CALL TO ORDER Vice-Mayor John Granillo called the meeting to order at 7:00 P.M. at the Apache Junction City Hall . INVOCATION Councilman Eidson gave the Invocation. PLEDGE OF ALLEGIANCE Vice-Mayor Granillo led in the Pledge of Allegiance. Box 515, Apache Junction had three questions as follows. 1. Are the Police Officers of the Apache Junction bonded? 2 . Has the Council in the last two weeks had time to consider a reply to his question on why the City does not take Cash for Bail? 3. If not, how does one go about getting the law changed before cash can be applied for bail? City Manager Lee answered in detail that the Department of Public Safety's policy is not to handle cash and the requirements to handle bail with a money order are under our current contract with the Pinal County Sheriff's Office. Also in answering Mr. Condra's questions, Mr. Lee explained that the City Officers currently are not bonded and not obligated to handle full service until May one. Robert Condra asked come May one will the City Police Department still not be under the bonding system. City Manager Lee explained that would be a dicision of the City and gave an outline of what the decisions would be based on. CITY COUNCIL MINUTES REGULAR MEEA4NG 4/16/80 Page 3 Assistant City Attorney Goodwin responded that the City Attorney's Office did answer the question that was brought before the City Council at the last meeting on why the City did not accept Cash for Bail . Miss Goodwin stated she would forward Mr. Condra a copy of the letter. Mr. Brad Durham, spokes- man for Ted Ledsetter, Elmer Wood and Danny Bush who reside in the Cestin Valley Trailer Park, expressed his concern of the condemnation of all the trailers in the Park. He further explained the problems they would have in evacuating as they are low income families living in that park. Mr. Durham presented the following petiton signed by the residents of the Cestin Valley Trailer Park: WE, THE RESIDENTS of Cestin Valley Trailer Park having been served notice by the City of Apache Junction to evacuate our homes with no alternative other than prison and the discrimination against low income families and children who are residents of this City do group and bind ourselves together for the cause of saving ourselves and our children from the financial and emotional burden placed upon us. That the burden should be born by the City of Apache Junction. We hereby set our seals with our signatures. Signed the residents of Cestin Valley Trailer Park. Mr. Durham further expressed concern on the cost of finding other places to live, requesting the City for assistance and direction. Vice-Mayor Granillo called on Building Official Leo Frazier to give an explanation of what has transpired. Building Official Leo Frazier explained in detail building code violations at the Cestin Valley Trailer Park, noting there have been approximately 17 fires at the park since 1973 and 2 electrical fires within the past year. Mr. Frazier further explained that pursuant to the Uniform Building Code, he served the manager, Mr. Lipovic , with notice after inspection of the park and finding numerous violations. Mr. Frazier stated he posted notifications on the individual units and attached a letter of explanation to the residents regarding the evacuation of the units. Mr. Frazier stated the electrical system was a life threatening situation and the premises should be vacated. Mr. Frazier further reported that there had been an electrical contractor into the Building Department to pick up an application and specifications, and informed him that he will have the permit, application and drawings for the revision of the electrial system by Monday. The City Council asked questions pretaining to who were the owners of the trailers and the dangers that are of an immediate concern. Mr. Frazier explained that there are provisions in the code that as long as there is action on correcting the situtation the evacuation could be put in abeyance. The action to correct the situation must be continuous, it can not be put off for three months. CITY COUNCIL MINUTES REGULAR MEF34NG 4/16/80 Page 4 Vice-Mayor Granillo summed up the matter saying Mr. Durham stated his concern and Mr. Lipovic is taking action to correct the problem. Vice-Mayor Granillo suggested to give Mr. Lipovic a chance to correct the problem in the given time and if he does not, the City Council may have an emergency meeting. Robert Dugger, 710 S. Lawson, instead of upsetting sixty-five families by saying you have to move out, why couldn't Mr. Lipovic be given 30 days to straighten the matter out. Al Limber, 126 S. Tomahawk at the Tomahawk Trailer Park, Apache Junction, stated that the question on who is the electrical inspector has not yet been answered and would like to know the answer to that question. Building Inspector Leo Frazier stated he believed the question asked was if there was a specialty electrical inspector and the answer was no. There are two inspectors working for the City including himself and both of them have at various times been licensed as contractors in just about every phase of building construction. CITY MANAGER'S REPORT ) City Manager Lee called