March 7, 1979
A Regular Meeting of the City Council of Apache Junction was held on the 7th day
of March, 1979 at the Apache Junction City Hall pursuant to the notice as required
by law.
The meeting was called to order at 7:00 P.M.by Mayor Roy Hudson.
The Pledge of Allegiance was lead by Vice -Mayor John Granillo.
Councilmembers Present:
Mayor Roy Hudson;vice -Mayor John qranillo,Jerry Burgess;Thomas Damiano;Vinton
Peck;Virginia Seeman; and Marie Shanks (Marie Shanks arrived late).
Staff Present:
Susan Goodwin and Michael Curtis,City Attorneys;Isabel C.Ballard,City Clerk.
Approval of Minutes:
Mayor Hudson asked for any corrections and/or additions to the February 21st meeting
and i f there isn't any,then a motion to approve the minutes.A motion was made
by John Granillo to approve the minutes of February 21st,1979 as reported and sec-
onded by Jerry Burgess.Motion carried unanimously.
Committee Reports and Recommedations
Planning and Zoning and Licenses by Thomas Damiano:A motion was made by Thomas
Damiano that the City Council recommend to the County Planning and Zoning Commission
of Pinal County,that the Commission approve the subdivision plans for Apache Villa
#4,and that the Mayor be instructed to communicate the Council's recommendation
to the County Planning and Zoning Commission of Pinal County,and seconded by JohnGranillo.The motion was discussed and Vinton Peck made a substitute motion that
the City Council recommend to the County Planning and Zoning Commission of Pinal
County that the Commission approve the Subdivision plan for Apache Villa #4,con-tingent upon changes in the plan which would be required to assure that SaguaroStreetwouldremainathroughstreetandthatthe Mayor be instructed to communicate
the Council's recommendation to the County Planning and Zoning Commission of Pinal
County,and seconded by Jerry Burgess.The substitute motion was discussed at
great lengths.One (1)voted yes -Vinton Peck.Five (5)voted no -Thomas Damiano,
Jerry Burgess,John Granillo,Virginia •Seeman and Mayor Hudson. (Absent -Marie
Shanks).Motion failed.
A substitute motion was made by Vinton Peck to postpone and set for a public hearing
and reconsider the matter of Apache Villa #4.Motion died for lack of a second
to the motion.
A substitute motion was made to table until Marie Shanks is present.Motion died
for lack of a second to the motion.
Mayor Hudson opened the discussion on the orginal motion made by Thomas Damiano
That the City Council recommend to the County Planning and Zoning Commission of
Pinal County that the Commission approve the subdivision plans for Apahce Villa
#4 and the Mayor be instructed to communicate the Council's i-ecommendation to the

County and Planning and Zoning Commission of Pinal County,which was seconded by JohnGranillo-Five (5)voted yes -Thomas Damiano,Jerry Burgess,John Granillo,Virginia Seeman, and Mayor Hudson.One (1)voted no -Vinton Peck. (Absent
Marie Shanks).Motion carried.
Thomas Damiano read request No. PZ 564-79 Christie J. Oakes,section 21,T-INR-8E
to expand his mobile home park and made a motion to recommend to the Planning and
Zoning that the Commission approves the request and seconded by John Granillo.
After discussion on the motion a substitue motion was made by Vinton Peck that the
three items before the Council for recommendation of action to the Pinal County
Planning and Zoning be postponed until next Wednesday at a work session of that
date to be re -noticed as a public meeting for official action and seconded byVirginisSeeman.Motion carried unanimously.
Police and Fire -Virginia Seeman:No report
Streets and Rights -of -ways:Vinton Peck reported on the request by Sam King onhispetitionforpayment of his street.In speaking to the County officials they
are willing to do the labor provided that the people on that street pay for the
materials.
Parks and Recreation:Jerry Burgess reported on a Basketball Tournament in order
to raise money to be able to send some kids to camp.Twenty-four teams have reg-istered at a $20.00 entry fee.The Tournament starts Tuesday and will be completed
by next Saturday.
Finance:Vice -Mayor John Granillo read the end of February Financial Report,and
the bills paid for February and through March 5, 1979.A motion was made by John
Granillo to approve the expenses through March 5, 1979 as reported and seconded
by Jerry Burgess.Motion carried unanimously.
Officers:Mayor Hudson reported that he would like to start a Planning and Zoning
Advisory Board and made motion that there be appointed by the Mayor a Planning
Agency which shall act as an advisory committee to the City Council,and whose
purpose shll be to assist the City Council in the drafting of Planning and Zoning
Ordinances for consideration by the Council and to make recommendations to the
Council for same, and to review proposed structures for a Planning and Zoning Com-
mission.After a lengthy discussion on the motion five (5)voted yes -Thomas
Damiano,Jerry Burgess,John Granillo,Vinton Peck and Mayor Hudson.One (1)voted
no -Marie Shanks and one (1)abstained -Virginia Seeman.Motion carried.
Mayor Hudson appointed to the Planning and Zoning Advisory Committee the following
persons:Clay Worst,Bill Wright,F. R. Formess,Bill McDaniel and Neil Barwick.
Policies and Records:Marie Shanks reported that Bill Adams called from the Bureau
of the Census. They are going to start at the end of the month.They will be
sending Isabel some applications soon.
Mayor Hudson announced that there will be an executive session of the City Council
to discuss employees prior to the City Council meeting on March 14th at 7:00 p.m.
and formal notice will be posted.The City Council agreed unanimously.

