A Regular Meeting of the City Council of the City of Apache Junction
was held on June 18, 1980, at the Apache Junction City Hall , pursuant to
the notice as required by law.
CALL TO ORDER
Mayor Virginia Seeman called the meeting to order at 7.00 p.m. at the
Apache Junction City Hall.
INVOCATION
Councilman Eidson gave the invocation.

The Chamber of Commerce
was presented with Certificates of Appreciation for hosting the City's 16th
Annual Lost Dutchman Days, for participation in the Town Hall Meeting on
Discipline and Career Education Day, and for participation in the 1979 Arizona
State Fair Booth as a civic advertising arm of the City of Apache Junction

Mayor Seeman pointed out
that the first readings on Ordinance No 50 and 51 are not public hearings
and that it is the second reading of Ordinances that are public hearings.
After a first reading, the public may read an Ordinance and/or obtain a copy
at City Hall

Mayor and City Council to repeal or modify certain sections of Ordinance

CITY MANAGER'S REPORT
City Manager Lee reported
the interuption in telephone service at City Hall had been due to the fact
that a subcontractor had severed the line and apologized for any inconvenience
City Manager Lee further
reported that the City complex paving contract is on schedule and should be
completed July 1
The audit team is in the
process of closing out the fiscal year books and will submit a formal audit
to the Council in October

The Council directed staff

as the Governor and perhaps at the Federal level also.

INFORMATION AND REPORTS
Councilman Burgess asked
the City Manager about the status on the AORCC Grant for the ball parks and
tennis courts.
.�. City Manager Lee reported
that Mr. Short's office has stated that the Architects will be finished with
thier part of the work by the end of the month and then the City will put
a bid package in motion
Mayor Seeman stated
that she will , personally, not support any legislation that will initiate a
property tax for the people of Apache Junction.
REQUESTS OF COUNCIL
Councilman Shanks requested
that an answer be given to the lady with the trailer that has been "red tagged"
by the Building Department.
City Manager Lee reported
that staff is obligated by Ordinance to administer those Ordinances, however,
should the Council wish to suspend a particular action or issue, staff is prepared
to follow that direction.
Mayor Seeman requested a
report from staff to Council on the issue involving the particular incident in
question Any further action in regard to this matter will be delayed on an
administrative level

MEMORANDUM TO: THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
THRU: RAY LEE, CITY MANAGER
FROM: JOE GERO, DIRECTOR OF PLANNING s.
SUBJECT: PROPOSED ORDINANCE NO. 46 (PZ-8-80)
The Planning and Zoning Commission has held a public hearing on
Proposed Ordinance No. 46 (PZ-8-80) on May 27, 1980. Following
the public hearing, the Commission unanimously voted to recommend
to the City Council the passage of the proposed Ordinance.
/, This proposed Ordinance will be on the City Council agenda for
first reading on June 19, 1980, and an advertised public hearing
has been scheduled for your July 2, 1980 meeting.
The proposal is necessary to correct several items in the Zoning
Ordinance which are not clearly written. Item #3 would also add
Mobile Home and Travel Trailer subdivisions to the types of
developments in which the said fencing requirements would apply.
I recommend the proposal.

JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION ZONING ORDINANCE
BY AMENDING SECTIONS 803, 805, AND 2001 (e) (11), PROVIDING FOR
THE REPEAL OF CONFLICTING ORDINANCES; AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, PINAL COUNTY, ARIZONA, AS FOLLOWS:
SECTION I. IN GENERAL
1. Amend Section 803 of Article 8 - General Rural Zone (GR)
to read as follows:
"Section 803 MINIMUM LOT AREA: One and one-fourth
acres."
2. Amend Section 805 of Article 8 - General Rural Zone (GR)
to read as follows:
"Section 805 MINIMUM LOT AREA PER DWELLING UNIT:
One and one-fourth acres."
3. Amend Section 2001 (e) (11) in Article 20 - Trailer
Homesite Zone (TH) to read as follows:
"11. A Mobile Home or Travel Trailer Park and
Mobile Home or Travel Trailer Subdivision
of ten (10) or more acres shall be screened
around its periphery except for gates or
access ways by an opaque solid fence or
wall of not less than five feet (5') nor
more than six feet (6') of height,
measured on the fence from outside the
park." _
SECTION II. PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES
All ordinances and parts of ordinances in conflict with the pro-
visions of this ordinance or any part of the code adopted herein
by reference, are herebu repealed.
SECTION III. PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, clause, phrase or portion of
this ordinance or any part of the code adopted herein by reference,
is for any reason held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision shall
not affect the validity of the remaining portions thereof.

