AWARDS, PRESENTATIONS, AND COMMUNICATIONS Mayor Seeman read a letter from UNICEF to the Chief of Police concerning the individual cited for opposing traffic on the highway in Apache Junction The letter stated, that contrary to the skater's statement, he was not sponsored by UNICEF, nor did they have any knowledge of the individual and his cross-country skating. .�. Mayor Seeman referred to a letter from Barry Goldwater on the Bureau of Census She stated Senator Goldwater has been supportive of the measure by the City's Planning Department protesting the results of the Bureau of Census in Apache Junction, and correspondence has been received with regard to it Mayor Seeman referred to the memorandum on a disaster drill from Mrs. Ruth McCain of East Valley Emergency Medical Center to be held December 18, 1980 at 9 00 a m. Mayor Seeman stated that the Pinal/Gila Senior Citizen's Van has been transporting senior citizens to the Nutrition Center She stated funds are available to use the van for other purposes and beginning Thursday, December 11, 1980, a shopping trip will begin for senior citizens on a once-a-week arrangement. She stated citizens can call the Nutrition Site at 982-6697 on, or before, Wednesday morning, requesting a ride on Thursday afternoon She stated to use the service citizens must be at least 60 years of age; there is no charge for the service although anyone who can afford to do so is asked to donate 25 cents a ride to help offset the cost of fuel and vehicle maintenance. Mayor Seeman stated City Hall Spotlight will feature Burglary Prevention on December 7th and Animal Control on December 14th. Councilman Damiano read a letter from Congressman John Rhoades regarding the Revenue Sharing Legislation ( that the House passed. Councilman Damiano stated that in his letter the Congress- man thanked the Mayor for contacting him regarding the legislation Councilman Damiano stated he had also received a letter from Congressman Rudd stating the same thing. Mayor Seeman stated there are now eight boards and commissions with approximately 45 citizens donating their time to serve on these boards and commissions She stated the City is almost equal in the number of people donating their time and the number of people on salary Mayor Seeman intro- ' duced her parents, who are winter visitors, to the Council and the public. CALL TO THE PUBLIC Mayor Seeman opened the meeting to the public. There being no one in the public wishing to address the Council, Mayor Seeman closed the meeting to the public. CITY MANAGER'S REPORT Mayor Seeman called upon the City Clerk to give the City Manager's Report. City Clerk Rich Oesterle stated the Director of Planning would give two reports: one on the Traffic Study and another on the Four-Corners Regional Commission Grant. REGULAR MEETING OF THE CITY COUNCIL DECEMBER 3, 1980 3'" PAGE TWO Director of Planning Joe Gero referred to the preliminary traffic flow map posted on the wall made in March 1980 by the Arizona Department of Transportation He explained the map to the Council and stated the City will be meeting with the Arizona Depart- ment of Transportation to review the City's findings and the Arizona Department of Transportation will prepare a transportation map and plan for the City of Apache Junction. He stated that in January or February it is hoped that a tour of the community for elected and appointed officials to take a look at the various points of interest in the traffic study will be arranged. Director of Planning Joe Gero stated that with regard to the Four-Corners Regional Commission grant approved by the Council for PRC Toups Corporation several meetings ago, those contracts have been finalized by the City Manager and have been approved by the Four-Corners Regional Commission He stated PRC Toups is actively pursuing the scope of work and at some point in the future each Councilmember will be contacted by members of that company. Mr. Gero stated any claims by anyone in the community that they are going to be having any imminent sewer charges are absolutely false and he wanted the community to be aware of that He stated there is, as one of the three elements of the program, a study to see if there is going to be some future need for a sewer system, then people who are elected and appointed might have the opportunity to work with the community and find out where we should be going with that and let the community make the decision He stated the other two things that will be studied are a transportation plan based on the Arizona Department of Transportation study and the third thing will be a water systems analysis. City Clerk Rich Oesterle recognized the Director of Public Works. Public Works Director Richard Broman stated the Building Division had a surprise visit from the Division of Mobile and Manufactured Housing Standards and they performed an audit in that department He stated essentially they pulled about ten inspection reports out and went into the field to check them He stated 179 permits have been issued in this particular category, so with the ten they go out to see how good a job was done. He stated the bottom-line on this is that under general comments the City of Apache Junction is doing a very fine job of inspections according to the State Rules and Regulations. PUBLIC HEARINGS Ark TRANSFER OF LIQUOR LICENSE LUCKY BOB'S LIQUORS Mayor Seeman opened the hearing to the public and asked if the applicants wished to speak on the item. There being no one wishing to address the Council, Mayor Seeman closed the meeting to the public Councilman Damiano aet stated that after reviewing the application, he did not find any reason why the Council should recommend denial of the application to transfer the liquor license. VOTE Unanimous The motion carried REGULAR MEETING OF THE CITY COUNCIL DECEMBER 3, 1980 PAGE THREE APPLICATION FOR BINGO LICENSE DESERT HOLIDAY R V PARK Mayor Seeman opened the hearing to the public for the item. She asked if anyone was present from the Park wishing to speak. City Clerk Rich Oesterle stated the gentleman representing the Park had called the City Clerk's Office to state he would be in Phoenix and would be unable to attend the meeting There being no one in the public wishing to address the Council, the meeting was closed to the public Mayor Seeman asked about the recommendation from the Department of Public Safety She stated there were no reports included from either the fire department or the police department on either of the two bingo license applications. Chief McDaniels stated there were no problems related to ingress and egress The Chief suggested that the applications be recommended for approval and if any serious violations, determined to be detrimental to public safety, were found a request could be made to hold it up until the problems are remedied Mayor Seeman pointed out the Department of Public Works memorandum stated that the bingo games are intended for the use of the residents of the Park so parking problems are not anticipated Vice Mayor Granillo MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY nF APACHE JUNCTION, ARIZONA, THAT THE APPLICATION FOR A SMALL GAME BINGO LICENSE BY DESERT HOLIDAY R V PARK BE, AND HEREBY IS, RECOMMENDED FOR APPROVAL TO THE ARIZONA TAX COMMISSION Councilman Damiano seconded the motion. GOLDEN APPLICATION FOR BINGO G LICENSE Amok DENACRESMOBILEMANOR Mayor Seeman stated this item is a public hearing for Golden Acres Mobile Manor She asked is there were any representatives of the Park who wished to address the Council on the item There being no one in the public wishing to address the item the hearing was closed to the public Mayor Seeman pointed out the Council does have the option of denying the recommendation for approval until such time as representatives for the parks were available to address the Council, she reminded the Council that it simply recommends approval to the Arizona Tax Commission Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE APPLICATION FOR A SMALL GAME BINGO LICENSE BY GOLDEN ACRES MOBILE MANOR BE, AND HEREBY IS, RECOMMENDED FOR APPROVAL TO THE ARIZONA TAX COMMISSION Councilman Eidson seconded the motion. VOTE Unanimous The motion carried. REGULAR MEETING OF THE CITY COUNCIL DECEMBER 3, 1980 PAGE FOUR — An. OLD BUSINESS There was no old business NEW BUSINESS MEDIAN CROSSING HIGHWAY 60 (DISCUSSION ITEM) Mayor Seeman called upon the Director of Public Works to provide background into the item. Director of Public Works Richard Broman stated that earlier in the year the State had been requested to provide a study because of the number of accidents being observed in the area where Highway 88 and Highway 60 merge to turn into the median access on the east side of the Alpha Beta Shopping Center. He stated from January 1978 to December 1979 there were 35 accidents in that location; from January 1980 until July 15, 1980 there were an additional 25 accidents there, and in the past four months there have been an additional nine accidents at that location He stated, that as indicated by the Transportation Action, the traffic study at the location, there are approximately 23,000 vehicles a day passing through the intersection and with the winter