City Clerk Kathleen Connelly stated that the application for petitions to place the airport issue on the election ballot, had been taken out. If returned, the actual petitions would be ready in a week. Ms Donna Felts, organizer for a pro-airport group expressed her opinion that Apache Junction needs an airport and asked that citizens join the group to further the cause Mr. Larry Kluth, Airport Military Affairs Chairman, answered several questions regarding the proposed airport City Manager James Tuvell asked that if the Task Force invited Apache Junction representatives to meet with them regarding the airport would the Council like the representatives to be the Airport Commission members, staff members, or Councilmembers? Robin Salem Stinnett Water Resource Planner Department of Water Resources Phoenix Active Management Area 99 East Virginia Phoenix, AZ 85004 Dear Ms. Stinnett: We wish to thank you for visiting Apache Junction on August 13 to discuss the proposed Arizona Groundwater Management Program. The city of Apache Junction understands the need for water conser- vation. It also believes the rules to achieve water conservation should be fair and equitable. The city position is that the groundwater code is an idealized concept that does not allow for exceptional circumstances that, in one or more communities, should have flexible interpretation. For example, in our community, due to the groundwater code and the current refusal of a private water company to sign a Central Arizona Project (CAP) unconditional contract, subdivisions cannot be approved in its certificated area. The landowners ' solution is to develop the land as a recreational vehicle (RV) park at a much higher density with probably higher total water consumption. Multiple family, RV, and mobile home parks are exempt, and many more are proposed in the area. The new rules propose to create conservation by establishing a goal of a certain limit on gallons/person/day, the estimated goal to be about 150 gallons. In Apache Junction, the residents are already consuming less than that. A 1981 water study conducted for the city of Apache Junction indicated the population in this area is using between 80 to 120 gallons/person/day, depending on which water company area you reside in. However, there is an influx of 30,000-40,000 winter visitors above the 12,000 permanent year-round population; many staying about six months. Each of these seasonal visitors creates a water demand. In addition, Apache Junction's permanent population, until recently, has been, to a large extent, retirees. This area is rapidly changing to a family orientation, as is indicated by rising school enrollments which will have the effect of increasing the per person water usage as the family size increases per household. How will the Active Management Area (AMA) factor for additional water consumption for tourist and part-time water demand? These outlying areas have been low density, but new and existing property owners are moving to and building in these areas. Soon it will be economically feasible for the water company to extend water lines and demand for water in those areas will increase. For Apache Junction residents, desert landscaping has been and is the rule. Our highway landscaping is natural and without watering systems. This is a major contributing factor to our low water consumption rates. There is current zoning in our area to accommodate about 150,000 persons. If landowners are suddenly told they cannot develop their land to a reasonable expectation, one might predict a confrontation on the groundwater code. This would be especially apparent if the State Land Depart- ment is declared exempt and allowed to develop. If subdivisions are to be approved in AMAs in one community or part of a community, the Department of Water Resources should apply the same rules to all communities, regardless of who is the water supplier. The city of Apache Junction is an area that does not have current agricultural uses or irrigation. We also believe we may have a major natural groundwater recharge area that may produce more than a sufficient amount of water for future uses. Your rules may not allow the certificated water company to even explore the idea, although the watershed is totally landlocked and prohibited from being inhabited in that it is a federal natural resource area. The rule a water company official has stated to us is a new well cannot now be established further than 300 feet from an existing water service line, even though the area is in the certificated service area. Apache Junction, having incorporated in November 1978, is a small , but growing, community. It has hopes of diversifying its tax base to afford the local services it must now provide. Retiring agricultural groundwater for other growth is not possible for Apache Junction. The current code and proposed rules would mean no growth and no industrial development for Apache Junction, while other areas could continue growth and development by retiring agricultural land. For large cities, any increase in water consumption by a new user would be only a small percent of an already large consumption of water. In a small city having a small total volume of water consumption, any increase may raise the per capita limit. Under this scenario, small cities lose; large cities win. Under this scenario, agricultural communities that can reduce agricultural drawdown on water win; non-agricultural communities lose. We also have concerns for how the management program will reduce water consumption for landscaping on freeways and state highways. Certain areas have a high consumption because they have the money to pay for the water. In Apache Junction, the reduced water demands reflect limited incomes in many instances, Robin Salem Stinnett September 10, 1982 Page Three coupled with one of the highest water rates in the state. Conservation should focus in the larger cities where the real waste occurs. The rules are clearly inequitable when one city provides water and service and another does not, yet there is a presumption the governmental unit can be coerced into signing future CAP contracts. In the one providing water, subdivisions can continue to proceed, while in the other the contract must first be signed, is clearly applying different rules to cities having different water producers. The fact that one community may have a watershed that drains directly into its water source, but cannot investigate the potential when there is a stated water shortage is unconscionably unreasonable. The assumption that all water resources lie in well-defined aquifers may not apply in all circumstances, particularly with regard to cities like Apache Junction which is in a geologic region that may have fractured geologic faults. In addition, communities where performance zoning is in use are being identified. To date, there appear to be communities in three states (Pennsylvania, Colorado, and Oregon where performance zoning is in use. We have requested ordinances from several of these communities. I have talked to persons in two agencies using performance zoning. Fort Collins, Colorado, has received national attention for the excellence of land use that is occurring there with performance zoning. Their staff in- dicated, however, that the zoning ordinance is still changing to meet new needs. In Bucks County, Pennsylvania, a number of communities are using performance zoning. The county planner indicated a good feeling for the technique. This is the area in which Lane Kendig apparently did his initial work. When the materials arrive, staff will evaluate them as a possibility to be used here. At this time, I am not sure of the specific adaptability of performance zoning to Apache Junction. In many cited examples, the evalu- ation is for large tract development, leaving much open space. With the patent easements, this may be difficult. On the other hand, with washes and topographic problems and a desire for more freedom in zoning, performance zoning may be a great tool . As soon as staff has completed its review, a report will be made to the City Council and Planning and Zoning Commission.
