The regular meeting of the City Council of the City of Apache Junction,
Arizona, was held on December 17, 1980, at the Apache Junction Council Chambers

Mayor Seeman opened the meeting to the public There being no one wishing
to address the Council, the Mayor closed the meeting to the public.
CITY MANAGER'S REPORT
Mayor Seeman called upon the City Manager to give the City Manager's Report.
City Manager Ray Lee reported that the City has received donations from
local contractors for the City's Community Services building of plumbing materials,
electrical supplies, etc. He added this was in addition to employees donating
their time; the stem walls are up and it is staff's hope that the structure will
be completed within the next few months The in-house project will locally
house the community services personnel and offer the public whatever services
the City can.
PUBLIC HEARINGS
PROPOSED ORDINANCE NO. 74, PZ-18-80
DELETING SUB-SECTION 23 02 OF THE APACHE
JUNCTION ZONING ORDINANCE (WITH EMERGENCY CLAUSE)
Mayor Seeman opened the
public hearing on this item. She stated it is a Planning and Zoning initiative
and asked the Planning Director to brief the Council and public on the petition
City Planner Joe Gero �r
stated the reason for deleting this section is that the wording of the Ordinance
permits the Planning Commission to hold public hearings and determine whether
or not a special use might be permitted. He stated it anpears to be a tremendous
delegation of power by the City Council to the Commission that is beyond the
scope envisioned by the writers of the Arizona Revised Statutes The
statutes require that in order for a zone change to be created, the Council must,
by Ordinance, create that zone change He stated it anpears to be blatantly
unfair to offer a proposition to the general public that they might apply for
when, in fact, it appears to be an unlawful delegation of power. Mr Gero, stated
the Commission, and the Director of Planning have, therefore, unanimously voted
to recommend to the Council that this section of the zoning ordinance be removed.
Mayor Seeman asked if any
member of the public wished to speak in favor of, or in opnosition to, the petition.
There being no one wishing to address this item, Mayor Seeman closed the meeting
to the public
Mayor Seeman opened the meeting
for Council discussion.
Mayor Seeman noted that Vice
Mayor Granillo joined the Council at 7 10 p.m. Vice Mayor Granillo was then given
a brief outline of what had transpired in reference to this item prior to his
arrival.

PROPOSED ORDINANCE NO 78
AIRPORT COMMISSION MEMBERSHIP (FIRST READING)
) Mayor Seeman stated the proposed
/',, ordinance on the Airport Commission membership would have its first reading
and asked if there was any discussion
Mr. Forseberg, 269 N Winchester
Road, Apache Junction, an Airport Commission member, reviewed the recommendations
of the Commission, and their reasons for the recommendations.
Mayor Seeman stated this motion
would be voted on at the first meeting in January. The Mayor reminded the Council
that because the City Code states the Commission members shall be citizens of
the City of Apache Junction, a change within the City Code would be involved
She stated the City has committed itself financially to the planning process of
the Commission and that although she had no objection to extending the membership
to seven, she did question the need for having a non-city resident on the Board
She stated the individual the Commission wishes to place on the Commission is
presently an ex-officio member of the Commission and can make any recommendations
he chooses; his only problem is that he cannot vote She added she felt this
gentlemen should be retained as an ex-officio member.
Councilman Burgess stated he
would like to see the members of the Commissions be residents of Apache Junction
and that if an exception was to be made for one Commission, a Precedent would
be set for the other Commissions.
Vice Mayor Granillo concurred
with Councilman Burgess and Mayor Seeman

Councilman Hill addressed
the motion and stated the majority of people utilizing the Airport would be
from outside the City and, therefore, he did not think it would be harmful
to allow an outside individual a place on the Commission.
Councilman Damiano addressed
the possible location of the Airport and his feeling that an exception should
be made for this specific commission
Mayor Seeman stated her
concern is whether or not people from outside the City should be allowed to
vote on the expenditure of City funds
Vice Mayor Granillo agreed
with the Mayor.

