AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA, EXTENDING AND
INCREASING THE CORPORATE LIMITS OF THE CITY OF APACHE JUNCTION INTO
MARICOPA COUNTY, STATE OF ARIZONA, PURSUANT TO THE PROVISIONS OF TITLE 9,
CHAPTER 4, ARTICLE 7, ARIZONA REVISED STATUTES AND AMENDMENTS THERETO, BY
ANNEXING THERETO CERTAIN TERRITORY PREVIOUSLY UNINCORPORATED AND CONTIGUOUS
TO THE EXISTING CITY LIMITS OF THE CITY OF APACHE JUNCTION, ARIZONA.
WHEREAS, a written petition has been presented to the Mayor and
City Council of the City of Apache Junction, Arizona, signed by the owners
of more than one-half in value of the real and personal property as would
be subject to taxation by the City of Apache Junction in the event of
annexation within the territory and land hereinafter described as shown by
the last assessment of said property, which said territory is contiguous to
the City of Apache Junction so as to embrace the same; and
WHEREAS, the Mayor and City Council of the City of Apache Junction,
Arizona, are desirous of complying with said petition and extending and
increasing the corporate limits of the City of Apache Junction to include
said territory; and
WHEREAS, the said petition sets forth a true and correct description
of all the exterior boundaries of the entire area proposed to be annexed to
the City of Apache Junction, and had attached thereto at all times an accurate
map of the territory desired to be annexed; and
WHEREAS, no additions or alterations increasing the territory sought
to be annexed have been made after the said petition has been signed by any
owner of real and/or personal property in such territory; and
WHEREAS, no deletions or alterations decreasing the territory
sought to be annexed have been made and therefore the territory to be annexed
is the territory hereinafter described; and
WHEREAS, proper and sufficient certification and proof of the fore-
going facts are now on file in the Office of the City Clerk of the City of
Apache Junction, Arizona, together with the original petition referred to
herein,
NOW,THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS:
SECTION I
That the following described territory be, and the same hereby is,
annexed to the City of Apache Junction, Arizona, and that the present -,corporate
limits be, and the same hereby are, extended and increased to include the
following described territory contiguous to the present City limits, to wit:
All that portion situate in Maricopa County, Arizona:
PARCEL NO.1:The South half of the East half of the Northeast quarter of
the Northeast quarter of Section Twenty-four (24), Township One (1) North.
Range Seven (7) East of the Gila and Salt River Base and Meridian.
PARCEL NO. 2:The North half of the East half of the Southeast quarter
of the Northeast quarter of Section twenty-four (24), Township One (1)
North, Range Seven (7) East of the Gila and Salt River Base and Meridian,
excepting the South 150 feet thereof.
PARCEL NO. 3:The West half of the following described property:
The South 305 feet of the Northeast quarter of the Northeast quarter of
the Northeast quarter of Section Twenty-four (24), Township One (1) North,
Range Seven (7) East of the Gila and Salt River Base and Meridian, Maricopa
County, Arizona, except the East 65 feet thereof.
PARCEL NO. 4:The South half of the east half of the Southeast quarter
of the Northeast quarter of Section Twenty-four (24), Township One (1)
North, Range Seven (7) East of the Gila and Salt River Base and Meridian,
and the South 150 feet of the North half of the East half of the Southeast
quarter of the Northeast quarter of Section Twenty-four (24), Township
One (1) North, Range Seven (7) East of the Gila and Salt River Base and
Meridian, Maricopa County, Arizona; EXCEPT the South 500 feet of said
Southeast quarter of the Northeast quarter; and EXCEPT the North 300 feet
of the South 800 feet of the East 300 feet of said Southeast quarter of
the Northeast quarter.
PARCEL NO. 5:The East half of the following described property:
The South 305 feet of the Northeast quarter of the Northeast quarter of
the Northeast quarter of Section Twenty-four (24), Township One (1) North,
Range Seven (7) East of the Gila and Salt River Base and Meridian, Maricopa
County, Arizona, except the east 65 feet thereof.
Being more particularly described as follows:
Beginning at the Northeast corner of Section Twenty-four (24) T.I.N., R.7 E.,
G.E.S.R.B.E.M. thence South 355.09 ft. to the true point of beginning thence
West 660.5 ft. thence South 1,785.04 ft., thence E. 361.3 ft. thence North
300 ft., thence E. 300 ft. thence North 1,485.18 ft., to the true point of
beginning containing 25 acres, more or less.
SECTION 2
That a copy of this Ordinance, 'together with an accurate map of the
territory hereby annexed to the City of Apache Junction, certified by the
Mayor of said City, be forthwith filed and recorded in the Office of the
County Recorder of Maricopa County, Arizona.
SECTION 3
WHEREAS, A.R.S. Section 9-471 (D) requires that annexations
"shall become. final after the expiration of thirty days from the first
reading of the Ordinance annexing the territory, provided the annexation
ordinance has been finally adopted in accordance with procedures established
..... by local ordinances"
THEREFORE, this annexation shall become e
expiration of thirty days from the /42 -day of
the City Council passes this ordinance pursuant
