VOTE In favor - Councilman Damiano Councilman Eidson Councilman Hill Councilman Shanks Vice Mayor Granillo Mayor Seeman Abstain - Councilman Burgess The motion carried AWARDS, PRESENTATIONS, AND COMMUNICATIONS Mayor Seeman presented a placque in memoriam of Donald Nesser to Mrs Nesser in recognition and gratitude for meritorious and unselfish service to the City of Apache Junction in his capacity as Vice Chairman of the Board of Adjustment. He was further recognized for his constant efforts to enhance the concepts of the board. The mayor also presented a certificate to the family of Donald Nesser expressing the regret of the City over the death of Mr. Nesser Y) T Mayor Seeman stated that since the budget has been tentatively adopted she would like the Director of Public Works to investigate whether or not the City would be able to provide regular maintenance and checkups such as oil changes to the senior services van provided by Catholic Community Services. The Mayor 11 stated this van provides valuable services to the senior citizens of Apache Junction. "Stre—staTeTtattisae=rziamedacxs is not requesting funds, but instead, is requesting mechanical services for the van The Mayor stated they are asking each City and Town in Pinal and Gila Counties who utilize the vans 41/ to maintain the van, with parts for repair to be provided by Catholic Community Services. CALL TO THE PUBLIC Mrs Lois Broman, Chairman of the Parks and Recreation Commission, presented a check in the amount of $488 51 to the City Council for the Swimming Pool Fund. Mrs. Broman stated this money resulted from the Annual Baby Debut and Open Horse Show. Mayor Seeman requested that the total money in the swimming pool fund be made available prior to the next meeting of the City Council Mr. Boyd Richardson, 4955 W Golden Lane, Glendale, Arizona, addressed the Council and gave background and information on Apollo Communications Systems, a cable television company. He provided an overview of the services provided by his company and requested the opportunity to present a specific proposal for Apache Junction CITY MANAGER'S REPORT City Manager Ray Lee called upon the Director of Planning Joe Gero. Director of Planning Joe Gero explained the color coding of the aerial photograph of the City He stated certain boundaries have been indicated through the color-coding REGULAR MEETING OF THE CITY COUNCIL MAY 6, 1981 PAGE TWO Aft. The language of the section is confusing and vague. It appears to invite an individual during the first 180 days from adoption of the Ordinance to establish on his own initiative a possible non-conforming use, If so, this is contrary to state legislation requiring City Council to act by ordinance after recommendation of the Planning and Zoning Commission, and requiring procedural requirement for the advertisement and public hearing are met. Non-conforming uses are taken care of in the Section 300 series of the Zoning Ordinance. Additionally, only one former land owner has utilized this provision prior to the expiration of the 180 day requirement and now finds himself in a difficult situation with regard to his land due to the provision, The Board cannot act to rescind its order without the City Council first repealing the provision. The property to the north is zoned Trailer Homesite and N. Warner Drive terminates at the northerly property line of the subject property. All other zoning in the vicinity is General Rural . The subject property has access along a thirty (30) foot easement running along the north side of the lots with access from N. Warner Drive There is other Trailer Homesite zoning in the vicinity including the property to the south (Golden Days Leisure Park) . There is a substantially built home toward the ( front of the property. Applicant's parcel has a net area of 25,380 square feet and a length of 188 feet. Approval of the rezoning would allow the property to contain three (3) mobile home units, subject to site plan approval . Within 300 feet (the "affected" area) , there are thirteen (13) owners, eleven (11) being General Rural and therefore "affected". The petition contains the signature of 8 of the 11 or 72%, and represents approximately 60%+ of the area. *". The Department of Public Safety, including the Fire Department, have no objec- tions to the rezoning. The Department of Public Works has raised the question of, if the rezoning is approved and the applicant creates a lot split, where will the access be and by what means? (a) Appliances, devices, equipment or other apparatus not regularly classed as plumbing fixtures, which are equipped with pumps, drips or drainage outlets, may be drained by indirect waste pipes discharging into an approved type open receptor (b) When the condensate waste from air