AWARDS, PRESENTATIONS AND COMMUNICATIONS ) ) Mayor Seeman presented Lieutenent Seder with the Certificate of Recognition announced at the Regular Meeting of May 7, 1980. CALL TO THE PUBLIC (PETITIONS) ) ) City Clerk, Rich Oesterle, announced there were five requests from four individuals to speak as follows: Mr. Dan Andrews has two requests; (1) He asked if the Council has changed the price of the Xerox copies and (2) Mr. Andrews wished to address the City Council on off street parking. CITY COUNCIL MINUTES REGULAR MEETING, 5/21/80 Page 3 Mayor Seeman explained that off-street parking is not on the Agenda and is scheduled for the next Council Meeting as a Public Hearing. City Clerk, Rich Oesterle, announced that Mr. Robert Dugger wished to address the Council on the Agenda Item No. 5; Mr. Joe Morvak wished to address the Council on Agenda Item No. 8; and Mr. Arthur Strange wished to address the Council on Agenda Item No. 10. CITY MANAGER'S REPORT ) City Manager Lee reported an up-date on the grant by the Governor's Highway Safety and has been advised that the City can proceed on the $62,000 grant. Secondly, the City Council/ Magistrate modular is on site and will be ready for public meetings by next Wednesday. Finally, the City now enjoys $31,000 in CETA grants which include 9 positions and the City has applied for $61,000 additional dollars for street crews. PUBLIC HEARINGS ORDINANCE NO. 48, REZONING CASE PZ-7-80 AZURE SKIES SUBDIVISION (SECOND READING) ) Mayor Seeman read the rules on the procedure of the Public Hearing. Upon opening the Public Hearing on PZ-7-80, Ordinance No. 48, (applicant Azure Skies Subdivision) , Mayor Seeman called on the Director of Planning to brief the City Council and the public on this petition. Planning Director, Joe Gero, explained that Rezoning Case PZ-7-80 is the application for rezoning lots 13-39, 52-73 and 86-112 inclusive, in the Azure Skies Subdivision. The requested rezoning is from Trailer Homesites (TH) to Single Family Residence (CR-3). The majority of the residences in the area did petition the commission for the commission initative. Mayor Seeman called on the applicant or spokesman for the petition. (No one spoke) Mayor Seeman called for any one in the audience that may wish to speak in favor of the petition. (No one spoke) Mayor Seeman called for anyone in the audience that may wish to speak in opposition of the petition. (No one spoke) Mayor Seeman called on the Planning Director for his recommendation. Planning Director, Joe Gero reported that the Planning and Zoning Commission recommends to the City Council the unanimous approval of this particular request and the Planning Director concurs with the Commission's recommendation. ORDINANCE NO. 41, AMENDING ZONING ORDINANCE SECTION 2705, (FEE SCHEDULE) (SECOND READING) ) ) Mayor Seeman opened the Public Hearing on PZ-6-80, Ordinance No. 41. Mayor Seeman called on the Planning Director to brief the City Council and public on this petition. Planning Director, Joe Gero, explained that in the City Zoning Ordinance, Section 2705, entitled FEES, setsforth various fees for the building permits; the Zoning Ordinance was adopted following the adoption of the Uniform Building Code, therefore, by placing Section 2705 in the Zoning Ordinance, the Council nullified the fee CITY COUNCIL MINUTES REGULAR MEETING, 5/21/80 Page 5 schedule in the Uniform Building Code. Mr. Gero futher explained why the fees should belong in the Uniform Building Code. Mr. Gero reported that the Planning and Zoning Commission by a 6 - 3 vote recommends to the City Council that proposed Ordinance No. 41, be approved. The second part of the Planning and Zoning recommendation refers to Agenda Item No. 8, Resolution No. 80-14. Mayor Seeman called for any one in the audience who wished to speak in favor of the petition. Lawson, #17, Apache Junction, commented that by raising the fees on building permits, the City Council will hurt the growth of Apache Junction and stated that he is against raising fees. Mayor Seeman called on the Planning Director for his recommendation. Planning Director, Joe Gero, recommended that proposed Ordinance No. 41, be approved. Mayor Seeman closed the Hearing to the public. NEW BUSINESS ORDINANCE NO. 47, AMENDING CITY CODE ON CITY COUNCIL MEETING LOCATION ) ) City Manager Lee explained that it is necessary to have an emergency clause on Ordinance No. 47, in order to have the next City Council meeting at the new location, and requested that the Mayor and Council consider a Special Meeting to consider this Ordinance. Mayor Seeman commented that the City Council should have a Special Meeting so the City may accommodate more people at the Council meetings. Councilman Damiano MOVED THAT A SPECIAL MEETING FOR THE CONSIDERATION OF ORDINANCE NO. 47, BE SET ON MAY 28TH, AT 5:30 P.M. , AT 150 N. OCOTILLO. Councilman Burgess seconded the motion. VOTE: Unanimous Motion carried. COMMUNITY SUMMER RECREATION PROGRAM ) ) Councilman Burgess provided a background explanation concerning the Connnunity Summer Recreation Program in coordination with the Apache Junction School District. Councilman Burgess MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE CITY MANAGER'S ACTION TO PROVIDE THE CITY'S SHARE OF SUMMER RECREATION FUNDS IN THE AMOUNT OF $10,000 BE AND HEREBY IS RATIFIED. Councilman Damiano seconded the motion. VOTE: Unanimous Motion carried. -- - _ - - CITY COUNCIL MINUTES REGULAR MEETING 5/21/80 Page 7 RESOLUTION NO. 80-14, UNIFORM BUILDING CODE BUILDING PERMITS FEES ) Mayor Seeman explained that this Resolution would set the building permit fees by the Building Depart- ment in regards with that service. Mr. Joe Morvak, 1224 S. Doran, Mesa, commented that he agrees that building permits as related to single family residence need to be increased, but they need to be put in proper line with the scope of the work being done. Mr. Morvak requested that the City Council consider a reasonable modifier in the increase. Mayor Seeman explained the personnel and costs involved in the Building Department. City Manager Lee added that the City has one Building Inspector that also doubles as a Zoning Admin- istrator, and one secretary. The Building Official 's responsibility is that of the Director of Public Works. Mr. Joe Morvack asked if any way this evening before Resolution No. 80-14 is passed that the fee level would be set. oak Planning Director, Joe Gero, explained at great lengths the method of the fee schedule as set forth by the Uniform Building Cosde and the checks and balances that would be used in determining the cost of permit fees. Mr. Gero referred to a periodical called "Building Standard" published by the International Conference of Building Officials and further explained the modifiers for each particular state and average costs. Mr. Roy Hudson, 2084 W. 9th Avenue, Apache Junction, expressed that he felt that the City can not set the building fee by the cost of the department. He stated that one person should not set the fees, that the City Council should consider the recommend- ation of the Planning and Zoning Commission. Mayor Seeman read the recommendation of the Planning and Zoning Commission as presented in the City Council agenda packet with Ordinance No. 41. Mr. George Baljo, 1070 E. Navajo, Apache Junction, Chairman of the Planning and Zoning Commission "+ expressed the views of the Planning and Zoning Commission and the reason for their recommendation on the 50% modifier. Mayor Seeman and Members of the City Council discussed at great lengths at what percentage the modifier would begin and the best way to start the program. Mayor Seeman called upon the City Clerk to read the title of Resolution No. 80-14. This item has been adver- tised and scheduled for Public Hearing for the June 4, 1980 meeting. This is the proposed revision of the parking and loading requirements as found in the Zoning Ordinance. This document has resulted from many hours of effort by the Planning and Zoning Commission and the Advisory Committee. The Planning Commission has held a Public Hearing on this matter, and following comments, recommends this proposal to the City Council for approval. The City Council has held a work session on this proposal. Comments were made at that time which suggested several minor modifications which would make the proposal more responsive to the Apache Junction circumstances. These suggestions have been incorporated. At this meeting, the City Council will have scheduled the first reading and the Public Hearing (advertised May 20, 1980) . The proposal contains the emergency clause. With regard to the emergency clause, all three proposed ordinances (32, 33 and 34) contain the requested emergency clause. The main reason for this is that there are a number of multiple- family rezoning cases which have been before the Planning and Zoning Commission for six months. These applicants desire to use the planned development process for requesting rezoning. There has been a sub- stantial loss of time by these applicants. It is the intent and purpose of the parking and loading requirements to provide for adequate off-street parking spaces to serve residential , commercial , industrial , institutional , and other land uses , and thus help to prevent congestion of city streets . Proper design of and access to parking facilities shall be required in order to protect the public health , safety and welfare . Furthermore , it is the intent and purpose of these regulations to promote the functional efficiency of all land uses by requiring off-street parking and loading facilities consistent with modern standards . Ordinance #34 Page 2 Section 21.02 GENERAL PROVISIONS 1. The provisions and maintenance of required off-street parking and loading facilities are continuing obligations of the property owner or tenant. Required parking spaces shall be improved as required and made available for use before final inspection is completed by the Building Official. 2. In all zoning districts, when a building is enlarged or struct- urally altered, or a new building is constructed, or the use of an existing building is changed, off-street parking and loading spaces shall be provided prior to occupancy according to the requirements set forth in Section 21.04, Off-Street Parking Requirements, and Section 21.05, Loading Facilities Re- quirements. When several uses occupy a single structure or lot, the total required parking shall be the sum of the requirements of the individual uses and further, when a building or use is planned or constructed in such a manner that a choice of parking requirements could be made, the use which requires the greatest number of parking spaces shall govern. When a use may have more than one work shift or occupancy, the shift or occupancy with the greatest number of occupants shall govern. When there is a change in the use of a building or parcel of land, the difference between the number of required parking spaces for the new use and the number required for the previous legal use according to this Article, even if spaces were not available for the pre- vious use, shall be provided. 3. In all zoning districts, required off-street parking shall be located on the premises intended to be served. 4. Required parking spaces shall be available for parking of vehicles of residents, customers, patrons, and employees, and shall not be used for storage of vehicles, or materials, or for the exclusive parking of vehicles used in conducting the business or use, and shall not be used for selling, repairing, or servicing. 5. In a residential zoning district no required parking spaces shall be provided in the front yard setback area; and provided further, except for single family dwellings and mobile homes, no parking shall be permitted in the front yard setback area. 6. A plan, drawn to scale, indicating how the off-street parking re- quirements are to be met, shall accompany an application for a building permit where parking is required. The plan shall show all elements necessary to indicate that the parking requirements as set forth in this Article are being fulfilled, and shall include at least the following: .. a. Delineation of individual parking spaces; and b. Circulation area necessary to serve spaces; and Ordinance ##34 Page 3 c. Access to streets and property to be served; and ^► d. Curb cuts; and e. Dimensions, continuity, and type of screening; and f. Grading, drainage, and surfacing details; and g. Delineation of obstacles to parking and circulation in finished parking area; and h. Specifications as to signs and bumper guards; and i. Landscaping. 7. When the unit of measurement determining the number of required parking spaces results in the requirement of a fractional space, any fraction up to and including one-half (0.5) shall be dis- regarded, and fractions over one half (0.5) shall require the additional one (1) parking space. 8. When parking areas are provided on a separate lot, the front setback requirements shall be determined as if applied to a one (1) story ,r► structure within the zoning district where it is located. Section 21.03 DETAILED STANDARDS All parking and loading areas shall be developed and maintained as follows: 1. Driveways and areas used for loading, parking, and maneuvering of vehicles shall have a surface which is durable, all weather, and paved of either asphalt or concrete; except that lots over 5/8 of an acre shall only be required to pave the accessway from the property line for a distance of up to forty (40) feet. 2. Except for single family and duplex dwellings, driveways and areas for loading, parking and maneuvering of vehicles shall meet the requirements of the Director of Public Works with regard to traffic flow onto public streets and alleys. 3. A parking area shall be designed to dispose of all surface water accumulation within the area in such a manner as to prevent drain- age onto adjoining property, and shall meet all other drainage requirements ... of the Director of Public Works. 