AWARDS, PRESENTATIONS, AND COMMUNICATIONS ) Mayor Seeman reported that she attended an Apache Junction Republican Women's Meeting at which time the 1 Republican Women presented her with a check in the amount of fifty dollars ($50.00) for the City's swimming pool fund. CALL TO THE PUBLIC (PETITIONS) _) City Clerk Ballard announced that a petition was received today by the Arizona Libertarian Party with twenty- three signatures and the title read as follows. We, the undersigned, though not necessarily agreeing with all views of the Libertarian Party, do hereby affirm our support of Robert M. Dugger in his opposition to the City Council of Apache Junction. George A. Ba1Jo, 1070 Navajo Avenue, Apache Junction announced, as part of Mayor Seeman's and Council- man Damiano's on going program of community education, with particular emphasis toward the Planning and Zoning Advisory Committee and Planning and Zoning Com- mission, that next Tuesday at 7:00 P.M. , March 11, 1980, there will be a speaker Mr. Ernie Ned, Assistant Commissioner for sub-divisions for the State of Ariz- " ona, Real Estate Department. The Public is invited. The Commission will change their method of presentation, starting April , Saturday 26th, the Commission will have a day time session. Also Saturday, May 17th will be a day time session. Joe Morvak, 1224 S. Doran, Mesa, Arizona had two questions (1) regarding the plumbing code on the 3" stack and where the City stands on the revision of the code. (2) The 2% City Business Tax that is showing up on water bills? Mayor Seeman explained that the utility tax was part of the business license ordinance and asked if the City Manager wished to comment. CITY COUNCIL MINUTFS RP.ULAR !'EFTIr'r. 3/5/^O Page 3 City Manager Lee added that the 2% utility tax is in lieu of a franchise tax. Most cities have either a franchise tax or a utility tax, which is primarily to enjoy using the public right-of-ways to install their lines, the cost of inspections, etc. This is a n tax to the utility companies. Passing it on to the customer is the decision of the utility company. Director of Public Works Broman address Mr. Movak's question on the plumbing code, 3" stack, explain- ing that the City is in the process of resolving the problem. At this time it looks like the 3" stack will be modified, however it !-!ill be an agenda item in the near future. Jim Jett, 1044 E. Linda Lane, ^cache Junction, explained that he came to the City Offices and obtained a permit for an addition to his home. The permit was issued on the 26th of January, he hired people to build the addition and the inspector came the 7th of February, said the City made a mistake, and the permit had to be cancelled. Mr. Jett said he spoke with Mr. Broman and Mr. Broman stated the permit was issued in error. Mr. Jett stated that he has torn down his bricks and leveled the property. The only thing he ever received from the City was a letter stating that the permit was denied. He has not received a refund. Director of Public Works Broman explained that the permit was issued, however it was upon observation eIS it was discovered that the addition was not in conformance. The construction was in violation of the set backs. The problem was reviewed with the building department and determined to be in error, but that does not relieve the builder and the contractor from doing it correctly. It was suggested that an appeal to the Board of Adjustments be made. Mayor Seeman explained that he would have to go through the Board of Adjustment to request a variance. Mr. Jett requested something in writing from the City to that effect. City Manager Lee explained that the appeal procedure is in Ordinance No. 7, and upon request he could be Mr Jett provided with a copyof the Ordinance. CityManager Lee apologized to 9 for any inconvenience. Robert Cosby, 230 N. Winchester, Apache Junction, stated that a member of the Planning and Zoning Advisory Committee, Mr. Wendall Clark, had submitted his resignation to the Mayor and he respectfully requested that Mr. Clark's letter be read and made PIN part of the public record. Mayor Seeman explained that she did not have that letter before her this evening and asked if any of the members of the City Council or staff had a copy of the letter. Mayor Seeman stated that it would be part of the next agenda. City Manager Lee explained that the letter was public record and anyone may obtain a copy. CITY COUNCIL MINUTES REGULAR MEETING 3/5/8(1 Page 4 CITY MANAGER'S REPORT _ ) City Manager Lee called on Director of Public Works Broman to give an airport activity report. Public Works Director Broman referred to the memorandum in the City Council 's packet and reported that the airport committee held a public meeting on Thursday with approximately 200 in attendance. It was explained that the airport would mostly be funded by the Federal and State governments, that the monies would come the taxes, licenses of the pilots, and the aviation industry and not from the income tax. The City is interested in whether an airport would be feasible, what kind of an airport, and all the pros and cons. The City will be working with the airport committee to prepare an impact study preparing