Unanimous The motion carried AWARDS, PRESENTATIONS AND COMMUNICATIONS Mayor Clarke expressed his appreciation of Mr. Robert DeBow's contributions to the community, and presented Mr. DeBow with a Certificate of Appreciation CALL TO THE PUBLIC Ms Jean Perkins, 616 North Cactus, Apache Junction, Arizona, expressed her views towards Charter Government for Apache Junction CITY MANAGER'S REPORT City Manager James Tuvell called on Director of Public Works Rich Broman to brief the Council on the progress that has been made on street repairs Mr. Broman informed the Council that the Department of Public Works has completed approximately 11 miles of chip sealing, and will be paving in the near future City Manager Tuvell reminded the Council that the Development Guide had been presented to the Council for a 30 day study period, and the period will expire very shortly, and invited the public to make any written comment on this. Mr. Matt MaHaffey presented the results of the Needs Assessment Survey, which was partially funded by the City of Apache Junction, with the purpose of assessing the employment, medical, and basic needs of this area PUBLIC HEARINGS APPLICATION FOR SMALL GAME BINGO LICENSE, LOST DUTCHMAN TRAVEL TRAILER RESORT ANNEX Mayor Clarke opened the hearing to the public Lieutenant Mercer Weiskotten stated that the Department of Public Safety had conducted the necessary inspections and have no objections to this application. Mr Stephen Crittendon, representing the Lost Dutchman Travel Trailer Resort, made himself available for any questions the Council might have. REGULAR MEETING OF THE CITY COUNCIL MAY 18, 1982 PAGE THREE COUNCIL DECISION ON CHARTER GOVERNMENT Mayor Clarke called on the City Clerk to read report of Final Opinion of the Charter Government Committee. City Clerk Kathleen Connelly read as follows "February 11, 1982 After a great deal of research and discussion, the Charter Government Committee would like to report that eight (8) members voted against adopting a Charter form of government at this time, and five (5) voted to accept it 1. If the public takes the time to analyze the achievements and financial position of the City, they will note that the present form of General Law Government has worked well for Apache Junction. For example, the City has accomplished the following a. In the first year of the City's existance, the initial loan to operate the City was repaid with interest b. Since its beginning, Apache Junction has operated without a deficit Prudent management and supervised spending has created a surplus that is wisely invested to generate future interest which will enable the City to continue to function debt free c An accomplishment that we should look upon with satisfaction is that we have a City Complex which houses all departments and equipment necessary to the efficient performance of City Government 2 Our further research revealed that under General Law Government a Mayor may be elected at large, but the City MUST be divided in Wards to accomplish this. However, under Charter Government, the Mayor may be elected without a Ward System. 3. There is a misconception concerning budgetary procedure As aforementioned, the City has created a surplus as a result of proper budget management By referendum, under either form of government, unencumbered funds may be transferred between City departments 4 A properly written charter is an excellent vehicle for governing our City, if it does not limit the power of it's administrators. In conclusion, it is the opinion of the Committee, by majority vote, that benefits of having a Charter Government as opposed to General Law Government is not advantageous for Apache Junction at this time. We do recommend that thL City Council should reevaluate the merits of Charter Government for our City at a later date. Respectfully submitted, Mildred E Conway, Chairman Charter Government Committee" Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE CITY COUNCIL APPROVE THE RECOMMENDATION OF THE CHARTER GOVERNMENT COMMITTEE, THAT THE ADVANTAGES OF CHARTER GOVERNMENT FOR APACHE JUNCTION IS NOT ADVANTAGEOUS FOR APACHE JUNCTION AT THIS TIME. Vice Mayor Hill seconded the motion. Councilman Shanks expressed her opinions of Charter Government for Apache Junction in the following way "I made a commitment to the people of Apache Junction. When I was campaigning for my current term, Mayor Clarke, Councilman Steelsmith vowed when elected to work for the Charter form of government. I cannot speak for the others, but I am still doing in-depth research on the Charter Government concept. REGULAR MEETING OF THE CITY COUNCIL MAY 18, 1982 PAGE FOUR Charter Government carries the clout needed to monitor the needs and demands of a community Cities using a Charter system have more governing provisions that are unavailable under General Law systems. Examples Elected officials residency requirements Tax limitations Mayor