CITY COUNCIL MINUTES REGULAR MEETING AUGUST 5, 1981 The regular meeting of the City Council of the City of Apache Junction, Arziona, was held on August 5, 1981, at the Apache Junction Council Chambers pursuant to the notice required by law CALL TO ORDER Mayor Clarke called the meeting to order at 7 00 p m INVOCATION Councilman Eidson led the invocation. PLEDGE OF ALLEGIANCE Councilman Damiano led the Pledge of Allegiance. VOTE Unanimous The motion carried ACCEPTANCE OF THE MINUTES OF THE REGULAR MEETING OF JULY 15, 1981 Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE MINUTES OF THE MEETING OF JULY 15, 1981, BE AND HEREBY ARE, ACCEPTED AS PRESENTED Councilman Shanks seconded the motion. VOTE In Favor Councilman Hudson, Councilman Shanks, Councilman Steelsmith, Councilman Damiano, Mayor Clarke Abstained Councilman Eidson The motion carried AWARDS, PRESENTATIONS, AND COMMUNICATIONS dismik Ann Lorenzo, representing the Chamber of Commerce, presented Certificates of Appreciation to the following departments for helping in the July 4th, 1981 celebration Community Services Department, Police Department,and Fire Department. She also presented a donation of $75.00 to the Swimming Pool Fund, from the Chamber of Commerce. Mrs Lorenzo also read the following letter from the President of the Chamber of Commerce, Jan Hiller Dear Mr. Broman: I would like to take this opportunity to express my views on the future Apache Junction Airport. The Chamber of Commerce, Apache Junction,would like to go on record as supporting same. I feel a broader tax base, a larger job market for our own young people, the encouragement of light industry, are all beneficial to this City I realize that even if it were started tomorrow its completion and and operational status is at least five years down the road The Chamber would like to be the vehicle to initiate the start of this project. We are ready to help in any way ( Mayor Clarke presented a Certificate of Appreciation to Christia Johnson of Il the Arizona Republic for the accuracy in reporting the news of the City of Apache Junction. CALL TO THE PUBLIC Mr Richard Taylor addressed the Council with comments on the Palm Springs Water Company. He requested that the City Council pass a Resolution to attempt to /mok have a rehearing from the Arizona Corporation Commission for an equitable rate. Dick Rabidue addressed the Council with comments on the boxing advertisement signs The Mayor referred the question to the City Manager, who stated that the City Staff would look into it and give the information to Mr Rabidue as soon as possible CITY MANAGER'S REPORT Rosemary Montgomery, Acting Finance Director, presented the following monthly Financial Report. HONORABLE MAYOR AND COUNCIL It is my pleasure to present a financial report on the conditions of the City's finances This report to the Mayor and Council will be made monthly in addition to your regular budget report I might tell you at this time that our annual audit is in progress A report containing the Financial Statement of the City for FY 1980-81 will be presented to the Mayor and Council in September by the audit firm of Haymore and Busby. We are proud to announce that the City is in good financial condition. My report this evening covers the first month of our new fiscal year of 1981-82. The bank balances given are as of July 31, 1981 REGULAR MEETING OF THE CITY COUNCIL PAGE TWO AUGUST 5, 1981 THE CITY'S GENERAL FUND CHECKING EXPENDED $ 94,094. WITH CREDITS OF 140,157 LEAVING A BANK BALANCE FOR GENERAL FUND 47,023. THE GENERAL FUND SAVINGS ACCOUNT EARNS 5i% INTEREST AND INDICATES A BANK BALANCE OF $427. COURT BONDS HOLDING ACCOUNT HAS A CHECKING ACCOUNT BALANCE OF $ 3,618. HIGHWAY USERS CHECKING ACCOUNT EXPENDED $ 6,870 WITH CREDITS OF 22,127 THE BANK BALANCE FOR HIGHWAY USERS CHECKING IS 18,238 HIGHWAY USERS SAVINGS EARNS 5i% INTEREST AND HAS A BANK BALANCE OF $ 553 THE PUBLIC WORKS RESERVE FUND THIS IS THE FUND THAT WE ARE USING AS A HOLDING FUND FOR ALL SWIMMING POOL DONATIONS. INDICATES CREDITS FOR THE MONTH OF JULY OF $ 186. WITH A BANK BALANCE $ 1,575 THE GRANTS IN TRUST CHECKING ACCOUNT EXPENDITURES NONE INDICATES CREDITS OF $ 5,430. WITH A BANK BALANCE OF $ 15,082 THERE IS AN OBLIGATION OF $ 2900. ON THIS ACCOUNT THERE ARE NO EMCUMBERENCES THEREFORE IT WILL BE MY RECOMMENDATION TO THE CITY MANAGER TO INVEST $ 10,000. FROM THIS ACCOUNT IN A 30 DAY TIME CERTIFICATE THE FEDERAL REVENUE SHARING CHECKING ACCOUNT EXPENDED $ 2,479 /lbw SHOWING CREDITS OF $ 31,602. AND LEAVING A BANK BALANCE OF $ 29,206 ENCUMBERENCES ON THIS ACCOUNT ARE $ 1,200 THEREFORE, I WILL RECOMMEND TO THE CITY MANAGER THAT $15,000. BE INVESTED IN A 30 DAY CERTIFICATE OF DEPOSIT THE PAYROLL ACCOUNT EXPENDED $ 63,282 WITH CREDITS OF $ 62,711 A BALANCE OF $ 35,785 REMAINS IN THE PAYROLL ACCOUNT. THIS WOULD COVER ONE PAYROLL AND SHOULD REMAIN AS A SAFETY MEASURE IN THIS ACCOUNT IDLE FUNDS OF $150,000 ARE INVESTED THROUGH A BID PROCESS AT 18.125% INTEREST IN A 30 DAY CERTIFICATE, FALLING DUE ON AUGUST 20th AND EARNING INTEREST FOR THIS 30 DAY PERIOD OF $ 2,265.62. THIS CITY HAS NO BOND ISSUE OR INDEBTEDNESS OTHER THAN NORMAL OPERATING EXPENSE. ARE THERE ANY QUESTIONS ON THIS REPORT? 