4. A loading berth shall have minimum dimensions of fourteen (14) feet wide and fifty (50) feet long, and where covered shall have a vertical clearance of at least fourteen (14) feet. If the loading area in in the buildable area, this requirement shall not prevent the con- struction over the loading space clearance area. Ordinance #34 Page 4 5. Each required parking space shall be not less than nine (9) feet wide and not less than twenty (20) feet long, exclusive of access drives or aisles. 6. No obstructions of any kind shall be permitted within any designated parking space. 7. No parking space shall be located in a manner so as to block access to any other parking space, except on a parking lot with a parking attendant having access to each vehicle's keys. 8. Parking spaces shall be designed so that no backward movement of a vehicle onto a public right-of-way, other than an alley, will be necessary, except for single family and duplex dwellings. 9. When installed, bumper guards or wheel barriers shall be secured to the ground surface and shall be so installed that no portion of a vehicle will project onto a public right-of-way, over adjoining property, over a sidewalk, or into a required setback, land- scaping, or screening. 10. Lighting of a parking area shall not interfere with surround- ing areas or traffic flow. 11. Directional signs and pavement markings shall be used to con- trol vehicular movement in a parking area. Signs shall be limited to two (2) square feet each, and an aggregate total not to exceed twenty (20) square feet. No sign of any kind other than those indicating entrances, exits, name of establishment to which such parking area is accessory, or conditions of use shall be erected. No advertising on such signs shall be permitted. 12. No driveway over 300 feet long shall exceed a ten percent (10%) grade; and no driveway shall exceed seventeen percent (17%) grade. 13. A. common driveway shall be permitted for adjacent residential lots. At least one-half (Z) the minimum required width of the ser- vice driveway shall be located contiguously on each lot. Legal evidence shall be presented to the Director of Public Works and approved by the City Attorney, in the forms of deeds, leases, or contracts to establish Joint use, prior to zoning approval. Amok14. Where a parking area for a business or commercial use is a side yard or rear yard and adjoins a residential zoning district, a solid wall or fence of masonry or other approved fireproof material shall be constructed between the parking area and said district not less than four (4) feet nor more than six (6) feet in height, except that no fence shall be required within twenty (20) feet of Ordinance #34 Page 5 public right-of--way. 15. No parking lot shall have a vehicular entrance or exit onto a public right-of-way within thirty (30) feet of a residential zoning district or within fifty (50) feet of any school grounds, public playground, church, hospital, sanitorium, public library or institution for dependents or for children. 16. Off-street parking areas shall be arranged so as to conform with the standards depicted in Figure 21-1, "Off- Street Parking Standards". 17. No driveway in a front yard shall be more than twenty (20) feet wide and the front yard driveway shall not be used in calculating parking spaces. The Director of Public Works, or Arizona Department of Transportation on State or Federal highways , may limit the number and location of curb cuts along a public right-of-way. 18. (Reserved - landscaping and screening.) Section 21.04 OFF-STREET PARKING REQUIREMENTS The following sets forth the minimum number of parking spaces to be provided as regLred in this Ordinance. Re- quirements for a building or use not specifically listed shall be determined by the Director of Planning or Building Official based upon the requirements of similar uses. 1. Residential a. ONE FAMILY DWELLING UNIT - Two spaces for the dwelling unit. b. DUPLEX AND MULTIPLE FAMILY DWELLING UNITS - Type of Required Parking Dwelling Unit Spaces (1) Studio or efficiency unit * 1 space per dwelling unit. (2) Family lodging house* 0.75 space for each person for whom living accommodations are provided. Ordinance it 34 'Pge b (3) One-bedroom apartment* 11 spaces per dwelling unit (4) Two or more bedroom 2 spaces per dwelling unit . apartment* *Accessory rooms , such as dens , recreation rooms , extra living rooms , or family rooms , (but excluding kitchens , dining rooms , bathrooms , and one living room) shall be calculated as a bedroom when determining the required off-street parking spaces . c. GROUP HOME One (1) space per bedroom , plus one (1) space for each staff member . If counseling services are provided to non- residents , an additional one (1) space for each 200 square feet of gross floor area used by said counseling services shall be provided . Commission may authorize provision of fewer parking spaces if there is a clear indication that the number of require,' spaces for a group home is unnecessary due to such factors as resi:,ent- being unable to drive due to age or mental or physical disability . d. MOBILE HOME PARK One (1) parking space per mobile home space ; plus park- ing spaces for commercial or office uses as otherwise pro- vided in this Ordinance ; plus one ( 1) parking space per each five (5 ) mobile home spaces , said spaces to be located in a security area . e . TRAVEL TRAILER PARK One (1) parking space per OR TOURIST COURT travel trailer space ; plus parking spaces for commercial or office uses as otherwise provided in this Ordinance ; Ordinance ##34 Page 7 plus one parking space per each ten (10) travel trailer spaces, said spaces to be located in a security area. f. ROOMING HOUSE OR One (1) space per guest room, BOARDING HOUSE plus one (1) space for resident manager. g. MOBILE HOME SUBDIVISION Two (2) spaces per lot. 2. Amusement park, fairground (reserved) or transient show. 3. Arena, stadium, auditorium, One (1) space for every four or theater. Section 21. 05 LOADING FACILITIES REQUIREMENTS In all zoning districts , in connection with every building hereafter erected to be occupied by uses requiring the receipt or shipment by motor vehicles of materials or merchandise , there shall be provided and maintained on the same premises with such building off-street loading and unloading space accessible from an alley or easement of access , or when there is no such alley or easement of access , from a street . One loading space shall be required for each 10 ,000 square feet of floor area . If less than 10 ,000 square feet exists , 5 ,000 or more square feet of floor area shall require one (1) loading space . Such space may occupy all or part of any required rear yard , except that no such space shall be located closer than fifty (50) feet to any lot in a residential zoning district unless wholly within a completely enclosed building or enclosed on all sides abutting said residential zoning district by a solid fence or wall not less than five (5) feet nor more than six (6) feet in height . Section 21 .06 PARKING : ADDITIONAL REQUIREMENTS ____ 1. In any residential district , all motor vehicles which are unlicensed or incapable of movement under their own power shall be stored in a rear yard in a completely screened space , garage or carport , except in an emergency . 2 . One (1) travel trailer , which shall not be used for any purpose , may be stored or parked in a residential zoning district in the rear yard provided said trailer is stored in a garage or ramada , or in an area shielded from adjoining properties by an opague fence or planting . Section 21 .07 HANDICAPPED PERSONS PARKING REQUIREMENTS ,.► (Reserved) SECTION II : REPEAL OF CONFLICTING ORDINANCES : All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference , are hereby repealed . It is the intention and purpose of the Planned Development Zoning District (PD) to provide for greater flexibility , and thereby encourage more creative design which may include a combination of different dwelling types and/or a variety of land uses which complement Ordinance ##33 rage 2 each other and which are congruous with existing and proposed land uses in the vicinity . Therefore , it is intended to enable the use and integration of contempor- ary land planning principles in such a manner as to promote its most appropriate use ; to allow diversification in the relationship of various uses , structures and spaces ; to facilitate the adequate and economical pro- visions of streets and utilities ; to preserve the natural and scenic qualities of open space ; and establish guidelines that will encourage the highest standards of design and construction ; to offer recreational opportunities close to home ; to enhance the appearance of neighborhoods through preservation of natural green spaces ; to counteract the effects of urban congention and monotony while providing the environmental amenities ; and provide the unified control of development of land . It is further the intent to insure substantial compliance with the General (Comprehensive) Plan adopted by the City now or in the future and spirit of intent of the Zoning Ordinance in requiring adequate standards necessary to promote the public health , safety and general welfare without unduly inhibiting the advantages of modern planning as a means of effectuating desirable development , redevelopment , rehabilitation , and conservation in the City of Apache Junction for residential , commercial , industrial and other purposes . Section 33 . 02 Permitted Uses 1. The buildings and uses permitted in the Planned Development Zoning District shall be governed by the permitted uses in the base district or in a combination of base districts . The base district or districts from which permitted uses shall be determined shall include only those designated in the application and approved by the Council . 2 . Upon the approval of Council , the arrangement of uses on the land as permitted by the base district (s) , and the proportions of permitted land use defined by the underlying base district (s) may be adjusted , re-arranged or altered according to standards and regulations as provided in this Article . 3 . Any use applied for and not specifically listed in this Zoning Ordinance , if approved by the Council , shall be designated to the base district for which the use , when applied , would most resemble . Ordinance 1133 Page 3 4. By "base district" this Article means any conventional zoning district(s) as approved by the Council for a particular area. Normally, the base district(s) will be those existing or com- patible with existing conventional zoning districts in the subject area. Section 33.03 Procedure The development plan review shall be conducted according to the following steps, procedures and requirements notwithstanding any other provisions of this Zoning Ordinance. There shall be a three (3) step review process for planned development approval consisting of Step One: pre-preliminary; Step Two: preliminary; and Step Three: final approval. Each step is outlined below and each shall be approved before proceeding to the next step as provided. 1. General Procedure a. Application for a Planned Development Zoning District (PD) shall be filed in writing and on a form approved by the Commission in the manner required for amending the Zoning Ordinance. No application shall be accepted unless it is complete and is verified as to the correctness of information given by ... the signature of the applicant attesting thereto. The applicant, or his designated representative, is requested to be present at each public hearing on their application. b. The proposed planned development shall be in one (1) owner- ship or control, or the subject of a joint application by the owners of all the property included. c. At the time of filing of the preliminary plan, a fee shall be due in the amount prescribed for "Planned Development" on the most current City of Apache Junction Schedule of Filing Fees as found in Section 2804 of the Zoning Ordinance. d. The application shall be accompanied by plans, filing doc- uments and information as prescribed in this Article, or as prescribed by the Commission. e. An application for a planned development must be filed not less than eighteen (18) days prior to the public hearing. Ordinance #33 Page 4 2 . Step One : Pre-Preliminary Application a. The approval of Step One shall be construed as only concept approval for the given site and shall not be construed as approval of any zoning amendment . b. The Planning Department staff shall determine whether the planned development requirements of this Article are complied with . If the developer disagrees with the determination , the applicant by request , cr the staff , may take the pre-prelim- inary information to the Planning Commission for its determination of whether this site is suitable for development as a planned development . This step does not require an advertised public hearing . 3. Step Two: Preliminary Application (General Development Plan) a. The approval of Step Two shall be preliminary approval of the specific project on the desig- nated site and shall create the zoning map change . .•. b . Investigation and Reports-Planning The Director of Planning shall cause to be made by himself or members of the staff , and in co- operation with other appropriate city departments and consultants an investigation of facts and review of all applications and documents presented hereunder as will serve to provide all necessary information to assure that the action of each applicant is consistent with the intentions and purpose of this Article . At the appropriate stage (s ) the Director of Planning , or designated representative , shall submit a prepared report to the Commission for consideration and may recommend that the application be approved as submitted , approved with conditions , denied , or returned to the applicant for revision . c. Review by Planning and Zoning Commission Thereafter , the Commission shall review the application for Planned Development and shall hold a public hearing (s) as required . After such hearing , the Commission shall determine whether the proposal conforms to the criteria and Planned Development Ordinance #33 Page 5 Requirements as set forth in this Article , and shall either recommend to the Council that the preliminary application and development plan be : 1) Approved ; or 2) Approved requiring changes therein ; or 3) Shall return the plan and application for revision ; or (4) Denied . d . Council Consideration Upon the recommendation from the Commission , the Council shall advertise and hold a public hearing upon the re- quest . After the conclusion of such hearing (s) , the Council shall either : 1) Approve the application as recommended by the Commission ; or 2) Approve the conditions requiring changes or impose such conditions of approval as are in its judgment necessary to insure conformity to the criteria and the Planned Development Regulations as set forth in this Article ; or 3) Shall return the plan and/or application for revision to the applicant ; .