visitors the number will probably increase substantially. He reviewed the major problems in the vicinity, the recommendations of the Department of Public Works, the Department of Public Safety, and the State Highway Department He stated the recommendation of the State Highway Department is that the median opening be altered to eliminate the left turn going south He stated it would be altered in such a manner that persons exiting the shopping center and going east on Highway 60 would still be able to turn north and then move west through the median opening. He stated several meetings with the businessmen have been held, they have been given copies of the traffic study, the study has been explained to them, and a representative from the Highway Department has come down and answered their questions and provided the traffic engineering reasons why certain recommendations are being made Mr Broman stated it appears there are three options available -- one, to close down the median entirely, two, to modify the median making it a one-way, out- bound, as previously explained; and finally, to do nothing After reviewing the social costs of the accidents, Mr. Broman said it is realized that some minor problems could be created to the business community, however, he felt that in lieu of any hard statistical evidence from the business community that their businesses would be jeopardized, it is very difficult to make any other recom- mendations Mr. Broman stated he feels a step was taken in the right direction at the meeting of November 19th when the State was requested to look at signalization and reduction of speed, etc. He stated the City is also coordinating with the State to get the Transportation Board into the City to hear the case and look at completely redesigning the intersection. He added these things are going to take time and that there is an immediate need for the change to be made now Director of Public Safety Bill McDaniel stated Public Safety agrees with the suggested recommendation. Vice Mayor Granillo stated he felt the Council should approach the person who has the power to change their planning, he stated he felt the City has a lot of traffic and congestion; and just because it was projected ten years ago that there would be nothing in Apache Junction until 1985 does not mean changes cannot be made Director of Public Works Broman stated that the State has a five-year plan and right now the City is not on the plan He added he had done some research to come up with the proposals which the City has laid out at this time and stated the District VII Engineer has done some preliminary designs -- schematic-type things and the State is aware of the problem. He stated the way to get on the State's five- year plan is to get the Transportation Board sympathetic to the problem Mr Broman said he has been advised that the State is limited in what they can do because they don't have the budgeted funds for the study, the plans, and the engineering that was not on the five-year plan He added that if the City is to take no action on the median crossing and work toward having the entire REGULAR MEETING OF THE CITY COUNCIL DECEMBER 3, 1980 PAGE FIVE Allan ... interchange modified and the City was lucky and got on the plan next year, by the time the City gets through the engineering and then allocates the money for construction a minimum of two or three years will pass before anything is done at all Councilman Damiano stated the City of Apache Junction has an emergency and needs to have something done now; the City cannot wait for twenty years. Amok Director of Public Works Richard Broman stated the Department of Transportation suggested that the Transportation Board be invited to Apache Junction so the public can address the Transportation Board to see what can be done to expedite solutions to these problems. Mayor Seeman asked if the City should accept the recommendations from the Arizona Department of Transportation for a temporary solution, she said the temporary solution will not solve the problem and asked if the City should settle for an interim solution or should it go all the way to get what the citizens actually need -- street lights, bike crossings, etc. The Mayor stated she felt the City should be given priority treatment and the Council should meet with the State officials in an attempt to address the problem. Mr. Broman stated he did not feel he could answer for the State -- the City has coordinated with them, they have answered questions and in that regard their comment was that this is a temporary measure He stated the City needs to meet with the Trans- portation Board and get some of the top-level administrators and work closely with them. He stated that the State has been a little reluctant in the area, that possibly within the State there may have been some other priorities but now that the City is here there is the opportunity, as a governmental agency, to coordinate directly with them and get the money and benefits down here where the City knows they are needed ( Vice Mayor Granillo stated he thought the City has probably been dealing with the lower echelon He asked if the Council, as a group, could meet with the head of the department, or the person who could say yes or no, rather than the people who can only make a recommendation to someone else. Mr. Broman stated the people he has been working with from the Transportation Department have .see, been working very closely with him, however, they are limited in what they can do. He added the State is so large there are certain procedures and formalities that must be followed and it is a matter of finding out what the rules of the game are and working as best the City and State can together to reach the goal Vice Mayor Granillo commended Mr. Broman for the wonderful job he is doing in pubic works Chief McDaniels stated that as Director of Public Safety he would have to recommend that some temporary measure by taken now to alleviate a lot of the injuries and accidents that are occurring. Mayor Seeman reviewed the three options placed before the Council Councilman Eidson asked how long it would take to work with these temporary options. Director of Public Works Richard Broman stated he did not have the answers but he thought it i.ould be done within 60 to 90 days, although he does not know if there could be any action sooner. He stated he would check with the State. BE IT FURTHER RESOLVED THAT THE DIRECTOR OF PUBLIC WORKS, THRU THE CITY MANAGER, BE DIRECTED TO ORDER CONSTRUCTION TO BE SCHEDULED BY THE ARIZONA DEPARTMENT OF TRANSPORTATION Councilman Hill seconded the motion VOTE• In favor -- Councilman Damiano Councilman Hill Councilman Shanks Mayor Seeman Opposed -- Vice Mayor Granillo Councilman Edison The motion carried Councilman Eidson requested that a meeting be arranged by the Mayor for the Council to meet with the top official with regard to a more permanent solution to the problem PAYMENT FOR ARCHITECTURAL SERVICES TENNIS COURTS/BALLFIELD/PARKING LOT ) Mayor Seeman stated this item pertains to the joint project between the City and the School District City Clerk Rich Oesterle stated he would be glad to answer any questions and that he had attempted to cover some of the items in the memorandum that the Council has received. He stated it is an item that is not part of that grant but is an expected cost under any type of construction project of this nature He added the architectural services of James Flynn and Associates have been involved in the project since the inception of the concept of the intergovernmental agreement between the School and the City to share expenses which was approved in August 1980 and the firm has completed the work up to the amount of the bill that was received. The City's fifty percent share of that cost is approximately $6500 00 Councilman Eidson MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT PAYMENT IN THE AMOUNT OF $6568 65 FROM ACCOUNT NO. 1.0945, FISCAL YEAR 1980-81 BUDGET, TO JAMES FLYNN & ASSOCIATES FOR ARCHITECTURAL SERVICES BE, AND HEREBY IS, APPROVED Vice Mayor Granillo seconded the motion. VOTE Unanimous The motion carried PROPOSED ORDINANCE NO. 77 -- $700 EXEMPTION TO THE BUILDING PERMIT FEES (SECOND READING) Mayor Seeman stated the first reading of this item was at the City Council meeting of November 19th. She stated it is a $700 exemption to the Building Permit fees proposed by Council Eidson. Councilman Eidson called attention to the fact that with the fifty percent modifier there is, in actuality, a $1400 free building permit instead of the $700. PROPOSED ORDINANCE NO 76 -- AMENDING SECTION 304 (a) ( OF THE UNIFORM BUILDING CODE (SECOND READING) fl ) Mayor Seeman stated this is the second reading of the proposed ordinance and that the proposal was suggested by Councilman Eidson to have a fee exemption for reconstruction due to natural calamities. VOTE Unanimous The motion carried REGULAR MEETING OF THE CITY COUNCIL DECEMBER 3, 1980 PAGE EIGHT em► PROPOSED RESOLUTION 80-37 STREET LIGHTING AGREEMENT WITH SALT RIVER PROJECT ) Mayor Seeman stated that presently Salt River Project is not providing electric service for street lighting to the City, in order to obtain such service