and Council - Present form of government Elect Mayor - without going to political ward controlled districts �► Hve non-partisan elections Mayor and Council terms regulated - limit consecutve terms - staggered terms defined Exercise investment alternatives for idle funds expand planning - zoning requirements tailored to local needs Selection procedures for Mayor Pro Tem for when Mayor and Vice Mayor are absent The right to define and abate nuisances Develop housing codes pertinent to our area Greater authority to control land use development Devise methods for awarding contracts - formal and informal Fine tune City elections to meet specific needs Citizens Commission on salaries Sign control not in conformance with zoning laws Remedies for air, water, noise pollution Exchange of real property It would broaden the rights of the people to determine how their City should be operated. Charter government derives it's powers from the advantage because no two cities are culturally, socially or structually alike, nor should they be Recent news items on Charter government stressed election of a Mayor This is a relatively small minor issue. In order to have a sound structured City, direction must come from home grounds It is quite obvious that the City has made progress in growth and development In order to be at our peak we must adopt the Charter form of government As for our bountiful surplus of funds. Tha money is tied up by budgetary constraints levied by the State legislature We can only spend the interest derived from these funds You cannot judge our City by its chronological age The City has matured beyond its age. I stand on the position that government of the people, by the people is the only way to maintain the balance that we all strive for " Councilman Steel smith stated that he also made a commitment for Charter Government to the people, and intends to stick it with that commitment, and believes that Charter Government allows the maximum freedom for all citizens, and is the best tool offered in the State of Arizona, and if we do not use all freedoms offered to us we may lose them. Councilman Steelsmith stated that he felt that Charter Government would be adopted by the City of Apache Junction, if not at this time, in the near future. Councilman Eidson commended the Charter Government Committee on their performance. Councilman Hudson recommended the Council agree with the recommendation of the Charter Government Committee, and expressed his views of a Charter form of government for Apache Junction Vice Mayor Hill agreed with Councilman Hudson Councilman Damiano stated that the Council appointed a Committee to study this form of government, and as they were appointed for the purpose of receiving a sound recommendation, the Council should make a decision based on those findings Mayor Clarke expressed his approval of the work the Committee did, and what they accomplished Councilman Steelsmith stated that according to the law, the community is required to vote on whether or not to have Charter government, before a Charter can be written, and the decision should be what REGULAR MEETING OF THE CITY COUNCIL MAY 18, 1982 PAGE FIVE Am. Adok, issues should be in the Charter. Councilman Hudson expressed the opinion that more important matters should be resolved before a Charter is seriously discussed VOTE In Favor. Mayor Clarke reconvened the meeting at 8.01 p.m. NEW BUSINESS PROPOSED RESOLUTION NOS. 82-20, AND 82-24, CDBG GRANT APPLICATION ) Director of Planning Joe Gero briefed the Council on the Community Development Block Grant program, the application for which required Council approval. Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT RESOLUTION NO. 82-20, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AUTHORIZING THE SUBMISSION OF AN APPLICATION FOR STATE COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS AND CERTIFYING THAT SAID APPLICATION MEETS LOW - AND MODERATE-BENEFIT REQUIREMENTS OF THE STATE CDBG PROGRAM, BE AND HEREBY IS, APPROVED BE IT FURTHER RESOLVED THAT THE CITY MANAGER BE DIRECTED TO SUBMIT A 1982 COMMUNITY DEVELOPMENT BLOCK GRANT APPLICATION TO CENTRAL ARIZONA ASSOCIATION OF GOVERNMENTS AND ARIZONA OFFICE OF ECONOMIC PLANNING AND DEVELOPMENT Vice Mayor Hill seconded the motion. Director of Planning Joe Gero explained that this second resolution authorizeds CAAG to recover planning costs Councilman Steel smith MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT RESOLUTION NO. 82-24, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, PERMITTING THE REGION V COUNCIL OF GOVERNMENTS (CAAG) TO RECOVER COMPLETED AND ON-GOING COMPREHENSIVE PLANNING COSTS ASSOCIATED WITH THE SMALL CITIES COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM FY 1982, BE AND HEREBY IS, APPROVED. Councilman Hudson seconded the motion. Councilman Steelsmith MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT RESOLUTION NO 