preliminary designs and grant applications. As the City continues with this process, the staff will be updating the Council and the public as to how these events are proceeding. Essentially, there is a good possibility the airport could increase the tax base, provide good trans- portation, increase tours to some extent, and provide some good medical emerg- ency service. PUBLIC HEARINGS ) ) None UNFINISHED BUSINESS (TABLED ITEMS) ORDINANCE NO. 29, REZONING PZ 10-79 TROY CHURCH Mayor Seeman called on Robert Cosby to speak on the behalf of the applicant. Bob Cosby, 230 N. Winchester, Apache Junction, explained that he and Mr. Church had submitted a letter to the Mayor and City Council dated February 19, 1980, and read the letter to the City Council as follows: With regards to my request for rezoning the corner of Tomahawk and 4th Avenue, also as proposed Ordinance No. 29, I am respectfully requesting this be withdrawn. We understand the position that the City is in with regards to Trailer Home Site rezoning and although, we disagree with the position in prinicple, we never the less will respect the importance of the issue at this time. We believe that that portion of the site in the flood prone area most properly should be zoned to Trailer Home Sites. Upon the approval of the City Council of the proposed Plan Development Ordinance, we will be submitting an application for rezoning for a plan compatible with the City's wishes but which allows us to develop our property to its fullest extent. NEW BUSINESS ORDINANCE NO. 36, ESTABLISHING A LIBRARY BOARD ) AmINMayor Seeman called upon the City Clerk to read the title of Ordinance No. 36 for the first reading. City Clerk Ballard read as follows. ORDINANCE NO. 36, AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING CHAPTER 2 BY ADDING ARTICLE 2-7, ESTABLISHING A LIBRARY BOARD PURSUANT TO ARIZONA REVISED STATUTES, TITLE 9, CHAPTER 4, ARTICLE 2; PROVIDING THE REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY. The City Council discussed at great lengths the Library Board along with the other proposed commissions to include the purpose of establishing these Boards and Commissions. ORDINANCE NO. 37 ESTABLISHING AN AIRPORT COMMISSION Mayor Seeman called upon the City Clerk to read the title of Ordinance No. 37 for the first reading. CITY COUNCIL MINUTES REGULAR MEETING 3/5/80 Page 6 RESOLUTION NO. 80-6, SUPPORTING TIMELY EXTENSION OF SUPERSTITION FREEWAY ) Mayor Seeman called on Mr. Robert Dugger. Robert Dugger, 710 S. Lawson, Apache Junction, stated that being a part of a major metropolition area, and the life blood of the metropolition area is transportation, therefore, Mr. Dugger strongly supports the City Council on the timely extension of the Super- stition Freeway, Resolution No. 80-6. Mayor Seeman complimented staff on a well written Resolution. Councilman Damiano thanked Mr. Dugger for giving the City Council some positive information. Mayor Seeman read Resolution No. 80-6 as follows: RESOLUTION NO. 80-6, A RESOLUTION OF THE MAYOR AND CITY COUNCIL 'OF THE CITY OF APACHE JUNCTION SUPPORTING THE TIMELY EXTENSION OF THE SUPERSTITION FREEWAY. WHEREAS, the City of Apache Junction is the most rapidly growing community in the State of Arizona; and WHEREAS the City is located in the eastern most section of the greater Phoenix urban area; and WHEREAS, when complete, the Superstition Freeway will be the major east-west transportation artery for the greater Phoenix areas and surrounding areas; and WHEREAS said freeway is intended to reduce threats to the public health, safety and welfare caused by traffic congestion by routing through traffic away from local City streets and onto said freeway, and WHEREAS the City of Apache Junction intends in the near future to actively promote industrial and commer- cial development in order that it can become a self-sustained community, and WHEREAS industrial and commercial development will require an efficient and effective transportation system of which the said Superstition Freeway would be an integral and important part; NOW, THEREFORE, BE IT RESOLVED that the City of Apache Junction does urge the Governor of the State of Arizona, the Arizona Commissioner of Highways, the Arizona Congressional Delegation and the Arizona State Legislators, to actively support the timely extension of said Freeway. Vice-Mayor Granillo, expressed to the public the importance of the Planning and Zoning Commission in the community stating that there are many people that have experience to serve on the Planning and Zoning Commission. I Vice-Mayor Granillo further requested that the Apache Sentinel publicize the two vacancies on the Planning and Zoning Commission. REQUESTS OF COUNCIL ) ) Councilman Damiano brought up the request made by Mrs. Hiller on the issuance of burning permits and commented perhaps something can be done and requested that the City Attorney find out why Mrs. Rankin, Pinal-Gila Quality Air Control couldn't come to Apache Junction once a week to issue burning permits. Mayor Seeman requested that Mrs. Hiller attempt the same action, and if she does not get the same response, the City Council will then attempt the alternate suggestion. Councilmembers asked