ACCEPTANCE OF THE MINUTES OF THE REGULAR MEETING OF OCTOBER 15, 1980 Mayor Seeman stated she would like to have filed with the minutes a copy of the report from the Chamber of Commerce and, additionally, a correction to the minutes needs to be made to reflect CPVC and PVC in a motion made by the mayor rather than ABC and PVC Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT THE MINUTES OF THE REGULAR MEETING OF OCTOBER 15, 1980 BE, AND HEREBY ARE, AMENDED, AND TO INCLUDE THE CHAMBER OF COMMERCE BUDGET REPORT Councilman Hill seconded the motion. AWARDS, PRESENTATIONS, AND COMMUNICATIONS Mayor Seeman stated she had two awards to present She presented a Certificate of Appreciation to Kathleen Anderson on the Community Attitude Survey She stated the certificate was for performing an arduous task for the benefit of the community in the preparation of the Community Attitude Survey. Mayor Seeman stated there were some pictures donated to the City Council Chamber that were taken in approximately the 1930's. The Mayor read a letter to Commissioner Felleni concerning Mr. Bill Fish's recognition of the pictures and their possible historical value to the City. oink Mayor Seeman read a letter from the Department of Economic Security in regard to the location of the D E S facility within the City limits of Apache Junction It indicated a request by the Department of Economic Security for $9,400 in the FY 1982 budget to lease space for an office in Apache Junction. The letter was signed by the Governor Mayor Seeman called upon Kathleen Anderson to present the Community Attitude Survey Kathleen Anderson, 1517 West Indian School Road, Phoenix, stated that as part of her Masters program she asked for,and received permission from,the City Council to conduct a Community Attitude Survey in order to assess the need for services in the leisure community of Apache Junction. She stated 202 of the residents of the community were contacted by approximately 36 students She added each survey took about an hour and that approximately five percent of the population was sampled. She stated that through the use of statistical techniques a random sample was arrived at. Ms. Anderson then presented the computer sheets with a tabulation of the results of the survey to Mayor Seeman. REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 5, 1980 PAGE TWO CALL TO THE PUBLIC Mayor Seeman called upon Bob Westburg and Ken Higgins. Bob Westburg, 910 S. Lawson, stated he wished to introduce Western Cable Television Services, Inc. He stated his desire is to appear before the Council and request a franchise for cable television in Apache Junction. Ken Higgins of Wickenburg stated from the beginning of the company, Western Cable Television, the desire of the principal people in the company was to appear before the Council and ask to begin negotiations, if desirable by the Council, to start the long process of issuing a license to a cable television company He addressed the types of programming available through Western Cable Television. Councilman Eidson stated he would not support a station that would show naked men and women in bed together at 6 00 p m on a Sunday evening. • Mr. Higgins stated that in any cable television system there are, unfortunately, going to be movies like those referred to by Councilman Eidson, but added there are alternatives. He stated Councilman Eidson is speaking of one channel, his company offers thirty. He stated the programming format has been designed so that a person can buy cable television and not have to receive what Councilman Eidson is referring to He stated there is an alternative called Home Theatre Network which shows nothing but family-type movies. He stated his company does not, and will not, offer hard-core pornography. He added Christian Broadcasting Network, the Cable News Network, and Channel 17 from Atlanta were examples of programming offered Mayor Seeman recognized Dan Andrews who wished to address Resolution No 80-10 in regard to the City's zone of influence Dan Andrews, 1975 North LaBarge Rd., Apache Junction,stated he is in the zone of influence. He asked why the public was not told that the City Planning and Zoning Commission would have to be consulted for their recommendation before any change in zoning or variances of the zone could be made He stated the citizens were told by Council that the reason for creating this zone of influence was so that Mesa and Gilbert could not annex the area and surround the City of Apache Junction. He asked that Council reconsider the Resolution creating the zone of influence, and asked that i► it be either eliminated completely or revised to apply only to the original application of keeping Mesa and Gilbert from annexing east. Mayor Seeman stated the Council fully understood Resolution 80-10 and, if her memory served her correctly, it was a unanimous decision by the Council. She asked the Planning Director to once again explain the intent of Resolution 80-10 Planning Director Joe Gero stated that Resolution 80-10 has no effect on the ability of the City to make recommendations with regard to proposed special use permits, board actions, or commission actions, or actions taken by the Board of Supervisors of Pinal County with regard to any land use matters He stated the point about zoning influence through Resolution 80-10 is really not a valid issue at all. He stated what Resolution 80-10 does do is tell the various communities that might desire to annex those portions of land in Pinal County that are in proximity to the City of Apache Junction that the City is simply declaring a zone of influence Mayor Seeman called upon Bob Condra who