HomeMy WebLinkAboutORD84ORDINANCE NO.84 AN ORDINANCE OF THE CITY OF APACHE JUNCTION,ARIZONA, AMENDING CHAPTER 2 OF THE CITY CODE. BY ADDING ARTICLE 2-10 ESTABLISHING THE APACHE JUNCTION COMMUNITY HEALTH COMMISSION,PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES,AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY AS FOLLOWS: SECTION 1 ARTICLE 2-10 --COMMUNITY HEALTH COMMISSION 2-10-1 Creation 2-10-2 Membership and Terms of Office 2-10-3 Compensation and Expenses 2-10-4 Officers 2-10-5 Duties 2-10-6 Meetings 2-10-7 Vacancies 2-10-8 Removal of Members OF APACHE Section 2-10-1 Creation The Community Health Commission of the City of Apache Junction, Arizona,is hereby created. Section 2-10-2 Membership and Terms of Office A.The Community Health Commission shall consist of seven (7) members who shall be appointed by the Mayor and approved by the City Council. One Commissioner shall be a member of the City Council. B.The appointments shall be for three (3)years each with the terms of members so staggered that the term of office of no more than two (2) members shall expire in any one year.The initial appointments of members shall be for two (2)members with terms beginning upon their appointment and expiring March 1,1981,two (2)members with terms beginning upon their appointment and expiring March 1,1982;one (1)member with a one-year term beginning upon his appointment and expiring March 1,1983.Thereafter,they shall all serve for a term of three (3)years or until their successors are duly appointed and qualified.Honorary members shall serve for a term not to exceed one (1)year. C.All members shall be residents of the City of Apache Junction except as otherwise provided for ex -officio members. Section 2-10-3 Compensation and Expenses The members of the Community Health Commission shall receive no salaries or other remuneration for their services in such capacity,and shall not be entitled to personal expenses incurred by them in the discharge of their official duties,except to the extent and purposes and amount such expense is first authorized and approved in advance by City Council: Section 2-10-4 Officers JUNCTION The Commission shall elect a Vice Chairman and Secretary from its members to serve for a period of one (1)year.The City Council member appointed to the Commission shall serve as its Chairman.The Vice Chairman shall preside at the meetings in the absence of the Chairman. ORDINANCE NO.84 PAGE ONE OF THREE Section 2-10-5 Duties There is hereby vested in the City of Apache Junction Community Health Commission the following duties: A.To hold public hearings to determine public health needs. B.To insure the development of community health care for all individuals with a minimum of interference from outside services. C.To review and recommend to the City Council approval/disapproval of any health care system originating outside the corporate limits and operating within the corporate limits. D.To aid in the development of health facilities and to attempt to locate and coordinate community needs with medical professionals in desired fields. E.To address methods of transportation and health care for the elderly. F.To present a hospital development plan to the responsible agencies,coordinate with City staff to insure its proper planning and zoning. Section 2-10-6 Meetings The Commission shall establish,as its regular meeting date,the second Thursday of each month at 7:00 p.m.in the City Council Chambers, 1001 N.Idaho Road.Special meetings may be called by the Chairman or at the request of a majority of Commission members.A quorum shall consist of four (4)voting members for the transaction of all business. Section 2-10-7 Vacancies Vacancies shall be filled in accordance with Section 2-10-2 by the City Council for the unexpired term of the member affected. Section 2-10-8 Removal -of Members Members of the Commission serve at the pleasure of the Council and may be removed by the Mayor with the concurrence of the Council.A member shall not be absent from the Commission's meetings for more than three (3) consecutive meetings,the remaining members of the Commission shall vote to retain or recommend to the City Council that the absentee member be relieved of his duties on the Commission. SECTION 2 REPEAL OF CONFLICTING ORDINANCES All ordinances and parts of Ordinances in conflict with the provisions of this ordinance or any part of the Code adopted herein by reference are hereby repealed. SECTION 3 SEVERABILITY If any section,subsection,sentence,clause,phrase,or portion of this ordinance or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