the City must enter into an agreement. She stated essentially the agreement provides for the installation, operation, and maintenance of a street-lighting system as may be ordered by the City The agreement outlines the City's utility responsibilities and defines the rates and charges The agreement is basic in format and is required to be approved prior to the implementation of any street light improvement district Councilman Damiano asked who would be collecting the money on the district. Special Use Permit applications are permitted by Section 2302 of the Zoning Ordinance. A review of Sub-sections (a) thru (n) indicates a list of specific items for which a Special Use Permit might be requested. The Sub-section which is at point for the pro- posed amendment to the Zoning Ordinance is Sub-section (o) which reads as follows: "(o) Such other uses as the Planning Commission may deem appropriate in the public interest. " Please review the opening paragraph of Section 2302 carefully. Please note that in the paragraph it says "building", structures, for uses in a district from which they are prohibited by this Ordinance. " In Article 23, there is an absence by which the Planning Commission might consider or evaluate whether or not to approve a request for a Special Use Permit. The Ordinance is referenced to a finding that must be "in the interest of the public health, safety and general welfare of the community". However, there is some specific criteria which is not only recommended but required to comply with the Arizona Revised Statutes. The State Enabling Act provides that the Legislative Body, or the City Council as in our case, may rezone by Ordinance. The referenced Sub-section (o) is so broad in scope, that no applicant would have to ever request a rezoning to have a change of use on his property, provided he could get the Planning Commission's approval for a Special Use Permit. Such broad powers appear to me to be an unlawful dele- gation of powers by the City Council to the Planning Commission. Several points with regard to Section 2302 should be made. 1. The entire Section lacks general criteria for the Planning Commission to make decisions. Therefore, it is advisable that the entire Section be reviewed and amended accordingly, However, such a task will most likely require substantial amendment to the entire Zoning Ordinance. With an early spring schedule to begin rewriting the Zoning Ordinance, it would appear the immediate remedy of deleting Sub-section (o) and having only the specific list of items (a) thru (n) would remedy substantial opposition to this Section of the Zoning Ordinance. 2. It appears blatantly unfair to the general public to have in the Zoning Ordinance a process that the Council believes to be an unlawful delegation of powers from itself to the Planning Commission. ANALYSIS AND IMPLICATION: Leaving this Sub-section in the Zoning Ordinance could create substantial embarrassement to the City if knowing the high propability of the Sub- section is unlawful , it allowed applicants to proceed utilizing the said .• Sub-section. ALTERNATIVES: The City Council has the following alternatives in this case: 1. Approved with or without the emergency clause. 2. Deny the proposed Ordinance. 3. Direct the staff to prepare for consideration other amendments. 4. Table action on this matter. 5. Other. Memorandum - Proposed Ordinance #74 Page 3 RECOMMENDATION: Attached to this request are several pieces of information germane to the topic, including the opinion of the City attorney. Due to up- coming scheduling committments, the staff would prefer not persuing amending the whole Sub-section with regard to Special Use Permits at this time. Rather, we would defer those to early spring when we begin the re- write of the entire Zoning Ordinance. We would recommend that Sub-section (o) be deleted from the Zoning Ordinance at this time with the emergency clause, to protect the general interest of the public. The Planning and Zoning Commission at its December 9, 1980, regular meet- ing held an advertised public hearing on this proposal . Following the close of the public hearing the Commission voted unamimously to recommend the proposal with the emergency clause for the reasons as appear in the memorandum. SUGGESTED MOTION. Sec. 2-9-5 Rules of Procedure; Power and Duties There is hereby vested in the City of Apache Junction airport commission full power and authority for, and on behalf of the City of Apache Junction, Arizona, to represent said city in any and all . negotiations with individuals, corporations, associations, govern- mental agencies, etc. , for the development and promotion of commerce by air in the counties of Pinal and Maricopa and especially the City of Apache Junction, Arizona. The director of public works shall review all the commission' s recommendations and shall submit his recommendations to the council . No contracts or other commitments shall be deemed to have been entered into or made, except in compliance with the provisions of article 3-7 of this code. Sec. 2-9-6 Meetings The commission shall establish a regular meeting day and time at least once a month. Special meetings may be called as required. As a prerequisite for those studies, and as part of the contract, the Toups Corporation is doing a study of the present and projected population for the City. The population study has been concluded and is attached. The staff has worked closely with Mr. John Stancil , of the Toups Corporation in the preparation of this document and gives it general approval . The Council is being asked to approve this document at this time for two purposes. Those purposes are: 1. Once approved, the consultants can then proceed with other studies from the base population as approved by the City Council . 2. The adopted population report would give us a firm document which to protest the U.S. Census count. Therefore, the City Council , during this week, is being asked to review this docu- ment and call the Director of Planning if there are any questions. Because the Director of the U.S. Bureau of the Census must make his report to the President of the United States, it is urgent that any protest to be filed in behalf of the City of Apache Junction, be done as soon as possible. As you may be aware, the procedures and results of the 1980 Census have raised questions concerning its accuracy and validity. Allega- tions have been made that the Census Bureau did not do a thorough job and that, as a result, many citizens in both urban and rural areas were simply not counted. I understand that several cities and states have filed suit alleging a census undercount. Because of the serious questions which have been raised concerning the Census, the House of Representatives approved an amendment which would prohibit the expenditure of funds by the Office of the President to calculate or transmit to Congress reapportionment figures for the House of Representatives. The Senate Appropriations Committee included this provision in its bill which was reported to the Senate Floor. This provision would simply be to establish a moratorium on the implementation of the Census until Congress can review the important question that have been raised by the results of the Census. I will support the retention of this provision in the Treasury Appropri- ations bill which is presently before the Senate. The following report is a summary of the various activities and findings that we have carried out and conclusions that we have reached in studying population and forecasts for the Apache Junction area as part of our contractural requirements in the study of future community facility and space needs. CONTACTS AND RESPONSES We carried out the following contacts to obtain population information and received the following general information: Pinal County Courthouse: 868-5801 Contacted Charlie Quinn, Deputy County Manager and Terry Smith, Planning Director was promised some information but received nothing. Department of Economic Security: This department is the official Government Office for determining population projections for the State and its political jurisdictions. Jack Kronenfield, 255-5984 supplied considerable data and the DES projections for the State, County and Apache Junction. Part of the data received is contained herein. Department of Economic Planning and Development: Eric Rassmussen, 255-5725, indicated that data they had available and data that they would use would be that provided by the Department of Economic Security. Department of Health Services: Helen Davis, 255-1068, submitted birth and death data for a 10 year period for the Apache Junction Area by zip code area designation. See copy in appendix. PRC Toups 1 \ Department of Transportation: Bob Mickelson, 261 -7433. Data similar to that produced by DES. Maricopa Association of Governments : Tom Ford, 261 -7867. Doesn' t have anything on Apache Junction area or Pinal County except that produced by DES. Central Arizona Association of Governments • John Glaze, 868-5878, said he would send data but never received anything. Valley National Bank Research Center: 261 -2777 Stated that they had no statistical data available for an area as small as Apache