December 20, 1978
ATTENDANCE:
Meeting opened at 7:00 p.m. with the Pledge of Allegiance and
reading of the minutes by Councilmembers.Minutes were approved
as read.Motion by John Granillo, seconded by Thomas Damiano.
All seven council members were present.A short presentation by
Jim Thorpe of First National Bank followed.Mr. Thorpe gave a
brief description of services his bank could provide the city.
PLANNING AND ZONING -STUDY REQUESTED- COMPLETED:
C.T. Parks, South Cedar St., Apache Junction, has sent a letter
requesting completion of a study begun by Pinal County Planning
and Zoning on Broadway Rd. from Meridian to Ironwood and Univ-
ersity from Meridian to State Route 88.Thomas Damiano moved to
allow completion, which the County halted when the City incor-
porated, subject to final approval by City Council.John Granillo
seconded the motion, which was carried with 5 votes, council
members Roy Hudson and Vinton Peck abstaining.
APPLICATION FOR ORIGINAL LIQUOR LICENSE:
Application for original liquor license, #16, from Edward G.
Hazdra for Pirates Cove, Inc.Vinton Peck moved to refer the
application to Thomas Damianols committee for investigation.
Marie Shanks seconded, and the motion was carried.Twenty day
notice of public hearing will be placed by the Clerk.
LOST DUCHMAN DAYS PARADE ROUTE:
A letter from Ross Greves was read to the Council requesting
closure of Meridian Rd. from Apache Trail to Teepee Rd. and Supt.
Blvd. from Meridian to Idaho for the Lost Duchman Days parade
on Saturday, January 27,1979,from 8:00 a.m. until the end of
the parade.Thomas Damiano moved to approve the request, and
Jerry Burgess seconded and the motion was carried.
NOTIFICATION OF VIOLATION OF ZONING:
A copy of a letter to George Lipovic from Pinal County Planning
and Zoning has been received, advising Mr. Lipovic that he is in
violation of zoning ordinance.Vinton Peck moved the matter be
referred to Thomas Damianots committee.John Granillo seconded
the motion, which was carried.Thomas Damianols committee will
tall; to Mr. Lipovic, but has no ordinance to enforce, so can only
talk with Mr. Lipovic and try to offer advice.
REQUEST FOR ABANDONMENT OF ROADWAY EASEMENT:
Request for abandonment of roadway easement from R.S. Minnick
received for roadway easement.Virginia Seeman moved to refer
to Vinton Peck's committee for investigation.Marie Shanks
seconded and the motion was carried.

COMMITTEE REPORT -INSURANCE. BUDGET AND FINANCE -John Granillo:
O'Donnell Agency reinforced that they are strictly advisory
to clarify their connection with the City Council.Quotes on
Liability and Errors and Omissions still pending.Mike Curtis)
advisor from legal firm Curtis, Martinez, and Goodwin, advises
purchase of coverage ASAP, and advises hiring full-time attor-
ney in about six months.John Granillo asked the represent-
atives of O'Donnell Agency if short term coverage was avail-
able, and was advised that INA would bind coverage for seven
days, for a binder fee of not to exceed $50.00.John Granillo
moved that the coverage and $30.00 cost be accepted, to be
paid when funds were available, and motion was seconded by
Thomas Damiano.Vinton Peck added to the motion an amendment
making coverage effective immediately.The amendment was ac-
cepted.Motion was carried with five votes in favor. Two
opposed.
COMMITTEE REPORT -POLICIES AND RECORDS -Marie Shanks:
Marie Shanks has contacted the office in Washington, D.C. re-
garding the census and advised that the application be sent
in by January 1, 1979,so that the census can be taken.
PLANNING. ZONING AND LICENSE:Thomas Damiano:
Richard Damiano reported for Thomas Damiano that he (Richard)
attended the hearing in Florence at 1:30 p.m. on December 20,
1978 regarding approval or disapproval of applications pend-
ing.The county has final say over zoning, but will refer all
zoning matters in Apache Junction to the City Council.
Thomas Damiano made a motion to approve request for abandonment
of Hale Street south of Huff's Trailer Park.Herschel Wilson
submitted this to the Pinal County Planning and Zoning Com-
mission on December 6, 1978.Since the area has not been ,
touched by the county since the owners gave it to them, Vinton
Peck opposed the motion, because he is negotiating right-of-
ways in several areas.Thomas Damiano withdrew the motion to
approve and moved that a 14 day notice of hearing be published,
and the matter tabled until January 17, 1979 at the regular
meeting.Jerry Burgess seconded, and the motion was carried.
Request for change of zoning was made by David Walker for the
area north of the post office to be developed into a travel
trailer resort.Present zoning is GU --he requests CB -2 and TH.
Thomas Damiano moved to publish the 14 day notice of hearing.
Vinton Peck reported he had met with David Walker and found a
drainage problem (being corrected), and he reported Mr. Walker
has accepted a proposal to re -open Virginia Street, and also
that Mr. Walker agreed that Ness Blvd. may be vital to devel-
opment of the city.Vinton Peck seconded Thomas Damiano's
motion, noting he opposes abandonment of Ness Blvd.Motion
carried.

