MARCH 19, 1980
A Regular Meeting of the City Council of the City of Apache Junction
was held on March 19, 1980, at the Apache Junction City Hall , pursuant to the
notice as required by law.
CALL TO ORDER
Mayor Virginia Seeman called the meeting to order at 7:00 P.M. at
the Apache Junction City Hall .

CALL TO THE PUBLIC (PETITIONS) )
Earleen Andrews, 480 E.
Palo Verde, Apache Junction, in behalf of the Tri-Chairman of the Lost Dutch-
man Days and the Chamber of Commerce presented the City of Apache Junction
with a Recognition Award for all the help the City gave on Lost Dutchman Days.
Also presented was a Recognition Award for Galen Monson who worked for the
City donating time helping out at the Rodeo Grounds.

CITY MANAGER'S REPORT )
) City Manager Lee, reported
that he had three items, first he reported on the Public Works security fence
on the State Land location was complete, which will enhance the capability of
the Public Works Department.

City Manager Lee called
on the Building Official , Leo Frazier, to give a status report on the fee
schedule that is currently under consideration.
Building Official Frazier
reported that the new fee schedule was prepared and ready for the Panning
and Zoning Commission to review.
Mayor Seeman brought to
the attention of the City Council that the fee schedule being proposed was
included in the City Council Agenda Packets.
City Manager Lee reported
that during the explosive growth of your City the first year, the employees
have been examining their job rolls and descriptions on a. constant basis. One
of our most dedicated and loyal employees, Ms. Ballard, has requested that the
following letter be read into the record and that her resignation as City Clerk
and acceptance of the position of Deputy City Clerk be noted. Mr. Lee read the
letter as follows:
Dear Madam Mayor and Council :
After a career path evalua-
tion in the most rapidly expanding City in the State and counseling with friends
and the help of Mr. Lee, I believe it will be in my best career interest with
the City of Apache Junction if I today submit my resignation as City Clerk and
assume an appointment as Deputy City Clerk/Secretary to the City Clerk.
This move I believe will
help me accomplish my personal goals as a member of the City management team.
I respectfully request my
resignation be effective immediately, so I may assume the new position as
Deputy City Clerk/Secretary.

Mayor Seeman reported that
the City Council as a whole would like to present Ms. Ballard with a Certifi-
cate of Appreciation as the City's first City Clerk.
PUBLIC HEARINGS
SMALL GAME BINGO LICENSE/GOLD DUST MOBILE
HOME RESORT
Mayor Seeman opened the
Public Hearing for the Gold Dust Mobile Home Resort on "Small Game" Bingo
License. The applicant Marvin Halbert was asked to speak on behalf of the
.�► petition.
Alice Benson, the Activities
Director of the Gold Dust Mobile Home Resort reported she was representing Mr.
Marvin Halbert.
Vice-Mayor Granillo asked
questions of Mrs . Benson on conducting Bingo Games and if there was adequate
parking space.
Mrs. Benson reported there
was a problem with parking during the Lost Dutchman Days being a new park, but
there hasn't been any since and they don't expect any problems in the future.

Mayor Seeman requested if
there was anyone from the public that wished to speak. There being no public
input, Mayor Seeman closed the hearing to the public.

TION, ARIZONA, THAT THE CITY COUNCIL RECOMMENDS APPROVAL TO THE ARIZONA DEPART-
MENT OF REVENUE THE QUALIFIED ENDORSEMENT OF THE GOLD DUST MOBILE HOME RESORT
"SMALL GAME" BINGO LICENSE TO BE CONDUCTED AT THE GOLD DUST MOBILE HOME RESORT,
202 N. MERIDIAN ROAD IN THE CITY OF APACHE JUNCTION, ARIZONA. THE QUALIFIED
ENDORSEMENT IS THAT THE BUILDING IN WHICH THE BINGO GAMES WILL OCCUR SHALL NOT
HAVE MOTOR VEHICLES PARKED IN THE VICINITY OF SAID BUILDING IN A MANNER THAT
THE VEHICLES' PRESENCE WOULD BECOME A HAZARD TO THE PUBLIC HEALTH, SAFETY, AND
GENERAL WELFARE.

time to review the reports submitted by the AD HOC Committee.

A RESOLUTION OF THE MAYOR
AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, PINAL COUNTY, ARIZONA, ENDORS-
ING AND ENCOURAGING THE DEVELOPMENT OF RECREATIONAL FACILITIES WITHIN THE CITY
.-. OF APACHE JUNCTION.
WHEREAS, there is a need
for recreational facilities within the City of Apache Junction; and
WHEREAS, recreational
facilities for citizens of Apache Junction to develop physical and mental
potentials; and
WHEREAS, this resolution
does not suggest or bind the City to any financial obligations or other obli-
gations of any kind;
NOW, THEREFORE, BE IT
RESOLVED that the City of Apache Junction hereby endorses and encourages the
development of recreational facilities within the City of Apache Junction.

AN ORDINANCE OF THE CITY
OF APACHE JUNCTION, PINAL COUNTY, ARIZONA, AMENDING CHAPTER 8, SECTION 8-5-23,
TO INCLUDE UTILITY AND/OR PUBLIC SERVICE COMPANIES ENGAGED IN FURNISHING GAS OR
,NW ELECTRICITY FOR LIGHT, FUEL, OR POWER, PROVIDING FOR PENALTY CLAUSE AND SEVER-
ABILITY CLAUSE; AND DECLARING AN EMERGENCY.
SECTION 8-5-23 PUBLIC
UTILITY TAX Utility and/or public service companies, who do not have a
franchise agreement with the City of Apache Junction, engaged in furnishing
gas or electricity for light, fuel or power, or in furnishing what for irriga-
tion or domestic purposes, fire protection or other public or private purposes,
or in transmitting messages or furnishing public telegraph or telephone services,
shall pay, in addition to the quarterly business tax, a sum equal to two percent
(2%) of the gross receipts of said utility or public service company from sales
for residential and/or commercial purposes within the corporate limits of the
City of Apache Junction. Such payments to be due and payable quarterly. Tax
shall not apply to gross sales or gross income from sales to the United States
Government, its departments or agencies which shall not be considered in the
computation of tax.

to the City of Apache Junction, P. 0. Box K, Attention: Office of the Mayor.
The Councilmen will be participating as well as the Department Heads.

his concern on the strip annexation by the City of Mesa, and stated his reasons
for his concern.

ARIZONA, THAT DIRECTION BE GIVEN TO THE CITY MANAGER TO CONDUCT A STUDY INTO THE
FEASIBILITY OF FORMALLY DECLARING THE CITY OF APACHE JUNCTION 'S ZONE OF INFLUENCE
TO INSURE THE FUTURE PROTECTION TO ALL CITY RESIDENTS.
Councilman Eidson asked the
City Manager to explain the Zone of Influence.
City Manager Lee explained
that the Zone of Influence is described as that 3 mile radius outside the City
limits. The Influence would include the potential site the City is interested
in for the airport, which the City is pursuing a grant. This would also help
satisfy the problem the City has with developers trying to comply with a Mesa
Code, Apache Junction Code, and a Pinal County Code. The City would have Zone
of influence for the protection of the public. They can not come in with that
noxious industry on property contiguous to the City of Apache Junction and
give problems with property values, etc. The City would not be annexing that
area but simply performing a study that would determine whether or not it would
be a prudent course for the Council to consider.
Councilmembers discussed
at lengths the recent annexation by the City of Mesa and the pros and cons in
relation to the City of Apache Junction.
City Manager Lee recommended
that the City Council consider a formal resolution, outlining the Zone of Influ-
ence so that the City of Apache Junction can go on record with the other Cities
that we intend to explore that Zone of Influence to see what value it has to
the City of Apache Junction. This would minimize any problem to the North,
South, and East as an attempt to circle the City. The City of Apache Junction
would send this Resolution to the City of Mesa and put their Council on notice
that the City of Apache Junction is in the process of conducting a study and
will come up with an impact on the residents of the City of Apache Junction for
the next 15 to 20 years . Mr. Lee felt this should be staffed through the Planning
and Zoning Commission for their recommendations.

the staff can draft the Resolution based on the motion.

Ray Prue complained on a
pond of water on the street in front of Johnny Below Zero's and stated that
it is a health hazard and he has complained to City Hall , with nothing being
done.

Director of Public Works
Broman answered that the staff is aware of the problem, and it appears that it
was created during the construction of the business in that area, which at the
time, it was under the jurisdiction of Pinal County. The City has to take some
action by contacting the property owner to see what action he would take to
correct the problem. Mr. Broman further explained that the City can not just
fill in the dip as it will not correct the problem, it would cause problems
elsewhere and the City can not go on private property.
Mayor Seeman thanked the
Business License AD HOC Committee, Chairman Don Brooke, Earleen Andrews, Tom
Lester, Martha Wright and Samford Gardom for the many hours spent, and invited
them to come to the March 27th Work Session.

The Planning and Zoning Commission has held an advertised public hearing
on the above case. At the public hearing no persons spoke against the
request, although several persons made comments and/or asked questions.
Following the closing of the public hearing, the following motion was
unanimously approved by roll-call vote.
"Be it resolved by the Planning and Zoning Commission of the City of
Apache Junction, Arizona, that this Commission recommends to the Apache
Junction City Council the approval of rezoning case (PZ-5-80) requested
by Mr. Virgil J. Buck from General Rural (GR) to Multiple Residence
(CR-4) for the property he owns located at 252 N. Ironwood Drive des-
cribed as Lot 11, Block 3, Newtown Subdivision located in Apache
Junction, Arizona.
The reasons for recommEnding approval are:
1. The property is located on a Section line road (arterial)
which has, and will continue to have, substantial traffic.
''\ 2. The subject area lies between Apache Trail and Superstition
which is an area of mixed uses including nearby commercial
uses on the Trail.
3. As such, apartments would provide an orderly transition.
4. CR-4 (Multiple Family) density is limited to one dwelling
unit per 3500 square feet of lot area and construction
of four plexes cannot be exceeded.

