AWARDS, PRESENTATIONS AND COMMUNICATIONS ) ) Mayor Seeman presented William E. McDaniel , Director of Public Safety; Lieutenent Weiskotten and Lieutenent Seder with Certificates of Recognition commending them for their expertise in the implementation of the first Police Department in the City of Apache Junction, to include approximately one hundred, thousand dollars in grants which have been awarded to the Department through their guidence. Achieving this goal in the best interest of the public and the department was a major task. CALL TO THE PUBLIC (PETITIONS) ) ) Bill Vaughn, 1011 S. Mara Dr. , Apache Junction, commented and supported the Apache Junction Police Department on their professional manner. Dan Andrew, 1975 N. LaBarge, (Out of the City Limits) , Apache Junction asked if there was As any report submitted to the City Council on his inquiry of the cost of xerox copies. Mayor Seeman replied that the City Council has received an extensive study, and the City Council may want to have a Work Session on the matter. Mayor Seeman requested that the City Manager put on the Agenda of May 21, 1980, the costs of xerox copies. CITY COUNCIL h JTES REGULAR MEETING 5/7/80 Page 3 Mr. Don Nesser, 1511 S. Cactus Rd. , Apache Junction commented on the Town Hall meeting held by the Planning and Zoning Commission on April 26, 1980, and read a letter into the record as follows: Dear Don, I want to compliment you on your first day-long Town Hall , and I would certainly encourage you to have these at least once a year. If I can help in getting speakers from the state agencies please let me know, Again, I want to thank you for inviting me to participate. It was a most enjoyable experience. Sincerely, James J. Sossaman Majority Whip Ilene Taylor, 1617 S. Cortez, Apache Junction, announced the next Town Hall Meeting is set for May 17th and briefed the City Council on the proposed program and encouraged the Council and Citizens to attend. Jail. CITY MANAGER'S REPORT ) City Manager, Ray Lee, reported on three items. 1. City Manager Lee referred to the memorandum from the Department of Public Safety outlining the advantages of the City's full service Police Department for the first month. 2) City Manager Lee reported that the City Departments are now at the new location, 1001 N. Idaho Rd. , with the exception of the Magistrate Court. The third modular is expected sometime next week, and all City operations are expected to be at the new location by the end of May. City Manager Lee commended the employees for their cooperation in the move and without a break in the services to the public. 3) City Manager Lee reported that all public vehicles are now in the City Yard with the exception of the Public Safety Vehicles and the Department Heads vehicles who are on twenty-four hour call . PUBLIC HEARINGS ORDINANCE NO. 45, GOLD DUST MOBILE HOME PARK ESTABLISHING ZONING (SECOND READING) ) Mayor Seeman opened the Public Hearing on the Gold Dust Mobile Home Resort on establishing zoning. Mayor Seeman called on Joe Gero, Director of Planning, to brief the City Council . CITY COUNCIL t JTES REGULAR MEETING 5/7/80 Page 4 Director of Planning, ... Joe Gero, explained that this is the establishment of the initial zoning on the Gold Dust Mobile Home Resort, having been annexed into the City Limits, officially on February 16, 1980. Mr. Gero further explained the location on the map and the difference between the previous zoning require- ments of Maricopa County and the City zoning requirements. Director of Planning, Joe Gero, reported that the Planning and Zoning Commission recommends approval by the City Council with the emergency clause. Marvin J. Halbert, applicant, introduced his attorney, Mike Pierce, who would like to address the City Council . Mr. Halbert stated he would be available to answer questions from the City Council . Mr. Mike Pierce, Attorney, 2333 N. Central , Phoenix, commented that the Planning Director had fairly covered the application. Mr. Pierce discussed the property owners point of view regarding zoning of the land and further explained the proposed construction and that it will meet City standards. Mr. Pierce requested that the City Council adopt the proposed zoning with the emergency clause. Mayor Seeman asked if there was anyone in the audience who wished to speak in favor of the petition. There was none. Mayor Seeman asked if there was anyone in the audience who wished to speak in opposition of the petition. Mr. Joe Barroco, 688 N. San Marcos Dr. , stated that he was not in opposition or in favor of the petition, but he had a couple questions on what the present zoning is under the Maricopa County Standards, and what was the difference. Planning Director, Joe