�. or 4) Shall deny the application as submitted ; or 5) May refer the application to the Commission for their reconsideration and a subsequent report to the Council . 4 . Step Three : Final Application (Precise Development Plan) a. Approval of Step Three shall be given only when it can be shown that the proposed project , or any stage of the total development plan , meets all requirements as set forth for final approval in this Article plus all requirements , stipulations , and modifications of the preliminary plan as required by the Council have been met . b . Within one (1) year after the approval of a preliminary development plan , the applicant shall file with the De- partment of Planning a final plan for the entire develop- ment , or when submission in stages has been authorized , for the first stage of the development . The Commission , after the first year and at its discretion , may extend the date for submission of the final plan for one (1) additional year providing that the circumstances warrant such an extension . c. The Commission shall not approve the final development plan for any stage of the Planned Development if either the total number of stages developed and /or the average of the allowable dwelling units per stage , up to and in- cluding the stage which is to be approved , exceeds by more than twenty-five (25) percent the average number of dwelling units per stage which is allowable for the entire planned development . a.. Ordinance #33 'c3$e 6 d . The Commission shall consider for approval all final plans . Provided all the requirements of this OIN Article are met the Commission shall grant such approval ; except that where action of the City Council is required said approval shall be subject to City Council approval of specific items . 5 . General a. For any area of which the City has a valid application for annexation and which also has a valid application filed for a planned develop- ment , the applicant shall have the base district considered as an integral part of the Planned Development application . b . Should the zoning of the base district be inappropriate for a proposed PD , changing of the base district shall be accomplished as an integral part of approval of the Planned Development application . Under the PD application , the base district zone change shall not be approved /e".• without approving the Planned Development Application . Section 33 . 04 Documentation Content Required The following information and documents shall be submitted with the application to the Department of Planning : 1 . Step One : Pre-Preliminary Stage Consideration a. A letter of intent for a Planned Development shall be submitted by the owner or authorized agent . Before submitting an application for a Planned Development , the applicant is urged to confer with the Department of Planning to obtain an application and discuss procedures , fees , schedules and assistance . An accurate map drawn to sufficient scale to adequately show the boundaries and dimensions of the site , a north arrow , the scale , names j and dimensions of all streets , alleys and ease- ments bounding or touching the site . The map shall also include schematic reference showing the plot plan of the land in the area to be developed indicating : 1 . The general relationship contemplated among all public and private uses ; and Ordinance #33 Page 7 2 . The location , dimensions and direction of any major physiographic features such as railroads , drainageways and existing man-made physical features ; and 3 . All private rights-of-way proposed ; and 4 . Location of all proposed structures ; and 5. Location of all proposed common open space ; and 6 . Location of any flood hazard areas as determined by the Federal Emergency Pre- paredness Agency . b . An explanatory statement containing the following information : 1. A showing of property ownership including all easements ; and 2 . The source of water supply , method of sewerage disposal and means of drainage ; and 3 . Approximate number and types of units proposed for the site ; and 4. Any proposed non-residential uses (i . e . commercial , industrial , etc . ) ; and 5 . Public and private egress ; and �`► 6 . Areas to be devoted to various uses and population densities contemplated for the project , and 7 . The area total for the project site . 2 . Step Two : Preliminary Stage Consideration a . One (1) transparency and four (4) prints of a development plan of the entire development showing : 1 . General location for vehicle and pedestrian circulation indicating streets , driveways , sidewalks (if any) , pedestrian ways , off- street parking , loading areas and provision for fire and other emergency vehicles . 2 . Location and approximate dimensions of structures together with the usage to be contained therein and approximate location of all entrances thereto showing character and relationships of buildings , streets , and open area . 3 . A description of adjoining areas , uses or structures which may affect , or be affected by , the design or location of buildings of the development or the uses or traffic circulation therein. Said description shall include maps and information for at least four hundred feet (400 ' ) beyond the development . Ordinance #33 Page 8 4 . A description of the general scheme of land- ► scaping to be employed including the extent , location arrangement and proposed improvements of all open areas , landscaping ,fences , and walls . Said description shall include per- spective schematic renderings . Proposed provisions for maintenance of all open areas shall be included . 5 . The Director of Public Works may require the submission of contour information for a portion of , or the total development site , when such information is deemed necessary to adequately evaluate the Planned Development . When re- quired , the information shall conform at least to the following minimum standards . i . Contour information given shall be tied to USGS or GLO datum. At least one (1) bench mark , at or close to the property shall be required . Contour elevations shall conform to ground slope intervals as required by Subdivision ^` Ordinance and/or : ii . Contour elevations at the centerline of all private and public streets , roadways , driveways and parking areas within the project area . 6 . Cross-sections through the property showing grades and building height relationships shall be included . 7 . General provisions to be made for utilities and storm drains . 8. General provisions for handling storm water runoff shall be indicated . b . Four(4) copies of the following information and documents : 1. A tabulation of the land area to be devoted to various uses including an indication of land to be dedicated for street , park , school , or any .••. other purpose . 2 . A development schedule indicating (1) the approximate date when construction of the project can be expected to begin; (2) the stages in which the project will be built and the approximate date when construction of each stage can be expected to begin . Ordinance #33 Page 9 3 . Architectural drawings , sketches , perspective schematic renderings , or scale models necessary to demonstrate the design and character of the proposed development . 4 . A draft of the major points for covenants proposed affecting the property . 5 . A lighting plan including proposed street and security lighting , an analysis of the effect of such proposed lighting on adjacent property , and such other information as may reasonably be necessary . 6 . A signing plan including the location , type , size , height and area of proposed signs . 7 . An indication of whether or not land is to be subdivided . 8. A certified legal description or boundary survey by a registered engineer or registered surveyor of the property , or properties , to be included in the total development including all easements ; and 9 . Other relevant operational data and such reasonable information as the Commission and/or Council may require including an updating of all information submitted for pre-preliminary approval . 3 . Step Three : Final Stage Consideration The information submitted shall be sufficiently detailed to indicate fully the ultimate operation and appearance of the development and shall include all information submitted in the preliminary plan plus the following : a. The location of water , sewerage and drainage facilities . b . Landscaping and planting plan showing location , number and name of all trees and major shrubs ; trees over 6" in trunk diameter to be removed by development shall be so marked . c. The character and location of signs in conformance with the Zoning Ordinance . d . Plans for street improvements and finished grades or earth moving plans . Specific request for modification of traffic barriers and provisions for the relocation of utilities should be made . "owe . Location and dimensions of pedestrian walkways , malls , trails or any easements . f . Comprehensive soils and geological reports substantiat- ing the soundness of the development shall be submitted by a soil analyst if required by the Building Official . g . Location and dimensions of parking areas and other car maneuvering areas including location of driveways and other access points . h . Copies of legal documents required by the Council for dedication or reservation of public facilities . i . Requirements for subdivision , if applicable , as set forth in the Subdivision Ordinance . Ordinance #33 Page 10 j . If development is in stages , the approximate .•: date when the stage is to be complete . Section 33 . 05 Staging When development by stages is requested , the Planning Commission shall review the preliminary application , re- quired documents , proposed development schedule and any other information or documents necessary to determine that the proposed total development meets the intent and purpose for "Planned Development" as set forth in the Zoning Ordinance , and to further determine if in the judgment of the Council the proposed development is of the scale and design to warrant approval of staging . When submission in stages has been authorized by the Council , the following shall apply : 1 . The time schedule , as described in 33 . 04 . 02 (b) (2) , indicating the approximate date on which construction of the project will begin and the anticipated rate of development shall become a part of the planned development preliminary approval and shall be adhered to by the applicant and any successors in interest . 2 . When more than one (1) area of a proposed planned development area is proposed for subdivisions , sub- mission of subdivision proposals for a specific area shall not be made until such time as the developer intends to proceed with each such area of development . Section 33 . 06 Development Standards In addition to , or as a greater requirement to the regulations normally found in the district , the following regulations shall apply to all development within a Planned Development Zoning District . 1. Density - The developer shall propose a density subject to Council approval . Upon the adoption of a City General (Comprehensive) Plan the allowable density shall not exceed that as set forth in said Plan . Further , the density shall not exceed that as permitted in the base zone ; provided , that the density restrictions of this section may be amended as set forth below: Ordinance #33 Page 11 "` a. Incentive Density Increases - Design , character , identity , and architectural siting variations incorporated into a develop- ment shall be considered cause for population density and building intensity increases not to exceed fifteen (15) percent of that allowable in the zone underlying the application , pro- vided they make a substantial contribution to the objectives of a Planned Developement . The degree of distinctiveness and desirable variation achieved shall govern the amount of density/ intensity increase which the Council may approve . The Council shall consider three major design features of each project when considering incentive density increases . The Council may grant up to five (5) percent increase in density for each of the three (3) major design areas which follow. Some specific design features are included under each of the three major headings to aid in the consideration of each project ' s merit . 1 . Landscaping (Maximum increase of five percent (5%) : 1 . Street landscaping for this area ; 2 . Open space and plazas ; 3. Use of natural landscape ; 4. Pedestrian way treatment ; 5 . Recreational areas . 2 . Siting (Maximum increase of five percent (5%) : 1 . Visual features ; 2 . Use of natural features (water , etc . ) ; 3 . View; . 4. Sun and wind orientation ; 5 . Circulation pattern ; 6 . Physical environment ; 7 . Variation in building setbacks ; 8. Building groups (cluster , etc . ) . 3. Design features (Maximum increase of five percent (5%) : • 1 . Street sections ; 2 . Architectural style ; 3 . Harmonious use of materials ; 4 . Parking area broken by landscape ; 5 . Varied use of house types . - s Ordinance #33 Page 12 b . Density Limitations -- If the Council finds that any of the following conditions would be created by a proposed Planned Development , it may either (1) prohibit any in- crease in density , or (2) decrease the basic density allowance by up to fifteen percent ( 15%) in order to avoid the creation of any of these conditions : 1 . Inconvenient or unsafe access to the Planned Development ; 2 . Traffic congestion which could be projected on the surrounding streets as a result of the existing conditions and approval of the planned development application , and which could thereby create a potential hazard to the health , and general welfare of the residents which adjoin the planned development site . 