on the Director of Planning, Joe Gero, to report on the up coming Town Hall Meeting. Planning Director Gero reported on the Town Hall meeting scheduled for April 26th, for the purpose Of putting together a City Plan for the Community, educating staff, Commission members and citizens prior the proposal of the recommended City Plan. Mr. Gero went over the proposed agenda for the Town Hall Meeting. PUBLIC HEARINGS ORDINANCE NO. 44, REZONING CASE PZ-5-80, BUCK (SECOND READING) ) Vice-Mayor Granillo opened the public hearing for Rezoning Case PZ-5-80, Ordinance No. 44, the applicant Mr. Virgil Buck. Vice-Mayor Granillo called on the Planning Director to brief the City Council on the case. Planning Director Gero referred to the sketch and explained that the property is located at 252 N. Ironwood and the surrounding property is zoned General Rural . The application has been heard before the Planning and Zoning Commission and a copy of their recommendation is in the Council 's packet. The Commission recommends to the City Council the approval of the Rezoning Case as request- ed by Mr. Buck to CR-4, multiple residence. Mr. Gero futher explained the reasons for the recommendations. Mr. Virgil Buck, the applicant, 252 N. Ironwood, stated that Mr. Gero explained the case very well and did not wish to add any more. CITY COUNCIL MINUTES REGULAR MEETING 4/16/80 �. Page 5 Vice-Mayor Granillo asked Mr. Gero if this Rezoning would revert back if the applicant does not start the improvements within a given time. Assistant City Attorney Susan Goodwin explained that there may be a provision in the zoning code that might cover it and require a reversion, but was not sure without further research. Vice-Mayor Granillo asked if any one in the audience wished to speak in favor of the petition. John Haber, 1151 S. Virginia, stated that his property is all occupied now, and explained what structures are in the area now. Planning Director Joe Gero explained the property in question has 32700 square feet of gross area. The Ordinance allows one dwelling unit per 3500 square feet. The total area is sufficient to meet the requirements of the Zoning Ordinance, in addition the ordinance does specify set backs between main buildings from the property lines. Vice-Mayor Granillo asked if any one in the audience wished to speak in opposition of the petition. No response from the audience. Planning Director Joe Gero stated as Planning Director he has gone over this particular area, has found that this area will have to have some kind of a transistion and he concurred with the recommendation of the Planning Commission and pointed out that no one spoke adversely at the Planning Commission hearing, although some people did ask questions. Mr. Gero recommended approval for the same reason as given by the Planning and Zoning Commission. Vice-Mayor Granillo declared the public hearing closed. Aoki LIQUOR LICENSE TRANSFER FOOD COUNTRY STORE, C.K. , HERRERA Vice-Mayor Granillo opened the Public Hearing for Transfer of License, Person to Person, the applicant Juan Herrera and Ofelia Jimenez Herrera and stated that if the applicant is present he may speak on his behalf at this time. Juan Herrera, Queen Creek, stated he purchased the store from Mr. Sanchez and would like the liquor license transfer. Vice-Mayor Granillo asked for questions of the City Council , and from the audience. Being no one wished to speak on the matter, Vice-Mayor Granillo closed the Public Hearing. I appreciate your bringing this matter to my attention. The City's interest in this bridge is certainly understandable and I will do all I can to be of assistance. Baseline Road is not the responsibility of the Arizona Department of Transportation and, therefore, we would have no jurisdiction over a bridge on the route. On your May 7, 1980 meeting there is a scheduled public hearing on the establishment of the initial zoning for Gold Dust Mobile Home Park. The applicant has requested a zoning classification of Trailer Homesite (TH) . The Planning and Zoning Commission held their advertised public hearing in consideration of this request on April 14, 1980. During the hearing the Commission learned the following: 1. Gold Dust Mobile Home Park is an existing Mobile Home Park. However, there are portions of the park yet to be developed. 2. Those portions that are yet to be developed would be subject to the Zoning and Building Code requirements at the time of requesting development permits. 3. A portion of the park which was developed under Maricopa County Zoning Ordinance standards would not be in compliance with the City of Apache Junction Zoning Ordinance requirements. These exceptions to the City's Zoning Ordinance would be minimal in terms of impact. Moreover, the development of the park generally exceeds the requirements of the City of Apache Junction Zoning Ordinance. 