4 THANK YOU REGULAR MEETING OF THE CITY COUNCIL PAGE THREE AUGUST 5, 1981 Leo Frazier, Building Official presented the monthly report on the number of permits issued for the months of May, June, and July Joe Gero, Planning Director reported on the non-conforming use inventory. PUBLIC HEARINGS APPLICATION FOR TRANSFER OF LIQUOR LICENSE, SUPERSTITION SKIES ) Mayor Clarke opened the meeting to the public. Mr. Bob Cosby spoke in favor of the application Mayor Clarke asked if there was anyone who wished to speak in favor of or in opposition to the application There being no one wishing to address the Council, Mayor Clarke closed the discussion to the public. Lieutenant Ed Seder stated that the Police Department recommended the liquor license transfer. Mayor Clarke questioned City Clerk, Marlis Davis,about Superstition Skies business license She stated that they did not have one, but had been contacted regarding the matter. It was decided by the City Council that not recommending the application because of their business license. would have no influence on whether or not the State would approve their application. Councilman Steelsmith MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ( ARIZONA, THAT THE APPLICATION FOR PERSON TRANSFER FOR A SERIES 6 LIQUOR LICENSE FOR SUPERSTITION SKIES TO LEONARD A SNOBLE, BE AND HEREBY IS, RECOMMENDED FOR APPROVAL TO THE STATE DEPARTMENT OF LIQUOR AND CONTROL Councilman Hudson seconded the motion VOTE• Unanimous + The motion carried 10.1 OLD BUSINESS PROPOSED ORDINANCE NO. 108, AIRPORT COMMISSION MEMBERSHIP Mr. Forsberg, Airport Commission member, requested that the Council raise the membership of the Commission from five to seven people. Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE READING OF ORDINANCE NO. 108 BE READ BY TITLE ONLY, AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Councilman Hudson MOVED THAT BE „AM\ IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT ORDINANCE NO. 108, AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING ORDINANCE NO 37 OF THE CITY CODE SECTION 29-2A, 29-2B, 29-2C, PROVIDING FOR AN INCREASE IN MEMBERSHIP FROM FIVE TO SEVEN OFFICIAL MEMBERS, REPEALING ANY CONFLICTING PROVISIONS, AND PROVIDING FOR SEVERABILITY BE AND HEREBY IS, APPROVED Councilman Damiano seconded the motion VOTE: Unanimous The motion carried PROPOSED CHARTER CALENDAR City Manager, G Ray Lee presented the proposed Charter Calendar to the Council for approval. Councilman Eidson opposed the members of the Charter Govenment being from different factions of the City. Councilman Steelsmith stated that he recommended that the members of the Committee be from the various factions of the community, but qualified ( Councilman Steelsmith MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT INFORMATION PRESENTED BY THE CITY MANAGER PERTAINING TO CHARTER GOVERNMENT AND THE CALENDAR PROVIDED, BE AND HEREBY IS, ACCEPTED BE IT FURTHER RESOLVED THAT THE STUDY OF ALL TALENT BANK APPLICATIONS BE COMPLETED AND ALL APPOINTMENTS MADE AT THE REGULAR COUNCIL MEETING OF SEPTEMBER 2, 1981 Councilman Damiano seconded the motion • VOTE. PROPOSED ORD INANCE NO 110, AMENDMENT TO THE PLUMBING CODE (FIRST READING WITH THE EMERGENCY CLAUSE) Councilman Eidson stated that the Building Official , Leo Frazier, and he had had many conferences regarding the substitution of plastic pipe for cast iron pipe in buildings for plumbing. The 1982 Building Code will allow the use of plastic pipe, and the 1981 Building Code does not A survey form was sent out to several plumbers and the general response was that their recommendation was plastic pipe, as it's cheaper, lasts longer, and is more efficient Building Official , Leo Frazier, recommended that this proposed Ordinance be approved, as plastic pipe has been tested. He stated that plastic pipe is advantageous in non-fire rated construction, it has durability, current with the latest technology, and is much less expensive than other materials. The Arizona Law Enforcement Officers Advisory Council discontinued the funding for CARLOTA Academy, and this Resolution will approve the CARLOTA Academy and will recommend continued funding for this Academy through the Arizona Law Enforcement Officers Advisory Council Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT RESOLUTION NO 81-12, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, OPPOSING THE ACTION OF THE ARIZONA LAW ENFORCEMENT OFFICERS ADVISORY COUNCIL REGARDING PER DIEM, BE AND HEREBY IS, APPROVED. Councilman Eidson seconded the motion .