also wished to address the item Mr Bob Condra, 32nd St , Silly Mountain area,stated on several occasions the elections were brought before the people on a 36 square mile area for the city of Apache Junction. He stated on those same several occasions the people of the 36 square mile area voted it down REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 5, 198U PAGE THREE oak, Alakk He stated that subsequently it regressed to a twelve square mile area, and in essence his understanding is that it gives the greatest appearance that even though he (Mr. Condra) lives outside the City of Apache Junction, the City's governing area, he is falling under unnecessary, unwanted, and unneeded regulation controls by the City and it is also his understanding that in the past there have been several individuals in the so-called zone of influence that have had to come through the City Council in order to get business (building?) permits for such things as beauty parlors, automotive repair installations, and services of that sort He stated that if twelve square miles is all the City could get in the beginning,and not the 36, why not leave the 36 miles alone and just play with the 12 square miles City Attorney Mike Curtis stated he believed there was a misunderstanding about what the Resolution does In an attempt to clarify Resolution 80-10 City Attorney Mike Curtis asked the following questions of the City Planner who responed as indicated City Attorney: "Does the City gain any authority to zone, re-zone, or not zone the utilization of property by land owners outside the City?" City Planner The City does not. As a matter of fact, and I think the record will be very clear, if Mr. Condra or anybody else would like to check with Pinal County officials, there are written communications on each one of the cases, the beauty shop recently, quite a number of other rezonings in which people have been invited to come to us because we have had a written request from Pinal County to make a recommendation to them. The power or recommendation is not the power to create an action and the record will be very clear, Pinal County has more often than not, gone in a different direction than the recommendation of the City of Apache Junction or its Planning Commission " City Attorney: "Mr. Gero, is this whole process similar to the advisory role that the City plays with respect to liquor licenses?" City Planner "That's correct " City Attorney "Non-binding, with simply for information only?" City Planner: "Simply for information " City Attorney. "So there is no real ability to exert any direct control, do anything other than simply give recommendations to an outside body, namely the counties that have jurisdiction?" City Planner: "That's absolutely correct and the record will show that. As I said, that more often than not the County has chosen to go opposite the recommendation of the City which clearly shows that it is strictly a recommendation;that quite often you get two or more agencies having different recommendations to Pinal County or whomever, and maybe in conflict, and they have to resolve it " Councilman Shanks commented that it is common practice of Pinal County to ask the City for recommendations; they have done that since the day the City incorporated so it is nothing unusual She stated it is a common courtesy as stated by Mr Gero, and has nothing to do with Resolution 80-10. Mayor Seeman stated that if Mr. Andrews and Mr Condra feel they have a serious enough problem,and can get about 50 people together,the Council would be happy to handle a worksession and iron out some of the problems. Mr. Andrews stated that by State law they are required to come to the City He stated they are requesting that the Resolution be changed. He stated he was told by Planning and Zoning, and the Zoning in the County that the zone of influence by State law requires that they come to the City for their recommendation He stated he recognizes that it is only a recommendation, but they are required by law to come to the City. REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 5, 1980 PAGE FOUR City Attorney Mike Curtis suggested that if a legal opinion is apparently going to be required to determine the effect of the law, his office will get a legal opinion both in-house and from Pinal County in order to allow the lawyers to find out what the interpretation is He stated he will be happy to report back to the Council as to the implications, the zone of influence, and whether or not the City is in any way taking the property of, or influencing the property of, people outside the City limits. In response to Mayor Seeman's request, the City Attorney stated he would make every effort to produce the opinion within 30 days Councilman Shanks stated that while making the inquiry perhaps all borders should be touched; both counties, and have them give their opinions of how they interpret it She stated that when the information is available she would like the two gentlemen to be notified by mail. Mayor Seeman stated items four, five, and six have been unanimously postponed until after agenda item 11. PUBLIC HEARINGS LIQUOR LICENSE APPLICATION CANDACE COOK, LUCKY NUGGET • Mayor Seeman stated the item is a public hearing for a transfer of liquor license, the applicant is Candace Cook of the Lucky Nugget She asked that the applicant, if present, speak in reference to the request for transfer. Candace Cook, 1439 N 66th Place, Mesa, stated she purchased the Lucky Nugget in September and since that time she has cleaned up the interior and the building, and has made some changes hoping to attract a better clientele which she believes she has