conditioning coils dis- charges by direct connection, to a lavatory tailpiece or to an approved accessible inlet on a bathtub overflow, the connection shall be located in the area controlled by the same person con- trolling the air conditioned space. (c) Except as provided in subsection (c) (1), no domestic dish- washing machine shall be directly connected to a drainage system or food waste disposer without the use of an approved dishwasher air-gap fitting on the discharge side of the dishwashing machine. Listed airgaps shall be installed with the flood level (FL) mark- ^ ing at or above the flood level of the sink or drainboard, which- ever is higher. (1) Direct connection may be made providing the drain is looped up and securely fastened to the underside of the counter- top and provided the dishwasher is also equipped with a vacuum breaker on the inlet side of the water supply connection. SECTION II REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provi- sions of this ordinance or any part of the code adopted herein by reference, are hereby repealed. The new Legislation is currently having an effect on the City of Apache Junction in that minimum water requirements to provide assur- ances for a 100 year water supply cannot be met by private utilities, under existing conditions. To alleviate the situation, the private water companies (Arizona Water and Palm Springs Water) must first enter into unconditional contracts for water from the Central Arizona Project in order to be granted an allocation. Any private water company which might fail to sign the contract may mean that allocation of water would be surrendered and could be allo- cated elsewhere. Once reallocated, there would be no taking back of the allocation unless someone else would surrender their allocation which is extremely unlikely. To protect the public interest, and the intent of land owners in Apache Junction, the attached resolution has been prepared. The purpose is to go on official record stating the intent of the City to pursue the water allocation, only when either private water company should choose not to sign the contracts and thereby jeopardize the water supply for the City of Apache Junction. Chairman announced that the next item on the agenda was the public hearing on case BA-2-81, a variance application /0‘ submitted by William and Marjorie Duxbury 6 Mr Newcomer located the parcel in question on the map and ex- plained that the applicant was seeking a variance to place a second mobile home in an area zoned General Rural (GR). He further explained that the applicant had purchased the lots separately as part of an illegal lot split He referred the members to Section 2309 of the Zoning Ordinance which referred to "lots of record" or those lots which were split prior to enactment of the Zoning Ordinance He added that the lot split occurred in 1976, after Pinal County had adopted the current Zoning Ordinance 7 Chairman requested that Mr Newcomer read Section 2309 aloud, and then called on the applicant to present his case. 8 Mr Duxbury explained that his property (located at the inter- section of N Starr Road and E Cody Street) had been purchased with the understanding that he could have a dwelling on each of the lots He added that he had started to purchase the land in 1972 and had finished paying for it in 1976 He pointed out that Pinal County had been taxing him on each parcel and had never informed him that it was an illegal split 9 Chairman asked from whom he had purchased the property f Page 2 - Board of Adjustment Minutes of March 2, 1981 10 Mr. Duxbury explained that he had bought the land from Mrs. Doolittle and her sister 11 Chairman asked him if he was aware at that time that lot __ splits were not legal. 12 Mr Duxbury replied that everyone was doing it and that other land in the area had been split the same way. 13 Chairman asked when the contract was first signed 14 Mr Duxbury replied that he started paying for the land in 1971, but that the contract was not completed until 1976 15. Mr. Furness asked if any of the adjoining 14 acre parcels had also been lot splits 16 Mr Duxbury replied that there were several others in the area 17 Mr Nunn asked if he was aware that he was purchasing a split lot 18 Mr Duxbury replied that he was aware of it and that the County had been taxing him on each of the parcels 19. Mr Furness asked if the lot split had been recorded 20 Mr Duxbury pointed out that they had been given copies of the deeds in the packets t 21 Mr Newcomer explained that it was the responsibility of the County Planning and Zoning Commission to enforce the zoning regulations and not the County Assessor 22 Mr Morrison stated that he did not feel that Mr Duxbury should be penalized now for something that should have been cleared up years ago, especially since he had been paying taxes on both parcels for all the years. 