That Article 8-5 of the Apache Junction City Code be amended by adding
Section 8-5-4, Schedule, to read as follows:
SECTION I
Section 8-5-4 Schedule
The license tax set out in the following schedule is hereby established for
trades, businesses, games or amusements , callings, professions, or occupations
listed therein and shall be paid by all persons who shall practice, transact,
carry on or engage in such trades, businesses, games or amusements, callings,
professions or occupations. The license tax set out herein shall be based on
a calender year, and shall be due and payable on or before January 31 of each
year or, in the case of a new trade, business, game or amusement, calling,
profession or occupation, said license tax shall be due and payable within

SECTION II

repealed.
SECTION III
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this Ordinance shall be severable,
and if any provision of this Ordinance is held unconstitutional for any reason
by a Court of competent jurisdiction, such unconstitutionality shall not affect
any of the remaining provisions of the Ordinance.

SECTION I
That Chapter 8 of the Apache Junction City Code be
amended to read as follows :
ARTICLE 8-6 Swap Meet Operations
Section 8-6-1 Definitions
In this Article, unless the context otherwise requires,
the following definitions shall apply:
1. Advertisement means the attempt by publication ,
dissemination, solicitation or circulation, oral or written, to
induce directly or indirectly any person to enter into any
obligation or acquire any title or interest in any merchandise or
engage in any sale at a swap meet.
2. Business Occupational License Tax means those sums
payable to the City by the Swap Meet Proprietor, pursuant to
Article 8-5 of the City Code.
3. Clerk means the City Clerk or Deputy City C] erk of
the City of Apache Junction.
4. Department of Public Safety means the department
within the City responsible for the protection of life and
property and for the enforcement of the Laws of the State of
Arizona and the City of Apache Junction.
5. Merchandise means any new or used object, wares ,
goods, commodities, personalty and intangibles, real estate,
amusements, food concessions or services.
6. Person means any natural person or his legal
representative, partnership, domestic or foreign corporation any
company trust, business entity or association, any agent,
employee, salesperson, partner, officer, director, member,
stockholder, associate or trustee.

7 Premises means any building, structure , lot or
other area at which a swap meet sale is conducted.
+� 8 . Proprietor ' s License means a current and valid
license issued by the City of Apache Junction to the Swap Meet
Proprietor authorizing the use of the premises owned or
controlled by the Proprietor, as specified on the Proprietor ' s
License, for the purpose of conducting a swap meet .
9 Sale means any sale, offer for sale or attempt to
sell any merchandise, including any exchange , offer for exchange
or attempt to exchange or barter any merchandise at a swap meet .
10 . Swap Meet means a place of commercial activity,
popularly known as a swap meet , flea market , park-and-swap , open
to the general public for the purchase of merchandise on the
premises , which place is available to the general public who wish
to sell or barter merchandise on the premises , whether such
sellers or vendors are in the business of vending or are making
casual sales or some combination thereof and which place is
noLmally composed of stalls , stands or spaces allotted to vendors
at least one of whom does not occupy the same allotted space or
spaces on an uninterrupted continuous daily basis
11 . Swap Meet Proprietor means any person who rents ,
sells , donates , or otherwise makes available to swap meet vendors
any space within premises owned or controlled by the proprietor
for the purpose of a swap meet sale.
12 . Swap Meet Vendor means any person upon the
premises for the purpose of causing the advertisement of or
making a sale at a swap meet .
13 . Transaction Privilege Tax means those sums payable
to the City by the Swap Meet Vendor pursuant to Article 8-3
of the City Code .
14. Vendor Registration Report means a monthly report
from the proprietor to the City of Apache Junction.
15 . Vendor Registration Log means a well-bound volume
kept by the proprietor to identify vendors .
16 . Vendor Sales Receipt means a receipt , in a foiui
approved by the City, to be issued by each vendor to each person
to whom a sale is made by the vendor for each article of
+•►. merchandise sold for twenty-five dollars ($25 . 00) or more .
17 . Park and Swap Operations means any activities
referred to in Section 8-6-1 (10) .
Section 8-6-2 Unlawful Practices of Swap Meet Proprietor
It shall be unlawful for a Swap Meet Proprietor to fail
to comply with the requirements of this Article , and in particular

1. To permit a Swap Meet upon premises owned or
controlled by the Swap Meet Proprietor without being in
possession of a Proprietor's License.