PARKS AND RECREATION -Jerry Burgess:
Jerry Burgess reported he has been meeting with residents for
input.David Walker has offered his help and has offered to
open recreational facilities in New Life Trailer Resort to the
public.
STREETS AND RIGHT -OF -WAY -Vinton Peck:
Vinton Peck reported he has contacted Mr. Anderson of the Grey-
hound Racing Track in Apache Junction in an effort to open a
right-of-way south of the Dog Track and Mr. Peck is trying to
open several arteries and right-of-ways.
CLERICAL. PERSONNEL AND EMPLOYEES -Roy Hudson:
No report was given, but Mr. Hudson asked for volunteers to
answer phones and keep the office open.
CETA POSITIONS APPLIED FOR:
Deadline for applications for CETA personnel is in January of
1979.If positions are granted, they can be turned down, so
Thomas Damiano moved to apply for three CETA positions.Jerry
Burgess seconded.Motion carried.
ELECTION OPERATIONAL PROCEDURES ADOPTED:
Ordinance #3, Elections and Operational Procedures, which had
been tabled from 12-13-78 meeting, was reviewed.Vinton Peck
moved to adopt ordinance #3.Jerry Burgess seconded and the
motion carried.
PLACES WHERE POSTINGS WILL BE MADE ESTABLISHED:
John Granillo moved that special meetings will be posted 24
hours prior to the special meeting at the Pinal County Health
Services Building,U.S.Post Office in Apache Junction and
Bayless Market in Apache Junction and at such other places as
may be required to be in compliance with AZ Open Meeting Law.
Vinton Peck seconded and motion carried.All other postings
to be made at the same three places.
MAGISTRATE NEGOTIATIONS WITH J.P. PERCY DAVIS:
Bill McDaniel reported that Percy Davis will negotiate with
council members for magistrate.
1% CITY SALES TAX--PROSPOSED AND TABLED:
A copy of an ordinance adopted by another City in Arizona

that effects a 1% City Sales Tax was obtained by John Granillo,
and he moved that the council adopt the ordinance with changes
that apply to Apache Junction.Motion withdrawn until copies
can be furnished to the other council members.
MOTIONS FOR ESTABLISHMENT OF SOME REGULAR POLICIES
MADE AND CARRIED:
Virginia Seeman moved that all votes be made with voice votes
by roll call.Marie Shanks seconded and motion carried with all
members voting aye.
Virginia Seeman moved that before any official action is taken
on any area in which a council member has been designated that
this council member will have priority on presentation of said
subject before any motion, proclamation or declaration is made.
Marie Shanks seconded, and motion carried unanimously.
Virginia Seeman moved that the agenda for each meeting be pre-
sented to each council member at least 3 days in advance of the
meeting date, and also that each council member be presented a
copy of the minutes of each and every meeting for their files.
Vinton Peck amended that motion, adding that only agenda items
should be discussed unless unanimous vote of the council approves
the item for emergency consideration.The vote on the amend-
ment to Virginia Seeman's motion was six ayes and one no, with
Roy Hudson voting no.The vote on the motion as amended was
six ayes, one no (Roy Hudson voting no).Virginia Seeman and
Marie Shanks were then appointed by Mayor Hudson to a committee
to help prepare the agenda.
MEETING WITH JAMES KARAM TO ESTABLISH PLANNING AND ZONING GUIDES:
Vinton Peck and Richard Damiano will arrange a meeting with
James Karam to try to establish some planning and zoning
guidelines.
BINGO LICENSE APPROVED:
Marie Shanks made a motion to approve and send on to the State an
application for Bingo License from Edward Donche of Roundup
Mobile Home Park.Virginia Seeman seconded, and motion carried
unanimously.
ADJOURNMENT:
Meeting adjourned at 10:50 p.m.
Approved this day of 1979 by the Mayor and City
Council.