A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA, DECLARING ITS INTENTION TO CONSIDER THE FUTURE ANNEXATION OF
CERTAIN AREAS CONTIGUOUS TO AND IN THE CITY'S ZONE OF INFLUENCE AND PROVIDING
NOTICE THEREOF.
WHEREAS, the City of Apache Junction contains an area of approximately
twelve (12) square miles; and
WHEREAS, certain areas which lie outside the City limits are never-
theless contiguous to the City and are located within the City's zone of
influence; and
WHEREAS, good land use planning requires that different land uses
which are contiguous to each other be compatible with each other; and
WHEREAS, good land use planning will ultimately attract a good comm-
ercial and industrial tax base to serve the public interest and needs and
will insure the fiscal soundness of both the City and the Apache Junction
School District; and
WHEREAS, in the interest of good land use planning the City is pre-
paring a General Plan for the area within the City and for those areas
contiguous to and in the City's zone of influence.
.M W. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA, THAT:
1. The City of Apache Junction declares its intention to consider
the future annexation of those lands contiguous to and in the
City's zone of influence.
2. Further, the City of Apache Junction requests its municipal
neighbors to refrain from annexing territory in Pinal County
contiguous to Apache Junction and in its zone of influence.
3. Further, the City Clerk is hereby instructed to provide notice
hereof by publishing and posting this resolution and by sending
certified copies to the Governor of the State of Arizona, the
Commissioner of the Arizona Land Department, the Arizona Director
of the Bureau of Land Management, the Central Arizona Association
of Governments, the Mayors of the cities of Mesa, Chandler, and
Gilbert, to the Pinal County Board of Supervisors, and to the
Base Commander of Williams Air Force Base.

SUBJECT: Proposed Ordinance #32 - Rezoning Fees

Attached you will find copies of the above proposed ordinances. At its
regular meeting of March 18, 1980, the Planning and Zoning Commission held
an advertised public hearing on the proposed ordinances. Nobody spoke
adversely on the proposals although several persons asked questions. Several
minor changes to the draft of the proposed ordinances #33 and #34 were made
by the Commission. Thereupon, they recommended the unanimous approval to the
City Council of the three proposed ordinances.
The current Zoning Ordinance has only one section which allows general
apartment development being CR-5. It is my opinion that the one unit per
2,000 square feet of lot area is entirely too dense for a city having septic
tank disposal. Without building upward, I believe the density factor to be
impractical anyway. This was discussed with the Planning and Zoning Commission
who currently has several rezoning applications for CR-5. The applicants have
agreed to wait on the Planned Development Ordinance and city staff has reviewed
their proposals which seem generally good. However, these applicants have been
waiting several months and we are all aware of what is occurring in the money
market. Should the City Council adopt these ordinances, it should be pointed
out that the application process as in any other rezonings must take place.
This includes notice and public hearings before the P & Z Commission before the
applicant can come before the City Council for rezoning approval. This is a
lengthy process.
These proposals were prepared by the Planning and Zoning Commission and Citizen's
Advisory Committee with staff assistance. As such, they represent input from
developers, realtors, as well as other members of the community. The Commission
.n� has held an advertised Town Meeting to acquaint the community with the proposals.

PARKING
The parking proposal sets forth what is projected to be reasonable requirements
which would require a land user to provide reasonable on-site parking. The
requirements also intend to not require more parking than what is in the public
interest because too much asphalt reduces the percolation area for rainfall and
creates added expenses for developers.

FEES
The fees set forth the the Planned Development fee. The amount does not change
($100.00) from other rezoning fees.
PLANNED DEVELOPMENT
The Planned Development ordinance establishes another method for establishing
land use zoning. Each of the other districts establish conventional require-
ments for using land. The planned development concept would allow the developer
some flexibility in designing his land use. With our terrain, potential flood
problems and the way this area has been cut into lots (including the problems
of federal patents) such flexibility appears to be desirable.
RECOMMENDATION
The Planning and Zoning Commission and the Director of Planning recommend

subject to and accompanied by a non-refundable filing and investigation
fee. The purpose of the fee shall be to defray, in part, the expenses

Attached you will find copies of the above proposed ordinances. At its
regular meeting of March 18, 1980, the Planning and Zoning Commission held
an advertised public hearing on the proposed ordinances. Nobody spoke
adversely on the proposals although several persons asked questions. Several
minor changes to the draft of the proposed ordinances #33 and 1134 were made
by the Commission. Thereupon, they recommended the unanimous approval to the
City Council of the three proposed ordinances.
The current Zoning Ordinance has only one section which allows general
apartment development being CR-5. It is my opinion that the one unit per
2,000 square feet of lot area is entirely too dense for a city having septic
tank disposal. Without building upward, I believe the density factor to be
impractical anyway. This was discussed with the Planning and Zoning Commission
who currently has several rezoning applications for CR-5. The applicants have
agreed to wait on the Planned Development Ordinance and city staff has reviewed
their proposals which seem generally good. However, these applicants have been
waiting several months and we are all aware of what is occurring in the money
market. Should the City Council adopt these ordinances, it should be pointed
out that the application process as in any other rezonings must take place.
This includes notice and public hearings before the P & Z Commission before the
applicant can come before the City Council for rezoning approval. This is a
lengthy process.
These proposals were prepared by the Planning and Zoning Commission and Citizen's
Advisory Committee with staff assistance. As such, they represent input from
developers, realtors, as well as other members of the community. The Commission
has held an advertised Town Meeting to acquaint the community with the proposals.

PARKING
The parking proposal sets forth what is projected to be reasonable requirements
which would require a land user to provide reasonable on-site parking. The
requirements also intend to not require more parking than what is in the public
interest because too much asphalt reduces the percolation area for rainfall and
creates added expenses for developers.
FEES
The fees set forth the the Planned Development fee. The amount does not change
($100.00) from other rezoning fees.
PLANNED DEVELOPMENT
The Planned Development ordinance establishes another method for establishing
land use zoning. Each of the other districts establish conventional require-
ments for using land. The planned development concept would allow the developer
some flexibility in designing his land use. With our terrain, potential flood
problems and the way this area has been cut into lots (including the problems
of federal patents) such flexibility appears to be desirable.
RECOMMENDATION
The Planning and Zoning Commission and the Director of Planning recommend
approval of the three proposed ordinances as you now have them. In that there
are a number of potential developments for the City to create needed apartments,
and in recognition of the time and cost factors, it is further recommeded that
the emergency clause be approved.

Section 21 01 INTENTION AND PURPOSE

It is the intent and purpose of the parking and loading
requirements to provide for adequate off-street parking spaces
to serve residential , commercial , industrial , institutional ,
and other land uses , and thus help to prevent congestion of
city streets Proper design of and access to parking facilities
shall be required in order to protect the public health , safety
and welfare . Furthermore , it is the intent and purpose of these
regulations to promote the functional efficiency of all land uses
by requiring off-street parking and loading facilities consistent
with modern standards .

Section 21.02 GENERAL PROVISIONS
1. The provisions and maintenance of required off-street
parking and loading facilities are continuing obligations of the
property owner or tenant. Required parking spaces shall be im-
proved as required and made available for use before final in-
spection is completed by the Building Official.
2. In all zoning districts, when a building is enlarged or
structurally altered, or a new building is constructed, or the use
of an existing building is changed, off-street parking and loading
spaces shall be provided prior to occupancy according to the
requirements set forth in Section 21.04, Off-Street Parking Require-
ments, and Section 21.05, Loading Facilities Requirements. When
several uses occupy a single structure or lot, the total required
parking shall be the sum of the requirements of the individual
uses and further, when a building or use is planned or constructed
in such a manner that a choice of parking requirements could be
made, the use which requires the gre2t,?st number of parking spaces
shall govern. When a use may have more than one work shift or
occupancy, the shift or occupancy with the greatest number of
occupants shall govern. When there is a change in the use of a
building or parcel of land, the difference between the number
of required parking spaces for the new use and the number required
for the previous legal use according to this Article even if spaces
were not available for the previous use, shall be provided.
3. In all zoning districts, required off-street parking shall
be located on the premises intended to be served.
4. Required parking spaces shall be available for parking of
vehicles of residents, customers, patrons, and employees, and shall
not be used for storage of vehicles, or materials, or for the ex-
clusive parking of vehicles used in conducting the business or use,
and shall not be used for selling, repairing, or servicing.
5. (Reserved.)
6. A plan, drawn to scale, indicating how the off-street parking
requirements are to be met, shall accompany an application for a building
permit where parking is required. The plan shall show all elements nec-
essary to indicate that the parking requirements as set forth in this
Article are being fulfilled, and shall include at least the following:

e. Dimensions, continuity, and type of screening; and

g. Delineation of obstacles to parking and circulation
in finished parking area; and
h. Specifications as to signs and bumper guards; and
i. Landscaping.
7. When the unit of measurement determining the number of
required parking spaces results in the requirement of a fractional
space, any fraction up to and including one-half (0.5) shall be dis-
regarded, and fractions over one half (0.5) shall require the
additional one (1) parking space.
8. When parking areas are provided on a separate lot, the front
set back requirements shall be determined as if applied to a one story
structure within the zoning district where it is located.
Section 21.03 DETAILED STANDARDS
All parking and loading areas shall be developed and maintained
as follows:
1. Driveways and areas used for loading, parking, and maneuvering
of vehicles shall have a surface which is durable, all weather, and paved
of either asphalt or concrete; except that lots over 5/8 of an acre
shall only be required to pave the accessway from the property line for
a distance of up to forty (40) feet.
2. Except for single family and duplex dwellings, driveways
and areas for loading, parking and maneuvering of vehicles shall meet
the requirements of the Director of Public Works with regard to
traffic flow onto public streets and alleys.
3. A parking area shall be designed to dispose of all surface
water accumulation within the area in such a manner as to prevent drain-
age onto adjoining property, and shall meet all other drainage requirements
of the Director of Public Works.
.•. 4. A loading berth shall have minimum dimensions of fourteen (14)
feet wide and fifty (50) feet long, and where covered shall have a
vertical clearance of at least fourteen (14) feet. If the loading area
in in the buildable area, this requirement shall not prevent the con-
struction over the loading space clearance area.