23 Mr Newcomer added that several other parcels in the area had also been split into lots of 625 acres each He pointed out that any of these which had occured after 1974 were considered to be illegal. 24 Mr Nunn asked how many of these lots had homes on them 25 Mr Newcomer explained that there were mobile homes located to both the north and to the south 26 Mr Nunn questioned whether or not the Board would have the right to deny Mr Duxbury his rights since others had set the precedent even though it was illegally done. He asked Mr Duxbury if the unit on the second parcel would be a rental or a residence. 27 Mr Duxbury explained that he was going to put a double-wide mobile home'on the one parcel and use the other mobile for guests. He added that he had not been aware of the illegal lot split until last Spring when he was issued a citation by the City Building Official Page 3 - Board of Adjustment Minutes of March 2, 1981 28 Chairman explained that if a non-conforming use had been established for the property prior to adoption of the Zoning Ordinance, the property must be used for that same purpose within a twelve-month period or the use would no longer be considered valid 29 Mr Duxbury explained that he thought he would come under the "grandfather" rights. He added that he did not know otherwise until the past Spring 30 Chairman asked if there was anyone who would like to speak either for or against the variance request 31 Mrs Bolin stated that Mr Duxbury should be permitted to use his property in the same way as everyone else and that his second mobile home would not be located very near to the neighboring properties. 32 Mr Baker explained that many lots were already split and that more would have to be split in order for there to be progress. He added that it would be better to have a structure on the lot rather than brush and trees, and that allowing the variance would be of benefit to the community 33 Mrs Taig stated that even though her lot had not been split, she saw no reason not to allow Mr Duxbury to use the second 5/8 acre for another dwelling She added that it seemed the sensible thing to do since it conformed with the rest of the area { 34 Chairman called for other questions or comments There being none, he called for a recommendation from the staff 35 Mr Newcomer pointed out that the Zoning Administrator had issued a memo on the variance which stated that the lots had been split in violation of the County Zoning Ordinance and that the granting of the application was not within the powers of the Board. 36 Chairman at the request of the Board members, closed the public hearing for five minutes in order to allow discussion of the application. 37 Mr Nesser stated that he considered the case viable since there was hardship involved 38. Mr. Nunn agreed that the Board should not deny the application since he had purchased the property in good faith and that he was not responsible for the County's failure to enforce the Zoning Ordinance 39. Chairman agreed that Mr Duxbury was a victim of circum- stances and that it was not his fault that the property had been recorded without providing him the full infor- mation as to the regulations 40 Mr Nunn asked if there were separate deeds on the property 41 Mr Newcomer explained that there were separate deeds with one mobile home already on the property. 42. Mr Nunn suggested that they allow the variance but with the restriction that if ever sold, it must be sold as one lot and under one deed. Page 4 - Board of Adjustment Minutes of March 2, 1981 43 Chairman stated that he did not know if the Board could set such a restriction 44 Mr Newcomer added that the Board could set the condition that the split would be removed and the lot rejoined if sold. 45 Mr Morrison pointed out that he had been paying taxes on two lots and that it would not be fair to rejoin the lots now 46 Mr Nunn pointed out that taxes would be lower on one piece of property. 47. She pointed out that she adjoined the property to the rear 17 Mr Kell asked if Pinal County had permitted smaller lot splits since others in the area already had the same thing ( 18 Mr Newcomer replied that the County had apparently permitted ft lot splits up until a set period of time 19 Chairman called for additional comments Ther being none, he called for a motion 20 Taylor/Baker M/S "BE IT RESOLVED by the Planning and Zoning Commission of the City of Apache Junction, Arizona, that approval of case PZ-3-81 (Proposed Ordinance No 89) be recommended to the City Council for the reasons that the parcel is small and the requested change is compatible with the existing land use and development patterns, housing trends and choice in the area is towards mobile homes on smaller lots, and the request does not constitute "spot zoning" because of the already existing zoning and nature of the neighborhood " The motion passed 5-0 21. Mrs. Taylor pointed out that it would be necessary for the applicant to comply with the requirements of the Trailer Homesite zoning district. 