Unfinished Business:Vinton Peck brought up the Commemorative coin on the Incorp-
oration of Apache Junction and made a motion and seconded by Thomas Damiano to
adopt the following:
Resolution No.79-11
WHEREAS the City of Apache Junction has recently been incorporated and
WHEREAS the creation of a suitable symbol to commemorate the birth of the City is
in furtherance of the stature and community relations of the City,and
WHEREAS the Apache Junction Lions Club,a non-profit corporation,as recognized
by the National Lions Club Organization has designed a commemorative coin
series celebrating the City's incorporation and intends to merchandise the
same and apply all proceeds above the cost of manufacturing to the benefit
of the blind of this area,and
WHEREAS the efforts of this organization on behalf of the blind and in furtherance
of the public relations of the City will be enhanced i f the coin series is
adopted by the City as its official commemorative coin.
NOW THEREFORE BE IT RESOLVED that the City of Apache Junction adopts as its officialIncorporationCommemorativeCoin,the Series of Coins designed by the Apache
Junction Lions Club and labeled as "The City of Apache Junction Incorporation
Commemorative Coin Series".
FURTHER RESOLVED that no approval of the merchandising is authorized,nor is the
Lions Club authorized to advertise that the City has taken any act other than
to adopt the Coin Series as the Incorporation Commemorative Coin Series.

Council Action:
The Code of the City of Apache Junction,Arizona -Administration:A motion was
made by Marie Shanks that the City Council adopt Resolution No.79-7,declaring
as a public record the document entitled "The Code of the City of Apache Junction,
Arizona -Administration"and declaring an emergency and seconded by John Granillo.
Six (6)voted yes -Marie Shanks,Thomas Damiano,Jerry Burgess,Vinton Peck, JohnGranillo,and Mayor Hudson.One (1)abstained -Virginia Seeman.Motion carried.
A motion was made by Marie Shanks that the City Council adopt Ordinance No. 5
adopting "The Code of the City of Apache Junction,Arizone -Administration"by

by Marie Shanks that the City Council adopt Resolution No.79-8,declaring as apublicrecord the document entitled "The Code of the City of Apache Junction,
Arizona -Magistrate"and declaring an emergency,and seconded by Thomas Damiano.
Six (6)voted yes -Marie Shanks,Thomas Damiano,Jerry Burgess,John Granillo,
Vinton Peck and Mayor Hudson.One (1)abstained -Virginia Seeman.Motion carried.