2. To permit any person to engage in the sale of
merchandise upon parking or other areas owned or controlled by
the Swap Meet Proprietor whenever such areas or sites are not
specified on the Proprietor's License.
3. To fail to control the entrance to and exit of all
Swap Meet Vendors and merchandise from the premises by the
physical presence and personal supervision on the premises of the
Swap Meet Proprietor or his designated agents during the hours of
operation of the Swap Meet.
4. To fail to pay the City of Apache Junction the
Business License Tax when due, pursuant to Article 8-5 of the
City Code.
5. To fail to file with the City of Apache Junction a
monthly Vendor Registration Report when due.
6 . To fail to keep an accurate Vendor Registration
Log.
7. To fail to collect the copy of each vendor sales
receipt from each Swap Meet Vendor at the close of each business
day.
8. To fail to preserve all documents required by this
Article, including Vendor Registration Logs and Vendor Sales
Receipts, for three ( 3) years, and to make available said
documents to inspection by the City Clerk, his Deputy , or the
Department of Public Safety.
9. To fail to make all daily document entries
required by this Article, including Vendor Registration Logs and
Vendor Sales Receipts, or to fail to make such entries open to
inspection by the Clerk or Department of Public Safety,
10. To fail to file with the Clerk by 12: 00 noon on
the next regular City business day the Vendor Registration Report
and Vendor Sales Receipts from the previous business day
11. To fail to maintain the swap meet premises in a
clean and unlettered condition free and clear of all abandoned
iON merchandise, rubbish and debris.
12. To fail to post on the premises, in a conspicuous
place so as to be clearly seen by the public and the Clerk, or
the Department of Public Safety, a Proprietor's License.

Section 8-6-3 Unlawful Practices of Swap Meet Vendor
It shall be unlawful for a Swap Meet Vendor to fail to
comply with the requirements of this Article, and in particular:
1. To fail to give to each person, to whom a sale is
made by the Swap Meet Vendor, a Vendor Sales Receipt for each
article of merchandise sold for twenty-five dollars ( $25. 00) or
more.
2. To fail to fully and accurately record on Vendor
Sales Receipts the complete descriptive information set forth in
this Article.
3. To fail to give one copy of each Vendor Sales
Receipt to the Swap Meet Proprietor upon close of each business
day.
4. To fail to post, at the Swap Meet Vendor's
assigned sales location on the premises in a conspicuous place so
as to be clearly seen by the public, the City Clerk , and the
Department of Public Safety any current valid license issued by
the City to the Swap Meet Vendor pursuant to Article 8-3
Transaction Privilege License Tax of the City Code.
5. To engage in sales at locations other than the
vendors sales location assigned that day by the proprietor.
Section 8-6-4 Regulations
For the purpose of this Article :
1. Nothing in this Article shall exempt a sale made
at a Swap Meet from taxes payable pursuant to Article 8-3
Transaction Privilege License Tax of the City Code.
2. The Vendor Registration report shall be in writing
in a form approved by the City Clerk containing the information
recorded in the Vendors Registration Log.
3. The Vendor Registration Log shall contain for each
Swap Meet Vendor a separate and distinct daily entry of the name ,
address, vehicle license numbers , Transaction Privilege Tax
License Numbers, Drivers license number and other descriptive
information in a form approved by the City of Apache Junction, of
any Swap Meet Vendor entering the premises of the Swap Meet
Proprietor for the purpose of a Swap Meet.

4. The Vendor Sales Receipt shall include : a
description of the sale merchandise including serial numbers if
any , the dollar amount of the sale of merchandise in a cash

transaction, the barter value of the merchandise of an exchange
transaction, and the vendor 's name, address, vehicle license
number, and drivers license number. The vendor sales receipt
original copy must be given to the purchaser, with a copy of the
receipt surrendered to the Swap Meet Proprietor by the Swap Meet
Vendor upon the close of each business day.
Section 8-6-5 Administration
1. The City Clerk, or Deputy , shall issue a
Proprietor's License only when the requirements of Article 8-5,
Business Occupational License Tax have been adhered to.
2. All the requirements of Article 8-3 , Transaction
Privilege License Tax and Article 8-5, Business Occupational
License Tax, shall be adhered to during Swap Meet operations.
3. The Clerk shall suspend a Proprietor 's License
upon the proprietor 's conviction of any violation of this
Article, or upon the Clerk ' s determination that the proprietor 's
Swap Meet activities are causing :