questions relating to the construction of the modulars, on the square footage, life expectancy, the type of structure, type of foundations, etc. City Manager Lee explained the energy package, the structure, that the buildings will be set on piers, the general layout of the buildings as set forth in the bid specifications, and the possible future use of the modular units when a permanent City Hall is built. Further stating the responsibilities of the City on the septic tanks, standby generator for the police department, the utility hookups, and plans in anti- cipation of future services. Small Game Bingo Application - Gold Dust Mobile Home Resort The Gold Dust Mobile Home Resort finds itself in the situation of having no zoning established by the City of Apache Junction. The reason for the current status is that this area has been recently annexed into the City of Apache Junction. The owners of Gold Dust Mobile Home Resort have applied to the City for a zoning designation which is the subject of case PZ-4-80 currently before the Planning and Zoning Commission. As pre- " viously noted, the zoning ordinance does not specifically provide lan- - guage to limit bingo to any particular zoning district. This application is located in an established mobile home park having a completed recreation center. The tenants enjoy the use of this facility and the park enjoys the ability to continue use of the various facilities under the "Grandfather" clause. As a zoning case, I therefore do not see any reason to deny this application. However, the City must be concerned with a potential public safety hazard which is reflected in various zoning requirements such as parking of cars. In this particular instance, I would be con- cerned if such cars parked in the vicinity of the recreation building, blocking access to the said building I would therefore recommend that the Council follow their similar actions with the following motion. These actions have been* 1. Coordination with the local Chamber of Commerce, 2. Coordination with airport main--gers and developers, 3. Coordination with State and Federal Aviation agencies, which includes air space approval for a site located in Section 4 TIN R8E C&SRB&M Pinal County, Arizona, 4. Coordination with airport consultants, 5. Attendance at an Aviation Forecast Seminar, 6. Preparation of a preliminary airport -report, 7. Request for city involvement to include a. assistance in preparing a preliminary report, b. approving consultants for obtaining grants and pre- paring master plan analysis and environmental impact report, c. managing, operating and maintaining the facility if and when it would be approved by the City Council, d. establishing an airport commission. This department has reviewed reports, attended an aviation forecast seminar, met with airport consultants, toured valley airports and dis- cussed airport feasibility in general. It is my understanding that a city airport study could be expedited with grants to include 90% Federal participation and 5% State part- icipation. An airport in this community could provide substantial incentive to industry to locate to this area, which would increase the City's tax base. It could also provide more convenient transportation to winter visitors that are becoming more concerned with automobile trans- portation, as well as satisfy the need of the local pilots. The establishment of an airport commission can investigate, coordinate and recommend action for all areas of interest and concern I recommend the establishment of an airport commission. Section 2-9-3 Salaries and Personal Expenses The members of the City of Apache Junction Airport Commission shall receive no salaries or other remuneration for their services in such capacity, and shall not be entitled to personal expenses incurred by them in the discharge of their official duties, except to the extent and purposes and amount such expense is first authorized and approved in advance by Common Council . OIN Section 2-9-4 Officers The Commission shall elect a Chairman, Vice-Chairman, and Secretary from its members to serve for a period of one ( 1 ) year. The Vice-Chairman shall preside at meetings in the absence of the Chairman. Section 2-9-5 Rules of Procedure; Power and Duties There is hereby vested in the City of Apache Junction Airport Commission full power and authority for, and on behalf of the City of Apache Junction, Arizona, to represent said City in any and all negotiations with individuals, corporations, associations, Governmental agencies, etc. , for the development and promotion of commerce by air in the Counties of Pinal and Maricopa and especially the City of Apache Junction, Arizona. The Director of Public Works shall review all the Commission 's recommendations and shall submit his recommendations to the -2- Council . No contracts or other commitments shall be deemed to have been entered into or made, except in compliance with the provisions of Article 3-7 of this Code. Section 2-9-6 Meetings The Commission shall establish a regular meeting day and time at least once a month. Special meetings may be called as required. A quorum shall consist of four (4 ) voting members for the transaction of all