5. Each required parking space shall be not less than nine (9)
feet wide and not less than twenty (20) feet long, exclusive of access
drives or aisles.
6. No obstructions of any kind shall be permitted within any
designated parking space.
7. No parking space shall be located in a manner so as to block
access to any other parking space, except on a parking lot with a
parking attendant having access to each vehicle's keys.
8. Parking spaces shall be designed so that no backward movement
of a vehicle onto a public right-of-way, other than an alley, will be
necessary, except for single family and duplex dwellings.
9. When installed, bumper guards or wheel barriers shall be
secured to the ground surface and shall be so installed that no
portion of a vehicle will project onto a public right-of-way, over
adjoining property, over a sidewalk, or into a required setback, land-
scaping, or screen.
10. Lighting of a parking area shall not interfere with surround-
ing areas or traffic flow.
11. Directional signs and pavement markings shall be used to con-
trol vehicular movement in a parking area. Signs shall be limited to
two (2) square feet each, and an aggregate total not to exceed twenty
(20) square feet. No sign of any kind other than those indicating
entrances, exits, name of establishment to which such parking area
is accessory, or conditions of use shall be erected. No advertising
on such signs shall be permitted.
12. No driveway over 300 feet long shall exceed a ten percent
(10%) grade; and no driveway shall exceed seventeen percent (17%)
grade.
13. A common driveway shall be permitted for adjacent residential
lots. At least one-half (l ) the minimum required width of the ser-
vice driveway shall be located contiguously on each lot. Legal
evidence shall be presented to the Director of Public Works and
approved by the City Attorney, in the forms of deeds, leases, or
contracts to establish joint use, prior to zoning approval.
14. Where a parking area for a business or commercial use is a
side yard or rear yard and adjoins a residential zoning district, a
solid wall or fence of masonry or other approved fireproof material
shall be constructed between the parking area and said district
not less than four (4) feet nor more than six (6) feet in height,
except that no fence shall be required within twenty (20) feet of

public right-of-way.
15. No parking lot shall have a vehicular entrance or
exit onto a public right-of-way within thirty (30) feet of a
residential zoning district or within fifty (50) feet of any
school grounds, public playground, church, hospital, sanitorium,
public library or institution for dependents or for children.
16. Off-street parking areas shall be arranged so as
to conform with the standards depicted in Figure 21-1, "Off-
Street Parking Standards".
17. No driveway in a front yard shall be more than
twenty (20) feet wide and the front yard driveway shall not
be used in calculating parking spaces. The Director of Public
Works, (or Arizona Department of Transportation on State or
Federal highways) , may limit the number and location of curb
cuts along a public right-of-way.

Section 21.04 OFF-STREET PARKING REQUIREMENTS
The following sets forth the minimum number of parking
spaces to be provided as regL _red in this Ordinance. Re-
quirements for a building or use not specifically listed shall
be determined by the Director of Planning or Building Official
based upon the requirements of similar uses.

Section 21 . 05 LOADING FACILITIES REQUIREMENTS
In all zoning districts , in connection with every building
hereafter erected to be occupied by uses requiring the receipt
or shipment by motor vehicles of materials or merchandise , there
shall be provided and maintained on the same premises with such
building off-street loading and unloading space accessible from
an alley or easement of access , or when there is no such alley
or easement of access , from a street One loading space shall
be required for each 10 ,000 square feet of floor area . If less
than 10 ,000 square feet exists , 5 ,000 or more square feet of
floor area shall require one (1) loading space .
Such space may occupy all or part of any required rear yard ,
except that no such space shall be located closer than fifty (50)
feet to any lot in a residential zoning district unless wholly
within a completely enclosed building or enclosed on all sides
abutting said residential zoning district by a solid fence or wall
not less than five (5) feet nor more than six (6) feet in height .
Section 21 . 06 PARKING : ADDITIONAL REQUIREMENTS

shall be stored in a rear yard in a completely screened space ,

SECTION III : SEVERABILITY
If any section , sub-section , sentence , clause , phrase
or portion of this ordinance or any part of the code
adopted herein by reference , is for any reason held to
be invalid or unconstitutional by the decision of any
court of competent jurisdiction , such decision shall not
affect the validity of the remaining portions thereof .
SECTION IV : EMERGENCY CLAUSE
Whereas , it is necessary for the preservation of the
peace , health and safety of the City of Apacho Junction ,
Arizona , an emergency is declared to exist , and this
ordinance shall become immediately operative and in force
from and after the date of posting hereof .

Attached you will find copies of the above proposed ordinances. At its
regular meeting of March 18, 1980, the Planning and Zoning Commission held
an advertised public hearing on the proposed ordinances. Nobody spoke
adversely on the proposals although several persons asked questions. Several
minor changes to the draft of the proposed ordinances #33 and #34 were made
by the Commission. Thereupon, they recommended the unanimous approval to the
City Council of the three proposed ordinances.
The current Zoning Ordinance has only one section which allows general
apartment development being CR-S. It is my opinion that the one unit per
2,000 square feet of lot area is entirely too dense for a city having septic
tank disposal. Without building upward, I believe the density factor to be
impractical anyway. This was discussed with the Planning and Zoning Commission
who currently has several rezoning applications for CR-5. The applicants have
agreed to wait on the Planned Development Ordinance and city staff has reviewed
their proposals which seem generally good. However, these applicants have been
waiting several months and we are all aware of what is occurring in the money
market. Should the City Council adopt these ordinances, it should be pointed
out that the application process as in any other rezonings must take place.
This includes notice and public hearings before the P & Z Commission before the
applicant can come before the City Council for rezoning approval. This is a
lengthy process.
These proposals were prepared by the Planning and Zoning Commission and Citizen's
Advisory Committee with staff assistance. As such, they represent input from
developers, realtors, as well as other members of the community. The Commission

has held an advertised Town Meeting to acquaint the community with the proposals.

PARKING
The parking proposal sets forth what is projected to be reasonable requirements
which would require a land user to provide reasonable on-site parking. The
` requirements also intend to not require more parking than what is in the public
interest because too much asphalt reduces the percolation area for rainfall and
creates added expenses for developers.
FEES
The fees set forth the the Planned Development fee. The amount does not change
($100.00) from other rezoning fees.
PLANNED DEVELOPMENT
The Planned Development ordinance establishes another method for establishing
land use zoning. Each of the other districts establish conventional require-
ments for using land. The planned development concept would allow the developer
some flexibility in designing his land use. With our terrain, potential flood
problems and the way this area has been cut into lots (including the problems
of federal patents) such flexibility appears to be desirable.
RECOMMENDATION
The Planning and Zoning Commission and the Director of Planning recommend
approval of the three proposed ordinances as you now have them. In that there
are a number of potential developments for the City to create needed apartments,
and in recognition of the time and cost factors, it is further recommeded that
the emergency clause be approved.

Section 33 01 Intention and Purpose
In certain instances the objectives of the Zoning Ordinance
may be best achieved by the promotion of planned developments
which do not conform in all respects to the land use pattern
and regulations of conventional zoning It is the intention
and purpose of the Planned Development Zoning District (PD) to
provide for greater flexibility , and thereby encourage more
creative design which may include a combination of different
dwelling types and/or a variety of land uses which complement

each other and which are congruous with existing and
proposed land uses in the vicinity . Therefore , it is
intended to enable the use and integration of contempor-
ary land planning principles in such a manner as to
promote its most appropriate use ; to allow diversification
in the relationship of various uses , structures and
spaces ; to facilitate the adequate and economical pro-
visions of streets and utilities ; to preserve the natural
and scenic qualities of open space ; and establish guidelines
that will encourage the highest standards of design and
construction ; to offer recreational opportunities close to
home , to enhance the appearance of neighborhoods through
preservation of natural green spaces ; to counteract the
effects of urban congention and monotony while providing
the environmental amenities ; and provide the unified control
of development of land .
It is further the intent to insure substantial compliance
with the General (Comprehensive) Plan adopted by the City
now or in the future and spirit of intent of the Zoning
Ordinance in requiring adequate standards necessary to
promote the public health , safety and general welfare without
unduly inhibiting the advantages of modern planning as a
means of effectuatingdesirable development , redevelopment ,

rehabilitation , and conservation in the City of Apache
Junction foi residential , commercial , industrial and other
purposes
Section 33 02 Permitted Uses
1 . The buildings and uses permitted in the Planned
Development Zoning District shall be governed
by the permitted uses in the base district or in
a combination of base districts . The base district
or districts from which permitted uses shall be
determined shall include only those designated in
the application and approved by the Council .
2 . Upon the approval of Council , the arrangement of
uses on the land as permitted by the base district (s) ,
and the proportions of permitted land use defined
by the underlying base district (s) may be adjusted ,
re-arranged or altered according to standards and
regulations as provided in this Article .
3 Any use applied for and not specifically listed
in this Zoning Ordinance , if approved by the
Council , shall be designated to the base district
for which the use , when applied , would most
resemble

4. By "base district" this Article means any conventional zoning
district(s) as approved by the Council for a particular area.
Normally, the base district(s) will be those existing or com-
patible with existing conventional zoning districts in the subject
area.
Section 33.03 Procedure
The development plan review shall be conducted according to the
following steps, procedures and requirements notwithstanding any other
provisions of this Zoning Ordinance. There shall be a three (3) step
review process for planned development approval consisting of Step One:
pre-preliminary; Step Two: preliminary; and Step Three: final approval.
Each step is outlined below and each shall be approved before proceeding
to the next step as provided.
1. General Procedure
a. Application for a Planned Development Zoning District
(PD) shall be filed in writing and on a form approved by
the Commission in the manner required for amending the
Zoning Ordinance.
No application shall be accepted unless it is complete and
is verified as to the correctness of information given by
the signature of the applicant attesting thereto.
The applicant, or his designated representative, is requested
to be present at each public hearing on their application.
b. The proposed planned development shall be in one (1) owner-
ship or control, or the subject of a joint application by
the owners of all the property included.
c. At the time of filing of the preliminary plan, a fee shall
be due in the amount prescribed for "Planned Development"
on the most current City of Apache Junction Schedule of
Filing Fees as found in Section 2804 of the Zoning Ordinance.
d. The application shall be accompanied by plans, filing doc-
uments and information as prescribed in this Article, or as
prescribed by the Commission.
e. An application for a planned development must be filed not
less than eighteen (18) days prior to the public hearing.