Gero, explained that under Maricopa County the said property was zoned R5 and the proposed zoning is TH (Trailer Homesites) and the difference between the two in great detail . Mr. Joe Barroco asked what was the purpose of the rezoning and if the applicant can sell separate lots to individuals under the proposed zoning. Al Planning Director, Joe Gero, explained that the City is being requested to provide an identical zoning district to what the applicant has for this particular piece of property. Mr. Gero further explained that the applicant would not be allowed to sell the lots individually without being able to meet the re- quirements of the individual lots. Mr. Dan Andrews, 1975 N. LaBarge, Apache Junction, asked where in relationship is Mesa's strip annexation. CITY COUNCIL P JTES REGULAR MEETING 5/7/80 Page 5 Mayor Seeman answered that Mesa went around the area of the Gold Dust Mobile Home Resort. Mr. Joe Barroco asked if there was 51% of the signatures of the surrounding property owners. Mr. Mike Pierce, attorney, answered that they have 100 percent of the surrounding property owners. Mayor Seeman requested the Planning Directors recommendation. Planning Director, Joe Gero, recommended the approval of the establishment of the zoning as Trailer Homesites for the Gold Dust Mobile Home Park for the reasons that are stated by the Planning Commission which can be found within the report. Mayor Seeman closed the Hearing to the Public. Assistant City Attorney, Susan Goodwin, advised the City Council that under the City Code require- ments, an ordinance with an emergency clause must be passed with 3/4 of all members elected, which takes at least six members. There is not enough members here this evening to pass an ordinance with an emergency clause. The Planning Commission had approved this requested rezoning by Commission Initiative in that a majority of the property owners within the subdivision had re- quested by petition the Commission Initiative. The property owners were represented by Mr. Raymond E. Foisy, 449 S. Gold Drive in Apache Junction. During the public hearing the following points were made: 1. The subject lots all comply with the CR-3 zoning district require- ments as to lot size and setbacks. 2. The development of the lots within the subject area are exclusively single family homes. 3. A majority of the property owners within the area are requesting the rezoning on the basis that the rezoning classification would accurately reflect the development of the area to date. This section supercedes the Building Code .► fees schedule found in Table 3-A of the Uniform Building Code (UBC) . This proposal would delete the fees from the Zoning Ordinances. The City Council would then have the option of ratifying, by resolution, the fees as found in the UBC. The Commission felt that it could not just consider the elimination of a fee without considering the substitution that might take place. The Com- mission passed the following recommendation by a 6-3 vote: "BE IT RESOLVED by the Planning and Zoning Commission of the City of Apache Junction, Arizona, that it recommends to the City Council the approval of Ordinance No. 41 (PZ-6-80) . Further, it is recommended that the Building Official be instructed to use Table No. 3-A "Building Permit Fees" as found in the currently adopted Uniform Building Code (1979 Edition) , but that the schedule of fees be adjusted not to exceed seventy percent (70%) of the scheduled amount, and that the immediate implementation not exceed fifty percent (50%) , and the distribution be subject to review." The Commission was presented information as to three methods of deter- mining the cost for performing the building inspection/plans review service. The methods included budget analysis, experience of other cities in the area, and analyzing the average cost as applied to Table 3-A in the UBC. Each of the methods resulted in approximately the same figures. The conclusion staff derives is that by using a seventy percent (70%) modified to table 3-A of the UBC, the cost of performing the service would be equated. If a percentage less than 70% is used, the tax payer would be subsidizing the service. If a higher percentage is used, then monies beyond the cost of service would be derived by the city. City from time to time is desirous of providing its residents certain recreational programs, and in order to provide such programs, it is desirable to contract with certain independent contractors to provide recreational services. Contractor will submit a report of disbursements of City funds to be submitted to the City Manager, Director of Public Works, or a designated representative. 