City Planner who wished to address the item
Director of Planning Joe Gero
addressed the item, the need for approval of this resolution, and the importance
1._ of requesting that the Bureau of Census investigate and correct their population
count He then introduced Mr John Stancil of PRC Toups. Mr. Gero explained
that Mr Stancil was not hired to prepare a defense to the U.S. Census Bureau,
however, the information that he presented appeared to place the City in a
posture to challenge the census count for the City of Apache Junction !Al".
Gero further explained that the population baseline, which PRC Toups is believed
to have accurately projected, becomes the baseline from which the City makes all
of its projections for water, transportation, land use studies, and the City
Hall complex needs.
Mr John Stancil, represen-
tative of PRC Toups, stated the function of the report was not to help the
City substantiate their claim that an error was made in the census count;
their function was to do other studies for the City representing water, sewer,
land use, and the government complex, and in order to accurately project the
needs of the community it was necessary to establish and agree upon a popu-
lation baseline for future projections Mr Stancil then reviewed the report
for the Council and public to inform them how the results were arrived at
Joe Gero, Director of Planning,
pointed out that the numbers that Mr. Stancil has arrived at are similar to the
ones in the FORESIGHT 80 publication He pointed out that in 1979 the U S
Bureau of Census did perform a census count for Apache Junction's certification
of incorporation and came up with a population of 10,121. Mr. Gero stated that
in the report before the Council there are a number of indicators., i.e. increase
in school enrollment, increase in registered voters, etc., which seem to be
very conservative, but are defensible He stated that if the City challenges
the U.S. Census Bureau the key factor is to be defensible and to make sure that
the final figure for the City is at least 10,000 because if the population is
less than 10,000 the City is categorically left out of numerous grant programs.

As you will recall earlier this year, the City approved the annexation of
Section 32 which is the site which includes the High School , proposed new
Junior High School , and the proposed site for Central Arizona College.
The rest is State land property. As such, all the lands in Section 32 are
in the public ownership. Following annexation, it is the responsibility of
the City within a reasonable period of time to establish the zoning for
such areas. In consultation with Mr. Bill Wright, Apache Junction Schools,
he has indicated his preference for zoning of the north half which includes
the sites for the High School , Junior High and the proposed Community college
should be CR-i - Single Family Residence. Such a zoning district would
permit schools, churches, public parks and single family dwellings. The land
that is south of the proposed Superstition Freeway is State land and may be
the subject of a commercial grazing lease. Therefore, we would recommend that
this area be retained as General Rural for the interim time until appropriate
plans for the area can be developed.

Letter to Commissioner Fallini , Arizona Land Department, has been sent
with regard to this matter requesting his opinion.
The County zoning for all of Section 32 has been General Rural . The
Commission authorized this initiative during the November 18, 1980, meeting
— Mr. Roy Hudson indicated during the Commission hearing on December 9th, that
Dr. Everingham, President, Pinal County Community College District, did not
object to the proposed rezoning. Further, it is the District's desire that
the proposed site in Section 32, be their first choice for a campus although
it will be up to the State Board to make the final decision.

except for the school property. The proposed Superstition Freeway is
projected to be extended through the east-west mid-section line of Section
32. The proposed zoning CR-i would be to the north and GR to the south.
GR is a holding zone until development is proposed. CR-1 permits schools
among other uses.

RECOMMENDATION:
Following their advertised public hearing on December 9, 1980, the Planning
and Zoning Commission unamimously voted to recommend the proposed establish-
ment of zoning in Section 32 as set forth in Proposed Ordinance # 73. The
Amokreasons for the recommendation were:
1. The south half has been and should continue as General Rural (GR)
until a future time when planning of the area south of the proposed
freeway can be accomplished.
2. The north half should be CR-1, the district which reflects existing
and proposed educational uses.
The City has a statutory obligation to establish the zoning for annexed
territory. Retaining the County classification of GR in the south half until
development is proposed, is recommended. CR-1 in the north half allows schools.
With the existing and proposed school facilities, CR-1 in the north half is
therefore recommended.

ANALYSIS AND IMPLICATION-
The parcel is at the intersection of two Section-line roads which will
carry substantial traffic. There are a substantial number of mobile
home parks in the area, many of which have been developed for some years
and do not necessarily provide adequate storage areas. The Planned Develop-
ment is a specific proposal and would meet a demand in the area.

Please review the permitted uses of CB-1 and CB-2 to determine what might
be placed in such zones.
Alternatives-
In this case, the council has the following alternatives, (please feel
free to handle each separately until the final motion) :
1. Recommend approval .
2. Recommend denial .
3. Amend and recommend approval for several alternatives.
4. Other.
RECOMMENDATION:
Following the advertised public hearing on December 9, 1980, the Planning
and Zoning Commission unamimously voted to recommend to the City Council
the following:
Parcel # 1 - Approval of the proposed planned development with staff
stipulations.
Parcel # 2 - Amend the application from CB-2 to CB-1 and aprove.
- Parcel # 3 Approve CB-1
The reasons for approval are:
General
1. The properties are at the intersection of two arterials which,
when fully developed, will carry the generated traffic safety.