4. The park owner Mr. Halbert, has agreed to comply with a requirement that those sights which have mobile homes placed upon them but which do not have complete permits, that the park owner would within 90 days secure the appropriate permits from the City of Apache Junction Building Official. And at the time of hook-up of units in already developed areas, the mobile homes shall have to only meet these requirements consistent to the rest of the developed area, provided no limit shall be required to exceed the City Zoning Ordinance requirements. The reasons for the recommendation are: 1. The Mobile Home Park is an established park 2. The granting of approval would subject the owner to obtaining in a reasonable time these outstanding building permits which are to protect the public health, safety and general welfare 3. The Mobile Home Park is generally developed in ^ compliance with Article 20 of the Zoning Ordinance. Further, the Commission recommends to the City Council that in establishing the initial zoning ciassification that this be done declaring an emergency in that the procedures have been rather lengthy and by such procedure the owner would then be permitted to proceed in an orderly fashion to meet the upcoming season requirements. Gero, Planning Director for Planning and Zoning Commission SUBJECT: Ordinance 1142 - proposed annexation of Section 32 The Apache Junction School Board has submitted a petition requesting annexation to the City of Apache Junction, Their request includes the land they own and the parcel they lease from the State Land Department. Tie State Land Department has submitted a letter to the School Board in which they state in part: "we neither protest nor take a position of advocacy for annexation." The AORCC grant for funding certain recreational facilities at the school's complex located at Ironwood and Southern has been approved. This joint city-schools project will be constructed under city super- vision. Further, it will be the responsibilty of the City to provide scheduling for the use of the facilities. Other than the school use, the remainder of Section 32 is in State trust and/or resctved for the Superstition Freeway. Two of the pro- posed ramp locations would be in Section 32 and the determination of zoning for such property will be at the discretion of either Pinal County or the City, if annexed. To convey the Apache Junction High School and Board of Education office into the corporate limits of the City of Apache Junction, Arizona. 2. To enable the students and faculty to enjoy the many advantages of being able to participate in various municipal activities. During the discussion the following findings were made: 1. The subject area is contiguous to the municipal boundary of the City of Apache Junction for one mile. 2. The Apache Junction school district has, by petition, requested annexation to the City of Apache Junction of their property, owned and leased, located in the subject Section 32. 3. The rest of Section 32 is Arizona Trust Properties or right-of-way for the proposed Superstition Freeway. By letter the State Land Department has indicated that: "we neither protest nor take a position of advocacy for annexation". 4. The City of Apache Junction has jointly applied with the Apache Junction School District for an AORCC grant which has been approved to provide certain recreation facilities to the mutual benefit of the school program and residents of the community. Although there is no legal requirement, such facilities should be within the corporate limits and are the obligation of the city for scheduling. 5. The area is generally undeveloped and the demand for most municipal services, until development occurs, will not be great. 6. Section 32 is within the Township and is provided Fire Protection service by the Township Fire Department. This section supercedes the Building Code fees schedule found in Table 3-A of the Uniform Building Code (UBC) . This .•. proposal would delete the fees from the Zoning Ordinances. The City Council would then have the option of ratifying, by resolution, the fees as found in the UBC. The Commission felt that it could not just consider the elimination of a fee without considering the substitution that might take place. The Com- mission passed the following recommendation by a 6-3 vote: "BE IT RESOLVED by the Planning and Zoning Commission of the City of Apache Junction, Arizona, that it recommends to the City Council the approval of Ordinance No. 41 (PZ-6-80) . Further, it is recommended that the Building Official be instructed to use Table No. 3-A "Building Permit Fees" as found in the currently adopted Uniform Building Code (1979 Edition) , but that the schedule of fees be adjusted not to exceed seventy percent (70%) of the scheduled amount, and that the immediate implementation not exceed fifty percent (50%) , and the distribution be subject to review." The Commission was presented information as to three methods of deter- mining the cost for performing the building inspection/plans review service. The methods included budget analysis, experience of other cities in the area, and analyzing the average cost as applied to Table 3-A in the UBC. Each of the methods resulted in approximately the same figures. The conclusion staff derives is that by using a seventy percent (70%) modified to table 3-A of the UBC, the cost of performing the service would be equated. If a percentage less than 70% is used, the tax payer would be subsidizing the service. If a higher percentage is used, then monies beyond the cost of service would be derived by the city. Mr. Gero gave the location of the request and stated the case has been properly advertised. He stated this request is to allow variances of setbacks to complete construction of car- port, Lot 66, "Azure Skies", also known as 641 S. Gold Drive, and to allow the required parking to be placed in the front yard setback. 