2 . Step One • Pre-Preliminary Application
ON a The approval of Step One shall be construed as only
concept approval for the given site and shall not
be construed as approval of any zoning amendment .
b The Planning Department staff shall determine
whether the planned development requirements of
this Article are complied with . If the developer
disagrees with the determination , the applicant
by request , or the staff , may take the pre-prelim-
inary information to the Planning Commission for
its determination of whether this site is suitable
fox development as a planned development . This
step does not require an advertised public hearing.
3 Step Two . Preliminary Application (General Development
•
Plan)
a The approval of Step Two shall be preliminary
approval of the specific project on the desig-
nated site and shall create the zoning map change .
b Investigation and Reports-Planning
The Director of Planning shall cause to be made
by himself or members of the staff , and in co-
operation with other appropriate city departments and
consultants an investigation of facts and review of
all applications and documents presented hereunder
as will serve to provide all necessary information
to assure that the action of each applicant is
consistent with the intentions and purpose of
this Article .
At the appropriate stage (s) the Director of Planning ,
or designated representative , shall submit a prepared
report to the Commission for consideration and may
recommend that the application be approved as
submitted , approved with conditions , denied , or
returned to the applicant for revision .
c Review by Planning and Zoning Commission
Thereafter , the Commission shall review the application
for Planned Development and shall hold a public
hearing(s) as required . Atter such hearing , the
Commission shall determine whether the proposal
conforms to the criteria and Planned Development

Requirements as set forth in this Article , and shall
es either recommend to the Council that the preliminary
application and development plan be •
1) Approved ; or 2) Approved requiring changes
therein ; or 3) Shall return the plan and
application for revision ; or (4) Denied .
d . Council Consideration
Upon the recommendation from the Commission , the Council
shall advertise and hold a public hearing upon the re-
quest After the conclusion of such hearing (s) , the
Council shall either :
1) Approve the application as recommended by the
Commission ; or 2 ) Approve the conditions requiring
changes or impose such conditions of approval as are
in its judgment necessary to insure conformity to
the criteria and the Planned Development Regulations
as set forth in this Article ; or 3) Shall return the
plan and/or application for revision to the applicant ;
eN or 4) Shall deny the application as submitted ; or
5) May refer the application to the Commission
for their reconsideration and a subsequent report to
the Council
4 . Step Three : Final Application (Precise Development Plan)
a Approval of Step Three shall be given only when it can be
shown that the proposed project , or any stage of the total
development plan , meets all requirements as set forth for
final approval in this Article plus all requirements ,
stipulations , and modifications of the preliminary plan
as required by the Council have been met .
b . Within one ( 1) year after the approval of a preliminary
development plan , the applicant shall file with the De-
partment of Planning a final plan for the entire develop-
ment , or when submission in stages has been authorized ,
for the first stage of the development . The Commission ,
after the first year and at its discretion , may extend
the date for submission of the final plan for one ( 1)
additional year providing that the circumstances warrant
such an extension .
c The Commission shall not approve the final development
plan for any stage of the Planned Development if either
the total number of stages developed and /or the average
of the allowable dwelling units per stage , up to and in-
cluding the stage which is to be approved , exceeds by
more than twenty-five (25) percent the average number
of dwelling units per stage which is allowable for the
entire planned development

d . The Commission shall consider for approval all
final plans . Provided all the requirements of this
Article are met the Commission shall grant such
approval , except that where action of the City
Council is required said approval shall be subject
to City Council approval of specific items .
5 . General
a For any area of which the City has a valid
application for annexation and which also has a
valid application filed for a planned develop-
ment , the applicant shall have the base district
considered as an integral part of the Planned
Development application .
b Should the zoning of the base district be
inappropriate for a proposed PD , changing of the
base district shall be accomplished as an
integral part of approval of the Planned
Development application Under the PD application ,
the base district zone change shall not be approved
without approving the Planned Development Application .
Section 33 . 04 Documentation Content Required
The following information and documents shall be
submitted with the application to the Department of
Planning .
1 ,Step_One : Pre-Preliminary Stage Consideration
a . A letter of intent for a Planned Development shall
be submitted by the owner or authorized agent .
Before submitting an application for a Planned
Development , the applicant is urged to confer
with the Department of Planning to obtain an
application and discuss procedures , fees ,
schedules and assistance
An accurate map drawn to sufficient scale to
adequately show the boundaries and dimensions
of the site , a north arrow , the scale , names
and dimensions of all streets , alleys and ease-
ments bounding or touching the site . The map
shall also include schematic reference showing
the plot plan of the land in the area to be
developed indicating .
1 . The general relationship contemplated
among all public and private uses ; and

2 . The location , dimensions and direction of any
major physiographic features such as railroads ,
drainageways and existing man-made physical
features , and
3 . All private rights-of-way proposed ; and
4 . Location of all proposed structures ; and
5 . Location of all proposed common open space ; and
6 . Location of any flood hazard areas as
determined by the Federal Emergency Pre-
paredness Agency .
U An explanatory statement containing the following
information :
1 A showing of property ownership including
all easements ; and
2 . The source of water supply , method of sewerage
disposal and means of drainage ; and
3 . Approximate number and types of units proposed
for the site ; and
4 Any proposed non-residential uses (i . e . commercial ,
industrial , etc . ) ; and
5 . Public and private egress , and
6 . Areas to be devoted to various uses and
population densities contemplated for the
project , and
7 . The area total for the project site .
2 . Step Two . Preliminary Stage Consideration
a . One (1) transparency and four (4) prints of a
development plan of the entire development showing :
1 General location for vehicle and pedestrian
circulation indicating streets , driveways ,
sidewalks (if any) , pedestrian ways , off-
street parking , loading areas and provision
for fire and other emergency vehicles .
2 . Location and approximate dimensions of
structures together with the usage to be
contained therein and approximate location
of all entrances thereto showing character
and relationships of buildings , streets , and
open area .
3 A description of adjoining areas , uses or
structures which may affect , or be affected
by , the design or location of buildings of the
development or the uses or traffic circulation
therein Said description shall include
maps and information for at least four hundred
feet (400 ' ) beyond the development .

4 . A description of the general scheme of land-
scaping to be employed including the extent ,
location arrangement and proposed improvements
of all open areas , landscaping ,fences , and
walls . Said description shall include per-
spective schematic renderings . Proposed
provisions for maintenance of all open areas
shall be included .
5 . The Director of Public Works may require the
submission of contour information for a portion
of , or the total development site , when such
information is deemed necessary to adequately
evaluate the Planned Development . When re-
quired , the information shall conform at least
to the following minimum standards
i Contour information given shall be
tied to USGS or GLO datum. At least
one ( 1) bench mark , at or close to the
property shall be required . Contour
elevations shall conform to ground slope
intervals as required by Subdivision
Ordinance and/or:
ii . Contour elevations at the centerline
of all private and public streets ,
roadways , driveways and parking areas
within the project area.
6 . Cross-sections through the property showing grades
and building height relationships shall be included .
7 . General provisions to be made for utilities and
storm drains .
8 . General provisions for handling storm water
runoff shall be indicated
b . Four(4) copies of the following information and
documents .
1 A tabulation of the land area to be devoted to
various uses including an indication of land to
be dedicated for street , park , school , or any
OIS other purpose .
2 . A development schedule indicating (1) the
approximate date when construction of the project
can be expected to begin; (2) the stages in which
the project will be built and the approximate date
when construction of each stage can be expected
to begin .

3 . Architectural drawings , sketches , perspective
schematic renderings , or scale models necessary
to demonstrate the design and character of the
proposed development .
4 . A draft of the major points for covenants
proposed affecting the property
5 . A lighting plan including proposed street and
security lighting , an analysis of the effect of
such proposed lighting on adjacent property , and
such other information as may reasonably be necessary .
6 . A signing plan including the location , type , size ,
height and area of proposed signs .
7 An indication of whether or not land is to be
subdivided
8 . A certified legal description or boundary survey
by a registered engineer or registered surveyor
of the property , or properties , to he included
in the total development including all easements ; and
9 . Other relevant operational data and such reasonable
information as the Commission and/or Council may
require including an updating of all information
submitted for pre-preliminary approval .
3 . Step Three . Final Stage Consideration
The information submitted shall be sufficiently detailed
to indicate fully the ultimate operation and appearance of
the development and shall include all information submitted
in the preliminary plan plus the following:
a . The location of water , sewerage and drainage facilities .
b . Landscaping and planting plan showing location , number
and name of all trees and major shrubs ; trees over 6" in
trunk diameter to be removed by development shall be
so marked .
c . The character and location of signs in conformance
with the Zoning Ordinance .
d . Plans for street improvements and finished grades or
earth moving plansSpecific S ecific request for modification
of traffic barriers and provisions for the relocation
of utilities should be made
e . Location and dimensions of pedestrian walkways , malls ,
trails or any easements .
f . Comprehensive soils and geological reports substantiat-
ing the soundness of the development shall be submitted
by a soil analyst if required by the Building Official .

driveways and other access points .
h . Copies of legal documents required by the Council for
dedication or reservation of public facilities .
i Requirements for subdivision , if applicable , as set
forth in the Subdivision Ordinance .

