Section 2-9-6 Meetings
The Commission shall establish a regular meeting
day and time at least once a month. Special meetings may be
called as required. A quorum shall consist of four (4)
voting members for the transaction of all business.
Section 2-9-7 Vacancies
Vacancies shall be filled in accordance with
Section 2-9-2 by the City Council for the unexpired term of
the member affected.
Section 2-9-8 Removal of Members
Members of the Commission serve at the pleasure of
the Council and may be removed by the Mayor with the
concurrence of the Council . A member shall not be absent
from the Airport Commission's meetings for more than three
(3 ) consecutive times. After the absence of three ( 3 )
consecutive meetings , the remaining members of the Airport
Commission shall vote to retain or recommend to the City
Council that the absentee member be relieved of his duties
on the Commission.
SECTION 2 REPEAL OF CONFLICTING ORDINANCES
All ordinances and parts of ordinances in conflict
with the provision of this ordinance or any part of the' Code
adopted herein by reference are hereby repealed.
SECTION 3 SEVERABILITY
If any section, subsection, sentence, clause,
phrase or portion of this ordinance or any part of the code
adopted herein by reference, is for any reason held to be

invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions thereof.

A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION SUPPORTING THE TIMELY EXTENSION OF THE SUPERSTITION
FREEWAY.
WHEREAS the City of Apache Junction is the most rapidly
growing community in the State of Arizona; and
WHEREAS the City is located in the eastern most section of
the greater Phoneix urban area; and
WHEREAS, when complete, the Superstition Freeway will be the
major east-west transportation artery for the greater Phoenix areas and
surrounding areas; and
WHEREAS said freeway is intended to reduce the threats to
the public health, safety and welfare caused by traffic congestion by
routing through traffic away from local City streets and onto said
freeway, and
WHEREAS the City of Apache Junction intends in the near future
to actively promote industrial and commercial development in order that
it can become a self-sustained community, and
WHEREAS industrial and commercial development will require an
efficient and effective transportation system of which the said Superstition
Freeway would be an integral and important part;
NOW, THEREFORE, BE IT RESOLVED that the City of Apache Junction
does hereby support the timely extension of the Superstition Freeway through
to its terminus with U. S. Highways 80, 70, and 89; and
BE IT FURTHER RESOLVED that the City of Apache Junction does
urge the Governor of the State of Arizona, the Arizona Commissioner of
Highways, the Arizona Congressional delegation and the Arizona State
Legislators, to actively support the timely extension of said Freeway.

SUBJECT: Street Classification Plan, Street Dedication and
Improvements, Standard Details and Specifications
A plan is needed to classifiy streets to provide and promote a
safe and efficient transportation system This plan will be used
in conjunction with development and preparation of the City's
General Plan This Department has discussed and reviewed this plan
with the Director of Planning and the City Attorney.
Standard procedure in valley cities is that developers will dedicate
and improve rights-of-way The City of Apache Junction cannot afford
to develop all streets within the City. Taxpayers not using these
facilities should not be expected to incur these costs, as improve-
ments benefit a particular owner, by increasing his property valuation
This Ordinance provides for dedicating and improving rights-of-way
prior to issuing building permits. It is realized that this proced-
ure may not be equitable for individual lot development for single
family construction. Therefore, a provision is made that would
allow waiver of the improvements if the owner enters into an agree-
ment to participate in a street improvement district. With this por-
tion of the Ordinance, the City will be in conformance with other
City procedures and will also provide for individual construction.
For some time governmental agencies have been attempting to stand-
ardize public works standard details and specifications In January
the Maricopa Association of Governments (M.A.G.) has published a new
PIN set of standard details and specifications that may soon be adopted
by the City of Phoenix, Mesa and the Maricopa County Highway Depart-
ment. No doubt other cities in Maricopa County will also follow
this lead in the near future. In the past, communities outside
Maricopa County hake also adopted details and specifications dev-
eloped in Maricopa County communities. This is further confirmed
by the Pinal County Engineer who stated Pinal County is presently
considering adoption of the new M A G standards and specifications.

This Department has reviewed the M.A G Standard Details and Specifi-
cations and finds said documents to be progressive, clear and com-
plete. Development of independent standards and specifications for
Apache Junction would be costly and time consuming This could lead
to inconsistency and confusion as new areas are annexed and could
create confusion to developers, consultants and contractors.
The street classification plan, provisions for street dedication
and improvement, uniform standard details and specifications are
essential to planning and development within the City.

AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF APACHE
JUNCTION+, ARIZONA, AMENDING CHAPTER 13, ARTICLE 13-2,
APACHE JUNCTION CITY CODE, BY ADDING SECTION 13-2-3
PERTAINING TO STREET IMPROVEMENTS, THE ADOPTION OF A
STREET CLASSIFICATION PLAN, REQUIRING THE DEDICATION AND
IMPROVEMENT OF RIGHTS-OF-WAY PRIOR TO THE ISSUANCE OF
BUILDING PERMITS, PROVIDING FOR THE ADOPTION BY
REFERENCE OF THE MARICOPA ASSOCIATION OF GOVERNMENTS
STANDARD DETAILS AND SPECIFICATIONS, PROVIDING FOR
PENALTIES, PROVIDING FOR SEVERABILITY, PROVIDING FOR THE
REPEAL OF CONFLICTING ORDINANCES.
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF
THE CITY OF APACHE JUNCTION, ARIZONA AS FOLLOWS:
Section I In General
Section 13-2-3 Street Improvements
A. A "Street Classification Plan" is hereby
adopted in a manner and form annexed hereto and made a part
of this Article by reference, said plan to be kept on file
in the office of the City Clerk.
B. It shall be a condition precedent to the
issuance of a building permit for new construction within
the City that the required street right-of-way dedications
and improvements be made as set forth in the street
classification plan of the City of Apache Junction.
C. The Director of Public Works may waive the
required improvements for individual single family
construction prior to the issuance of a building permit
provided that the applicant enters into an agreement to
participate in an improvement district for the purpose of
street improvements.
D. All street improvements shall be constructed in
accordance with the Maricopa Association of Government
Standard Details and Specifications, 1979 edition which
standard details and specifications shall be the standards
f1 of design and construction for the City, provided however,
that the Director of Public Works may revise, delete or add
emN standard details and specifications by supplement and
addendum as may be required.
Section II Penalties
Any person found guilty of violating any provisions
of this ordinance shall be guilty of a misdemeanor, and upon
conviction thereof shall be punished by a fine not to exceed
$300 or imprisonment for a period of not to exceed three
months, or by both such fine and imprisonment. Each day
that a violation continues shall be a separate offense
punishable as hereinabove described.
Section III Repeal of Conflicting Ordinances
All ordinances and parts of ordinances in conflict
with the provisions of this ordinance or any part of the
Code adopted herein by reference are hereby repealed.
Section IV Severability
If any section, subsection, sentence, clause,
phrase or portion of this ordinance or any part of the Code
adopted herein by reference is for any reason held to be
invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions thereof.

For some time the Councilmen, City Manager and City Clerk have
been co-ordinating to develop recreational programs and appling
for recreational grants. Now this department will be co-ordin-
ating these community services.
This department recommends the creation of a Parks and Recreation
Commission, to assist in all phases of planning, developing and
administrating recreational programs.

Section 2-8-1 CREATION
A Parks and Recreation Commission of the City of
Apache Junction is hereby created.
Section 2-8-2 MEMBERSHIP AND TERMS OF OFFICE
A. The Parks and Recreation Commission shall
consist of nine (9 ) members who shall be appointed by the
Mayor and approved by the City Council . Ex Officio members,
without voting privileges , may be designated by the Mayor
with the approval of the City Council .
B. The initial appointments of members shall be
as follows : three ( 3) members with terms beginning upon
their appointment and expiring April 1, 1981 , three ( 3 )
members with terms beginning upon their appointment and
expiring April 1, 1982, three ( 3 ) members with terms
beginning upon their appointment and expiring April 1, 1983.
Thereafter, Commission members shall all serve for a term of
three ( 3 ) years or until their successors are duly appointed
and qualified, and terms of members shall be so staggered
that the terms of no more than three ( 3 ) members shall
/'*. expire in any one year. Ex Officio members shall serve for
a term not to exceed one (1 ) year.
C. All members shall be residents of the City of
Apache Junction.
Section 2-8-3 SALARIES AND PERSONAL EXPENSES
The members of the Parks and Recreation Commission
shall receive no salaries or other remuneration for their
services in such capacity, and shall not be entitled to
personal expenses incurred by them in the discharge of their
official duties, except to the extent and purposes and
amount such expense is first authorized and approved in
advance by the City Council.
Section 2-8-4 OFFICERS
The Commission shall elect a Chairman, Vice
Chairman and Secretary from their members to serve for a
period of one ( 1 ) year. The Vice Chairman shall preside at
meetings in the absence of the Chairman.
Section 2-8-5 MEETINGS
The Commission shall establish a regular meeting
day and time at least once a month. Special meetings may be
called as required. A quorum shall consist of five ( 5 )
voting members for the transaction of all business.
Section 2-8-6 VACANCIES
Vacancies shall be filled by the City Council in
accordance to Section 2-8-2 for the unexpired term of the
member affected.
Section 2-8-7 REMOVAL OF MEMBERS
.•. Members of the Commission serve at the pleasure of
the Council and may be removed by the Mayor with the
concurrence of the Council. A member shall not be absent
from Parkland Recreation Commission regular meetings for
more than three (3) consecutive times without a reasonable
excuse. After the absence of three ( 3 ) consecutive meetings
the remaining members of the Parksand Recreation Commission
shall vote to retain or recommend to the City Council that
the absentee member be relieved of his duties on the
Commission.
Section 2-8-8 DUTIES
The Commission through the Director of Public Works
shall recommend regulations and policy for the government,
control and improvement of the public parks of the City of
Apache Junction. The Commission shall also recommend fees
for the use of public park facilities and recommend full
time or seasonal employees as necessary for the efficient
management of the City Parks and Recreation Program.
SECTION 2 Repeal of Conflicting Ordinances
All ordinances and parts of ordinances in conflict
with the provisions of this ordinance or any part of the
Code adopted herein by reference are hereby repealed.
SECTION 3 Severability

SUBJECT: Resignations of Planning and Zoning Commission members
I have recently received letters of resignation from the Planning
Commission from Mr. Theron Adams and Mr Arthur Strange. These
letters are attached and are self-explanatory I wish to commend
them for their period of service and for the time that they have so
willingly dedicated to help Apache Junction get started.
Mr. Adams and Mr. Strange's term of office are scheduled to expire
6-30-82. I have requested that an advertisement be made for persons
who wish to be considered for appointment to the Planning Commission.
I am asking that the following motion of the Apache Junction City
Council be made'
"I move that the requested resignations of Mr. Theron D.
Adams and Mr Arthur L. Strange from the Planning and Zoning Comm-