7. Chairman opened the hearing to the public for comment. 8. Mrs. Luddy spoke on behalf of her husband and herself. She said they had made every effort to comply Page 2 - Board c 4djustment ,ri, by the law. She stated the error was made of giving them a permit by the Building Official/Zoning Administrator. Mrs. Luddy said she had several signatures signed by ,m, adjacent residents not objecting to the carport. 9. Resident spoke in disfavor of the petition stating that property value could be harmed if allowed to remain. 10. Chairman asked Mr. Gero if there were any instructions to the Board. 11. Mr. Gero read from the Zoning Ordinance the questions which the Board of Adjustment must answer to prior to making a motion. 12. Chairman declared a short recess. Meeting resumed at 8:00 p.m. with the Chairman asking Mr. Gero for a recommendation. 13. Mr. Gero noted that the City Code provides specific remedy in case of an error by the Building Official and that process has correctly been carried out by Mr. Frazier. The Luddy's are not contesting the Building Officials decision. They are seeking two variances as stated above. The Luddy's had the home built and are the original occupants. They caused the enclosing of one parking space for a hobby shop area and the other space is by the owner's choice a patio area. Unless the owner provides one on-site parking space not included in the front setback area, the applicant would be violating the Zoning Ordinance. The remedy would be to use the on-site area for parking as the other neighbors must also do. If the above is accomplished then there is no need for the carport. Other than sentiment for error there is no distinguishing reason to separate the applicant from his neighbor with regard to the setback. Further, the applicant submitted plans for the carport which were in error showing the setback from the curb line which is not the property line. The applicant indicates they made inquiry but they didn't identify where the property line was. At issue is whether the Board will be able to distinguish this case from future similar requests. The reasons for the decision are: 1. There is no unique hardship shown. The applicant, who has been the sole owner of the property, made a previous decision to enclose the parking area as a convenience to himself. 2. The City Code provides the remedy when an error is committed by the Building Official. That procedure has been correctly followed. p 3. The applicant submitted a site sketch which is in error assuming the curb line to be the property line. The motion failed by a 2-3 vote with Messers Nesser and Furness voting for the motion. 16. The applicant is requesting certain variances in setbacks and space sizes to allow completion of the park and use of property known as Big Mountain Mobile Home Park located at 1100 S. Warner Drive, in compliance with a plan prepared prior to the adoption of Pinal County and City of Apache Junction's Zoning Ordinances. 19. Chairman opened the hearing to the publicfor comment. 20. Mr. Gruner requested that variances be approved for the .�.. existing developed area which would allow existing units to remain in their locations. Further, he is requesting that for the area yet to be developed, that the rear setback be re- duced to the same as other units along the westerly property line, but meeting all other setbacks, He stated there are no fire hydrants within 800 feet of the furthest point of the park, and there are no swimming pools in close prox- imity. 21. Mr. Gero recommended that in view of the change by Mr. Gruner with regard to the setbacks that the portion yet to be developed be held over and that Mr. Gruner furnish a site plan for the area. Mr. Gero called the roll and determined eight of the nine members to be present as indicated above. 3. Chairman declared a quorum present at the meeting, noted there were two sets of "Minutes" dated March 18th and March 24th, 1980, and suggested they be moved to the end of the meeting. 4. Chairman announced the public hearing opened on PZ-4-80 and asked the Executive Secretary to brief those present. 5. Mr. Gero briefed those present on PZ-4-80, (Ordinance No. 45) stating it is a request from Mr. Marvin Halbert, enabled by, Commission Initiative, to establish initial zoning for Gold Dust Mobile Home Park, the park having been annexed to the City effective February 16, 1980. He directed the Commission's attention to the map of Gold Dust Mobile Home Park and pointed out undeveloped areas that would have to conform to City requirements in order to be improved. At the present time there is 15.4 acres developed. The park generally equals or exceeds the setbacks established by the City of Apache Junction, in that many of Maricopa County's requirements are greater than the City requirements. -2- /"\ON . There are a number of sites which apparently do not have permits from Maricopa County, or have partial permits. There are a number of sites within the de- veloped area which are vacant, or have stored units upon them. At the time of hook-up those sites should have to only meet those requirements the rest of the developed area has provided where_the requirements do not exceed the City Zoning Ordinance requirements. Mr. Halbert has submitted a request to the City Council asking the rezoning be considered with the emergency clause. 