3 . Excessive burden on parks , recreational areas , schools , and other public facilities which serve the Planned Development . c. Planned Development in more than one ( 1) district -- If the Planned Development is in more than one (1) zoning district , the number of allowable dwelling units must be separately calculated for each portion of the Planned Development that is in a separate zone , and must then be combined to determine the number of dwelling units allowable in the entire Planned Development . However , the distribution of dwelling units and lot sizes within the Planned Development need not be affected by existing zoning district boundaries . Individual buildings , accessory buildings , off-street parking and loading facilities , open area , and landscaping and screeening may be located without reference to lot lines , save the boundary lines of the development . When calculating density of a proposed Planned Development , the total area , including street dedication , shall be included . d . A proposed Planned Development may have specified reasonable minimum lot sizes or other minimum re- quirements for a part of , or all , of the planned development area . Ordinance #33 Page 13 2 . Setbacks and Spacing between buildings --- .. a. Perimeter setbacks - Generally these setbacks will be those of the base district unless otherwise approved by the City Council . b . Interior setbacks - As approved by the City Council ; provided no setbacks shall violate requirements of the Uniform Building Code or Uniform Fire Code . c. Buildings should be located in such a manner so as to avoid , when possible , a corridor or barracks-like effect . d . Increased setbacks - Setbacks greater than those of the immediately adjacent property may be required where the intensity of development is greater than that of the adjacent property to such an extent that greater peripheral setbacks are needed in order to insure the health , safety and welfare of the inhabitants of the development of said A.+ adjacent property . e . In reviewing setback requirements the following criteria shall help govern the degree an appli- cant shall be permitted to deviate from the base zoning district requirements . 1. A better or more appropriate design can be achieved by not applying the provision of the zoning district ; and 2 . Adherence to the requirements of the zoning district is not required in order to insure health , safety and welfare of the inhabitants of the development ; and 3 . Adherence to the requirements of the zoning district is not required in order to insure that property values of adjacent properties will not be reduced . 3. Height sm. a. Generally , no building shall exceed a height which is twenty-five (25) percent greater than that of the maximum building height limitation of the base district in which the planned development is proposed . b . The Council may approve different extra limita- tions not less than that provided in Subsection a , provided that the proposed height is not detrimental , incompatible or otherwise unde- sirable with respect to existing or proposed Ordinance # 33 Page 14 future surrounding area development , and provided that one of the following situations can be found to exist : 1 . That the height increase can be justified on the basis of unique lot characteristics , topographical conditions , or other natural features ; or 2 . That the height increase can be justified on the basis of amenities provided or con- cessions made by the developer for which some bonus incentive is warranted . c. When the Planned Development abuts or is in a single family base district , the building height for the base district shall apply within 200 feet of the said single family base district . 4 . Usable Open Area a. There shall be a minimum of ten percent (10%) ..••. of the total area of the Planned Development dedicated or reserved as common usable open area. Such area shall be clearly designated on the plan as to character of use and develop- ment , but shall not include : 1 . Private or public dedicated streets , alleys and other rights-of-way . 2 . Vehicular drives , parking , loading and storage areas . b . The required minimum lot area for any single family dwelling unit within a planned develop- ment project may be reduced by one (1) square foot for each one (1) square foot of common usable open area substituted in the project site elsewhere , and provided that the minimum lot area is not reduced by more than twenty percent (20%) . The substitute common open area may not be counted toward the minimum required open area for the planned development site . c. With a planned development , a planned residential area may have distributed without regard to the underlying zone , the required open area . d . When , with a PD , a planned residential area is constructed by stages , the plans for usable open area shall include provisions for such areas within each staged area . Ordinance #33 Page 15 e . Required usable open area shall be complete as to .•. approved specifications prior to occupancy of the planned development , or an approved stage thereof . 5 . Off-Street Parking Facilities-- The following shall be applied in all Planned Developments : a . Parking requirements shall be equal to at least the sum of the parking requirements for all uses proposed and which is equal to that required by Article 21 herein , except that those requirements may be increased or decreased where the Council determines that because of the location of the property with respect to surrounding areas within reasonable walking distance , and or public trans- portation , or any other consideration reasonably relating to the need for parking in the development , such increase or decrease is appropriate . However , in a commercial or industrial planned development where it can be demonstrated by the applicant that due to nonconflicting hours of operation , design ''—• of the circulation and parking plan or any other factor reasonably related to the need for parking the total parking requirement can be reduced , the Council may do so provided legal notice of the application specifies that such reduction has been requested . b . Development standards shall be as provided in Article 33 of the Zoning Ordinance except that the following shall also be guidelines : 1. Private streets may serve circulation and parking purposes if providing adequately for fire and police protection , rubbish collection and lighting , as established by the Director of Public Works and the Director of Public Safety . 2 . A building group may not be so arranged that any temporarily or permanently inhabited building is inaccessible by emergency vehicles . 3 . Driveways and circulation roadways shall be designed to minimize traffic and congestion within the Planned Development and to minimize the amount of paving . 4 . Circulation and parking areas shall be separated from recreational areas to facilitate safe vehicular movement . In the design of the circu- lation and parking plan , priority shall be given to pedestrian access and activity . Ordinance #33 Page 16 c . Any required parking spaces serving residential uses shall be located within two hundred (200) .•. feet of the building containing the living units served . Section 33 .07 Dedication and maintenance of facilities --- The Commission may recommend and the City Council may require as a condition of approval for any planned development , that portions of the tract or tracts under consideration be set aside , improved , conveyed or dedicated for the following uses : 1. Streets : That the right-of-way width designated be dedicated to the City . Such other streets necessary to the proper development of adjacent properties may also be required . 2 . Easements : That owner shall grant to the City such easements as will be required to insure the necessary and orderly extension of public utilities , including easements over all non-dedicated private streets over .••. which the City may need ingress or egress for the purpose of protecting and preserving the health , safety , and welfare of the public and for the provision of municipal services of which each citizen within the City has a right to expect and may require at any future time . 3. Underground Utilities : In any development which is primarily designed for or occupied by dwellings , all electric and telephone facilities , fire alarm conduits , street lighting wiring , and other wiring , conduits and similar facilities shall be placed underground by the developer , unless waived by the Council . 4 . Recreation Facilities : The Council may require that suitable area for parks or playgrounds be set aside , improved or permanently reserved for the owners , residents , employees or patrons of the development . Section 33 . 08 Mixed Land Use 1 . Residential use mixed with other uses -- a. In a residential planned development of over four (4) acres , or where development is by stages , and where commercial and /or industrial uses are being developed in conjunction with residential uses , construction of commercial Ordinance #133 Page 17 and/or industrial uses shall not be initiated until a percentage of residential units to be specified in the planned development approval have been developed . The Council may specify stages of approval for industrial or commercial use to coincide with a minimum percentage of residential uses completed . b . A basic premise shall be that such retail and service commercial development and/or industrial development be ancillary to , basically serve , and integrate in a compatible fashion with the primary residential use and character of the planned development district and surrounding properties . Section 33 . 09 General Criteria In addition , a planned development may be granted only if it is found that the development conforms to all of the following general criteria : 1 . That the location , design , size , and uses are consistent with the General (Comprehensive) Plan , adopted by the City now or in the future , and with any other applicable plan , development map , or ordinance adopted by the City Council . If the development plan is found to be in the public interest , but is in conflict with the General (Comprehensive) Plan , amendment of the General (Comprehensive) Plan shall be approved before approval may be granted for the Planned Development application . 2 . That the location , design , and size are such that the development can be well integrated with its surround- ings ; is planned and developed with the intention to harmonize with any existing or proposed development in the adjacent neighborhood ; and in the case of a departure in character from surrounding uses , that the location and design will adequately reduce the impact of the development so the project will not be detrimental to the adjacent property . 3. That the location , design , size and uses are such that traffic generated by the development , except in single family density , can be accommodated safely without congestion on existing or planned arterial or collector streets and shall , in the case of Ordinance #33 Page 18 A. commercial or industrial developments , be designed to attract and accomodate traffic on local arterial or collector streets . 4 . That the location , design , size and uses are such that the residents or establishments to be accommodated will be adequately served by existing or planned public facilities and services . 5 . That the location , design , size and uses should result in an attractive , healthful , efficient and stable environment for living , shopping , working and leisure activities . 6 . That the development plan makes appropriate provision for th preservation of the environment , both natural and man-made . Section 33. 10 Planned Development Subdivisions 1 . Conversions of pre-existing subdivisions to ,..� Planned Developments a . The Council may approve a Planned Development for an area previously subdivided , in which case said subdivision , and any structure con- structed thereon , shall be considered in con- formance with zoning requirements as to lot size , setbacks , and height . Such an area may include a group of structures either sub- stantially constructed cr in existence at the time of the effective date of this Ordinance , which structures when constructed were intended to be similar in purpose and are substantially similar in design and purpose on the effective date of this Ordinance . b . Applicants for conversions of pre-existing subdivisions to Planned Development District zoning shall follow the application and pro- cedures for plan review as set forth in this Article , except that during the pre-preliminary conference the Director of Planning shall advise the applicant as to appropriate modifications which might be made in application requirements . c. In a pre-existing subdivision , the signatures of 51% of the property owned by both number and area shall be required to initiate a planned development application for such area. Ordinance #f33 Page 19 Section 33 . 11 Supplementary Provisions 1. Limitation on resubmission Whenever an application for a planned development has been denied , a similar application for the same area or any portion thereof shall not be filed within six (6) months after the date of denial . 2 . Adherence to approved plan and modification thereof The applicant shall be bound by the plans and narrative for himself and his successors in interest , and by the conditions prescribed for approval of the development . The approved final plan and stage development schedule shall control the issuance of all building permits and shall restrict the nature , location and design of all uses . Minor changes in an approved preliminary or final development plan may be approved by the Building Official if such changes are consistent with the purposes and general character of the development plan . All other modifications and amendments , and all major changes , including extension or revision of the stage development schedule shall have a public hearing for consideration and action by the Council . 