M.CALL TO PUBLIC
At this time the public has the privilege to address the council with requests, communications, comments
or suggestions relating to city business. All speakers must have already submitted a written “Request to
Speak” form to the city clerk no later than the conclusion of the city manager’s report portion of the
agenda. If there is a group speaking on the same item, they should select a spokesperson. All such
remarks shall be addressed to the council as a whole and not to any member thereof. The mayor is
authorized to ask a speaker to stop speaking and leave the podium or to adjourn the meeting if anyone
becomes disorderly, uncivil, makes personal attacks or continues to speak about items that are not
within the jurisdiction of the city after being warned such issues are beyond the jurisdiction of the city to
act. The council may not answer questions of the speaker, discuss the matter with one another, but may,
at the conclusion: 1) respond to criticism by a speaker; 2) ask the city manager to review a matter; 3)
ask the city manager to place the matter on a future agenda. Each speaker must approach the podium,
speak into the microphone, provide their name and address. There is a three (3) minute time limit per
speaker.

SUBJECT: Continuance of the Public Hearing for Case
P-26-4-PZ “Banyan Apartments” to September 15,
2026.
Representing their client, Banyan Residential, LLC, Snell &
Wilmer LLP requested to continue the scheduled public meetings
for Case P-26-4-PZ to later dates in August, however with the
scheduling conflicts of the cancellation of the August 17th
and 18th Council meetings, staff have coordinated with the
applicant to move the proposed schedule to the next available
set of meetings, as identified below.
This continuance was requested to provide time to implement
design changes to address the concerns noted at the June 23,
2026 Planning and Zoning Commission hearing regarding parking
and to provide additional public outreach.
Staff respectfully requests that the public meetings be
continued to:

Re: Case No. P-26-4-PZ (the “Application”) — Continuance Request of Application
Dear Honorable Mayor Wilson and Members of the City Council:
On behalf of Banyan Residential, LLC ("Banyan"), the developer of the property located at
the southeast corner of North Rennick Drive and West Virginia Avenue in the City of Apache
Junction, Arizona, we respectfully request a continuance of the July 6, 2026 City Council Work
Session and the July 21, 2026 City Council public hearing on the Application.
The Application was first heard by the Planning and Zoning Commission on June 23, 2026,
and is currently scheduled for the City Council Work Session on July 6, 2026, and the City Council
public hearing on July 21, 2026. The requested continuance will provide us more time to revise
the proposed site plan to incorporate additional parking in response to planning staff's
comments, and to continue our ongoing outreach to the surrounding neighborhood.
Accordingly, Banyan respectfully requests that the Work Session be continued to August
3, 2026, and the public hearing to August 18, 2026.

The attached resolution pertains to the SFY 2027 Governor's Office of Highway Safety
DUI Abatement Council (DUTAC) grant that the Apache Junction Police Department
("AJPD") applied for on 4-8-2026. The grant requests were submitted and reviewed by
the DUTAC, which awarded the AJPD $49,000.00 for personnel services and employee
related expenses to enhance DUI enforcement activities throughout the City of Apache
Junction.
The grant money will be reimbursed to the AJPD after acceptance of Resolution No.
26-31, and therefore staff recommends approval.
RESOLUTION NO. 26-31
A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, PERTAINING TO THE
SUBMISSION OF PROJECTS FOR CONSIDERATION IN ARIZONA' S
2027 HIGHWAY SAFETY PLAN.
WHEREAS, the Governor' s Office of Highway Safety ("GOHS")
sought proposals from state and local agencies for highway
safety projects with a submittal deadline of April 11, 2026; and
WHEREAS, the City of Apache Junction ("City") , through its
police department ("AJPD") on April 8, 2026, submitted a DUI
abatement project to be considered for funding in the form of a
reimbursable grant for personnel expenses from the National
Highway Traffic Safety Administration; and
WHEREAS, on June 3, 2026, the GOHS awarded the grant
request to AJPD.
NOW, THEREFORE, be it resolved by the mayor and city
council of the City of Apache Junction, Arizona, as follows:
SECTION I :
Staff is seeking approval to accept $49, 000 . 00 in funding for
the DUI Abatement Council Grant under the Arizona 2027 Highway
Safety Plan.
SECTION II :
The chief of police or his designee is appointed the agent for
the City of Apache Junction to conduct all negotiations and to
execute and submit all documents and any other necessary
instruments in connection with such grant and project .
SECTION III :
The chief of police or his designee is authorized to take any
and all actions necessary to implement and complete the
activities submitted in the applications.

PROBLEM IDENTIFICATION AND RESOLUTION:
Agency Background:
The City of Apache Junction is a small suburban communityjust east of the Phoenix Metropolitan area.
The City has a population of 44,309 with an average additional 20,000-30,000 seasonal residents.
Apache Junction's north and eastern sectors have many dirt roadways where residents have a desire
for no light pollution. This rural environment exacerbates conditions for unsafe driving while providing
the illusion to impaired drivers the area is free of enforcement. There are 181 paved road miles within
the city limits and 18 signalized intersections operated and maintained by the City. In addition, there
are approximately 5 miles of US-60 and 7 miles of SR-88 within the city limits.

Agency Problem/Attempts to Solve Problem:
Apache Junction has experienced rapid population growth, especially in the southern part of the city
where new residential development is concentrated. The city's population increased from about
38,500 residents in 2020 to over 44,000 in 2024, and local demographic sources project continued
growth to approximately 47,000-48,000 residents by 2027.
This growth has contributed to increased traffic throughout the city and presents heightened risks of
impaired driving.Apache Junction's nightlife includes more than 20 bars and pubs, such as Handlebar
Pub S Grill, The Wheelhouse Tavern, Cat Wagon Tap and Bottle, and Rusty Buckle Saloon, creating
multiple environments where alcohol consumption intersects with travel demand.
Local crash data show persistent fatal and serious injury collisions, with DUI-related incidents a
substantial safety concern. In response, the Apache Junction Police Department has established a
dedicated DUI Squad to focus enforcement on impaired drivers citywide.
Agency Funding:
State DUI Abatement Funds will support Personnel Services (Overtime) and Employee Related
Expenses to enhance DUI Enforcement Activities throughout the City of Apache Junction.
How Agency Will Solve Problem With Funding:
Funding through the DUI Abatement Council will enable the department's DUI Squad to expand
targeted DUI enforcement, particularly during high-risk times and in areas with growing traffic and
nightlife activity. These efforts will reduce impaired driving, prevent crashes, and support the GOHS
mission to reduce traffic fatalities and serious injuries in Apache Junction.
Grant funds will support overtime for officers to conduct highly visible DUI saturation patrols
throughout the year. This includes active participation in multi-agency task forces during holiday
periods and special events, which historically experience elevated numbers of alcohol and drug-
related incidents. These targeted enforcement efforts aim to enhance public safety, deter impaired
driving, and reduce serious crashes in Apache Junction.

Quarter 1 (July 1 to September 30):
Traffic and Patrol Officers will conduct a minimum of 4 DUI details per month. The details will be
conducted primarily during weekend nights, with an emphasis on holiday weekends.
Quarter 2 (October 1 to December 31):
Traffic and Patrol Officers will conduct a minimum of 4 DUI details per month. The details will be
conducted primarily during weekend nights, with an emphasis on holiday weekends.
Quarter 3 (January 1 to March 31):
Traffic and Patrol Officers will conduct a minimum of 4 DUI details per month. The details will be
conducted primarily during weekend nights, with an emphasis on holiday weekends.
Quarter 4 (April 1 to June 30):
Traffic and Patrol Officers will conduct a minimum of 4 DUI details per month. The details will be
conducted primarily during weekend nights, with an emphasis on holiday weekends.