business. Section 2-9-7 Vacancies Vacancies shall be filled in accordance with Section 2-9-2 by the City Council for the unexpired term of the member affected. Section 2-9-8 Removal of Members Members of the Commission serve at the pleasure of 011141 the Council and may be removed by the Mayor with the concurrence of the Council . A member shall not be absent from the Airport Commission 's meetings for more than three (3 ) consecutive times. After the absence of three ( 3 ) consecutive meetings, the remaining members of the Airport Commission shall vote to retain or recommend to the City Council that the absentee member be relieved of his duties on the Commission. SECTION 2 REPEAL OF CONFLICTING ORDINANCES All ordinances and parts of ordinances in conflict with the provision of this ordinance or any part of the Code adopted herein by reference are hereby repealed. Street Classification Plan, Street Dedication and Improvements, Standard Details and Specifications A plan is needed to classifiy streets to provide and promote a safe and efficient transportation system This plan will be used in conjunction with development and preparation of the City's General Plan. This Depattment has discussed and reviewed this plan with the Director of Planning and the City Attorney. Standard procedure in valley cities is that developers will dedicate and improve rights-of-way The City of Apache Junction cannot afford to develop all streets within the City. Taxpayers not using these facilities should not be expected to incur these costs, as improve- ments benefit a particular owner, by increasing his property valuation. This Ordinance provides for dedicating and improving rights-of-way prior to issuing building permits. It is realized that this proced- ure may not be equitable for individual lot development for single family construction. Therefore, a provision is made that would allow waiver of the improvements if the owner enters into an agree- ment to participate in a street improvement district. With this ;por- tion of the Ordinance, the City will be in conformance with other City procedures and will also provide for individual construction. For some time governmental agencies have been attempting to stand- ardize public works standard details and specifications. In January the Maricopa Association of Governments (M.A.G.) has published a new set of standard details and specifications that may soon be adopted by the City of Phoenix, Mesa and the Maricopa County Highway Depart- ment No doubt other cities in Maricopa County will also follow this lead in the near future. In the past, communities outside Maricopa County have also adopted details and specifications dev- eloped in Maricopa County communities. This Department has reviewed the M.A.G Standard Details and Specifi- cations and finds said documents to be progressive, clear and com- plete. Development of independent standards and specifications for Apache Junction would be costly and time consuming. This could lead to inconsistency and confusion as new areas are annexed and could create confusion to developers, consultants and contractors. A "Street Classification Plan" is hereby adopted in a manner and form annexed hereto and made a part of this Article by reference, said plan to be kept on file in the office of the City Clerk. B. It shall be a condition precedent to the issuance of a building permit for new construction within the City that the required street right-of-way dedications and improvements be made as set forth in the street classification plan of the City of Apache Junction. C. The Director of Public Works may waive the required improvements for individual single family construction prior to the issuance of a building permit provided that the applicant enters into an agreement to participate in an improvement district for the purpose of street improvements. D. All street improvements shall be constructed in accordance with the Maricopa Association of Government Standard Details and Specifications, 1979 edition which standard details and specifications shall be the standards ON of design and construction for the City, provided however, that the Director of Public Works may revise, delete or add standard details and specifications by supplement and addendum as may be required. Section II Penalties Any person found guilty of violating any provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine not to exceed $300 or imprisonment for a period of not to exceed three months, or by both such fine and imprisonment. Each day that a violation continues shall be a separate offense punishable as hereinabove described . Section III Repeal of Conflicting Ordinances All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the Code adopted herein by reference are hereby repealed . Section IV Severability If any section, subsection, sentence, clause, phrase or portion of this ordinance or any part of the Code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. Section 2-8-3 SALARIES AND PERSONAL EXPENSES The members of the Parks and Recreation Commission shall receive no salaries or other remuneration for their services in such capacity, and shall not be entitled to personal expenses incurred by them in