accomplished. She added she has had no problems in the Nugget since she has taken over and she ( felt this could be verified by the Apache Junction police Mayor Seeman asked if there were any members of the public wishing to address the issue Dan Andrews stated he has been in the Lucky Nugget prior to, and since, Ms Cook's takeover and it has been cleaned up considerably. There being no further Amok members of the public wishing to address the item, Mayor Seeman closed the hearing to the Public. Councilman Damiano suggested that the application be revised to indicate Superstition Elementary School as the nearest school Councilman Shanks asked if Ms. Cook is a citizen of the United States. Ms. Cook stated she is not a citizen of the United States Mayor Seeman reminded the City Council that the Council only recommends to the State of Arizona; the City does not issue liquor licenses Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE APPLICATION FOR TRANSFER OF SPIRITUOUS LIQUOR LICENSE TO SELL ALL SPIRITUOUS LIQUOR, BY APPLICANT CANDACE COOK, LUCKY NUGGET, BE, AND HEREBY IS, RECOMMENDED FOR APPROVAL TO THE DEPARTMENT OF LIQUOR LICENSE AND CONTROL. LIQUOR LICENSE APPLICATION CHARLES AND MILDRED GOLZIO, DESERT LIQUORS Mayor Seeman stated the item is a public hearing for transfer of liquor license, the applicants are Charles and Mildred Golzio of Desert Liquors. She asked the applicants if they i•. would like to speak on the item Charles Golzio, 5833 N 70th Place, Scottsdale, stated he purchased the liquor store on October 1st and has been operating it since that time. Mayor Seeman asked if there were any members of the public wishing to address the item There being no one in the public wishing to address the item, Mayor Seeman closed the hearing to the public Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE APPLICATION FOR TRANSFER OF SPIRITUOUS LIQUOR LICENSE, SERIES 9, OFF-SALE RETAILER'S LICENSE TO SELL ALL SPIRITUOUS LIQUOR, BY APPLICANTS CHARLES AND MILDRED GOLZIO, DESERT LIQUORS, BE, AND HEREBY IS, RECOMMENDED FOR APPROVAL TO THE DEPARTMENT OF LIQUOR LICENSE AND CONTROL Councilman Hill seconded the motion. VOTE Unanimous The motion carried SPECIAL LIQUOR LICENSE APACHE JUNCTION CHAMBER OF COMMERCE (LOST DUTCHMAN DAYS) ) Mayor Seeman stated this is a public hearing for a special event license with the applicant being the Apache Junction Chamber of Commerce. She called upon Bob Bogart to address the item. Mr. Bogart of the Apache Am.' Junction Chamber of Commerce Board of Directors stated the State Liquor Department has seen fit to establish this special new section within the liquor law to allow non-profit organizations a limited liquor license to be used in conjunction with special occasions He stated that the Chamber has applied for a limited liquor license to run for two days in conjunction with Lost Dutchman Days and the Apache Junction rodeo. He stated it is hoped that through the operation of the limited liquor license the Chamber will be able to derive finances to help support the Chamber Mayor Seeman asked if anyone in the public wished to address the issue. Mr. Andrews asked if a business license would be involved with the temporary liquor permit. Mayor Seeman stated that civic or non-profit organizations are not subject to the business license ordinance. The Chamber of Commerce is a non-profit organization. There being no further individuals wishing to address the item, Mayor Seeman closed the meeting to the Public Councilman Damiano asked if beer would be the only liquor sold. NEW BUSINESS APPOINTMENTS TO THE BOARD OF ADJUSTMENT Mayor Seeman stated that when going through the Talent Bank applications it was apparent that the City is short on Board of Adjustment applicants. She stated the Council wants people who would like to serve in these positions, it takes a lot of donated time. She stated she has one appointment to make and hopefully in the special meeting would be able to make the second appointment She stated she realized it placed a hardship on the board to make only one appointement but that is all there is Mayor Seeman MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, /milk ARIZONA, THAT HARVEY MORRISON BE APPOINTED TO THE BOARD OF ADJUSTMENT, SAID TERM TO EXPIRE JUNE 30, 1982. Councilman Damiano seconded the motion VOTE Unanimous The motion carried Councilman Eidson pointed out that he had read in the paper that someone had stated the $700 no-cost building permit would not affect anyone in Apache Junction. He stated he had spoken with Mr. Frazier who checked into the allegation and found that since the City is now using a fifty percent modifier which, in effect, means that any application made for a building permit for a project of $1400 or less there is no cost on the building permit. He stated that about twenty permits a month right now are being affected by this so some people have been helped He stated another point brought up by Mr Frazier is that in one month there were about six house fires within the City limits which sometimes presents a problem because the insurance does not fully pay for the damage done and also the individual involved might have to get his plans drawn up and approved before he can get a building permit to repair whatever might have been damaged Councilman Eidson MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION THAT DIRECTION BE GIVEN TO THE CITY STAFF TO PREPARE AN AMENDMENT TO THE UNIFORM BUILDING CODE TO REFLECT THE EXEMPTION OF BUILDING PERMIT FEES TO THOSE PROPERTY OWNERS WHO EXPERIENCE STRUCTURAL DAMAGE BY FIRE, STORM, OR OTHER ACTS OF GOD Councilman Damiano seconded the motion Councilman Eidson stated he would