GOALS/OBJECTIVES:
State DUI Abatement Funds will support Personnel Services (Overtime) and Employee Related
Expenses to enhance DUI Enforcement Activities throughout the City of Apache Junction.
IMPAIRED DRIVING OR OPERATING ENFORCEMENT PROGRAMS
Expenditures of funding pertainingto Impaired Driving or Operating Enforcement Programs, including
Personnel Services and ERE, Materials S Supplies, and/or Capital Equipment, shall comply with the
Impaired Driving or Operating Program Goals of the DUI Abatement Council in conjunction with those
provided by the Arizona Governor's Office of Highway Safety. The Impaired Driving or Operating
Program Goal is to reduce the incidence of alcohol and drug-related driving or operating fatalities and
injuries through enforcement, education, and public awareness throughout the State of Arizona. Law
Enforcement personnel participating in Impaired Driving or Operating Enforcement/DUI activities,
including DUI Task Force details under this program, shall be HGN/SFST certified.
MEDIA RELEASE
To prepare complete press release information for media (television, radio, print and on-line) during
each campaign period including a main press release, schedule of events, departmental plans and
relevant data. The material will emphasize the campaign's purpose, aggressive enforcement
and the high cost of DUI/Alcohol in terms of money, criminal and human consequences.
METHOD OF PROCEDURE:
The Apache Junction Police Department will make expenditures as follows to meet the outlined
Program Goals/Objectives:
Personnel Services-To support Overtime for DUI Abatement Activities
Employee Related Expenses-To support Employee Related Expenses for Agency Overtime
PRESS RELEASE:
Agencies are required to develop and distribute a press release announcing this grant award upon
receipt of the executed agreement. A copy of this press release shall be sent to the DUI Abatement
Council at the same time it is sent to the media. This press release shall include the objective and
specify that the funding is from the Oversight Council on Driving or Operating Under the Influence
Abatement.
BAC TESTING AND REPORTING REQUIREMENTS:
Alcohol impairment is a major contributing factor in fatality and serious injury motor vehicle collisions.
Accurate data on alcohol involvement is essential to understanding the full extent of the role of alcohol
and to assess progress toward reducing impaired driving.
Each law enforcement agency that receives an enforcement-related grant is required to ensure
that this accurate data on all drivers involved are reported. Failure to comply may result in
withholding funds and cancellation of the grant agreement until this requirement is met.
PURSUIT POLICY:
All law enforcement agencies receiving state funds are encouraged to follow the guidelines
established for vehicular pursuits issued by the International Association of Chiefs of Police (IACP)
that are currently in effect.

PROJECT EVALUATION:
This project shall be administratively evaluated to ensure that the objectives have been met.
Quarterly Report
The purpose of the Quarterly Report is to provide information on agreement grant activities conducted
at the conclusion of each respective quarter.The information provided is used to review progress of the
funded project and the successfulness in meeting outlined goals and objectives. The information,
photos, highlights, obstacles, and mandatory statistical data provided in this report are analyzed by the
assigned DUI Abatement Coordinator. It is critical that the on-line report contains the following
information:

Final Statement of Accomplishment July 19, 2027
The Quarterly Report shall be completed on the form available on-line and submitted by email to
the DUI Abatement Council at the Governor's Office of Highway Safety. The Quarterly Report title is
based on the 3-month calendar period (Year-Calendar Quarter).
FINAL STATEMENT AND ACCOMPLISHMENTS:
The Project Director shall submit a Final Statement of Accomplishments Report to the DUI Abatement
Council no later than 30 days following the agreement end date. All agencies receiving funding are
required to submit a Final Statement of Accomplishments Report.
Note; Failure to comply with the outlined DUI Abatement Council reporting requirements may result in
withholding of state funds or termination of the agreement and return of any unexpended advanced
funds.
PROFESSIONAL AND TECHNICAL PERSONNEL:

Seth Painter, Lieutenant, Apache Junction Police Department, shall serve as Project

REPORT OF COSTS INCURRED (RCI):
The Apache Junction Police Department shall submit a Report of Costs Incurred (RCI), with
supporting documentation attached, to the Governor's Office of Highway Safety on a quarterly basis,
for each active quarter, in conjunction with the required report. Agencies may submit additional RCI
forms for expenditures when funds have been expended for which reimbursement is being requested.
Accepted supporting documentation to submit with a Report of Cost Incurred (RCI) includes, but is
not limited to;scanned copies of timesheets, payroll records, paid invoices/purchase orders,and other
account records.
RCIs shall be typed and submitted with appropriate supporting documentation to the Governor's
Office of Highway Safety. Electronically submitted RCIs will be accepted. Final RCIs will not be
accepted fifteen (15) days after the conclusion of each State Fiscal Year (June 30th). Expenditures
submitted after the expiration date may not be reimbursed and the Agency will accept fiscal
responsibility.
PROJECT MONITORING:
DUI Abatement Council grant project monitoring is used by the assigned DUI Abatement Coordinator
to track the progress of project objectives, performance measures and compliance with applicable
procedures, laws, and regulations.
The process is used throughout the duration of the agreement project and serves as a continuous
management tool. Project monitoring also presents a good opportunity for developing partnerships,
sharing information and providing assistance to granted agencies. Additionally, project monitoring
outlines a set of procedures for project review and documentation.
Project monitoring also serves as a management tool for:
y Detecting and preventing problems
Helping to identify needed changes
Identifying training or assistance needed
Obtaining data necessary for planning, and evaluation
Identifying exemplary projects
Types of Monitoring
Monitoring is formal and informal, financial and operational. The most common types of monitoring
are:
Ongoing contact with the grantee through phone calls, e-mails,correspondence,and meetings
➢ On-Site and/or In-House monitoring reviews of project operations, management, and financial
records and systems

site by DUI Abatement Coordinator.Any findings,areas of improvement,concern,or recognition,
will be provided to the grantee.
On-site and/or In-house monitoring for grantees of designated projects with large capital outlay
purchases, personnel services, and complex projects must be completed within the second or third
quarter of the Agreement period. Granted projects displaying any problems might need on-site
monitoring more than once during the fiscal year.
On-site and/or In-house monitoring includes a review and discussion of all issues related to assure the
effective and administration of the granted project. The following are the most important items to
review:

Adherence to the grant agreement specifications,timely submission of complete and correct
reports, including required documentation
Quarterly reports
Status of expenditures related to the outlined budget
Accounting records

In addition, the designated Project Administrator will ensure that any equipment purchased will be
available for inspection and is being used for the intended purpose as outlined in the grant agreement.

Documentation
The Governor's Office of Highway Safety will retain all findings on the GOHS Monitoring Form in the
grantee's respective state file. Findings will be discussed with the designated grant agreement
representative (Project Administrator or Fiscal Specialist) by phone and/or e-mail. All noted
deficiencies will be provided to the grantee with guidance for improvement and solutions to problems.
Grantees that exhibit significantly poor performance will be placed on a performance plan as outlined
by the DUI Abatement Coordinator. Grantee monitoring information will additionally provide
documentation for potential funding in subsequent fiscal year grant proposal review.
PLEASE NOTE: Failure to submit Statistics, Quarterly Reports and/or Report of Costs Incurred
(RCIs) on time and correctly may delay reimbursement for expenditures to your agency, or a
cancellation and return of unexpended advanced funding.
PROJECT PERIOD:
The Project Period shall commence on the date the DUI Abatement Council Chairperson or GOHS
Director in the Chairperson's stead, signs the DUI Abatement Grant Agreement and terminates at the
end of one year on the date as indicated on the DUI Abatement Council Grant Agreement.
DURATION:
Agreements shall be effective on the date the DUI Abatement Council Chairperson or GOHS Director
in the Chairperson's stead, signs the agreement and expire at the end of the project period.
If the Agency is unable to expend the funds in the time period specified and needs an extension, a
typed extension request shall be signed by the Project Director on the Agency's letterhead and
submitted via mail or hand delivered to the Chairperson of the DUI Abatement Council at the
Governor's Office of Highway Safety within ninety(90) days before the end of the project period.
The Agency shall address all requests to modify the grant agreement to the Chairperson of the DUI
Abatement Council on Agency letterhead and either hand deliver or submit the request via regular mail
to the GOHS office. All requests for modification must bear the signature of the Project Director.
Failure to comply may result in cancellation of the agreement. Any unexpended funds remaining at
the termination of the agreement shall be released back to the DUI Abatement Fund.