1. The Commission finds the applicant complies with Section 33.09
of the Zoning Ordinance.
2. Storage is needed in the vicinity particularly to service the
numerous mobile home and travel trailer parks in the area.

The reduction from CB-1 is warranted because:
1. Industrial uses in this area would be spot zoning in
terms of land use and therefore inappropriate.
2. CB-2 permits such uses as a bar, cocktail lounge, night
-- club or tavern which would be inappropriate for the area
as demonstrated by public comment during the public hear-
ing. CB-1 does not permit such uses.
Parcel #2 & 3
Commercial uses such as those permitted in CB-1 would provide
service to the local area and would be located at the intersection
of two arterial streets.
The staff concurs with the Commission recommendation; provided further
that the staff recommendations for the Planned Development be included
during the Planned Development final stage consideration.

No objection to rezoning request, however, when improvements are
designed:
>' 1 . Street improvements for frontage on Ironwood are required and
should be shown on plan.
2. Correction and consideration to information as provided on plan:
a. Total retention required shall be 14,708 cu. ft.
b. Maximum depth of retention area in Southwest corner
shall not exceed 3.5 feet in depth.
c. Further consideration should be given by the developer
to eliminate the ponding of water in the paved areas
as shown, for reasons of convenience to the users and
'`` maintenance. In order to obtain the average depth as
shown in the paved areas , asphalt berms would have to
be a minimum of 7 inches high.
d. Consideration should be given for drainage at the base

BACKGROUND: Applicant: Sumner Brooks
Area: 21,335 square feet (about 0.5 acres)
Current Zoning: General Rural (GR)
Proposed Zoning: CR-5 Multiple Family Residence
Advertised: November 23, 1980
The subject site has an existing duplex and single family dwelling upon
it. The parcel was previously 42 feet wider to the east. However, a .
portion of the lot was sold to the owner of the adjacent restaurant to
increase their lot size. The applicant indicates the area as 0.6 acres.
However, the City Engineer's review shows the applicant using the 33 feet
of the right-of-way (Scenic Street) as part of the lot area.
The subject site was recently purchased by the applicant.
A review of the Ordinance map will indicate other CR-5 parcels in the
affected area.

ANALYSIS AND IMPLICATION:
There are several implications which should be considered. They are:
1. The Zoning Ordinance permits one (1) multiple family dwelling
unit per 2,000 square feet of lot area. Approval of this
application would be a granting of a maximun of eleven (11 ) units on the
site, or eight (8) more than now exist; provided the other
provisions of the CR-5 district are met by the developer.
2. Such a size development would require a substantial area for
the septic system, thereby reducing the surface area.
3. Scenic Street is a quarter-section or collector street with a
sixty (60) feet right-of-way.
ALTERNATIVES:
In this case the Council has the following alternatives:
1. Recommend approval .
2. Recommend denial .
3. Table to allow the applicant, at the suggestion of the applicant,
to amend the application to a Planned Development.
4. Other.
Please include a statement of reasons for your motion.
RECOMMENDATION.
Following the advertised public hearing held on December 9, 1980, the
Planning and Zoning Commission voted unamimously to recommend to the
City Council the approval of proposed Ordinance No. 80. The reasons
for the recommendation are.
1. There are several contigious or near-by properties already zoned
CR-5 Multiple Family Residence, therefore, this would not be out
of character as an apartment project.
2. There is an adjacent commercial use which would be compatible
with multiple family uses.
3. Scenic Street, a quarter-section road, is classified a collector
and will be adequate when fully developed to carry the extra traffic
generated.
4. Such a project would add to the upgrading of the area.
Should the Council choose to approve this case, there are no requested
stipulations from staff.

SECTION I IN GENERAL
The zoning district classification on the Apache Junction, Arizona, Zoning
Map for the parcel of land described as:
The Northwest 1/4 of the Northeast 1/4 of the
Northwest 1/4 of the Southwest 1/4 of the North-
east 1/4 of Section 21, Township 1 North, Range
8 East, except the East forty-two (42') feet,
and the North 1/2 of the North 1/2 of the South-
west 1/4 of the Northeast 1/4 of the Northwest
1/4 of the Southwest 1/4 of the Northeast 1/4
of Section 21, Township 1 North, Range 8 East,

hereby repealed.