like to have this item ready by next meeting night Councilman Damiano asked if the motion should be made residential or commercial City Attorney Mike Curtis stated the precise wording was that the people who were more or less dispossessed by fire or destruction compared with the wording, he stated the wording would require staff to conclude that a major shopping center that was destroyed by fire or a large commercial or industrial development would also be exempt from those fees He stated the Council could simply insert the word residential in the motion if that is the intention. Councilman Eidson stated he would like the word "residential" inserted into the motion. Councilman Damiano seconded Councilman Eidson's amendment to the motion REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 5, 1980 PAGE EIGHT VOTE: Unanimous The motion carried Councilman Hill pointed out a dangerous intersection in Apache Junction he feels needs to be dealt with. He stated the problem area is Fourth Avenue and Tomahawk. He would like the possibility of putting in a four-way stop investigated City Manager Lee stated that the City Council might want to consider the Public Hearings for Items four, five, and six this evening in case it would inconvenience anyone who showed up for the public hearing, and then recess. Mayor Seeman stated she skipped the City Manager's report and asked the City Manager if he would like to provide that information City Manager Ray Lee called upon the Director of Public Works to give a status report on the street sign project Director of Public Works, Richard Broman, stated the City has begun the installation of the street signs in conjunction with the $62,000 grant from the Governor's office. He stated the City is presently putting up the steel posts and as soon as the recommendation comes in from the street-naming committee and the Planning and Zoning Commission, and the Council takes action on the street names the street name signs will be ordered and attached to the posts He stated work is starting in the northeast quadrant and then working the southeast, and northwest, and the southwest. He stated it is very possible that a majority of the sign posts will be up prior to the fabrication and then getting the signs up can be expedited. Mr Broman further advised the Council that construction has begun in conjunction with the $192,000 AORCC grant for the baseball field and the tennis courts; the area has been cleared, the contractors have moved in, and the project has begun being layed out City Manager Lee called upon the Building Official to address the volume of building permits which is a strong indicator of growth within the corporate limits Leo Frazier, Building Official, stated that the permit activity is up 60 percent in a single month. He stated 100 permits were issued and the value of construction for the month of October was $1,569,000 in round figures. In addition,the State Division of Mobile and Manufactured Housing Standards is holding public hearings in anticipation of the adoption of the 1979 Uniform Building Codes, and the 1981 National Electric Code Mr. Frazier stated that additionally the City of Mesa has adopted the 1979 UBC that will go into effect November 19th He stated this provides for consistency for the contractors because everyone will be using the same code. City Manager Ray Lee called upon the Director of Public Safety to give an activity report for the month of October. Director of Public Safety Bill McDaniel reviewed the activity report for the police department with the City Council. In addition, Chief McDaniel stated 122 animals were picked up during the month, seven new kennels have been almost completed and will be in full operation next week. PUBLIC HEARINGS PROPOSED ORDINANCE NO 70, PZ-16-80, ZONING ORDINANCE SECTION 2804 - FEES (SECOND READING WITH EMERGENCY CLAUSE) Mayor Seeman opened the public hearing for PZ-16-80, Ordinance 70, applicant Planning and Zoning Commission, and asked the Planning Director to provide background on the item. REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 5, 1980 PAGE NINE p Director of Planning Joe Gero stated the Planning and Zoning Commission was sending to the Council, with a vote of 6 to 1, the recommendation to approve proposed Ordinance 70 which amends Section 2804, fees, in the Zoning Ordinance He stated most of the fees are already in existence in the ordinance and the several changes provide for a $65 fee and a standard rezoning fee of $100. He stated what it will do, additionally, is clarify that public officials are exempt from the fees when operating in their public capacity It also provides protection for the public in that currently the ordinance says that anyone who has filed cannot regain that fee in any way, shape, or form even if, just hours after they filed they have had a change in circumstances and wish to withdraw that application He stated it has been recommended that there be an administrative charge of ten percent taken out of it because there will have been checks that have come in, receipts that were issued, etc He stated the feeling is that the public should have the money returned to them if there have been no basic expenses. Mayor Seeman asked if there was anyone wishing to speak in favor of, or in opposition to, the petition. As there was no one wishing to address the hearing, Mayor Seeman called upon the Planning Director for his recommendation Joe Gero, Planning Director, recommended that the Council pass the proposed ordinance. Mayor Seeman closed the meeting to the public. REQUESTS OF COUNCIL Mayor Seeman recognized Director of Public Works Richard Broman. Richard