CERTIFICATIONS AND AGREEMENTS
This AGREEMENT, is made and entered into by and between the STATE OF ARIZONA, by and
through the Oversight Council On Driving Or Operating Under The Influence Abatement (DUTAC)
hereinafter referred to as"STATE", and the agency named in this Agreement, hereinafter referred
to as"AGENCY."
WHEREAS, the Arizona Revised Statutes (§§1303-1304), provides State funds to STATE for
approved DUI Enforcement and DUI Innovative projects; and
WHEREAS, STATE may make said funds available to various state, county, tribal, or municipal
agencies, governments, or political subdivisions upon application and approval by STATE; and
WHEREAS, AGENCY must comply with the requirements listed herein to be eligible for State
funds for approved DUI Enforcement and DUI Innovative projects; and
WHEREAS, AGENCY has submitted an application for State funds for DUI Enforcement and DUI
Innovative projects;
NOW, THEREFORE, IN CONSIDERATION OF MUTUAL PROMISES AND OTHER GOODS
AND VALUABLE CONSIDERATION, it is mutually agreed that AGENCY will strictly comply with
the following terms and conditions and the following Federal and State Statutes, Rules, and
Regulations:
I. Project Monitoring, Reports,and Inspections
A. AGENCY agrees to fully cooperate with representatives of STATE monitoring the
project, either on-site or by telephone, during the life of the Agreement.
B. AGENCY will submit Quarterly Reports (one for each three-month period of the project
year) to STATE in the form and manner prescribed by STATE. Notice of the specific
requirements for each report will be given in this Agreement or at any time thereafter by
giving thirty (30) days written notice to AGENCY by ordinary mail at the address listed
on the Agreement. Failure to comply with Quarterly Report requirements may result in
withholding of State funds or termination of this Agreement.
C. AGENCY will submit a Final Report/Statement of Accomplishment at completion of the
Agreement to include all financial, performance, and other reports required as a
condition of the grant to STATE within thirty (30) days of the completion of the
Agreement.
D. Representatives authorized by STATE will have the right to visit the site and inspect the
work under this Agreement whenever such representatives may determine such
inspection is necessary.

II. Reimbursement of Eligible Expenses
A. AGENCY'S Project Director, or Finance Personnel, will submit a Report of Costs
Incurred Form (RCI) to STATE each time there have been funds expended for which
reimbursement is being requested. Failure to meet this requirement may be cause to
terminate the project under section XIX herein, "Termination and Abandonment."
B. AGENCY will reimburse STATE for any ineligible or unauthorized expenses for which
State funds have been claimed and reimbursement received, as may have been
determined by a State audit.
C. STATE will have the right to withhold any installments equal to the reimbursement
received by AGENCY for prior installments which have been subsequently determined
to be ineligible or unauthorized.
Ill. Property Agreement
A. AGENCY will immediately notify STATE if any equipment purchased under this
Agreement ceases to be used in the manner as set forth by this Agreement. In such
event, AGENCY further agrees to either give credit to the project cost or to another
active DUI Abatement project for the residual value of such equipment in an amount to
be determined by STATE or to transfer or otherwise dispose of such equipment as
directed by STATE.
B. No equipment will be conveyed, sold, salvaged, transferred, etc., without the express
written approval of STATE, or unless otherwise provided elsewhere in this Agreement.
C. AGENCY will maintain or cause to be maintained for its useful life, any equipment
purchased under this Agreement.
D. AGENCY will incorporate any equipment purchased under this Agreement into its
inventory records.
E. AGENCY will insure any equipment purchased under this Agreement for the duration
of its useful life. Self-insurance meets the requirements of this section.
IV. Standard of Performance
AGENCY hereby agrees to perform all work and services herein required or set forth, and
to furnish all labor, materials,and equipment, except that labor, material,and equipment as
STATE agrees to furnish pursuant to this Agreement.

V. Hold Harmless Agreement
Neither party to this agreement agrees to indemnify the other party or hold harmless the
other party from liability hereunder. However, if the common law or a statute provides for
either a right to indemnify and/or a right to contribution to any party to this agreement then
the right to pursue one or both of these remedies is preserved.
VI. Non-Assignment and Sub-Contracts
This Agreement is not assignable nor may any portion of the work to be performed be sub-
contracted unless specifically agreed to in writing by STATE. No equipment purchased
hereunder may be assigned or operated by other than AGENCY unless agreed to in writing
by STATE.
VII. Work Products and Title to Commodities and Equipment
A. The work product and results of the project are the property of STATE, unless otherwise
specified elsewhere in this Agreement. All property, instruments, non-consumable
materials, supplies, and the like, which are furnished or paid for by STATE under the
terms of this Agreement, unless otherwise provided for elsewhere in this Agreement,
are and remain the property of STATE and will be returned at the completion of this
project upon request of STATE. The work product and results of the project will be
furnished to STATE upon request, if no provision is otherwise made by this Agreement.
B. The provisions of subparagraph A apply whether or not the project agreed to herein is
completed.
VIII. Copyrights and Patents
Any copyrightable materials, patentable discovery, or invention produced in the course of
this project may be claimed by STATE and a copyright or patent obtained by it at its
expense. In the event STATE does not wish to obtain such copyright or patent, AGENCY
may do so, but in any event, provision will be made by AGENCY for royalty-free,
nonexclusive, nontransferable, and irrevocable licenses to be given the United States
Government and STATE and its political subdivisions to use such copyrightable material,
patented discoveries, or inventions in any manner they see fit. The STATE reserves the
right to impose such other terms and conditions upon the use of such copyrights or patents
as may be deemed in the best interest of STATE in the event AGENCY is allowed to obtain
a copyright or patent.

IX. Arizona Procurement Code(A.R.S., §41-2501,et. seq.)
AGENCY and sub-grantees will use their own procurement procedures, which reflect
applicable State and local laws and regulations. The most stringent purchasing
requirement at each level must be met.
The Arizona Procurement Code(A.R.S., §41-2501,et.seq.)and promulgated rules(A.A.C.
Title 2, Chapter 7) are a part of this Agreement as if fully set forth herein and AGENCY
agrees to fully comply with these requirements for any procurement using grant monies
from this Agreement.
X. Equal Opportunity
A. Pursuant to the requirements of the Federal-Aid Highway Act of 1968 (U.S.C. §103 et.
seq.), AGENCY, as a condition to receiving approval of this Agreement, hereby gives
its assurance that employment in connection with the subject DUI Abatement Council
Grant Project will be provided without regard to race, color, creed, sex, or national
origin, and that any grant agreement it enters into with any private agency pursuant
hereto will include provisions in compliance with this paragraph (XI).
As a condition of receiving approval of this Agreement, AGENCY will be subject to and
will comply with Title VI of the Civil Rights Act of 1964, providing that no person in the
United States shall on the ground of race, color, creed, sex, or national origin be
excluded from participation in, be denied the benefits of, or be otherwise subjected to
discrimination under the subject DUI Abatement Council Grant Project.
B. If AGENCY fails or refuses to comply with its undertaking as set forth in these
provisions, STATE may take any or all of the following actions.
1. Cancel,terminate, or suspend, in whole or in part,the agreement, contract, or other
arrangement with respect to which the failure or refusal occurred; and
2. Refrain from extending any further State financial assistance to AGENCY under the
DUI Abatement Council Grant Program with respect to which the failure or refusal
occurred until satisfactory assurance of future compliance has been received from
AGENCY.
C. Pursuant to the requirement of Section 504 of the Rehabilitation Act of 1973 (29 U.S.C.
§794), AGENCY must operate this DUI Abatement Council Grant Project so that it is
accessible and otherwise non-discriminatory to handicapped persons.
XI. Executive Order 2023-01
It is mutually agreed that AGENCY will comply with the terms and conditions of Executive
Order 2023-01, Non-Discrimination in Employment by Government Contractors and
Subcontractors.

XII. Arbitration Clause, A.R.S. §12-1518
Pursuant to A.R.S. §12-1518, the parties agree to use arbitration, after exhausting
applicable administrative reviews, to resolve disputes arising out of this Agreement where
the provisions of mandatory arbitration apply.
XIII. Inspection and Audit, A.R.S. §35-214
Pursuant to A.R.S. §35-214, all books, accounts, reports, files, and other records relating
to this Agreement will be subject at all reasonable times to inspection and audit by STATE
for five (5) years after completion of this Agreement. The records will be produced at the
Governor's Office of Highway Safety.
XIV. Appropriation of Funds by the Arizona Legislature
It is agreed that in no event will this Agreement be binding on any party hereto unless and
until such time as funds are appropriated and authorized by the Arizona Legislature and
specifically allocated to the project submitted herein by the DUI Abatement Council and
then only for the fiscal year for which such allocation is made. In the event no funds are
appropriated by the Arizona Legislature or no funds are allocated for the project proposed
herein by the DUI Abatement Council for subsequent fiscal years, this Agreement will be
null and void, except as to that portion for which funds have then been appropriated or
allocated to this project, and no right of action or damages will accrue to the benefit of the
parties hereto as to that portion of the Agreement or project that may so become null and
void.
XV. Continuation of DUI Abatement Program
It is the intention of AGENCY to continue the DUI Abatement Program identified in this
Agreement once DUI Abatement Council funding is completed.This intended continuation
will be based upon cost effectiveness and an evaluation by AGENCY of the program Is
impact on highway safety.
XVI. E-Verify
Both Parties acknowledge that immigration laws require them to register and participate
with the E-Verify program (employment verification program administered by the United
States Department of Homeland Security and the Social Security Administration or any
successor program)as they both employ one or more employees in this state. Bath Parties
warrant that they have registered with and participate with E-Verify. If either Party later
determines that the other non-compliant Party has not complied with E-Verify, it will notify
the non-compliant Party by certified mail of the determination and of the right to appeal the
determination.