,.� date when the stage i5 to be complete .
Section 33 .05 Staging
When development by stages is requested , the Planning
Commission shall review the preliminary application , re-
quired documents , proposed development schedule and any
other information or documents necessary to determine
that the proposed total development meets the intent and
purpose for "Planned Development" as set forth in the Zoning
Ordinance , and to further determine if in the judgment of
the Council the proposed development is of the scale and
design to warrant approval of staging .
When submission in stages has been authorized by the
Council , the following shall apply :
1 1he time schedule , as described in 33 .04 . 02 (b) (2) ,
indicating the approximate date on which construction
of the project will begin and the anticipated rate of
development shall become a part of the planned
development preliminary approval and shall be adhered
to by the applicant and any successors in interest .
2 . When more than one (1) area of a proposed planned
development area is proposed for subdivisions , sub-
mission of subdivision proposals for a specific area
shall not be made until such time as the developer
intends to proceed with each such area of development .
Section 33 06 Development Standards
In addition to , or as a greater requirement to the
regulations normally found in the district , the following
regulations shall apply to all development within a Planned
Development Zoning District .
1 Density - The developer shall propose a density subject
to Council approval. Upon the adoption of a City
General (Comprehensive) Plan the allowable density
shall not exceed that as set forth in said Plan . Further ,
the density shall not exceed that as permitted in the
base zone ; provided , that the density restrictions
of this section may be amended as set forth below :

a . Incentive Density Increases -
Design , character , identity , and architectural
siting variations incorporated into a develop-
ment shall be considered cause for population
density and building intensity increases not to
exceed fifteen (15 ) percent of that allowable
in the zone underlying the application , pro-
vided they make a substantial contribution to
the objectives of a Planned Developement . The
degree of distinctiveness, and desirable variation
achieved shall govern the amount of density/
intensity increase which the Council may approve .
The Council shall consider three major design
features of each project when considering incentive
density increases . The Council may grant up to
five (5) percent increase in density for each
of the three (3) major design areas which follow.
Some specific design features are included under each
of the three major headings to aid in the consideration
of each project ' s merit .
1 . Landscaping (Maximum increase of five percent (5%) :
1 . Street landscaping for this area ;
2 . Open space and plazas ;
3 Use of natural landscape ;
4 . Pedestrian way treatment ,
5 . Recreational areas .
2 . Siting (Maximum increase of five percent ( 5%) :
1 . Visual features ;
2 . Use of natural features (water , etc . ) ;
3 . View;
4 . Sun and wind orientation ;
5 . Circulation pattern ;
6 . Physical environment ;
7 . Variation in building setbacks ;
8. Building groups ( cluster , etc ) .
3 . Design features (Maximum increase of five percent ( 5%) :
1 . Street sections ;
2 . . Architectural style ,
3 . Harmonious use of materials ;
4 . Parking area broken by landscape ;
5.. Varied use of house types .

b Density Limitations --
If the Council finds that any of the following
conditions would be created by a proposed Planned
Development , it may either ( 1) prohibit any in-
crease in density , or (2 ) decrease the basic
density allowance by up to fifteen percent ( 15%)
in order to avoid the creation of any of these
conditions •
1 . Inconvenient or unsafe access to the Planned
Development ;
2 . Traffic congestion which could be projected on
the surrounding streets as a result of the
existing conditions and approval of the planned
development application , and which could
thereby create a potential hazard to the health ,
and genera] welfare of the residents which adjoin
the planned development site .
3 . Excessive burden on parks , recreational areas ,
schools , and other public facilities which serve
the Planned Development .
c . Planned Development in more than one ( 1) district --
If the Planned Development is in more than one ( 1)
zoning district , the number of allowable dwelling
units must be separately calculated for each portion
of the Planned Development that is in a separate zone ,
and must then be combined to determine the number of
dwelling units allowable in the entire Planned
Development
However , the distribution of dwelling units and lot
sizes within the Planned Development need not be
affected by existing zoning district boundaries .
Individual buildings , accessory buildings , off-street
parking and loading facilities , open area , and
landscaping and screeening may be located without
reference to lot lines , save the boundary lines of
the development .
When calculating density of a proposed Planned
Development , the total area , including street
dedication , shall be included .
d A proposed Planned Development may have specified
reasonable minimum lot sizes or other minimum re-
quirements for a part of , or all , of the planned
development area.

2 . Setbacks and Spacing between buildings --
a Perimeter setbacks - Generally these setbacks will
be those of the base district unless otherwise
approved by the City Council .
b . Interior setbacks - As approved by the City
Council , provided no Setbacks shall violate
requirements of the Iniform Building Code or
Uniform Fire Code .
f c . Buildings should be located in such a manner
so as to avoid , when possible , a corridor or
barracks-like effect .
d . Increased setbacks - Setbacks greater than those of
the immediately adjacent property may be required
where the intensity of development is greater than
that of the adjacent property to such an extent
that greater peripheral setbacks are needed in
order to insure the health , safety and welfare
of the inhabitants of the development of said
adjacent property .
e . In reviewing setback requirements the following
criteria shall help govern the degree an appli-
cant shall be permitted to deviate from the
base zoning district requirements
1 . A better or more appropriate design can be
achieved by not applying the provision of
the zoning district ; and
2 . Adherence to the requirements of the zoning
district is not required in order to insure
health , safety and welfare of the inhabitants
of the development ; and
3 . Adherence to the requirements of the zoning
district is not required in order to insure
that property values of adjacent properties
will not be reduced
3 . Height
^ a . Generally , no building shall exceed a height
which is twenty-five (25) percent greater than
that of the maximum building height limitation of the
base district in which the planned development
is proposed .
b . The Council may approve different extra limita-
tions not less than that provided in Subsection
a , provided that the proposed height is not
detrimental , incompatible or otherwise unde-
sirable with respect to existing or proposed

future surrounding area development , and provided
that one of the following situations can be found
to exist :
1 . That the height increase can be justified
on the basis of unique lot characteristics ,
topographical conditions , or other natural
features , or
2 . That the height increase can be justified
on the basis of amenities provided or con-
)cessions made by the developer for which
some bonus incentive is warranted
c . When the Planned Development abuts or is in
a single family base district , the building
height for the base district shall apply
within 200 feet of the said Single family
base district .
4 . Usable Open Area
a . There shall be a minimum of ten percent ( 10%)
of the total area of the Planned Development
dedicated or reserved as common usable open
area. Such area shall be clearly designated
on the plan as to character of use and develop-
ment , but shall not include .
1 . Private or public dedicated streets , alleys
and other rights-of-way .
2 . Vehicular drives , parking , loading and
storage areas
b . The required minimum lot area for any single
family dwelling unit within a planned develop-
ment project may be reduced by one ( 1) square
foot for each one (1) square foot of common
usable open area substituted in the project
site elsewhere , and provided that the minimum
lot area is not reduced by more than twenty
percent (20%) The substitute common open
area may not be counted toward the minimum
required open area for the planned development site .
c. With a planned development , a planned residential
area may have distributed without regard to the
underlying zone , the required open area.
d . When , with a PD , a planned residential area is
constructed by stages , the plans for usable open
area shall include provisions for such areas
within each staged area .

e . Required usable open area shall be complete as to
/, approved specifications prior to occupancy of the
planned development , or an approved stage thereof .
5 Off-Street Parking Facilities--
The following shall be applied in all Planned Developments :
a Parking requirements shall be equal to at least
the sum of the parking requirements for all uses
proposed and which is equal to that required by
Article 21 herein , except that those requirements
may be increased or decreased where the Council
determines that because of the location of the
property with respect to surrounding areas within
reasonable walking distance , and or public trans-
portation , or any other consideration reasonably
relating to the nued for parking in the development ,
such increase or decrease is appropriate However ,
in a commercial or industrial planned development
where it can be demonstrated by the applicant that
due to nonconflicting hours of operation , design
eN of the circulation and parking plan or any other
factor reasonably related to the need for parking
the total parking requirement can be reduced , the
Council may do so provided legal notice of the
application specifies that such reduction has been
requested
b Development standards shall he as provided in
Article 33 of the Zoning Ordinance except that the
following shall also be guidelines :
1 . Private streets may serve circulation and
parking purposes if providing adequately for fire
and police protection , rubbish collection and
lighting , as established by the Director of
Public Works and the Director of Public Safety .
2 . A building group may not be so arranged that
any temporarily or permanently inhabited building
is inaccessible by emergency vehicles .
3 . Driveways and circulation roadways shall be
designed to minimize traffic and congestion
within the Planned Development and to minimize
the amount of paving .
4 Circulation and parking areas shall be separated
from recreational areas to facilitate safe
vehicular movement In the design of the circu-
lation and parking plan , priority shall he given
to pedestrian access and activity

c . Any required parking spaces serving residential
uses shall be located within two hundred (200)
ek feet of the building containing the living units
served
Section 33 . 07 Dedication and maintenance of facilities --
The Commission may recommend and the City Council may
require as a condition of apprcval for any planned development ,
that portions of the tract or tracts under consideration be
set aside , improved , conveyed or dedicated for the following
uses :
1 Streets : That the right-of-way width designated
be dedicated to the City Such other streets necessary
to the proper development of adjacent properties may
also be required .
2 . Easements . That owner shall grant to the. City such
easements as will be required to insure the necessary
and orderly extension of public utilities , including
easements over all non-dedicated private streets over
eN which the City may need ingress or egress for the
purpose of protecting and preserving the health , safety ,
and welfare of the public and for the provision of
municipal services of which each citizen within the
City has a right to expect and may require at any
future time.
3 Underground Utilities : In any development which is
primarily designed for or occupied by dwellings , all
electric and telephone facilities , fire alarm conduits ,
street lighting wiring , and other wiring , conduits
• and similar facilities shall be placed underground
by the developer , unless waived by the Council .
4 Recreation Facilities . The Council may require
that suitable area for parks or playgrounds be
set aside , improved or permanently reserved for
the owners , residents , employees or patrons of the
development .
Section 33 08 Mixed Land Use
1 . Residential use mixed with other uses --
a . In a residential planned development of over
four ( 4) acres , or where development is by
stage and where commercial and /or industrial
uses are being developed in conjunction with
residential uses , construction of commercial

and/or industrial uses shall not be initiated
until a percentage of residential units to be
ON specified in the planned development approval
have been developed The Council may specify
stages of approval for industrial or commercial
use to coincide with a minimum percentage of
residential uses completed
b . A basic premise shall be that such retail and
service commercial development and /or industrial
development be ancillary to , basically serve ,
and integrate in a compatible fashion with the
primary residential use and character of the
planned development district and surrounding
properties .
Section 33 . 09 General Criteria
In addition , a planned development may be granted only
if it is found that the development conforms to all of the
following general criteria .
That the location , design , size , and uses ate
consistent with the General (Comprehensive) Plan ,
adopted _ by the City now or in the future , and with
any other applicable plan , development map , or
ordinance adopted by the City Council . If the
development plan is found to be in the public
interest , but is in conflict with the General
(Comprehensive) Plan , amendment of the General
(Comprehensive) Plan shall be approved before
approval may be granted for the Planned Development
application .
2 . That the location , design , and size are such that the
development can be well integrated with its surround-
ings ; is planned and developed with the intention to
harmonize with any existing or proposed development
in the adjacent neighborhood ; and in the case of a
departure in character from surrounding uses , that
the location and design will adequately reduce the
impact of the development so the project will not be
detrimental to the adjacent property .
ek 3. That the location , design , size and uses are such
that traffic generated by the development , except
in single family density , can be accommodated safely
without congestion on existing or planned arterial
or collector streets and shall , in the case of