6. Haze Burch Attorney representing the applicant, stated the owners are anxious to begin development of the two areas of the park. As indicated on the site map, Mr. Halbert has made substantial financial commitment to the rest of the park which is already constructed, and has secured financing for this new development. Mr. Al Shumate, a partner is present also to answer questions. 7. Commission inquired as to the following: 1. Question: What is the Park occupancy rate at this time9 Answer: About 75-80% full (Halbert) 2. Question: Why has Maricopa County alleged certain zoning regulation violations as set forth in their letter? Answer: Their appears to be an error on the part of Maricopa County officials as to what per- mits have or have not been issued. However, Mr. Halbert would be glad to comply with requirements of the City to secure permits. (Burch) 3. Question: Why is the emergency clause requested9 Answer: Park developers have made considerable investments to date. In order to make a return they must be competitive and ready to do business when the fall visitores arrive. This necessitates obtaining permits at this time and getting the work done. Mr. Halbert began this process in the fall of 1979. Noting nobody else wished to speak for or against the request the public hearing was closed. -3- 8. Kell/Oltman M/S BE IT RESOLVED by the Planning and Zoning Commission ,/, of the City of Apache Junction, Arizona that in Zoning Case PZ-4-80 application of Marvin Halbert, by Commission Initia- tive, to establish the initial zoning classification as Trailer Homesite (TH) of the Gold Dust Mobile Home Park, a parcel of land described as: Beginning at the Northeast corner of Section Twenty- four (24) TIN, G&SRB&M, thence South 355.09 feet to the true point of beginning, thence West 660.5 feet thence South 1785.04 feet, thence East 361.3 feet, thence North 300 feet, thence East 300 feet, thence North 1,485. 18 feet to the true point of beginning containing twenty-five (25) acres more or less. and also known as 202 N. Me-idain Road that the initial zoning be approved as Trailer Homesite (TH) subject to: 1. That the park owner apply for and gain approval from the Building Official within ninety (90) days from the date of approval by the City Council of the zoning classification for those sites not having a valid building permit but which are being occupied for residential purposes. (at least sites 7, 26, 28, 52 and possibly 9 and 31) . 2. That setbacks established in areas already developed shall be granted "grandfather" variances. And at the time of hook-up of units in already developed areas, the mobile homes shall have to only meet these requirements consistent to the rest of the developed area, provided no limit shall be required to exceed the City Zoning Ordinance requirements. The reasons for the recommendation are: 1. The Mobile Home Park is an established park 2. The granting of approval would subject the owner to obtaining in a reasonable time these outstanding building permits which are to protect the public health, safety and general welfare 3. The Mobile Home Park is generally developed in • compliance with Article 20 of the Zoning Ordinance. Further, the Commission recommends to the City Council that in establishing the initial zoning classification that this be done declaring an emergency in that the procedures have been rather lengthy and by such procedure the owner would then be permitted to proceed in an orderly fashion to meet the upcoming season requirements. -4- /IN The motion Passed unanimously by roll-call vote. 9. Chairman announced the public hearing on PZ-7-80, Commission Imitative, a request of certain homeowners for rezoning a portion of the subdivision known as Azure Skies, and asked for Executive Secretary to brief those present. 10. Mr. Gero stated this request is being heard through Commission Initiative for rezoning lots 13-39, 52-73 and 86-112, inclusively, from Trailer Homesite zoning to Single Family Residence (CR-3). He also noted the owner of certain vacant lots had signed the petition. 11 . Las'cally they do not want to have the possibility of mobile 'cores being placed in an area developed on single family homes. 12. Ni . Gero stated the area would comply with the CR-3 zoning requirements and is developed in such a manner that it has the appearance of having already been so zoned. He recommedned the rezoning and noted this is one of those areas where rezoning would establish property values in compliance with zoning. 13. Chairman inquired if anyone else desired to speak. Noting none, the public hearing was closed. 