XVIL Termination and Abandonment
A. The STATE and AGENCY hereby agree to the full performance of the covenants
contained herein, except that STATE reserves the right, at its discretion, to terminate
or abandon any portion of the project for which services have not been already
performed by AGENCY.
B. In the event STATE abandons the services or any part of the services as herein
provided, STATE will notify AGENCY in writing and within twenty-four (24) hours after
receiving such notice, AGENCY will discontinue advancing the work under this
Agreement and proceed to close said operations under the Agreement.
C. The appraisal value of work performed by AGENCY to the date of such termination or
abandonment shall be made by STATE on a basis equitable to STATE and AGENCY
and a final reimbursement made to AGENCY on the basis of costs incurred. Upon
termination or abandonment, AGENCY will deliver to STATE all documents,
completely or partially completed, together with all unused materials supplied by
STATE.
D. AGENCY may terminate or abandon this Agreement upon thirty (30) days written
notice to STATE, provided there is subsequent concurrence by STATE.Termination or
abandonment by AGENCY will provide that costs can be incurred against the project
up to and including sixty (60) days after notice is given to STATE.
E. Any equipment or commodities which have been purchased as a part of this Agreement
and which have not been consumed or reached the end of its useful life will be returned
to STATE upon its written request.
XVIII. Cancellation Statute
All parties are hereby put on notice that this Agreement is subject to cancellation pursuant
to A.R.S. §38-511,the provisions of which are stated below.
In accordance with A.R.S. §38-511, this Agreement may be cancelled without penalty or
further obligation if any person significantly involved in initiating, negotiating, securing,
drafting, or creating the Agreement on behalf of the STATE, its political subdivisions or any
department or agency of either, is at any time while the Agreement or any extension of the
Agreement is in effect, an employee of any other party to the Agreement in any capacity or
a consultant to any other party of the Agreement with respect to the subject matter or the
Agreement.
The cancellation shall be effective when written notice from the Governor or chief
executive officer or governing body of the political subdivision is received by all other
parties to the Agreement unless the notice specifies a later time.

AGREEMENT OF UNDERSTANDING AND CERTIFICATION OF COMPLIANCE
Acceptance of Condition
It is understood and agreed by the undersigned that a grant received as a result of this
Agreement is subject to A.R.S. §28-602, and all administrative regulations governing
grants established by the STATE. It is expressly agreed that this DUI Abatement Grant
Project constitutes an official part of the STATE's DUI Abatement Council Program and
that AGENCY will meet the requirements as setforth in the accompanying DUTAC Project
Director's Manual, which are incorporated herein and made a part of this Agreement. All
State Statutes, Rules, Regulations, and Circulars referenced in this Agreement are a part
of this document as if fully set forth herein. It is also agreed that no work will be performed
nor any obligation incurred until AGENCY is notified in writing that this project has been
approved by the DUI Abatement Council Representative.
Certificate of Compliance
This is to certify that AGENCY will comply with all of the State Statutes, Rules and
Regulations identified in this Agreement,
Certification of Non-Duplication of Grant Funds Expenditure
This is to certify that AGENCY has no ongoing nor completed projects under agreement
with other Federal or State fund sources which duplicate or overlap any work
contemplated or described in this Agreement. It is further certified that any pending or
proposed request for other Federal or State grant funds which would duplicate or overlap
work described in the Agreement will be revised to exclude any such duplication of grant
fund expenditures. It is understood that any such duplication of Federal or State funds
expenditures subsequently determined by audit will be subject to recovery by STATE.
Single Audit Act
If your political subdivision has had an independent audit meeting the requirements of the
Single Audit Act of 1984, (31 U.S.C.A. §7501 et. seq.), please forward a copy to GOHS,
Attention: Fiscal Services Officer, within thirty (30) days of the effective date of this
Agreement. If such audit has not been performed, please advise when it is being
scheduled.

Certification for Contracts, Grants, Loans, and Cooperative Agreements
The undersigned certifies, to the best of his or her knowledge and belief, that:
A. No State appropriated funds have been paid or will be paid, by or on behalf of the
undersigned, to any person for influencing or attempting to influence an officer or
employee of any agency, a Member of the Arizona Legislature, an officer or employee
of the Arizona Legislature, or an employee of a Member of the Arizona Legislature in
connection with the awarding of any State contract, the making of any State grant, the
making of any State loan, the entering into of any cooperative agreement, and the
extension, continuation, renewal, amendment, or modification of any State contract,
grant, loan, or cooperative agreement.

The City of Apache Junction Police Department is requesting authorization to
enter into an intergovernmental agreement to dedicate one full-time AZPOST
certified law enforcement officer to the state VTTF, which is a multi-agency
task force led by the Arizona Department of Public Safety, focused on
suppressing vehicle theft. Officers in VTTF provide criminal interactions,
community safety and investigative support to the task force. VTTF will
reimburse the city 75% of the payroll cost for the officer and 20 hours per
month for overtime.

WHEREAS, DPS agrees to reimburse AJPD monthly for seventy-
five percent of payroll expenses and DPS will reimburse overtime
compensation not to exceed twenty hours per month; and
WHEREAS, pursuant to A. R. S . § 11-952 (A) , public entities
may enter into intergovernmental agreements with other
municipalities and governmental entities for joint or
cooperative activities; and
WHEREAS, the AJPD and DPS have crafted the legal
arrangement in the form of the attached IGA which sets forth the
terms and conditions of the services .
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF APACHE JUNCTION ARIZONA, AS FOLLOWS :
1) The mayor is authorized to sign the intergovernmental
agreement in a form consistent with Attachment A;
2) The police chief and/or his designee are authorized and
directed to take all other necessary steps to carry out
the purpose and intent of this resolution and to fulfill
all the duties required under the IGA.

