Z diRIZON • ,D2�` U @ ��1c�C�2e 0 u c ZJn January 5, 1982 MEMORANDUM TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL THROUGH: ACTING CITY MANAGER `v e,n'J FROM: ACTING CITY CLERK SUBJECT: REQUESTED CHANGE IN AGENDA ITEM PLACEMENT Prior to the consideration of Agenda Item #10 concerning the study of the annexation of property for the proposed Apache Junction Airport, the Council should first take the necessary steps to accept the Master Plan and Site Selection Study and Final Report for the Airport. Therefore, the Director of Public Works has requested that the Council switch the placement of Agenda Items #9 and #10 in order to accomplish these steps. This switch can be made during the acceptance of the agenda. Recommended Motion: "Be It Resolved by the Mayor and City Council of the City of Apache Junction, Arizona, that the Agenda be accepted as presented with the exception of the placement of Agenda Items #9 and #10 which should be considered in the reverse of their present order." AWARDS, PRESENTATIONS AND COMMUNICATIONS NONE 1 CALL TO THE PUBLIC Ms Midge Conway, 902 South Ocotillo Drive, Apache Junction, Arizona, reported on the Charter Government Committee, stating that the meeting dates have been changed to the second and fourth Thursday of every month. Ms Conway invited public input. , _ „ �,,N., CITY MANAGER'S REPORT Acting City Manager, Bill McDaniel , commended the Department of Public Works on the cleanup on the Plaza Drive intersection. ( Director of Public Works, Rich Broman, stated that the striping L in the Highway 88 passing zone has been redone. Mr. Broman introduced Mr Ken Hamblin, District Traffic Supervisor, who addressed the Council regarding the reduction of the 45 MPH speed limit on Highway 60 through Apache Junction Mr Hamblin introduced Mr David Oliveras, Traffic Engineer in charge of State-wide operations, who addressed the study conducted on the speed limit. The procedure and results were explained, those being that the speed limit should stay as is, since the studies showed that this is what the average, prudent driver can and will safely drive - Councilman Hudson stated that the normal population of Apache Junction does not drive that fast - Mr. McDaniel , stated that the Apache Junction Department of I Public Safety accident statistics indicated a greater rate of accidents and fatalities Several Councilmen requested that the Department of Transportation re-evaluate the study on the average speed limit on Highway 60 through Apache Junction Mayor Clarke stated that it was obvious that the Council and public were unhappy with what the Department of Transportation study results 1 .---- -— were, and that special attention should be given to the problem since Apache Junction has unique circumstances. Ms Stevens, 612 North Signal Butte, Apache Junction, a Social Worker employed by Mesa Lutheran Hospital attached to the Apache Junction Medical Center, explained the purpose of the resolution and requested that the City give their support Ms Stevens stated that the East Valley is very concerned by the attitude of the State government officials regarding distribution of funds for human services, and the purpose of the East Valley Coalition is to urge the Governor's office to base the distribution of funds on population and growth Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT RESOLUTION NO 81-23, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, ENDORSING THE DISTRIBUTION OF HUMAN SERVICES FUNDS AMONG ARIZONA CITIES IN A MANNER WHICH IS EQUITABLE AND TAKES INTO CONSIDERATION THE POULATION GROWTH, BE AND HEREBY IS, APPROVED. Vice Mayor Hill stated that the representatives from the cable television companies in the past were not speaking to sell , but were there to inform the Council and public of the benefits of cable television Councilman Hudson stated that more -=•'v_ investigation and time was needed in the issue VOTE: In Favor Councilman Hudson, Councilman Shanks, Councilman Steelsmith, Councilman Damiano, Mayor Clarke. VOTE Unanimous The motion carried INFORMATION AND REPORTS (COUNCIL LIAISON REPORTS) Councilman Damiano reported on the Airport Commission meeting on December 7, 1981, regarding annexation of the proposed future airport property to the City of Apache Junction A full report on the Master Plan of the airport will be presented to the Council in the future, for action. Councilman Damiano Junction had been incorporated five years also stated that if the City of Apache p ago, the City would have the possibility of profitable projects such as Hughes Aircraft Councilman Eidson reported that the Personnel Committee had worked hard on City Manager applications and would be presenting applications to the Council in January He congratulated Acting City Manager, Bill McDaniel, on his efforts. She added that the Council should decide if the money could be used in a more prudent way Director of Public Works, Rich Broman, stated that this is an excavation problem that is compounded by the existing water line The problem only exists when it rains and the Council would need to decide whether to repair this dirt road, or to repair existing paved streets Councilman Shanks stated that as there are other priorities, the Council consider postponing these repairs at the present time Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE CITY COUNCIL HEREBY DIRECT THE DIRECTOR OF PUBLIC WORKS THROUGH THE ACTING CITY MANAGER TO POSTPONE MODIFICATIONS TO ELIMINATE THE PONDING ON 4TH AVENUE EAST OF WINCHESTER Councilman Eidson seconded the motion. ,Imk Councilman Hudson stated that this problem has existed for some time, even before the City was incorporated Mayor Clarke stated that the finances are not available at this time for this project. VOTE Unanimous •„—•-•- f S«« .