14. The motion passed unanimously by roll-call vote. 15. Chairman announced public hearing on PZr6-SQ1 "Fees' schedule, and asked the staff to brief those present. 16. Building Official Leo Frazier reviewed current city Building permit fees1 the fees in the UBC, the fees changed in surrounding cities and stated the Building Department is losing $120Q a month: in salaries alone because of the low permit fees, Re also pointed out the inaccuracies in other portions of the fee schedule, that for instance, a Building permit fee to construct a fence would cost more than the fee to construct a house. He would like to see the Building Department generally on a self supporting basis. -5- 17. Commission inquired into the following: Question: How do the city building permit fees compare with Pinal County fees? Answer: They do not compare. The county does not administer a building code program. Their fee is a zoning site review re- quiring less work and their fees are lower. (Frazier) Mr. Laabs responded that the County fee is about 500% that of the City. Question: Does the Commission set or recommend fees, or are they limited to recommending on proposed Ordinance No. 41? Answer* The Commission's task is to recommed on proposed Ordinance #41. However, it would be unfair to require a recommendation be made without informing the Commission as to the consequences of the action and allowing them to make a recommendation should they choose. Question: Inquiry was made as to what the 65% fee for plans review on mobile homes will cover. Answer: New state law has established a flat fee of $40, ani the City now is a participant of the program. This new law supersedes the recommendation. 18. Mr. Hudson stated he thought the cost of inspection program should not be paid by the taxpayers, but by the people needing the service. Question: What is the number of inspections required for a new home? Answer: Usually 5-8. -5- 19. Joe Morvak commented building permits should cover expenses of the building department, however, because of interest rates it is too large an increase at this time: 1000 sq. ft. the fee would be $150. FHA requires 5 inspections. Suggests reinspection fee if it is not ready for in- spection when inspector arrives. 20. Mr. Laabs stated that before any fees are set there could be a projection of the budget needs of the Building Department. A1so,they could come up with a preliminary cost estimate of what is going to be done next year. They should be able to come up with adjusted formula before the figure is set. 21. Mr. Kell Is it proper to call for a wc :k session and come up with something possibly mote workable9 22. Mr. Gero advised the Commissionto make a motion to continue public hearing if they decide on a work session. He indicated a need for reasonable fees as expeditiously as possible. The city, being new, does not have a track record as far as budget goes. The UBC establisheda fee based on eiN national experience for cost. An Arizona multiplier of 92% has been established. This proposal calls for a 70% fee, 22% under the Arizon-i multiplier. 23. Hudson/Kell M/S to continue the public hearing on Proposal Ordinance to April 29, 7:00 p.m. in this same location. The staff is requested to prepare more information and call a work session. The motion passed unanimously by roll-call vote. 24. With a interchange at Hwy. 60 just east of the site, it doesn't appear Goldfield wauld go through at this location, thereby having CB-2 on a dead-end street. The land is currently zoned Suburban Homesite (SH) . The applicant is requesting another 80 acres be rezoned TH. The Commission is aware of the figures already developed on the acreages vacant but zoned TH. I recommend denial on both of the above. 30. He noted there were three sets of "Minutes" dated January 14, 1980; February 25, 1980; and March 10, 1980 and requested a motion as to the "Minutes". 4. Chairman armour-cad that the next items would be the public hearing item PZ-1-80 (Ordinance 32) , PZ-2-80 (Ordinance #34) , a� PZ-3-80 (Ordinance #33) . He requested the Executive Secretary brief those present. 6. Mr. Gero stated the three ordinances form a package with Ordinance #32 amending the Zoning Ordinance fees schedule to include planned developments, Ordinance #33 to add a new section to permit planned development zoning, and Ordinance #34 which would revise the parking requirements of the City. The developmemt of these proposals are a result of efforts over many months by Planning and Zoning Commission mem- bers, Citizens' Advisory Committee Members and City staff. 7. Chairman asked if there were persons in the audience requesting to speak on the proposed ordinances. Two questions were raised and answered. They were: a. How would the planned development proposal affect the Palm Springs area for applying, including by Commission Initiative, for rezoning") -2- in, rr ANSWER: It would not at :It any applicants access to the possibility of a Commission Initiative. It was further explained that it would be up to the applicant to obtain the requisite 51% + signatures and that by carefully defining the area requested may make the application in certain instances an easier process. b. Would people having existing zoning be required to apply for the new zoning classification o.f Planned Development' ANSWER: No, obtaining a Planned Development zoning district is not mandatory. By its passage the City Council would only be authorizing the opportunity for a potential developer to apply for one more zoning district option. This option proposes more design flexibility. 