3 . Revocation for failure to adhere to approved plan , satisfy conditions of approval , or comply with stage development schedule In the event of a failure to comply with the approved preliminary or final development plan or any prescribed condition of approval , including failure to comply with the stage development schedule , shall constitute a violation of this Article as prescribed in Article 27 . The Commission may , after notice hold a public hearing and recommend the revocation of a planned development zoning district . Thereafter the Council shall consider the recommendation in the same .••. manner as in considering a rezoning request . 4. Expiration and reversion of Planned Development Zoning District If within one (1) year after the approval of the preliminary plan and designation on the Apache Junction Zoning Map by the Council , construction specified in the final development plan has not been 4 Ordinance #33 Page 20 commenced , or cannot be developed as approved , then the PD District classification shall be recalled to the Commission for review. If it has not been shown that it is in the public interest , and if the applicant has not demonstrated good cause necessitating the extension of time , the Commission shall recommend the PD designation revert to the base zone designation existing at the time of approval of the Planned Development Zoning District , or other appropriate designation . If however , the applicant shows good cause necessitating an extension which would serve the public interest , then the Commission may grant two (2) extensions of time to commence substantial construction . Each extension of time shall not exceed a one ( 1) year period . 5 . Transfers and assignments - If during any stage of the development the property under application , or any portion thereof , is trans- ferred or assigned to another , then the transferee or assignee shall be bound to the requirement and design of the approved project ; except that a transferee or assignee may make application for a major change of the application in which case the Council shall hear the application as if it were a major change in the Planned Development . 6 . Cancellation by applicant Cancellation may be initiated by the applicant of the property covered by the application by means of a written Notice of Cancellation directed to the Department of Planning . Cancellation of the applica- tion shall become effective thirty (30 ) days after receipt of the Notice of Cancellation in the Office of the Department of Planning . 7 . Use or occupancy No building or structure within the planned development or portion thereof as approved for stage development shall be used or occupied , and no change in the existing occupancy classification of a building or structure or portion thereof shall be made until the Building Official has issued a Certificate of Occupancy thereof as provided under the provisions of the Uniform Building Ordinance #33 Page 21 8. Planned Development precedents The approval of departures from standards ordinarily required for a base district zone , or for any other planned development , shall not be considered as precedent setting when approved for any individual planned development project . 9 . Construction standards -- building permit issuance The provisions of the Uniform Building Code and all other City codes and detailed standards shall apply • and control all design and construction of improvements within a planned development . 10 . Map change and Mapping Map Chance-- Approval by the City Council of the pre- liminary development plan in accordance with the procedures and requirements of the Apache Junction Zoning Ordinance shall constitute approval of the necessary amendment of the Official Zoning Map of the — City of Apache Junction and the map shall be changed in accordance with the approved site area . Whenever a planned development has been approved and remains in effect , the boundary of the planned development shall be indicated on the Zoning Map of the City . 11 . Termination of a Planned Development after completion A planned development may not revert to any base district designation upon completion unless and until all requirements of the base district are complied with . Should the applicant or any transferree or assignee , of an approved planned development wish to discon- tinue the PD use , or uses , upon or after completion , any use , or uses , of the land including the continua- tion of the planned development zoning district designation shall be reviewed and may be approved by Aft. the Council . SECTION II : REPEAL OF CONFLICTING ORDINANCES All ordinances and parts of ordinances in conflict with the provisions of this Ordinance or any part of the code adopted herein by reference , are hereby repealed . Ordinance #33 Page 22 SECTION III : SEVERABILITY If any section , sub-section , sentence , clause , phrase or portion of this Ordinance or any part of the code adopted herein by reference , is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction , such decision shall not affect the validity of the remaining portions thereof . SECTION IV : EMERGENCY CLAUSE Whereas , it is necessary for the preservation of the peace , health and safety of the City of Apache Junction , Arizona , an emergency is declared to exist , and this Ordinance shall become immediately operative and in force from and after the date of posting hereof . Although 4 companies received bid packets, only IBM responded. After reviewing the bid from IBM with the current price book from the company we currently lease a copier from (Xerox) , the City will save approximately $1,000.00 over the period of a 12 month lease, with add- itional savings possible on a 2-year lease. The IBM machine also offers extra features, such as automatic two sided copying, which comparable machines do not offer in this price range. I recommend acceptance of the IBM proposal for a 2-year extended lease which offers the City the lowest available lease cost. Improvements were phased and options were provided for in order to minimize expenses. Essentially, improvements call for grading, curb, paving, storm retention and storm drainage for a portion of the complex. As the City is presently asking developers to comply with proposed improvement guidelines,it seems the City should set a good example. Also, improvements are needed to control dust, route traffic and provide a means of routing storm water, while reducing erosion. During the previous construction, when it rained, mud and rocks were tracked on the new carpets and tiles. Not paving will certainly increase our liability and building maintenance costs as well as reduce the life and appearance of the new units. This department recommends that Professional Contracting Co. , Inc. be awarded the contract as the lowest and most qualified bidder. Their low bid for option number three was $44,762.40. The Consultant shall do, perform and carry out in a satisfactory and proper manner, as determined by the Sponsor and the State of Arizona, the services generally outlined below and specifically indicated in Exhibit A - Scope of Services, attached and incorporated by reference hereto. 1.3 Notice to Proceed. The official notice to proceed will be issued only after the Sponsor has received the Project Grant from the State of Arizona. The Consultant can proceed with work elements associated with this project prior to the issuance of a Project Grant at his own risk if he so desires . The Sponsor will not be liable for claims for services performed until the State of Arizona has awarded the Project Grant and the official Notice to Proceed has been issued. 1.4 Time of Performance. The services of the Consultant shall be undertaken and completed in the sequence shown in Appendix B - Project Schedule, attached and incorporated by reference hereto. Total time of performance shall not exceed twelve (12) months. 1.5 Responsibility of the Consultant. The Consultant shall be responsible for the professional quality, technical accuracy and the 1 coordination of all services provided by the Consultant under this contract. The Consultant shall , without additional compensation, correct or revise any errors or deficiencies in any documentation prepared in association with this Project. ARTICLE 2 - COMPENSATION AND METHOD OF PAYMENT 2. 1 Compensation. It is expressly understood and agreed that the • total compensation to be paid to the Consultant shall be a firm fixed price amount of Sixty Thousand Dollars ($60,000) for the services specified in Exhibit A - Scope of Services. Such sum shall constitute full and complete j compensation for the Consultant ' s services , as identified in Exhibit C - Cost Summary, attached and incorporated by reference hereto. 2.2 Method of Payment. The Sponsor shall pay to the Consultant not more 1 than the fixed price amount set out in Article 2. 1 above. Payments shall be at monthly intervals subject to receipt of requisitions for payments !: from the Consultant specifying that he has performed the work and is entitled to the amount requisitioned under the terms of this Agreement. Ten percent (10 ) of the total value of Work completed shall be retained by the Sponsor until satisfactory completion of the Project. 2.3 Consultant Responsibilities for Compensation. The Consultant shall prepare monthly invoices and progress reports which clearly indicate the progress to date and the amount of compensation due by virture of that progress. All requisitions for payment shall be for work completed unless otherwise agreed to by the Sponsor. The Consultant shall also prepare the necessary State forms and Requisition for Payment under the Project Grant requirements for the State of Arizona. 2.4 Sponsor Responsibilities for Compensation. The Sponsor agrees to pay the Consultant 's invoices net upon receipt. At no time will payment of requisitions exceed thirty (30) days from the date of the invoice without written notification to the Consultant . It is expressly understood that the payment process outlined above builds in provisions for the Consultant to carry Project costs for no more than Sixty (60) days to minimize interest overheads and provide more planning manhours for each Project dollar. It is also expressly understood that the Sponsor has the right to withhold payment on any invoice if he feels that the Consultant has not performed the requisitioned work efforts in a satisfactory manner. If the Sponsor does decide to withhold payment to the Consultant for any reason he must provide written notification and an explanation to the Consultant within ten (10) days of the date of the invoice. ARTICLE 3 - CHANGES TO THE SCOPE OF SERVICES The Sponsor may, at any time, and by written order, make changes in the services to be performed under this Agreement. If such changes cause an increase or decrease in the Consultant 's cost or time required for performance of any services under this contract, an equitable adjustment shall be made and the contract shall be modified in writing accordingly. Any claim of the Consultant for adjustment under this clause must be submitted in writing within 30 days from the date or receipt by the Consultant of the notification of change. No services for which an additional cost or fee will be charged by the Consultant shall be furnished without the prior written authorization of the Sponsor. ARTICLE 4 - TERMINATION OF THE AGREEMENT The Sponsor may, by written notice to the Consultant , terminate this contract in whole or in part at any time , either for the Sponsor's • convenience or because of the failure of the Consultant to fulfill his contract obligations. Upon receipt of such notice, the Consultant shall : (1) immediately discontinue all services affected (unless the notice directs otherwise) , and (2) deliver to the Sponsor all data, drawings , reports, estimates, summaries , and such other information and materials � . as may have been accumulated by the Consultant in performing this contract , whether completed or in process. If the termination is for the convenience of the Sponsor, an equitable adjustment in the contract price shall be made, but no amount shall be allowed for anticipated profit on unperformed services. If the termination is due to the failure of the Consultant to fulfill his contract obligations , the Sponsor may take over the work and prosecute the same to completion, by contract or otherwise. • ARTICLE 5 - ASSURANCES • 5.1 Covenant Against Contingent Fees. The Consultant warrants that he has not: 5.1 .1 employed or retained any company or person, other than a bona fide • employee working for the Consultant ; to solicit or secure this Agreement , or paid or agreed to pay any company or person, other than a bona fide employee, any fee, any commission, percentage , brokerage fee, gift , or any other consideration , contingent upon or resulting from the award or making —• of this Agreement. For breach or violation of this warranty, the Sponsor shall have the right to annul this Agreement without liability, or, in its discretion to deduct from the Agreement price or consideration or otherwise recover the full amount of such fee, commission, percentage , brokerage fee, gift or contingent fee. 5.1.2 paid or agreed to pay to any firm, organization, or person (other t than a bona fide employee working solely for the Consultant) any fees, contribution, donation, or consideration of any kind for, or in connection with, procuring or carrying out the contract; except as here expressly stated: 5.2 Compliance with Equal Employment Opportunity. The Consultant agrees to comply with the regulations relating to nondiscrimination whether State or Federal , and agrees to make similar provisions in all contracts with any subcontractors used in the performance of this Project. 