22 Chairman reminded the applicant that this was only a recom- mendation to the City Council. 23 Mr Newcomer added that the first reading by the Council would be on May'6, 1981 and the second reading and public hearing would be on May 20, 1981 He pointed out that these arrangements were being made at the request of the applicant. 24 Chairman announced that the next case was PZ-5-81 25. Mr. Newcomer located the subject property on the map and added that the requirements for area and number consent from affected property owners had been met He pointed out that four units could also be placed on these lots if the zoning was approved. r Page 3 - Planning and Zoning Commisison Minutes of April 23, 1981 26 Mr McLaughlin explained that he had five acres and that he wished his wife to have one of the lots and her sister to have the other He added that the splitting of the property would reduce his tax bills 27 Mrs Taylor asked if he intended to divide the property into four lots 28 Mr McLaughlin said that he had considered it, but that a survey showed him that it would not be possible 29 Mrs Taylor asked if he lived in the house that was on the property and if he also owned the travel trailer that was located there 30 Mr McLaughlin explained that he lived in the house and that he kept the travel trailer there for guests to stay in 31 Mrs Taylor reminded him that the requirements called for only one unit per lot the same as with mobile homes 32 Chairman called for other questions or comments 33 Mr McLaughlin asked if it was necessary for him to attend the Council meeting since he wanted to visit some relatives in another state 34. Chairman explained that it was not essential, but that it would be to his benefit to attend the hearing in case the Council members had questions regarding the rezoning request. He then called for additional comments either for or against the rezoning. 35 Mr Newcomer pointed out that these was a memo from the Public Works Department in the packet which pointed out that a cul-de-sac would be required for roadway purposes He suggested that the applicant discuss this with the City Engineer 36. Mr. Kell asked if this was done in accordance with the rezoning or at the time of development 37 Mr Newcomer explained that it was done at the time of the actual development 38 Mr Steelsmith added that the rezoning was subject to site plan approval. 39 Chairman there being no further comments, called for a motion. 40 Baker/Steelsmith M/S "BE IT RESOLVED by the Planning and Zoning Commission of the City of Apache Junction, Arizona, that rezoning case PZ-5-81 (Proposed Ordinance No 91) be recommended for approval to the City Council for the reasons as follows (1) the parcel of land is small and the requested rezoning is compatible with the existing neighborhood land uses and patterns of development, (2) housing trends in the area have been towards mobile homes on smaller lots, and (3) approval of the request would not constitute "spot zoning" due to the present nature and zoning of the neighborhood The motion passed 5-0 41 Chairman requested the Acting Executive Secretary to brief the Commission on the next case, PZ-7-81 .�. 9016. Page 4 - Planning and Zoning Commission Minutes of April 23, 1981 42 Mr. Newcomer located the property in question on the map and pointed out that the applicant had met the require- ments of both number and area consent of the affected property owners He added that the parcel already had a single family home and a mobile home located oink on it 43 Chairman called on the applicant to present his case 44 Mr Davis explained that the parcel of land was too large for himself to properly maintain and keep free of weeds. He added that the house already on the lot was his and that the mobile home was his brother's He explained that his brother had helped him build the house and that he wished to give his brother the second parcel for his own use 45. Mrs. Taylor asked why there was a real estate sign on the house. 