Broman, Director of Public Works, stated that he had been asked by the residents of Apache Villa III to assist them in preparing a Street Light Improvement District. Mr. Broman outlined the procedure for improvement districts, outlined the options available, and stated a list of over two-thirds of the residents' names in the area who want the street lights have been obtained. He stated Mr Frank Tate was designated as the spokesman for the residents. Mayor Seeman recognized Mr. Tate. Mr Frank Tate, 1094 S Main Drive, Apache Villa III, stated that the people in the area have asked that street lights be put in due to the fact that there have been quite a few acts of vandalism in the area and people don't feel safe. He stated when the homes were purchased they were sold as improved lots with street lighting and consequently the residents of the area have already paid the bill for the lighting He stated as a result of the transition of going from the County to the City there has been a delay in getting them and the residents are now requesting the City initiate appropriate action to obtain the lighting. Councilman Damiano asked who would pay for it. Mr. Broman stated that only those people in Apache Villa III would be paying for the improvement district. Mayor Seeman asked the Director of Public Works for his recommendation. Director of Public Work, Richard Broman, stated his recommendation would be to approve Option No 1 which requires no petition. AGENDA ITEM REQUEST - STREET NAMES BACKGROUND: The City Council , during a recent meeting, directed the Planning and Zoning Commission to prepare and bring forth a recommendation for street names within the City of Apache Junction. The Planning and Zoning Commission appointed a Street Name Committee. They have concluded their recommendation. The Street Name Committee will present its report to the Planning and Zoning Commission on Tuesday, November 18, 1980. As the Council is aware, the City has received a street name sign grant from the Governor's Office of Highway Safety. In order to insure the retention of the funds from this grant, the City is desirous of proceeding with placing the street name signs at the specified locations as soon as possible. Prior to ordering these sign faces, the City Council must first, by Ordinance, adopt the street names for the various streets within the City. The adoption, by Ordinance, of a street name map would accomplish this task. Therefore, without compromising the right of the general public to have their input, it is requested that the Council be as expeditious as possible in determining the outcome of this report. The report of the Planning Commis- sion is being requested to be an agenda item on your Wednesday night meeting at which time recommendations on street names of the City will be made. RECOMMENDATION: At your November 19, 1980, City Council meeting, the report of the Planning Commission will be made to you outlining the proposals for establishing street names within the City. The Council would hopefully direct the staff to make available to the public, in a reasonable manner, the information as presented by the Planning Commission. A specific request was made to the State by Mr. and Mrs. Grandlich. The State has requested a recommendation from the City (see attached letters) . The traffic investigation report prepared by the State in July in regard to the median crossing at milepost 195.62, did include a portion of the study area as requested by Mr. and Mrs. Grandlich. This study observed traffic is exceeding the 45 mph speed controls by three to four miles per hour and that existing stopping sight distances are adequate ".. for the posted speed limit and current operating speeds. This department has no documentation of previous studies regarding speed and traffic controls, other than the July study aforementioned. This department deems a study would be appropriate and submits the following resolution for your consideration. From Idaho Rd. to Meridian Rd. (west city limits) from 45 to 35 mph. As immediate changing of the design of the major highway intersection is not in the near future and the cost and application of street lights (stoplights) is not an immediate answer, it is our desire as major property owners and business people in Apache Junction, to see this done. We also have total support of the Apache Junction Police Department and the Merchant ' s Association. WITNESSETH WHEREAS, ARS Section 16-172 authorizes any political subdivision conducting an election pursuant to the laws of the State to use the County Registration Rolls in the conduct thereof, and to reimburse the County Recorder for actual expenses in preparing the necessary lists for use in such election, and, WHEREAS, the City of Apache Junction desires to use such Pinal County Registration Rolls for all future elections, NOW, THEREFORE, IT IS AGREED AS FOLLOWS 1 The City Clerk of the City of Apache Junction, shall apprise the Recorder of the City limits boundaries as of the date of execution of this agreement, and further shall notify the Recorder of any subsequent changes thereto. 2. The City Clerk shall notify the Recorder of any scheduled election for which lists are required, such notification to be given in writing and not less than fifty (50) days prior thereto. 3 The Recorder shall furnish copies of Precinct Registers, such i••� copies to be prepared and certified in accordance with the relevant portions of ARS 16-168 and ARS 16-169 4. Said Precinct Registers shall encompass all voting precincts, or portions of voting precincts, within the City such that every registered voter resident therein is listed. 