OIN commercial or industrial developments , be
designed to attract and accomodate traffic
on local arterial or collector streets .
4 That the location , design , size and uses are such that
the residents or establishments to be accommodated
will be adequately served by existing or planned
public facilities and services .
5 . That the location , design , size and uses should result
in an attractive , healthful , efficient and stable
environment for living , shopping , working and
leisure activities .
6 . That the development plan makes appropriate
provision for th preservdtion of the environment ,
both natural and man-made .
Section 33 . 10 Planned Development Subdivisions
1 . Conversionso.t pre-existing subdivisions to
Planned Developments
a The Council may approve a Planned Development
for an area previously subdivided , in which
case said subdivision , and any structure con-
structed thereon , shall he considered in con-
formance with zoning requirements as to lot
size , setbacks , and height Such an area may
include a group of structures either sub-
stantially constructed or in existence at the
time of the effective date of this Ordinance ,
which structures when constructed were intended
to be similar in purpose and ate substantially
similar in design and purpose on the effective
date of this Ordinance .
b Applicants for conversions of pre-existing
subdivisions to Planned Development District
zoning shall follow the application and pro-
cedures for plan review as set forth in this
Article , except that during the pre-preliminary
conference the Director of Planning shall advise
the applicant as to appropriate modifications
which might be made in application requirements .
c . In a pre-existing subdivision , the signatures
of 51% of the property owned by both number
and area shall be required to initiate a
planned development application for such area.

Section 33 . 11 Supplementary Provisions
1 . Limitation on resubmission
Whenever an application for a planned development
has been denied , a similar application for the same
area or any portion thereof shall not be filed
within six (6) months after the date of denial .
2 Adherence to ap
proved plan and modification thereof
The applicant shall be bound by the plans and
narrati\ e for himself and his successors in interest ,
Ind by the conditions prescribed for approval of
the development . The approved final plan and
stage development schedule shall control the
issuance of all building permits and shall restrict
the nature , location and design of all uses . Minor
changes in an approved preliminary or final development
plan may be approved by the Building Official if
such changes are consistent with the purposes and
general character of the development plan All
other modifications and amendments , and all major
changes , including extension or revision of the
stage development schedule shall have a public
hearing for consideration and action by the Council .
Revocation for failure to adhere to approved plan ,
satisfy conditions of approval , or comply with
staple development schedule
In the event of a failure to comply with the
approved preliminary or final development plan
or any prescribed condition of approval , including
failure to comply with the stage development schedule ,
shall constitute a violation of this Article as
prescribed in Article 27 .
The Commission may , after notice hold a public
hearing and recommend the revocation of a planned
development zoning district . Thereafter the Council
shall consider the recommendation in the same
manner as in considering a rezoning request .
4 . .Expiration and reversion of Planned Development
Zoning District
If within one ( 1) year after the approval of the
preliminary plan and designation on the Apache
Junction Zoning Map by the Council , construction
specified in the final development plan has not been

commenced , or cannot be developed as approved ,
then the PD District classification shall be
recalled to the Commission for review. If it
has not been shown that it is in the public
interest , and if the applicant has not demonstrated
good cause necessitating the extension of time , the
Commission shall recommend the PD designation revert
to the base zone designation existing at the time of
approval of the Planned Development Zoning District ,
or other appropriate designation .
II however , the applicant shows good cause necessitating
an extension which would serve the public interest , then
the Commission may grant two (2 ) extensions of time to
commence substantial construction . Each extension
of time shall not exceed a one (1) year period .
5 . Transfers and assignments -
If during any stage of the development the property
under application , or any portion thereof , is trans-
ferred or assigned to another , then the transferee
OMS or assignee shall be bound to the requirement and
design of the approved project ; except that a transferee
or assignee may make application for a major change
of the application in which case the Council shall
hear the application as if it were a major change in
the Planned Development .
6 . Cancellation by applicant
Cancellation may be initiated by the applicant of the
property covered by the application by means of a
written Notice of Cancellation directed to the
Department of Planning Cancellation of the applica-
tion shall become effective thirty (30) days after
receipt of the Notice of Cancellation in the Office of
the Department of Planning .
7 Use or occupancy
No building or structure within the planned development
or portion thereof as approved for stage development
shall be used or occupied , and no change in the existing
occupancy classification of a building or structure or
portion thereof shall be made until the Building
Official has issued a Certificate of Occupancy thereof
as provided under the provisions of the Uniform Building
Code

8 Planned Development_precedents
eiNk The approval of departures from standards ordinarily
required for a base district zone , or for any other
planned development , shall not be considered as
precedent setting when approved for any individual
planned development project .
9 . Construction standards -- building_permit issuance
The provisions of the Uniform Building Code and all
other City codes and derailed standards shall apply
and control all design and construction of improvements
within a planned development .
10 . Map change and mapping
Map Chace- Approval by the City Council of the pre-
liminary development plan in accordance with the
procedures and requirements of the Apache Junction
Zoning Ordinance shall constitute approval of the
necessary amendment of the Official Zoning Map of the
^ City of Apache Junction and the map shall be changed
in accordance with the approved site area .
Whenever a planned development has been approved
and remains in effect , the boundary of the planned
development shall be indicated on the Zoning Map
of the City
11 . Termination of a Planned Development after .ompletion
A planned development may not revert to any base
district designation upon completion unless and until all
requirements of the base district are complied
with
Should the applicant or any transferree or assignee ,
of an approved planned development wish to discon-
tinue the PD use , or uses , upon or after completion ,
any use , or uses , of the land including the continua-
tion of the planned development zoning district
designation shall be reviewed and may be approved by
the Council .
SECTION II : REPEAL OF CONFLICTING ORDINANCES
All ordinances and parts of ordinances in conflict with
the provisions of this Ordinance or any part of the code
adopted herein by reference , are hereby repealed .

SECTION III : SEVERABILITY
If any section , sub-section , sentence , clause , phrase
or portion of this Ordinance or any part of the code
adopted herein by reference , is for any reason held
to be invalid or unconstitutional by the decision of any
court of competent jurisdiction , such decision shall not
affect the validity of the remaining portions thereof .
SECTION IV : EMERGENCY CLAUSE
Whereas , it is necessary for the preservation of the
peace , health and safety of the City of Apache Junction ,
Arizona , an emergency is declared to exist , and this
Ordinance shall become immediately operative and in
force from and after the date of posting hereof .

SUBJECT: Recorder-Logger Bid opening this date
Pursuant to the advertised "Call For Bids" and the specifications contained
therein for the Recorder-Logger equipment for the police department, I have
reviewed the one bid received from the Dictaphone Corporation and found it to
be in compliance with all specifications.
Bids were also solicited from Magnasync/Moviola Corp of North Hollywood, California
and Stancil-Hoffman Corp. of Hollywood, California. We were contacted by Stancil-
Hoffman regarding a locatfion of local installers for their equipment. No
communications was received from Magnasync/Moviola Corp. Neither firm later followed
our notice to them for "Call For Bids" by any submission of a bid.
Inasmuch as Dictaphone Corp. is a qualified bidder and within a figure which
repesents that of one lower than our budgeted estimate, I recommend that the bid
for the Recorder-Logger equipment for the police department be awarded to
Dictaphone Corp.