5. Contractor shall indemnify the City against and hold the City harmless from loss as to all claims, costs, demands, attorneys' fees , causes of action, losses , or damages that may arise as a result of any action or conduct by Contractor or its agents in providing said recreational services and programs under this agreement. If any legal action is brought against City as a result of any action or conduct by Contractor or its agents, Contractor agrees to appear and defend or to provide such funds as may be necessary to defend City in such action. 6. The provisions embodied in this agreement contain all covenants, agreements, obligations and stipulations agreed on by the parties and on execution hereof, any and all previous and existing agreements and/or contracts entered into between the parties are hereby declared by mutual consent to be null and void. Section 2-9-2 Membership and Terms of Office A. The Airport Commission shall consist of five (5) members who shall be appointed by the Mayor and approved by the City Council . Ex officio members , without voting privileges , may be designated by the Mayor with approval of the City Council . At least one ex officio member may be designated from outside the City limits of the municipality. B. The appointments shall be for three (3 ) years each with the terms of members so staggered that the terms of no more than two (2) members shall expire in any one year. The initial appointments of members shall be for two (2) members with terms beginning upon their appointment and expiring March 1 , 1981 , two (2) members with terms beginning upon their appointment and expiring March 1 , 1982 ; one (1 ) member with a one year term beginning upon his appointment and expiring March 1 , 1983. Section 2-9-3 Salaries and Personal Expenses The members of the City of Apache Junction Airport Commission shall receive no salaries or other remuneration for their services in such capacity , and shall not be entitled to personal expenses incurred by them in the discharge of their official duties, except to the extent and purposes and amount such expense is first authorized and approved in advance by Common Council . Section 2-9-4 Officers The Commission shall elect a Chairman, Vice-Chairman, and Secretary from its members to serve for a period of one ( 1 ) year. The Vice-Chairman shall preside at meetings in the absence of the Chairman. Section 2-9-5 Rules of Procedure ; Power and Duties There is hereby vested in the City of Apache Junction Airport Commission full power and authority for, and on behalf of the City of Apache Junction, Arizona , to represent said City in any and all negotiations with individuals , corporations , associations , Governmental agencies, etc. , for the development and promotion of commerce by air in the Counties of Pinal and Maricopa and especially the City of Apache Junction, Arizona. The Director of Public Works shall review all the Commission 's recommendations and shall submit his recommendations to the -2- Council . No contracts or other commitments shall be deemed to have been entered into or made , except in compliance with the provisions of Article 3-7 of this Code. Section 2-9-6 Meetings The Commission shall establish a regular meeting day and time at least once a month. Special meetings may be called as required. A quorum shall consist of four (4 ) voting members for the transaction of all business. Section 2-9-7 Vacancies Vacancies shall be filled in accordance with Section 2-9-2 by the City Council for the unexpired term of the member affected. Section 2-9-8 Removal of Members Members of the Commission serve at the pleasure of the Council and may be removed by the Mayor with the concurrence of the Council . A member shall not be absent from the Airport Commission 's meetings for more than three (3) consecutive times. Lot 6 and the south 48 feet of Lot 4 in Grandview Place Subdivision We feel there is a need for this type housing, and we started action for proper zoning the early part of December 1979. At a public meeting in January we presented Petition signed by almost 100; of property owners signifying their approval , but was informed the City was in process of adopting an Ordinance of Planned Development and we were asked to wait until. this Ordinance was passed. We agreed, and attended a later meeting when the draft of the Ordinance was read and discussed. On April 2nd we learned the Ordince was again on the agenda of the Council and attended the meeting, only to be informed it had been deleted from the agenda for that evening. We are disappointed, and I am sure there must be others that feel as we do. We have had an architect engaged for these past few months and our expense keeps mounting. We need to know as soon as possible whether to proceed or not.