5. Said lists shall be prepared as of the close of registration for each election, which shall occur as of 5.00 p.m. on the fiftieth day preceding such election, and shall be delivered to the City not later than the fifth day preceding said election 6 The Recorder shall furnish suitable covers for said lists, and other election supplies as needed, if available Such other election supplies shall include preliminary, uncertified lists of eligible voters to be used to facilitate absentee voting, and for such other purposes as the City deems necessary or advisable Said uncertified lists shall be furnished by the Recorder as soon as practicable, normally no later than thirty-three (33) days prior to each election, in order to be available for absentee voting. 7 City shall reimburse Recorder for actual costs incurred in carrying out this agreement. Claims for such payment shall be submitted and approved in the same manner as are other expenditures by the City 8. The Honorable Mayor and City Council THRU: City Manager fs (77)(, GM: Director of Public Works SUBJECT: Median crossing - Highway 60 Last Thursday Chief Bill McDaniels met with businessmen (see attached list) to schedule a meeting for the following Tuesday with the City and the Arizona Department of Transportation to discuss the construction options to the median crossing at Superstition Plaza. On Tuesday, November 4, 1980, a meeting was held in the Council Chambers and the following people were in attendance (see attached list) . The Director of Public Works provided an overview of what had transpired to date and introduced Benjamin Burritt from the Arizona Department of Transportation. Mr. Burritt explained the reasons for the engineering recommendations for the median redesigns and explained the options available which were. No. 1 - close the median opening entirely; No. 2 - modify the median and make it a one way corridor exiting North from the shopping center only; No. 3 - to cut a new median at the main entry to the center west of the median opening in question. Of the options available, the Department of Transportation recommended number 2, modification of the median to a one way corridor in a northerly direction. The Department of Public Works and Department of Public Safety, after reviewing the traffic study and meeting with the businessmen, stated their recommendations to the City Council that these departments concur with the recommendations of the Arizona Department of Transportation. The businessmen do not feel that some of the criteria sited by the Department of Transportation is reasonable, in analyzing the modification to the median opening. The Department of Transportation explained that the modification could be accepted with the stipulation that is is an interim solution only and that further work will need to be done. There was quite a bit of discussion about signalizing commercial develop- 'kik ment and Mr. Burritt explained that the Arizona Depart it of Transportation is not opposed to signalizing developments, but there is certain traffic and design criteria that must be met and design installation costs would be borne by the developer. Further discussions included multiple problems of the highway, including pedestrian traffic crossing from North-South. It was explained by the Director of Public Works that in order to proceed with any major redesign and construction that the Arizona Department of Transportation Board should be contacted to discuss our problems and to solicit their assistance in reprioritizing programs, so that Apache Junction can begin design and construction at the earliest date, on some of the problems relating to highway and traffic problems. This department will obtain the names of the Transportation Board members and contact them to solicit their help. In regard to the median crossover which prompted the study and the coord- ination with the businessmen and the Department of Transportation, there is yet to be a determination made by the City Council, as to whether or not to advise the Arizona Department of Transportation that we concur with their study and would request scheduling of the construction by their department. The paper was comprehensive and provided thorough information. In our comment, we suggest that if the general aviation aircraft expected to use the airport include airplane models having ten seats or more, then the chart of Figure 4-2, AC 150/5300-4B (copy enclosed) may be used to obtain the recommended runway length to accomodate this type of airplane. We obtained 4900' of runway length based on the same factors given in the report. We appreciate the opportunity to review the study development. When the study reaches the stage which determines the most desirable airport site or sites for the airport, the Federal Aviation Administration (FAA) will have to review the selected sites to assure convenience from an airspace stand point. After only three weeks of full time devotion to Community Services , the programs and acti- vities are becoming a reality YOUTH JOB REFERRAL SERVICE 'W This service was offered to help the youth of the community find part-time employment . The department also feels citizens of Apache Junction can benefit from this program by letting our young people do the strenous chores around the house. (Progress) We have received a few calls on this service, and with a little more advertisement we 're projecting a successful service . CRIME PREVENTION PROGRAM The Community Services Department in conjunction with the Police Department offers this program at request by the citizens This program covers everything from fraud to home security. Our purpose is to