A RESOLUTION OF THE CITY COUNCIL OF APACHE JUNCTION
_ CREATING A BOARD OF APPEALS PURSUANT TO SECTION 204
OF THE UNIFORM BUILDING CODE, 1979 ADOPTED BY THE
CITY COUNCIL BY REFERENCE
WHEREAS, the City Council of Apache Junction did on
June 27, 1979 adopt by reference the Uniform Building Code,
1979 Edition as the Building Code for the City of Apache
Junction, Arizona and
WHEREAS, Section 204 of the Uniform Building Code,
1979 Edition does create a Board of Appeals whose purpose
shall be to pass upon all matters pertaining to building
construction; and
WHEREAS, Section 204 of said Uniform Building Code,
1979 Edition does provide that members of the Board of
Appeals shall consist of members who are qualified by
experience and training to pass upon such matters and that
the Building Official shall be an ex officio member of said
Board and shall act as Secretary of said Board and that the
Members of said Board shall be appointed by the City
Council ;
NOW THEREFORE BE IT RESOLVED, that to satisfy the
provisions of the Uniform Building Code, 1979 Edition, the
Apache Junction Board of Adjustments be and is hereby
designated to hear all cases which would come before the
Board of Appeals and to sit as the Board of Appeals,
established pursuant to Section 204 of the Uniform Building
Code, 1979 Edition.

loan vehicle service and it is a desirous method in which our

RESOLUTION NO. 80-12
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
PINAL COUNTY, ARIZONA AUTHORIZING AND DIRECTING THE DEPARTMENT OF PUBLIC
SAFETY OF THE CITY OF APACHE JUNCTION, ARIZONA TO ENTER INTO A VEHICLE LOAN
AGREEMENT WITH THE ARIZONA DEPARTMENT OF PUBLIC SAFETY TO PROVIDE FOR LOAN
VEHICLES ON A ROTATIONAL BASIS TO THE DEPARTMENT OF PUBLIC SAFETY OF THE
CITY OF APACHE JUNCTION, DECLARING AN EMERGENCY.
WHEREAS, the City of Apache Junction, a municipal corporation,
must begin to provide full-time police services to the City and its
residents on or before May 1 , 1980;
WHEREAS, the Arizona Department of Public Safety is capable of
providing loan vehicle services to the Department of Public Safety, City
of Apache Junction;
WHEREAS, the City is desirous of obtaining loan vehicles on a
rotational basis for law enforcement purposes and the Arizona Department
of Public Safety is desirous of providing said services and equipment;
NOW, THEREFORE, BE IT RESOLVED that the Department of Public
Safety of Apache Junction, Arizona, be and he is authorized and directed to
enter into an agreement entitled Vehicle Loan Agreement between the
Department of Public Safety of the City of Apache Junction and the Arizona
Department of Public Safety for the aforementioned loan vehicles.
FURTHER RESOLVED that the Department of Public Safety of the City
of Apache Junction, Arizona be and he is hereby authorized and directed to
execute any documents which may be necessary to implement said agreement.
WHEREAS, the immediate operation of the provisions of this
resolution is necessary for the preservation of the public peace, health,
safety, and general welfare, an emergency is hereby declared to exist and
this resolution shall be in full force and effect from, and after its
passage, by the City Council as required by the City Council .

It was with a great deal of pleasure that I
have read the first copy of "NEWS From Your
CITY". Virginia Seeman dropped one off on
my desk this very day and also left a num-
ber of copies in the lobby to be distributed
to the public.
The articles will do more for the image of
you people at Town Hall than anything that
I have seen in the form of releases in the
newspaper or any other media since Apache
Junction became a city.
Obviously, a great deal of effort and care-
ful planning went into this news letter and
I know that, properly distributed, the com-
munity will, for the first time, have an op-
portunity to review the facts as they are.

1. Mr. Jessamine opened the meeting at 7: 10 p.m. welcoming those
present and requesting the roll call of members.
2. Mr. Gero called the roll and determined all five
members to be present as indicated above.
3. Chairman declared that there was a quorum present at
this meeting. He noted there are two sets of
"Minutes" before the Board dated December 17, 1979
and February 21 , 1980.
4. Nesser/Furness /S to approve as circulated "Minutes" dated
TTe-Tember 17, 1979. Motion passed by roll call
vote 3-0-2 with Messers Nunn and Vaughn abstaining
in that they were not at the meeting of December
17, 1979.
5. Nunn/Nesser M/S to approve as circulated "Minutes" dated
Y bruary 21, 1980. Motion passed 4-0-1 by roll
call vote with Mr. Jessamine abstaining in that
he was not at the meeting of February 21, 1980.
6. Chairman announced the Board would take the continuance of
consideration of BA-1-80, application of Carl Ely
up next. He called upon the Executive Secretary
to present a report.
,+►, 7. Mr. Gero stated that a further check with Pinal County
Assessor's Office disclosed:
1. The 1975 date which had been given city
officials is the effective date assessing
the area as two separate lots (lots A & C)
began.
2. The official record shows that the
recording date of the lot split was
September 16, 1974, tw^ ;months prior to

Pinal County amending the CR Zoning
District requirements. Clearly lots
A & C were lawfully split while under
County Zoning jurisdiction.
8. Mr. Jessamine noted that the public hearing was closed on
February 21, 1980. To hold another public
hearing would require readvertising. However,
a substantial number from the neighborhood are
interested in the case as shown by their
attendance here. The Board would therefore,
entertain questions about what has been stated.
(Several minor points were clarified as to dates
as previously expressed.)
He then asked in view of the new information if
there were persons who felt they had substantial
information to present to warrant the Board
advertising for another public hearing. (None
was noted .)
9. Furness/Messer M/S "Be it resolved by the Board of Adjustment
the City of Apache Junction, Arizona that the
application of Mr. Carl Ely (BA-1-80) for his
property located at N1 NZ NE SW SE NE Sec. 22,
R8E, TIN G & SRB & M in Apache Junction, Az. be
approved granting variances to the subject
property located in a General Rural (GR) zoning
district of:
1. Reduction of the 14 acre requirement to
0.625 acre less the area reserved for
public right-of-way purposes.
2. Reduce one side yard minimum requirement
(the one furthest from the public right-
of-way) from 20 feet to 15.5 feet.
3. Reduce the minimum lot frontage from
100 feet to 49.5 feet.
This motion is made in recognition that the lot
is a pre-existing non-conforming lot of record
in Pinal County the split being recorded September
16, 1974 in conformance with the then existing
Zoning Ordinance requirements. Further, the
lot is of record July 1, 1979 as required by the
Apache Junction, Arizona Zoning Ordinance."
The motion passed by 4-1 by roll call vote with
/+l Mr. Nunn voting negative based on the fact the
neighborhood is opposed to the request.
10. Chairman allowed a five minute recess at about 7:45 to
discuss with the neighborhood the particulars of
zoning principles.
11. Chairman noting the Board was again in session stated that
the next item would be the public hearing for

case BA-2-80, application of Gerald Pancheri,
Trustee in behalf of Apache Junction Mobile Home
Park requesting certain variances of the Trailer
Homesite Zoning District be applied to the said
mobile home park in accordance with Section 2309
of the Zoning Ordinance in that the Park is pre-
existing and non-conforming to the City Zoning
Ordinance but had either approvals for certain
areas by Pinal County Planning or existed prior
to Zoning Enforcement by Pinal County. Applicant
stipulates that the variances requested are as
depicted in exhibits "A" through "E" attached
to the application. The case was advertised on
February 23, 1980.
He then called upon the Executive Secretary to
brief the Board and public present on the case.
12. Mr. Gero oriented the case on a sketch map for all present.
He noted that:
1. A major portion of the park was over
twenty years old.
2. The remainder was approved for con-
struction by Pinal County approximately
two years ago.
3. Depicted on sketches the existing Mobile
Home Park requirements of the City.
Although they are the sane as those
adopted by Pinal County, the approved area
cannot meet the requirements in all
regards.
13. Mr. Pancheri stated that he is among the owners of the property
subject to the application. He reiterated the
facts as stated above. Without the variances, the
entire mobile home park would not be in con-
formance. He requested approval for all the lots
within the park.
14. Board determined that the Apache Junction Mobile Home
Park could not comply in its present layout,
including the rear setbacks.
15. Nesser/Vaughn M/S "Be it resolved by the Board of Adjustment
UT—the City of Apache Junction, Arizona that in
case BA-2-80, application of Gerald Pancheri,
requesting approval of certain variances hereinafter,
to be specified within the Apache Junction Mobile
Home Park, identified as Parcel #8 on Pinal County
Assessor's Map 101-11 located in Apache Junction,
Arizona and being approximately 17.5 acres on this
date that the requested variances as stipulated
in applicants Exhibits "A" through "E" be approved
for the Apache Junction Mobile Home Park; further
providing that no habitable living area or other
main building in said park be located closer than

twenty (20) feet to another habitable living area
or main building within said park, further
provided that the applicant shall submit to the
Apache Junction Department of Planning no later
than March 17, 1980 any existing locations
where the twenty (20) feet of separation does
exist that such exceptions shall be approved to
the degree of the currently existing separations;
further provided that the applicant will not
permit the replacement of a non-conforming mobile
home with another non-conforming mobile home
the placement of which would exceed the variances
as specified herein."
The motion passed unanimously by roll call vote.
16. Board called a work session for March 17, 1980 at
7:00 p.m. or after any business that might be
scheduled to discuss Board procedures.
17. Board adjourned at 9: 10 p.m. there being no further
business on the agenda.

SUBJECT: Planning and Zoning Meeting Times Change
-For your information-
At the last meeting of the Planning and Zoning Commission they approved
unanimously changing their meeting time from the second and fourth
Monday to the second Tuesday at 7:00 p.m. Other meetings would be called
as per Chapter 11 "Planning and Zoning Commission." (See 11-1-5
"Meetings") This was done to facilitate the schedules of all members.
Their intention is that the Monday, April 14 meeting be the last
Monday meeting. They would continue with their heavy schedule due to
the workload by announcing in advance the other meetings. Special
business meetings could be posted. If an item required a public
hearing, there must be compliance with special notice requirements.
The staff will be publishing and posting notice of the change.

1. Mr. Baijo opened the meeting at 7:05 p.m. and requested
(Chairman) the roll-call of members.
2. Mr. Gero called the roll and determined members as indicated
above to be present. He noted the City Council has
accepted the letters of resignation from Messers
.�. Adams and Strange. Mrs. Baker called in and
indicated illness while Messers Hudson and Strickler
have business/job commitments.
3. Mr. Baijo declared that no quorum was present and therefore
no action could be taken by the Commission.
4. Mr. Howell Anderson made a brief informal presentation as to what he
is seeking as rezoning in Pinal County. He indicated
he would be able to be present Tuesday, March 18
at 7:00 p.m.
5. Mr. Haze Burch attorney for Mr. Halbert requested the Commission
make an advisory motion establishing a new time
and place for the public hearing. He suggested it
is common practice to carry over to the next meeting
an advertised hearing when no quorum is present.
He would not object to such an action by motion to
be contingent to approval of the City Attorney as
to procedure.
6. Sharp/Oltman M/S that rezoning case PZ-4-80, application of •
Marvin Halbert for Gold Dust Mobile Home Park to
establish initial zoning having been annexed, be
continued to Tuesday March 18, 1980 at 7:00 p.m.
in this same location, the motion to be contingent
upon a report from the City Attorney that such
action is permissible without a quorum. Otherwise,
the case will have to be readvertised.
The motion passed unanimously by those present.