the discharge of their official duties, except to the extent and purposes and amount such expense is first authorized and approved in advance by the City Council. Section 2-8-4 OFFICERS The Commission shall elect a Chairman, Vice Chairman and Secretary from their members to serve for a period of one ( 1 ) year. The Vice Chairman shall preside at meetings in the absence of the Chairman. Section 2-8-5 MEETINGS The Commission shall establish a regular meeting day and time at least once a month. Special meetings may be called as required. A quorum shall consist of five ( 5 ) voting members for the transaction of all business. Section 2-8-6 VACANCIES Vacancies shall be filled by the City Council in accordance to Section 2-8-2 for the unexpired term of the member affected. Section 2-8-7 REMOVAL OF MEMBERS Members of the Commission serve at the pleasure of the Council and may be removed by the Mayor with the concurrence of the Council. A member shall not be absent from Parks and Recreation Commission regular meetings for more than three (3) consecutive times without a reasonable excuse. After the absence of three ( 3 ) consecutive meetings the remaining members of the Parks and Recreation Commission shall vote to retain or recommend to the City Council that the absentee member be relieved of his duties on the Commission. e'S Section 2-8-8 DUTIES The Commission through the Director of Public Works shall recommend regulations and policy for the government, control and improvement of the public parks of the City of Apache Junction. The Commission shall also recommend fees for the use of public park facilities and recommend full time or seasonal employees as necessary for the efficient management of the City Parks and Recreation Program. It was the intent to include this provision, and the omission was due to clerical error. Such pay -gents to be due and payable quarterly. Tax shall not apply to gross sales or gross income from sales to the United States Government, its departments or agencies which shall not be considered in the computation of tax. CTION II REPEALER All Ordinan:es and parts of Ordinances in conflict with the provisions of this Ordinance or any part of the Code adopted herein by reference, are hereby repealed. SECTION III SEVERABILITY It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this Ordinance shall be severable, and if any provision of this Ordinance is held unconstitutional for any reason by a Court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining provisions of the Ordinance. Fee Charges Enclosed please find an evaluation package relating to the proposed revision to the fee schedule as outlined in the Uniform Building Code, 1979 Edition, Table #3-A. This system is based on valuation of the work being performed. This is the same system that the cities of Phoenix, Tempe and Mesa are using with different variations for their respective areas. After an exhaustive study of material supplied us by these cities, it is our conclusion that this is the most equitable system upon which to base a permit fee system, ie: the cost of the permit to be determined by the cost of the work being done. In as much as this system is directly comparable to Mesa, and in that it has been evaluated and set up by the International Conference of Building Officials, we wholeheartedly recommend it for adoption by the City Council . The system is established with the intent that the fees collected will support the building department. Sec. called the roll call and determined that three (3) of the five (5) members as indicated above were present. 3. Chairman declared that there was a quorum present at this meeting. He then briefed all those present as to the procedures of public hearings by the Board of Adjustment. He indicated that there would be one public hearing this evening that being case BA-6-79. This is the application of Charles Selleck. He then called upon the Executive Secretary to brief the Board and public present as to this particular request. 4. Mr. Gero indicated that c se BA-6-79, the request of Mr. Selle-k, is to allow a variance in the side yard requirements from 20' to 10' in a General Rural (GR) zoning district for his particular lot #16, Wilson Addition, and fronting on Hale Drive. Mr. Selleck is requesting the variance as permitted by Section 2309 of the City of Apache Junction Zoning Ordinance, specifically relating to "exceptions for lots of record." This application was properly advertised on December 6, 1979. He /'N indicated on a sketch map the location of the subject property, and indicated that this was in the same vicinity of a recent case under the,_same procedures. 5. Mr. Selleck indicated to the Board that he had purchased this property while it was still in Pinal County. At that time he had been told that Pinal County would honor 10' setbacks as had been previously permitted when this particular tract of the subdivision was being built. He n_:ed many of the homes in the subdivision are constructed to a 10' side yard setback. Further, the septic has been placed prior to the City of Apache Junction establishing zoning authority in which it would now be difficult to locate the new proposed mobile unit without relocating the septic tank. 6. Mr. Gero presented his recommendation to the Board. He noted that this would be another application of Section 2309 of the Zoning Ordinance whereby a lot of record can be granted a variance in the setback requirement when previous development has already set precedent. In this particular case that has been done under the previous County Zoning Ordinance whe. aby 10' setbacks were required. He therefore recommended the Board approve the request of Mr. Selleck but also indicated that the rear yard should also be govern.