A special meeting of the City Council of the City of Apache Junction,
Arizona, was held on March 30, 1981, at the Apache Junction Council Chambers
pursuant to notice required by law

Mayor Seeman called the meeting to order at 6:00 p.m
INVOCATION
Councilman Eidson led the invocation.

The Council and public participated in the Pledge of Allegiance.

CANVASSING OF VOTES, PRIMARY ELECTION
MARCH 24, 1981
The City Clerk presented
to unofficial returns,from both 22A and 22B, along with the official returns
which were sealed at the time the election closed She opened the official
returns and presented them to the Council so they could ascertain that nothing
had been altered
The members of the City
Council reviewed the returns and the canvassing of votes was concluded by the
Mayor citing A.R.S lh-642, which states the City Council shall meet on the
first Monday following the election in order to canvass the votes of the primary
election.

Mayor Seeman stated
the procedure was to merely accept the canvass of the votes and if there were
any other procedures that anyone wishes to produce, the procedures should be
put through the Superior Court system

MOVED THAT THE FOLLOWING RESOLUTION BE ACCEPTED'
RESOLUTION No 81-03 Onlik
WHEREAS the Primary Election for the City Councilmembers for
Apache Junction was held on March 24, 1981; and
WHEREAS a Special Meeting of the City Council was held on March
30, 1981, pursuant to law, for the purpose of canvassing the
returns of said election; and
WHEREAS the City Council did canvass the election returns at
said Special meeting and did determine the official results of
the election,
NOW, THEREFORE, be it resolved.
That the City Council declares the official returns of the Primary
Election for City Councilmembers of the City of Apache Junction
as follows
1. The number of ballots cast in Precinct 22A 1379
The number of ballots cast in Precinct 22B• 1481
2. The number of ballots rejected in Precinct 22A 4
The number of ballots rejected in Precinct 22B• 16(7 question ballots

Further resolved that the City Clerk be and she is hereby directed
to issue the certificates of nomination as provided by law, notifying
those persons that their names will appear on the ballot for the
General Election to be held May 19, 1981.

Mayor Seeman announced the Boards of Supervisors met jointly in Superior
Court and unanimously voted against the disincorporation issue
IT WAS STATED FOR THE RECORD THAT ALTHOUGH COUNCILMAN SHANKS WAS NOT IN ATTENDANCE
AT THE MEETING FOR A VOTE ON THE ACCEPTANCE OF THE AGENDA, SHE WAS PRESENT
DURING THE MOTION AND VOTE ON ACCEPTANCE OF THE CANVASSING OF THE VOTE
ADJOURNMENT
There being no further business, Mayor Seeman adjourned the meeting
at 6 30 p.m

CITY MANAGER'S REPORT
City Manager Ray Lee stated the City received the Economic Estimates
Commission's expenditure limit which is $1,985,398 for the ensuing year. He
stated it is based on the Gross National Product price deflator which is the
inflation factor and is based on what was actually expended in the 1979-80 budget
along with the current population. He added there is a multiplier which will
be provided to the media in hope that the public can understand the basic
formula.

and his desire to set up a new concept RV home.

COMMISSION PROJECT AGREEMENTS, AS SUBSTANTIALLY COMPLETE AND WILL ASSUME FULL

Councilman Burgess stated that over the past six or seven months, virtually
every employee hired by the City before the current management arrived has either
left or been fired He stated he did not understand what was happening, his
questions have not been answered -- he stated he felt questions need to be asked

know if it was that they could not get along with management, if they were incom-
petent, or whatever.
Councilman Shanks stated she was in full agreement with Councilman Burgess
Councilman Damiano asked the City Clerk if the same people were going to be
on the election board
City Clerk Marlis Davis stated the City Council , at their next session, will
appoint new election boards and tally boards in order to provide relief at 7 00
p.m. Mrs Davis stated the Council appoints the election board
Councilman Damiano asked if there would be addition polling places.

Following the Planning and Zoning Commission meeting of March 10, 1981, several
changes were recommended by the Commission as part of the transmittal to the
City Council . By this memorandum, the staff review is presented.
1. With a main entry on Palo Verde Drive, and an emergency gate
at Broadway, should Fourth Avenue be determined to be a
public right-of-way, the staff would not object to its
abandonment to Saguaro Street. However, should it remain,
its centerline should match the existing centerline of the
private street within the project.
2. The Fire Chief has indicated by telephone that the emergency
gate from either alley (assuming that they are at least sixteen
feet in width) can accomodate the emergency fire equipment.
Therefore, should Fourth Avenue be abandoned, access from the
alley through an emergency gate could be accomplished.
Minimum width requirement for the gate is thirty (30) feet.
RECOMMENDATION
The Planning and Zoning Commission recommends by a 5-2 vote the approval
of the rezoning.
The reason for the recommendation is: 1) the Commission has determined
that the proposed planned development is the highest and best use to be made
of the property; and 2) requirement of S o 3, a09 of the Zoning Ordinance