Junction outside of Maricopa County. First National Bank of Arizona Research Center: 271 -1211 Similar comment as (VNB) above. Arizona Public Service - Gas Service: John McAtee, 271-7830, Area Service Manager. Service Area east of Meridian Road, for 6 miles east and 2 miles north and south of Apache Trail total accounts 6,500+. Number of accounts that request to be disconnected during summer 2,241 for 2 years ago; 2,736, this past year or approximately 42% of total accounts. Some residents leave but don' t ask for disconnects and pay the monthly minimum of $2.50, the manager has no idea how many this would be. Arizona Public Service connects approximately 80 new accounts annually in the Apache Junction Area. The Area Office Manager indicated that they had some information on computer tapes by zip code areas, but no seasonal cut off information. Any information retreived on a small area basis would have a special program run and a service charge would be necessary. This source may be a useful one and one to work with as an input to future population projections and particularly to seasonal trends. PRC Toups Mountain Bell - Telephone Service: Saundra Lawson , 255-6411 , Local Area Manager. Mountain Bell keeps track of telephone connections by prefixes . The area wide Superstition prefixes are 982, 984, 986, 981 and 985. Apache Junction prefix is 982 and generally includes the area bounded by McDowell and Baseline, Meridian to Goldfield. Total number accounts 5,803, September 24, 1980, of which 1 ,901 or (32 8%) of the accounts were on vacation status. Mountain Bell does not distinguish between residential or commercial connections or accounts at this time. Current growth in the Apache Junction Area is less than 100 connections per year. Big growth occured in 1978 and 1979. Current new growth is between Meridian to Sossaman This source appears to be a very useful one for input to current growth, projections and seasonsal trends. The city should contact Mountain Bell representatives to work out an acceptable program of accounts information. Salt River Project - Electrical Service: Bing Brown, 273-5724, Manager Information Division indicated that they kept records by geographic billing areas which are established to assist meter readers, and are not usually of much value to government jurisdictional area. However, for a small charge Salt River Project can provide computer printout data from a single or a combined billing area for a limited amount of information. Apache Junction Post Office: 982-2121 Apache Junction zip code number 85220. Zip code boundaries ; West Boundary: Crismon Road, South of Apache Trail and 102nd Street between Apache Trail and Brown Road and 108th Street (Signal Butte) north of Brown Road. North Boundary: Salt River. East Boundary: Includes Florence Junction, Queen Valley, Kings Ranch. South Boundary: Not fully established. Post mistress to supply new information directly to the City Planning Department. Postal receipts make a pretty good barometer of growth. An attempt should be made to establish a more logical zip code area which will match the city's existing or projected growth area. Other types and sources of information are maintained by zip code number. POPULATION Apache Junction has shown remarkable population growth since its quiet crossroads status in 1950 While lack of well defined political boundaries has hindered the U S Census and other organizations in their estimation efforts, the Arizona Department of Economic Security has estimated Apache Junction's population at 8,500 at mid year 1976 This estimate, it should be noted, extends to the west beyond the Maricopa Pinal county line taking in built up portions of Maricopa County and should reflect the best possible estimate )' currently available This estimate also reflects an average population, i e somewhat greater than the actual permanent year round figure although considerably below the temporary peak experienced in February and March with the influx of winter visitors At the time of writing, Apache Junction had 63 mobile home and R V parks which regularly achieve full occupancy during the December April season but often less than one-third occupancy during the summer. Kraus Retail sales, bank deposits, postal receipts and school enrollments make pretty good statistical information in carrying out population estimates, trends and projects. If a reasonable data base can be established, every effort should be made by the City to maintain and enhance this data base for future use. PROJECTIONS The following chart indicates estimates and trends of resident population between 1970 and 1980, with projections to the year 2000 for the State of Arizona, Maricopa County, Mesa, Tempe and Apache Junction. These estimates and projections were prepared by the Arizona Department of Economic Security which is the official demographic agency for the State of Arizona. This chart indicates the general growth trend lines for each area. All areas, with the exception of Tempe, showed substantial increases in growth between 1978 and 1980. The chart indicates a flattening in the projections after 1980, except for the State. We believe that the Maricopa County and Apache Junction rate may be slightly steeper than what is indicated. It is this offices ' feeling that the recent incorporation of the City will add amenities to the Apache Junction area which will attract a higher percent of persons coming to the State to settle in Apache Junction. The extension of the Superstition Freeway closer to Apache Junction will also tend to increase the desirability to live in Apache Junction. Consequently, we feel that the actual growth trend line for Apache Junction during the next decade should be increased to approximately 16,300 persons for the year 1990 with the trend line remaining approximately as indicated for the second decade raising the estimated total for the year 2000 to approximately 21 ,600 persons. It indicates a growth rate line slightly lower than the State and Maricopa County but considerably higher than Pinal County. The chart indicates that Apache lk Junctions' share in the State total would increase from 0.4% in 1980 to 0.47% for the year 2000. This appears to be a reasonable growth trend and on this basis, in the year 2000 the State will have approximately 4,280,000 persons with Apache Junction having 20,111 as indicated in the previous chart. However, with the continuation of people migrating from the snow and frost belts to the sun belts due to higher energy costs and more favorable living conditions , also, the completion of the Central Arizona Project which will assure Eastern and Midwestern industrial and financial establishments that the State has an assured water supply; then the State's total growth rate may increase substantially over that indicated. Also, with increased growth to the East and Southern portions of the Phoenix Metro Area. Apache Junctions ' growth may increase to more than 0.5% of the State total thereby raising the towns ' resident population projection to well over 30,000 by the year 2000. Since Apache Junct►on is a new jurisdictional area, available economic data is slight and questionable due to the statistical area being considered at the time of the data collection. The chart shows some economic indicators for data available but questionable. Reta► l sales , bank deposits, postal receipts and school enrollments are good indicators for projecting future growth. Utility connections can also be used as a very good indicator for growth, as well as provide reasonably good information on seasonal occupancy. However, Apache Junctions ' utility companies service connection data cover different service areas and at this time they are not suitable for reliable projections. Every effort should be made to have utility service connections accounted in a way which would be of value in making and supporting future population estimates and projections. A review of the following chart indicates that retail sales , bank deposits, and postal receipts have been rapidly increasing since 1973/74, while part of this is due to inflation, this office believes that it more clearly reflects a truer and faster growth rate for the Apache Junction area than has actually been considered. A continued but declining growth rate for these indicators is projected on the following chart by this office. Superimposed over this chart is a population projection line following a growth rate comparable with the other growth indicators This line starts with a 1980 population of 10,500 x 3 and increases to a population of 60,300 3 = 20, 100 for a year 2000 population. This projection ► s close to the 20, 111 projected by the Arizona Department of Economic Security. PRC Toups it SEASONAL OR WINTER RESIDENTS Seasonal residents, which have not been included in the previous comments and projections, account for a large number of Apache Junctions ' total population. Whether these residents are classified as permanent resi- dents from a federal census definition is questionable. For the most part, Apache Junctions' seasonal residents live in mobile home or travel trailer parks; they consider some other location, where they usually