82-22, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, PINAL COUNTY, ARIZONA, INDICATING THE INTENT OF THIS BODY TO MAINTAIN, AFTER THE FIRST 12 MONTHS OF FUNDING BY THE OFFICE OF HIGHWAY SAFETY OF THE ARIZONA DEPARTMENT OF TRANSPORTATION, WITH CITY FUNDING THE TRAFFIC ENFORCEMENT PROGRAM REQUESTED FOR FUNDING BY THE CITY OF APACHE JUNCTION THROUGH RESOLUTION NO. 82-21. THIS PROGRAM WILL CONTINUE TO BE OPERATIONAL WITHIN THE POLICE DEPARTMENT OF THE CITY OF APACHE JUNCTION FOR A MINIMUM OF 12 SUCCEEDING MONTHS FOLLOWING THE END OF FUNDING FROM THE OFFICE OF HIGHWAY SAFETY, AND DECLARING AN EMERGENCY, BE AND HEREBY IS, APPROVED Councilman Damiano seconded the motion VOTE Unanimous The motion carried. However, the various utility companies may abandon their easement rights. Mr. Bunnell has a thirty-three foot (33' ) patent easement on the west side of the subject property which he wishes to abandon. There is not a west one-half of the easement which is in an area that is Pinal County park. Excepted from the abandonment, if approved, should be State Route 88 and Superstition Boulevard right-of-way. Mr. Bunnell , by quit claim, is dedicating fifty feet (50' ) of right-of-way on his property frontage along Superstition Boulevard. DCC Comment The DCC has no objection to this case. No parcels in other ownerships would be landlocked by your affirmative action. The staff' s interpretation is that mailed notice must be made even when a general text change that might affect a class of property owners is contemplated. Implications are that, in order to make a text change, the possibility exists that hundreds to thousands of persons might have to be notified by letter. Additionally, many residents of Apache Junction have never changed from the old to new addresses. Many property owners have addresses to places such as savings and loans, and banks, which are holding a mortgage. DCC Comments No objection to this proposal . However, on March 21, 1982 at approximately 0215 hours, Mr. Fassett was cited by the Apache Junction Police Department for "allowing a person to consume spirituous liquor on the premises between the hours of one fifteen A.M. and six o'clock A.M." Mr. Fassett is either not knowledgeable of the liquor laws or is not concerned with adhering to them. An ordinance as prepared by the consultant . 2 . A 1981 cost estimate . 3 . A map of the district. 4 . Petitions . 5 . ARS Excerpt 9-713. 6 . Sample letter to Pinal County Manager . A memorandum to the Director of Administrative Services on March 3 , 1981 , explained the City would be billed approximately $ 135 . 00 per month for the first three years and approximately $ 103 . 00 per month thereafter. These costs are estimates and will undoubtedly increase in the future due to fuel and economic conditions . It was re- quested that $ 1 , 620 be provided in the fiscal year 81-82 budget (non-departmental) . Also , this memorandum requested �.. provisions be made for payment of utility charges for traffic signals and other City utilities . The March memorandum was returned to this office marked "Done" and initialed by the Director . As we have just recently received billing from Salt River Project for the improvement district and other City lights and as I understand the County Assessor will not bill retroactively , the Finance Department should invoice the property owners of the improvement district for past charges and future charges up to when the County will collect the same . As this street light improvement district and other utility issues have developed over the years , I will be happy to work with you in any way to provide support data as you may required . The applicant is attempting to work out a solution with the Building Department. Allobk BA-6-82 (Rogelstad) Applicant's request to reduce the rear yard setback to twelve feet (12' ) on the subject property (Lot 11, Sierra Entrada Garden Homes) was denied by the Board. Attached are the approved Minutes of the April 5, 1982, meeting of the Board. Please have the original Minutes placed in the Minutes Book in the City Clerk's office. Ms. Breece called the roll, determining six members were present and one absent, as indicated above. { 3 Chairman asked for a motion to approve the Minutes of March 1, 1982 4 Vaughn/Oberg M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction, Arizona, that the Minutes dated March 1, 1982, be approved as written." The motion passed unanimously (6-0). 5 Chairman relinquished the gavel to the vice chairmar'.m", to a potential conflict of interest with tL public hearing next on the agenda 6 Acting Chairman asked staff to brief the Board on BA-3-82 (Tettley) which was continued from the March 1, regular meeting of the Board 7 Mr Newcomer explained the applicant is requesting a variance to all of the yard requirements and the minimum lot size requirements in the GR zoning district Noting that the applicant did not appear to be present at the hearing, it was noted for the record that notification was sent to the applicant on March 2, 1982. 