Amok VOTE: Unanimous The motion carried ACCEPTANCE OF THE MINUTES OF THE REGULAR MEETING OF AUGUST 5, 1981 Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE MINUTES OF THE REGULAR MEETING OF AUGUST 5, 1981, BE AND /IN HEREBY ARE, ACCEPTED AS PRESENTED. Councilman Hudson seconded the motion VOTE Unanimous The motion carried AWARDS, PRESENTATIONS, AND COMMUNICATIONS Councilman Shanks gave a history background on the life of Eleanor Lewis before presenting her with a Certificate of Appreciation. Her parents moved to Kings Ranch in 1948, and she moved to Apache Junction in 1950. She was teaching in Safford at the time, but this was her home then When Superior began their first school , she was one of their first teachers In 1953, she was a member of the Civic Club of Apache Junction, which was the first organization to further the interest of Apache Junction She also helped organize the Club and became Secretary the first year, the next year she was voted in as Vice President. Il She was the driver of the first school bus in Apache Junction, her own car She picked up kids as far as Sand Tanks, and squeezed them all into her car. She was the first head teacher of the first school in Apache Junction. The school consisted of two rooms, four teachers, /.1\ and she taught the first and second grades Until her last year, when she taught the sixth, seventh, and eighth grades She enjoyed her last year the most, as she had a great group of kids. She has always been interested in library work, and was involved three years before the Library Board appointment She had made donations to the Library for years, for memorials for long standing citizens. She was the first µN..�,y= _ .,,.,••. President of the Library Board She is a member of the Lost Dutchman Retired Teacher's Association, helped organize it, and was the first Secretary of that organization She is also the Chairman of the Legislative Committee of the Lost Dutchman Retired Teacher's Association They also do work with the Legislature As a token of gratitude and recognition and appreciation of faithful , meritorious service to the City of Apache Junction, for service to the City, and devotion to her duties as first President to the Library Board, the Certificate was presented Mayor Clarke stated he had a Certificate of Appreciation for Wendy Seeman, for her service as Apache Junction's first Easter Bunny, he asked that the City Clerk mail it to her since she could not be present Mayor Clarke stated REGULAR MEETING OF THE CITY COUNCIL PAGE TWO AUGUST 19, 1981 "There are presently 51 citizens of Apache Junction serving on Boards, Commissions, or Committees They represent all walks of life These people give their time and knowledge to help the City grow in a healthful and prosperous way. These people deserve our appreciation from time to time I have attended Committee meeting and worked with one person who to me has put in more time and effort than has been required of him This person has studied hard He has done his homework This person has earned the respect of his committee members, the public, the Council and the staff I believe that the Planning and Zoning Commission is probably the most important Commission to any city Certainly, the decisions they make touch more of the citizens than any other Commission, Board, Committee " Mayor Clarke stated he wanted to present a Certificate of Appreciation to George Baljo of the Planning and Zoning Commission. CITY MANAGER'S REPORT City Manager, Ray Lee stated that the Department of Economic Security facility plans to open on September 1, 1981 City Manager, Ray Lee called upon Mr. John Granillo who briefed the Council and public on the purpose and uses of the DES facility stating, "It will be used for food stamps, unemployment, job service, and many other services " PUBLIC HEARINGS C PROPOSED ORDINANCE NO. 105, PZ-12-81, TORAN (second reading) Mayor Clarke opened the meeting to the public. Joe Gero, Planning Director, briefed the Council and public on the application. r\ Mayor Clark asked if there was anyone who wished to speak in favor of or in opposition of the application Mrs Margaret Toran requested that the application be approved. Mayor Clarke closed the meeting to the public. Councilman Damiano seconded the motion Councilman Damiano recommended a large turnout of interested citizens if a rehearing is granted to be held in Apache Junction. Councilman Steelsmith requested that the Resolution be read in order that those present may be aware of /'► what was being sent to the Corporate Commission Mayor Clarke called upon the City Clerk to read the entire Resolution City Clerk, Marlis Davis read as follows: RESOLUTON NO. 81-14, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF 1HE CITY OF APACHE JUNCTION, ARIZONA, REQUESTING THE ARIZONA CORPORATION COMMISSION TO REVIEW THE RECENT RATE INCREASE GRANTED TO PALM SPRINGS WATER COMPANY, A SUBSIDIARY OF CONSOLIDATED WATER UTILITIES, AND TO CONSIDER TAKING APPROPRIATE ACTION. WHEREAS, a substantial portion of the Palm Springs Water Company certificated area lies within the city of Apache Junction, Arizona, and WHEREAS, citizens of this city residing in the Palm Springs Water Company certificated area must rely on said company for delivery of domestic water as a basic need, and - ^^ WHEREAS, it is commonly understood that this service is provided for the public health, safety, and welfare but that, as a private water company, Palm Springs Water Company is entitled to a reasonable profit, and, ( WHEREAS, numerous citizens of Apache Junction have approached and petitioned the City Council with regard to the new Palm Springs Water rates, such rates which these many citizens conted are beyond their economic means