PLEASE COME AGAIN AND BRING YOUR FRIENDS. For the last few weeks I have been studying the issue of the proposed airport for Apache Junction. I have seeked out people from all walks of life. Clerks, Doctors, Construction workers, Attorneys, Retired, Business men, Bankers . I talked to them and I listened to them. The proposed airport is a strong issue. The proposed airport is a controversial issue. It is an issue that must be recognized for what it is . What I say and do this evening, I do with a clear conscience and wL1 the strong determination that the progress of our city shall conti on a positive and orderly path, with the united support of all the citizens of Apache Junction. For any council member to do less, would be ignoring the oath of office and disrespecting the confidence placed on us by our friends and nei ors . / td6g, °'a Be it resol d by the mayor and the city council of the City of Apache Junction, Arizona, that the decision to build a municipal airport be decided by placing it as a. proposition on the ballot in the next general city election in Apache Junction. Furthermore, that direction be given to the city manager to continue; to study the economic feasibility of an airport . And furthermore, that the council, the city manager and his staff be directed to participate and cooperate with all agencies, local, county and state in air traffic studies, keeping in mind the practical safety factors and good neighbor policies with other cities .and Williams Air Force Base. ♦y . The Central Arizona Project allocation of water to the Ari- zona Water Company, could provide enough water to accommo- date moderate density in Section 16 . Should the need arise in the future for additional density on this section, on a case by case basis, we would be pleased to discuss the pos- sibilities involving State land and Central Arizona Pro- ject allocated water with you. Gero Director of Planning City of Apache Junction 1001 North Idaho Road Apache Junction, Arizona 85220 Dear Joe: The State Land Department has carefully reviewed the alternatives available in reference to the Apache Junction Retention Dam in Section 16 , Township 8 North, Range 1 East. To move the structure would gain the Land Department +/- 100 acres of developable Trust land in Section 16 , while potentially creating added costs to planning and construction. Moving the dam northerly would also adversely affect the SRP power line right of way. We have, there- fore, opted not to pursue a structural solution. It should be noted, however , that the Land Department did suggest in a letter dated Septem- ber 22 , 1975, responding to the Buckhorn - Mesa EIS that, "the develop- ment capabilities of State Trust lands in Section 16 , Township 1 North, Range 8 East, will be improved by the relocating of the Apache Junction Dam. " We have reviewed the possibility of density transfer from the retention area to the unencumbered area of Section 16 suggested by Apache Junction officials. At this time, the Land Department wishes to keep this option open should the need arise in the future. Perhaps a sentence in the Apache Junction General Plan to the effect that it is possible that Section 16 developable acreage density could be increased should a transfer of density scheme be worked out in the future between the City and State Land Department. The State Land Department recognizes the significant strides Apache Junc- tion has made towards implementing a General Plan. We applaud this ef- fort and are looking forward to working closely with Apache Junction in the planning and development of Urban Trust lands. Hank Steelsmith, A.J. _ ORDINANCE NO. 141 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION ZONING ORDINANCE BY AMENDING ARTICLE 23, "GENERAL PROVISIONS AND EXCEPTIONS" BY ADDING A NEW SECTION 2330, "DEDICATION OF PUBLIC RIGHT-OF-WAY REQUIRED" , REPEALING ANY CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS• SECTION I IN GENERAL That Article 23, "General Provisions and Except ions" be amended as permitted by Arizona Revised Statutes §9-462.01 by adding a new section, 2330, "Dedication of Public Right-of-Way Required," to read as follows: SECTION 2330 DEDICATION OF PUBLIC RIGHT-OF-WAY REQUIRED The City Council may, as a condition precedent to granting approval to a rezoning application, require the dedication of public right- of-way along the frontage of and/or within the subject application area said required right-of-way to be in compliance with the Apache Junction Street Classification Plan. SECTION II REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section, subsection , sentence, clause, phrase, or portion of this ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction , such decision shall not affect the validity of the remaining portions thereof. SECTION IV EMERGENCY CLAUSE It is necessary for the preservation of peace, health, and safety of the city of Apache Junction, Arizona, that this ordinance become effective immediately, an emergency is hereby declared to exist, and this ordinance shall be effective immediately upon passage and adoption. To be able to compete in sports at our age is unheard of in other parts of the country We will be back next season and hopefully to an expanded league. Thanks again Sincerely, Ed Rochester, President Don Dargis, Vice President Tom Lucas, Manager Vice Mayor Hill introduced Mr. Boyd Richardson and Mr. Jack Reed of Texas American Cable Television. Mr. Jack Reed addressed the Council with information on cable television and the Texas American Cable Television Company. Mr Reed further informed the Council that Texas American Cable Television would provide free service to educational facilities and should be a strong source of revenue for the City Councilman Damiano asked how much cable television would cost per installation Mr. Reed stated that it would cost approximately $8 50 to $9.50 per month for approximately 21 channels, premium channels would cost an additional $8 00 to $9 00 per month Mr Reed also informed the Council that there will be a public access channel available free of charge. Councilman Hudson asked if the system would be underground or above ground. Mr. Reed stated that it depends upon the Apache Junction Cable Television Ordinance as to whether the system is underground or above ground. REGULAR MEETING OF THE CITY COUNCIL MARCH 16, 1982 _ PAGE TWO Councilman Steelsmith asked what the approximate revenue would be for a city of Apache Junction's size. Mr. Reed stated that an approximate amount of revenue for the first year would be $25,000.00. Councilman Hudson asked if people outside the City limits would be able to obtain cable television with the City program /► Mr. Reed replied that the Company would have to work with the County for anyone outside City limits In some instances, counties will give the city a percentage of the franchise. Mr Reed outlined some of the special additional programs such as computerized monitoring of homes, energy conservation programs, and medical alerts, providing the Council with a construction manual and other material CALL TO THE PUBLIC Mr Robert 0. Stevenson, Countryside Trailer Park, congratulated the Council and Mr Jeff Bell, Superintendent of Community Services, on the recreational programs Mr Stevenson complimented the City of Apache Junction on the softball programs, expressing his and other senior citizens' enjoyment of the games. CITY MANAGER'S REPORT Mr. James Tuvell, City Manager, announced that the Lions' Club would be planting an evergreen tree at City Hall , on Thursday, March 18, 1982, at 9 30 a m , and invited the Council and public to attend the event. Director of Public Works Rich Broman, reported the completion of repairing a section of Plaza Drive. Mr. Tuvell reminded the Council and public of a Work Session on March 23, 1982, pertaining to street repair alternatives. PUBLIC HEARINGS None OLD BUSINESS PROPOSED ORDINANCE NO. 132, NOVAK (Second Reading) Director of Planning Joe Gero, briefed the Council on rezoning case PZ-1-82, from GR General Rural to CB-2 General Business. Mr Gero stated that the Arizona Revised Statutes provides that a city may, by ordinance, require the dedication of j rights-of-way, and the staff is in the process of preparing that. PROPOSED ORDINANCE NO. 133, BUSINESS LICENSES AMENDMENTS (Second Reading) ) City Clerk Kathleen Connelly stated that the amendments are a clarification of the licensing procedures, including an establishment of a staggered renewal date of business licenses, that businesses not be licensed for a particular occupation or for each location of the business, that each business be required to be licensed even if there are more than one in a building, that there be a special provision for special-event licenses, and other amendments. Unanimous The motion carried Mayor Clarke called upon the City Clerk to read Ordinance No. 140, by title only for the second reading City Clerk Kathleen Connelly, read as follows• ORDINANCE NO. 140, AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE CITY CODE AND ORDINANCE NO 108 SECTION 2-9-2A, REPEALING ANY CONFLICTING PROVISIONS, AND PROVIDING FOR SEVERABILITY Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT ORDINANCE NO 140, AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE CITY CODE AND ORDINANCE NO. 108 SECTION 2-9-2A, REPEALING ANY CONFLICTING PROVISIONS, AND PROVIDING FOR SEVERABILITY, BE AND HEREBY IS, APPROVED Vice Mayor Hill seconded the motion. Councilman Hudson reminded the Council that the Ordinance, as it stands, does not allow Airport Commision members to live outside the City limits and that it should stay that way. REGULAR MEETING OF THE CITY COUNCIL MARCH 16, 1982 PAGE FIVE Councilman Damiano requested that two members of the Airport Commission be appointed that live outside City limits, as in the near future these areas will probably be annexed, and these people have an interest in the City of Apache Junction Councilman Edison agreed with this, but added that if approved all of the Commissions and Boards will want to do the same thing and would carry it too far. Councilman Steelsmith expressed his disapproval of the Ordinance as a commission, such as the Planning and Zoning Commission, could not allow members from outside City limits. VOTE: In Favor Councilman Damiano, Vice Mayor Hill Opposed• Councilman Shanks, Councilman Hudson, Councilman Eidson, Councilman Steel smith, Mayor Clarke The motion failed. SPRINKLER SYSTEM REQUEST Superintendent of Community Services Jeff Bell , requested that an additional $4,000 be appropriated for materials, due to inflation. Mr. Bell stated that the Schools will install the system if the City supplies the material. Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT DIRECTION BE GIVEN TO THE CITY MANAGER TO REVIEW THE CURRENT BUDGET FOR AVAILABLE FUNDS NOT TO EXCEED $4,000 FOR THE PURPOSE OF PURCHASING MATERIALS TO IRRIGATE THE JOINT BALLFIELD PROJECT. THIS AMOUNT WILL BE ADDED TO THE PREVIOUSLY REQUESTED $6,000, AND WILL PROVIDE THE CITY'S SHARE OF THIS IRRIGATION PROJECT. ( BE IT FURTHER RESOLVED THAT THE CITY MANAGER IS DIRECTED TO INVESTIGATE THE POSSIBILITY OF A JOINT BIDDING PROCESS INVOLVING REPRESENTATION FROM BOTH THE CITY AND SCHOOL DISTRICT. Councilman Hudson seconded the motion. Councilman Damiano stated that the City and School , by working together, are saving the citizens money. VOTE: Unanimous The motion carried. Mayor Clarke recessed the meeting. Attached for your reference is a copy of this section of the statutes. The City of Apache Junction has fulfilled all of these requirements with the exception of subsection 3(d) , the appointment of a city physician by the City Council . The city physician would serve as the initial examiner in Workmen 's Compensation related cases and for employee physicals when required by a department. At present, there are five physicians practicing within the corporate limits of Apache Junction. I would request that I be given Council direction to contact these individuals to discuss with them their possible appointment as the city physician and to report back to the Council at the next regular meeting with the results. i / . Contained in Title 34 of the Arizona Revised Statutes, pertaining to public health and safety, is outlined the city's obligation to appoint a board of health and a health officer. The city Board of Health shall be composed of two members of the governing body (City Council ) , the city engineer and the city health officer. They may exercise the same powers as granted to a county board of health as well as those powers granted by ordinance. The City health officer shall be a practicing physician and serve as a member of the board of health. His/her duties shall be outlined by law or ordinance and shall receive compensation for services as determined by the Council . The health officer shall be bonded in the amount of $1,000.00 and must take an oath of office prior to performing any duties. I am requesting that I be given direction to proceed with the steps necessary to appoint a city health officer and a city board of health.