�... x� �. .- �..� ...�.,. .-T. v VOTE Unanimous The motion carried PUBLIC TRANSPORTATION GRANT FOR NON-URBANIZED AREAS Superintendent of Community Services, Jeff Bell , gave a brief review of the plans for the program Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE CITY MANAGER BE AND HEREBY IS, AUTHORIZED TO TAKE STEPS NECESSARY TO PROCEED WITH THE PRE-APPLICATION FOR THE NON-URBAN AREA TRANSPORTATION GRANT IN ORDER TO DETERMINE THE ELIGIBILITY OF THE CITY OF APACHE JUNCTION, ARIZONA, FOR RECEIPT OF SUCH FUNDS. Councilman Damiano seconded the motion VOTE Unanimous The motion carried REGULAR MEETING OF THE CITY COUNCIL PAGE SEVEN AIIritcr 1041 REQUESTS OF COUNCIL Councilman Hudson MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT DIRECTION BE GIVEN THE CITY MANAGER TO REVIEW THE CURRENT BUDGET FOR AVAILABLE FUNDS IN THE AMOUNT OF $6,000 TO HELP SHARE THE EXPENSE WITH APACHE JUNCTION SCHOOLS TO INSTALL A SPRINKLER SYSTEM AT THE JOINT BALL FIELD PROJECT BE IT FURTHER RESOLVED THAT BUDGET ALTERNATIVES BE PROVIDED TO THE COUNCIL WITHIN A REASONABLE PERIOD OF TIME. Councilman Eidson seconded the motion Superintendent of Community Services, Jeff Bell , confirmed the need for grass in the ball field, as citizens have complained of the dust caused by traffic and activity on the field. VOTE Unanimous The motion carried. The proposed change as rewritten eliminates the setback requirement for metal awnings leaving that decision instead to the park owners . This makes the City of Apache Junction consistent with Mesa' s recent change. It is felt the proposed change will alleviate many enforcement problems encountered by the City and also will give park owners more discretion in the development of their parks . Two different size signs will be placed on public property and a third size placed within the city right-of-way. Mr. Urban indicated he will obtain necessary permission to place trailer mounted 4'x 9' signs AND 2'x 2' signs on private property. MCDANIEL, DIRECTOR OF PUBLIC SAFETY taxi r SUBJECT: PROPOSED BUILDING ADDITION Attached is a diagram of a proposed addition to the Apache Junction Police Department building which would give us approximately 672 sq. ft. to enable us to more efficiently operate our department. The proposed addition would give us an office for records so we may be able to expand the lobby and have a larger area for the public, more room to store forms and supplies, relieve the over-crowded property room, provide a place to house the polygraph desk and machine and have privacy during examinations. A larger office for detectives, and the Chief's office would also be housed in the new addition. Other offices in existence would be utilized for Sergeants or supervisors and a secretary's office, thus relieving the now over- oink crowded Squad Room where the copy machine, fingerprint cabinet and intoxilyzer machine are housed, and the officers work area, as well as the shotgun storage, portable battery charger, all located in a room the size of 8 x 12. Apache Junction Police officers have volunteered to donate their time for construction after the slab is poured. All we need from the City is the cost of materials estimated at approximately $10,700. Chairman recognized Mayor Clarke, Councilmen Steelsmith, Hudson, and Damiano, who were in the audience opened the Public Hearing and called upon staff to brief the commission on case PZ-12-81 12. Mr. Gero presented the application of Frank Toran which would rezone from GR to TH and allow the possi- bility of placing a second trailer on the 14 acre site. Petition requirement statistics were presented 13 Chairman invited comments from the applicant 14 Mr Don Graham introduced himself as Mrs Toran's brother and explained that if the petition was granted, relatives from California would reside in the second trailer 15 Chairman asked for further comments in favor of or opposed to the case. There were none Staff recommendation was requested. 16 Mr Gero stated that the Development Coordinating Committee (DCC) had no objections to the case For the commission's information, Mr Gero announced the cases on this agenda going to City Council would have the first reading on August 5 and, if successful, the public hearing, second reading, and consideration on August 19 sr 17 Chairman asked if there were comments in rebuttal. There were none 18 Ms. Taylor asked Mr. Graham if the property would be divided into equal parts. Mr. Graham replied affirmatively. 19 Chairman called for a motion 20 Taylor/Oltman M/S "BE IT RESOLVED by the Planning and Zoning Commission of the City of Apache Junction, Ari- zona, that approval of case PZ-12-81 (Proposed Ordinance No. 105) be recommended to the City Council for the reasons that it is compatible with zoning in the area and there are no ob- jections to having another residence in the area " The motion passed unanimously (5-0). 