VOTE Unanimous %-+-• -a- �r3-.:;,• .< ..., The motion carried AWARDS, PRESENTATIONS AND COMMUNICATIONS l Mayor Clarke asked Rocco Paffumi to come forward and called upon Police Chief McDaniel who stated "Rocco Paffumi found a portable radio that was the property of the Police Department, which was worth approximately $1,500 00 and would have been a big loss to the Police Department." He thanked Rocco Paffumi and his mother for their honesty in returning it Mayor Clarke stated "All the volunteers are to be commended for jobs well done, but once in awhile an exceptional person comes along and does more than his share Tonight, I would like to express our appreciation to an exceptional volunteer. Harvey Long has served on the Parks and Recreation Commission faithfully since November, 1980, which was the beginning of that Commission. He not only has attended every meeting, but actively participated in every event sponsored by the Parks and Recreation Commission. Harvey has also taken time from his family life to serve on the Land Use Committee and Equine Committee. The Parks and Recreation Commission automatically says, "Harvey will do it," when a volun- teer is needed Harvey is the first one to rise when a job needs doing, and stays until the job is completed His unwavering support of the City of Apache Junction and hours of contribution is to be commended Harvey Long is indeed a credit to his community " l Mayor Clarke then presented Mr Long with A Certificate of Appreciation REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 4, 1981 PAGE 2 CALL TO THE PUBLIC Mr. Theron Adams, representing the congregation of the Crossroads Southern Baptist Church requested the,Council give consideration to changing the meeting night of the City Council so the members of his and other churches may have the opportunity to attend Council meetings. Mr Richard Taylor, 616 S Saguaro, outlined the recent activities with regard to the request of the Corporation Com- • mission to hold another hearing on the Palm Springs water rate increase, stating that Senator Turley has also requested a rehearing in addition to the 1,200 signatures from the residents who live in the Palm Springs service area None of these requests have seemed to prompt the Corporation Commission to have a rehearing The Corporation Commission has requested that basis of fact be 'presented to include why the increase is unreasonable, and stating the dollars and cents Mr. Taylor stated that he had 35 to 45 errors and miscalulations on projections on which the Corporation Commission based their ratings on the projected income of the company He then read to the Council some of these errors, stating he would give the City Clerk a copy after the meeting He requested the Council, on behalf of the residents of Palm Springs service area, to re-submit a resolution with these facts of errors included Virginia Seeman, 1352 W Shiprock, Apache Junction, a representative to the Arizona Statewide Health Co-ordination Council (ASHCC) appointed by Governor Bruce Babbitt, informed the Council on the Arizona Health Containment System (AHCCCS) which has been under much discussion lately She presented information on the resolution of the Statewide Health Coordination Council (SHCC) and stated if the Council had questions they could contact her Mrs Seeman also urged the Council appoint the Community Health Commission as soon as possible John Forsberg, 269 N Windchester Road, spoke to the Council regarding the Airport Commission, stating that it would be in the best interest of the commission to have two more members and urged the Council to vote favorably on this issue because it was difficult to have a quorum with a five member board Mr Forsberg further stated that he wished the Council to give con- sideration to persons outside Apache Junction, as several good pilots have requested to be appointed to the Board Dick Rabidue, 575 W 23rd Avenue, spoke to the Mayor and Council as a member of the Charter Government Committee request- ing that the Council consider neighborhood councils Mr Rabidue presented the Council with information regarding neighborhood councils which was obtained from the City of Chandler Mayor Clarke thanked all those who spoke, and specifically commented to Mr Rabidue regarding the neighborhood councils, stating that he would like to wait for the Charter Government Committee recommendations before any more committees are appointed CITY MANAGER'S REPORT _ Acting City Manager McDaniel introduced Mr Lant Haymore of the audit firm of Haymore and Busby of Tucson who presented the 1980-81 audit of the books for the City of Apache Junction Mr Haymore stated that the city has grown tremendously He commended the staff, stating .hat they have improved in their REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 4, 1981 PAGE 3 SDI eMN effectiveness Haymore further stated that he was concerned about the computer some months ago, however, now he understands it 0.1141 will be fully operational soon He explained how it would help as soon as the computer becomes fully operational He reminded the Council they had received the audit report a week previous, and he asked if they had any questions Acting City Manager McDaniel called upon the Planning Director, Joe Gero, who introduced Mr Dick Kaku of PRC Voorhees, Los Angeles, a Division of PRC Toups Mr Dick Kaku presented a slide presentation of the Transportation Plan to the Council and citizens who were present Mr Gero stated that Mr Kaku would be