ARIZONA VEHICLE THEFT TASK FORCE
This lntergovemmental Agreement ("1GA'"), which becomes effective on the date last signed, is
entered into between the State of Arizona through its Department of Public Safety ("DPS"), and
the Apache Junction Police Department, ("Agency").
The purpose of this Agreement is to enhance law enforcement services concerning vehicle theft
through the cooperative efforts of the parties to this Agreement.
DPS is authorized and empowered to enter into this IGA pursuant to A.R.S. §41.1713 B.3; both
parties are authorized and empowered to enter into this IGA pursuant to A.R.S. ¢ 1 1-952.
In consideration of the mutual promises set forth herein,the parties to this Agreement agree to the
following terms and conditions.
I. PARTICIPATION
The Agency agrees to assign one (1) AZ P.O.S.T. certified sworn law enforcement('officer")to
the Arizona Vehicle Theft Task Force,("Task Force"),on a full-time basis, for such assignments
within the purposes of this Agreement, as directed by DPS. Agency agrees the assigned officer
shall be in compliance with DPS residency requirements.
During the term of the IGA, Agency and DNS agree that Agency shall continue to provide an
officer with ail employment-related benefits,rights,and privileges. The officer must abide by all
of Agency's applicable rules and regulations and are subject to Agency's disciplinary process. In
the event the officer is involved in a critical incident, as defined by DPS policy, Agency agrees to
cooperate with, and participate in, any investigation and/or critical incident review conducted by
DPS for the purpose of evaluating the policies and procedures utilized by the Task Force.
II. DPS'S RESPONSIBILITIES
Based upon the officer's completed DPS weekly time sheets, DPS will reimburse Agency on a
monthly basis for seventy-five(75%)percent of personal services and employee-related expenses
that accrue during the term of the IGA (depending upon funding from the Arizona Automobile
Theft Authority). Personal services and employee-related expenses are detuied as gross pay,FICA
taxes, health, dental, and life insurance, workers compensation, retirement, overtime, and sick,
vacation, and personal leave. Vacation and sick leave that accrues but is not used will not be
reimbursed.
Overtime compensation will be for Task Force-related activities only. DPS will reimburse all
overtime compensation (based upon DPS rules, not to exceed 20 hours per month). The officer
must perform a minimum of forty(40)hours of Task Force-related work for DPS to reimburse for
overtime in any given week. The twenty (20) hours of overtime per month may be exceeded
without contacting Agency if DPS determines that additional funding is available,and the overtime
is authorized by the respective district commander.
All DPS approved travel expenses will be reimbursed directly to the officer by DPS under the
employee travel reimbursement guidelines established by the Arizona Department of
Administration. The amount reimbursed for travel expenses shall be for actual costs incurred
during the effective dates of this IGA.
DPS agrees to assign a department vehicle to the Agency's officer. The officer is responsible for
maintaining the assigned vehicle in accordance with DPS policy and shall utilize the DPS assigned
vehicle for Task Pore purposes only. The officer must meet the ADOA driver training
requirements.
Any other equipment assigned to officers for use during the assignment shall remain the property
of the party that assigned the equipment.
111. AGF.CV'S RESPONSIBILITIES
Prior to the officer commencing work at DPS, Agency shall furnish DPS with the information
necessary for DPS to pay personal services and employee-related expenses as defined in paragraph
11. Agency will pay the remaining twenty-five (25%) percent of the personal services and
employee-related expenses. DPS will not reimburse Agency for salary increases or changes to
base salaries, unless Agency submits the changes to DPS at least sixty (60) days prior to the
effective date of the change.
IV. AVAILABILITY OF FUNDS
Every payment obligation of DPS under this Agreement is conditioned upon the availability of
funds appropriated or allocated for the payment of such obligation If funds are not allocated and
available for the continuance of the Agreement, the Agreement may be terminated by DPS at the
end of the period for which funds are available. No liability shall accrue to DPS in the event this
provision is exercised, and DPS shall not be obligated or liable for any future payments or for any
damages as a result of termination under this paragraph.
V. IMMIGRATION
All parties agree to comply with A.R.S. §§ 23-214 and 41-4401.
VI. NONDISCRIMINATION
All parties agree to comply with the non-discrimination provisions of the Govemoes Executive
Order 2023-01.
VI1. INDEMNIFICATION
Each party (as "indemnito') agrees to indemnify, defend, and hold harmless the other party (as
"indemnity")from and against any and al I claims, losses, liability, costs, or expenses(including
reasonable attomey's fees) (hereinafter collectively referred to as "claims")arising out of bodily
injury of any person(including death)or property damage, but only to the extent that such claims
which nsuh in vicariowdderivativc liability to the indemnity, are caused by the act, omission,
negligence, misconduct, or other fault of the indemnity, its officers, agents, employees, or
volunteers.
VIII. DRUG FREE WORKPLACE
Any officer assigned to the Task Force will be subject to random and/or for cause,drug and alcohol
testing in accordance with Agency's guidelines. If Agency does not have a drug free program,the

officer will be required to submit to testing pursuant to the DPS Drug Free Workplace Program
Each assigned officer shall be subject to the responsibilities of and shall retain all rights as provided
for in the DPS Drug Free Workplace Program Manual, D118 Form Number DPS 932-02056. DPS
shall not charge any fee or cost to Agency for officers who undergoes testing. Officers may be
removed from the Task Force for failure to comply with the program or failure to pass DVS drug
screening requirements
IX. RECORDKEEPING
All records regarding the 16A,including time accounting logs, must be retained for five(5)years
in compliance with A.K.S. §35-214.
X. FEES
Neither party may charge the other for administrative fees for any wark performed pursuant to the
IGA.
XI. JURISDICTION
Agency agrees to permit officers to work outside of their regular jurisdictional boundaries.
XIL ARBITRATION
In the event of a dispute under this IGA, the parties agree to use arbitration to the extent required
under A.R.S. §§ 12-1518 and 12-133.
XIII. WORKER'S COMPENSATION BENEFITS
Pursuant to A.R.S. § 23-1022 D., for the purposes of workers compensation coverage, Agency
officers shall be deemed to be employees of DPS and Agency. Agency,as the primary employer,
shall be sole y liable for payment of workers compensation benefits and the processing of any
claims occurring during the ,trrce S asskgnmcnt to the"Task Force.
XIV. LIMITATIONS
This agreement in no way restricts either party from participating m similar activities with other
public or private agencies, organizations, and individuals. Nothing in this agreement shall be
construed as limiting or expanding the statutory responsibilities of the parties.
XV. EFFEC'll DATFfDURATION
The terms of this agreement shall become effective on the date lass signed and shall remain to
effect until June 30,2027, The IGA shall renew annually on July I of each year for a period not
to exceed four(4) years All prior agreeinents between DPS and Agency regarding Task Force
participation are superseded as of the effective dale of this IGA.
XV1. CANCELLATION
This IGA is subject to cancellation for conflicts of interest pursuant to A.R.S. § 38-511
XVIL TERMINATION
Either party may terminate the IGA for convenience or cause upon thirty (30)days written notice
to the other party Upon tenninat.on, DPS shall pay all outstanding amounts up through the

XV. VALIDITY
This document contains the entire agreement between the parties and may not be modified,
amended, altered,or extended except through a written amendment signed by both parties. If
any portion of this Agreement is Wd to be invalid, the remaining provisions shall not be

The parties hereto have caused this IGA to be executed by the proper offrcers and officials.

Designed to ensure a rapid and comprehensive community response to child
abductions or endangered missing child incidents. A significant percentage of
abducted children are harmed within the first few hours of abduction,
highlighting the critical need for immediate, coordinated action.
CARTs provide a structured approach to reduce delays in notification and
investigation, in creasing the likelihood of safe recovery.

for compliance with employment-eligibility verification requirements applicable to its own employees,contractors,
and subcontractors.
V. CRIMINAL INTELLIGENCE/INFORMATION SHARING
All collection,access,use,entry,retention,dissemination,and destruction of criminal justice information, criminal
intelligence information,and law-enforcement-sensitive information under this Agreement shall comply with
applicable federal and state law,CJIS/ACJIS requirements,28 C.F.R.Part 23 to the extent applicable,DPS policy,
applicable system-use rules,and any applicable Agency policy.Nothing in this Agreement authorizes either party to
access,use,disclose,or retain information except as permitted by law and policy.
VI. NONDISCRIMINATION
The parties shall comply with all applicable federal and state nondiscrimination laws and applicable Arizona
Executive Orders, including Executive Order 2023-01,to the extent applicable.
VII. INDEMNIFICATION
Each party (as "indemnitor") agrees to indemnify, defend, and hold harmless the other party (as
"indemnitee") from and against any and all claims, losses, liability, costs, or expenses (including reasonable
attorney's fees) (hereinafter collectively referred to as "claims") arising out of bodily injury of any person
(including death) or property damage, but only to the extent that such claims which result in vicarious/derivative
liability to the indemnitee, are caused by the act, omission, negligence,misconduct, or other fault of the
indemnitor,its officers, agents, employees, or volunteers.
VIII. DRUG FREE WORKPLACE
Any officers assigned to GIITEM will be subject to random and/or for cause, drug and alcohol testing in
accordance with Agency's guidelines. If Agency does not have a drug free program, officers will be required
to submit to testing pursuant to the DPS Drug Free Workplace Program. Each assigned officer shall be subject to
the responsibilities of and shall retain all rights as provided for in the DPS Drug Free Workplace Program Manual,
DPS Form Number DPS 932-02056. DPS shall not charge any fee or cost to Agency for officers who undergo
testing. Officers may be removed from GIITEM for failure to comply with the program or failure to pass
DPS drug screening requirements.
IX. RECORDKEEPING
Each party shall retain all books,accounts, reports, files,time records,reimbursement records,and other records
relating to this Agreement for five(5)years after completion of the Agreement. Such records shall be subject to
inspection and audit at reasonable times as required by A.R.S. § 35-214.
X. FEES
Neither party may charge the other for administrative fees for any work performed pursuant to the IGA.
XI. JURISDICTION
To the extent permitted by law,Agency authorizes assigned officers to perform GIITEM duties outside Agency's
regular jurisdictional boundaries.