21 Chairman called upon staff to brief the commission on case PZ-13-81, Commission Initiative. 22 Mr Gero deferred to Zoning Administrator Leo Frazier. 23 Mr. Frazier explained that this proposed ordinance would create a presumption of legality for existing controversial conditions within the city, establishing grand- fathered rights effective February 9, 1979; the date was selected in that the city has an aerial photo- graph recording existing conditions at that time 24 Chairman invited comments There being none, staff recom- mendation was requested 7 t 7 25. Mr. Gero stated that approval was recommended to alleviate a hardship on the people of the community due to a lack of basic records. 26. Mr Kell asked staff if the inventory of non-conforming uses was revealing many such conditions. Mr. Gero answered affirmatively citing one block in which approximately eighty (80) non-conforming uses were found oidak 27 Chairman called for a motion. 28 Taylor/Kell M/S "BE IT RESOLVED by the Planning and Zoning Commission of the City of Apache Junction, Ari- zona, that case PZ-13-81 (Proposed Ordinance No. 106) be recommended to the City Council for the reason that problems concerning establishment of grandfathered rights would be alleviated." The motion passed unanimously (5-0) 29. Chairman called upon staff to brief the commission in case PZ-14-81 (Proposed Ordinance No 107), Commission Initiative 30 Mr Gero deferred to Zoning Administrator Leo Frazier 31. Mr. Frazier explained that this ordinance would eliminate the set-back requirements for awnings in a mobile home park Set-back requirements between units still exist. He itemized the changes made in Article XX 32. Chairman invited comments There being none, staff recommendation was invited ( 33. Mr Gero explained that approval was recommended to meet Il some of the problems currently existing in the Zoning Ordinance. 34 Chairman called for a motion 35 Kell/Taylor M/S "BE IT RESOLVED by the Planning and Zoning Commission of the City of Apache Junction, Ari- zona, that approval of case PZ-14-81 (Proposed Ordinance No 107) be recommended to the City Council for the reason that it is a corrective measure " • The motion passed unanimously (5-0) 36 Chairman called upon staff to brief the commission on the Jaycees' proposal 37 Mr Gero explained that after the commission decided to recommend approval of the Jaycees' proposal to the appropriate agencies, it was found that there was concern about the selected site by the people living in the area. There were many requests that the commission reconsider its recommendation The Bureau of Land Management was contacted, they agreed to defer action until the commission reviews its previous decision 38 Chairman invited comments in favor of the proposal 39. Mr. Dale Kohler introduced himself as President of the Apache Junctton Jaycees He stated the Jaycees want to comply with the well-being of the community and that another site is being considered. 40. Mr. Gero described the alternate site at Mr Kohler's request He explained it is a 20-acre parcel, the southern border of which is contiguous with the northern border of the city 3 of 7 41 Mr. Kell asked if the Jaycees were withdrawing theer application 42 Mr. Kohler explained that they have not officially with- drawn the application at this time. This second parcel is being considered as an alter- nate site, and is the desired location 43. Mr Kell asked if the Bureau of Land Management had AIN indicated they would accept the application with the alternate site 44 Mr Gero stated the State Land Department has indicated they would like to acquire this 20-acre parcel and surrounding lands. He explained that in- formation indicates that the State Land Depart- ment would defer to second position, meaning they would allow a local application to have priority. A meeting has been arranged with Bureau of Land Management, State Land Depart- ment, members of the City Council, and himself to study the details of this site application. 45. Chairman asked if the alternate site was near family residences 46. Mr Gero pointed out there was a residence approximately one-eighth of a mile with no access to the house from the site. • 47 Mr Kell asked what the procedure would be since a previous recommendation had been made by the commission. 