available for questions in the Community Center after the Council meeting Mayor Clarke requested a break at 8 00 p m The Council re-convened at 8 17 p m. A water line will have to be extended along 4th Ave. east to the Main Entrance of the park. One hydrant to be placed on the NW corner of this entrance on 4th Ave. The Water line is then to run East on Long- view Drive to Westward Lookout Drive and South to Superstition Look- out Drive, the second hydrant is to be placed on space 168 in the NW corner; Water line continues West on Superstition Lookout Drive to Hilltop View Drive and then North to 4th Ave and connected to the water main. The third hydrant will be placed on the South side of Superstition Lookout Drive between spaces 143 & 144. It is recommended that the finished floor elevations of the travel trailers be designed for a minimum of 14 inches above outfall of each lot, for every lot in the development. Lots 157 thru 166 encroach into Flood Zone A, and access to lots 134 thru 138 falls within Zone A, on the plan submitted for review. Development in the 'A' Zone is strongly discour- aged; however, if the developer can show channel modifications that will accommodate the expected 100-year flow of 5480 cfs, plus bank protection to prevent erosion, approval of encroach- ment will be studied. The plan from Doug McGillivray of Engineering & Surveying of Arizona, received by the City Engineer August 17, 1981, does not adequately address the requirements for building in a flood zone. The plan accompanying this rezoning request is essentially the same; additional engineering is needed. For information only, attached is a copy of an acceptable chan- nel cross-section to carry the 100-year flow past the subject property. It requires a 146-foot strip to be reserved for channel purposes. The existing 'A' Zone is much wider (up to 320 feet wide, crossing the subject property) because the existing 'natural' channel is only three feet deep and 40 feet wide. Any fence within the 'A' Zone should be either parallel to the flow, or built in such a way to present no obstacle to flood- waters. An un-slatted chainlink fence is considered an obstacle to flow, as it is normally constructed. The Legal Description of Right-of-Way should be entered onto either a Quit Claim Deed or an Easement Grant, then properly executed for processing by the Engineering Division. A copy of each blank form is attached. Before the remainder of parcel 19 is developed, further flood protection will be required, as well as right-of-way dedication to Tomahawk Road. No objection to the proposed rezoning. Entries are asked to check in with their division officials prior to prejudging which will begin with Division I at 8 30 A. M. The parade will start promptly at 10:00 A. M., Saturday, January 30, 1982. • 2. Every entry must display their number clearly on the right side for the judges to see. Your Division Official has your identification number. 3. The set pace of the parade must be maintained by all entrants. Unnecessary halting or delays are prohibited. 4. All horses must be freshly groomed the day of the parade. They will be inspected by the Division Officials. The following points could result in your animal or animals being placed in a non-judging category and/or rejection as a participant. A. In the interest of safety, all floats and parade vehicles will be fully operable and in a safe condition. 6. No drinking of alcoholic beverages from open containers will be allowed (1) at the parade assembly area, (2) while on horseback or any parade float or vehicle, (3) during the parade, or (4) at the disbanding area. 7. The discharge of firearms or fireworks during the parade is prohibited. This does not include "start" guns or "blank" cartridges, specifically approved by the parade Officials. 8. Throwing or passing-out of candy, gum, balloons or other objects from the parade route is prohibited without the expressed permission of the Parade Officials present. 9. Parade participants will exercise the utmost discretion when spectators are taken into "custody" or "forced" to ride in parade vehicles or upon parade animals. This practice is discouraged if the spectator shows any sign of reluctance whatsoever. 10. Extra vehicles not used in the parade may exit University (Superstition) south on Merdian Road or north on Delaware to Tepee Drive for reloading at termination of parade. 11. Large vehicles and floats are encouraged to enter "line-up" positions from the rear (where possible) to avoid havings to turn around. 12. Trophies will be awarded at the Superstition Park shortly following the parade. 13. Auto Clubs-a maximum of the four best of your club will be shown as a group entry. 