XII. ARBITRATION
In the event of a dispute under this IGA, the parties agree to use arbitration to the extent required under
A.R.S. §§ 12-1518 and 12-133.
XIII. WORKER'S COMPENSATION BENEFITS
Pursuant to A.R.S. § 23-1022 D., for the purposes of workers compensation coverage, Agency officers shall
be deemed to be employees of DPS and Agency. Agency, as the primary employer, shall be solely liable for
payment of workers compensation benefits and the processing of any claims occurring during the officer's
assignment to GIITEM.
XIV. LINIITATIONS
This agreement in no way restricts either party from participating in similar activities with other public or
private agencies, organizations, and individuals. Nothing in this agreement shall be construed as limiting or
expanding the statutory responsibilities of the parties.
XV. EFFECTIVE DATE/DURATION
This Agreement becomes effective on the date last signed and remains in effect through June 30,2027,unless earlier
terminated.The parties may renew this Agreement for additional one-year terms by written amendment or written
renewal approved by the parties and their respective legal counsel,subject to the availability of funds and any
governing-body approval required by law.No renewal or extension is effective unless approved in the manner
required by A.R.S. § 11-952.
XVI. AVAILABILITY OF FUNDS
Every payment obligation of DPS under this agreement is conditioned upon the availability of funds appropriated or
allocated for the payment of such obligation. If funds are not allocated and available for the continuance of the
agreement, the agreement may be terminated by DPS at the end of the period for which funds are available. No
liability shall accrue to DPS in the event this provision is exercised,and DPS shall not be obligated or liable for
any future payments or for any damages as a result of termination under this paragraph.
XVIL CANCELLATION
This IGA is subject to cancellation for conflicts of interest pursuant to A.R.S. § 38-511.
XVIII. TERMINATION
Either party may terminate the IGA for convenience or cause upon thirty(30)days written notice to the other party.
Upon termination, DPS shall pay all outstanding amounts up through the effective date of the termination. All
property shall be returned to the owning party upon termination.

XX. VALIDITY
This document contains the entire agreement between the parties and may not be modified, amended,
altered or extended except through a written amendment signed by both parties. If any portion of this
agreement is held to be invalid,the remaining provisions shall not be affected.
The parties hereto have caused this IGA to be executed by the proper officers and officials.

abducted children are harmed within the first few hours of abduction,
highlighting the critical need for immediate, coordinated action.
CARTs provide a structured approach to reduce delays in notification and
investigation, in creasing the likelihood of safe recovery.

The City of Apache Junction Police Department (“AJPD”) is requesting
approval to enter into for an Intergovernmental Agreement encompassing
the Arizona Child Abduction Response Team.
The goal of this IGA is to meld multijurisdictional efforts and resources to
address child abduction and endangerment activities in the East Valley.
There is no entry cost incurred for participation in the IGA.

A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, AUTHORIZING THE CITY OF
APACHE JUNCTION POLICE DEPARTMENT TO ENTER AN

WHEREAS, the East Valley law enforcement agencies
("Agencies") desire to join together in a multi-jurisdictional
effort for allocating resources to address missing/endangered
children cases; and
WHEREAS, the multi-agency effort will be known collectively
as the Arizona Children Abduction Response Team ("AZCART") ; and
WHEREAS, the undersigned agencies have the authority to
enter into agreements for joint cooperation and assistance for
this goal pursuant to A. R. S. §§ 11-951, et seq. and 13-3872; and
WHEREAS, participation in AZCART will enhance mutual aid
efforts in the form of law enforcement services and resources to
respond to continuing, multi-jurisdictional criminal child
abduction/endangerment activity; and
WHEREAS, this agreement does not supersede or take the
place of any other agreement entered into by the various members
of the AZCART and those agreements shall remain in full force
and effect .
NOW, THEREFORE, THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION, ARIZONA, RESOLVE AS FOLLOWS:
1) The mayor is authorized to sign the agreement similar
in form to Attachment A.
2) The police chief or his designee is authorized to take
whatever steps are necessary to participate in AZCART.

I INTERGOVERNMENTAL AGREEMENT
2 FOR THE CREATION OF AND PARTICIPATION IN THE

5 This Agreement is entered into by the"public agencies,"as defined in A.R.S. § 11-951, that have
6 executed and recorded this Agreement in accordance with the law, and as set forth in Section 1
7 (each, a"Party,"and collectively, the "Parties").
8
9 1. PARTICIPATING PUBLIC AGENCIES.
10
11 A. The Parties to this Agreement are subject to change as additional public agencies
12 are invited to join, and as others withdraw. In either event,the State Coordinating Agency (defined
13 below) will distribute an updated Party list to all Parties.
14
15 B. Each Party shall provide a copy of its fully executed Agreement to the AZCART
16 State Coordinating Agency for distribution to every other Party.
17
18 2. PURPOSE.
19
20 A. The purpose of this Agreement is to establish the Arizona Child Abduction
21 Response Team (AZCART), the primary goal of which is to provide a pool of specialized
22 investigators available to dedicate intensive investigative,preventive,and general law enforcement
23 efforts, primarily focused on cases involving abducted and at-risk missing children. Parties may
24 request and render law enforcement assistance to each other to address serious violations of law,
25 including,but not limited to,the investigation,arrest,and prosecution of those involved in criminal
26 child kidnapping, abduction, false imprisonment, and similar or related violations (utilizing state
27 and federal law and prosecutions, and forfeitures, as appropriate), and the rescue of the abducted
28 child or children.

30 B. The geographical jurisdiction of each Party relative to one another makes it
31 beneficial to enter into this Agreement, enabling the exchange of mutual aid through law
32 enforcement services and resources, and facilitating responses to ongoing multi jurisdictional
33 criminal activities.

35 3. AUTHORITY.
36
37 A. The Parties are authorized and empowered to enter into this Agreement pursuant to
38 A.R.S. §§ 11-951 et seq. and 13-3872, and their respective governing authorities.
39
40 B. If any tribal community requests AZCART assistance, consideration should be
41 given to granting tribal peace officer authority to all assisting Parties for the duration of the
42 Activation (defined below) within the applicable tribal jurisdiction if and when required.

1 4. TERM.

3 A. This Agreement shall become effective upon execution by the Parties and filing
4 with the appropriate County Recorder and shall remain in effect until June 30, 2030, unless
5 otherwise terminated by the terms of this Agreement or operation of law. Failure by one or more
6 Parties to execute this Agreement shall not invalidate it as to those Parties who did execute this
7 Agreement.Any Party may withdraw from this Agreement with or without cause by giving thirty
8 calendar days' written notice to the other Parties.

10 B. This Agreement may be administratively extended by each Party at the direction of
11 their respective chief law enforcement officer and as authorized by their respective governing
12 bodies, on or before the termination date, for an additional five-year period by notifying the other
13 Parties in writing.Any Party which fails to do so by the termination date shall no longer be a Party
14 to the Agreement.

16 5. STEERING COMMITTEE; COORDINATING AGENCIES.
17
18 A. Steering Committee.
19
20 (1) A steering committee is hereby established, and each Party shall have the
21 right to appoint a representative to it(the "Steering Committee").
22
23 (2) The Steering Committee is led by the current State Coordinating Agency
24 (defined below)and is tasked with meeting quarterly,either in person or virtually, at the discretion
25 of the State Coordinating Agency, to discuss AZCART-related issues, gather feedback on current
26 and past Activations, prepare quarterly training for Parties, and seek and select appropriate
27 agencies for rotation as Branch Coordinating Agencies.
28
29 (3) The Steering Committee shall select,subject to final approval of the Parties'
30 chief law enforcement officers, one lead coordinating agency (the "State Coordinating Agency"),
31 and two branch (Northern and Southern) coordinating agencies (respectively, the "Northern
32 Branch Coordinating Agency"and the"Southern Branch Coordinating Agency"),each selected on
33 a rotating basis for a term of at least one year, which shall correspond with the effective date of
34 this Agreement.

36 (4) If multiple Parties wish to become a Branch Coordinating Agency, the
37 Steering Committee shall determine the outcome by majority vote during its designated fourth
38 quarter meeting, with the current State Coordinating Agency serving as the tiebreaker if needed.
39
40 (5) If all replacement Branch Coordinating Agencies are not identified by the
41 fourth quarter meeting, the current Coordinating Agency may choose to stay in place on a month-
42 to-month basis until a replacement agency is found.

1 (6) If a Branch Coordinating Agency cannot be determined, then the Activation
2 responsibilities of that Branch will fall back under the State Coordinating Agency until a
3 replacement is found.

5 B. Coordinating Agencies; Coordinators.
6
7 (1) Each Coordinating Agency shall select and be led by its own individual
8 Coordinator selected from within the Coordinating Agency.
9
10 (2) If a Coordinator is unable to complete their term due to retirement,
11 resignation, change in primary assignment, promotion, or for any other reason, the Coordinating
12 Agency shall name a replacement Coordinator to fulfill the remainder of the year term.
13
14 (3) Coordinators are responsible for coordinating ongoing training, meetings,
15 or other necessary functions in support of AZCART's operational effectiveness.
16
17 (4) The State Coordinator is responsible for mediating any jurisdictional or
18 Activation disputes between the Parties during an Activation. If such mediation fails, the issue
19 shall be brought to the attention of the applicable AZCART chief law enforcement officers or their
20 designees for appropriate resolution.
21
22 C. State Coordinating Agency.
23
24 (1) The State Coordinating Agency holds primary responsibility for U.S.
25 Department of Justice certification, compliance, and reporting, and for ensuring compliance with
26 intergovernmental agreements within Arizona.
27
28 (2) The State Coordinating Agency also holds primary responsibility for
29 Activations in Maricopa,Yuma, Pinal, La Paz, Gila, Graham,and Greenlee Counties; for handling
30 primary vetting of Activation requests to ensure criteria have been adequately met; and for
31 providing oversight and support to any Northern or Southern Branch Activations.