BACKGROUND
On February 4, 1981, the City received the application of Keith Bullock
requesting rezoning of a nine (9) acre (±) parcel as per the attached map
from General Rural (GR) to Trailer Homesite by Planned Development (TH/PD) .
On February 22, 1981, notice was published for the rezoning stating that
the Commission would hold a public hearing on March 10, 1981 and, upon
receipt of a recommendation from the Commission, the City Council would
hold a public hearing on April 1, 1981. By this memorandum and attach-
ments, the recommendation of the Commission is forwarded to the City
Council .
The proposal is to rezone for a future subdivision request and not to
create a mobile home park. The applicant is aware of the groundwater
legislation passed in 1980 by the State Legislature and, until this is
resolved by State and Federal officials, the current legislation would
not allow approval of a subdivision within the area in that the certi-
ficated water company has not met the requirements for providing the area
with a 100-year supply of water.
The fire chief noted that the area is underwatered and unless the water
system were revised, there would not be sufficient water to provide
adequate fire protection. He stated that a minimum of a six-inch water
main is needed together with an adequate supply of water at an adequate
pressure.
The Director of Public Works noted the streets within the project area
have a right-of-way of forty (40' ) feet while the City minimum standard
is fifty (50' ) feet. The design does not have sufficient space for stan-
dard curbs, sidewalks and utility easements. Therefore, the developer

should retain the streets as private and not propose such for dedication.
As originally proposed, the water retention area were proposed to be dedi-
cated to the City. As a general policy, the City should not accept such
areas as this increases the City's maintenance program which would increase
budget demands.

Recommendation
The Planning and Zoning Commission recommends by a 5-2 vote the approval
of the rezoning.
However, in the presentation of the planned development plan, certain
changes were noted based on comments made by the Development Coordinating
Committee. The amended version has not had a complete review by the
staff. Therefore, the choices open to the City Council are:
1. Open the public hearing and immediately continue it to a
future date (such as April 17, 1981 at 7:00 P.M. in
these Council Chambers) .
2. Open the public hearing and allow those present to present
their comments, then continue the public hearing as above.
3. Do not hold the public hearing and direct the staff to
readvertise the case when the materials are complete.
In options 1 and 2, the first reading can also be accomplished.
The staff intends to present its recommendation at the April 17th
meeting.

SECTION I IN GENERAL
1 The zoning district classification on the Apache Junction,
Arizona, Zoning Map for the parcel of land described as•
Lot 9, Davis Tract, except the North 200 feet,
located in Apache Junction, Pinal County, Arizona,
be and hereby is amended by changing the zoning district
classification from General Rural (GR) to Trailer Homesite
by Planned Development (TH/PD)
2 The approval of the zoning district classification incorporates,
by reference, the preliminary approval of the Planned Develop-
ment as submitted by the applicant, and the development of the
said property shall be in accordance with said Planned Develop-
ment and as provided in Article 33 of the Zoning Ordinance
3 Applicant shall install, at his expense, fire hydrants as per
approved plans of the Apache Junction Township Fire Chief for

If any section, sub-section, sentence, clause, phrase or portion of this
Ordinance or any part of the Code adopted herein by reference is for any
reason held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decisions shall not affect the
validity of the remaining portions thereof

domestic use in your proposed recreational vehicle park
in accordance with the rules and regulations of the Arizona
Corporation Commission and the State Health Department .
Palm Springs Water Company has been granted a tentative
allocation of CAP water for augmentation of groundwater
supplies beginning in the mid-1980 ' s . However , as you
are aware , the Arizona Department of Water Resources has
not issued certificates of 100-year assured water supply
to any private water companies on the basis of CAP alloca-
tions pending the resolution of related legal issues .
We will look forward to hearing from you as your plans
proceed. Upon receipt of engineered plans for the park,
we will prepare a cost estimate for the water lines and
appurtenances .

In response to your question concerning fire flows , in
Arizona municipal and rural fire departments have the
responsibility for providing fire protection facilities .
Should they decide to pay a water utility to install larger
fire-flow mains , additional storage , and greater booster
pump capacity, an agreement could be reached with an
individual utility.
Neither of the agencies which regulate water utilities
in Arizona (the State Health Department and the Arizona
Corporation Commission) have any regulations relating to
fire flow requirements nor is there any Arizona statute
specifying such requirements for private water utilities .
Where fire hydrants have been installed by developers ,
Palm Springs supplies water through the hydrants in such
quantities and at such pressures as are available at the
time without charge , and there is no assumption whatever
of any liability on the part of the water utility.
If you wish to talk with Mr . Stewart about this matter ,
he will be back in the office on Monday , March 9 .