5.3 Ownership of Documents and Other Data. The Consultant agrees that all drawings, reports, estimates, summaries , notes, and other work developed in the performance of this contract shall be and remain the sole property of the Sponsor and may be used on any other work without additional compensation to the Consultant. With respect thereto, the Consultant agrees not to assert any rights and not to establish any claim under copyright laws. The Consultant for a period of three (3) years after completion of the Project, agrees to furnish and provide access to all retained materials on • the request of the Sponsor. Unless otherwise provided in the contract , the Consultant shall have the right to retain copies of all such materials beyond such period. 5.4 Examination of Records. The Consultant agrees that duly authorized representatives from the State of Arizona and the Sponsor shall , until the expiration of three (3) years after final payment under this contract , have access to and the right to examine any directly pertinent books , documents, papers , and records of the Consultant involving transactions related to this contract. 5.5 Subcontractors , Outside Associates and Consultants. The Consultant agrees that any subcontractors and outside associates or consultants required by the Consultant in connection with the services covered by the contract will be limited to Coffman Associates of Kansas City, Missouri . Any substitution in such subcontractors, associates , or consultants will be subject to the prior written approval of the Sponsor. 5.6 Procurement Standards. The Consultant understands and agrees that the type of procuring instruments used (i .e. fixed price contracts, cost reimbursable contracts , purchase orders , incentive contracts , etc. ) , shall be appropriate for the particular procurement and for promoting the best interest of the Project. Furthermore, the Consultant certifies that the "cost-plus-a-percentage-of-cost" method of contracting shall not be used. If the performance of all or any part of the work is, for any unreasonable period of time, suspended or delayed by an act of the Sponsor in the administration of this contract , or by its failure to act within the time specified in this contract (or if no time is specified, within a reasonable time) , an adjustment shall be made for any increase in cost of performance of this contract necessarily caused by such unreasonable suspension or delay , and the contract modified in writing accordingly. However, no adjustment shall be made under this clause for any suspension or delay to the extent (1 ) that performance would have been suspended or delayed by any other cause, including the fault or negligence of the Consultant or (2) for which an equitable adjustment is provided for or excluded under any other provision of this contract. ARTICLE 7 - COMPOSITION OF CONSULTANT If the Consultant is comprised of more than one legal entity, each such I; entity shall be jointly and severally liable. ARTICLE 8 - INTERESTS AND BENEFITS 8. 1 Interest of Consultant. The Consultant covenants that he presently has no interest and shall not acquire any interest , direct or indirect, which would conflict in any manner or degree with the performance of services required to be performed under this Contract. The Consultant further covenants that in the performance of this Contract no person I `• - having any such interest shall be employed. 8.2 Interest of Members of Sponsor and Others. No officer, member or employee of the Sponsor and no members of its governing body, who exercises any functions or responsibilities in the review or approval , ' of the undertaking or carrying out of the services to be performed under this Contract , shall participate in any decision relating to the contract which affects his personal interest or have any personal or pecuniary interest, direct or indirect , in the Contract or the proceeds thereof. ARTICLE 9 - ASSIGNABILITY The Consultant shall not assign any interest in this contract , and shall not transfer any interest in the same without the prior written consent of the Sponsor thereto, provided, however, that claims for money due or to become due to the Consultant from the Sponsor under this contract may be assigned to a bank, trust company, or other financial institution without such approval . Assemble , catalogue and review all data for use in later tasks of the study and to support inquiries and interviews in the local area. Output: Organized reference file to support master plan analyses. Task 1 .2 Obtain Land Use Data Description: Obtain copies of existing local community planning and land use regulations contained in existing documentation and mapping. This effort will concentrate on identifying boundaries under some formal jurisdictional control and the land uses by type that may have been established for the airport siting area. These types will be general and will include but not be limited to residential , commercial , industrial , agricultural , recreation, conservation , and public uses. In addition available information will be obtained that will identify the physical characteristics which may influence construction and planning for an airport. These characteristics include soil classifications , topographic conditions , flood hazard area, public utilities , drainage and flood control works , major power and pipeline rights-of-way, railroads , and key ground transportation routes. Preliminary discussions will also be held with area planning agencies to determine procedures for obtaining assurances that compatible land uses can be maintained around a new airport. Output: Land use assurances data for environmental assessment. Task 1 .3 Obtain Environmental Data Description: Identify and assess the status of natural environmental factors that may be of particular significance to selection of a new airport site such as. a - Ambient air quality conditions and standards - Water quality standards , conditions and resources - Plant and acquatic life indigenous to the area - Archaeological considerations - Prime farmland identification and status - Present and planned public parks , recreation areas, wildlife refuges, historic sites , and monuments - Wildlife and waterfowl , endangered species - Solid waste and sewage disposal regulations and facilities This information will be compiled for later use in evaluating direct environmental relationships of the airport. Output : Environmental background data. Task 1 .4 Obtain Socioeconomic Data Description• Obtain area-wide socioeconomic data and update and verify the projections and content where necessary. This effort will include population data, income, and employment. Review existing data available on factors that may reveal a potential for induced or secondary socioeconomic impacts such as shifts in human settlement patterns , changes in population growth, public service demands , and any changes to business or economic activity. .r. Output: Socioeconomic background data. Task 1 .5 Obtain Existing Area Airport Data Description: Each area airport will be inspected to determine present activity, expansion potential , current based aircraft , future development intentions and facilities available to the public. Annual operations per based aircraft and airport capacity will be estimated at the significant area airports. The type of service provided at each airport will be reported. Output: Area airport characteristics reported in text. Task 1 .6 Identify Area Registered Aircraft Description • FAA aircraft registration data will be assembled and summarized. Aircraft with gross weights greater than 8,000 pounds will be identified by owner and aircraft type and will be listed in the report text. Special attention will be given to aircraft registered in the area, where they are based, and the number of annual operations performed. Output : Quantification of area aircraft and activity by type of aircraft. 1 Task 1 .7 Assemble Weather Data Description: W►nd velocity data from all available relevant sources will be collected, reviewed and compared to determine which is most applicable to a new airport site. Output: Windrose. Task 1 .8 Prepare Basic Reference Map Description- A reduced USGS map mosaic will be prepared to identify the future land use planning and existing airspace. This basic map will be utilized throughout the study to identify basic siting area, local boundaries, land uses , transportation corridors and topography. Output : Reference map. Task 1 .9 Prepare Inventory Working Pacer Description• Combining the data and conclusions drawn from the previous efforts , prepare a working paper that provides a detailed overview of the background information compiled and the parameters to be used to establish boundaries of the area in which an airport could be feasibly located to adequately serve the needs of the Apache Junction area. Output: Background information and identification of the airport siting area criteria. Task 1 . 10 Prepare Public Information Brochure Description : Organize basic information and community data and develop a narrative and graphical presentation ►n the form of a simple brochure explaining the purpose, organization, work efforts , and goals of the airport master plan. The brochure will be one color ink on colored paper, 8ix11 inches, printed on both sides , tri-folded. Output: 2000 copies of a Public Information Brochure. Task 1 .11 Prepare Planning Advisory Committee Workbooks Description: Three-ring notebooks will be prepared with the Airport Master Plan cover, tabs for the primary master plan elements and meeting minutes and notes. This notebook will be used by planning advisory committee members to organize the working papers and other information developed during the course of the study. Output: 25 copies of the Planning Advisory Committee Workbooks. K ELEMENT 2 - FORECASTS Task 2. 1 Planning Advisory Committee Meeting {Y Description: Schedule and conduct a meeting of the Planning 0- Advisory Committee to review and evaluate the inventory working paper. This meeting will also be used to discuss the efforts that will be ; undertaken during the next phase of the study especially the identi- fication of an airport site area boundary. Output: Coordination and direction for continuing study efforts. f<< Task 2.2 Determine Airport Site Area Description: Utilizing information developed in Element 1 and the overview provided by the planning advisory committee , establish boundaries based on population centers , location of industry, pertinent existing area-wide planning and access. This area will be used to t identify the general limits of a search area that appears to be feasible for locating an airport for maximum present and future benefit to 5 Adak the area. Output: Airport site area boundary. Task 2.3 Develop Airport Activity Forecasts Description: The total Apache Junction area aircraft operation's forecasts for each phase of the study period will be compared to the airport system capacity outlined in the Regional , State and Federal _ System Plans. The deficit capacity by phase will be checked and related to general design phasing requirements for a new airport . Operations forecasts will be refined and expanded from data developed in Element 1 and forecasts will be prepared to include the following : - Annual and peak hour aircraft operations - Based aircraft - Aircraft mix - Local and itinerant split - Annual Instrument Approaches - Annual and peak hour enplaned passengers - Annual enplaned airmail and cargo volumes Output: New Airport Activity Forecasts Task 2.4 Establish Air ort Re uirements Description: Utilizing the data developed from the previous tasks in this section perform a general demand/capacity analysis where necessary to verify the general airport requirements that will be necessary to meet projected demand so that it can be utilized as criteria for establishing basic factors in the search for an adequate site for the ultimate development of the airport. Output: Airport Requirements and Site Criteria. Task 2.5 Prepare Forecasts Working Paper Description• Combining the data and conclusions drawn from the previous efforts, prepare a brief working paper that establishes and describes that criteria that will be used in the site selection process. Output : Forecasts Working Paper. ELEMENT 3 - PRELIMINARY SITE ANALYSIS • ..�. Task 3. 1 Planning Advisory Committee Meeting. Description: Schedule and conduct a meeting with representatives of the Planning Advisory Committee to review and evaluate the forecasts working paper. This meeting will also be used to schedule the public information meeting and to outline the activities of upcoming work efforts. Output : Coordination and direction for continuing study efforts. Task 3.2 Conduct Public Information Meeting Description : Schedule and organize an initial public information meeting to acquaint the public with the purpose and organization of this study. The primary elements to be covered in this meeting will be to familiarize the public with the study format , ways in which the public may become involved in the study, the findings to date , the activities of the consultant 's prior to the next meeting , open discussion and a back- ground slide presentation relating to general aviation airport development. �► Output: Public Information Meeting and Summary Memorandum. Task 3.3 Perform Overlay Analysis Description: This initial process will begin with the base map prepared in Task 1 .8. A series of base map overlays will be prepared which will "black out ," areas of land which are least suitable for airport development. The following criteria (each factor represents an overlay) will be utilized in the overlay procedure: 1. Urban Development. Developed and proposed commercial , industrial , and residential areas will be identified and eliminated from further consideration. 2. Historic and Archaeological . Areas containing known sites will be identified and eliminated from consideration. 3. Areas of Unusual Scenic Beauty. These areas , as identified by local sources, will be eliminated from consideration. 