48 Mr Gero explained that application for the alternate site would probably be accepted since the first application had been acceptable. He presented commission alternatives recommending the alternate site, recommending the alternate site with the first site as a second choice, or other recommendations the commission might determine 49. Chairman invited comments oark 50 Mr. Harold Harrington introduced himself and said he had recently bought some land in the area, but had he known of the possibility of having a rodeo arena nearby, he would not have purchased it. ' 51. Mr John Klein introduced himself and explained that he and his neighbors feel that this arena should not be located at the proposed site since the area is residential He expressed a desire to have a rodeo arena in another location. Other reasons for opposition include dust pollution, traffic, and too small an area for such a project. 52 Mr Burton Taylor introduced himself and said he feels there is a significant number of citizens opposed to this proposed site. 53. Ms Pat Adams introduced herself as speaking on behalf of Crossroads Southern Baptist Church She indicated that this proposed arena is not the best use of the land. 54. Chairman called upon staff for recommendation 55 Mr Gero reiterated the two alternatives previously noted 56 Chairman asked if there were comments in rebuttal 57 Mr. Klein explained that the people present want to terminate the possibility of the currently proposed site being used for a rodeo arena. 4 of 7 58 Mr Gero suggested the commission could confirm its previous recommendation, or change the previous recommendation. A second alternative would be to make a recommendation to the Bureau of Land Management that they consider the new site as opposed to the first site If the commission is inclined to recommend the original site be considered as an alternate, such could be part of the second alternative. oink 59. Mr. Hall asked the Jaycees to verify that the new site would be more conducive to its purposes. This was answered affirmatively He then asked how often the arena would be used. Mr Kohler answered that it would be used for rodeos once or twice a year He replied he was unsure what other activities would be permitted or what uses would take place beyond scheduled rodeos. 60 Chairman asked staff how such a problem could be avoided in the future 61 Mr Gero explained that often time is a factor in providing recommendations to other agencies and direction has been requested of the new city council. Other agencies do not supply lists of property owners affected by requested recommendations, which when added to time constraints, intensi- fies the problem Efforts are being made (i.e., request for council direction) to resolve the problem. 62. Mr. Kell asked how many people in the audience were ( present to oppose the proposed site of the Il rodeo arena (Those people stood.) He then summarized that it is the respondibility of the commission to listen to the public affected by the cases. He explained that due to the lack of time he had not viewed the land in question, and the decision to recommend the site was probably an error (in his opinion) He noted that the Jaycees have recognized Amok the fact that, since the project began a few years ago, the area has drastically changed. 63 Kell/Hall M/S "BE IT RESOLVED by the Planning and Zoning Commission of the City of Apache Junction, Ari- zona, that a letter be submitted to the Bureau of Land Management rescinding the original re- commendation of approval and signifying dis- approval , and recommending to the Bureau of Land Management that they generally approve the Jaycees project at the newly-proposed site." The motion passed 4-0-1, with Mrs Taylor abstaining due to a conflict of interest. 64 Chairman declared a five-minute recess 65 Mr Gero briefed the commission concerning desired con- sistency in subdivision approval procedures. Amendment to the procedure was approved for Apache Villa 6 and staff requests the same for Ironwood Sands (installation of sidewalks) 66. Chairman asked if there was a comment from the audience There being none, a motion was requested. 67 Taylor/Oltman M/S "BE IT RESOLVED by the Planning and Zoning Commission of the City of Apache Junction, Ari- zona, that the amendment to the Ironwood Sands • preliminary plat requirement be accepted so that it will be consistent with other requirements." 5 of 7 The motion passed unanimously (5-0). 68. Chairman asked staff to brief the commission on the next item of business, the Water Systems Evaluation. 69 Mr Gero requested the commission take the next two items of business (the Water Systems Evaluation and the Sewage Disposal Alternatives) together. He recommended that a sub-committee of three persons be appointed to organize a work program for concluding the General Plan. 70 Chairman asked for comments. 71. Mr. Kell asked what amount of time would be involved for this sub-committee and whether it would be possible to have some intense briefing by the consultants conducting the studies. 