A motion was made by Marie Shanks that the City Council adopt Ordinance No.6
adopting "The Code of the City of Apache Junction,Arizona --Magistrate"by
reference and declaring an emergency and seconded by Jerry Burgess.Six (6)
Noted yes;Marie Shanks,Thomas Damiano,Jerry Burgess,John Granillo,Vinton
Peck and Mayor Hudson.One (1) abstained,Virginia Seeman.Motion carried.
Contract with Pinal County Recorder: A motion was made by Marie Shanks that
the City Council adopt Resolution No. 79-9 authorizing and directing the Mayor
to enter into a contract with the County Recorder for use by the City,the
County vote lists,and seconded by Vinton Peck.Motion carried unanimously.
Primary Election and Election Board:A motion was made by Marie Shanks that
the City Council adopt Resolution No.79-10,authorizing the holding of the
Regular Primary Election on March 27, 1979 and seconded by John Granillo.
Motion carried unanimously.(Election Board to be appointed at Special Meeting March 21,1979)
Planning and Zoning: A motion was made by Vinton Peck to reconsider the Council
action on Apache Villa #4 for the purpose of receiving public discussion and
allowing Councilwoman Shanks to vote,and seconded by Marie Shanks. John
Granillo made an amendment to the motion to read as follows:To reconsider the
Council action on Apache Villa #4 for the purpose of receiving discussion from
persons requesting to speak on the agenda item and Councilwoman Shanks to vote
and seconded by Virginia Seeman.Six (6)voted yes;Marie Shanks,Thomas Damiano,
John Granillo,Virginia Seeman,Vinton and Peck and Mayor Hudson. One(1) voted
no;Jerry Burgess.Motion carried on the amendment. Vote on the amended motion
was six (6)yes;Marie Shanks,Thomas Damiano, John Granillo,Virginia Seeman,
Vinton Peck and Mayor Hudson.One (1)voted no;Jerry Burgess. Motion carried.
Now before the Council is the original motion made by Thomas Damiano that the
City_Council recommend to the County Planning and Zoning Commission,that the
Commission approve the subdivision plans for Apache Villa #4 and that the Mayor
be instructed to communicate the Council's recommendation to the County Planning
and Zoning Commission of Pinal County and was seconded by John Granillo.Four
(4)voted yes;Thomas Damiano,Jerry Burgess,John Granillo and Mayor Hudson.
Two (2)voted no;Marie Shanks and Vinton Peck.One (1)abstained;Virginia
Seeman.Motion Carried.
Variance Request:Council discussed on the variance request by Mrs.Katie
Merryman.A motion was made by Thomas Damian()that the City Council approve Katie
Merryman's application subject to the recommendation and i f approved that it be
recorded and seconded by Vinton Peck.Six(6)voted yes;Marie Shanks,Thomas
Damiano,Jerry Burgess,John Granillo,Vinton Peck,and Mayor Hudson.One (1)
abstained;Virginia Seeman.Motion carried.
Liquor LIcenses:
Superstition Skies:Frank Reed Sr.has been posted as pursuant to law.A
motion was made by Marie Shanks to recommend approval and seconded by JohnGranillo.Motion carried unanimously.

Sundancer Restaurant:Mr.and Mrs.George Pippet and has been posted pursuant
to law.A motion was made by Marie Shanks to recommend approval and seconded
by John Granillo.Motion carried unanimously.
Skaggs:Marie Shanks reported that Skaggs had been approved previously but
Isabel Ballard couldn't find it in the minutes.A motion was made to recommend
approval and seconded by John Granillo.Motion carried unanimously.
Office Machines:
Mayor Hudson reported he checked with the State on the typewriters and they will
be ready by Friday if someone can pick them up then or by the first of the week.
Copy Machine:Isabel Ballard reported on the bids she received on the copiers.
The Council discussed the copier and directed Isabel Ballard to make a recom-
mendation for the next Council meeting.
Council Meeting Procedures: A motion was made by Virginia Seeman that the City
Council adopt Resolution No.79-12, Council Meeting Procedures for the orderly
conduct of business of the City Council sof Apache Junction and was seconded by
John Granillo.Mike Curtis read the full Resolution.Six (6)voted yes;Thomas
Damiano,Jerry Burgess,John Granillo,Virginia Seeman,Vinton Peck and Mayor
Hudson.One (1)abstained;Marie Shanks.Motion carried.
Hospital Location:No action was taken.
Sales Tax Schedule for City businesses:A motion was made by Vinton Peck tofurnishbusinesseswithanew5%sales tax schedule to every business that buys
a City license.Motion died to lack of second.
City Stationary:Isabel Ballard requested the Council approve a stationary for
the City of Apache Junction.Virginia Seeman suggested to put City of Apache
Junction,P.O.Box K, Apache Junction,Ariz.85220,for now until the seal is .
designed and would be incorporated on the letter head.John Granillo further
suggested to have the Mayor's and Clerk's names on the letter head.Mayor HudsoninstructedIsabelC.Ballard to design it and present it to the City Council next
week for approval.Council agreed.
Announcements:
John Granillo announced that he will miss the next three meetings.He won't beavailableuntilthefirstweekinApril.
Input from the Floor:
Doris Mathews asked what time public meeting will start since the executive
meeting starts at 7:00 p.m. Mayor Hudson replied that he expects the executive
meeting to last about fifteen minutes so the Special Meeting should start at 7:15 p.m.
A woman from the audience asked Mr.Peck i f the Lions Club was going to donate a
seal for a new city hall which is being planned for the future.

Norman Martin said John Basic called him tonight and they would like to know how
the Council stands on the canal closing baseline.Mayor Hudson informed Mr.Martin that there is a meeting Thursday at 8:00 p.m. at the Baywood Trailer
Court if he would like to attend.
Adiournment:
A motion was made by Thomas Damiano to adjourn and seconded by John Granillo.
Motion carried unanimously.