33 D. Branch Coordinating Agencies.
34
35 (1) The Northern Branch Coordinating Agency falls under the responsibility
36 and oversight of the State Coordinating Agency and holds primary responsibility for coordinating
37 the response for Activations in Mohave, Coconino,Yavapai, Navajo, and Apache Counties.
38
39 (2) The Southern Branch Coordinating Agency falls under the responsibility
40 and oversight of the State Coordinating Agency and holds primary responsibility for coordinating
41 the response for Activations in Pima, Santa Cruz, and Cochise Counties.

1 6. ACTIVATION, PROCEDURES,AND RESOURCES.

3 A. Any Party or authorized representative may request AZCART"Activation." which
4 can include but is not limited to any of the following:
5
6 (1) A Limited Team (Hasty Team) callout for the purposes of consulting with
7 the primary jurisdiction.
8
9 (2) A branch-only callout for conducting a specific task.
10
11 (3) A Technical Team callout for cell tower analysis, foreign language
12 translation, dedicated forensic interviews, specialized equipment, etc.
13
14 (4) A Full Team callout for neighborhood and roadside canvassing, criminal
15 investigation assistance, lead management assistance, area searches, crime scene management
16 assistance, intelligence gathering, etc.
17
18 B. The Party or its authorized representative requesting Activation must contact the
19 Arizona Department of Public Safety Duty Office (602-223-2212) to connect with the State
20 Coordinator or their designee to vet the Activation request.
21
22 C. The criteria for an Activation include one or more of the following: confirmed or
23 suspected non-family child abduction; confirmed or suspected family or non-custodial parent
24 abduction involving endangerment circumstances; or any other at-risk missing child investigation
25 that requires an immediate response to protect the life or well-being of a child, as determined by
26 the AZCART State Coordinator or their designee.
27
28 (1) Endangerment circumstances are defined as situations in which a child's life
29 or well-being is perceived to be at risk due to violence or health conditions, or when the abducting
30 party poses a potential threat of violence or is expected to otherwise endanger the child.
31
32 (2) At-risk factors can include but are not limited to any of the following:
33 special needs due to a medical diagnosis or diagnosed behavioral condition; life-threatening health
34 issues; medication or drug dependence; being 13 years old or younger (at risk of exploitation);
35 signs consistent with sexual exploitation; or absence inconsistent with established patterns of
36 behavior without explanation.

38 D. The Party with legal jurisdiction over the incident or investigation will remain as
39 the lead agency for the duration of a particular Activation, with support from other Parties.
40
41 E. Each Party shall, to the best of its ability, designate at least one sworn law
42 enforcement officer to be available, along with supporting equipment such as vehicles, to support
43 an Activation.

I F. Each Party shall designate a primary representative to participate in Activations,
2 meetings, trainings, etc., and shall immediately inform the other Parties when such designations
3 change. If a primary representative is not available,or as the situation dictates,a Party may provide
4 officers not normally designated as representatives to support an Activation.
5
6 G. Each Party shall have the sole discretion to determine how many and how long any
7 of its personnel or resources will be assigned in support of an Activation.
8
9 7. COSTS AND REIMBURSEMENT.
10
11 Each Party is responsible for its own costs incurred in implementing this Agreement, including,
12 but not limited to,employee salaries, shift differentials,overtime compensation,benefits,vehicles,
13 and equipment. If any Party receives grant funds designated for the Arizona Child Abduction
14 Response Team, some or all of these expenses may be reimbursed to the Parties. Under no
15 circumstances shall any Party charge the other Parties any administrative fees for work performed
16 under this Agreement.

18 8. MISCELLANEOUS.
19
20 A. Independent Authority and Judgment. Nothing within this Agreement shall be
21 construed to limit the ability of the Parties to assist with or otherwise engage in law enforcement
22 activities outside this Agreement. Except as otherwise provided by law, in the performance of this
23 Agreement, the Parties act in their individual governmental capacities and not as agents,
24 employees, or partners of the other Parties. The employees, agents, or subcontractors, of one party
25 shall not be deemed or construed to be the employees, agents, or subcontractors of another Party.
26 At all times relevant to the performance of this Agreement, each Party shall maintain an
27 independent chain of command and exercise its own independent law enforcement judgement.
28
29 B. Non-Discrimination.Parties shall comply with all applicable provisions of state and
30 federal nondiscrimination laws and regulations, including, but not limited to, that all persons,
31 regardless of race, color, religion, sex, age, marital status, sexual orientation, gender identification
32 or expression, genetic characteristics, familial status, national origin or political affiliation, U.S.
33 military veteran status, or disability, shall have equal access to employment opportunities and all
34 other federal and state employment and educational opportunity laws, rules, and regulations,
35 including the Americans with Disabilities Act; provided however, tribal communities are subject
36 to 25 U.S.C. § 450e(c). No Party shall engage in any form of illegal discrimination.

38 C. Indemnification. To the extent permitted under applicable laws, each Party (as
39 "Indemnitor") agrees to defend, indemnify, and hold harmless the other Parties (as "Indemnitee")
40 from and against any and all claims, losses, liabilities, costs, or expenses (including reasonable
41 attorney's fees)(collectively,"Claims")arising out of bodily injury of any person(including death)
42 or property damage,but only to the extent that such Claims are caused by negligent act or omission
43 or other fault of the Indemnitor, its officers, officials, agents, employees, or contractors. Failure of
44 a Party to comply with the terms of this Agreement shall not provide the basis for any third-party
45 action against any of the Parties.

2 D. Governin Law; Venue. This Agreement shall be governed by the laws of the State
3 of Arizona, and suit pertaining to this Agreement may be brought only in courts in Maricopa
4 County, Arizona, unless the subject matter of the dispute involves a tribal community, in which
5 case venue shall be in the Federal District Court for the State of Arizona.

7 E. Disputes.
8
9 (1) The Parties shall make every effort to resolve all disputes arising out of or
10 relating to this Agreement through arbitration after exhausting applicable administrative review to
11 the extent required by law.
12
13 (2) If any legal action is brought by either Party to enforce any provision of this
14 Agreement, the prevailing Party may recover from the other Party reasonable attorneys' fees and
15 court costs in such amounts as allowed by the court.
16
17 F. Cancellation pursuant to A.R.S § 38-511. The Parties reserve all rights that each
18 may have to cancel this Agreement pursuant to A.R.S. § 38-511.
19
20 G. Counterparts. This Agreement may be executed simultaneously or in counterparts,
21 each of which constitutes an original, but all of which together constitute one and the same
22 agreement. Neither a signature for every Party nor a signature line shall be required in each
23 counterpart except that on a counterpart being brought forward by a Party to its legislative body or
24 equivalent for approval, that particular counterpart shall have to be signed and executed in
25 accordance with that Party's practice. The signature pages from one or more counterparts may be
26 removed from such counterparts and attached to a single instrument so that the signatures of all
27 Parties may be physically attached to a single document.

29 H. Worker's Compensation. Pursuant to A.R.S. § 23-1022(D), for the purposes of
30 worker's compensation coverage, an employee of a public agency who works under the
31 jurisdiction or control of or within the jurisdictional boundaries of another public agency pursuant
32 to a specific intergovernmental agreement or contract entered into between the public agencies
33 pursuant to A.R.S. § 11-952, is deemed to be an employee of both public agencies for the purposes
34 of this section. The primary employer shall be solely liable for the payment of workers'
35 compensation benefits for the purposes of this section.

37 1. Severability. In the event that any provision of this Agreement shall be held invalid
38 or unenforceable by any court of competent jurisdiction, such holding shall not affect the validity
39 or enforceability of any other provision hereof.
40
41 J. Entire Agreement. This Agreement contains the entire understanding between the
42 Parties with respect to the subjects hereof and supersedes all prior negotiations and agreements.
43 This Agreement may be amended only by an instrument in writing and signed by all the
44 participating Parties. The waiver of any breach of this Agreement shall not be deemed to amend

I this Agreement and shall not constitute waiver of any other subsequent breach. Headings are for
2 convenience and shall not affect interpretation.

