ATTENDANCE:
The Regular Meeting of the City Council of the City of Apache
Junction was called to order by Mayor Hudson at 7:05 p.m. on
January 17, 1979 at the Pinal County services Building in Apache
Junction.The Acting City Clerk called the role. The following
Council members were present: Roy Hudson, John Granillo, Virginia
Seeman, Marie Shanks, Jerry Burgess, Vinton Peck, and Thomas
Damiano.
APPROVAL OF MINUTES:
Discussion was held on the Minutes of the meeting of December
27, 1978, January 3, 1979, and January 10, 1979. Motion by
Council member Seeman, seconded by Council member Burgess to
defer consideration of the minutes until January 24.Motion
carried unanimously.
COMMITTEE REPORTS:
Personnel:
Mayor Hudson reported that the applications for employment with
the City of Apache Junction would be reviewed and that some of
the applicants would be interviewed on Friday.
Taxation:
Vice -Mayor Granillo reported that public hearings on the pro-
posed Transaction Privilege Tax will be held January 24, 1979
and January 31, 1979.
Parks and Recreation:
Council member Burgess reported on a meeting which he had with
members of the community with respect to future planning for
Parks and Recreation facilities for the City.Council member
Burgess felt the meeting was successful in getting community input
Streets and Right -of -Ways:
Council member Peck reported that he and some other citizens had
inspected various areas of the City with drainage problems.Of
particular concern were drainage problems created by the Lost
Duchman's Trailer Park on Superstition Drive. Motion by Council
member Peck, seconded by Council member Burgess, that the City
Council contact the Pinal County Engineer to attempt to find a
solution to the drainage problem on Superstition Drive. Motion
carried unanimously. It was suggested that at some future time
the City hire a City Engineer to approve plans before permits
for trailer parks and other building permits are issued.
Police and Fire:
Concil member Seeman made no report at this time.

Planning and Zoningt
Council member Damiano requested that Mr. Parks report on his
attendance at a meeting of the Pinal County Planning and Zoning
Board held in Florence, Arizona. Mr. Parks reported that with
respect to an application by Mr. Walker, the County Planning and
Zoning Board had recommended to the Board of Supervisors that the
matter be continued until the City of Apache Junction could make
a recommendation, and that the recommendation will be forth-
coming after January 17, 1979. Mr. Walker had requested post-
ponement of consideration of his application, and the County
postponed the matter indefinitely.
Mr. Parks reported on the application of Mr. Green for rezoning
of 160 acres, 10 acres to be CB -1 and 150 acres to be CR-1.Plans
include 147 lots at 20,000 square feet per lot. The Pinal County
Planning and Zoning Board recommended approval of the zoning
change with certain further modifications with respect to plans
for Mountain View Drive.
Mr. Parks reported that the application of Mr. Barocco for CB -2
zoning was discussed and that the Pinal County Planning and
Zoning Board recommended that the application be denied.
Mr. Parks further reported that the application of Mr. Wilson
for a zoning change to CB -2 zoning was discussed and the Pinal
County Planning and Zoning Board denied the application.
Council member Damian() made no report with respect to Business
License Schedule.
Policies and Reports:
Council member Shanks reported that based on a population estimate
of 6,500 people, the U.S.Census Bureau had advised her that the
cost for doing a census for the City would be $3,800 and that the
Census Bureau requires $2,605 immediately in order to begin the
census on time. The deadline for this is April 1, 1979. Motion
by Council member Shanks, seconded by Council member Seeman to
appropriate the funds to be paid to the Census Bureau.Motion
carried unanimously.
UNFINISHED BUSINESS:
There was no unfinished business.
ORDERS OF THE DAY:
Correspondence:
The Acting Clerk reported that there was correspondence requiring
Council attention.

Public Hearing:
Request for abandonment of Hale Street (aka Delaware).
Mr. Parks presented a hand -drawn map of the area showing gen-
erally the geographical situation. The question before the City
Coucil was whether to abandon one-half of a right-of-way on Hale
Street, which right-of-way had been dedicated by the original
subdivider but had never been officially accepted by the County.
Motion by Council member Peck, seconded by Mayor Hudson that the
City Council recommend to the Pinal County Board of Supervisors
that the request for the abandonment of the right-of-way be
denied.Motion carried, with Council members Damiano and Shanks
abstaining, Council members Seeman and Burgess Voting against,
and Council members Granillo, Hudson and Peck voting in favor
of the motion.
PUBLIC HEARING:Pirates Cove
Discussion was had with respect to the Pinal County Board of
Supervisors by the Pirates Cove for approval of a liquor license.
No one from the Pirates Cove was present. Motion by Council
memberDamiano, seconded by Council member Seeman that the City
Council send a letter to the Pinal County Board of Supervisors
recommending approval of the request for the new issue liquor
license. Motion carried unanimously.
PUBLIC HEARING: Green -Gonzales Application for Re -zoning
Motion by Council member Damiano, seconded by Council member
Seeman to notify the Pinal County Board of Supervisors that the
City of Apache Junctbn has no objection to the re -zoning plan
presented by Green -Gonzales but that the City Council would like
an opportunity to review final plans submitted by the applicant.
Motion carried unanimously.
PUBLIC HEARING: Application of Walker
The Pinal County Planning and Zoning Board postponed action on
this matter indefinitely. Mr. Walker, is going to submit new plans.
PUBLIC HEARING: Application of Barocco.
Mr. Barocco requested that his property be rezoned to CB -2.Council
member Damino's committee had reviewed the application and recom-
mended that it be denied. Mr. Barocco made a presentation explain-
ing why he requires CB -2 zoning instead of CB -1 zoning. After an
extensive discussion, motion was made by Council member Damiano,
seconded by Council member Shanks that the City Council recommend
to Pinal County Board of Supervisors that the application of Mr.
Barocco for CB -2 be denied, but that the City Council recommends
consideration of CB -1 zoning.Motion carried unanimously.

PUBLIC HEARING: Application for Wilson.
Mr. Wilson's son reported that the Pinal County Planning and
Zoning Board had recommended that the area not be rezoned to CB -2.
He requested that the City Council recommend to the County Planning
and Zoning Board that the area be rezoned to CB -1, which zoning will
include retail stores.After extensive public discussion motion
was made by Council member Damiano, seconded by Council member
Seeman to notify the County Planning and Zoning Board that the
City Council concurs with the decision to reject the application
for CB -2 zoning but that it recommends the application be con-
sidered for CB -1 zoning.Motion carried unanimously.'
NEW BUSINESS:
Council member Granillo introduced Susan D. Goodwin of the Law
Firm of Martinez, Curtis, Goodwin, and Karasek.
ANNOUNCEMENTS: Transaction Privilege Tax:
Mr. Granillo reported that a Public Hearing will be held on the
proposed Transaction Privilege Tax on January 24 and January 31,
1979 at 7:00 p.m. at the Pinal County Services Building.
ELECTIONS:
It was announced that Nomination Petitions for the City Elections
should be delivered to the Pinal County Sheriff's Office.Council
member Shanks distributed forms for candidate expense disclosure.
She reported that the forms had to be completed prior to the
election.It was announced that the primary election will be held
on March 27,1979 and the general election will be held on May
15, 1979.Council member Shanks will, upon request, make avail-
able for public inspection any petitions received.
MEETING:
Council member Shanks was directed by the City Council to locate
another room in which to hold public meetings and public hearings
for the reason that the present building cannot accomodate all
who attend.
Meeting adjourned at 10:15 p.m.