own property, as being their permanent place of residency. A survey that was carried out in November of 1980, indicates that there were 73 separately owned mobile home or travel trailer parks located within the corporate limits of the City and seven more parks lying ad- jacent or within the immediate service area of the City. The 73 parks contained 1719 mobile home spaces and 4305 travel trailer spaces. The seven parks contained 761 mobile home spaces and 45 travel trailer spaces. It was indicated during the survey, that 90% of these spaces are filled during the peak of the winter season. Another survey conducted for the Central Arizona Association of Governments in 1975 and reported on in September 1976, indicated that only 61 .4% of the areas population re- sided in the area for more than 330 days of the year and about 20% re- sided in the area for less than 180 days of the year. Consequently, it appears that the seasonal resident population of the City could be as high as 9760 with another 1300 residing within the general service area. This project is based upon the assumption of 900 occupancy of all mobile home and travel trailer spaces and utilizing a 1 .8 persons per residency ratio. It can also be assumed that over 2200 of these people reside in the community for more than one half of the year but claim other places as their permanent place of residency. Nevertheless, the City of Apache Junction must consider seasonal re- sidents in its' future planning and growth process for providing muni- cipal and public services and functions. The preliminary 1980 Federal Census indicates that the City of Apache Junction contained 6,960 housing units of which 2,677 were vacant leav- ing 4273 occupied units containing 9,967 persons for an average of 2.33 persons per occupied unit. If this average or 2.0 were used for sea- sonal occupancy then the projection would be increased by another 1000 persons. The special census taken at the time of incorporation in March of 1979 resulted in a count of 10, 128 persons. Considerable controversy is be- ing carried out regarding the population count by the 1980 Federal Census in regards to the City of Apache Junction as well as many other cities of the state and nation. In our opinion, this controversy is PRC Toups p p / \ primarily caused by the mass movements of persons primarily of retire- ment age who travel and reside in multiple locations during the year. oft. Consequently, we feel it is important for the City of Apache Junction to attempt to count all of the residents of the community in future census' that reside in the City for the most part of the year as per- manent residents and to establish data collection techniques which will support such a determination. PRC Toups Ask CONCLUSION For the purposes of this study, which is to establish baseline projections for future population growth to determine future community facilities and space needs. We believe that the following projections should be considered. These projections take into consideration permanent year round residents as well as seasonal residents which should be considered as permanent residents when determining future City needs , facilities and services. Section 2-10-6 Meetings The Commission shall establish, as its regular meeting date, the second Thursday of each month at 7 00 p m in the City Council Chambers, 1001 N. Idaho Road. Special meetings may be called by the Chairman or at the request of a majority of Commission members. A quorum shall consist of four (4) voting members for the transaction of all business. Section 2-10-7 Vacancies Vacancies shall be filled in accordance with Section 2-10-2 by the City Council for the unexpired term of the member affected. Section 2-10-8 Removal of Members Members of the Commission serve at the pleasure of the Council and may be removed by the Mayor with the concurrence of the Council A member shall not be absent from the Commission's meetings for more than three (3) consecutive meetings, the remaining members of the Commission shall vote to retain or recommend to the City Council that the absentee member be relieved of his duties on the Commission. SECTION 2 REPEAL OF CONFLICTNG ORDINANCES All ordinances and parts ofOrdinancesin conflict with the provisions of this ordinance or any part of the Code adopted herein by reference are hereby repealed. As a new city, incorporated in November of 1978, we immediately inherited a population of 10,000 permanent residents, 30,000 seasonal residents and daily traffic volumes exceeding 25,000 vehicles per day, along U.S. 60. Apache Junction is also pre- sently the 17th largest and fastest growing City in the State. At this time our primary goal is to have the intersection of U.S. 60 and S.R 88 reconstructed. It must be one of the most confusing intersections in the State, and it creates a def- inite threat to life and property. We also are supporters of the extension and completion of the Superstition Freeway to U.S. 60. This extension will assuredly reduce the volume of traffic along U.S. 60 that now divides our city in half. The action by the Transportation Board to include Apache Junction in the FY 19.81 airport development program is greatly appreciated. We are presently about half way through the process of airport master planning and a site selection study. Chairman stated that a quorum was present and that he would like the members to review the copies of the "Minutes" from the meeting of November 3, 1980 which they had before them. 4 Mr. Nesser recommend that the approval of the "Minutes" be put off until later in the meeting so as to allow the members the time to review them. 5 Mr. Furness agreed with Mr Nesser 6 Chairman agreed to suspend the approval of the "Minutes" until the end of the meeting He then requested Mr. Newcomer to brief the members on Item #3 on the agenda, the change elk in the quorum number necessary for meetings 7 Mr Newcomer explained that with the addition of a new member to the Board (Mr. Morrison), that it was necessary to amend the Rules and Proce- dures for the Board of Adjustment to account for the new member in the number of members needed to have a quorum 8 Mr Nesser asked what section of the Board rules would have to be amended 9. Mr Newcomer referred the members to page 3 of the Rules and Procedures Handbook which outlined the number required for a quorum under the title, "Quorum and Voting". 10. Mr Newcomer explained that the applicant had requested that the hearing on this case be postponed until the Board meeting of December 1, 1980 to allow him to change his application He further explained that the change in the application would make necessary a new legal advertisement in the newspaper and that it could only be accomplished by postponing the hearing date until December 1, 1980. 13. Chairman asked if the applicant had requested that the hearing be postponed until December 1, 1980. 14 Mr Newcomer explained that the applicant wished to amend the application to eliminate the request for a resident-caretaker in the mobile trailer. He added that the applicant had withdrawn his request for a Special Use Permit and, therefore, would not be having a hearing before the Plan- ning and Zoning Commission 15 Nesser/Jessamine M/S "BE IT RESOLVED by the Board of Adjustment at-the City of Apache Junction, Arizona, that Il case BA-18-80 be continued until the meeting of December 1, 1980, in order to allow for a change in the application and the necessary time for a legal advertisement of same " The motion passed 6-0 16 Chairman asked Mr. Newcomer to brief the members on the next case, BA-17-80. 17. Mr. Newcomer explained that BA-17-80 was the application of Arthur Dwyer of Rock Shadows Travel Trailer Resort requesting a variance to permit the reduction in the side setback requirements so that people renting the spaces could set up carport and patio covers next to the travel trailers. He added that the park was located at Idaho and Broadway Road and had approximately 681 spaces The average size of each space being 1,584 sq ft The applicant was requesting that the side setback requirement be reduced from three feet (3') to eighteen inches (18"). 18 Chairman called upon the spokesman for the applicant to present his case 19 Mr Geiger stated that he was the spokesman for the applicant, Arthur Dwyer He explained to the Board members that the requirements of the City were different from those in other cities with regard to the side setback requirements for travel trailers He added that Rock Shadows wished only to be able to do what other area parks could do He added that the travel trailer owners wished to be able to set up carports and protective awnings so as to protect their cars and travel trailers from the sun. Chairman explained that he had inspected the park and asked if the awnings would be facing each other, if set up 21 Mr Geiger explained that there would be room for the car and carport on each trailer on the side opposite the other trailer. 22 Chairman asked if the proposed awnings would be canvas or aluminum 23 Mr Geiger felt that the awnings would be of aluminum- type construction 24 Chairman asked Mr. Geiger if they had considered the possible fire hazard with the structures being so close together 25 Mr Geiger explained that there would be nothing to burn and that there would be at least thirty feet (30') from one trailer to the other. 