-d under this same section of the Zoning Ordinance. 7. Mr. Gero called the roll and determined members as indicated above to be present. 3. Mr. Nesser declared a quorum present. He called for a motion on "Minutes" dated December 3, 1979. 4. Mr. Vaughn noted on "Minutes" dated December 3, 1979 that #7 indicated a unanimous vot, Mr. Vaughn had voted in the negative. Further his reason for voting for denial was that the applicant had an adequate rear yard of about 153 feet and therefore room to move the unit backwards. 5. Vaughn/Nunn M/S to approve "Minutes" dated December 3, 1979 with the one correction so noted. Motion passed unan- imously. 6. Mr. Nesser indicated that this was the public hearing for BA-1-80 application of Carl Ely requesting variances in a GR zone of: a. 1114 acre minimum reduced to 5/8 acre less the area of the right-of-way for public streets and utilities. b. reduce one side yard from 20 feet to 15.5 feet. c. reduce 100 feet lot frontage to .49.5 feet. Mr. Ely's request is based on Section 2309, Zoning Ordinance pertaining to pre-existing lots of re- cord. The case was advertised on February 7, 1980. He then called upon the Executive Secretary to brief the Commission and public present on the case. Page 2 7. Mr. Gero oriented the case on a map sketch for all present. IHe noted that. a. There are easements for public rights-of- /mkt way on three sides. b. The 21 acre parcel was first split in 1971 into 114 acre parcels. c. In 1974 Pinal County revised its Zoning Ord- inance requirements with regard to the GR Zoning District as follows: (germane points only) 1. Minimum lot area from 12,000 square feet to 1k acre. 2. Setbacks changed: Front yard increased from 30 feet to 40 feet. Side yards increased from 10 feet to 20 feet. Rear yards remained at 40 feet. 3. Minimum lot frontage of 70 feet was raised to 100 feet minimum. d. In 1975 a former owner split the northerly 114 acre into 5/8 acre lots creating the lot layout as currently shown on the Pinal County Assessor's Map e. In 1978, Mr. Ely purchased lots 55A and 55C. f. On July 1, 1979, The City adopts its Zoning Ordinance which includes the specific section under which Mr. Ely is requesting a decision. g. In late 1979, Mr. Ely has apparently entered into contract for sale of his lot 55C. h. Mr. Ely, believing that Section 2309, Zoning Ordinance allows him to gain a favorable de- cision of this Board thereby allowing him to place a single dwelling on lot 55A, has applied for variances as stated above under said section of the Zoning Ordinance. 8. Carl Ely stated that he is the applicant and owner of the prop- erty that is the subject of this application. He re- iterated the facts as stated above by the Director of Planning. He further indicated that he intends to place a mobile home on the site which is intended as his re- tirement home. He requested the Board's approval of the requests in that the lots, although non-conforming were split prior to July 1, 1979. 9. Numerous spoke against or questioning the approval by the Board. Citizens They noted that the area is generally large lots and that many people consider openness a very important aspect of their land value. They also questioned what effect the existing structures on lot 55C would have on the development of lot 55A. Page 3 10. Mr. Gero stated that the questions the Board must ask are defined in the Zoning Ordinance which has been adopted by the City Council. The Board nor the staff have the authority to arbitrarily ask other questions. With regard to property development, a property owner is permitted to develop their property to the full extent as set forth in the Zoning Ordin- ance with respect to such requirements. 11. Mr. Cero stated that the split of the lots occurred after Pinal County adopted new standards and therefore the division appears an unlawful split with regard to their Zoning Ordinance. However, the City of Apache Junction Zoning Ordinance makes reference to lots of record on the date of adoption of the City Zoning Ordru.ne which is July 1, 1979. It appears the applicant meets the criteria as set forth in the Zoning Ordinance and therefore approval is called for. 12. Furness/ M/S that the application of Mr. Carl Ely (BA-1-80) Nesser for his property located at N1 N1 NE SW SE NE Sec. 22, R8E, TIN G & SRB & M in Apache Junction, Az. be approved granting variances to the subject property located in a General Rural (GR) zoning district of. 1. Reduction of the 114 acre requirement to 0.625 acre less the area reserved for public right-of-way purposes. 