provide valuable information to service organization, churches , seniors , etc . on crime prevention. ADULT MIXED VOLLEYBALL LEAGUE This volleyball league will begin on December 8 , 1980 and is open to all past high school aged citizens . The league will run on the evenings of Monday, Tuesday, and Wednesday thru December and January. An entry fee of $25 00 per team is required to cover the cost of officials , facilities , and equipment All games will be played at the Apache Junction Junior High School Cafetorium. SENIOR SOUNDS The third edition of the Senior Sounds monthly news- letter has just been released The newsletter is continuing to grow with more and more seniors in the area becoming aware of this service Five hundred copies of this edition will be distributed throughout the community VERY SUCCESSFUL! GOLDEN AGE SOFTBALL LEAGUE This department is going to initiate a Golden Age Softball league (over 50) There seems to be quite a bit of interest in this league . McDonald lives in Pleasanton, Ca in a retirement home owned by three churches. I first met Mack when I was assigned to duty aboard the Battle Cruiser U S S. California in January of 1923 while she was on her first cruise. We manuvered off Panama that winter and observed the sinking of the old U S S Oregon. She was one of the older ships of the old white fleet The Navy had her manuy ring by radio with no one aboard making 9 knots. She was sunk by the U S S Mississippi firing from 21 miles. We were observing ship and stood by close enough to observe the 14 inch shells striking The California was commissioned in 19l and after a year at the outfitting dock, sailed for Panama for marGvrs with the fleet the winter of 1922 and 1923. Mack was one of fEe original crew who put her in commission at Mare Island, Ca He stayed in the Navy and retired after 30 years as Chief BoatSwain Mate I remember him well from our days in the old 5th division We were both expert riflemen first class gun pointers, and rifle instructors. Mack extended his enlistment 2 years at that time and went to Nicaragua After Nicaragua, he continued his Navy career and served as Chief BoatSwain aboard the U.S S Texas and did some recruiting duty. I left the service after my 4 years, after some very int resting experiences as helmsman aboard the California r,0 the Austrd1 ian cruise in 1925, I was on the wheel on several ac s ions such as the night we put a landing party on the beach at a 'IA ce called Nimits Beach on Hawaii Admiral Kunz once complimented me on my steering during high speed ma uvers )any problems were worked out at this time with Battle Slits manuvering together The United States had 21 first line battle ships at this time and were all but 2 or 3 together. The Calif was flag ship of the Pacific fleet at this time and was one of the big 4 The U S S Colorado, U S S Maryland, and U S S West Virginia were the others and ,they had. 16 inch guns as to the California's 14 inch, but the California had 12 long range rifles and they were chambered for an extra charge of powder where the others had 8 guns each of 16 inches. The California was, therefore, able to fire considerable more weight and was one of the big 4. (corres- pondence dated Setpember 29, 1980) was "Yes, the reasoning behind this was private deed restrictions are private contracts between property owners within the area affected by the deed restrictions Page 2 - Board of Adjustment Minutes of October 6, 1980 The private contracts affect the use of private property much in the same way a zoning ordinance affects the use of private property, except that a zoning ordinance is a regulation of the use of private property through ordinances passed by a governing body enacted under the police power of the City Zoning regulations are separate and independent _ of deed restrictions However, although in principle, deed restrictions and zoning ordinances are separate and independent regulations of private property, they often come in conflict Similarily, the Board of Adjustment will often be asked to approve a variance from the zoning ordinance which approval would be in their power to grant, the only question being the existence of a deed restriction in conflict with that variance The general rule is that any consideration of building restrictions placed upon property by private contracts has no place in proceedings under zoning laws for a building permit or variance. Case sited: Michener, State of Penn , 1955 The reason for this rule is that the Board ( of Adjustment is an administrative Board L Although it has been granted certain quasi- judicial functions, it is not a court and cannot construe or strike down plat or other deed restrictions. Case sited Oklahoma City v Harris State of Oklahoma, 1941. In other words, even though the Board of Adjustment knows of the deed restrictions in effect, its decision of whether or not /wak to approve a variance application should be based on considerations separate and independent of the existence of the deed restrictions. The property owners affected by the granting of the variance to another property owner whose property is governed by private deed restrictions may seek their remedy in a court of law They would enforce any private contract allegedly breached There is a possibility that the Board of Adjustment will also be joined in that law suit, but the only remedy avail- able to the property owners would be to request a Writ of Mandamus, which is an order from the court ordering the Board to do something Damages will not lie against the Board of Adjustment for the granting of the variance in conflict with deed restrictions " Page 3 - Board of Adjustment