72. Mrs. Taylor asked if the Advisory Committee was still active 73 Mr Hall asked if the Department of Public Works was accessible to the commission for guidance 74 Mr Gero explained that completing the General Plan is a priority. The suggestion of the sub- committee would enable the commission to develop a strategy to formulate its recommended General Plan for submission to the City Council Directional support would be made available, if needed 75. Mrs. Taylor recommended this matter be handled as a work session by the entire commission. 76 Mr Kell suggested the staff propose the methodology for preparation of a recommended General Plan Further, staff could prepare a calendar (strategy) and present it to the commission, at which point the commission would begin the work session 77 Mr Gero stated that a calendar can be prepared by staff and then a meeting with the Executive Committee ofirk (Chairman and Vice Chairman) can be arranged 78. Mrs. Taylor suggested a training program be organized by staff to help the commission members be most effective. 79 Mr Gero commented that a related topic workshop has been requested and it might be possible to combine these interests in Planning for a very productive session. 80 Chairman asked staff to brief the commission on the next agenda item 81 Mr Gero explained that these materials were for the commission's information. 82. Chairman continued to the next item of business. 83 Mr Gero deferred to Mr. Oltman, who serves on the Air- port Commission 84 Mr. Oltman stated he was pleased by the response to the Airport Study presentation Obtaining the land and funding will be the next step 85 Chairman invited comments regarding the airport or other business. 86 Mr Gero brought to the attention of the commission that copies of articles of interest have been distributed 6 of 7 Adak 86. Mayor Clarke offered to reestablish the Citizens' Advisory Committee if the commisiion desired assistance in preparing the General Plan. He went on to make two suggestions JaiN 1. All properties within the city zoned GR and yet divided into residential parcels be rezoned by Commission Initiative for the purposes for which the areas are presently being used 2 Encourage property owners in the central part of the city to rezone their residential property that is adjacent to commercial re- zoned property to CB-1 or CB-2 The reason for this is to promote business in the center of town rather than to force new businesses to locate on the outskirts. 89. Mr. Gero agreed with the suggestions and reiterated the efforts to document current uses of properties within the city A report will be presented soon as part of the Land Use Analysis 90 Mr Kell commented that as the General Plan completion • nears, the need for additional commission sessions should be scheduled Perhaps the calendar the staff is to present could include these additional meetings. He pointed out there have been frequent absences by one commission member and asked if any measure has been taken to resolve the situation 91 Mr Gero said he would have to review the attendance records of the commission and would provide a report. He stated the calendar would be ready the beginning of August 92 Chairman asked if there was further business. The motion passed 3-1 with Mr Burfiend voting present because he had not attended the meeting in question 5 Chairman announced that the section for public hearings was now open and asked Mr Newcomer to brief the Board on case BA-4-81 (Corsi) 6 Mr Newcomer explained that the applicant in this case is Norma J Corsi, the property owner of a parcel located en S Hilton Road The property is approximately 250 feet X 125 feet This is excluding the easements of 33 feet taken off of each side. He said the applicant is requesting permission to place a second mobile home on the property to house a family member There is currently one mobile home located towards the front half of the parcel He said the variance request is to put the second mobile home on and this would be a variance to Section 805 of the City Zoning Ordinance which retiuires the one dwelling unit per acre and a ouarter 7 Mrs Corsi explained that she brought a picture and a copy of her mother's income that she gets each month She said that her mother could not afford anything on her own and she was not able to keep her and what she wanted to do was set a mobile home on the parcel for her to live in Page 2 - Board of Adjustment Minutes of June 1, 1981 8 Chairman asked if the mobile home was going to go approxi- mately 80 feet behind the present mobile home. 9 Mrs Corsi answered "Yes" 10 Chairman asked how she proposed to serve another mobile home -� ""' •` 11 Mrs. Corsi answered another septic tank would be put in 12. Chairman asked how far was the mobile home from the wash 13 Mrs Corsi said it was probably three or four feet She ex- plained that there had only been water in there twice since she has lived there 14 Chairman asked if there was anyone who wanted to speak