8. Mr. Gero suggested the following amendments: ORDINANCE #33 page 3 - Section 33.03 Procedure in the first line by correcting the typographic error in the word "shall". page 3 - Section 33.03 Procedure, subsection lc by adding to the sentence the following words "as found in Section 2804 of the Zoning Ordinance". ORDINANCE #34 page 2 - Section 21.02 General Provisions #5 by deleting the section and placing the word "(reserved)" in lieu thereof. page 3 - Section 21.02 General Provisions by adding a new #8 to read: "8. When parking areas are provided on a separate lot, the front set back requirements shall be determined as if applied to a one story structure within the zoning district where it is located." page 3 - Section 21.03 Detailed Standards, subsection #1 by adding before the word "forty" the words "up to". page 4 - Section 21.03 Detailed Standards,subsection #9, by adding before the word "Bumper" the words "When installed." page 5 - Section 21.03 Detailed Standards, subsection #17 by .ak deleting the said subsection #17 and inserting a new subsection #17 to read: "17. No driveway in a front yard shall be more than twenty (20) feet wide and the front yard driveway shall not be used in calculating parking spaces. Pinal County just south of Apache Junction by Mr. Howell Anderson and asked the Executive Director to brief those present. 13. Mr. Gero indicated the site to be just west of Hawk Rock; to be approximately 30 acres; to be located in Section 6, R8E, TIS and although there are two proposed roads into the area (Huston and Guadalupe) they are currently not con- structed. 14. Mr. Anderson stated he was the applicant and that he is desirous of Applicant locating his truss building industry on the site among other uses. Water to the site is obtained from an ad- jacent well which he has an agreement to use the water. , . The capacity of the well is about seven (7) gallons per minute. He further stated he expects the extension of Guadalupe from the west by the end of the year. That is the direction a substantial amount of his business is located in. 15. Mr. and Mrs. indicated they were neighbors and also obtained t.Jater Womack from the same well. They had moved here and developed their home in an area they believed would remain in the desert landscape. They, therefore, objected to the re- zoning. 16. Mr. Gero presented the staff recommendations to approve the rezoning .0111. and stated several conditions which he requested be included. He also gave his reasons (see attached) . 17. Mr. Gero noted that this is the first requested subdivision in the City. Lacking subdivision regulations, the City is using a letter of intent whereby the staff projects what it believes will be the regulations and the developer agrees to meet such considerations. Further, the developer agrees to meet any additional subdivision requirements if adopted. In this particular case, the plat is o.' file in the folder for case S-1-80, the subdivision of Ironwood Sands. Mr. Wendell Clarke is agent and a proper written power of attorney is in the file. Accompanying the plat is a staff letter stating concerns and a letter from Mr. Darrell Truitt replying in behalf of the developer. Mr. Truitt is the developers architect. The letters should be made a part of the record. He raise the following question and re;ueste-', through the Chairman that Mr. Clarke address his comments. a. The developer would not like to have a one foot non-trespass easement as that cuts down some of the design capability. e. The owner has not expressed a sign intention. That could be covered at the time of development and is under the zoning ordinance. f. The developer has not decided on a sales office. g. No recreation facilities are to be provided. h. Mr. Gero called the roll and determined six (6) of the seven members present. 3. Chairman declared a quorum present at the meeting. He noted there was one set of minutes dated 3-18-80, and suggested action be take:i on these later in the meeting. He stated the State law requires all cities to hold at least one public hearing on any rezoning case, and asked the Executive Secretary to brief those present on the details of the case before the Commission. 4. Mr. Gero presented the details of case PZ-5-80 for those present, stating the applicant, V.J. Buck would like to have his property rezoned from General Rural to CR4 to allow the construction of multiple residence, up to a four plex, at the rate of one dwelling unit per 3500 square feet of lot area. Zoning ordinance requires 16 feet minimum ,—w between units and further, in CR4 there are requirements of 35' in the rear, 8' on each side, and 25' on the front yard. 5. Mr. V.J. Buck speaking in his behalf stated he wished to build a duplex apartment, and noted he was on a section line road - Ironwood Drive. Question was asked regarding single family home and duplex already on lot? .