Minutes of October 6, 1980 9 Mr Jessamine stated that he would like to elaborate a little on this. 10. Mrs. Oden asked him if he could speak a little louder 11 Mr. Jessamine said that during the last session that was held, he was not satis- fied until he got the Attorney's opinion, in writing, as to what the decision would be between the City authorizing a variance to the private deed restrictions He added that he wasn't satisfied until he got some kind of an answer. He explained it all boiled down to just one simple thing: the City has their own ordinances to contend with, and that private deed restrictions are nothing but something put on a subdivision by a subdivider That means that if someone requests a variance within a City, the City can override the restrictions. If there was any conflict that arose, the property owners would have to go to Judicial court to fight. This means that we really could be involved as a Board of Adjust- ment member. He asked Mrs Oden to understand that we are governed by certain rules according to the City Ordinance and that he wasn't satisfied until he got this information Up until that point, he added that he was very un- happy about what was going on He noted where they quoted a few cases He told Mrs. Oden that if she had any questions right now they would be glad, for a short period, to answer anything she might have 12 Mrs Oden stated that she thought it was self-explanatory She asked Mr. Newcomer if she could have a AL.,* copy of that. She also requested a copy of the minutes of the last meeting, the meeting of Sept 8, 1980 13. Mr Newcomer asked the Chairman if he could wait on giving Mrs Oden a copy of the legal opinion he explained that it's been read into the minutes and that he was not sure if it would be proper to give out the actual legal opinion itself, once it's entered into the minutes then it could be transcribed back out. -r � Ago\ rah. New forms, developing procedures, answering numerous questions on a new program, etc. , all have a significant impact on the total costs. DAY-TO-DAY OPERATIONS Answering questions on both new and existing business license applicants and related areas consumes an average of three to four hours a day. In addition time is required to check on business locations around the City, including peddlers, to insure they are properly licensed. BILLING CYCLE COSTS During the past billing cycle in which all business licenses were manually typed, it required three individuals the better part of a week and a half to prepare for the billing. This very time consuming activity disrupts the day-to-day activity of City Hall. COMPUTER Use of the computer will save time in both the day-to-day functions and billing cycle functions. Quick access to the entire file of the business provides the ability to update, change information, and/or retrieve information at a touch. The billing process, once the program is ready to run, will take about ten minutes rather than the week and a half. "A/6"1"2 arott RICH OESTERLE City Clerk RO/jdt rook ORDINANCE NO. 79 AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA AMENDING SECTION 8-5-4 SCHEDULE OF THE CITY CODE, REPEALING ANY CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA AS FOLLOWS That Section 8-5-4 Schedule of the Apache Junction City Code be amended to read as follows SECTION I The license tax set out in the following schedule is hereby established for trades, businesses, games or amusements, callings, professions, or occupations listed therein and shall be paid by all persons who shall practice, transact, carry on or engage in such trades, businesses, games or occupations The license tax set out herein shall be based on a calendar year, and shall be due and payable on or before January 31 of each year or, in the case of a new trade, business, game or amusement, calling, profession or occupation, said license tax shall be due and payable within thirty (30) days from the start of operation In the case of a new trade, business, game or amusement, calling, profession or occupation whose start of operation occurs during the months of October, November, or December, said business license tax shall be pro-rated to reflect twenty-five percent of the scheduled amount to be paid ( The schedule shall be as follows: Bathhouses, Massage Parlors and Therapy Centers $1200 00 (Must meet provisions of Ordinance No 11) Fortunetellers and Palmists $1200 00 (Must be approved by the Director of Public Safety) Social Introduction, Escort and Dating Service $1200 00 (Must be approved by the Director of Public Safety) Circuses/Carnivals - Per Day $ 150 00 (Must be approved by the Director of Public Safety, and require a Certificate of Insurance naming the City of Apache Junction elected and appointed officials and employees as additional insureds) Swap Meet Proprietor $ 600.00 All others $ 40.00 SECTION II The effective date of this Ordinance shall be January 1, 1981. SECTION III All Ordinances or parts of Ordinances in conflict with the pro- visions of this Ordinance or any part of the City Code adopted herein by reference, are hereby repealed • • SECTION IV It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinances shall be severable, and if any provision of this Ordinance is held unconstitutional for any reason by a Court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining provisions of the Ordinance. SECTION V It is necessary for the preservation of peace, health, and safety of the City of Apache Junction, Arizona, that this Ordinance become effective immediately, an emergency is hereby declared to exist, and this Ordinance shall be effective immediately upon passage and adoption.