4. . Existing Airport Airspace. Standard airspace configurations will be identified for each area airport. Existing smaller airports for which a low probability for continued operation has been identified will not be entirely eliminated from consideration. A comprehensive evaluation of area airport traffic • d flow compatibility is not possible with two-dimensional graphics, however. Therefore, only general limitations to a new site will be identified in the elimination procedure and the airspace analysis will be performed as a separate work element. 5. Potential Airspace Obstructions. Communication towers , smoke stacks, and power transmission lines will be identified by symbol to the readily apparent as site limitations. 6. Excess Slope. Areas of terrain with slopes greater than 2% will be eliminated. It is quite possible that the selected site may p infringe on areas with slopes greater than 2% but not with the major portions of the runways. 7. Flood Hazard. Areas subject to 100-year flood probability will be eliminated as indicated by current Federal Flood Insurance Administration maps. 8. Absence of Water Supply Source. Areas without economically feasible groundwater supply , surface water or an adjacent local system will be eliminated. 9. Sanitary Landfills. Locations will be identified. Output: Overlays prepared for base map to graphically identify each major factor. Task 3.4 Identify Potential Airport Sites Description• From Task 3.4 the overlays will be combined into a composite to readily identify areas which may be suitable for airport development. Output: Overlay composite and identification of potential sites. Task 3.5 Engineering Site Rating Analysis Description: All sites identified in Task 3.4 will be evaluated for development costs and other factors including drainage, site clearing , general soil characteristics , obstruction removal , general topography , road relocation, and structure relocation. Consideration will be given to the probability of adjacent compatible urban development. Output: Potential sites will be related to each other in matrix format. Task 3.6 Environmental Site Rating Analysis Description: Each airport site identified in previous tasks will be evaluated in a general sense for its relationship to environmental factors . These factors will include but will not be limited to: ... - Social Considerations - Public Acceptance - Land Use Compatibility - Prime Farm Land - Property Value _ - Tax Base - - Relocation Needs and Impacts - Community Disruption Factors Influence on Future Area Development Output: A general environmental rating for all potential sites. Task 3.7 Prepare Selection of Candidate Sites Working Paper Description- Combining the data and conclusions drawn from the previous efforts , prepare a working paper that provides a detailed overview of the data and evaluations utilized to examine potential sites and eliminate those with the least potential for feasibility. "`. Output: Selection of Candidate Sites. Task 3.8 Planning Advisory Committee Meeting Description- Schedule and conduct a meeting of the Planning Advisory Committee to review and evaluate the candidate site selection working paper. This meeting will also be used to discuss the efforts that will be undertaken during the next phase of the study. Output: Coordination and direction for continuing study efforts. Task 3.9 Determine Land Ownership Description- Once the candidate site(s) have been selected, apply the airport requirements data pertaining to land area and site configuration to identify the general location and extent of each proposed site. Obtain through local or county records the number, size and ownership of each parcel of land included in the site property boundaries, and depict this information on site layouts prepared in later tasks. Output: Identification of land ownership at candidate sites. lx_ ELEMENT 4 - REFINED SITE ANALYSIS } Task 4. 1 Evaluate Airspace Considerations Description: Compare the airport airspace needs for each candidate site to the area needs and system. As a part of this procedure identify areas where airspace may be saturated or restricted as a result of the location of a new airport. Where airspace conflicts result from the development of a new airport , evaluate and identify the level or degree of conflict and the delays that might result. tl Output: Airspace analysis on each candidate site. {i n [ }. Task 4.2 Refine Site Requirements tx Description: Utilizing the basic forecast data on aeronautical activity as well as FAA design standards and the facility requirements , determine the overall requirements of the airport to be used in evaluating potential sites. These requirements will include but not be limited to the runway length and orientation, general airfield layout and minimum �► land area required to accommodate a facility of the size indicated by the forecasts. Output: Airport Site Requirements. Task 4.3 Estimate Development Costs Description: Quantities will be estimated , unit costs will be established for purposes of comparison and the total development cost at each site will be estimated. Costs of major improvement items will be reported. Output : Ultimate development costs for each of the candidate sites. Task 4.4 Prepare General Site Layouts Description• For each of the candidate sites , a general airport layout sketch will be prepared (8 " X 11") indicating runway and taxiing configuration, access road requirements, general terminal area location , /011 and major existing topographical features. Wind coverage at each site will be computed and indicated on each sketch. Output: General site layout sketch for each of the candidate sites. • Task 4.5 Prepare Aircraft Noise Contours Description: Utilizing the airport activity and fleet mix forecasts developed for the new airport , prepare aircraft noise contours for each candidate site. The contours will be developed using the Day-Night Sound Level (Ldn) metric which is a cumulative measure with a penalty for night time operations. These contours will be prepared utilizing a standard hand calculated methodology presented to Report No. FAA-AS-75-1 "Developing Noise Exposure Contours for General Aviation Airports" by Bolt , Beranek, and Newman, Inc. The contours will be depicted on the site layouts prepared in previous tasks. Output: Aircraft noise contours for each candidate site. ELEMENT 5 - SITE SELECTION p Task 5. 1 Conduct FAA Site Inspection Description: Following discussion of the characteristics of each of the candidate sites, FAA representatives will be invited to inspect each site with representatives of the Planning Advisory Committee and the Consultants. Output: FAA familiarization with each potential site prior to Public Information Meeting Number 2. Task 5.2 Prepare Candidate Sites Working Paper Description. Combining the data and conclusions drawn from the previous efforts, prepare a working paper that provides a detailed overview of the data and evaluations utilized to examine the candidate sites. This data will be organized in such a way that the advantages and disadvantages of each candidate site can be easily identified and understood. Mt Output • Evaluation of Candidate Sites. Task 5.3 Planning Advisory Committee Meeting Description: Schedule and conduct a meeting of the Planning Advisory Committee to review and evaluate data developed about each candidate site. This meeting will be used to discuss the relative merits of each candidate site as well as the signif►cant negative factors involved, and to outline the activities involved in the follow-up effort of recommending a site or sites in preferential order. Output: Coordination and direction for continuing study efforts. Task 5.4 Conduct Public Information Meeting Description: Schedule and organize a public information meeting to acquaint the public with the analyses and findings from study efforts to determine the candidate sites for the airport. The primary elements to be covered in the meeting are the selection of the sites themselves , the process of elimination and the procedures to be used in further eliminating the sites, recommending the remaining sites in preferential order, and open discussion, This meeting will require several graphic aids and formal preparation to produce. Output: Public Information Meeting. Task 5.5 Determine Recommended Site Description: Based upon the conclusions drawn from both the refined ,.. site analysis and from the public information meeting discussing these sites prepare adequate background rationale and information to support the recommendation of a single site for a new airport. Coordinate this selection with a final discussion between cognizant community officials and interested parties as well as the Arizona Department of Transportation and the Federal Aviation Administration. Output : Selection of a Preferred Site. Task 5.6 Assemble Environmental Assessment Document Description . Once the selection of a preferred site has been made the data obtained in previous efforts will be compiled and organized into a draft environmental assessment document for distribution. This effort will include the development of detailed assessment data and will comply with FAA Order 1050. 1C and 5050.4 as well as responding to any remaining community require-ents that might become necessary as a result of public concern or controversy. Twenty (20) copies of the Draft Assessment will be prepared. Output: Twenty (20) copies of Draft Environmental Assessment Document. Task 5.7 Conduct Public Hearing on Site Selection Description: A duly advertised, formal public hearing will be held at an appropriate tine and location upon the availability of a complete draft of the Environmental Assessment Document. The hearing will be conducted to provide an overview of the site selection process and the environmental , social and economical factors significant to the recommended airport sites , and to allow for interested and affected citizens to make comments and express opinions on the process and/or in favor of or in opposition to the recommended sites. The consultant will prepare the appropriate graphic aids needed to provide the overview and will organize and conduct the hearing. The hearing will be preceded by an informal information meeting to answer general questions about the study and its results to date. Output: Forr-al Public Hearing and Information Meeting. .•. Task 5.8 Prepare Final Environmental Assessment Document Description: Co-ments made at the public hearing as contained on the verbatim transcript , as well as those received in writing from A-95 review agencies , ether agencies and citizens who submit them within 30 days after the Public Hearing will be evaluated. Appropriate written response in the form of answers to questions , correction of errors or omissions, additional data or referral will be prepared for attachment • to the related comment source document. Utilizing the information obtained above, reorganize and expand the draft environmental assessment document to reflect and include the material and format required under FAA Order 1050. 1C "Policies and Procedures for Considering Environmental Impacts" especially Appendix 6 "Instructions for Processing Airport Development Actions Affecting the Environment." Upon completion of the revisions and attachments print fifty (50) copies of the document for review distribution. Output: Fifty (50) copies of Final Environmental Assessment Document. i ELEMENT 6 - PLANS AND REPORTS Task 6. 1 Refine Development Schedule �► Description • A land acquisition and development program will be recommended based on forecast activity. Development will be reported by phase (0-5 year, 6-10 year, 11-20 year) , based on activity, avail- ability and estimated future funding resources. Special attention will be given to development phas►ng for the initial development of the airport. Improvements recommended during each phase will be indicated, in detail , on 8z"X11" drawings in the text. Output: Development Schedule and supporting narrative and graphics. Task 6.2 Refine Cost Estimates Description: Land and improvement costs will be verified for each development phase based upon local current unit construction prices and reported comparable land sale prices. No appriasals will be performed by the Consultant. Quantities and unit costs will be estimated for each development item. The cost estimates will be adequate for project budgeting. Output: Development of Cost Estimates. Task 6. 3 Develop Financial Plan Description: A thorough review of fund source alternatives will be performed at the outset of this task and listed on the report text. The availability of federal grants , State grants , revenue bonds , county road funds, private financing of terminal area improvement and estimated airport revenues will be considered separately and in combination. Application of Federal grant funds other than FAA will be considered. Output: Detailed Financial Plan. Task 6.4 Economic Feasibility Evaluation Description: Economic benefits resulting from development of the new airport will be identified and quantified to the extent possible. Potential increased tax revenues to adjacent communities , improved safety , added employment and direct and indirect business expansion will be related to project development costs , operation and maintenance costs , and . - „ airport revenues. Particular attention will be given to the benefits to the area immediately affected by airport development. Output: Economic Feasibility Evaluation. i Task 6.5 Prepare Airport Layout Plans Description: Prepare appropriate drawings associated with an airport layout plan set meeting FAA requirements. This set of plans Aim. will be prepared on 24"X36" mylar reproducible film which will become the property of the City of Apache Junction. The airport layout plan { set will include the drawings outlined and described below: (1) Airport Layout Plan !!1 The airport layout plan will be drawn to a scale of 1" = 300' d ` or 1" = 400' and will include the layout of the existing and ultimate l development of the airport. This will include, but will not be limited to, the runway configuration , taxiways , aprons, terminal facilities , hangars, automobile parking and access and the physical boundaries of the airport. The windrose analysis , basic runway data tables , facility legend and building identification table will also be included on this drawing. 