a. Traffic congestion on the abutting public streets ;
b. The accumulation of debris or litter upon the
premises; or
c. Loud noises, nuisances, or disturbances whereby
the quiet and good order of the premises or of the
neighborhood is disturbed .
4 . The Clerk may refuse to issue a Proprietor's
License for good cause stated.
5. The Clerk shall revoke a Proprietor 's License upon
the Swap Meet Proprietor 's conviction of any violation of this
Article within three (3) years of any prior conviction of a
proprietor under this Article.
6 . Before suspending or revoking a Proprietor 's
License, the Clerk shall give the Swap Meet Proprietor prior
notice, by certified mail addressed to the Swap Meet Proprietor
at the address of the licensed premises or by personal service ,
that a hearing to suspend or revoke the license will be held by
the City Clerk at a specified place, and at a time not sooner
than five ( 5 ) days from the date of such notice. The notice
shall clearly and concisely state the grounds and reasons relied
upon for revocation or suspension. The Clerk shall hold the
hearing at the time and place specified, unless adjourned by

consent of all parties , and the licenses shall be allowed to
appear in person and by counsel , offer proof , and evidence. A
record shall be kept of all the proceedings at such hearing , and
a transcript of all evidence offered shall be made and filed. No
Proprietor ' s License shall be suspended or revoked except when
grounds therefore as provided in this section are satisfactorily
established by the proofs offered as shown by the record of
proceedings and transcript of the hearing. The decision of the
Clerk suspending or revoking any license shall be final .
7 . The Clerk may suspend or revoke a Proprietor ' s
License upon evidence that a Swap Meet Vendor is allowed to participate
in a swap meet following three (3) or more convictions of violations
of this Article within any three (3) year period, unless the
Proprietor forbids the offending Vendor from continued participation
at the swap meet . Prior to suspending or revoking a Proprietor ' s
License pursuant to this Subsection, the Clerk shall notify the
Proprietor that a Swap Meet Vendor operating upon the premises
owned or controlled by the Proprietor for the purpose of a swap
meet sale has three (3) or more convictions of violations of this
Article within any three (3) year period.
SECTION II Penalties
Any person found guilty of violating any provisions of
�• this Article shall be guilty of a misdemeanor and upon conviction
thereof shall be punished by a fine of not to exceed three
hundred dollars ($300 00) or by imprisonment for a period not to
exceed three months , or both such fine and imprisonment . Each
day that a violation continues shall be a separate offense
punishable as herein above described.
SECTION III Repealer
All ordinances and parts of ordinances in conflict with
the provisions of this ordinance or any part of the code adopted
herein by reference , are hereby repealed
SECTION IV Severability
It is hereby declared to be the intention of the City
Council that the sections , paragraphs , sentences , clauses , and
phrases of this Ordinance shall be severable and if any provision
of this Ordinance is held unconstitutional for any reason by a
court of competent jurisdiction, such unconstitutionality shall
not affect any of the remaining provisions of the Ordinance

As a matter of clarification to Ordinance No. 52, the Arizona
Department of Revenue has asked the City to amend its sales tax
Ordinance to reflect recent changes made by the State Legislature.
Specifically, this amendment changes reporting dates from the
lot latter part of the month to the 1st, reduces the amount of the
liability for taxpayers who pay annualy or quarterly, and finally,
k,, increases the interest rate on delinquent taxes from 2 percent
to one percent. According to the Department of Revenue, failure
to conform our Ordinance with State passed legislation would
result in delay in computing the City's sales tax.

AN ORDINANCE OF THE CITY OF APACHL JUNCTION, ARILONA AMENDING SECTION
8-3-5, ADMINISiPAIIOU AND PROCEDURES OF CHAPTER 8, BUSINESS, OF THE CITY

BE IT ORDAINED BY THE MAYOR AND:CITY COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA AS FOLLOWS.
SECTION I
That Section 8-3-5 (H), When Tax Payable, read as follows.
Except as otherwise specified in this article, the taxes levied under this
article shall be due on or before the 1st day of the second month next
succeeding the month in which the tax accrues, and shall be delinquent
five (5) days thereafter. The taxpayer shall , on or before the 1st day of
the second month next succeeding the month in which the tax accrues, make
out a return showing the gross amount, any authorized deductions, taxable
amount and amount of the tax due for the preceding month The taxpayer shall
be required to use the report form authorized by the tax collector, and shall
mail or deliver the same, together with remittance for the amount of tax
due, payable to the City of Apache Junction to the tax collector or any City
representative authorized to receive such payment. The tax return shall be
signed by the taxpayer or his authorized agent, and such signature shall be
evidenced that the person signing the return verifies the accuracy of the
information supplied in the return
1. For any taxpayers whose estimated annual liability for
taxes imposed by this article is $50 00 per annum or less,
may authorize such taxpayer to pay such taxes on an annual
basis.
2. For any taxpayer whose estimated annual liability for
taxes imposed by this article is between $50 01 and $125 00
per annum, authorize such taxpayer to pay such taxes on a
quarterly basis
SECTION II
That Section 8-3-5 (L), Penalty for Delinquency, read as follows.
Any taxpayer who shall have failed to pay such tax within five (5) days from
the date upon which such payment shall have become due shall be subject to
and shall pay a penalty of ten percent (10%) of the amount of such tax,
together with interest on such tax at the rate of one percent (1%) per
month or fraction thereof until paid
SECTION III
All Ordinances and parts of Ordinances in conflict with the provisions of
this Ordinance or any part of the Code adopted herein by reference are
hereby repealed.
SECTION IV
If any section, subsection, sentence clause, phrase or poriton of this
Ordinance or any part of the Code adopted herein by reference, is for any
reason held to be invalid or unconstitutional by the decision of any Court
of competent jurisdiction, such decision shall not affect the validity of
the remaining Iortions thereof.