in favor of the applicant or in opposition 15 Mr Gullelson explained that Mrs Corsi lives directly behind him He said that he bought the property there for the spaciciousness of it, and that he plans to retire soon and live there He explained that if Mrs Corsi wanted to place a second mobile home on the property, she should also have to go through the'Grandfather" clause 16. Mrs Luddy asked just what his objection to Mrs Corsi placing another mobile home on her property was 17 Mr Gullelson explained that it would be back to back with his property r 18. Mr Corsi said that she was not behind him, but that the Quigley's were 19 Mr Gulleson said he was somewhat confused after he studied the map which was on the drawing board 00104 20 Mrs Cummings explained that she was opposed to having Mr Corsi place another trailer on her property because when she had purchased the land some ten year.s ago, it was with the stipulation that only one dwelling was allowed to 1: acres She said that they liked the area out there because it was sparsely populated and if an exception is made for one person, there will be others doing it, and then we will not have what we have out there now 21 Mrs. Corsi stated that there were others up in the area with more than one trailer on each lot 22 Mr Newcomer explained that any mobile homes out there, unless on an acre and a quarter now, would either be on a lot that was split below the acre and one quarter before enactment of the City Zoning Ordinance or else illegally put on at one time when the County had jurisdiction over the zoning 23 Mrs Corsi stated that her neighbors to the front, back, and side of her had no objections to her placing a second mobile home on the property et Page 3 - Board of Adjustment Minutes of June 1, 1981 24. Chairman asked if they had just one mobile home on their property 25 Mrs Corsi answered "Yes" One has a little house 26 Chairman asked for recommendation of the staff. 27. Mr Newcomer said that he had a letter from the City Zoning Administrator which read "Having reviewed the application with the City Attorney, it is my interpretation that the request falls within the Board's authority under Section 2403 (h) Because of the reason given for the requested variance, it is recommended that the variance be granted with the condition that when the applicant's mother no longer needs the use of the second trailer, the second trailer is to be removed Further conditioned, that the variance for the second trailer must be renewed in nine (9) months" 28 Mrs Luddy asked if the property was sold, would it be sold with the variance 29. COMMUNITY SERVICES SUPERINTENDENT SUBJECT. SOCIAL SERVICE BLOCK GRANT On Wednesday, August 5, 1981 , I attended a meeting in Mesa concerning Social Service Block Grants . In attendance were various social service providers from throughout the East Valley. The main issue discussed was Governor Babbitt' s recent appointments to a twenty-one member panel established to advise him on Block Grants in the area of social services . Apparently, fourteen members on this panel are from Maricopa ...... County, but not one represents services in the East Valley . All fourteen are from the Phoenix and Scottsdale area They are trying to form a group made up of city leaders (mayors , council members) to oppose the Governor ' s selection and get fair representation from the East Valley. I am sure you will be contacted on this matter in the near future, and I have included some material for your information. I will be glad to answer any questions . It is inevitable that such an effort will require cuts in federal spending, including cuts in the areas e , of health and social services. Such cuts, however, need not result in the dissolution of programs and elimination of effective and necessary services The major challenge to the Governor's Block Grant Task Force is to develop a methodology for allocating limited Federal and State human service funds in the most fair and equitable manner. There is only one truly equitable way to allocate the available block grant dollars in the social services (Social Security Act Title XX) and health areas - - assuming that these will be the primary block grants emanating from the Reagan Administration and the U.S. Congress. This would be to distribute the dollars for Maricopa County by population figures (absolute totals) and particularly by documented percent of growth during the most re- cent Census period (the 1980 U S Census) . This is the only way the East Valley can maintain its competitive stance side-by-side with the City of Phoenix and the balance of the County ,• DRAMATIC GROWTH For example, it can be noted in the statistics below that the rate of growth for the East Valley, as measured by the Census, is very dramatic 1980 CENSUS City or 1980 1970 Percent Change Town