8. Mr Jim Hughes 2344 East Scenic Street, Apache Junction, opposed the application due to the small lot size and a preference for low density i 11. Ms Eleanor Tucker 564 North Cortez Road, Apache Junction, opposed the application due to apparent illegalities of the situation. 12. Mr Rich Broman 2160 East Scenic Street, Apache Junction, opposed the application due to extreme degree of variance from standards set by the zoning ordinance and due to surrounding property owners' evident dissent. 13. Mr. Hugh Warren 2145 East Cody Street, Apache Junction, opposed the application due to desire for one-acre minimum parcels 14. Acting Chairman asked for public comment in favor of the appli- cation. There being none, staff recommendation was requested 15 Mr Newcomer noted the Zoning Administrator recommended denial of the application, (memorandum read into the record) as did the Development Coordinating Committee (memorandum read into record) 16 Acting Chairman called for a motion, following Board discussion 17 Morrison/Berry M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junciton, Arizona, that in case BA-3-82, the requested variance to yard and minimum lot area per dwelling unit require- ments of the General Rural zoning district, be ( and herby is denied. (t "The Board bases its decision on the following reasons 1) The creation and recording of the subject property (Tax Assessor's Parcel No. 103- 03-338) was done in violation of the minimum lot area per dwelling unit requirements of the Pinal County zoning regulations in effect at the time of the parcel's recording and, therefore, is not a legally created lot of record. 2) Use of the subject property as a residential building site would require extreme variances to the minimum lot size and yard setback requirements of the GR zoning district regulations of the City of Apache Junction Zoning Ordinance 3) Numerous property owners in the neighborhood have submitted verbal and written statements opposing the re- quested variance. 4) The applicant owns the ' lot contiguous to the subject property and the .1 combined square footage of these two lots does not equal the minimum area per dwelling unit re- quirements of the zoning ordinance Therefore, these two lots can be considered as one lot with no substantial infringement or denial of property rights. 5) The Development Coordinating Committe (DCC) believes the Board of Adjustment would be exceeding its authority in approving the requested variance due to the inability of the applicant to show that the subject property is a legally created lot of record with regard to the zoning requirements in existence at the time of the lot's recording " The motion passed 5-0-1, with Mr Jessamine havinc abstained ,•. p Page 3 - Board of Adjustment Minutes of April 5, 1982 18. Chairman having regained the gavel, called for staff to brief the Board on BA-5-82 (Southard). 19 Mr. Newcomer explained that the applicant was called out of town and requests the hearing be postponed 20 Chairman called for a motion, there being no objection to the request. 21. M. Long before I became a member of this council, I have been concerned over the Zoning Ordinance as adopted by the City. This ordinance is almost twenty years old, -1ith very few amendments . It is out-dated and does not meet the requirements of todays developers . Land owners and developers are struggling with our ordinance, some of them ;,waiting over a year for zoning or sub-division approval. Others will not even attempt to undertake a project here because of the time involved and lack of modern zoning districts. Pinal County presently is up-grading their zoning ordinance to meet the demand of the land owners . It is our responsibility to have a zoning ordinance that not only gives proper protection to the present owners but also encouragesdevelopment and growth. Development of land such sub-divisions will create more employment and more business . The Planning & Zoning Commission has an almost impc'ssible task of doing the best for zoning applicants under the present conditions . I have been and still am an advocate of slow orderly gro,ith. But there are some projects that must be completed early in the beginning of a city. Be it resolved by the Mayor and City Council of the City of Apache Junction, Arizona, that direction be given the City Manager to work directly with the Planning Director and the Planning & Zoning Commission to revise, up-grade, ammend, and streamline the zoning ordinance and the re-zoning procedures immediately after adoption of a general plan . Furthermore, that the council be reouested to actively participate in this process . And furthermore, that the first progress report from the Planning Director be delivered to the City Manager no less than 60 days from adoption of a general plan .