INITIATION OF ZONING ORDINANCE AMENDMENT - BY PETITION
AND CONSENT. Any person may initiate a zoning ordinance amendment
changing the zoning district boundaries within an area previously
zoned by filing with the City Clerk the proposed amendment, a petition
in favor of such change, and also the written consents of at least
51% of the owners, by number and by area, of all other properties
any part of which is within 300 feet of the proposed change. If the
petition is for a change of classification, there shall not be counted,
either in numbers or area, the owners of the land of the same or less
restrictive zoning classification as sought by the petitioners. Unless
the proposed change is an extension of an existing zoning district,
the extent and boundaries of the area proposed to be changed shall be
such as to constitute a"zoning district. In the event that the area

The Airport Commission, at its meeting of 1 December 1980, unanimously
voted approval to request a change of the City Code to increase the member-
ship from five (5) to seven (7) members. In addition, the Commission

providing residence is within ten (10) miles of the City limits, and
the member holds a current Arizona pilots license. It is further
recommended that Dr. J. Howard Downs, presently an ex-officio mem-

Sec. 2-8-8 Duties
The commission through the director of public works shall recommend
regulations and policy for the government, control and improvement
of the public parks of the City of Apache Junction. The commission
shall also recommend fees for the use of public park facilities
and recommend full time or seasonal employees as necessary for the
efficient management of the city parks and recreation program.

Section 2-9-1 Creation
An airport commission of the City of Apache Junction, Arizona is
hereby created.
Sec. 2-9-2 Membership and Terms of Office
A. The airport commission shall consist of five (5) members who
shall he appointed by the mayor and approved by the city council .
Ex officio members, without voting privileges, may be designated
by the mayor with approval of the city council . At least one
ex officio member may be designated from outside the city limits
of the municipality.
B. The appointments shall be for three (3) years each with the terms
of members so staggered that the terms of no more than two (2)
members shall expire in any one year. The initial appointments
of members shall be for two (2) members with terms beginning
upon their appointment and expiring March 1 , 1981 , two (2)
members with terms beginning upon their appointment and expiring
March 1 , 1982; one (1 ) member with a one year term beginning
upon his appointment and expiring March 1 , 1983. Thereafter,

they shall all serve for a term of three (3) years or until their
successors are duly appointed and qualified. Honorary members

Sec. 2-9-3 Salaries and Personal Expenses
The members of the City of Apache Junction airport commission shall
receive no salaries or other remuneration for their services in such
capacity, and shall not be entitled to personal expenses incurred
by them in the discharge of their official duties, except to the
extent and purposes and amount such expense is first authorized and
approved in advance by common council .
Sec. 2-9-4 Officers
The commission shall elect a chairman, vice chairman and secretary
from its members to serve for a period of one (1 ) year. The vice
chairman shall preside at meetings in the absence of the chairman.
Sec. 2-9-5 Rules of Procedure; Power and Duties
There is hereby vested in the City of Apache Junction airport
commission full power and authority for, and on behalf of the City
of Apache Junction, Arizona, to represent said city in any and all
negotiations with individuals, corporations, associations, govern-
- mental agencies, etc. , for the development and promotion of commerce
by air in the counties of Pinal and Maricopa and especially the
City of Apache Junction, Arizona. The director of public works
shall review all the commission' s recommendations and shall submit
his recommendations to the council . No contracts or other commitments
shall be deemed to have been entered into or made, except in compliance
with the provisions of article 3-7 of this code.
Sec. 2-9-6 Meetings
The commission shall establish a regular meeting day and time at least
once a month. Special meetings may be called as required. A quorum
shall consist of four (4) voting members for the transaction of all
business.

Sec. 2-9-7 Vacancies
Vacancies shall be filled in accordance with section 2'-9-2 by the city
council for the unexpired term of the member affected.
Sec. 2-9-8 Removal of Members
Members of the commission serve at the pleasure of the council and may
be removed by the mayor with the concurrence of the council . A member
shall not be absent from the airport commission's meetings for more
than three (3) consecutive times. After the absence of three (3)
consecutive meetings, the remaining members of the airport commission
shall vote to retain or recommend to the city council that the absentee
member be relieved of his duties on the commission.

AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE CITY
CODE AND ORDINANCE NO 37 SECTION 2-9-2A, 2-9-2B and 2-9-2C, REPEALING
ANY CONFLICTING PROVISIONS, AND PROVIDING FOR SEVERABILITY
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL AS FOLLOWS
/1% SECTION I. IN GENERAL
[- Section 2-9-2A shall be amended to read as follows.
"The Airport Commission shall consist of seven (7) official members who
shall be appointed by the mayor and approved by the City Council, one (1)
official member of the Commission may be designated from outside the
City limits, providing a current pilots license is held and residence is
within ten (10) miles of the City limits of the municipality Ex-officio
members, without voting privileges, may be designated by the mayor with
approval of the City Council One (1) ex-officio member may be de-
signated from outside the city limits of the municipality, providing

Section 2-9-2B shall be amended to read as follows*

Section 2-10-5 Duties
There is hereby vested in the City of Apache Junction Community
Health Commission the following duties
A. To hold public hearings to determine public health needs
B To insure the development of community health care for all
individuals with a minimum of interference from outside
services.
C To review and recommend to the City Council approval/disapproval of
any health care system originating outside the corporate
limits and operating within the corporate limits.
D To aid in the development of health facilities and to attempt
to locate and coordinate community needs with medical professionals
in desired fields
E To address methods of transportation and health care for the
elderly
F To present a hospital development plan to the responsible
agencies, coordinate with City staff to insure its proper
planning and zoning.

Due to an administrative oversight, the State failed to include the
inspection of blocking for mobile hare setups in the previous inter- '•
governmental agreement entered into by Resolution 80-15.
Since both the State and the City desire that we make these inspections

Council amend the agreement to inclwle the blocking of mobile homes.

WHEREAS, the State of Arizona and the City desire to amend said
agreement by authorizing the City to enforce the provisions of Rules and

ARTICLE II. INSTALLATION STANDARDS AND CODES
R4-34-201. Mobile Home Installations and Codes
A. Mobile homes manufactured after July 31, 1977 shall be installed according to the manufacturer's
instructions in the Mobile Home Consumer Manual provided pursuant to the act.
B. The minimum standards for the installation of mobile homes are as follows:
1. Load bearing support: Prefabricated and permanent
a. Supports shall be located under the main beams of the chassis at intervals no greater than six
feet and no more than two feet from either end of each main beam. When intervals no greater than six
feet cannot be complied with due to running gear, supports shall be located as close as practical to the
running gear and the remainder of the supports shall conform to the six and two feet requirements.
b. Supports shall bear no greater load than 8,000 pounds.
c. The supports shall have a minimum vertical concentrated load failure rating of 14,000 pounds.
2. Prefabricated support heights
a. No more than twenty—five percent of the supports along the main beams of the chassis, including
footing, shall be in excess of 36 inches or less than 12 inches.
b. The ;;inimum height of the bottom of the floor joist shall be 18 inches above a soil base unless
otherwise specified by the manufacturer.
4. Footings
a. Prefabricated footings
i. Each footing shall be of such design and construction to withstand the transferred load from the
load bearing support to the earth.
ii. Footings shall be placed only on surfaces adequately prepared to distribute equalized transfer of
applied loads and to minimize settling of the footings.
' iii. The minimum size of each footing shall be compatible with the local soil conditions to minimize
settling of the unit.
5. Wedges
a. Wedges may be placed only between the load bearing supports and main beams of the chassis.
b. Wedges shall be capabable of transfer of the applied load.
c. Wedges shall be limited to two on any one bearing support.

OF APACHE JUNCTION, PINAL COUNTY, ARIZONA, FINDING AND
DECLARING THAT SAID MAYOR AND SELECT COUNCIL DEEM THAT

deem that the establishment of staggered terms for the members of the City
Council, in the manner described in A R S 9-232 02, would be beneficial to
the citizens of the City of Apache Junction.

PRIMARY AND GENERAL ELECTION
In accordance with the Arizona Revised Statutes, the attached Resolution
is submitted for your adoption. Resolution 80-42, which was carefully
reviewed by the Attorney staff for the protection of all concerned,
provides for the holding of the Primary and General Election, Election
Officials and their compensation, and a change in the polling places.
Since no City facilities were available at the last election, the
Fire Station was used as a polling place. The now existing City Complex
is a convenient and logical place to use as one polling place. There-
fore, it is respectfully requested that you adopt the attached Resolution
in order that approval may be requested from the U.S. Attorney General 's
office for a change in polling places.