14. The aforementioned has been posted and advertised in the newspaper. Included is a signed quote, a bid specification, and pictures of the roller. Having inspected the equipment, I found it to be operational, however, it will require an overhaul on the engine, two U-joints and some chain work. The roller has also been checked by Buzz Worsley, who estimated that the total repairs to be less than $300. The value of the roller is approximately $15,000. "0. If future road work for dirt control or soil stabilization is expected, we will need a roller whether we rent or buy. The weekly rental on a similar machine in $400 per week. For example, to rent a roller to work twelve miles of dirt road for a mile a month program, would cost a minimum of $4,800. With this and other construction projects, we feel the roller would pay for it- self in less than one (1) year. Cosidering the above, I recommend that we purchase this Ingram pneumatic roller from account #002-112-523-13-72. Chairman invited comment in favor of the application 26 Everett Walker introduced himself as the applicant and asked the members for questions 27 Ms Taylor asked if there was an easement through the middle of the parcel, a side parcel seems to be added 28 Mr Walker explained that that parcel is requested to be included in the rezoning since it is landlocked from the east 29 Ms Taylor asked if storage space for residents was being included in the plan 30 Mr Walker answered that he was not allowing for storage space 31 Ms. Baker asked if a wire fence was planned 32 Mr Walker replied that masonry fence would face the streets and chain-link with screening would be used else- where, masonry may be used in total 33 Mr Hall pointed out that a wire fence along lleekes' Wash would not be adequate 34 Mr Walker explained that he was working with the city engineering department on such matters 35 Mr Gero reminded the Commission that the final development plans would be subject to approval of the city engineer to ensure compliance with the Federal Flood Insurance program and 100-year flood regulations 36. City Council the approval of said application The approval being contingent upon the following stipulations (to be attached to written ordinance) and the reasons are that the application is in compliance with Section 33 09 of the Zoning Ordinance " 40 Chairman opened the public hearing of PZ-18-81 (Hare) He asked staff to inform the membership concerning this case 41 Mr Gero delivered the required data regarding this application 42. Chairman invited comments from the applicant 43 Robert Lake introduced himself and indicated he had power of attorney 44 Ms. Taylor excused herself from this public hearing due to a potential conflict of interest as a land- 1( owner within the 300' radius of the property in question 45. Kell asked if the roadway to run through the property has been dedicated 46 Mr. Lake answered affirmatively and mentionec a small wash on the east side that may need a bridge sometime in the future �� 47 Mr Gero indicated there may be other solutions to tt/ 1 the property might be developed as one unit with a street abandonment. 48. Chairman asked if this was pertinent at this time 49 Mr Gero noted that if the applicant intended to develop it as a single unit, it would be recommended that application be mace as soon as possible However, this is not germaine to the rezoning question at hand 50 Chairman asked if there were comments in favor of this measure. { f 51 Mr Frank Byrds introduced himself and asked that the applicant submit a more definite plan for use of the land 52 Chairman asked staff if a planned development for this venture could be submitted at a later date 53 Mr Gero responded that if the Council approved the rezonino to CB-2 for this parcel, a zone change would not be required in the future for planned development 54 Chairman asked for comment in opposition Page 5 - Planning and Zoning Commission Minutes of October 13, 1981 55 Pastor Hibbard introduced himself and said he only wanted verification of the type of park this would be, his letter indicated it would be a mobile park 56 Mr Gero asked from where the letter of notification came 57 Pastor Hibbard stated it came from the city Planning Office, 58. Mr. Gero he believedwondered if some confusion might have arisen from more than one case being listed on the Public Notice that accompanied the letter of notice 59 Chairman pointed out that if anything was to be done with 20th Ave ,it would entail a separate hearing 60 Mr Gero confirmed this stating that no application concerning that roadway had been submitted 61 Chairman again asked if anyone wished to speak in opposition to this application There being no comment, staff was directed to summarize 62 Mr Gero referred the members to the DCC comments, including a memorandum from the city eneineer, which was in the members' packet 63 Chairman closed the public hearing. 64. Mr. Gero clarified a reference to spot zoning by defining a GR district as a "holding classification" pending the city's decision concerning the permanent zoning of an area He suggested that, since a permanent zone district had not been established spot zoning would not be an applicable description in this case He submitted to the Commission that they may wish to determine by use, and use in the area, whether this would be a spot zoning 65 Chairman asked if any member of the public now had comment 66 Mr Byrds asked if there was a time limitation on the rezoning. 67 Mr Gero commented that legal opinion had been requested in the past concerning reverter clauses It was determined that the City Council can place a reverter clause in their decision, and the land would revert back to its original zoning, if the applicant failed to perform as required It was advised that use of this clause be sparse since it leaves land in a tentative zoning classification for that time period and its status would be questionable if it were sold The Commission may recommend to the Council the reverter clause and Council may attach a reversion as a stipulation and state a specific period of time 68 Mr Byrds commented that he and his neighbors would be receptive to such a recommendation 69 Chairman asked for further comment 70 Mr Kell suggested that this matter be tabled until the Land Use Plan is completed (prior to the next regular meeting) since there is nothing to indicate that this area would be zoned commercial. AilmN Page 6 - Plannina and Zoning Commission Minutes of October 13, 1981 71 Chairman called for other comment 72 Mr Gero pointed out that it might be appropriate to invite comment from Mr Lake at this time. 73 Chairman did invite Mr. Lake to comment. 