1. Mr. Baljo Called the meeting to order at 7:00 p.m. and requested
Chairman the Executive Secretary to call the roll of members.
2. Mr. Gero called the roll and determined that six (6) of th-
Exec. Sec. eight (8) members of the Planning and Zoning Commission
were present as indicated above.
3. Chairman declared a quorum present.
4. Commission M/S to approve as circulated, "Minutes" dated
January 3, 1980. Motion passed 6-0.
5. Chairman announced that this is the advertised Public Hearing
on PZ-12-79, a request by Mrs. Hazel Lawther. He re-
quested the Executive Secretary to brief those present.
6. Executive indicated that this is PZ-12-79, a request to change
Secretary approximately 39,000 square feet of property from
General Rural (GR) to Multiple Family Residence (CR5)
which would allow approximately 20 units of as many
bedrooms as desired and questioned if the Planning and
Zoning Commission should endorse this density. He indic-
ated he thought that in general concepts this was
probably a good location for multiple family by planned
development.
7. Mr. Lawther spoke in behalf of his wife. He indicated that the
dimensions on the easterly side were off slightly and
that the parcel is not quite as large as shown on the
easel sketch. He indicated they definitely would
follow all requirements, that they originally owned .
30 acres in that area and have developed most of it.
No definite plan has yet been done indicating how many
units, etc. will be placed on the parcel.

8. Chairman asked if anyone wished to speak in favor or opposition.
No one came forth. Chairman then called for questions
from the Planning and Zoning members.
9. Mr. Strange questioned if the smaller lot would cut down on the
density and was advised by the Executive Secretary
that it would allow about 18 units, rather than the 20
units.
10. Mr. Lawther responding to a question from the Executive Secretary
stated time is of the essence because of unexpected
delays in the building industry, but they tA11 wait
several months if really necessary.
11. Chairman explained the Planned Development concept and reason
for asking the applicants to wait, including benefits
to the applicant, city, and surrounding land owners.
12. Oltman/Strange M/S to continue the public hearing on PZ-12-79 until
suit time and place as stated by the Executive Secretary
or applicant. Motion passed unanimously.
13. Chairman asked Executive Secretary to present case PZ-6-79
(Mr. Deane, applicant) .
14. Executive gave presentation on request PZ-6-79. He brought out
Secretary that should one drive on Tomahawk south it will
intersect with the proposed freeway and with Highway
1 60 just to the north. Adjacent uses are industrial,
vacant, or an RV park.
15. Chairman asked the Planning and Zoning Commission if they had
questions of Mr. Deane. Inquiry was made about
proposed use, Mr. Deane advised he would like to use
it for trailer repairs.
16. Adams/Baker M/S "I move that in case //PZ-6-79, application of
Mr. Frank Deane, owner of the parcel described as the
West 200 feet of the N 188.62 feet of the E 1156.34
feet of the NE 1/4 of SE 1/4, Sec. 28, TIN, R8E,
G & SRB & M located in Pinal County, Arizona, and common-
ly referred to as 1310 E. 17th Avenue in Apache Junction,
Arizona, be recommended to the City Council for a zone
change from General Rural (GR) to Light Industrial
(CI-1) for the reasons given below.
The subject site lies within an area bounded by Weeks
Wash (west) , industrially zoned properties and dev •
-
eloping as such (south) , undeveloped properties (east
and partially north) and a R-V park on the north.
Further, the general area has Tomahawk Road to the
east and Highway 60 just to the north. The general
area has barriers to other areas, thereby defining a
neighborhood area.

1. The industrial use would be a continuation
of existing industrial uses.
2. Access via Hondo to Tomahawk would place
industrial traffic on the major north-south
street which could connect to either Highway
60 or proposed Superstition freeway via only
major routes.
3. Land adjacent to flood plains can often be
better utilized for industrial purposes due
to building techniques and reducing family
concentrations in such areas.
17. Chairman announced that Pinal County is requesting a recommendation
on case #PZ-597-79 for rezoning within three (3) miles
of City limits.
18. Executive briefed Commission PZ-597-79 (Pinal County) an
Secretary application by Irby Cain for rezoning from General
Rural (GR) to Trailer Homesite (TH) and General
Commercial (CB-2) of 80 acres at the southwest corner
of Vineyard and the proposed Superstition Freeway.
19. Carl Weckerly explained the CB-2 (approximately 20 acres) is being
(agent for changed to CB1 at the request of Pinal County. Charles
applicant) Johnson of Weckerly's staff stated approximately 60
acres would be zoned trailer parks and the spaces
will be approximately 52' x 80' .
20. Executive inquired as to the proposed width of Vineyard ad-
Secretary jacent to the park? What type of fencing would be
around the park? What would be the source of water,
and what flow rate will it be supplied? What are
plans for fire hydrants? Is there flooding or sub-
sidence in the area?
21. Applicants replied Az. Water has just brought new well in that
same area. Negotiations are progressing to obtain
water services to the park. In reference to access,
there will be fence or wall around park with "crash"

22. Executive gave statistics on vacancies in Trailer Parks in
Secretary Apache Junction of at least 2916 total spaces
(RV and Mobile Home) only 2294 are occupied. Mobile
Home parks are 94% full and parks in general are 78%
occupied. Additionally, nearly 118 acres in Apache

for 1175 spaces or if RV's 1645 potential spaces.
In addition, within a few miles of the City are
approximately 200 acres zoned TH; 2000 additional
potential mobile home spaces, 2800 potential spaces
if RV's, or a combination of both. There is the
potential of doubling the number of available spaces
already zoned for RV's or mobile home parks. We must
be prudent in the amount of area zoned for trailer
parks. The rezoning would be inappropriate from an
environmental point of view, in that the Freeway
will carry huge amounts of traffic. Due to the hydro-
carbon emissions, light, and sound pollution areas
adjacent to freeways are not acceptable environments
for residential use. Based on the above, he suggested
the Commission recommend denial of this request.
23. Strange/Baker M/S to recommend denial as per the attached recommendation
to Pinal County. The motion passed unanimously.
24. Executive gave presentation of PZ-1-80,Pinal County, requested by
Secretary James Copeman to rezone 40 acres from General Rural
(GR) to Heavy Industrial (CI-2) zoning in Pinal County
within three (3) miles of Apache Junction.
25. John Barber stated he is representing Mr. Copeman. Mr. Copeman
wants to take various ores from mines he is working
in the Superstition Mountain and store them on this
land until enough is collected to take the ore to
the smelter in Superior. This is low grade ore, and
would need zoning for storage of rocks, soil, etc.
This is entirely surrounded by State land, and would
not be fenced. The site is approximately 1/4 mile to
Baseline on the south. Gold, silver, copper and tur-
quoise will be the main ore types. There could be a
possibility of other uses than stockpiling, as it is
40 acres, including other industrial purposes.
26. Sharpe/Adams M/S to recommend approval to County Board of Supervisors
as per attached recommendation. Motion passed unanimously.

That in Pinal County Case 11PZ-597-79, application of Irby Cain,
owner of the parcel described as N1/2, SEA, Sec. 31, TIN, R8E, G&SRB&M,
Pinal County, Arizona that the City of Apache Junction Planning and Zoning
Commission recommend to the Pinal County Board of Supervisors the denial of
the proposed rezoning from General Rural (GR) to Trailer Homesite (TH) and
General Business 2 (CB-2) as per attached map. The reasons are:
1. The intersection of Superstition Freeway and Ironwood will be
the main entrance to the City of Apache Junction upon the com-
pletion of the Freeway. Realizing that zoning districts should
establish in principle present and future land uses, trailer
homesite zoning is inappropriate for this major transportation
route.
2. The present and future economic health of the County and City
require planned areas be established where jobs can be created.
There is a substantial population in Apache Junction which is
directly to the north of the subject area.
Through established zoning it would be difficult to create
industrial areas suitable for industrial parks within areas
of the City where utility services and transportation might
also be provided while giving due consideration to environmental
questions. Incidently, the City has requested the County study
this general area for establishing industrial zoning.
3. Locations adjacent to Freeways are proving unfit living environ-
ments due to auto emissions, noise, glare, etc.
4. There are currently no plans or agreements for fire services or
water services to the site.
5. During the first week of January 1980, the City of Apache Junction
surveyed mobile home parks/R.V. parks and determined the following:
a. There are at least 2916 total spaces (R.V. & Mobile
home) in Apache Junction. •
b. At least 2264 spaces are occupied.
c. Percent occupancies are approximately:
Overall == 78%
Mobile home parks = 94%
Recreations) vehicles = undetermined
This indicates a possible weakness in the R.V. industry

SUBJECT: PURCHASE OF FRONT END LOADER
We would like to purchase a front end loader at this time. I feel that this
.•. front end loader can cut our operating expenses considerably. We are
periodically having to rent a front end loader which costs us one hundred
($100.00) dollars a day. We are going to try to do a lot of the on-site
work on our new city complex such as backfilling; water, sewer, electrical
and telephone trenches; as well as around our septic tank. We have for
sometime needed a front end loader to clean away some of the rubbish along
our streets, such as piles of dirt and weeds which are a fire hazard and
also an eyesore to the public. There are a lot of our gravel streets which
are in need of repair. We can use this front end loader to help haul gravel
for repair and also asphalt for our paved streets. A front end loader will
ease the work load of our large patrol and be able to do the smaller jobs
that the large patrol is now doing. The loader will also free some of the
workers to take care of other jobs that are being neglected.
This front end loader will also handle the following attachments:
1. Rotary broom sweeper.
2. Mowing machine.
3. Post hole digger.
4. Rear blade.
5. etc.
Since this tractor can handle all these attachments, it would eliminate the
purchase of other separate pieces of equipment.