OF THE REGULAR PRIMARY ELECTION ON MARCH 24, 1981, AND

WHEREAS, it is provided by law for the holding of a Primary and
General Election, and
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City
of Apache Junction, as follows
Section 1 Designation of Election Date
That the City Primary Election be held and conducted on Tuesday,
March 24, 1981 and that the City General Election be held and conducted on
May 19, 1981
Section 2 Polling Places and Voting Districts
That County precincts will be used and that voters residing in
Pinal County Precinct 22A and Maricopa County Precinct Apache shall vote at
City Hall, 1001 North Idaho Road, and voters residing in Pinal Precinct 22B
shall vote at Superstition Mountain School at Ironwood and Broadway.
The polls shall be open on said date of Primary and General Elections
( from 6.00 a.m. until 7 00 p.m.

and it is hereby exempt from the referendum provision of the Constitution and

SUBJECT: Council Request of City Council Meeting
of October 1, 1980
At its meeting of October 1, 1980 the City Council
directed staff to investigate the needs and to determine
whether there are methods whereby the zoning procedures
might be made more responsive to citizens ' needs with regard
to the use of "grandfathered" rights, said report to be due
no later than January 7, 1980. The City Council further
directed that the report include, but not necessarily be
limited to, a consideration of the Apache Junction Zoning
Ordinance, Article 3, Article 23, Article 24, Article 25,
and Article 26.
This Memorandum responds to that Council request.
It is our understanding that this Council request
rises out of the cost, time delay and inconvenience of
making an application to the Board of Adjustments for
variances where it appears that homeowners in some areas of
the City of Apache Junction wish to add to or alter their
structure/home, but where such addition would not meet set
back requirements of the City, thereby requiring a variance
from the Board of Adjustments.
Section 9-462. 06 provides the statutory authority
for and jurisdiction of the Board of Adjustments. That
statute basically provides that
(1) the Board of Adjustments shall be established by
the City Council,

( 2) the City Council may, by ordinance delegate to a
hearing officer the authority to hear and decide on matters
within the jurisdiction of the Board of Adjustments,
(3) the Board of Adjustments shall hear and decide
appeals from the decisions from the Zoning Administrator,
( 4 ) the Board of Adjustments shall hear and decide
variances if, because of special circumstances applicable to
the property, including its size, shape, topography,
location or surrounding district application of the zoning
ordinance will deprive such property of privileges enjoined
by the property of the same classification in the same
zoning district. The Board of Adjustment may set certain
conditions on the variance.
Pursuant to ARS 09-462. 06, the City of Apache
Junction adopted Apache Junction Zoning Code Section 2403,
setting forth the authority of the Board of Adjustment
within the parameters of the Arizona statute. Section 2403
carefully sets forth the powers and duties of the Board of
Adjustments.
The staff has concluded that the following
alternatives regarding simplifying the procedures for
application for some variances or eliminating the necessity -- +�
for the application for the variance might be considered :
(A) The City could adopt an ordinance pursuant to ARS
§9-462. 06 (A) whereby the City Council may delegate to a
zoning hearing officer the authority to hear and decide on
matters within the jurisdiction of the Board of Adjustments.
There would remain a right of appeal from the decision of
the zoning hearing officer to the Board of Adjustments. Any
such ordinance would have to carefully delineate the matters
which the hearing officer could hear.
The major problem with this procedure is that it would
appear that even a procedure before a zoning hearing officer
would be required to go through the public notice and
hearing process which would not resolve the time consuming
aspects of variance application, it is our opinion that the
City Council cannot eliminate the requirement of notice and
hearing . The legislative body could, if it wished,

eliminate the fee which is required for an application to the
Board of Adjustments , but that fee generally offsets the cost
of publication of notice and part of the administrative costs .
(B) The Zoning Administrator/Building Official could
interpret Apache Junction Zoning Ordinance Section 304 more
expansively. Section 304 provides as follows :
"The provisions of this ordinance shall not affect
existing uses of property or the right to its continued
use or the reasonable repair or alteration thereof for
the purpose for which used at the time this Ordinance be-
comes effective, or for any other use of the same or a more
restrictive classification . . "
In other words , a person could reasonably alter and
add to his structure if it had previously been "grandfathered" in.
The Zoning Administrator has already begun to more liberally
construe Section 304 in order to minimize unnecessary hardships .
However, guidelines should be developed and adopted by the City
Council. We suggest an amendment to Section 304 such as the following :
(1) In any rural or residential zone where a lot contains
a structure which is a lawful non-conforming use under
the ordinance and other applicable codes , but which
structure does not meet current minimum set-back require-
ments , the minimum front, rear and side set-back require-
ments shall not be less than the set-back of that portion
of the structure which, on July 1, 1979 , was the least
distance from the point from which set-backs are normally
measured, or