1 t (2) Airport Airspace Drawing 4 I The airport airspace drawing will include a plan view of all FAR Part 77 surfaces based on ultimate runway lengths and approaches , and profile views of ultimate approaches. The plan view will be drawn at a scale of 1" = 2000' and the profiles will be drawn at a scale of i 1" = 2000' and the profiles will be drawn at a scale of 1" = 1000' 1 horizontal and 1" = 100' vertical . The background maps for the airspace i drawing will be U.S.G.S. Topography maps. (3) Approach and Clear Zone Drawing Large scale approach and clear zone drawings will be made for i each end of each runway. The drawing will consist of 1" = 100' horizontal I and 1" = 20' vertical plan and profile views of the inner portions of the runway approaches. Topography and land features will be included by simplified mapping. (4) Terminal Area Drawing 1 The development of the terminal area plan will evolve from the 1 airport layout plan drawing and the airport land use drawing. The terminal i area plan will include the primary operation's area of the airport and will be drawn at a scale of 1" = 50' or 1" = 100' with appropriate topographic contours. (5) Airport Land Use Drawing A comprehensive "on airport" land use plan will be developed. The drawing will also evolve from the airport layout plan and will be the i same scale, but will reflect only pertinent dimensional criteria , boundaries , i physical facilities and land uses. The land uses for all land area within i the airport boundary will be depicted with symbols. The areas set aside for ; 1 1 each type of use will be defined by both appropriate symbol and dimensions to make adherence to these uses easier to accomplish. Output : Seven (7) sets of prints and the original mylar drawings of the Airport Layout Plan Set. Task 6.6 Planning Advisory Committee Meeting Description: At an appropriate time near the completion of this phase of the study conduct the final planning advisory committee meeting to discuss concluding requirements and any special needs for the development of the final master plan report. This meeting will also be used to outline plans for implementation of the master plan and to set the first phases of implementation into motion, including application for inclusion into the National Airport System Plan (NASP) and application procedures for State and Federal grant participation in land acquisition and/or construction. This document will incorporate in sufficient 1 -! detail all of the data and recommendations developed throughout the entire Study effort. it will be adequately inclusive and provide approximate depth to insure that all technical elements of the plan process are clearly identified as to their methodology, data content , and pertinent conclusions. It will describe the various plan alternatives , both for the Airport and the Environs Area, that were considered in achieving recommendations , and will indicate the reasons for selecting I those alternatives which prove to be most desirable. The SPONSOR now has on deposit or is in a position to secure$ 6,000 ,or an equivalent amount represented by SPONSOR's proposed labor end equipment costs,for use in defraying SPONSOR's share of the costs of the PROJECT The present status of these funds Is as follows. 3. The SPONSOR possesses legal authority to apply for the grant and that a resolution motion or similar action has been duly adopted or passed as an official act of the SPONSOR's governing body,authorizing the filing of the application including all understandings and assurances contained therein,and directing and authorizing the person identified as the official representative of the SPONSOR to act in connection with this application and to provide such additional information as may be required • The SPONSOR hereby designates NAME TITLE to receive payments representing the STATE's share of PROJECT cost. ADDRESS PART III -SPONSOR'S ASSURANCES The SPONSOR hereby covenants and agrees with the STATE as follows 1 That these covenants shall become effective upon execution of an Intergovernmental Agreement for the PROJECT or any portion thereof,made by the STATE and shall constitute a part of the Intergovernmental Agreement thus formed and shall remain in full force and effect throughout the useful life of the facilities developed under the PROJECT,but in any event not to exceed twenty(20)years from date of said execution of the Intergovernmental Agreement 2. To operate the AIRPORT as such for the use and benefit of the public,and to keep the AIRPORT open to all types,kinds and classes of aeronautical use without discrimination between such types,kinds and classes,provided that the SPONSOR shall establish such fair equal and nondiscriminatory conditions to be met by all users of the AIRPORT as may be necessary for the safe and efficient operation of the AIRPORT and provide further,that the SPONSOR may prohibit any given type kind or class of aeronautical use of the AIRPORT if such use would create unsafe conditions,interfere with normal operation of aircraft,or cause damages or lead to the deterioration of the runway or other AIRPORT facilities J To suitably operate and maintain the AIRPORT and all facilities thereon or connected therewith which are necessary for AIRPORT purposes and to prohibit any activity thereon which would interfere with its use for aeronautical purposes.and to operate essential facilities,including night lighting systems,when installed in such manner as to assure their availability to all users of the AIRPORT,provided that nothing contained therein shall be construed to require that the AIRPORT be operated and maintained for aeronautical uses during temporary periods when snow,flood or other climatic conditions interfere substantially with such operation and maintenance 4 To refrain from entering into any transaction which would operate to deprive the SPONSOR of any of the rights and powers necessary to perform any or all of the covenants made herein,unless by such transaction the obligation to perform all such covenants is assumed by another public agency eligible to assume such obligations and having the power,authority and financial resources to carry out such obligations and if an arrangement is made for management or operation of the AIRPORT by an agency or person other than the SPONSOR or any employee of the SPONSOR,the SPONSOR will reserve sufficient powers and authority to insure that the AIRPORT will be operated and maintained in accordance with these covenants 5. To maintain a current Airport Layout Plan(ALP)of the AIRPORT having the approval of the STATE which shows building areas and landing areas,indicating present and future proposed development,to conform to the ALP in making any future improvements or changes at the AIRPORT,and to furnish the STATE a current ALP of the AIRPORT and such information as is necessary to keep the ALP current 6 The SPONSOR hereby assures that it is the Owner,or Lessee of the property or properties on which the AIRPORT is located and that the lease,if any,guarantees that the SPONSOR has full control of the use of the property for a period of not less than twenty(20)years from the date of the Agreement. 7. Mr. Baljo announced the public hearing opened on Ordinance No. 41 (PZ-6-80) and asked the executive secretary to brief those present on Ordinance No. 41. 6. Mr. Gero briefed those present on Ordinance No. 41 (PZ-6-80) stating that it is a Commission recommendation to the City Council for the adoption of a Building Permit and Fee Schedule based on Table 3-A in the Uniform Building Code with suggested approval. being 70% of the scheduled amount as outlined in Table 3-A. Page 2 - Planning and Zoning Commission 7. Mr. Gero explained to those present that if the building permit fees were eliminated from the ordinance, a substitution must be in- stituted. 8. Mr. Baljo requested that Mr. Gero explain the appli- cation of Table 3-A to the Apache Junction schedule of fees. 9. Mr. Gero explained that the Table 3-A as outlined in the Uniform Building Code was a com- posite of the national average. The appli- cation of the fee schedule in Apache Junction would be 70% of this national average. If the fee schedule was less than the 70%, then the public would be forced to subsidize the balance. If the fee schedule was more than the suggested 70%, then the City would be actually charging a fee that was higher than the cost. 10. Mr. Gero called on the City's Building Administrator, Mr. Leo Frazier, to further explain the fee schedule to the Commission members. 11. Mr. Frazier explained that the suggested 70% as applied to Table 3-A was based on the cost of con- struction within Apache Junction as compared to the National Average. The cost in Apache Junction is 70% of the National Average, thence the 70% application of the fee schedule. He offered additional to the Commission in that surrounding areas, such as Tempe, were already applying the 70%. He concluded by explaining that the present fee schedule in Apache Junction was 20% of the National Average. 12. Mr. Baljo read the proposed resolution to those present and called for speakers: for the resolution and against the re- solution. 13. Mr. Kell Is the 1979 Uniform Building Code based on ''o` property value? 14. Mr. Gero No, it is based on the cost of construction nation-wide. 15. Mr. Morvak asked if the proposed schedule fee would equate the cost of constructing a house with that of constructing a fence. Page 3 - Planning and Zoning Commission .�. 16. Mr. Morvak asked how building fees were allocated throughout adjoining areas, particularly Mesa, and how they were to be allocated in Apache Junction. 17. Mr. Gero stated that he did not have that infor- mation available but would find out for the benefit of the Commission and those present. He further explained that the fee schedule as outlined in the UBC was based on the cost per square foot of construction nationwide. He added that the cost of construction per square foot in Apache Junction was 70% of that national average. 18. Mr. Baljo emphasized that the UBC was not a regula- tory publication and was used only as a guideline. He added that the City Council reviews the Commission's recoumnendations, but still has the option of adopting another r•. plan or course of action. 19. Sharp/Hudson M/S "Be It Resolved by the Planning and -Zoning Couunission of the City of Apache Junction, Arizona, that it recommends to the City Council the approval of Ordinance No. 41 (PZ-6-80) . Further, it is recom- mended that the Building Official be in- structed to use Table No. 3-A "Building Permit Fees" as found in the currently adopted Uniform Building Code (1979 edition) , but that the schedule of fees be adjusted not to exceed seventy percent (70%) of the scheduled amount, and that the immediate implementation not exceed fifty percent(50%) , and the distribution be subject to review". 20. Mr. Baljo called for a discussion of the amendment to the proposed ordinance. 21. Mr. Hudson How are the fees charged by other cities Oakdistributed among the various departments? 22. Mr. Morvak Mesa charges a basic fee and an additional fee for schools and recreation. 23. Taylor/Strickler M/S "Be It Resolved by the Planning and Zoning Commission of the City of Apache Junction, Arizona, that the Planning and Zoning Commission recommends that the Council consider a reduction of the proposed building fees, Ordinance No. 41". Page 4 - Planning and Zoning Commission Specifically, that the 1976 UBC building fee schedule be adopted, and that a major reduction be made in the Plan Review per- centage of the formula used to compute the total fee. 24. Mrs. Taylor explained that she views the proposed fee schedule as a 400% increase over the present fees with regard to single-family dwellings and other livable building structures. She expressed the feeling that, based on the present state of the economy and the high interest rate imposed on lending funds, that a lower fee schedule be adopted to encourage construction in Apache Junction. 25. Mr. Gero explained to the Commission that the amend- ment as proposed by Mrs. Taylor would cut the City income in-half, forcing the tax payers to pay 50% of the building office functions. 26. Mr. Baljo reemphasized to the Commission that the fees and codes suggested by the members could be changed by the City Council. 27. Mr. Gero suggested that the members consider the 70% application of the building fees as previously discussed. These fees were based on the 1979 information compiled in the UBC. 28. Mr. Frazier explained to the Commission that the UBC was published in three-year increments. 29. Mr. Baljo suggested to Mr. Gero that a detailed ex- planation of the fee schedule be presented to the Commission so that they could make a decision with complete understanding. 30. Mr. Gero suggested that a brief break in the pro- ceedings would allow him time to prepare a Aukvisual explanation of the UBC and proposed fee schedule. 31. Mr. Baljo called for a 10 minute recess. 32. Mr. Baljo called the meeting to order at 8:30 P.M. and asked Mr. Gero to proceed with his clarification of the proposed building fee schedule. 33. Mr. Gero illustrated to those present how the UBC Page 5 - Planning and Zoning Commission cost of per square foot construction nationwide was compared to that of Apache Junction. He explained, via illustration, how the proposed fee schedule would only be 70% of the national average based on the cost of construction in the area. 34. Mr. Kell inquired as to the cost per square foot construction in the area. 35. Mr. Morvak speaking as a Valley builder, explained that the cost per square foot was $21.00. 36. Mr. Baljo asked if there were any more questions or comments on the proposed fee schedule before the Commission proceeded to take a vote. 37. Mr. Baljo called for a vote on the proposed ordinance and requested that Susan Sharp re-read the ordinance so that it could be entered into the record. 38. Mr. Baljo called for a vote on the amendment pro- posed by Taylor/Strickler: the motion was defeated by roll-call vote: 3-6 39.