•. "N. -2- Yes, two units already on lot. Question was asked , will you be able to meet those requirements considering units already on the lot? Yes. oink 6. Mr. Terwillinger stated he is the owner of lots 12 and 13 North of Mr. Buck. The lots are 200 feet across and neighbor 327 feet deep, and he would like to place units on these lots to coincide with Mr. Buck's plans. 7. Chairman asked if anyone would like to speak in opposition. None came forth. 8. Exec. Secretary recommendation to rezone from General Rural to CR4 for the following reasons: 1. The property is located on a Section line road (arterial) which has, and will continue to have, substantial traffic. 2. Subject area lies between Apache Trail and Superstition which is an area of mixed uses including nearby commercial uses on the trail. 3. As such apartments would provide an orderly transition. 4. Buck from General Rural (GR) to Multiple Residence (CR-4) for the property he owns located at 252 N. Ironwood Drive described as Lot 11, Block 3, Newtown sub-division located in Apache Junction , Arizona. The motion passed unanimously by Roll call vote. 11. Exec. Secretary presented some follow-up material on the pre- liminary approval of the proposed Ironwood Sands sub-division. He stated that to, date, the only reference to Pinal County subdivtstnn•regillAtions appears to be Section 505, Sidewalks where "shall" is a mandatory word. However sidewalks have not been constructed in the County and if other information is developed it will be presented to the Commission. AIM I\ Ink -3- 12. Mr. Wendell Clark stated three (3) builders will be involved in this project and may not buy the lots if Agent they are required to put in sidewalks. If this happens, the developer will not develop property. He requested this be tabled for the present time. 13. Mrs. Taylor inquired about the price of the lots and also the price of the houses that will be constructed on these lots, and was advised the price range will be $50,000 on the house and lot, the individual lots having a value of about $8500 as close as they can now estimate. No single lots would be sold. 14. Mr. Gero stated the one (1) foot non-trespass ease- ments was previously required. The developer proposes to take the non-trespass easement off and to construct a "key" parking turn- around on each lot. This would allow the homeowner to turn around and drive onto Palo Verde. Que ,Lioned applicant as to whether this would be constructed in one phase? 15. Applicant responded that it would be constructed in �► several phases, each phase to be totally developed before the next one began. 16. Ms. Sharp questioned crosswalks. Mr. Gero stated there will be a time when they will become necessary. She questioned feelings about requiring sidewalks along Ironwood initially and doing the rest in stages, and about the speed limit within the subdivision. Mr. Gero responded that is governed by the standards of the streets. 17. Mr. Gero noted that the staff is working with Mr. Clarke and have him report back to the Planning and Zoning Commission on the 4-14- 80 and at that time Planning and Zoning could act on this matter. 18. Mr. Clarke noted that regarding the church property on the North side and East side, the church is willing to deduct property for public right- oi-way as will the developer. The developer will pay the cost of developing 16th Avenue along the church frontage. The church will have to assume the cost along the Ironw000d frontage but indicates they can't at this time. Commission discussed attending Pinal County Planning and Zoning Commission hearing in Florence at 1:30 Wednesday, March 26, for the rezoning requested by Howell Anderson. These fees deal with building ""k, permits and belong in the building code. Once eliminated, the Building Department will approach the City Council to use the fees in the Uniform Building Code. 26. Commission agreed to authorize a public hearing to delete Section 2705 of the Zoning Ordinance. Recessed at 8:35, reconvened at 8:40 p.m. 27. Mr. Gero briefed Commission on the written request from property owners in Azure Skies subdivision. Without 100% representation on the petition, the City attorney said the only way to have a rezoning considered is by Cotission Initiative. Based upon the written request, is that action be taken by the Commission to allow consideration of rezoning this area from TH to CR 3. 28. Sharp/Baker M/S that P & Z authorize staff to advertise a pudic hearing for the purpose of hearing the +► request to rezone a portion of Azure Skies as per the letter from residents from the 'present class- ification of TH to CR 3 for that area as requested by the applicant. 29. Mr. Balj o gave a presentation on "strip" annexation. He recommended the City protect its future interest by strip annexing 1) a ten foot strip north along the Maricopa/Pinal County line from the city limits to Tonto National forest. 2) a ten foot strip south from the city limit, 4 miles past S 18, TIS, R8E, thence easterly past Kings Ranch; thence northerly to within one mile of the National forest. 30.
