HomeMy WebLinkAboutORD15ORDINANCE NO. 15 AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA AMENDING CHAPTER 2 BY ADDING ARTICLE 2-6 ESTABLISHING A BOARD OF THERAPY EXAMINERS AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA AS FOLLOWS: SECTION I: Article 2-6 Board of Therapy Examiners A Board of Therapy Examiners of the City of Apache Junction, Arizona is hereby created, and shall meet not less than once a year or when requested by the Chief of Police, the City Manager or the City Council. Section 2-6-1 Membership The Board of Therapy Examiners shall consist of three (3) resident citizens of the City, who shall be appointed by the Mayor with the consent of the Council and shall serve without pay.The normal terms of office of the Commission shall be three (3) year staggered terms.The initial appointment shall be one (1) member for three (3) years, one (1) member for two (2) years and one (1) member for one (1) year.Members serve at the pleasure of the Council and shall select their own Chairman. The Chief of Police shall be an exofficio member of this Board. Section 2-6-2 Duties Examiners shall meet not less than once a year and whenever requested by the Chief of Police, or the Council, or the City Manager. The Chairman of the Board of Therapy Examiners shall within five (5) working days after receiving such request call a meeting of the Board to consider the business of the Board, including but not limited to applications for a City license for the operation of a Bathhouse, Massage Parlor or Therapy Center, or for the occupation of attendant at any such establishment, and if the applicant is found by the Board to be qualified, the Chairman shall so certify to the Chief of Police and the City Manager. Prior to certification of any applicant as the operator of a Bathhouse, Massage Parlor or Therapy Center, or as an attendant at any such establishment, the Board of Therapy Examiners shall determine that the applicant is a graduate of a recognized school of hydrotherapy, physical therapy or massage therapy; or has a valid certificate of registration issued by a bona fide nationally recognized massage therapy association. SECTION II If any section, subsection, sentence, clause, phrase or portion of this ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. SECTION III WHEREAS, it is necessary for the preservation of the peace, health and safety of the City of Apache Junction, Arizona, an emergency is declared to exist, and this ordinance shall become immediately operative and in force from and after the date of posting hereof. PASSED AND ADOPTED by the Mayor and Common Council of the City of Apache Junction, Arizona, this 7 11(day of 1/4-.;e7.44k,oci.e.4:-, 1979.