26 Mr Nunn asked Mr. Geiger if he had the "Power of Attorney" from Arthur Dwyer 27 Mr Newcomer explained that the proper documents were on file with the Planning Department 28. Mr Nunn asked if the Fire Chief had had the time to study the situation and, if so, what were his conclusions 29 Mr Newcomer explained that he had sent a memo to the Fire Chief requesting his input but had not received anything back. 30 Mr Nunn recommended that the Board postpone the hearing until they had information from the Fire Chief regarding the possible safety and fire hazards involved. 31. Nunn/Vaughn M/S "BE IT RESOLVED by the Board of Adjust- ment of the City of Apache Junction, Arizona, that the public hearing on case BA-17-80 be postponed until the meeting of December 1, 1980 so as to allow time to obtain a report from the Fire Chief on the possible fire hazards" The motion passed 6-0 32. Mr. Geiger asked when the next meeting would take place 33 Mr Newcomer informed Mr. Geiger that the next Board meeting would be Monday, December 1, 1980. 34. Mr. Geiger asked if he would be notified of the meeting 35 Mr Newcomer stated that a letter would be sent reminding him of the meeting date 36. Chairman asked if there were any additional comments I\ Ink Page 4 - Board of Adjustment Minutes of November 17, 1980 37 Mrs. Taylor explained that she was speaking neither for nor against Mr Geiger, but that some of the older parks in the area did allow the 18" side setback to permit the awnings and car- ports She pointed out that the Mesa Fire Chief had no problem with the smaller require- ment that some of the Mesa parks had 38. Mr Newcomer pointed out the memo from the Building Admin- istrator that was in the Board packets The memo stated that the travel trailers and rec- reational vehicles did not conform to the one- hour fire resistance rating as required by the Uniform Building Code, which the City had previously adopted 39 Mr Nesser added that since the UBC referred to fire hazards, that he assumed the Fire Chief also used it as a reference. He suggested that Mr Newcomer determine whether or not the Fire Chief was in agreement with the findings of the Building Administrator 40 Mr. Newcomer explained that he had made such a request to the Fire Chief approximately ten (10) days ago, -. - but had not received any response. 41 Mr Furness added that according to the UBC, the awnings and carports could not be placed on the travel trailers at the requested 18" apart. He explained that it couldn't be done, no matter what the input of the Fire Chief was 42. Mr Nesser suggested that they wait until the next meeting to determine what the opinion of the Fire Chief was 43. Mr Furness reminded the Board members that the Fire Chief represented the County and not the City 44. Chairman called for additional comments He then announced a five-minute recess to allow time for the members to review the "Minutes" from the previous meeting. 45. Chairman called the meeting to order at 7 40 P M and stated that he would entertain a motion on the "Minutes" from the meeting of November 3, 1980 46 Nesser/Vaughn M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction, Arizona, that the "Minutes" of the meeting of November 3, 1980 be approved as written " The motion passed 5-0 with Mr. Morrison abstaining since he had not attended the meeting in question 47 Chairman asked if there was any other business to be considered at this time. 48 Mr Newcomer informed the Board that he had met earlier in the day with a man who had purchased the Page 5 - Board of Adjustment Minutes of November 17, 1980 property that had been the subject of case BA-9-80 earlier in the year He explained that the original had never done anything with the property after being granted the variance. He added that the new owner was now having problems placing a mobile home on the prop- erty because of the Board's original resol- ution requiring that the CR-3 setbacks be complied with 49 Mr Nesser stated that he recalled the case and that the Board had inspected the property and had found the storage shed to be well-constructed, but had decided that it must be placed in com- pliance with the CR-3 requirements 50. Mr. Newcomer explained that it was not possible for the property owner to comply with the requirements. 51 Mr Nesser asked if it was necessary for the property owner to come before the Board or if the Board could change the wording in the original resolution. 52 Nesser/Furness M/S "BE IT RESOLVED by the Board of Adjustment of—the City of Apache Junction, Arizona, that the new owner of Lot #39 in the Hughes Place Subdivision be permitted to come before the Board to present his proposal for the place- ment of the storage shed on the lot." The motion passed 6-0 53 Mr. Newcomer added that the original variance ran with the property, not the owner, and that it also applied to the other such lots that were in that same subdivision. 54 Mr Vaughn requested copies of the "Minutes" from that particular meeting before the next meeting 55. The motion passed 6-0 with Mr Hudson and Mr Oltman abstaining since they had not attended the meeting in question 5 Chairman called the Commission's attention to the next item on the agenda which involved the State Statutues and asked the Executive Sec- retary to explain them to the members 6. Mr. Gero explained that the State Statutes outlined the requirements for a motion which included giving the reasons for such a motion He reminded the members that until such time that the official "Minutes" were drawn up, the tape of the meeting was the official record, and that the tape should contain the reasons for any motion that the Commission members might make He added that these reasons did not have to be in a proper form and that the Executive Secretary and Secretary would be able to put the proper legal wording in, if necessary 7. Mr Hudson stated that he had belonged to numerous boards and commissions, and that he had never before been required to present his reasons for a motion in writing, but that it had al- ways been the responsibility of the Secretary to put them into the "Minutes" He agreed that if the State Statutes required a full motion, in writing, that the City Boards and ikk Page 2 - Planning and Zoning Commission Minutes of November 18, 1980 Commissions should adhere to it and at enter the complete motion onto the tape He added that since the other boards and commissions he had served on did not always have the full motion, then they were in violation of the State Statutes 8. Chairman agreed that while the Commission preferred to keep its motions informal, it was also necessary to give reasons for these same motions and that, for obvious reasons, these full motions should be on the official tape. 9 Mr Hudson agreed that a formal motion was not always good because someone might want to make a change in the recommended motion 10. Mr Gero suggested that the Commission discuss the procedure they wanted to follow in the prep- aration of their motions with the Rules and Procedures Subcommittee which would soon be presenting their recommendations to the Commission He informed the members that the Subcommittee actions had been delayed until the City Clerk had completed his own work on the Handbook for the City Boards and Commis- ions. 11 Chairman pointed out the section in the State Statues ((( which called for the presentation of a written recommendation following the hearing He agreed that the law does not say that it had to be done "on the spot", but also pointed out that it was the advice of the City Attorney to get into the practice of writing out the reasons for the recommendation He added that the people were owed the reasons for the recommendation and should be able to know what they were without having to play the recording of the meeting. If clarification or additional information was necessary, then the tape and the written "Minutes" would be there He called for additional comments and recommen- ded that the matter be turned over to the sub- committee when they work on establishing the guidelines for the Commission. 