46 Mr Davis - explained that the house would only be sold if the price was acceptable, but that he really wasn't pushing to sell it 47 Chairman pointed out that conventionally-built houses were permitted in the TH zone, so if the property was rezoned there would be no problem with conforming 48 Mrs Taylor asked what size the two lots would be 49. Mr. Davis pointed out on the map that one parcel would be ( 78' wide x 165' deep and that the other would be 112' wide by 165' deep. Il 50 Mr Kell asked if he was correct in assuming that the house would be on one of the lots and the existing mobile home on the other, and that the second lot would be sold to the brother 51 Mr Davis replied that he was correct ''s'` 52 Mr Kell asked if there was going to be another mobile home on the lot. 53 Mr. Davis replied "no " 54 Mr Kell asked if there would be access to both lots 55 Mr Newcomer explained that there would be access from Coyote Street 56 Mrs Taylor asked if it was necessary to require sketches for site plans 57 Mr Newcomer replied that it was not for the Commission to re- quire the applicant to submit site plans. 58 Mr Steelsmith added that the rezoning would be subject to site plan approval as in the previous case 59 Chairman called for additional comments. There being none, he called for a motion 60. He added that the proposed amend- ment would remove the stipulation that Planned Developments could only be done in an existing sub- division by the petition and consent method and would permit them to be done by Commission Initiative 64 Chairman called for comments either for or against There being none, he opened the floor for discussion 65 Chairman pointed out that when Palm Springs had applied for the recent rezoning by Planned Development, the Zoning Ordinance did not allow it to be done by the Commission Initiative process 66 Mr Newcomer explained that only subsection (lc) would change in Section 33 10 to allow for the Commission Initiative method of rezoning for Planned Development in the already existing subdivisions 0141 67 Mr Steelsmith asked if it would be legal to make this change since it may have been the intention of the original ordinance to omit the option of the Commission Ini- tiative in regard to Planned Developments to existing subdivisions. 68. Mr. Kell agreed that perhaps that option had been omitted in order to make sure that all of the affected property owners would receive notification of the proposed changes He asked if the owners would still receive notification of the change. 69 Mr. Newcomer explained that the property owners would still be notified of the proposed change, but that their consent on a petition would not be required They would still be able to attend the public hearing and make their views known 70 Chairman pointed otit that the petition and consent method was fine for an individual applicant, but that the Com- mission Initiative method was better for large areas with multiple owners 71 Mr Steelsmith agreed that the option of the Commission Initiative should be available when it is for the good of the community. Page 6 - Planning and Zoning Commission Minutes of April 23, 1981 72 Mrs Taylor asked how many people in Palm Springs were members of the Home Owner's Association and how many of the others would be affected by the proposal 73 Chairman pointed out that prior to the public hearing, all of the property owners in the affected area plus all those within a 300' radius would be notified of the hearing and given a chance to speak on the matter 74 Mrs Taylor asked if it would be up to the home owners or the City to enforce the zoning if passed 75. Chairman explained that the burden of enforcing the zoning regulations would be passed on to the City 76 Mr Kell suggested that they,get back to the original item since the ordinance would apply to all subdivisions, not only Palm Springs 77. Chairman called for additional comments or questions There being none, he called for a motion 78 Kell/Steelsmith M/S "BE IT RESOLVED by the Planning and Zoning Com- mission of the City of Apache Junction, Arizona, that case PZ-8-81 (Proposed Ordinance No 95) be recom- mended to the City Council for approval for the reason that it was the intent of the Zoning Ordinance to include this choice of Commission Initiative as part of the Planned Development process for pre- existing subdivisions Further, it is recommended that the Ordinance be approved with the emergency clause " The motion passed 5-0. 79 Chairman announced that the next item on the agenda was the naming of a street located near the Kubler Mortuary He requested the Acting Executive Sec- retary brief the members on the case. OIS 80 Mr Newcomer explained that the street was adjacent to the Kubler Mortuary and west of Winchester Road He pointed out that the names of "Outpost", "Stetson" and "Red Rock" had already been suggested and that all of these names had been cleared with the Post Office 81 Mr Kell thought that they were supposed to use the names of the past and existing Council members 82. Mr. Newcomer replied that the choice was up to the Commission and that the choice of Council-member names was not mandatory. 