4 K. Recording.This Agreement shall be recorded with the appropriate County Recorder
5 as described above upon its execution, and a copy shall be forwarded to each Party.

7 L. E-Veri . To the extent applicable under A.R.S. § 41-4401, each Party warrants
8 compliance with all federal immigration laws and regulations that relate to their employees and
9 their compliance with the E-Verify requirements under A.R.S. § 23-214(A). Failure to comply with
10 such warranty shall be deemed a material breach of this Agreement and may result in the
11 termination of this Agreement. All Parties retain the legal right to inspect the papers of any
12 employee who works pursuant to this Agreement or any related subcontract to ensure compliance
13 with this warranty, and to conduct random verifications of the employment records of any other
14 Party to ensure compliance with this warranty. A Party will not be considered in material breach
15 of this Agreement if it establishes that it has complied with the employment verification provisions
16 prescribed by 8 USCA §1324(a) and (b) of the Federal Immigration and Nationality Act and the
17 E-Verify requirements prescribed by A.R.S. §23-214(A). The provisions of this section must be
18 included in any contract any Party enters into with any contractors or subcontractors who provide
19 services under this Agreement.

21 M. Notices. Any notice required to be given under this Agreement will be provided to
22 all Parties, with notice directed to each Party's chief law enforcement and chief legal officers.

24 N. Non-Appropriation. Every payment obligation of each of the Parties under this
25 Agreement is conditioned upon the availability of funds appropriated and allocated for the payment
26 of such obligation. If a Party's funds are not appropriated, allocated, and available, or if the
27 appropriation is changed by the legislature or other governing body, resulting in funds no longer
28 being available for the continuance of that Party's participation in this Agreement, that Party may
29 terminate its participation in this Agreement as of the end of the period for which funds are
30 available by providing written notice in advance to the Parties.No liability shall accrue to the Party
31 in question in the event this provision is exercised, and that Party shall not be obligated or liable
32 for any future payments or for any damages as a result of termination under this paragraph.

34 O. Compliance with Laws. Each Party shall comply with all laws, rules, and
35 regulations, as applicable, without limitation to those designated within this Agreement.

37 P. Provisions Required by Law. Each and every provision of law and any clause
38 required by law to be in this Agreement will be read and enforced as though it were included herein
39 and, if hrough mistake or otherwise any such provision is not inserted,or is not correctly inserted,
40 then upon the application of a Party,this Agreement will promptly be physically amended to make
41 such insertion or correction.

abducted children are harmed within the first few hours of abduction,
highlighting the critical need for immediate, coordinated action.
CARTs provide a structured approach to reduce delays in notification and
investigation, in creasing the likelihood of safe recovery.

Schedule
Apache Junction City Code Volume I, Chapter 4: Fees, Article 4-1: Parks and Recreation
Fee Schedule addresses parks and recreation fees. Fees are required by the state of
Arizona to be reviewed every five years to ensure they are aligned with the local market, the
community needs, and changes in other laws.
The parks and recreation department has historically used three primary funding sources to
provide high quality programs, services, and facilities for the community: 1) general fund
(sales tax); 2) development fee fund; and 3) user fees. These are supplemented by various
smaller sources such as grants, donations, corporate partnerships, etc. Many facilities,
amenities, and events are paid for by all residents through city sales taxes; however
additional fees are put in place for more exclusive uses by individuals.
Staff and the Parks and Recreation Commission have conducted a thorough review of our
current market and have made recommendations based on the following:
1. General Market Comparison
Parks and Recreation fees were last updated in 2021. The recommended updates will aim
to increase only those fees that are substantially below market value or need to be
increased to cover rising operating costs.
2. Demographics and Affordabiltiy
A priority is ensuring that many facilities/programs are available to all residents, regardless
of their income level. This is reflected in some of the fee decisions, and in a robust
scholarship program, funded by partners to offset necessary fees.
2. New Amenity/Service Fee Considerations
With the introduction of renovated facilities at the Rodeo Event Center, recommendations
also include new amenities such as the large pavilion, vendor electricity, and RV hook-ups.
Once city council is satisfied with proposed changes, the fees will be discussed and voted
on at a future public hearing. The intent is to have any approved changes effective no later
than January 1st, 2027.

§ 4-1-4 REFUNDS.
All refunds shall be made in full, except for a 10% administrative processing fee, with a $5
minimum.
§ 4-1-5 PROMOTIONAL DISCOUNTS
(A) Intent. The Parks and Recreation director or his or her designee may from time to
time establish promotional discounts to encourage and increase participation in programs and
memberships, especially for off season events.
(B) Limitation: With the exception of a limited quantity of free day passes to the multi-
generational center or aquatic center, no promotion may exceed 50% off the regular price of
admission.
§ 4-1-6 FEE CATEGORIES
(A) No Fee Category: The Parks and Recreation Department has priority use of all
facilities and recreational areas. When facilities are not in use for Parks and Recreation sponsored
activities, they shall be available on a permit/no fee basis to the following:
(1) All other city departments.
(2) City council approved special events (considered annually during budget
process).
(3) Partner agencies with formal agreements.
(B) Partial Fee Category: Groups that meet the following Local Youth Serving Agency
criteria will have priority use with those above, on a reduced fee basis (25% of regular public
rates):
(1) Youth Serving Agency is a 501(c)(3) non-profit organization.
(2) Youth Serving Agency is governed by local, unpaid volunteer board and unpaid
staff.
(3) Participant members are made up of a majority of City of Apache Junction
residents.
(4) Youth Serving Agency participation is open to the public and not “by invitation
only” or limited by any means other than the natural makeup of the league (i.e. no cuts and
must have minimum participation/play rules in place).
(C) Full Fee Category: When facilities are not in use by the Parks and Recreation
department, or the groups listed above, they will be made available to other Apache Junction
residents, groups or organizations on a permit/fee basis.
(D) Non-Resident Fee Category: Individuals that do not reside within the incorporated
limits of the city shall be charged a fee that is 25% more than the listed facility rental fees in §4-
1: FACILITY AND EQUIPMENT RENTAL FEES, with the exception of Pool Entry/Passes and
Multi-Generational Center Entry/Memberships.
(E) Commercial Fee Category: Businesses and other for-profit organizations shall be
charged a fee that is 50% more than the listed facility rental fees in § 4-1-1 FACILITY AND
EQUIPMENT RENTAL FEES, with the exception of Pool Entry/Passes and Multi-Generational
Center Entry/Memberships. Facilities that are on a Bureau of Land Management Recreation and
Public Purpose Lease will not be eligible for commercial rentals.
§ 4-1-7 PRIORITY RESERVATIONS AND REGISTRATIONS
The Parks and Recreation director or his or her designee may establish a priority registration or
priority reservation period for Apache Junction residents. Programs and facilities with the highest
participation and/or use shall be considered for priority registration or priority reservation for
Apache Junction residents.

PUBLIC ART|FUNDING SOURCE
•INTENT:
•Art in Public Places Fund (“APPF”) is funded by fees from qualified new commercial, multi -family, and
mixed-use developments, public construction projects, and renovations. The APPF pays for the art
program.
•No taxpayer funds are used for public art projects.
•Fee is based on a percentage of the building permit fee.
•Requires private development to pay the public art fee when the permit is issued or provide
approved public art before receiving their Certificate of Occupancy.
•Current APPF budget is nearly $640,000.

•REQUEST FOR QUALIFICATIONS (“RFQ”): Requires a resume, letter of interest, at least three references, 6-10
work samples, and an image description sheet.
•APPLICATION PROCESS: Applications accepted online only at CaFE: Call for Entry by Creative West, a U.S.
regional arts organization at www.callforentry.org ; the RFQ is also advertised at least twice in the news
paper, added to the city’s homepage and on the city’s public art webpage, email blasted to thousands
of artists located in qualifying areas by CaFE, and added on other organization’s websites for
opportunities.
•ARTIST SELECTION PANEL: Once the application closes, dates are scheduled with the panel members,
typically including three or more of the following: an Apache Junction Public Art Commission member, an
art commission member from another city, artists, public art managers, public art administrators, staff,
and/or the Apache Junction PAC Consultant.
•PROCESS: the Panel reviews the applicants ahead of the panel meeting to choose their top 10 artists (or
less), and the panel will review all the top artists from each member of the panel during the panel meeting
(either zoom or in person) and narrow down the artists to the required number and potential alternates.