• The motion carried Councilman Shanks read the following letter To City of Apache Junction "I have asked Councilmember Shanks to present this letter before the City Council on my behalf due to illness restricting me to complete bed care. It pertains to handicapped parking spaces I feel this should be put on the agenda - acted upon - adopted as a City ordinance and totally, completely inforced'' Attached to this letter is an "Application for Permanent Disability Plates". Many people have never seen these forms I would like every Councilmember to read this form if they are not familiar with it Handicapped plates are simply not handed to you Also, no physician is going to fill out the "Examining Physician" part and perjure . himself. CITY CLERK SUBJECT: REQUEST FOR AGENDA ITEM PLACEMENT - - - LOCATION TRANSFER OF LIQUOR LICENSE DISABLED AMERICAN VETERANS - PUBLIC HEARINGS In accordance with the procedures for processing applications for liquor licenses , notice was posted on the premises at 1422 East Broadway Avenue, Apache Junction , Arizona on the 7th day of December, 1981, by the Acting City Clerk. The notice remained posted for twenty (20) days , during which time written arguments in favor of or in objection to the proposed license were to be filed with the City Clerk. As of this date, there have been no objections addressed to the City on this matter. Correspondence has been received from the Director Public Safety and the Director of Public Works , a copy of each which is attached. The next step in the procedure is for the Council to hold a hearing on the application and make recommendation for approval or disapproval to the State Department of Liquor Licenses and Control . Box 2316, Apache Junction, has applied for the abandonment of N. Gold Drive from W. Tepee Street to W. Foothill Street, and W. Smoketree Street from N. Ironwood Drive to N. Valley Drive, as shown on the attached map. The applica- tion fee of $250 was received, as well as an application form from each of the five property owners adjoining the 66-foot-wide patented easements in question. Information was circulated to city departments and to utility companies. Their comments are summarized as follows: Public Works Department Since the abandonment of public access on the two streets would remove one half mile from maintenance responsibility, the Operations Division has no objection. In accordance with the Street Classification Plan, no abandonment should be approved within 50 feet of the center of Ironwood Drive nor within 40 feet of the center of Tepee Street. In addition, 17 feet of right-of-way should be dedicated by the owner of parcel 21-A, and 7 additional feet by parcels 29 and 30-D as a condition of approval. So that parcel 21-B does not become land-locked, the abandonments should be made only upon creation of the proposed cul-del-sac street from Ironwood Drive. The two streets in question are classified as local residential streets and as such would not adversely affect the city's trans- portation network by their abandonment. Planning Department The owners of parcels 19 and 20 will have to plan carefully to avoid double frontage. No objection to the abandonment. Public Safety Department No objection. oft. The City relinquishes its interest in the patented easements only to the extent that public access is abolished. The entire area under question should be retained for public utility easements. 2. The east 50 feet of Ironwood Drive and the north 40 feet of Tepee Street be retained right-of-way easements. 3. Contingency or contract zoning is a legally permissible action on the part of a legislative body . I personally do not favor such use of the zoning power since it entails questions involving possible breaches of contract as well as creates administrative burdens upon the legislative entity to insure that the promises made by petitioner are fulfilled. I, therefore , suggest to you that contract or contingency zoning be sparingly used and that such use of the zoning powers should not be the general rule. The specific case that you suggested to me, I do not feel fits within the purview of contingency or contract zoning. You suggested to me an instance where a zoning amendment would be contingent upon some future act of the same legislative body. In my opinion, this would be an inappropriate use of the power to use contingent zoning amendments . Rather than to pass a contingent zoning amendment in this fact situation , I would recommend that the zoning amendment proposal be tabled until the contingency is removed by subsequent legislative action. Page 2 , Mr. Joe Gero December 2, 1981 In the instant case, it is my understanding that certain roads would