and are excessive for the service provided, all matters considered, and WHEREAS, several hundred of these citizens did attend and, through spokesmen, made comment at the Commission's public hearing on the proposed rate increase, such comment which seems to have been made but not with /1.11\ effect; and WHEREAS, the numerous citizens are requesting the City Council to petition the Arizona Corporation Commission, whose duty it is to establish fair rates, and to request a new public hearing and review of the recent decisions, NOW THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction, Arizona, that this Council does hereby request the Arizona Corporation Commission to review its most recent decision with regard to Palm Springs Water Company, and BE IT FURTHER RESOLVED that it is hereby requested that the Commission hold a public meeting in Apache Junction to explain the most recent decision and, if permitted by law, to take further public comment and any appropriate action deemed necessary. Unanimous The motion carried PROPOSED BUILDING ADDITION ) Director of Public Safety, Bill McDaniel, explained to the Council and public the need for a larger building, further stating that the work will all be done in-house, voluntarily as time permits REGULAR MEETING OF THE CITY COUNCIL PAGE SEVEN AUGUST 19, 1981 1 Mayor Clarke suggested that the amount requested be increased, because the amount requested would only provide for the absolute necessary space and the City would probably have to expand again in the next few months Councilman Eidson requested Chief McDaniel to tell him the additional amount necessary to accomplish the expanded size suggested by Mayor Clarke Mayor Clarke stated that he believed that the amount necessary was estimated at $4,000.00. Councilman Eidson MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE CITY MANAGER BE AND HEREBY IS, AUTHORIZED TO EXPEND FUNDS IN ACCORDANCE WITH THE PROVISIONS OUTLINED IN THE CITY CODE FROM ACCOUNT NO 005-114-533-12-72, IN THE AMOUNT OF $14,000 00 TO PURCHASE MATERIALS TO CONSTRUCT A ROOM ADDITION FOR THE DEPARTMENT OF PUBLIC SAFETY Councilman Damiano seconded the motion City Manager, Ray Lee, suggested to add to the motion an authorization for him to transfer funds from the Congingency Account as the Public Safety Capital Outlay account did not contain funds for the additional amount. EXECUTIVE SESSION, SEPTEMBER 2, 1981 _) Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT AN EXECUTIVE SESSION BE HELD IN THE CITY HALL OF APACHE JUNCTION, ARZIONA, ON SEPTEMBER 2, 1981, AT 6 00 P M FOR THE PURPOSE OF DISCUSSING PERSONNEL AND LEGAL MATTERS. Councilman Damiano seconded the motion. VOTE Unanimous The motion carried. INFORMATION, REPORTS, AND REQUESTS OF COUNCIL Councilman Steelsmith, Liaison member of the Planning and Zoning Commission, complimented the Commission on their fine performance. He briefed the Council and public on the Planning and Zoning Commissions current and future activities. Councilman Steelsmith called upon Joe Gero, Planning Director, to brief the Council and public on the proposed Resolution No 81-15 REGULAR MEETING OF THE CITY COUNCIL PAGE EIGHT AUGUST 19, 1981 _ Alink oak Director of Planning, Joe Gero, stated that the City of Apache Junction wants to notify the Bureau of Land Management of our definite interest in the 200 acres that is available as a recreational park. The purchase price now is $2.50 an acre, and beyond March of 1982, the price will be full market value, at which time the land will be offered to the State Land Department. Councilman Steelsmith MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT RESOLUTION NO 81-15, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, EXPRESSING THE CITY INTEREST TO APPLY, BY A RECREATION AND PUBLIC PURPOSES APPLICATION, FOR CERTAIN BUREAU LAND MANAGEMENT LANDS CONTINGUOUS TO THE CITY LIMITS. Councilman Damiano seconded the motion Councilman Hudson asked if the land purchased by the City would automatically become part of the City incorporation City Attorney, David Alexander, informed the Council that purchasing the land would not mean it was annexed The City would have to go through the necessary channels for annexation. VOTE Unanimous The motion carried. Councilman Shanks gave a brief report on the Parks and Recreation Commission. A master plan sets forth in broad terms a goal which is the best judgment for some specific future time. One has only to travel to each of the cities in Arizona to learn why master planning for governmental facilities is so important. Many city complexes find themselves enclosed by other development whereby needed expansion, modification, or parking cannot be accomplished. The result is either less efficient city services, or development of more expensive satellite services. PRC Toups' responsibility has been in two areas, which are: 1 ) By five-year increments, project space demands for a) needed services, b) possible other services. 2) Prepare one or more alternative city complex master plan recommendations. PRC Toups will be represented by Mr. John Stansel , who has been responsible for this project. Mr. Stansel has met on several occasions with city officials (elected and appointed) , city staff, and certain members of the community. He has had several critique sessions with one or more staff members. Included in his study was performance of a survey on city complex appearance and needs. Following his presentation, he will be available for questions. The Council may wish to take the presentation under advisement at the conclusion of the item. The staff requests, at City Council 's discretion, that direction be given as to the procedures to be taken in considering the report's adoption.