(2) For lots of record on July 1 , 1979 , in any
rural or residential zone where a lot is near
lots having existing front , side and rear yards
with set-backs less than the minimum required by
this Ordinance , the minimum front, side and rear yards
on said lot shall be not less than the average of
the existing front , side and rear yards on the
nearest developed lot or lots within 660 feet . If
only one of the lots is built upon, the minimum
setback shall be an average of such front , rear or side yard
set-backs of the nearest developed lot and the minimum
front, side and rear yard of the zone , provided no such
front or rear yard shall be less than ten feet and no
side yard shall be less than three feet . "
The above amendment would create automatic
exceptions to minimum set-back requirements of the Zoning
Ordinance in certain cases .
(C) The fee for applying for a variance from the Board
of Adjustment could be waived. This would not , however, eliminate
the time delays of applying for a variance In addition, since
notice and hearing would still be required the matter would still
have to be published and the City would be subsidizing the applicant .
It is estimated that the variance application fee generally covers
cost of publication and some of the administrative costs
(D) The Planning and Zoning Commission could, on its
own initiative, change the zoning in areas of Apache
,.. Junction where it is appropriate , such as where there is a
common thread of development activity and where, although
zoned GR, it is apparent that a residential zoning classification
is now more appropriate .
Staff recommends that alternatives (B) and (D) be
given serious consideration

SUBJECT: REPORT ON GRANDFATHERED ZONING RIGHTS
I have read the memorandum of December 22, 1980 on this matter and made
comments. However, I believe several points should be amplified.
Consider that in most families the major financial committment is in the
purchase of a residence. Residential properties have a very high value
and, consequently, property owners have a substantial monetary and emotional
attachment to their properties. One of the goals of zoning is to protect
purchased property rights.
However, the action of a Planning and Zoning Commission, Board of Adjust- •
ment or City Council may substantially affect the financial investment
made by a property purchaser. The closer other properties are to the
property having a proposed change may intensify the effect, and the effect
may affect the property values negatively, positively or further solidify
the status quo.
The State Statutes require all properties to be handled equally so that
discrimination does not occur. Because the impact may be substantial and
harmful in some circumstances, certain requirements for notice, inquiry,
and opportunity for comment have been developed.
This community has unique land use questions. In resolving how to best
respond to citizen needs, the solution must not forget protection of prop-
erty investment. Therefore, any solution must be carefully considered.
Should the Council recommend amendments to the Zoning Ordinance, I would
request the staff be given discretion to review the words beyond those in the
memorandum.
With regard to eliminating fees, I doubt the City has ever received more money
in the application fees than their cost of processing the application. Please
note the following cost items for an application:

2. Mailed certified letter (minimum $1.45 per letter) .
3. Staff review time (field and office) .
4. Overhead cost (utilities, space) .
5. Printing of materials.
6. Administrative cost (file preparation, notice preparation,
bookkeeping, etc. ) .
Many cities are having to recognize that budgeting requires user fees be
paid. If the City charged the applicant the actual cost, the application
fee would be substantially more than the current amount.
CONCLUSION:
The Department of Planning therefore recommends that the concepts of (B)
and (D) be given consideration, but that the staff be given direction to
develop the actual wording of any proposals.

As you may be aware, a number of issues have come to light with the implemen-
tation of the new Groundwater Legislation enacted in 1980. For example, in
our City currently, the City Council cannot approve subdivisions because to
do so would be a violation of the legislation.
Certain members of City committees and staff have been concerned over the
issue. We believe that there would be some amendment legislation in the
next State Legislature session. To provide an opportunity to discuss the
issue, the Planning and Zoning Commission has invited Senator Stan Turley
to the next regular meeting. At this time, Senator Turley has accepted.
The meeting is scheduled for 7:00 P.M. on Tuesday, January 13, 1981 in the
Council Chambers. This issue is of the utmost importance to this City and,
therefore, I would urge each member of the City Council to attend and meet
with Senator Turley.