74 Mr. Lake asked what Mr Kell meant, commercial zoning { exists along much of Highway 60 /fir i1 75 Mr Kell explained that he is looking at the entire 1' N area in which there remains much General Rural He clarified the fact that he is not opposed to commercial zoning; but only with Parcel 1, which is set off away from the highway and with what might be recommended by the General Plan when it is completed 76. Chairman called for a motion 77 Mr Kell wondered if Mr Lake's client would mind waiting_ until the next regular meeting of the Commission for a decision In that way, the General Plan will be complete and present questions could be resolved by the recommendations of the General Plan. 78 Chairman posed the question to Mr Lake. 79. Mr. Lake accepted the proposal to table the issue until the next regular meeting of the Commission of November 10, 1981 80 Chairman again called for a motion 81 Kell/Baker M/S "BE IT RESOLVED by the Planning and Zoning Commission of the City of Apache Junction, Arizona, that in rezoning case PZ-18-81, also known as Proposed Ordinance No 116, application of Robert Hare for rezoning from General Rural (GR) to CB-2, be and hereby is tabled until November 10, 1981, at 7 30 p m , in these chambers " 82 Chairman continued the proceedings by introducing the next case, SN-2-81, and asked staff to brief the Commission 83. Mr. Gero outlined the definitives of the case, including the suggested alignment, name assignments and street name changes 84 Chairman invited comment in favor or opposition There being none, he called upon staff for summarization. 85 Mr Gero explained the advantaaes to address assignments this would present 86. Chairman asked staff to brief the Commission on the Pinal County case PC-PZ-21-81 (Dickey) 89 Mr Gero presented the statistics of the case to the Commission The application is from General Rural (GR) to a new county classification "Recreational Vehicle Park (RVP) " 90 Chairman invited the applicant to speak 91 Mr Dickey introduced himself and described the desired addition to nis current facility 92 Chairman invited questions from the Commission members 93. Mr. Kell declared a potential conflict of interest and abstained from discussion and voting on the issue 94. Mr. Andrus introduced himself and thoroughly described his property and his intentions for developing the property 114 Mr Kell asked if the park planned was an adult park 115 Mr. Adrus answered affirmatively 116 Mr Kell asked if sewaoe was to be handled by septic tanks 117. Mr. Andrus answered affirmatively 118 Mr Gero addressed the 100-year stormwater requirement. 119. Mr Andrus confirmed that his plans complied with that requirement. 120 Mr Gero presented comments from the city engineer concern no pedestrian traffic safety due to University being the sole access to the park. 121 Mr Andrus explained that pedestrian traffic was not limited to the University access, Dates allow access along other borders for residents to cross over to the other parks and to amenities 122. Mr Kell commented that the density in this area should be considered relative to sewage and water 123 Chairman invited comment in favor or opposed to the y/mill 124 Mr Andrus pointed out that the proposed park's density - is less than it could be and less than currently possible under existing zoning 125 Mr Gero asked if having applied for a Special Use Permit binds the applicant to the plan design submitted 126. Mr. Kolar introduced himself as President of the Apache Junction Jaycees He promotea the area of the proposal as compatible with its surroundings 134 Chairman asked if there was comment in favor or opposition to this case. 135 Mr. Carl Otherson introduced himself and spoke in favor of the proposal as being conducive to local business and as an amenity for Apache Junction residents 136 Mr Gero submitted to the Commission that the Resolution to apply for acreage for a City Park mioht be included with its letter of reconunendation since the areas are adjacent 137 Mr Kell commended the Jaycees for their community awareness and cooperation in acquiring an alternative site for their proposal. 138 Mr Gero pointed out that both borders of the proposed site are on arterials and these should be dedicated as a stipulation, and the adjacent property owners would be responsible for the off-site improvements 139 Chairman called for a motion. 