83. Mrs Taylor asked who had the right to choose the names 84 Mr Newcomer replied that the Commission was the recommending body. 85 Chairman asked if this was only the step to select a name and have the public hearing on it 86 Mr Newcomer replied that that was correct 87 Chairman called for a nomination for a street name. Page 7 - Planning and Zoning Commission Minutes of April 23, 1981 88 Mr Kell suggested that they consider naming the street after the present Vice Mayor Granillo since he had served the City so well for so long 89 Chairman agreed that the Vice Mayor should be so honored, but that a different street with more prestige would be a more suitable choice 90 Mr Steelsmith asked what the steps would be after the Commission chose a name 91 Mr Newcomer explained that a public hearing would be advertised on the choice of the street name and after the hearing, a recommendation would be made to the City Council for a decision 92 Chairman called for additional questions or comments There being none, he called for any objections to holding a public hearing on the naming of "Outpost Road" on May 12, 1981 at 7.00 P.M. at this same location There being no objection raised, he announced that the hearing would be held on that date, time and location and directed the Executive Secretary to place the necessary legal advertisements 93. Mr. Newcomer announced that the last item for consideration was a Housing Committee for the City He suggested that the Commission discuss the subject and ask the Council to consider forming such a committee 94 Chairman explained that a Housing Committee would be helpful to the City and that it should be composed of local citizens, members of the Commission and other groups that would have an interest in housing 95. The league ran for approximately two months with fifty men involved. All in all, the league was a success , and we are looking forward to expanding it next year . WOMEN' S VOLLEYBALL LEAGUE A volleyball league for women, high school age and over, is continuing thru the middle of May. Approximately fifty ladies are involved in the league that started in March. Again, an- other new activity that will grow next year . BABY DEBUT AND OPEN HORSE SHOW The Baby Debut and Open Horse Show was held on April llth. This swimming pool fund raiser was sponsored and organized by the Parks and Recreation Commission. We had an excellend response from the community by sponsoring the various classes and presentation of awards . We are looking forward to making this an annual event Approximately $500 . 00 will go into the swim- ming pool fund as a result of this show. EASTER EGG HUNT If you missed it, what an experience ! ! Over 500 children participated in the Easter Egg Hunt on April 18th. Project HOY of the Community Schools showed a Walt Disney movie prior to the hunt . This joint project is a step in the right direction in providing recreation activities to the community . It sure didn' t take the kids long to find the 100 dozen eggs donated by Alpha Beta. SUMMER RECREATION PROGRAM The Recreation Program for this summer is finalized. We will be holding pre-registration on May 7 and 8 from 3 . 30 P M - 5 .30 P.M. at the Junior High Cafetorium. Hopefully, this year ' s program will be the best yet . A variety of activities are offered, aimed at meeting our community' s youth leisure time needs . CRIME PREVENTION PROGRAMS This past month we have no requests for Crime Prevention This is largely due to our winter visitors leaving for the summer At least this will allow us time to replenish our supply of handouts , and give us time to work out programs for next fall . We are still short on both youth looking for employment and employers . We plan on publicizing more this month, hoping to keep some of the kids busy with work this summer. TENNIS COURT ACTIVITY The newly developed tennis courts are getting plenty of use . Hopefully, this trend will benefit our tennis lessons offered during the Summer Recreation Program. ALUMINUM CAN DRIVE DRIVE TO DIVE! ! Fliers were sent out to all schools announcing the drive to fund a community swimming pool . This is one way the youth can actively participate in the fund raising Superstition Elementary School plans to collect cans beginning the first week in May thru the -end of the school year, and donate them to the drive It ' s going to take everybody in the community to achieve this major goal . CITY COMPLEX PARK It will only be a short while before we start developing the park directly north of the Community Service Building . Our tentative plan is to add on a patio off the rear of the building, sand volleyball courts , basketball court, picnic area, and children' s playground. Our long range goal is to develop this area into a mulct-purpose park offering as many facilities as the area will hold.