12 Chairman There being no further discussion, he announced the opening of the public hearings and asked the Executive Secretary to brief the members on the first case, SUP-3-80 13 Mr Gero pointed out the letter from the applicant, Mr Wynn, in which he requested that the application be withdrawn 14 Chairman said that he would entertain a motion on case SUP-3-80 15 Oltman/Baker M/S "BE IT RESOLVED by the Planning and coning Commission of the City of Apache Junction, Arizona, that the application of Mr. Wynn, SUP-3-80, be withdrawn and removed from the agenda" The motion passed 8-0 II - Page 3 - Planning and Zoning Commission Minutes of November 18, 1980 16 Mr Gero pointed out the comments from the City Attorney that the application might be in jeopardy due to a question of the planning procedures and the right of the Commission to approve a Special Use Permit in the first place 17 Chairman announced the opening of the public hearing on case SUP-87-80 and asked the Executive Secretary to brief the Commission on the case. 18 Mr Gero explained that this was an application for a Special Use Permit submitted to Pinal County by Mr Junker for a small-batch cement plant located south of the City off Ironwood Drive. He added that this was strictly an advisory hearing requested by Pinal County, and was not a formal public hearing He reminded the Commission of an earlier re- quest for rezoning in that same area submit- ted by Howell Anderson This request was denied by Pinal County based on complaints that the requested industrial rezoning would allegedly deplete the water supply of the people living in the area and that the use would create a lot of dust. These complaints had been lodged by Mr and Mrs Womack and allegedly a son-in-law who had not appeared at the hear- ing This son-in-law was also the applicant at this time, Mr Junker 19. Chairman called on the applicant to present his case. 20 Mr Alexander announced that he was the attorney for Mr Junker and pointed out on the map where the property in question was located. " He ex- plained that it was a two-acre parcel and was the first privately owned land going west from Ironwood He explained that there was a difference in the rezoning as requested by Mr Anderson and the Special Use Permit requested by Mr. Junker. The Special Use Permit would not be for a large parcel of land as would a rezoning A time limit would also be imposed and would also be held to a specific use, while the rezoning to an industrial area would be open to a number of uses He further explained the previous problem with the water in that only one pump was in use and that the same pump would be used to supply water for three families as well as the industrial uses Mr Junker had since contacted a well driller and was in the process of trying to obtain his own water supply He added that sufficient groundwater was avail- able, but that a well would have to be drilled The Central Arizona Project canals going through the area would eventually isolate the area, keeping it apart from the development of Apache Junction He concluded by stating that Apache Junction was in need of industrial uses and that the City should look to other areas for these uses if the people did not want them within the actual City limits He added that the dust would not create a problem since the Junker land was the first Page 4 - Planning and Zoning Commission Minutes of November 18, 1980 land off Ironwood that was inhabited, that the trucks would not be passing any homes on Houston Road 21 Chairman thanked Mr Alexander and asked if there were any questions 22 Mrs Baker asked if a permit had been obtained from the State to drill the well that had been mentioned 23 Mr Alexander replied. "No". 24. Mrs. Baker asked if there was a problem in obtaining the permit. 25 Mr Alexander replied that there was a problem The owner of the drilling company did not anti- - cipate any problem, but he did himself 26. Mr. Hutchens asked why the batch plant had been in oper- ation without first requesting the special use permit or going through the rezoning process. 27 Mr Alexander replied that the applicant had offered goods for sale around September 1st and had been issued the Cease and Desist order on October 20th He added that the plant had not been in operation for a long period of time. 28 Mrs Taylor questioned the size of the operation and the amount of traffic that it would involve. 29. Mr. Junker replied that it was a small, portable plant, and would have 3 to 4 trucks. The area could not support a larger operation 30. Mrs. Taylor asked if the materials would be stockpiled or brought in as needed. 31. Mr Junker replied that the materials were brought in as needed, mixed and hauled out He added that there were no grinders or presses that could handle the raw materials. 32 Mrs Taylor asked if the trucks would be going past the schools and through Apache Junction. 33. Mr. Junker replied that the trucks would most likely use Ironwood Road and Apache Trail, depen- ding on their destination 34 Mrs Taylor asked if there was access to the property from the west 35 Mr. Junker explained that the road to the west was not used very often and was not in good condition 36 Mr. Gero asked what hours the plant would be in operation 37 Mr Junker explained that the hours would vary, being 6.00 AM until 12 00 PM during the winter, and 4.00 AM until 11 00 AM during the summer AO .•. Page 5 - Planning and Zoning Commission Minutes of November 18, 1980 38 Mr 0ltman asked if there was enough water available for fire purposes 39 Mr Junker replied that they were not given any fire pro- Amok tection since they were outside of the Fire Department jurisdiction He explained that there was one well to service 40 acres of land and three residential houses. During the summer there was a water problem when all three families were using the water for their plants and such. He added that one of the property owners, Mr. Haas, was supposed to build a three-stage water storage system, but that nothing had been done on it as yet 40 Mr Gero asked if Arizona Water had any intentions of extending their lines into the area. 41. Mr. Junker replied that he had been hearing rumors of such plans for the past eight years 42. Mr. Gero asked how many years of operation would be necessary for Mr Junker to get a return on his operation 43 Mr. Junker explained that it would be difficult to deter- mine since it was all based on economics 44. Mr. Gero asked if it was predictable that the plant would have to operate for several years before there { was a return on the investment 45 Mr Junker stated that the larger plants needed ten to twenty years to get a return on their invest- ment, but their initial investment was in the millions of dollars. 46 Mrs Taylor asked where the four mobile homes on the property got their water from. p 47 Mr Junker stated that there weren't any mobile homes on the property 48 Mr Hudson asked that if and when the new well was drilled, would there be three-phase electric also installed 49 Mr. Junker replied that Salt River Project had already been contacted and that the power would be put in within sixty days of notification 50 Mr Hutchens asked how the question of the Commission to grant a Special Use Permit in the first place might affect this case 51 Mr Gero explained that it might have bearing on the situation since a question was raised on the legislation involved in permitting such a hearing 52 Mr Alexander stated that the portion of the Zoning Ordinance referred to applied only to what the Commission can or cannot do and that in this case the burden of the decision fell on Pinal County with the City Commission only providing a rec- ommendation on the case to the County Page 6 - Planning and Zoning Commission Minutes of November 18, 1980 53 Mr Hutchens asked if the Commission could be deleted from that responsibility since the Section of the Zoning Ordinance was now under discussion. 54 Mr Gero explained that according to the State Statutes, only the City Council can legislate with regard to rezoning It was possible that that Section of the Ordinance was an improper delegation of powers and that this same thing might be applied to the County Planning and Zoning Commission since the original City Zoning Ordinance had been adopted from the County. 55 Mr Alexander stated that the actions of the legislative body in Pinal County did not apply with what was going on at this City hearing 56 Mr Gero contended that there was a relationship because if the Section of the Ordinance was void, then there was no basis for a special use permit 57 Mr Alexander disagreed with Mr. Gero, and added that the City was only acting as an advisor in this situation 58. Mrs. Taylor asked that since there was no comment from any of the adjoining property owners, could the City Commission make no recommendation and be consid- ered neutral 59. Mr. Gero stated that since this was not an advertised Il public hearing that none of the other property owners were notified of the meeting 60 Chairman called for other questions or comments 61 Mr Gero reminded the Commission that an industrial use for a number of years does establish the use and actually is a rezoning to the industrial classification The City Commission had rec- ommended the Anderson application to the County He added that the land in that area was not suited to residential and subdivision uses because of the subsidence of the land. He called attention to the fact that there might be a problem with obtaining a permit to drill the well because it was now necessary to obtain a certificate of assured water supply from the State. 62 Mr Alexander explained that the existing well was fine, but that the pump was inadequate He added that Mr Anderson had proposed to use holding tanks for the industrial water uses until such time that another well was drilled. 