necessarily have to be abandoned prior to Mr. Tandy ' s proposed use to conform CO the current zoning ordinances . It �• is further my understanding that the abandonment issue will come before the council on December 16 , 1981 , and I , therefore, suggest that the petition be tabled until that date . This suggestion assumes that some formal motion would have to take place at the December 2, 1981 , City Council meeting. From my review of the Council packet, it appears that the Tandy petition is only scheduled for public hearing and first reading at this Council meeting, and therefore , I question whether any action need be taken on this particular petition. Mr. Hirsch has indicated to me that there has been some question as to the validity of the Planning Commission ' s recommendation. It is our understanding that the Planning Commission recommended denial of the Tandy petition because his use did not conform with Apache Junction ' s General Plan. As you are aware, Apache Junction has no general or comprehensive plan at this time ; therefore, I would suggest to you that the basis for the Planning Commission ' s decision is probably inappropriate and another alternative that might be available to the City Council is to return the petition to the Planning Couuiiission for re- consideration. LETTER OF INTENT: It is our intention setforth herein, as owners of the 5 acre parcel of land described below to rezone said property from the " General Rural" classifica- tion to "TH-PD". In doing so, our purpose is to create an attractive mobile home neighborhood consisting of a maximum of 12 mobile spaces each with a Cminimum size of 14,000 square feet. Included in the development will be the construction of a private road allowing access to each space. The roadway will be engineered in such a manner as to include easement space necessary to conform to city requirements regarding surface, curbing, and gutters should it become desirable to make it a dedicated public street at a latter date. As owners and developers, we are fully aware, and in complete understanding of the limitations setforth by legislation governing the current Arizona ground water laws. We intend to remain within these limitations. On rezoning from G.R. to T.H. -P.D. we plan to reside on the site, making it our home. The remainder of the property will be split into large mobile home spaces to be offered on a rental basis, each to conform to the minimum space size as mentioned above. Other restrictions will also apply and be enforced, such as. * doublewide mobiles only * increased setbacks: 20 ft. in front; 15 ft. rear and sides. * 10 ft. front or rear patio with 10 ft. awning. * one mobile per space. * mobiles to be ground level with proper drainage and retention. At some time in the future when, and if the ground water problem has been resolved, we may wish to offer the spaces on a "for sale" basis, thus creating an upgraded mobile home subdivision. In doing so, we feel that a real need will be met in the community and will be a definite asset to the City of Apache Junction. It will offer an attractive alternative to conventional TH living that involves a 3000 sq. ft. space in a congested park, and to the 1k acre requirement in GR zoning, which is often too big and too eicpenvlve for many of our residents to buy and to keep up. At which time it were posaiblu to create a subdivision, we would, of course, proceed through the proper channels with the Arizona Dept. of Real Estate in conjunction with the City of Apache Junction. HERE AND NOW, HOWEVER, OUR ONLY DESIRE, INTENT, AND REQUEST IS FOR A ZONING CHANGE FROM "GENERAL RURAL TO TRAILER HOMESITE - PLANNED DEVELOPMENT. We feel the important matters at hand in this request are. 1 We are not attempting to create a mobile home subdivision! 2. We are trying to build a mobile home neighborhood consisting of a maximum of 12 spaces (to be rented) located in an area where adjacent properties are currently offering as much as 46 spaces per 5 acres. 3. RECITALS . 1. Association is the owner in fee simple of certain real property, a library building and certain fixtures and personal property located at 122 East Second Avenue, Apache Junction, Arizona, whose legal description is . Lots 50 and 51 , APACHE JUNCTION PLAZA, according to Book 10 of Maps , Page 41 , of Pinal County, Arizona. 2. City was incorporated on November 24 , 1978 , and currently has no public library. 3 Association wishes to donate its real property, ° library building, fixtures and personal property , located at 122 East Second Avenue, Apache Junction, Arizona, to the City, and the City wishes to accept such donation. TERMS 1. Association hereby donates to the City the Public Libzary located at 122 East Second Avenue, Apache Junction , Arizona, whose legal description is as follows : Lots 50 and 51 , APACHE JUNCTION PLAZA , according to Book 10 of Maps , Page 41 , of Pinal County , Arizona, said donation to include all the real property owned by the Association at the above described property, all buildings , all cash except the sum of $1 , 500 , fixtures , and personal property located on said property. An inventory of the items included in this transaction is attached hereto and made a part hereof as though set forth in full , as Exhibit "A" 2. The City hereby accepts said donation and agrees to maintain said property in reasonable repair and to use said property for library purposes ; however, if the City builds a new City complex which includes library facilities , then the ° City may sell the donated, property or any part thereof, so long as the proceeds of the sale benefit the new library facility. /11 The Association donates said property and the City accepts said property with the understanding that the library will continue to operate on said property or a suitable alterna- tive location within the community. 