Population Population 1970-80 Chandler 26,673 13,763 115 6% Gilbert 5,717 1,971 190.1% ea Mesa 152,453 63,049 141.8% Phoenix 764,911 584,303 30 9% Tempe 106,743 63,550 68.0% TOTAL COUNTY: 1,508,030 971,228 53 3% The rapid growth of the East Valley area must be a significant factor to consider in the allocation of block grant funds As a result of recently released census date, Mesa, Arizona has been identified as the second fastest growing city in the United States. That fact must not be ignored by the state, especially since the East Valley area, with almost 300,000 residents, is, for example, currently receiving one of the smallest per capita allocations of State Behavioral Health dollars in the entire state: (6.37 as compared with 18.47 in South Phoenix, 11.64 in Flagstaff; 10.67 in Casa Grande, and 8.85 in Globe) Page 2 ALLOCATION PROCEDURE A procedure for allocating block grant funds, therefore, should be based on a clear understanding of where the funds are currently going, and where the greatest need lies! Although every agency may have to accept some cutbacks in funding, now is the time to rectify the gross maldistribution of behavioral health dollars among the various areas of the state And with the East Valley es area ranking third in the state in terms of population, behind only Phoenix and Tucson, that area must be given the opportunity now to develop a comprehensive health and human service delivery system for its citizens The East Valley area has already initiated several creative efforts to address impending human services funding cuts and should be supported by the State in these endeavors. The East Valley area has already demonstrated how a variety of human services can be delivered through a more efficient and co- ordinated effort such as the Tri-City Community Service Center currently housing forty-one (41) agencies The potential savings through sharing of administrative (clerical, receptionist, xerox services), professioral (social work, medical, public assistance staff, consultants) and maintenance/security services for a variety of agencies - is an excellent example of how local community leader- ship can impact on the improved efficiency in the delivery of human services. EAST VALLEY BEHAVIORAL HEALTH COUNCIL The establishment of the East Valley Behavioral Health Council is yet another step toward further coordinating human services at the local level, the emphasis here being on alcoholism, mental health and drug abuse. The Council believes that the anticipated cuts in human service funding should be addressed with an aggressive, creative approach toward organizing, or reorganizing the current fragmented system of care and treatment into a more efficient, co- ordinated and effective one. As a catalyst in the East Valley area, the Council does not compete with existing direct service providers, ^ but rather identifies ways in which available resources, personnel and facilities might be effectively shared, coordinated and utilized to the benefit of the local citizens As the East Valley area is severely underfunded in the Behavioral Health services, the Council is highly concerned that a fair and more equitable procedure for allocating human services Block Grant Funds be developed. LOCAL PARTICIPATION One of the keys in establishing a more effective and efficient local, comprehensive human service delivery system is to utilize the talents and resources at the community level. If a local area is to receive its "fair share" of Federal/State human service funds, there should be evidence that the local community is also contributing to that effort. There is no region in Arizona that has a better track record than the East Valley. The re- cent efforts of. the Behavioral Health Council and Mahnah Club of Mesa to establish a Crisis Nursery for Abused Children in the East Valley area is one shining example of local support. Through the active involvement and generosity of the East Valley community, only one-third (1/3) of the total, overall cost of de- veloping and operating that program will be born by the State. Page 3 Through coordination with the Governor's Block Grants Task Force, entities, such as the Tri-City Community Service Center and the East Valley Behavioral Health Council, could serve as invaluable resources to the State Health Department, and the Department of Economic Security. They could greatly share in de- veloping an effective process for establishing priorities, co- ordinating existing services, sharing expensive personnel among existing community agencies, and exploring new sources of support and funding within the local area. The East Valley is ready and willing to work hand-in-hand with the Governor's Task Force on block grants to effect an efficient and constructive approach to meeting the human services needs of Arizona.