On July 7, 1980, at 7:00 P.M. at the City Hall Complex, the Board of
Adjustment will hear the request for a variance to the provisions of
Section 805 of the City Zoning Ordinance by Mrs. Francis S. Ramirez,

This is to acknowledge receipt of the copy of your letter to
Governor Babbitt dated June 13 , together with the resolution
from the Mayor and City Council of Apache Junction and supported
by the signed petitions for timely extension of the Superstition
Freeway
We're pleased to have this strong support on behalf of the Super-
stition Freeway, which will be a major benefactor of the State
Transportation Board' s $50 million bond issuance, bids for which
were approved just last week
/'4 This is not the only answer , of course, but the bonds will help
accelerate progress Funds are now earmarked for nearly $28
million in additional Superstition construction through the next
five years Further , the Board has approved start of design on
the Val Vista-Power Road section in the hope that increased funds
will become available and this stretch can be moved up .
We are extremely hopeful the State Legislature will take up the
matter of additional revenues for major transportation investments
later this year in special session, which will be vital to continued
progress not only with the Superstition, but other highways , roads
and streets throughout the State . We trust your support will help
accomplish this increase in necessary resources to get the job done.
Thank you for your resolution and the petitions It all helps
"build the case" for sorely-needed transportation improvements

1. Mr. Jessamine called the meeting to order at 7.00 P.M.
and requested a roll call of members.
2. Mr. Newcomer called roll and determined that all
members were present as indicated above.
3. Mr. Jessamine declared a quorum present and asked for
a motion to approve the "Minutes of
May 19, 1980."
4. Mr. Vaughn noted that during the May 19, 1980 meet-
ing, it was Mr. Nunn whom abstained dur-
ing the vote on the approval of the "Min-
utes of May 5, 1980", since he did not
attend the meeting of May 5, 1980
5. Mr. Jessamine directed Mr. Newcomer to amend the minutes
to read. "the motion passed 4-0-1 with
William Nunn abstaining since he did not
attend the meeting in question".
6. Nesser/Vaughn M/S "BE IT RESOLVED that the "Minutes"
oT the May 19, 1980 meeting be approved as
amended"
7. Mr. Jessamine requested a roll-call vote The motion
passed 4-0-1 with Mr Nunn abstaining since
he did not participate in the in the entire
May 19, 1980 meeting.
8 Mr. Jessamine asked for a motion to approve the "Minutes"
of the April 21, 1980 meeting as written.

10. Mr. Jessamine requested a roll.-call vote on the motion.
The motion passed 4-0-1 with Mr. Furness
abstaining since he was not present at
the meeting in question.
11. Mr. Gero discussed Board meeting dates. He stated
that in order to hold a second meeting dur-
ing a month, the Board must set a time and
date and post a public notice. He stated
that the public hearing on Big Mountain
Trailer Park should be continued after
further discussion with the applicant re-
garding his intentions.
12. Nesser/Furness M/S "BE IT RESOLVED the Board of Adjust-
ment of the City of Apache Junction, Arizona,
will hold a meeting on June 23, 1980, at
7.00 P.M. at 1001 North Idaho Road, Apache
Juntion, Arizona "
13. Mr. Jessamine requested a roll-call vote on the motion.
The motion passed 5-0
14. Mr. Nesser opened discussion on rules and procedures
for the Board He stated that he would be
working on rules for the Board with Mr.
Newcomer for presentation at the June 23rd
meeting.
15. Mr. Jessamine directed Mr. Newcomer to make an inquiry
of the City Attorney concerning the appro-
priateness of holding a recess immediately
before considering a motion so that the
Board members could discuss the action at
hand and clarify any questions that they
might have.
16. Jessamine/Nesser M/S to adjourn the meeting at 8:00 P.M.
The motion passed unanimously.
A short work session followed the formal
meeting During the work session, further
discussion was held on items to be included
in the Board's rules and procedures.