3. The City agrees that all services offered by the library shall be made available to City and County eN residents alike, except non-residents may be charged a nominal service fee. Said service fee shall not exceed the sum of five dollars ($5. 00) per year for a period of two (2) years from the date of this Agreement. 4. Disincorporation: If the City should be dis- incorporated within two (2) years from the date of this Agreement , the City agrees that upon said disincorpoation the above described library, real property, buildings , fixtures and appurtenances shall revert to the Association. 5. By accepting said property, the City agrees to assume all responsibility, legal or otherwise, in connection with said property and library operation unless or until the above described library, real property, buildings , fixtures and appurtenances shall revert to the Association. RECOMMENDED MOTION: Be it resolved by the City Council of the City of Apache Junction, that the Department of Public Works be and hereby is directed, thru the City Manager, to co-ordinate as necessary to request the Arizona Department of Transportation to implement a speed test thru the city limits. It is recommended to the Arizona Department of Transportation that: 1. The speed test include areas between Meridian Drive and (choose one on next line) (Idaho Rd.) (Royal Palm Rd.) (Tomahawk Rd.) (Cortez Rd. ) (Goldfield Rd.) . 2. The speed limit be posted at 35 mph. 3. The speed test be implemented immediately because of the additional volume of traffic created by the winter visitors in the locale. 4. The speed test be in effect for a minimum of 120 days. Furthermore, be it resolved that the Department of Public Safety be and hereby is directed, thru the City Manager, to take appropriate measure to enforce the test speed limit by issuing warning citations to violators. WHEREAS, there is a necessity for low-income housing in the City Limits of Apache Junction, Arizona, and WHEREAS, the City of Apache Junction has no program established for low-income housing within the City Limits; and WHEREAS, there is a program that has been submitted to the City of Apache Junction by the Board of Supervisors for Pinal County for the establishment of conventional public housing on scattered sites throughout the municipal limits; NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction, Arizona, that the City enter into a Cooperation Agreement with the Board of Supervisors of Pinal County, Arizona, for the establishment of at least twenty- five low-income housing units, consisting of six one-bedroom units and nineteen two-bedroom units, to be designated as "conventional public housing units" and scattered on sites throughout the municipal limits. General Obligation Bonds Issue: This method of financing would create several problems : A. The need for a bond election to be held requesting voter approval the expenditure of bond funds. B. Bonds are paid for a tax levied on all property of the City. There is no tax levied by the City at this time. If Steps A and B can be overcome , the sale of approximately $175,000 principal amount of bonds sold over a five to ten year period at a rate of 14% would result in a tax rate of 20 to 30G per $100. 00 of assessed value. 2. Revenue Bond Issue: This is not a viable alternative simply because there is no specific airport revenue source to pledge for the payment of debt service. . y Page 2 3. Municipal Property Corporation: This method would appear the most advantageous to the City for a variety of reasons . A Municipal Property Corporation is set up as a vehicle for financing for the advantage of the City. The Municipal Property Corporation issues bonds which are secured by a pledge of the City' s Sales Tax. In addition, the State Sales Tax could be pledged. In Fiscal Year 1981/82 the City will also be receiving State Lottery monies for the first time, and if necessary to confort the bond buyer , these monies could be pledged if the City Council deems it necessary. The advantages are as follows: A. No property tax rate is established. B. Source of payment is sales tax which the City may have some flexibility with. C. Private placement of bonds can be accomplished. This could shorten repayment and lower the cost of borrowing. D. With bond funds, the City does not have to worry about expenditure limitations . E. Bond funds are made immediately available and all investment income earned can be used to repay debt services on bonds. 4 . City Treasury - Cash: This would appear to be cash on hand from various sources of funds, however expenditure limitations may restrict payments.