140. Mr. Urban stated he had had contact with Mr Phil Yarnell who was in possession of a mobile concession stand. Mr. Yarnell would like to handle the concession on October 24, 1981 at the Boxing Tourna- ment, donating 15% of the gross proceeds to the swimming pool fund In this way, the concession would be taken care of with no involvement from the Commission Harvey Long made a motion to allow Mr Phil Yarnell to take care of the con- cessions on October 24, 1981 with 15% of the gross proceeds going to the swimming pool fund Ron Staples seconded the motion which carried unanimously Jeff Bell stated at the request of the Commission he had checked into the leg- ality of no water at the ballfield There is no problem as long as people know there is no water The water line comes out of the school's well and is not suitable for drinking It is used only for irrigation On updating the Commission on activities, P & R Commission Regular Meeting September 28, 1981 page 2 Mr Bell stated the adult tennis lessons for both beginners and advanced students had begun with Al Cranmer teaching The softball league would be approaching an end in about three weeks and had been going on nearly 4k months He also t9011IN the Commission about the Pre-School pi gram planned to begin about October 13 The City Complex Park was the next item of discussion The basketball standards are ready to go in, volleyball standards were being shipped and should be here any time The other equipment will be installed as the public works crew has time Railroad ties will probably be used around the perimeter of the volley ball court Curbing would cost too much Ten lights had been acquired for the lighting of the park Janice Palson was introduced to the Commission at this point as a prospective member Jeff Bell explained to the Commission that out of the four talent bank applications submitted, two were already appointed to other Boards ( INFORMATION BOOTH Il REPORT Margaret Carlin stated she had attended the last Lost Dutchman Days meeting, and there were still details to be worked out By December, plan would be more finalized LAND USE REPORT Harvey Long stated he had gone on a tour sponsored by the Planning Department on Saturday The Committee is working on a master plan of land and the useage of t e land Discussion was held on the are BLM land that is to be sold for recrea tional purposes at $2.50 an acre This area is 276 acres plus the 20 acres the JayCees have applied for The application is due in April The land use study is a master plan of zoning, streets, density of population, etc .. w. .�.�...._ " ` MOVIE UPDATE Sharon Seder told the Commission the first movie, Dr. Dolittle, had gone well for a first The total cost was $140 91 which included rental, postage, and projectionist The next movie will be titled "It came from Beneath the Sea", and will be shown on October 31st BOXING TOURNAMENT Was discussed earlier TRANSPORTATION GRANT Jeff Bell told the Commission the Trans- portation Administrator in Phoenix was meeting with him on Wednesday to offer suggestions The Office of Economic Planning and Development had said the grant looked good They wanted the City to expand on services to be offered Jeff hopes of receive information from the Wednesday meeting of what these expanded services would entail as far as administ- ration and operation Apache Junction was 1 P & R Commission Regular Meeting September 28, 1981 page 3 the only city who had applied for the grant, and OEPAD is encouraging accept- ance A general discussion followed regarding the grant PIN HALLOWEEN PLANS Harvey Long is making the Great Pump- kin to be used at the costume contest DeDe Scheff has a master of cermoney lined up Phil Richardson has a 16X8 flat bed truck to be used as a stage The judges will be picked from the community, sacks of penny candy will be given to the kids, and we will also have a jack-o-lantern contest Phil Richardson made a motion to have a stand with pumpkin pie and coffee for sale at 75 DeDe Scheff made the second with motion passing unanimously Phil Richardson made a motion to provide koolaide for the kids at no charge, with Harvey Long making the second Motion passed unanimously Harvey Long made a motion to have the Halloween party in the City Complex parking lot at 3 00 p m on October 31 ( with Phil Richardson making the second Il Motion carried unanimously Harvey Long offered to donate the kool- aide and Lois Broman the cups and plates NEW BUSINESS TRAVEL TOURS Jeff Bell stated a travel agency from the Mesa area had contacted him regarding group tours His feelings are if we did /NAN get involved with tours, they should be done with a local agency, but he felt we should not get involved at this time Michael Carden made a motion to hold off on sponsoring tours until a more desireable time Harvey Long made the second to the motion which carried unanimously RECOMMENDATION OF NEW MEMBER Janice Palson spoke to the Commission on her desire to serve on the Commission. Margaret Carlin made a motion to recommend to the City Council the appointment of Janice Palson to the Parks & Recreation Commission Phil Richardson seconded the motion which carried unanimously Michael Carden made a motion to have a prioritized list beginning with Hazel Sanders for the next vacancy on the Commission Lois stated what if there were more applications in the talent bank when a vacancy needed to be filled If there was such a list, the others could not be considered The motion failed for lack of a second / 1 / IN P & R Commission Regular Meeting September 28, 1981 page 4 4 FEE FOR SUPERSTITION MTN BALLFIELD Jeff Bell reminded the Commission that a fee had been set at $8 per hour for the use of the new ballfield Superstition Mountain Elementary School ballfield did not warrant that large a fee. Jeff few that $3 per hour was more appropriate that the $10 flat fee per night would cover the cost of the field Harvey Long made a motion to set a fee of $10 per night for the use of the Superstition Mountain Elementary School ti ballfeild DeDe Scheff made the second, and the motion carried unanimously BOARD DISCUSSION Lois Broman read a letter from the Apache 4 Junction Chamber of Commerce to DeDe Scheff thanking her for her entry in the Lost Dutchman Days Parade theme contest.