63. Mr Gero questioned how there could be enough water for the batch plant if it was already stated that water shortages occurred during some times of the year. 64 Mr Hudson asked who owned the well 65. Mr Junker explained that the well was on the property of a Mr Bruno who was the original owner of the forty acres that he had a part in purchasing. The con- tract for the purchase of the forty acres had also included telephone service, utilities, water, etc. Mr Bruno had not supplied them with these. ... ... Page 7 - Planning and Zoning Commission Minutes of November 18, 1980 66 Mr Hudson asked how deep and what size the well was 67. Mr. Junker explained that the well was 523' deep and 11" wide He added that while the well was on the /►. Bruno's property, the lines ran to his own prop- erty and that he had maintained the well himself for the past several years. He had made improve- ments on the well and constructed a 3,000 gallon storage tank 68. Chairman stated that this explanation clarified the issue as to why there was an objection to the Anderson request for rezoning to industrial 69 Mrs Baker asked if Mr Bruno was aware of the water use. 70 Mr Junker replied that he was, but that the individual people using the well were paying the charges. 71 Chairman called for additional questions or comments There being none, he called for a motion 72 Mrs Taylor commented that no matter what the recommendation, there was still a question as to whether or not the basis for it was legal 73. Chairman stated that that could be a part of the discussion after a motion had been made ( 74. Steelsmith/Baker M/S "BE IT RESOLVED by the Planning and Zoning Il >ommission of the City of Apache Junction, Arizona, that it recommend approval of Special Use Permit SUP-87-80 to the Pinal County Planning and Zoning Commission, with the following stipulations 1) That the permit be for the property owner only, and would become null and void if the use were to be abandoned or the property sold. 2) That the permit be granted on a yearly basis /► with the applicant required to request a re- newal, in writing, thirty days prior to the expiration of the permit 3) That the applicant comply with Section 1709 "Industrial Buffers" of the Pinal County Zoning Ordinance 4) That the applicant should have not more than four (4) mixer trucks 5) That the applicant comply with all County, State and Federal health and safety laws, including the Arizona State Air Quality control standards. 6) That the permit be issued pending approval of the well and complying with the State laws " 75 Mr Steelsmith explained that he felt this area was well-suited to industrial uses and that the City was in need of such industry 76 Chairman added that since the Superstition Freeway would be in the area that the land was well suited to industrial uses. 77 Mr Hudson agreed with the motion and added that the problems regarding the water should be the owners' respon- sibility and not the Commission 78 Mr Hutchens agreed with Mr Hudson, but questioned whether or not the Commission could make a recommendation. Amok Am, Page 8 - Planning and Zoning Commission Minutes of November 18, 1980 79 Mr Oltman stated that he was concerned about the fire hazards involved. 80 Mr Hudson added that any industrial use would have a Ark fire hazard 81. Chairman called for additional comments or questions. There being none, he called for a roll call vote. 82 Mr Gero called the roll for a vote on the motion The motion passed 8-0 83. Mr. Gero suggested that the Commission next discuss the Street Name Committee report since the parties involved might not be able to stay until the end of the meeting. 84 Chairman recommended that the next item for discussion be the Street Name Committee report, and asked it there were any objections. There being none, he asked Mr. Newcomer to present to report to the Commission 85 Mr Newcomer explained that the members of the Street Name Committee had met on three separate occasions to discuss the situation During these meetings, the committee had formulated several recommendations and suggested criteria for future street name situations in the City. 86. Chairman stated that the members of this committee should be commended for the work done 87 Mr Newcomer added that Clay Worst and Lorraine Krause of the local post office had been very helpful to the committee He explained that the committee had discussed the basic street name system, the problem of the dual Ask street names in Palm Springs, and establishing criteria for future street alignments 88 Mrs Taylor stated that the Commission should send letters to the members of the committee thanking them for the work done 89 Mr Newcomer added that the committee had recommended that the City adopt the ASAP policy guidelines 90 Chairman asked if the responsibility of naming streets would be that of the Commission or of the Public Works Department. 91. Mr. Gero explained that the Council was responsible for the adopting of street names, but that they would be looking to the Commission for recommendations 92. Chairman asked what the recommendations of the committee were 93 Mr Newcomer explained that the committee had recommended: 1) The adoption of the Uniform Address and Street Assignment Policy as used by the local Post Office 2) That the East-West alignments in the Palm Springs area maintain their original names, but be suffixed "Avenue" and prefixed "East" Page 9 - Planning and Zoning Commission Minutes of November 18, 1980 3) That E. 21st Avenue be changed to E Osage Avenue 4) That the "Address and Street Assignment Policy Manual", September 1979 edition, be ..w adopted as a policy guideline 5) Junction Drive be re-named Junction Street. 6) Meridian Road be re-named to Meridian Drive. 7) That the "Official Street Name Map of Apache Junction, Arizona", be adopted after all changes and editions have been made. 8) That future new street alignments be allowed to have the last names of the first and interim City Council members due to the historical significance 9) That it be recommended to the City Council the approval of the names shown on the Street Naming Map throughout the Northeast quadrant of the City so that the street signs could be ordered for the area It was noted that this map included two new alignments, Cones- toga Road and Chaparral Road 94 Mr Gero added that those people living on streets where a name change did occur would be given a one-year period in which to make the adjustment 95 Chairman thanked Mr Newcomer and the Committee members for the work and recommendations. 96 Mr Benson stated that he had learned a lot while working on the committee and that he had enjoyed it 97 Chairman stated that he would entertain a motion on the Committee's recommendations 98. The motion passed 8-0. 99 Chairman asked the Executive Secretary to brief the members on the next case, PZ-19-80. 100 Mr Gero explained that the next item was a request for a Commission Initiative on the rezoning of Section 32, which had not been rezoned since its annexation into the City He added that the concerned parties regarding the rezoning, in- cluding the State Land Department, the School District and Central Arizona College, had all been contacted and asked for an opinion on the proposed rezoning. He further explained that the State had a six- month time limit on establishing the zoning in a newly annexed area, and it was now up to the Commission to have an Initiative, advertise a public hearing and consider the rezoning as an agenda item. Mr. Hutchens asked if the closeness of the possible indus- trial zones would create junk yards by the high school and college 105 Mr. Gero reminded the Commission members that the Freeway, once completed, would be acting as a barrier. 106. Chairman asked if the CR-1 zone would be directly south of Southern Avenue. 107. Mr. Gero replied that the CR-1 zone would be between Southern Avenue and the proposed Freeway. 108. Mr Hudson pointed out that industry close to schools was often a good idea because of the interest in vocational education and additional classes He agreed that the suggested rezoning was a good idea. 109. Mr. Steelsmith added that the modulars must conform to the Uniform Building Code 127. Approximately 500 copies will be distributed throughout the community. We're still not getting the community involvement we anticipated, but it is continuing to grow. A program relating to drugs was given Wednesday to a Girl Scout troop by our department and the Police Department. Remember, coordination is done through the Community Service Department. This same prog mm was given to parents and scout leaders on Tuesday evening. Mailed out plenty of entry forms for the First Annual Lost Dutchman Days Basketball Tournament. Hoping for a good turn-out of teams from all over the state. A majority of the week we spent on ironing out some of the mino r details for the upcoming volleyball league and basketball tournament. We are getting great response and cooperation with the school district. We seemed to have an active group appointed to our Parks and Recreation Commission. They seemed to have plenty of ideas and suggestions. The kids are still coming in and signing up for the Youth Job Referral service. Unfortunately we need more employers. The Community continues to show interest in the Golden Age Softball League. Should be a success. Everyone must realize these programs aren't going to begin with full community involvement. Once you get one started, they will continue to grow.