PROPOSED SUNNY LANE ESTATES
.•. It is our intent to develop Lot 9 of Davis Tract except the
north 200 feet thereof, for the purpose of subdividing and selling
small homesites as part of an RV Home package. These units require
a minimum amount of water usage and septic capacity since the only
plumbing involves a travel trailer hook-up.
Septics--to meet Pinal County Code.
Fire hydrants--to meet City and fire dept. requirements.
Desert Landsca.:ang--provided by the developer as part of the package.
Also provided by the developer in water retention areas.
Privacy r:all--constructed around the perimeter of the property with
openings for entrances.
Street Lights--Lighting district proposed.
Restrictive Covenants--will protect the investment of the property
owners. All RV's must meet the approval of the developer. No
modifications will be allowed that change the intended use from
RV hook-up and accessory building.
Easements--dedicated to and maintained by the City of Apache Junction
will include 50 feet for Broadway and the alley (6' allotment)
as indicated on development layout.
Time Table--Construction will begin within 90 days after final approval.
Phase I will be the north one half of the property and will consist
of all streets and utilities needed to service that area.
Phase II will begin by the spring of 1982, and will consist of
completion of the entire development.
Price Range--provided construction can begin in the near future, the
RV Home package will be offered for about $30,000. That will
include the RV Home, lot and hookups. The RV will be additional.
Options will include a carport with paved drive, fireplace, air
conditioning, upgrade insulation and many other extras at an
additional charge.
The above proposals are tentative and may be adjusted to meet
the recommendations of the Planning and Zoning Commission and the
City Council.

LETTER OF INTENT CONTINUED
After conferring with the development committee, the following changes
have been made and are reflected on the development layout.
A revised lot layout is shown on the attached drawing. This will
allow for placement of the septic system and a utility easement in the
front yard of each home where they will be easily serviceable.
The developer will record a declaration of restrictions, covenants
and easements to ensure the orderly and harmonious development of the sub-
division, and to protect against future depreciation of values .resulting
from deterioration of the neighborhood. As the lots are sold, the develo-
per will gradually transfer his right to enforce the restrictions, liens,
and covenants to the homeowners' association.
The association will retain ownership of and provide main+.ainance for
the streets and common areas(for water retention). Since the street will
be privately owned, the width will remain at 32' from back of curb to back
of curb . Emergency entrances will have locked gates.3ecurity will be
provided at the main entrances by a guard.
All recreational vehicles to be used as part of the ?.V Home must
be approved in writing by. the developer/association. No additional
recreational vehicles, boats or boat trailers shall be parked in any
lot front or side yard.
The storage area shown in the optional carport on the original plan
has been eliminated, thereby allowing 48' of off-street parking per lot.
Detached storage buildings will be allowed but must be at least 50' from
the front lot line and at least 4' from the rear lot line, and may not
exceed 8' by 10' in size.
The easement area of each lot and all improvements in it shall be
maintained continuously by the lot owner and shall be reserved on the
recorded plat. No structure, planting or other material shall be placed
or permitt ed to remain within these easements which will interfere with
the maintenance of utilities.
Every lot owner automatically becomes a member of the homeowners'
association and is assessed monthly dues. Each member is entitled to
one vote for each lot owned. The builder is temporarily entitled to three
votes for each lot he owns, thus allowing him to fulfill his original
committment to complete the overall concept of the development. The
assessment of dues constitutes a lion on each lot and any default by a
homeowner or the builder inlayment of assessments can result in fore-
closure of the defaulting member's lot.

APPOINTMENTS TO THE BOARD OF ADJUSTMENT
Enclosed in your packet is information from those City residents who
have submitted Talent Bank Applications for appointments to the Board
of Adjustment. Currently there are two vacancies on the Board, one
created by a position which was never filled and one due to the death
of Don Nesser.
The April meeting of the Board failed to produce a quorum due to two
members having unscheduled events which prevented them from attending
the meeting. Therefore, it is requested that the appointment of one
or more individuals be considered at this time.
Please note that both the Apache Sentinal and the Apache Junction News
featured articles on the positions presently open on the Board of
Adjustment.