2. Reduce one side yard minimum requirement (the one furthest from the public right- of-way) from 20 feet to 15.5 feet. 3. Reduce the minimum lot frontage from 100 feet to 49.5 feet. This motion is made in recognition that the lot is a non-conforming lot of record, the split occurring prior to July 1, 1979 as required by Section 2309 of the City of Apache Junction, Az. He pointed out the Board is currently not having a heavy demand for meetings. Yet, it has a requirement for two monthly meetings. The Special Meeting of the Industrial Development Authority of the City of Apache Junction, Arizona, was duly convened on eIN December 18, 1979, pursuant to notice duly given, and there being a quorum present, the meeting was called to order by William F. Wright, President. Mr. Michael A. Curtis, City Attorney for the City of Apache Junction, Arizona, advised the members of the Board that in his opinion it was in the best interests of both the City and the Industrial Development Authority of the City of Apache Junction for the Authority to retain independent counsel to advise it in connection with any bond issues. Mr. Curtis advised that he would coordinate closely with the counsel for the Authority and recommended considera- tion of retention of the Law Offices of Donald D. Meyers as counsel with whom he has had dealings in the past and noted that the standard hourly rates charged by the Law Offices of Donald D. Meyers were reasonable and, in accordance with the standards prevailing in the community for services of a similar nature. Ruby Forsberg moved that the Law Offices of Donald D. Meyers be retained as counsel to the Authority, with their fees to be paid from the proceeds of money submitted in connection with applications to the Authority and from the proceeds of any bond issues. John Drummond seconded the motion. All voted aye. . None voted nay. The motion was carried unanimously. Thereafter, Mr. Robert J. Pohlman from the Law.Offices of Donald D. Meyers outlined the duties and obligations of the Authority and the members of the Board. Thereafter, Mr. Don Rishell presented the Commerce-Development Associates' project to the members of the Authority. The Project contemplates the construction of a shopping center anchored by a K-Mart store and located at the corner of Apache Trail and Meridian in Apache Junction, Arizona. The Project contemplates -2- gf an issuance of $5, 800, 000 worth of bonds which will be fully guaranteed as to principal, interest and premium, if any, by the K-Mart Corporation. Projected number of employees at the completion of the Project is between 250 and 300. The K-Mart store is contemplated to be a total of 72,897 square feet' and will be leased to K-Mart for a term of 25 years, with ten 5-year options . There followed a lengthy discussion concerning the merits of the Commerce Development Associates' application during which it was noted by all members of the Board that the materials concerning the application had been predistributed to them at a pre-organizational meeting, that all members had previously studied the materials carefully and had heard a presentation made to them by Mr. Rishell. Mr. Curtis observed that he was aware that one of the general partners of the EGS Metro general partnership, a Mr. Walter Sterling, had successfully completed construction of these types of shopping centers and leased space previously. After discussion, it was moved by Mr. Wright and seconded by Mr. Johnson that Mr. Wright and Mr. "Johnson would be authorized to execute a Memorandum of Agreement in form and substance as drafted and approved by the counsel for the Authority, providing for preliminary approval of issuance of revenue bonds in the approximate sum of $5, 800 , 000, providing that the .issuance of such bonds, together with all interest and premiums thereon, if any, would be unconditionally guaranteed by the K-Mart Corporation and that the K-Mart Corporation would furnish its complete indemnity to the members of the Authority and their representatives. All voted aye. None voted Nay. The motion passed unanimously. After further discussion, the preliminary bond resolution regarding the issuance of the approximate sum of $5, 800,000 of revenue bonds for the benefit of Commerce Development Associates was presented and read to the Board by Mr. Wright; and upon motion by Mr. Wright, seconded by Mr. Johnson, it was resolved that the resolution be adopted with a copy of the said resolution and Memorandum of Agreement to be _ attached to and made a part of these Minutes. All voted aye. None voted nay. The motion was carried unanimously. Thereafter a discussion ensued as to retention of an expert accountant to advise the Authority. Mr. John Drummond moved that Mr. Harry Pappas, currently the accountant representing the Industrial Development Authority of Pinal County, Arizona, and Maricopa County, Arizona, be retained to represent the City of Apache Junction., Arizona, so long as satisfactory fee arrangements could be made. The Motion was seconded by Dorothy Johnson. All voted aye. None voted nay. The elliN motion was carried unanimously. Upon motion by Mr. William Wright, and seconded by Ruby Forsberg, it was resolved that an application fee of $2, 000 be paid to the Authority by Commerce Development Associates. All voted aye.