APPOINTMENT OF AN ELECTION BOARD,
A TALLY BOARD, AND THEIR COMPENSATION
In accordance with the Arizona Revised Statutes, the attached Re-
solution is submitted for your adoption. Resolution 81-05, which
was carefully reviewed by the Attorney staff, provides for the
appointment of an Election Board, a Tally Board, and for their
compensation.
By providing for a Tally Board, the number of hours the Election
Board will be required to serve will be reduced with the exception
of the Inspectors, who by State statute, must remain in attendance
from the time the polls open until all the returns have been tallied.
It is requested that the attached resolution be adopted by the Council .

WHEREAS, Resolution 80-42 provides for the holding of a General
Election, and
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council
of the City of Apache Junction, as follows.

A regular meeting of the Library Board of Trustees was held on February
3, 1981 at 7.00 P M at the Apache Junction City Hall Complex pursuant to
notice as prescribed by law

ACCEPTANCE OF THE AGENDA Discussion of contract and planning
accepted. Motion was made by Elizabeth
Burks and seconded by Donald Taylor.
Motion carried unanimously
ACCEPTANCE OF MINUTES A motion was made by Elizabeth Burks
to accept the minutes of the December
1980 meeting as presented and seconded
by Donald Taylor Motion carried
unanimously.
A motion was made by Lillian Castro
to accept the minutes of the January
6, 1981 meeting as presented and seconded
by Donald Taylor. Motion carried
unanimously
REPORTS. None
OLD BUSINESS: The contract regarding the Library had
been refused by Mrs. Opal Hansen
Eleanor Lewis has an appointment with
Susan Goodwin, City Attorney, to make
a complete acceptance of the Apache
Junction Public Library Association, Inc.
as present contract states or to accept
or reject any contract until the matter
of disincorporation is settled. A
motion to draft a letter to the City
Attorney stating the above was made by
Donald Taylor and seconded by Lillian
Castro Motion carried unanimously
NEW BUSINESS Meeting on City Hall Complex•1-27-81
showing designs on various state levels
as to what would be applicable to our
locale. Diagrams of City plans and
questionaires had been passed out.
There was discussion on applying to
the City Council to increase the number
of Trustees on the Library Board to
seven so a quorum would be easier to
reach
A motion was made by Jan Hiller to
apply to the City Council to increase
the number of the LIbrary Board of
Trustees to seven instead of the
present six and seconded by Lillian
Castro. This motion was tabled until
further notice.
A motion to adjourn was made by Jan
Hiller and seconded by Donald
Taylor. Motion carried unanimously

Dear Mayor Seeman :
Thank you for your letter and concern regarding the street
lighting improvement district for Apache Villa Three sub-
division . Your concern is shared by officals in nearly
every municipality within our service area , as well as the
people in over 30 other street light improvement districts
awaiting installation of lights .
Presently the schedule for your district is :
March 23 to 27 - engineering work
March 30 or 31 - to be released for the construction
scheduling.
After March 31 , activity in the area will commence with the
surveying of pole sites and the locating procedures, which
are required by state law, for determining what other under-
ground utilities might be near the street light pole sites .
Actual installation of poles begins within about 5 days of
completion of the utility locating procedures which have 2
working days to be completed .
The City is to be congratulated for the foresight displayed
in establishing and pursuing lighting activities so early
in its lifetime. You are extremely fortunate that your
Engineering Department was so capable of making decisive
conclusions relating to lighting specifications and pro-
cedures . It will be our pleasure to work with the City
whenever the occasion arises .

Memorandum
To : Honorable Mayor and City Council

Thru: City Manager
Subject : Departmental Report - March 1981
Attached you will find our departmental report for
March, 1981 . This month, as we experienced in
February, was quite busy in the area of Traffic .
We had 13 injury accidents in which 36 people were
injured. Additionally , we experienced 14 non-injury
accidents for a total of 27 accidents in March .
During one time period, we had three accidents within
one block of each other on US 60 between Delaware and
the Dog Track. All of these were injury accidents
and occured one after the other . As we were investigating
— one accident another occured and so on all within a
short block of area . These types of things will
continue as the numbers of people in the community must
travel over roadways and intersections that were designed
for a Rural area . In this situation , we had used all
our personnel and had to request assistance to keep
up with all the activity . We can impact Speed in the
community through Selective Traffic Enforcement which
will help to lesson the severity of any injuries suffered
in an accident , due to reduced speed at the time of impact ,
however , we must be aware of the fact that the rate of
accidents will be with us as the community swells with
population . Burglaries and Thefts are down from last
month which can be reflected to our Community Crime
Prevention programs . We shall see if this trend continues .
Animal Control has had another busy month with an increase
in complaints . The following is a breakdown of activity
for March .
